Der Aufsatz diskutiert die zentralen Gedanken Niklas Luhmanns über die Individualitätsbildung und Freiheitslage der Menschen in der segmentär, stratifikatorisch und funktional differenzierten Gesellschaft. Die Individualität und mithin die Freiheit der Menschen wird in den ersten beiden Differenzierungsformen durch Inklusion in Familien, Haushalten, Stämmen, Ständen etc. ermöglicht, also von außen bestimmt. In der modernen funktional differenzierten Gesellschaft muss man hingegen seine Individualität selbst bilden, weil man von den Funktionssystemen nur durch Anpassung an ihre Forderungen inkludiert werden kann, was heute vor allem (...) durch einen Karriereverlauf möglich ist. Als Individuum hat man aber auch die Freiheit, sich dem zu widersetzen und sich zurückzuziehen. Ferner zeichnet sich die moderne Gesellschaft dadurch aus, den Individuen die Freiheit einzuräumen, Ansprüche an sie zu stellen, damit sie ihre eigenen Strukturen dementsprechend aufbauen kann. Luhmanns Beschreibung der modernen Verhältnisse hat auch für die „Nachzügler“ der Modernisierung wie z.B. China Relevanz. (shrink)

We, the residents of modernity, live in an unquiet house.This essay examines the relationship between human subjects and their built environment, but it does so less by focusing on architecture than on what one might call ‘architecture once removed'. It is less concerned with the built environment itself than with a prevalent image of that environment in ‘high’ and ‘popular’ culture, in literature, in film and painting. It is my contention that a particular unsettling image of buildings has gained increasing (...) currency in the modern epoch. I will attempt to show that such an image — and a concomitant anxiety — exists, and to offer an explanation for its provenance. (shrink)

Background The COVID-19 pandemic has influenced the approach to the health-disease system, raising the question about the principles of bioethics present in physician–patient relations. The principles while widely accepted may not be sufficient for a comprehensive ethical analysis. Therefore, the aim of this study was to explore the perception of these principles and the physician–patient relationship during a hospital stay through a qualitative approach. Method Sixteen semi-structured interviews took place to know the patients’ perception during their 2020 hospitalization for COVID-19. (...) The data was analyzed through the constant comparison method, creating categories and comparing them. In the end, seven categories were established and were grouped in three: bioethical principles (dignity, charity, vulnerability, autonomy), doctor-patient relationship (participant commitment, informed consent, health staff-patient relationship) and the experience of the disease (illness, the role of the family). Results The research found that most patients described a positive experience, with the feeling of having been well cared for with no sense of discrimination or injustice done. The majority also reported that their autonomy was respected in the treatment decisions. The evaluation of these attitudes is an area of opportunity, especially when the patients' vulnerability is at risk. Conclusions The ethics of virtue offers a better reflection of how human beings manifest themselves by emphasizing the development of virtuous character and behaviors that allow them to realize their values in life. The COVID-19 pandemic has impacted medical care in many ways; previously, a patient would enter a hospital and had an approximate idea of what would happen upon his admission, the physician informed them about it, but in the last two years this scenario has changed. Therefore, our aim was to identify if bioethical principles are present in the physician–patient relationship and the effect of these in the health care provided, through an observational and descriptive study where patients answered the validated (...) ReMePaB questionnaire that measures the presence of bioethical principles in the physician–patient relationship, on the seventh day of their hospital stay and 24 h after discharge, during the period from 1 August to 5 November 2020. In autonomy, an improvement in the score was observed in the second application compared to the first measurement; in the principle of non-vulnerability, the same scenario was observed for the first and second measurements, respectively. In the principles of beneficence, dignity, and justice, no statistically significant differences were observed. Considering the presence or absence of bioethical aspects in health care in this pandemic creates an area of opportunity to know the feelings of the patient during the care received and to maintain what is done well and improve those aspects that can be improved. This project consisted of conducting a survey to medical students from three medical schools in Mexico City with (...) different ethical and humanistic ideas with the aim of evaluating knowledge about IVF techniques and their ethical implications. The survey was applied to 404 medical students. Students in schools with personalistic ethics had a greater recognition of the bioethical principles involved in the use of these techniques. But what is the message of China's rise as an economic and political power? Tongdong Bai addresses this pressing question by examining the history of political theories and practices from China's past, and showing how it impacts upon the present. World problems are intercultural, requiring sensitivity to cultural integrity in order to resolve them. Wu Kuang-ming has been grappling with cultural clashes at their boundary for half a century, insisting that we must first let Chinese thinking be Chinese, not Western, leading thereby to a truly fruitful China-West and West-China interculture. Wu has been proposing how to do so in a dozen published volumes and beyond. During the autumn of 1949, Hannah Arendt completed the manuscript of The Origins of Totalitarianism. On 1 October of the same year, the People’s Republic of China was founded under the leadership of Mao Zedong. This article documents Arendt’s claim in 1949 that the prospects of totalitarianism in China were ‘frighteningly good’, and yet her ambivalent judgment, on the eve of the Cultural Revolution, about the totalitarian character of the Maoist regime. Despite being the premier theorist of totalitarian formations, Arendt’s (...) interest in China was half-hearted and her analysis often wildly inaccurate. The concern of this paper, however, is less with the veracity of her remarks, than with a counterfactual question. If Arendt had known what we know now, would she have considered Maoist China to be a totalitarian regime? Put another way: to what extent is our modern picture of Mao’s regime consistent with Arendt’s depiction of the Soviet Union under Stalin or Germany under Hitler? While Arendt got many of her facts wrong, her theory of totalitarianism — as shapeless, febrile, voracious of human flesh, and endlessly turbulent — was in good measure applicable to Mao’s regime, even though she failed to recognize it. We explore how we get markets where previously there were no markets and draw on White’s central themes of ‘uncertainty’, ‘value’ and ‘order’. We maintain a distinction, with White and with Frank Knight, of risk, on the one hand, and uncertainty, on the other, where ‘risk’ has to do with entities that are in principle (...) insurable or calculable and ‘uncertainty’ has to do with what is not calculable/insurable. An entrepreneur’s decision to enter a market, to invest in and enter a production market, entails what White calls a ‘commitment to facilities’. China, which has made a major economic breakthrough, has become one of the most important actors in international politics by increasing its military power in recent years. China's increasing power and influence in the international arena arouses increasing curiosity about the country's foreign policy. With Xi Jinping becoming president, China began to display a more assertive attitude or behavior on many issues. This study basically seeks an answer to the question of what differences Xi Jinping brought to Chinese foreign policy. (...) What kind of changes do these differences lead to in Chinese foreign policy? In this study, the general tendencies and directions of Chinese foreign policy during the Xi Jinping period are discussed. The assertive foreign policy approach that Xi Jinping is trying to implement is analyzed. In this context, the visions of "Chinese dream", "new type of great power relations", "new type of international relations", “Belt and Road Initiative" and "a community with a common future for humanity", which reflect Xi's assertive foreign policy approach, are examined. At the same time, challenges to the assertive foreign policy implemented under Xi Jinping are discussed. The study mainly questions the extent to which Xi Jinping's assertive foreign policy approach is successful. The study concludes that Xi Jinping's active foreign policy approach has not increased China's sphere of influence in the international arena to the extent expected. As China becomes more visible in the international arena, the country's foreign policy challenges seem to be increasing. (shrink)

