In this article, the place and the nature of an ethical dialogue that develops within Christian healthcare institutions in Flanders, Belgium is examined. More specifically, the question is asked how Christian healthcare institutions should position themselves ethically in a context of a pluralistic society. The profile developed by Caritas Catholica Flanders must take seriously not only the external pluralistic context of our society and the internal pluralistic worldviews by personnel/employees and patients, but also the inherent inspiration of a Christian healthcare (...) institution. There might not be a specific nano-ethics, but there definitely is an ethics of new & emerging science and technology (NEST), with characteristic tropes and patterns of moral argumentation. Ethical discussion in and around nanoscience and technology reflects such NEST-ethics. We offer an inventory of the arguments, and show patterns in their evolution, in arenas full of proponents and opponents. We also show that there are some nano-specific issues: in how size matters, and when agency (...) is delegated to smart devices. Our overall approach is a pragmatist ethics, and we conclude that struggle (and learning) might be more productive than models emphasizing consensus. (shrink)

Missing topics in the discussion, at least from the perspective of NEST-ethics, are second “level” arguments—those referring to techno-moral change connected to tissue engineering. Corporate/collective moral responsibility is a thorny topic in business ethics and this paper argues that this is due a number of unacknowledged and connected epistemic issues. Firstly, CSR, Corporate Citizenship and many other research streams that are based on the assumption of collective and/or corporate moral responsibility are not compatible with Kantian ethics, consequentialism, or virtue ethics because corporate/collective responsibility violates the axioms and central hypotheses of these research programmes. Secondly, in the absence of a sound theoretical (...) moral philosophical foundation, business ethicists have based their ideas on legal and political epistemologies, yet still claim to be ethics-based. Thirdly, research is often driven by an intention to prove that a specific social goal is right, not by open and critical inquiry. Finally, today, corporate/collective moral responsibility is widely accepted as the Truth as most researchers are unaware of any issues because they are untrained in philosophy. The paper identifies the confusion about the epistemic basis as a major impediment for delivering a thick concept of the role of corporations as moral agents. Thus, the paper does not argue against corporate or collective agency as such, but points out an obvious but forgotten paradox: corporate and collective personhood cannot, at the moment at least, be epistemologically grounded in the field in which business ethics claims to operate: moral philosophy. There is good reason to suppose that our best physical theories, quantum mechanics and special relativity, are false if taken together and literally. If they are in fact false, then how should they count as providing knowledge of the physical world? One might imagine that, while strictly false, our best physical theories are nevertheless in some sense probably approximately true. This paper presents a notion of local probable approximate truth in terms of descriptive nesting relations between current and subsequent theories. (...) A suggestion is made for representing iterated deontic modalities in stit theory, the “seeing-to-it-that” theory of agency. The formalization is such that normative sentences are represented as agentive sentences and therefore have history dependent truth conditions. In contrast to investigations in alethic modal logic, in the construction of systems of deontic logic little attention has been paid to the iteration... of the deontic modalities.

