This article challenges the generally accepted dogma that reliance is an essential ingredient in contractual formation. We argue that this view has resulted from an erroneous interpretation of the relevant case law, failure to cite contrary authority, and the elevation of often oblique judicial references to the need for reliance to the status of fundamental contractual principle. Contractual theory and clear policy reasons support our position that in English law a contractual obligation subsists when a person, knowing of a promise, (...) performs the stipulated act (or gives the promise) requested by the promisor, even though that person has not relied on the promise. Drawing together researchers from diverse theoretical positions, the aim of this book is to work towards a coherent and unified account of how we develop an understanding of one's and others' mental states.

My construction of the position of the eye in Rabbinic Judaism represents almost a reversal of the roles “Hebraic” and “Hellenic.” A powerful case can be made that only under Hellenic influence do Jewish cultures exhibit any anxiety about the corporeality of visibility of God; the biblical and Rabbinic religions were quite free of such influences and anxieties. Thus I would identify Greek influences on Judaism in the Middle Ages as being the force for repressing the visual. The Neoplatonic and (...) Airstotelian revision of Judaism undertaken by the Jewish scholastics was so successful that it has resulted in the near-total forgetting of the biblical and Rabbinic traditions of God’s visibility. W. J. T. Mitchell’s characterization of the Rabbinic tradition is a perfect example of this “forgetting.” In order to position Judaism in a typology of cultures, Mitchell cites Moses Maimonides. Mitchell’s reading of Maimonides is well-founded; the problem lies rather in the identification of Maimonides as if he typified the old Rabbinic tradition. In my view, he represents a distinct departure from that tradition. This Platonic departure was indeed marked and condemned as such by many of his contemporaries, but it has become the almost unchallenged orthodoxy of later Judaism as well as of the critical tradition. The memory of having seen God in the Bible and the desire to have that experience again were a vital part of Rabbinic religion. They constituted, moreover, a key element in the study of Torah, the making of midrash. Daniel Boyarin, associate professor of Talmud and midrash at Bar-Ilan University, has published essays on midrash and literary theory. In this paper I discuss recent debates concerning etiological theories of functions. I defend an etiological theory against two criticisms, namely the ability to account for malfunction, and the problem of structural doubles. I then consider the arguments provided by Bigelow and Pargetter (1987) for a more forward looking account of functions as propensities or dispositions. I argue that their approach fails to address the explanatory problematic for which etiological theories were developed.

Ismael aims for an understanding of the nature of an embedded perspective of agents in a world. If successful, this would explain a cluster of ways in which from an embedded perspective, we experience the world in an array of temporally asymmetric ways. Moreover, these are ways that have led many philosophers to rather metaphysically inflationary views about the nature of time, according to which time itself really is dynamical, and is characterized by the movement of an objectively (i.e., non-perspectival) (...) present. Ismael aims to explain these features of our experience without positing any such metaphysical picture. She argues that there are constraints which prevent us from taking this Olympian conception of the world and our place in it, and that these, jointly, explain why we experience the world in these temporally asymmetric ways. We take up two related questions. First, what it would mean to say that these constraints are not merely epistemic, and second, how far these constraints get us in explaining why we experience the world in these ways. (shrink)

Faced with the liability of newness, a scarcity of resources, and concerns of survival, new firms frequently encounter difficult ethical decisions and might be pressured to make choices that run counter to the tenets of more developed ethical and moral reasoning. This study explores the impact of newness and entrepreneurial orientation on the ethical climate of firms. Data collected from 304 individuals across 37 firms indicated that firm newness was more strongly related to ethical climate than was an entrepreneurial orientation. (...) Results also revealed that firm newness may be usefully conceptualized in both continuous and categorical terms, with each operationalization holding a somewhat different relationship with climate. Finally, results revealed that firm size was related to several types of ethical climates. (shrink)

Alexithymia is associated with emotion processing deficits, particularly for negative emotional information. However, also common are a high prevalence of somatic symptoms and the perception of somatic sensations as distressing. Although little research has yet been conducted on memory in alexithymia, we hypothesized a paradoxical effect of alexithymia on memory. Specifically, recall of negative emotional words was expected to be reduced in alexithymia, while memory for illness words was expected to be enhanced in alexithymia.Eighty-five high or low alexithymia participants viewed (...) and rated arousing illness-related , emotionally positive , negative , and neutral words . Recall was assessed 45 min later.High alexithymia participants recalled significantly fewer negative emotion words but also more illness-related words than low alexithymia participants. The results suggest that personal relevance can shape cognitive processing of stimuli, even to enhance retention of a subclass of stimuli whose retention is generally impaired in alexithymia. Since its inception as a topic of inquiry, mirror-self-recognition has usually been explained by two models: one, initiated by Guillaume, proposes that mirror-self-recognition depends upon kinesthetic-visual matching, and the other, initiated by Gallup, that self-recognition depends upon a self-concept. These two models are examined historically and conceptually. This examination suggests that the kinesthetic-visual matching model is conceptually coherent and makes reasonable and accurate predictions; and that the self-concept model is conceptually incoherent and makes inaccurate predictions from premises which are themselves (...) inaccurate. From a theoretical standpoint, the kinesthetic-visual matching model is the better explanation of self-recognition. (shrink)