The relationship between the People’s Republic of China and the Republic of India has traditionally been seen in terms of the interaction of two different trends—cooperation and competition. At the same time, the positive or negative dynamics of China–Indian contacts have mostly been shaped by the extent to which the political leadership of China and India have been prepared at various times to be guided by pragmatic interests and the desire to overcome the legacy of the past. This set of (...) problems includes long-standing territorial disputes, New Delhi’s suspicions of the “all-weather strategic partnership” between Beijing and Islamabad, as well as the sensitive issues of Tibet and the Dalai Lama. Although the idea of ChIndia, as a condominium of the global interests of the two Asian giants and a manifestation of their growing interdependence, is no longer relevant, this article argues that cooperation or confrontation between China and India should not be linked solely to historical matters, but should be viewed from a broader regional and international perspective. Two different kinds of collections have been used to anticipate influenza pandemics: viral strains and bird specimens. These collections have been organized in museums and data banks to fill the gaps when specimens were decaying or when viral strains were missing. This article asks how collecting practices changed when such collections integrated specimens from China, considered a reservoir of influenza viruses and bird species, following a recurrent critical trope that Chinese specimens were missing. The article shows that techniques for hunting (...) viruses and birds were used to accumulate information so as to mitigate the global threat of species extinction. It suggests that in sentinel territories, museums transform samples and specimens into signs and images of future catastrophic events. (shrink)

Since 2004, Nanyan Cao and some other scholars have implicitly or explicitly claimed that engineering ethics in China is importantly different from engineering ethics in the United States. The evidence for that claim relies on examination of official documents or certain large features of Chinese society. Though neither is an uncommon approach to studying engineering ethics in China, neither actually studies engineering practice in China. This article does—or at least gets much closer. The authors have asked almost two hundred Chinese (...) engineers about what they do and why they do it. The responses suggest that Chinese engineers, or at least those surveyed, think about engineering ethics much as American engineers do. The responses also suggest that much more empirical work needs to be done before we can claim to understand either the similarities or differences between engineering ethics in China and engineering ethics in “the West.”. What is feminist philosophy? A difficult question for feminist scholars in China. Women's studies in the Chinese mainland are characteristically policy‐oriented, geared to practical concerns and moral urgency. Empirical research projects engage many pressing social issues related to the changing situation of women in a rapid marketification of society and commercialization of culture since the post‐1978 reform movement. Here are some examples: migrant female workers and their working conditions in the urban centers; the impact of rural industrialization on women in (...) the countryside: discrimination against women in employment as well as in other aspects of social life; marriage and sexual relations. What follows in this article however, represents an effort to identify and categorize trends in emerging feminist theories. The main questions that might be seen as in one way or another philosophical are located in the historical context of the transformation of Chinese socialism. As we have only very limited access to publications in Hong Kong and Taiwan, to avoid mispresentation we regret that we cannot discuss the feminist work developed in these areas. (shrink)

