He argued that the phrase should not be taken literally, as a statement that Troy fell at the new moon, but in an extended sense, as a poetic indication that the moon had not yet risen when the Greeks set sail. In the first chapter of his De rebus per epistolam quaesitis Giano Parrasio sharply criticised the fuzziness of Politian's explanation: ‘Ambages istae sunt, ambages’. More important, he quoted a line from the Little Iliad: νξ μν ην μέσση, λαμπρ δ' πέτελλε σελήνη. This he rendered ‘Nox erat intempesta, nitebat et aurea coelo Luna’, and inferred from it that the moon had been up when Troy fell. In his Virgilius collation scriptorum Graecorum illustratus, finally, Fulvio Orsini published a scholium on Euripides' Hecuba, one which quoted both the line from the Little Iliad and an analysis of it by the Peripatetic Callisthenes. This paper examines the shareholder primacy norm as a widely acknowledged impediment to corporate social responsibility and explores the role of business schools in promoting the SPN but also potentially as an avenue for change by addressing misconceptions about shareholder primacy and the purpose of business. We start by explaining the SPN and then review its status under US and UK laws and show that it is not a likely legal requirement, at least under the guise of shareholder value maximization. (...) This is in contrast to the common assertion that managers are legally constrained from addressing CSR issues if doing so is inconsistent with the economic interests of shareholders. Nonetheless, while the SPN might be muted as a legal norm, we show that it is certainly evident as a social norm among managers and in business schools—reflective, in part, of the sole voting rights of shareholders on corporate boards and of the dominance of shareholder theory—and justifiably so in the view of many managers and business academics. We argue that this view is misguided, not least when associated with claims of a purported legally enforceable requirement to maximize shareholder value. We propose two ways by which the influence of the SPN among managers might be attenuated: extending fiduciary duties of executives to non-shareholder stakeholders and changes in business school teaching such that it covers a plurality of conceptions of the purpose of the corporation. The cyborg that Donna Haraway appropriated in ‘Manifesto for Cyborgs’ as a metaphor for political action and theoretical inquiry has ceased to have the potency it did 20 years ago. While Haraway has turned from a central focus on technoculture to companion species, much important cultural work remains to be done, especially in networked and programmable media. Problems with the cyborg as a metaphor include the implication that the liberal humanist subject, however problematized by its hybridization with cybernetic mechanism, continues (...) as a singular entity operating with localized agency. In a word, the cyborg is not networked enough to encompass the emergent possibilities associated with the Internet and the world-wide web and other phenomena of the contemporary digital era. Instead I propose the idea of the cognisphere. As operational concept and suggestive metaphor, the cognisphere recognizes that networked and programmable media are not only more pervasive than ever before in human history but also more cognitively powerful. It is closely associated with what many researchers regard as a major insight: the idea that the physical world is fundamentally computational. While these scientists regard computation as a physical process, the cultural critic is apt to see it as an over-determined metaphor. The binary choice between seeing the computational universe as a literal description of the physical world and reading it as an over-determined metaphor misses a crucial aspect of contemporary cultural dynamics: the interaction between means and metaphor, technology and cultural presupposition. Taking this dynamic into account leads to a more complete understanding summed up in the aphorism, ‘What we make and what we are co-evolve together.’. (shrink)

The essay replies to comments by Finnis, Gardner and Endicott, on my book, Law as a Moral Idea. It is questioned whether Finnis is right to suggest that governance by law is a requirement of justice. It is suggested that Hart's positivism may have rested upon an unduly private conception of morality. Gardner's suggestion that Law as a Moral Idea falsely manufactures disagreement with Hart is rejected, principally by pointing out that Gardner focuses upon only one issue, where the book (...) already acknowledges that Hart might conceivably agree, and ignores other issues where the disagreement with Hart seems indisputable. In response to Endicott, it is acknowledged that 'politics' could be understood as a moral idea comparable to the idea of 'law', but denied that this robs either thesis of interest. The nature of doctrinal reasoning and law's justificatory force is then discussed. (shrink)

There were five kinds of cyber deterrence presented at the workshop on Landscaping strategic cyber deterrence, hosted at the Oxford Internet Institute. They were the well-studied areas of deterrence by ‘punishment’ and ‘denial’, and the novel concepts of deterrence by ‘association’, ‘norms and taboos’, and finally, ‘entanglement’. In the following workshop commentary, I present these five kinds of deterrence and explain them in light of recent developments in the academy and industry. I argue for analytical congruence between all three novel (...) concepts, since they aim to alter the behaviour of actors by adding a social cost in response to breaking norms and conventions. Throughout, I argue that we are beginning to understand how cyber deterrence works, both in theory and practice, and when all concepts are taken together, they become more than the sum of their parts. Finally, I point out an omission of the workshop, where computational modelling and simulation could be added to the landscape of strategic cyber deterrence. (shrink)