Abstract: How is it that we can visually experience complete three-dimensional objects despite being limited, in any given perceptual moment, to perceiving the sides facing us from a specific spatial perspective? To make sense of this, such visual experiences must refer to occluded or presently unseen back-sides which are not sense-perceptually given, and which cannot be sense- perceptually given while the subject is occupying the spatial perspective on the object that they currently are – I call this the horizonality of (...) visual experience. Existing accounts of these horizonal references are unsatisfactory. In providing a satisfactory account, this paper argues that the content and structure of the visual experience of complete three-dimensional objects is as follows: the object is presented as being perceptible from yet-to-be-determined alternative points of view. As part of the content of visual experience, this motivates non-propositional attitudes of anticipation. Explicating this proposal is the central positive aim of this paper. (shrink)

This paper sketches a historical account of interdisciplinarity. A central claim advanced is that the modern array of scientific and humanistic disciplines and interdisciplinarity emerged together; both are moving targets, which must therefore be studied historically in relation to one another as institutionalized practices. A second claim is that of a steadily increasing complexity; new fields emerged on the boundaries of existing disciplines beginning in the late nineteenth century, followed by multi- and transdisciplinary initiatives in the twentieth, and finally transdisciplinary (...) programmatic research in the late twentieth and early twenty-first centuries. The latter two phases in this development have been driven primarily by funding agencies seeking to move the sciences in particular directions deemed socially or politically desirable (in dictatorships as well as democracies), while the existing disciplines remained in place and new ones came into being. Such policy initiatives have transformed both disciplinarity and interdisciplinarity in unanticipated ways. The question whether multi- or transdisciplinary arrangements produce epistemically better science or scholarship appears not to have been raised, let alone examined, by the policy actors driving their creation. At the University of Newcastle, health law and ethics is taught and assessed in each year of the five-year curriculum. However, the critical question for assessment remains: 'Does teaching ethics have a measurable effect on the clinical activity of medical students who have had such courses?' Those responsible for teaching confront this question each year they sit down to construct their assessment tools. Should they assess what the student knows? Should they assess the student's moral reasoning, that is, what decisions (...) the student makes, and, how these decisions are justified, or should they assess what the student actually does when dealing with patients in the clinical setting, and how he or she does it? From 1982 to 1991, assessment at Newcastle was primarily aimed at determining the quality of the students' ethics knowledge base. This paper describes the strengths and limitations of a purely knowledge-based method of evaluation and why in 1992, we are now attempting to redefine and assess, what we call 'clinical ethical competence' in terms of how students actually apply this knowledge base in a controlled clinical context. Persistent and pervasive rudeness and lack of respect are unfortunately common in workplaces today. The deleterious effects of this incivility at work may be even worse than previously demonstrated, impacting not only employee victims but also trickling down to those who employees contact. However, we propose that leaders who prioritize their followers’ needs above their own, also known as servant leaders, may be a critical preventative mechanism to reduce group-level incivility through promoting a virtuous climate. Applying social learning theory and (...) social information processing theory, we argue that servant leaders role model virtuous character that contributes to a virtuous climate that influences group members to reduce incivility and, in turn, treat others well. We utilize the healthcare setting to support this hypothesized process across multi-source measures of incivility from coworkers and team supervisors and three indicators of quality of patient care. Specific findings and implications for managers in healthcare settings and beyond are discussed. (shrink)

Summary This paper explores the legacy of the great French experimental physicist Victor Regnault through the example of Gabriel Lippmann, whose engagement with electrical standardization during the early 1880s was guided by Regnault's methodological precept to measure ‘directly’. Lippmann's education reveals that the theoretical practice of ‘direct’ measurement entailed eliminating extraneous physical effects through the experimental design, rather than, like physicists in Britain and Germany, making numerical ‘corrections’ to measured values. It also provides, paradoxically, exemplars of the qualitative theoretical practices (...) that sustained Regnault's misguided ambition to avoid theory. By considering the largely negative reactions to Lippmann's proposals for selecting suitable electrical units and methods of measuring the ohm, this paper associates these theoretical practices with the ineffectual rhetorical strategies employed by Lippmann to promote his work, and thereby indicates that the practice of direct measurement was limited to French experimental physics. Whilst this result aligns readily with the existence of divergent nineteenth century British and German cultures of precision, it emerges from a very different disciplinary context in which the practice of precision electrical measurement developed independently of submarine telegraphy. This is because, as this paper illustrates, telegraphic engineering and experimental physics remained separate professions in France. (shrink)

An examination on the one hand of Aristotle's report in Metaphysics A6 of Plato's teachings regarding the One, the dyad of the Great and the Small, and mathematical intermediates and on the other hand of key passages in Plato's Parmenides. I argue that we can find in those passages exhibitions of the teachings Aristotle reports and that these exhibitions help us to understand those teachings.

