In The Birthright Lottery, Ayelet Shachar subjects the institution of birthright citizenship to close scrutiny by applying to citizenship the historical and philosophical critique of hereditary ownership built up over four centuries of liberal and democratic theory, and proposing compelling alternatives drawn from the theory of private law to the usual modes of conveyance of membership. Nonetheless, there are some difficulties with this critique. First, the analogy between entailed property and birthright citizenship is not as illustrative as Shachar intends it (...) to be; second, the mechanism of the birthright privilege levy is insufficient for addressing structural impediments to growth; and third, the principle of ius nexi, while an important corrective to currently dominant principles of nationality, will likely have effects both unnecessary and insufficient to correct the injustices that Shachar identifies. In the end, the most significant improvements in the lives of the neediest persons on the planet are more likely advanced through conventional arguments for the lowering of barriers to the circulation of goods, labor, and capital. Entendo a partidarização judicial como agravamento do anti-igualitarismo jurídico que degrada o formalismo democrático. Atenho-me ao Brasil, sem generalizar: há pessoas dignas no judiciário. Falo na aplicação indevida da lei na esfera política para impedir mudanças na sociedade. Trato o tema em três níveis. Preliminarmente, discuto a desigualdade político-jurídica, depois os golpes de Estado, e por fim o manejo da legislação como arma política que mantém injustiças.

A common approach for measuring the effectiveness of an education system or a school is the estimation of the impact that school interventions have on students’ academic performance. However, the latest trends aim to extend the focus beyond students’ acquisition of knowledge and skills, and to consider aspects such as well-being in the academic context. For this reason, the 2015 edition of the international assessment system PISA incorporated a new tool aimed at evaluating the socio-affective variables related to the well-being (...) of students. It is based on a definition focused on the five dimensions proposed in PISA theoretical framework: cognitive, psychological, social, physical and material. The main purpose of this study is to identify the well-being components that significantly affect student academic performance and to estimate the magnitude of school effects on the well-being of students in OECD countries, the school effect being understood as the ability of schools to increase subjective student well-being. To achieve this goal, we analyzed the responses of 234,000 students from thirty-five OECD countries to PISA 2015 questionnaires. Specifically, we considered non-cognitive variables in the questionnaires and student performance in science. The results indicated that the cognitive well-being dimension, composed of enjoyment of science, self-efficacy and instrumental motivation, as well as the test anxiety all had a consistent relationship with student performance across countries. In addition, the school effect, estimated through a two-level hierarchical linear model, in terms of student well-being was systematically low. While the school effect accounted for approximately 25% of the variance in the results for the cognitive dimension, only 5-9% of variance in well-being indicators was attributable to it. This suggests that the influence of school on student welfare is weak, and the effect is similar across countries. The present study contributes to the general discussion currently underway about the definition of well-being and the connection between well-being and achievement. The results highlighted two complementary concerns: there is a clear need to promote socio-emotional education in schools, and it is important to develop a rigorous framework for well-being assessment. No Íon, a autoridade e a sabedoria de poetas e rapsodos são confrontadas por meios indiretos. O caráter oblíquo dessa estratégia impede o acesso direto ao conteúdo do diálogo e provoca inúmeros equívocos de leitura. Um fato contextual estimula mais ainda leituras equivocadas. A poesia tratada no Íon difere muito da forma como nós, modernos, a entendemos. Na Antiguidade grega, de base aural, a poesia era o modo privilegiado de conservação da tradição herdada, e permaneceu exercendo essa função capital até (...) mesmo quando a escrita passou a desempenhar papel relevante na forma de composição e transmissão cultural. Neste contexto, o rapsodo representa uma autoridade que cobre praticamente todos os campos do saber. Autoridade enciclopédica, contra a qual Platão travou uma guerra não sem ambiguidades. O presente artigo busca revelar a motivação profunda que anima o Íon: a contraposição entre dois modos de comunicação, o da poesia e o da filosofia. Defende, ainda, que Platão, ao atacar a performance poética, busca, além de rejeitá-la, substituí-la pelo élenkhos socrático como modo de comunicação ideal para instrução e guia da vida humana. If the revival of humanism depends on closing the gap between differences, western and eastern perspectives on the world diverge: the first uses History as its guide and the second uses the notion of destiny. Between the logical power of western instrumental rationalism and the affective power of the feeling modes of knowledge like liturgy and music, the West should be able to accept difference and reject both closed identities and absolute alterities.