By blending multiple strands of thought into one ideology, Chinese Syncretists of the pre-imperial period created an essential guide to contemporary ideas about self, society, and government. Merging traditions such as Ruism, Mohism, Daoism, Legalism, and Yin-Yang naturalism into their work, Syncretists created an integrated intellectual approach that contrasts with other, more specific philosophies. Presenting the first full English translation of the earliest example of a Syncretist text, this volume introduces Western scholars to both the brilliance of the syncretic method (...) and a critical work of Chinese leadership. Written by Shi Jiao, China's first syncretic thinker, during the Warring States Period of 481 to 221 BCE, _Shizi_ is similar to Machiavelli's _The Prince_ in that it dispenses wisdom to would-be rulers. It stresses the need for leaders to be detached and objective. It further encourages self-cultivation and effective government, recommending that rulers maintain self-discipline, hire reliable people, delegate power transparently, and promote others in an orderly fashion. The people, it is argued, will emulate their leader's wisdom and virtue, and a just and peaceful state will result. Paul Fischer provides an extensive introduction and a chapter-by-chapter summary and analysis of the text--outlining the importance of syncretism in Chinese culture--and explores the text's particular features, authorship, transmission, loss, and reconstruction over time. The _Shizi_ set the stage for a long history of syncretic endeavor in China, and its study provides insight into the vital traditions of early Chinese philosophy. It is also a template for interpreting other well-known works, such as the Confucian _Analects_, the Daoist _Laozi_, the Mohist _Mozi_, and the Legalist _Shang jun shu_. (shrink)

This pre-Qin dynasty recluse produced what is considered the earliest Chinese treatise devoted entirely to the art of persuasion. Called Guiguzi after its author, the text provides an indigenous rhetorical theory and key persuasive strategies, some of which are still used by those involved in decision making and negotiations in China today. In "Guiguzi," China's First Treatise on Rhetoric, Hui Wu and C. Jan Swearingen present a new critical translation of this foundational work, which has great historical significance for the (...) study of Chinese rhetoric and communication and yet is little known to Western readers. The paper discusses the Chinese policy environment as regards the experiences of foreign firms in China. In particular, the study focuses on the changes in China’s policies toward foreign-invested firms and the companies’ perceptions of protectionism of the Chinese regulatory environment. Theoretically, the paper reflects approaches in international political economy and business studies on the bargaining relations between host states and firms, and institutional perspective on business strategy that focuses on the dynamic interaction between organizations and their institutional environment. Hence, (...) the approach takes into account the formal and informal institutional constraints that firms face in a particular institutional framework. Drawing from international survey data, as well as interviews with China-based Finnish firms, the paper analyzes the different types of formal and informal protectionism that foreign companies face in China. It is found that foreign firms perceive the Chinese policy measures as increasingly protective, strict toward foreigners, and favoring of local companies. This is based on China’s strategy to remove the earlier preferences for inward foreign direct investment and to support, instead, the growth of indigenous companies. At the same time, the Chinese market presents such a potential that attracts foreign firms to increasingly invest in the country. China has a strong position in competing for investments: its aspiration for higher technology, together with its labor resources, gives China an unique advantage in bargaining with foreign firms over investments. In the 1920s, John Dewey's followers in China, led by his student Hu Shih, attempted to put his pragmatism into practice in their quest for democracy. This essay compares Hu Shih's thought, especially his emphasis on pragmatism as method, with Dewey's philosophical positions and evaluates Hu's achievement as a pragmatist in the context of the tumultuous times he lived in. It assesses Hu's claim that the means to democracy lies in education rather than politics, since democracy as a way of (...) life requires a cultural renewal beyond institutional changes. It argues that a problem‐centered approach to social change does not preclude radical action, even revolution. But pragmatism is against gratuitous use of violence in the service of wholesale and abstract ideals advocated by various “isms.” While Hu's experiment of democracy in China is a significant episode in the history of pragmatism, its “failure” does not prove that there are inherent flaws in the pragmatist method, that pragmatism is unviable for China. The failure needs to be understood in the context of the pragmatist conception of experiment, in which failures are to be expected; what is important is to learn from them to achieve better results in the next stage of inquiry. Hu Shih's pragmatism contains lessons for pragmatists and for those interested in the continued quest for democracy in China—the experiment continues. (shrink)