Defending Kant against the charge that his ethics is formalistic has prompted some prominent interpreters to stress the “humanity” formulation of the categorical imperative. In this paper I argue that this more sophisticated account of Kantian ethics generates a deeper and more philosophically interesting Hegelian criticism (located primarily in the Phenomenology of Spirit). Hegel’s claim that the moral worldview is rife with dialectical conflict serves as a criticism both of Kant’s conception of the moral self and of his (...) more basic assumptions about the proper philosophical reply to the challenges posed by dogmatism and skepticism. As I will argue, the moral worldview unselfconsciously preserves elements of dogmatism and skepticism, even as it claims to be self-critical. Burnout has important ramifications for employees and organizations and preventing burnout forms an ethical issue for managers. However, the role of the leader and especially the role of ethical aspects of leadership have received relatively little attention in relation to burnout to date. We conducted a survey among employees (N = 386) of a Dutch retail organization, nested in 122 teams with a leader. Our first contribution is that we empirically show the hypothesized opposing relationships of ethical and passive leadership (...) behavior with follower burnout. Furthermore, we examined two job characteristics as mechanisms that link these forms of leadership and burnout. Lastly, we show that the positive relationship of ethical leadership with burnout via role clarity (but not overload) is dependent on the degree of passive leadership the leader is perceived to display. Our results suggest that organizations should promote ethical leadership behaviors and limit passive leadership behaviors by stimulating leaders to be active in their role and use their social influence to promote ethical conduct. Great Britain subjugated colonists using various power strategies, including dehumanization, misinformation, fear, and other divisive strategies. The Founders described these oppressive strategies as “a long train of abuses and usurpations.” Throughout the Declaration of Independence and the U.S. Constitution, the Founding Fathers imbued the people with hope in a government for the people: one unlike that of the monarchy, which sought to protect itself at the expense of colonists. As a result, the Founders created a government more likely to lead (...) with fairness, demonstrate respect for human dignity, unite Americans as one people, empower citizens through hope, and lead the nation toward security. This socio-ethical framework was an abductive discovery nested within a grounded theory study where it had been concluded that the first principles of democracy were woven within the American founding documents. Using Charmaz’s constructivist grounded theory, the first principles of democracy—knowledge, fairness, human dignity, hope, unity, and security—were used to answer an emerging research question: Are there two democratic frameworks in the founding documents, and how do they differ? The first principles of democracy promote a culture of ethics, resilience, and freedom. Their empowering disposition makes them suitable as a normative framework for a democratic government for the people. (shrink)

This paper utilizes the framework of Karl Popper’s 3-world ontology to make the case that forensic science is a specialized coding system that establishes meaningful connections between the world of biology and the world of human society . Forensic science is a cross-disciplinary endeavor that uses scientific methods to determine what transpired in a crime so the legal system can determine how to prosecute the offender. On a Popperian analysis of forensic science, world 1 consists of evidence gathered at the (...) crime scene, which enables investigators to develop a detailed reconstruction of the incident for consideration under the legal and ethical codes of society, which are products of world 3. Understanding forensic science in this way serves two purposes: first, it extends Marcello Barbieri’s code biology into the realm of philosophical considerations in science, law and ethics; and second, it situates forensic science within the larger context of debates in contemporary philosophy of science. Though antiretroviral therapy is the standard of care for people living with HIV, its treatment limitations, burdens, stigma and costs lead to continued interest in HIV cure research. Early-phase cure trials, particularly those that include analytic treatment interruption, involve uncertain and potentially high risk, with minimal chance of clinical benefit. Some question whether such trials should be offered, given the risk/benefit imbalance, and whether those who choose to participate are acting rationally. We address these questions through a longitudinal decision-making study (...) nested in a Thai acute HIV research cohort. In-depth interviews revealed central themes about decisions to join. Participants felt they possessed an important identity as members of the acute cohort, viewing their bodies as uniquely suited to both testing and potentially benefiting from HIV cure approaches. While acknowledging risks of ATI, most perceived they were given an opportunity to interrupt treatment, to test their own bodies and increase normalcy in a safe, highly monitored circumstance. They were motivated by potential benefits to themselves, the investigators and larger acute cohort, and others with HIV. They believed their own trial experiences and being able to give back to the community were sufficient to offset participation risks. These decisions were driven by the specific circumstances experienced by our participants. Judging risk/benefit ratios without appreciating these lived experiences can lead to false determinations of irrational decision- making. While this does not minimise vital oversight considerations about risk reduction and protection from harm, it argues for inclusion of a more participant-centered approach. (shrink)