The confinement of the population into their homes as a result of COVID-19 has entailed a notable increase in the consumption of diverse media. This exploratory study aimed to examine how the increase in media consumption was related to subjective happiness and psychological well-being. For this purpose, a questionnaire was administered to a sample of Spanish adults to assess their consumption of different media before and during confinement. Moreover, participants were evaluated for hedonic, eudaimonic, social, and experienced happiness by using (...) the Pemberton Happiness Index. The results underlined the great increase in the consumption of TV for entertainment and social networking sites during confinement. Furthermore, it was found that higher consumption was negatively correlated with the level of happiness, so that, people who reported greater well-being, both subjective and psychological, spent less time watching TV and using SNS. In contrast, no association was found between the level of happiness and the consumption of news and radio. Therefore, it seems that far from cultivating greater happiness, those who engaged in heavy consumption of TV entertainment and SNS during confinement were less happy than those who did so more moderately and spent more time using other media or performing other activities. A dilemma has stymied interpretations of the Stranger’s method of dividing kinds into subkinds in Plato’sSophistandStatesman. The dilemma assumes that the kinds are either extensions or intensions. Now kinds divide like extensions, not intensions. But extensions cannot explain the distinct identities of kinds that possess the very same members. We propose understanding a kind as like an animal body—the Stranger’s simile for division—possessing both an extension and an intension. We find textual support in the Stranger’s paradigmatic four steps for collecting (...) a subkind. (shrink)

English translates ‘genos’ as kind and ‘eidos’ as form, which differ in meaning as much as ‘herd’ and ‘brand’ do. But there are hard passages where ‘genos’ and ‘eidos’ have appeared to be synonyms, usually given the new meaning class. We show that, although ‘genos’ and ‘eidos’ are never synonyms and continue to mean kind and form, the word ‘eidos’ can be used figuratively, as a metonym, for a genos.