Aims: To describe individuals’ perceptions of the activities that take place within the cancer genetics clinic, the relationships between these activities and how these relationships are sustained. Design: Qualitative interview study. Participants: Forty individuals involved in carrying out cancer genetics research in either a clinical (n = 28) or research-only (n = 12) capacity in the UK. Findings: Interviewees perceive research and clinical practice in the subspecialty of cancer genetics as interdependent. The boundary between research and clinical practice is described (...) as vague or blurred, and this ambiguity is regarded as being sustained by a range of methodological, ethical and economic factors. The implications of these findings for the “therapeutic misconception” are explored. It is argued that while research participation is seen as having therapeutic benefit for individual patients, the interviewees are not labouring under any misconceptions about the relationship between research and clinical care. It is suggested that concepts such as the “therapeutic misconception” may have less relevance in highly technological specialities that are characterised by a developing evidence base. (shrink)

I clarify how the requirement of conservative extension features in the thinking of various deflationists, and how this relates to another litmus claim, that the truth-predicate stands for a real, substantial property. I discuss how the deflationist can accommodate the result, to which Cieslinski draws attention, that non-conservativeness attends even the generalization that all logical theorems in the language of arithmetic are true. Finally I provide a four-fold categorization of various forms of deflationism, by reference to the two claims of (...) conservativeness and substantiality. This helps to clarify the various possible positions in the deflationism debate. (shrink)

The automatic verification of large parts of mathematics has been an aim of many mathematicians from Leibniz to Hilbert. While Gödel's first incompleteness theorem showed that no computer program could automatically prove certain true theorems in mathematics, the advent of electronic computers and sophisticated software means in practice there are many quite effective systems for automated reasoning that can be used for checking mathematical proofs. This book describes the use of a computer program to check the proofs of several celebrated (...) theorems in metamathematics including those of Gödel and Church-Rosser. The computer verification using the Boyer-Moore theorem prover yields precise and rigorous proofs of these difficult theorems. It also demonstrates the range and power of automated proof checking technology. The mechanization of metamathematics itself has important implications for automated reasoning, because metatheorems can be applied as labor-saving devices to simplify proof construction. (shrink)

Background: We were finding volunteers for functional magnetic resonance imaging studies with abnormalities requiring referral surprisingly frequently. The bioethics surrounding the incidental findings are not straightforward and every imaging institution will encounter this situation in their normal volunteers. Yet the implications for the individuals involved may be profound. Should all participants have review of their imaging by an expert and who should be informed? Methods: The normal volunteers that were imaged with magnetic resonance (MR) which were reviewed by a consultant (...) neuroradiologist. All participants completed a volunteer consent form in addition to a standard departmental MR safety screening form. The volunteer screening form requires the general practitioner details to be completed and asks the participant to consider closely the possibility and implications of finding an unexpected but potentially serious abnormality before signing. Results: 525 different individuals were scanned as normal volunteers, the mean age was 35-years and 330 were males. Of these 525, 46 had definite significant abnormalities (8.8%), mean age 50-years. Conclusion: We have found a high rate of incidental abnormalities amongst individuals participating in imaging studies at our institution. It is our current practice to inform the research study participant of the findings, counsel them and inform their primary care physician. We think that it is advisable for researchers utilising MR imaging of the brain to have access to trained neuroradiologists, a protocol in place to deal with this problem and take consent in a way that allows the participant to realise the possibility of an abnormal finding. The relation of the special and the general principle of relativity to the principle of covariance, the principle of equivalence and Mach's principle, is discussed. In particular, the connection between Lorentz covariance and the special principle of relativity is illustrated by giving Lorentz covariant formulations of laws that violate the special principle of relativity: Ohm's law and what we call “Aristotle's first and second laws.” An “Aristotelian” universe in which all motion is relative to “absolute space” is considered. The first (...) law: a free particle is at rest. The second law: force is proportional to velocity. Ohm's law: the current density is proportional to the electrical field strength. Neither of these laws fulfills the principle of relativity. The examples illustrate, in the context of Lorentz covariance and special relativity, Kretschmann's critique of founding Einstein's general principle of relativity on the principle of general covariance. A modification of the principle of covariance is suggested, which may serve as a restricted criterium for a physical law to satisfy Einstein's general principle of relativity. Other objections that have been raised to the validity of Einstein's general principle of relativity are based upon the preferred state of inertial frames in the general, as well as in the special theory, the existence of tidal effects in “true” gravitational fields, doubts as to the validity of Mach's principle, whether electromagnetic phenomena obey the principle, and, finally, the anisotropy of the cosmic background radiation. As part of an ethics course, health professions students were asked to identify ethical issues and to propose resolutions before and after a class discussion of a case involving confidentiality and substance abuse. Students listed an average of 2.4 issues before and 3.6 issues after the discussion. After discussion 50 per cent of students made explicit changes in their proposed resolution. Opinions varied widely on breaching confidentiality and the responsibility for protecting the patient's health. After the discussion almost 20 per (...) cent of the class felt it was acceptable to breach confidentiality as long as the patient was unaware. Many students identified more with the health care provider than with the patient. The presence of substance abuse altered many students' views on confidentiality. In this experience students were less rigorous in their application of principles, creating an excellent opportunity for teaching through exploration of the complexity of ethical decision-making in a specific case.