The astute manger should be aware that, in organizations, the deck is frequently ‘stacked’ against higher levels of ethical behavior. This deck stacking occurs because of socialization processes, environmental influences, and the organization hierarchy. As a result of bosses using hierarchical leverage to take the ethical dimension of decision-making away from subordinates, the stage is set for a they-made-me-do-it defense of their moral integrity by these subordinates if and when violations of ethical norms come to light. There is also at (...) work, however, an I-made-them-do-it situation in which professionals who prefer to ‘nest’ in the more technical aspects of their work ‘delegate’ — upward — to their bosses ethical decision-making. Understanding these dynamics is crucial in an age which is especially sensitized to the ethical facet of organizational behavior. (shrink)

Background Ethical decision-making education in nursing can be taught effectively by combining different teaching models that support the visualisation of taught concepts and integrating theory into practice. Objectives The study aims to examine the effect of flipped and jigsaw learning models on ethical decision-making and ethical sensitivity in nursing. Research design We used a nested mixed design. A pretest-posttest single-group quasi-experimental design was used in the quantitative part, and a case study method was used in the qualitative part. Participants and (...) research context This study was conducted in fall semester with second-year nursing students who studied an ethics course for the first time, using two different collaborative learning models. In the quantitative part, ethical dilemma and ethical sensitivity scales were made as pre-test with 117 and post-test with 128 students. In the qualitative part, a semi-structured three focus group interviews was conducted with 16 students. Ethical considerations After obtaining the approval of the University’s ethics committee, the study was carried out after obtaining participants’ informed written and verbal consent. Findings Students’ perspectives changed positively after training. This was related to six cases in section A of the Ethical Dilemma Scale. In part B, Practical Consideration (PC) and Principled Thinking (PT) mean scores were similar, showing no significant difference. For Familiarity in section C, it was determined that 68.4% of students in the pre-test and 77.3% in the post-test were familiar with similar dilemmas. The ethical sensitivity scale’s total scores were in a similar range. In the qualitative stage, ethical decision-making, ethical sensitivity, ethical dilemma and the improvement process were obtained as a theme. Conclusions There was an increase in the level of ethical sensitivity and familiarity with ethical dilemmas of nursing students after education. Flipped and jigsaw learning models can be used for nursing ethics courses. (shrink)

Attending--patient contemplation focused on a particular being--is a central ethical activity that has not been recognized by any of the main moral systems in the European philosophical tradition. That tradition has imagined that the moral agent is primarily a problem solver and world changer when what might be needed most is a witness. Moral theory has been agonized by dualism--motivation is analyzed into beliefs and desires, descriptions of facts and dissatisfactions with them, while action is represented as an effort to (...) lessen dissatisfaction by altering the empirical world. In Attending Warren Heiti traces an alternative genealogy of ethics, drawing from the Platonism recovered by Simone Weil and developed in the work of Iris Murdoch, John McDowell, and Jan Zwicky. According to Weil, virtue is knowledge, knowledge is embodied, and the knower is nested in an ecosystem of relationships. Instead of analyzing and solving theoretical problems, Heiti aims to clarify the terrain by setting up objects of attention from more than one discipline, including not only philosophy but also literature, psychology, film, and visual art. The traditional picture captures one important type of ethical activity: faced with a moral problem, one looks to a general rule to furnish the solution. But not all problems conform to this model. Heiti offers an alternative: to see what is needed, one attends to the particular being. (shrink)