En este artículo llevamos a cabo una extensa revisión de la literatura científica en lo relativo a los vínculos entre materialismo y felicidad, desde un enfoque multidisciplinar que incluye la psicología, la comunicación, la economía y la ética. La línea dominante en la bibliografía insiste en vincular un mayor materialismo con una menor auto-percepción de felicidad y de bienestar, y con una mayor propensión a la depresión. En esta revisión atendemos a los aspectos que así lo evidencian, al rumbo actual (...) de las investigaciones y a los retos aún pendientes de clarificación por parte de la comunidad investigadora. This study focuses on a news framing analysis of Latin America and Latin Americans in the Spanish press. For this purpose 1,271 news articles with different Latin American countries or their citizens as main actors were examined. These news stories had been published by the main Spanish newspapers in 1999. The results reveal that attribution of responsibility, human interest, and conflict constitute the prevailing frames used by the Spanish press. Furthermore, significant differences in the considered variables in terms of main (...) country actor were observed. Venezuela and Colombia, in particular, are associated with armed conflicts, natural disasters, crimes, and accidents using human interest and conflict news frames. This leads to a necessary consideration of the consequences this type of news coverage on Latin America may generate, and whether it will reinforce stereotypes or prejudices in the Spanish audience against peoples from these countries, especially those with a high migratory influx to Spain. This chapter focuses on one of the common fallacies in Western philosophy: hasty generalization (HG). HG is committed when some aspect of the definition of the proper generalization is violated. In other words, the “hasty” aspect of this fallacy is triggered either when there is a lack of knowledge of the selected sample or when the selected sample is not representative of the whole group, or when both and are true. We see HG committed just about every day in politics (...) and the media. In politics, HGs are used to emphasize the extremes of a particular viewpoint. Concurrently, HG is used quite often by advertisers to promote a particular product. To avoid committing this fallacy, the arguer should take into consideration the amount of justifiable knowledge one might have on a particular subject and whether the selected sample being used in the case is justifiably representative of the group in question. Many of the ancient Greeks believed that symmetry represented order, and order was beautiful because it revealed a type of cosmic justice and truth that no person could deny. So, when Steinman's application of beauty comes into play, he is definitely emphasizing the order and justice that beauty (...) provides. The player of BioShock is introduced to a world quite familiar to ours, not necessarily in sense of Rapture, underwater cities, or vintage décor, but rather in the form of worldview. The vending machines are not coincidentally called Circus of Values. O presente trabalho visa expor, utilizando dupla perspectiva, as tecnociências e suas inovações como resultantes do modo de produção capitalista e no que isso implica. Num primeiro momento, será apresentada a perspectiva utilizada por Deuleuze e Guattari em Mil Platôs para denotar a importância do Estado como garantidor de um modo de produção e como agenciador, via ordem jurídica, das linhas de fuga que emergem da sociedade, inclusive no que toca às inovações trazidas pelo desenvolvimento e ampliação dos conhecimentos e (...) dos saberes. Na sequência, de forma complementar, serão abordados o capitalismo em si e alguns de seus fundamentos relevantes para a compreensão das consequências possíveis para as inovações tecnocientíficas, isso a partir de postulados da teoria materialista-histórica. Após, irá se procurar demonstrar a realização de um estatuto ético-jurídico brasileiro como agenciamento das modificações e inovações que dizem com uso de células tronco para pesquisas. (shrink)

Algunos filósofos utilitaristas justifican proteger los derechos humanos por la utilidad que reportan, pero niegan que tal obligación pueda desplazar al deber ético más fundamental de procurar el bienestar. El trabajo argumenta que los derechos humanos son bienes cuyo valor moral es en parte independiente del bienestar que causan, y por tanto crean exigencias que pueden oponerse y superar a las razones para incrementar el bienestar global. A partir de esta idea se discute la suficiencia de una ética basada únicamente (...) en derechos, los conflictos de los derechos humanos entre sí y con otros bienes morales y la justificación de la inalienabilidad de los derechos humanos. The present article presents brief notes on the "new thought" of the German philosopher Franz Rosenzweig, in the work The Star of Redemption, with the exposure of reason and its totalitarian and violent vocation, which, since Antiquity until Modernity, was based on the tireless search for knowledge of the All, in its essence, with the formulation of concepts, in a closed experience. In contrast, the philosopher from Kassel points out his proposal for a new philosophical system, with a vocabulary similar (...) to the one found in Jewish theology, even being confused with theological thought, which revealed an alternative analysis of experience (open, dynamic, relational and in time), the construction of a plural reason, admitting and respectingplurality. É a própria luta entre as distintas parcelas das elites, que se distribuem por distintas porções do território e tem nelas assentadas seus interesses políticos e econômicos, para dar as diretrizes da nação emergente, que leva ao surgimento de reivindicações, ações e discursos de cunho regionalista, alguns deles chegando a radicalidade da proposição da secessão. É a luta em torno (...) de hegemonizar a nação que leva emergência das regiões. O artigo faz um percurso em torno do tema da formação territorial brasileira e de como as questões regionais se colocam nesse processo de configuração do espaço nacional. (shrink)

