The Director-General of the WHO has suggested that China’s approach to the COVID-19 crisis could be the standard of care for global epidemics. However, as remarkable as the Chinese strategy might be, it cannot be replicated in other countries and certainly not in Europe. In Europe, there is a distribution of power between the European Union and its member states. In contrast, China’s political power is concentrated in the central government. This enables it to take immediate measures that affect the (...) entire country, such as massive quarantines or closing borders. Moreover, the Chinese legal framework includes restrictions on privacy and other human rights that are unknown in Europe. In addition, China has the technological power to easily impose such restrictions. In most European countries, that would be science fiction. These conditions have enabled China to combat epidemics like no other country can. However, the WHO might have been overoptimistic. The Chinese standard of care for treating COVID-19 also raises problematic issues for human rights, and the real consequences of these actions remain to be seen. (shrink)

Although Chinese law imposes informed consent for medical treatments, the Chinese understanding of this requirement is very different from the European one, mostly due to the influence of Confucianism. Chinese doctors and relatives are primarily interested in protecting the patient, even from the truth; thus, patients are commonly uninformed of their medical conditions, often at the family’s request. The family plays an important role in health care decisions, even substituting their decisions for the patient’s. Accordingly, instead of personal informed consent, (...) what actually exists is ‘family informed consent’. From a Western perspective, these features of Chinese law and Chinese culture might seem strange, contradicting our understanding of doctor-patient relationship and even the very essence of self-determination and fundamental rights. However, we cannot forget the huge influence of cultural factors in these domains, and that ‘Western’ informed consent is grounded on the individualistic nature of Western culture. This article will underline the differences between the Western and the Chinese perspectives, clarifying how each of them must be understood in its own cultural environment. But, while still respecting Chinese particularities, this paper advocates that China adopt patient individual informed consent because this is the only solution compatible with human dignity and human rights. : In Research on Religious Funerary Documents in China, the author studies the religious funerary documents used at funerals for more than two thousand years from the Warring-States period to the present with the truth-seeking and objective attitudes. Besides some criticisms and reasonable doubts, he points out that the previous articles present a somewhat lopsided view with prejudice when the scholars interpret the existing literature. He further explores the underlying implications of the archaeological materials based on studying large numbers of (...) references. In this way, reliable conclusions are obtained with rigorous academic attitude. Resumo: Em Research on Religious Funerary Documents in China, o autor adere às atitudes objetivas e de busca da verdade e questiona as ideias dos principais estudiosos, ao analisar os documentos funerários religiosos usados em funerais por mais de dois mil anos, desde o período dos Estados Combatentes até o presente. O autor critica os pontos de vista de alguns estudiosos famosos e apresenta dúvidas razoáveis a esse respeito. Ele ressalta que seus artigos exibem uma visão um tanto desigual e preconceituosa, na interpretação da literatura existente. Ele ainda seleciona a literatura para um nível mais profundo e explora as implicações subjacentes dos materiais arqueológicos. Dessa forma, são obtidas conclusões, mostrando a abordagem acadêmica dos autores. (shrink)