The rapid and dynamic nature of digital transformation challenges companies that wish to develop and deploy novel digital technologies. Like other actors faced with this transformation, companies need to find robust ways to ethically guide their innovations and business decisions. Digital ethics has recently featured in a plethora of both practical corporate guidelines and compilations of high-level principles, but there remains a gap concerning the development of sound ethical guidance in specific business contexts. As a multinational science and technology (...) company faced with a broad range of digital ventures and associated ethical challenges, Merck KGaA has laid the foundations for bridging this gap by developing a Code of Digital Ethics (CoDE) tailored for this context. Following a comprehensive analysis of existing digital ethics guidelines, we used a reconstructive social research approach to identify 20 relevant principles and derive a code designed as a multi-purpose tool. Versatility was prioritised by defining non-prescriptive guidelines that are open to different perspectives and thus well-suited for operationalisation for varied business purposes. We also chose a clear nested structure that highlights the relationships between five core and fifteen subsidiary principles as well as the different levels of reference—data and algorithmic systems—to which they apply. The CoDE will serve Merck KGaA and its new Digital Ethics Advisory Panel to guide ethical reflection, evaluation and decision-making across the full spectrum of digital developments encountered and undertaken by the company whilst also offering an opportunity to increase transparency for external partners, and thus trust. The ethical theory discoverable in Hegel’s writings assigns, on Dean Moyar’s reading, an important role to the idea of conscience. Hegel’s discussion of conscience presents a theory of practical reasoning which requires that one be able to nest the particular purposes that motivate one’s actions in the objective purposes that have normative status insofar as they prevail in the institutions of modern ethical life. Those norms are legitimized by the fact that the institutions in question, most especially the state, (...) predicate themselves on their recognition of the rights of the particular individual. Individuals are not simply passive in relation to ethical, institutional norms. Individual moral deliberation plays a key role in the ethical development of society. Nonetheless, the norms that the state requires the individual to recognize do seem to be, in the last analysis, beyond appeal. Hegel makes, and Moyar presents, a powerful case for this position. Nonetheless, pacifist arguments present this position with a serious challenge. (shrink)

Even the most scientifically reductionist view of the individual reveals that we are complex systems nested within complex systems. These interactions within and among systems are based and depend on numerous variables of our environment. If we define ethics as a system of moral decision making, then it becomes clear that these decisions ultimately affect the situation of managing our activities and relationships with others in our environment. Given that ecology literally means “a study or system of wisdom and (...) reasoning about the interrelation of organisms in their environment or place of inhabitance,” Owen Flanagan's description of ethics as “human ecology” takes on considerable relevance and importance. Many of the world’s mental health acts, including all Australian legislation, allow for the coercive detention and treatment of people with mental illnesses if they are deemed likely to harm themselves or others. Numerous authors have argued that legislated powers to impose coercive treatment in psychiatric illness should pivot on the presence or absence of capacity not likely harm, but no Australian act uses this criterion. In this paper, I add a novel element to these arguments by comparing the use (...) of the harm to others justification for coercive treatment in mental illness with its use in illness due to infectious disease, and suggest a double standard applies. People with mental illness are subjected to coercive treatments at levels of risk to others far, far lower than would precipitate coercive treatment in people with influenza. In effect, this element of mental health legislation represents an example of sanism—state-sanctioned discrimination against people with mental illnesses. (shrink)

Human capital, the knowledge, skills, and abilities of employees, can be a powerful driver of firm performance, yet the mobility of human capital raises questions over how to protect it. Employee non-compete agreements, which limit an employee’s ability to start or join a rival firm, have received recent attention. While past research considers whether non-competes are effective tools at limiting employee mobility, few have considered if non-competes should be used. Filling this gap, I propose a normative schema for when employee (...) non-competes can be considered ethical. A review of the limited existing literature on the ethics of employee non-competes finds that prior research has mostly focused on questions of property rights, which I propose as being nested within other ethical constructs. Analysis of two real-world illustrative examples of employee non-competes leads to a three-prong approach to evaluating non-competes based on ethical dimensions of power, autonomy, and fairness. I end by proposing—although further research is warranted—a measure of employee-level absorptive capacity, which is closely coupled with an employee’s pre-employment human capital, as an employee-level attribute independent of, although likely coincidental with, the tripartite requirements of power/autonomy/fairness for ethical employee non-compete agreements. Thought experiments have played a pivotal role in many debates within ethics—and in particular within applied ethics—over the past 30 