The question naturally arises: Is public art inherently violent, or is it a provocation to violence? Is violence built into the monument in its very conception? Or is violence simply an accident that befalls some monuments, a matter of the fortunes of history? The historical record suggests that if violence is simply an accident that happens to public art, it is one that is always waiting to happen. The principal media and materials of public art are stone and metal sculpture (...) not so much by choice as by necessity. “A public sculpture,” says Lawrence Alloway, “should be invulnerable or inaccessible. It should have the material strength to resist attack or be easily cleanable, but it also needs a formal structure that is not wrecked by alterations.”12 The violence that surrounds public art is more, however, than simply the ever-present possibility of an accident—the natural disaster or random act of vandalism. Much of the world’s public art—memorials, monuments, triumphal arches, obelisks, columns, and statues—has a rather direct reference to violence in the form of war or conquest. From Ozymandias to Caesar to Napoleon to Hitler, public art has served as a kind of monumentalizing of violence, and never more powerfully than when it presents the conqueror as a man of peace, imposing a Napoleonic code or a pax Romana on the world. Public sculpture that is too frank or explicit about this monumentalizing of violence, whether the Assyrian palace reliefs of the ninth century b.c., or Morris’s bomb sculpture proposal of 1981, is likely to offend the sensibilities of a public committed to the repression of its own complicity in violence.13 The very notion of public art as we receive it is inseparable from what Jürgen Habermas has called “the liberal model of the public sphere,” a dimension distinct from the economic, the private, and the political. This ideal realm provides the space in which disinterested citizens may contemplate a transparent emblem of their own inclusiveness and solidarity, and deliberate on the general good, free of coercion, violence, or private interests.14 12. In his 1987 paper “Truth or Consequences,” Dan Brock describes a deep conflict between the goals and virtues of philosophical scholarship and public policymaking: whereas the former is concerned with the search for truth, the latter must primarily be concerned with promoting good consequences. When philosophers are engaged in policymaking, he argues, they must shift their primary goal from truth to consequences—but this has both moral and methodological costs. Brock’s argument exemplifies a pessimistic, but not uncommon, view of the possible (...) shape and nature of applied philosophy. The present paper paints a richer and more optimistic picture. It argues that the difference between theoretical philosophy and applied philosophy is not best understood as a choice between truth and consequences. On the contrary, applied philosophers engage in forms of truth‐seeking that are properly concerned with consequences—including the consequences of philosophical practice itself. (shrink)

The question of what and how artworks mean things is conventionally satisfied by appealing to literature from either philosophy of art or philosophy of language. This book offers an alternative by positioning art as a type of meaning-making tool whose function can only be understood through the application of the philosophy of technology.

The importance of the spiritual dimension in the lives of people living in conditions of poverty and social exclusion and the often-critical role of faith-based organisations has gained increasing relevance in development research and practice. A growing line of research focuses on how to integrate the faith dimension into the evaluation of social programmes and on quantifying the effects of faith. The objective of this article is to propose a framework for integrating a spiritual dimension into the design and practice (...) of impact evaluation by using the concept of integral human development. Integral human development emerged within the Catholic social tradition, but is not specific to it. It is a perspective on human development that integrates the material and spiritual, recognises the interdependence between humans and their environment or territory and demands change at both the individual and collective levels. This framework is then applied to the design of an impact evaluation of a faith-based programme that accompanies people with drug and alcohol addictions in Argentina. The article highlights the following characteristics of an integral impact evaluation: the interaction between multiple well-being dimensions; the use of knowledge and methods of analysis from multiple disciplines; the importance of understanding the diverse pathways to improvements in well-being; the assessment of the spiritual dimension through changes in one's relationships with oneself, others and the environment; and the importance of assessing personal change within the context of social and community transformation. Written in the 12th century in Arabic by a faithful Jewish man, "The Guide" is a work that explores the contradiction a very intelligent mind clearly saw between the tradition he was raised to believe inherently and the growing philosophy of Arabian and Western culture. In Maimonides' time, there was an emerging disparity between the Law and a new level of philosophical sophistication, which he attempts to bridge in this work, primarily through the use of metaphor, though also acknowledging this (...) method's limitations. "The Guide" follows the form of a three-volume letter to a student, which was quickly translated to Hebrew and spread throughout the known world and carefully read by Jews and non-Jewish philosophers alike well through the Middle Ages. This work was so successful in its organization and arguments that it has long been a classic of the Jewish religion and of the secular world of philosophy. (shrink)

History of Science in History. This position paper discusses the position of history of science within the field of history and presents arguments for maintaining and expanding that position in future.

In this paper I argue that two domains of uncertainty should inform our strategies for making social policy on new genetic technologies. The first is biological complexity, which includes both unknown consequences on known variables and unknown unknowns. The second is value pluralism, which includes both moral conflict and moral pluralism. This framework is used to investigate policy on genetically modified food and suggests that adaptive management is required to track changes in biological knowledge of these interventions and that less (...) simplistic, polemic representations of scientific knowledge are required to permit democratic decision making.