Current legal theory is concerned with the presence of principles in law partly because they are at the core of Dworkin's criticisms of Hart's rule of recognition. Hart's theory is threatened by the possibility that the identification of some principles follows an extremely relaxed rule of recognition, or even no rule at all. Unfortunately, there is no conclusive test to ascertain what is the case in actual practice. On the other hand, the evaluative arguments which support Dworkin's proposal of principled (...) adjudication are forceful but not conclusive. Resumo A conservação da biodiversidade tornou-se um compromisso inquestionável diante do seu papel inexorável para a manutenção da vida na Terra. Apesar do consensual compromisso em sustentá-la, as razões pelas quais fazê-lo ainda são alvo de discussões e controvérsias. Que valores devem reger sua proteção? Contudo, a conservação da biodiversidade está cada vez mais voltada para um lado objetivo-econômico, na qual a natureza é marginal aos interesses que parecem mais evidentes: a eficiência econômica. Esse artigo faz uma reflexão sobre os (...) esquemas de biodiversity offsets, instrumentos cujo objetivo é a compensação pelos danos à biodiversidade provocados pelas atividades de desenvolvimento; e sobre a mudança nos valores da conservação da biodiversidade que tais instrumentos tendem a provocar. Uma mudança discursiva, institucional, técnica e material que altera o sentido de se fazer conservação e a relação humana com o mundo natural. Essa ‘nova’ perspectiva da conservação revela dilemas éticos fundamentais, e vem se tornando uma estratégia cada vez mais difundida no âmbito das políticas ambientais para a conservação. (shrink)

This chapter focuses on one of the common fallacies in Western philosophy called the slippery slope. According to Patrick Hurley in A Concise Introduction to Logic, “the fallacy of slippery slope is a variety of the false cause fallacy. It occurs when the conclusion of an argument rests on an alleged chain reaction and there is not sufficient reason to think that the chain reaction will actually take place”. The key term in the chapter is “chain reaction”. If all of (...) the events in the chain reaction can be justified, then the slippery slope is not committed. But the nuances and intricate improbable connections between each event still make it difficult to support the ultimate conclusion, which is to get rid of cable. The chapter discusses two simple techniques in order to avoid committing the slippery slope fallacy. (shrink)

O objetivo do presente artigo, pensado preliminarmente como parte integrante de um estudo mais amplo e sistemático sobre o processo de formação do pensamento do jovem Nietzsche, é discutir o estatuto da linguagem em suas considerações sobre estética, notadamente naquela apresentada nos fragmentos, apontamentos e escritos póstumos preparatórios d’ O Nascimento da Tragédia . Como se poderá notar, o viés de investigação proposto, respaldado em importantes estudos de literatura secundária, primou por uma esmerada, porém não exaustiva, reconstituição do trinômio: linguagem (...) sonora ( Tonsprache ), linguagem-de-gesto ( Geberdensprache ) e linguagem-de-palavra ( Wortsprache ), que margeia a investigação nietzscheana sobre a origem, desenvolvimento e perecimento da tragédia grega. O presente artigo tem por objetivo, na primeira parte, explorar algumas teses gerais apresentadas por recente pesquisa de Josef Simon acerca do estatuto da linguagem na filosofia de Kant, em especial no que tange ao modo de significar e comunicar presente nas reivindicações de verdade dos juízos. Em segundo lugar, pretende-se pontuar a crítica de Nietzsche a um modo de significar e comunicar ao qual denomina "gregário", contrapondo-o a uma comunicação e significação "individualizada". Como apontamos no final, a visada interlocução (...) entre Kant e Nietzsche acerca do significar e comunicar se dará segundo um aspecto central: o fator subjetivo presente em qualquer reivindicação discursiva da razão. The present article aims, in the first part, to explore some general theses presented by recent research of Josef Simon concerning the status of language in Kant's philosophy, especially regarding the mode of signification and communication present in the claims for truth of judgment. In the second part, it is intended to point out Nietzsche's critique of a mode of meaning and communication, which he calls "gregarious", confronting it to "individualized" communication and meaning. As it is pointed out in the conclusion, the intended dialogue between Kant and Nietzsche on this theme occurs according to a central aspect: the subjective factor present in any discursive claim of human reason.