years. Nonetheless, despite their having become a commonly used philosophical tool, there is something odd about the extensive reliance upon thought experiments in areas of philosophy, such as applied ethics, that are so obviously oriented towards practical life. Herein I provide a moderate defence of their use in applied philosophy against those three objections. I do not defend (...) all possible uses of thought experiments but suggest that we should distinguish between legitimate and illegitimate uses. Their legitimate uses are determined not so much by the modal content of any actual thought experiment itself, but by the extent to which the argument in which it is nested follows basic tenets of informal logic and respects the fundamental contingency of applied ethical problems. In pursuing these ideas, I do not so much provide a set of criteria for their legitimate use, but more modestly present two significant ways in which their use can go awry. (shrink)

Se discute si las pretensiones argumentales de Singer se actualizan en sus obras. The article analyzes the hermeneutical bases of all ethical decisions. Moral norms require (...) an understanding of the circumstances, since good ethical judgments can only be made on that basis. While for Peter Singer, the tools for that understanding are rational, Mauricio Beuchot expands them through intuition and subtlety. Em questões ambientais, a relação dos seres humanos com a natureza é vista como um problema ético importante. Isso gerou várias posições éticas como antropocentrismo, biocentrismo, ecocentrismo e similares. Sobre a relação do homem com o animal, B. G. Nortor menciona que animais em “contexto” devem ter prioridade em relação a animais em “conteúdo”. Norton nomeia animais domesticados e animais selvagens mantidos em cativeiros como animais em “contexto”. Ele sustenta que devemos cuidar dos animais domesticados na medida em que temos (...) um contrato hipotético com eles (Norton, 2003). Ao mesmo tempo em que concordamos com a posição de Norton de cuidar dos animais domesticados, defendemos que sua compreensão do contrato e sua subsequente compreensão de “cuidado” como derivando de um valor instrumental dos animais reflete sua posição de um antropocentrismo fraco. Neste artigo, defendemos que uma ética do “cuidado” é mais significativa quando emerge de uma perspectiva não-antropocêntrica que trate o outro como valioso intrinsecamente.: In environment related issues, the relationship of human beings to nature is seen as an important ethical issue. This issue has resulted in various ethical positions like anthropocentrism, biocentrism, ecocentrism and like. On man’s relationship with animal beings, Bryan G. Norton mentions that animals in ‘context’ should be given priority over animals in ‘content’. Norton brings the domesticated animals and captive bred wild animals under the ‘context’ animals. Norton maintains that we should take care of the domesticated animals as we have a hypothetical contract with them. (Norton, Searching for Sustainability: Interdisciplinary Essays in the Philosophy of Conservation Biology, 2003) While we agree to Norton’s position of taking care of the domesticated animals, we maintain that his understanding of contract and his subsequent understanding of ‘care’ as stemming from an instrumental value of animals reflects his position of weak-anthropocentrism. In this paper, we claim that a ‘care’ based ethics is more meaningful when it emerges from a non-anthropocentric perspective that treat the other as intrinsically valued. We establish a connection between measurement-based quantum computation and the field of mathematical logic. We show that the computational power of an important class of quantum states called graph states, representing resources for measurement-based quantum computation, is reflected in the expressive power of (classical) formal logic languages defined on the underlying mathematical graphs. In particular, we show that for all graph state resources which can yield a computational speed-up with respect to classical computation, the underlying graphs—describing the quantum correlations of (...) the states—are associated with undecidable logic theories. Here undecidability is to be interpreted in a sense similar to Gödel’s incompleteness results, meaning that there exist propositions, expressible in the above classical formal logic, which cannot be proven or disproven. Neste artigo, argumento que a marca de uma metafísica viável é tanto prática e ética quanto é lógica e sistemática. Para tal, analiso os Diálogos no Limbo de George Santayana, no qual ele afirma seu apoio ao materialismo atomístico de Demócrito em bases pragmáticas. Uma metafísica, ele sugere, é uma visão de mundo que acomoda uma pessoa – vista como um determinado tipo de organismo psicológico – sabiamente às forças da natureza e da melhor forma possibilita essa pessoa a levar (...) uma vida próspera. Ao mesmo tempo, Santayana coloca sua marca no materialismo ao questionar a possibilidade da caracterização geométrica dos átomos de Demócrito ser uma explicação literal da substância material. Ele interpreta a metafísica Democritiana como uma posição poética e mitológica que desconsidera a experiência subjetiva e, em vez de, volta nossa atenção para as origens substrativas do nosso ser. A reflexão que se desenvolve, aqui, reporta-se ao contexto de um período caracterizado por questionamentos profundos, no que tange à tensão entre as diferentes concepções de ciência, verdade, método, ética científica. O eixo da discussão incide sobre o lugar da ética neste século, exercendo o papel de problematizadora de uma vinculação fetichista a determinada visão acerca da verdade, visão esta que tem mantido as Ciências Humanas refém de um olhar cético em relação à legitimidade do conhecimento que produz. O objetivo (...) principal, aqui, é provocar um debate que instigue a uma visão que venha a transcender a oposição excludente entre Ciências Humanas e Naturais, cuja polêmica se assenta na tensão entre os conceitos de verdade e verdade científica. Neste sentido, consideram-se como resultados da discussão, a proposta de que o problema fundamental na pesquisa científica, atualmente, consiste em assumir o desafio de ressignificar a visão sobre a fonte do conhecimento e, em consequência, os meios de deliberar sobre o que distingue verdade de verdade científica. Embora não seja uma questão nova, pois segue peregrina desde a sua origem, precisa ser conjecturada sob a emergência de uma nova mentalidade. Desta vez, desestabilizando-se da visão de que a verdade científica estaria ou no sujeito ou no objeto, e sendo a fonte do conhecimento um lugar de onde fala um sujeito que conhece e um objeto que é conhecido, em posição de equidade epistemológica, a verdade poderia estar na relação entre eles e, em consequência, no princípio da complementaridade entre as ciências. Ética do discurso e racionalidade comunicativa são temas fortes na filosofia de Habermas. Ambos se voltam para o estudo dos efeitos ilocucionários que os atos de fala causam na atividade comunicativa dos falantes. A presença do sujeito, no sentido da modernidade, tornou-se problema na construção da argumentação a favor da ação comunicativa, e isso se tornou motivo de discordâncias quanto à proposta de fundamentação pela pragmática formal que Habermas propõe para afirmar a sua teoria da ação comunicativa. Neste artigo, discutimos, (...) particularmente, o entrelaçamento entre ética e técnica com sujeito, tríade que garante o sucesso da ação comunicativa. Dado que a ética do discurso resulta em decisões coletivas dos concernidos, perguntamos até que ponto isto é possível e necessário, e vinculamos esta discussão com o tema da ética e da responsabilidade no contexto de justificações e argumentações a favor de uma fundamentação possível da ética contemporânea.: Discourse ethics and rationality are strong themes through out all Habermasian philosophy. Both themes come close to the study of the illocutionary effects that the speech acts bring to the communicative action. The presence of the modern subject constitutes mistake in the construction of the argumentative process towards communicative action, and this is mistaken by many criticists. This is motive of disagree in relation to the foundation way through the universal pragmatic that Habermas proposes to state your theory of communicative action. We aim here, in particular, to tell about some interlacing between ethics and technic with subject, three basis that ensures the success of the communicative action. Supposing that the discourse ethics comes out as result of collective decisions, we ask up to where it is necessary and possible, and link this discussion with theme of the responsibility and ethics concerning to arguments and justification in behalf of a possilbe foundationalism of the contemporary ethics. Aggregative consequentialism and several other popular moral theories are threatened with paralysis: when coupled with some plausible assumptions, they seem to imply that it is always ethically indifferent what you do. Modern cosmology teaches that the world might well contain an infinite number of happy and sad people and other candidate value-bearing locations. Aggregative ethics implies that such a world contains an infinite amount of positive value and an infinite amount of negative value. You can affect only a finite (...) amount of good or bad. In standard cardinal arithmetic, an infinite quantity is unchanged by the addition or subtraction of any finite quantity. So it appears you cannot change the value of the world. Modifications of aggregationism aimed at resolving the paralysis are only partially effective and cause severe side effects, including problems of “fanaticism”, “distortion”, and erosion of the intuitions that originally motivated the theory. A set of basic static predicates, 'in itself, 'existing through itself, 'free', and others are taken to be (at least) extensionally equivalent, and some consequences are drawn in Parts A and? of the paper. Part C introduces adequate causation and adequate conceiving as extensionally equivalent. The dynamism or activism of Spinoza is reflected in the reconstruction by equating action with causing, passion (passive emotion) with being caused. The relation between conceiving (understanding) and causing is narrowed down by introducing grasping (λ (...) μβ?νω) as a basic epistemological term. Part D, 'The road to freedom through active emotion', introduces a system of grading with respect to the distinctions introduced in the foregoing, including 'being in itself, 'freedom', etc. Active emotions are seen to represent transitions to a higher degree of freedom, the stronger and more active ones being the more conducive to rapid increase in degree of freedom. Elementary parts of the calculus of predicates are used in order to facilitate the survey of conceptual relations and to prove some theorems. (shrink)