La antigua sociedad china abarcó cinco mil años, la tendencia social del pensamiento cambiaba constantemente, y el sistema de vestimenta también se actualizaba constantemente. Resumo: O artigo investiga a seguinte hipótese: o homo friabilis tem se tornado uma nova condição para a compreensão humana emergente da experiência contemporânea. O homo friabilis é uma experiência de fragmentação, no sentido de friável, ou seja, aquilo que se fragmenta facilmente, esboroa-se, ou em sua aquisição mais figurativa, desagrega-se. Para tanto, parte-se de uma questão teórica situada por Deleuze e Guattari em Mil Platôs acerca da complexa relação da potência-impotência do poder na produção de subjetivação. Ver-se-á que tal (...) perspectiva diz respeito ao coeficiente afetivo dos sujeitos. Nesse caso, o sujeito contemporâneo estaria padecendo de uma cleptoafetividade, entendida como roubo da potência de agir e demanda maior à adaptação aos circuitos afetivos padronizados. Ao explorar esse cenário, o artigo sustenta que não se pode ignorar o impacto de tais mutações para se avançar nas pesquisas concernentes às ciências humanas. Palavras-chave: Subjetivação. Afetos. The rise of homo friabilis: subjectivation in klepto affectivity times: The article investigates the following hypothesis: the homo friabilis has become a new condition for the emerging human understanding of contemporary experience. The homo friabilis is an experience of fragmentation, meaning friable, i.e., that which breaks up easily, crumbles up, or in its figurative acquisition, disintegrates. To this purpose, it starts from a theoretical question posed by Deleuze and Guattari in Thousand Plateaus about the complex power-powerlessness relation of power in the production of subjectivation. It will be seen that such perspective concerns the affective coefficient of the subjects. In this case, the contemporary subject would be suffering from klepto affectivity, understood as theft of the power to act and demands greater adaptation to the standardized affective circuits. In exploring this scenario, the paper argues that the impact of such mutations cannot be ignored to advance research on the humanities. Key-words: Subjectivation. Affections. Homo friabilis. ObjectiveThe aim of the study was to explore the relationship among gratitude, meaning in life, career calling, and career goal self-efficacy of the pre-service teachers in the Free Teacher Education program in China and the internal mechanism of action.MethodsIn this study, gratitude, MIL, career calling, and CGSE questionnaires were used to investigate 801 pre-service teachers. IBM SPSS 25.0 and AMOS 24.0 were used for data processing, and SPSS macro program Model 6 was used for the mediating mechanism.Results Gratitude was positively (...) correlated with MIL and career calling. MIL was positively correlated with career calling. Gratitude, MIL, and career calling were significantly and positively associated with CGSE. Gratitude influences pre-service teachers’ CGSE mainly through the independent intermediary of MIL and career calling, and the chain intermediary of MIL→career calling, three indirect effects.ConclusionGratitude indirectly predicts CGSE of pre-service teachers not only through the independent intermediary of MIL and career calling but also through the chain intermediary of MIL and career calling. Many arguments have been made against gene editing. This paper addresses the commonly invoked argument that gene editing violates human dignity and is ultimately a subversion of human nature. There are several drawbacks to this argument. Above all, the concept of what human dignity means is unclear. It is not possible to condemn a practice that violates human dignity if we do not know exactly what is being violated. The argument’s entire reasoning is thus undermined. Analyses of the arguments involved (...) in this discussion have often led to the conclusion that gene editing contravenes the principle of genetic identity (genetic immutability) thereby subverting a requisite of human dignity and ultimately threatening human nature. This paper refutes these arguments and shows that any opposition to gene editing cannot rely on the human dignity argument. (shrink)

In a time marked by the development of innovative treatments in healthcare and the need for health professionals to deal with resulting ethical dilemmas in clinical practice, this study was developed to determine the influence of the bioethics teaching on the moral competence of medical and nursing students. The authors conduct a longitudinal study using the Moral Competence Test extended version before and after attending the ethics curricular unit, in three nursing schools and three medical schools of Portugal. In this (...) questionnaire the participant is confronted with three ethical dilemmas and asked to evaluate arguments for and against the attitude of the main character. For both nursing and medical students, C-score was lower after the attendance of the ethics curricular units, with a statistically significant decrease in the total score for nursing students and a decrease not statistically significant for medical students. A multivariate analysis did not find any association between this decrease and gender, course, or age. The phenomenon of moral segmentation was observed, with better performance in the worker and judge dilemma, than in the doctor dilemma. These results highlight the need to reflect on the curricular strategies that can be implemented for health professionals to better develop moral competence and decision-making, allowing for the provision of humanized health care. We show that in the Maxwell–Lorentz theory of classical electrodynamics most initial values for fields and particles lead to an ill-defined dynamics, as they exhibit singularities or discontinuities along light-cones. This phenomenon suggests that the Maxwell equations and the Lorentz force law ought rather to be read as a system of delay differential equations, that is, differential equations that relate a function and its derivatives at different times. This mathematical reformulation, however, leads to physical and philosophical consequences for the ontological (...) status of the electromagnetic field. In particular, fields cannot be taken as independent degrees of freedom, which suggests that one should not add them to the ontology. (shrink)

The events surrounding COVID-19, combined with the mandatory quarantines widely imposed in Asia and Europe since the virus outbreak, have reignited discussion of the balance between individual rights and liberties and public health during epidemics and pandemics. This article analyses this issue from the perspectives of precaution and necessity. There is a difficult relationship between these two seemingly opposite principles, both of which are frequently invoked in this domain. Although the precautionary principle encourages the use of quarantines, including mandatory quarantines, (...) and associated restrictive measures, the principle of necessity puts a break on such measures. The COVID-19 pandemic reveals once again the different interrelations between these two principles. However, the alleged conflict between the PN and the PP is based on a superficial analysis. The relation between these two principles is far more complex, as this article will demonstrate. (shrink)

According to the doctrine of Super-Humeanism, the world’s mosaic consists only of permanent matter points and changing spatial relations, while all the other entities and features figuring in scientific theories are nomological parameters, whose role is merely to build the best law system. In this paper, I develop an argument against Super-Humeanism by pointing out that it is vulnerable to and does not have the resources to solve the well-known problem of immanent comparisons. Firstly, I show that it cannot endorse (...) a fundamentalist solution à la Lewis, since its two pillars—a minimalist ontology and a best system account of lawhood—would generate, together, a tedious problem of internal coherence. Secondly, I consider anti-fundamentalist strategies, proposed within Humeanism, and find them inapplicable to the Super-Humean doctrine. The concern is that, since it is impossible to choose the best law system within Super-Humeanism, this doctrine may be charged with incoherence. (shrink)

The slight recognition that the idea of obligation to society has received in modern morality has Greek and Roman rather than Christian roots. So, even in the morals of private life - everything in it from generosity, nobility, personal dignity, even a sense of honor - has its origin purely a humanitarian, not a religious part of our education, and these qualities could never evolve from those ethical standards where the only explicitly recognized value is humility.

In this article, I confront Garvey’s argument that a weak-willed individual deserves partial excuse for trying to resist a strong desire that pushes him toward commission of a criminal act even though in the end he unreasonably abandons his resistance and commits the crime. I attempt to refute Garvey’s argument on two counts: one, I question whether the law should indeed provide mitigation to such an offender; and two, I argue that, even if it should, this mitigation may not come (...) in the form of a partial defense. Defenses, even partial, are desert based, and there is nothing in Garvey’s offender’s circumstances that makes him less blameworthy for the crime he committed. A court may choose to treat such an offender more leniently but it should not be mandated to do so. (shrink)

The abstract notion of “the feminine”, —in French, le f minin, and in German, das Weibliche —as substantivum neutrum, remains together with its opposite, the masculine, connotative of an inherent disparity. It is meant neither as the biological affiliation of sex, nor as gender, the social response, or echo, of this biological affiliation. Rather, it is the spiritual attitude which is the norm for psychic manifestations in general, and is its subtle psychosomatic background. It is not necessarily connected with the (...) rude biological differentiation of sex, but rather appears as a quality in one or the other form; either as the individual, the social group or forms of activities, etc., without respect to the biological manifestations of the participants. What this paper attempts to demonstrate, is the way in which the above described notion of the feminine, functions in classical Asian cultures and philosophies. In the famous Yijing, for instance, this is seen as the hexagram correlated to the male Qian; in the philosophy of Yin and Yang, as Yin the Earth, in correlation with Yang, the Heaven; which are united in the famous Taiji diagram, a sophisticated development of Chinese Neo-Confucianism. The paper focuses on the Dao de jing, in which Lao Zi gives, as a counterbalance to the existing praxis, priority to the female principle. He remains, however, faithful to the Asian tradition, maintaining that the masculine and the feminine should remain equal, correlative, neither one nor the other vying for dominance. The correlative embrace, “When you know the male yet hold on to. the female” subsists in the mythical past where both principles are joined in androgynous unity. (shrink)

Comprehensive regulatory changes brought on by recent corporate governance reforms have broadly redefined and re-emphasized the roles and responsibilities of all the participants in a public company’s financial reporting process. Most notably, these reforms have intensified scrutiny of corporate audit committees, whose role as protectors of investors’ interests now attracts substantially higher visibility and expectations. As a result, audit committees face the formidable challenge of effectively overseeing the company’s financial reporting process in a dramatically changed – and highly charged – (...) corporate governance environment. This paper discusses the new expectations of audit committee responsibilities and effectiveness in the wake of corporate governance reforms, key challenges, “whistleblower” provisions and shortcomings, and provides some directions for future research. ABSTRACTPrevious research suggests that labelling emotions, or describing affective states using emotion words, facilitates emotion regulation. But how much labelling promotes emotion regulation? And which emotion regulation strategies does emotion labelling promote? Drawing on cognitive theories of emotion, we predicted that labelling emotions using fewer words would be less confusing and would facilitate forms of emotion regulation requiring more cognitively demanding processing of context. Participants mentally immersed themselves in an emotional vignette, were randomly assigned to an exhaustive or minimal emotion (...) labelling manipulation, and then completed an emotion regulation strategy planning task. Minimal emotion labelling promoted higher subjective emotional clarity. Furthermore, in terms of specific emotion regulation strategies, minimal emotion labelling prompted more plans for problem solving and marginally more plans for reappraisal, but did not affect plans for behav... A central tenet of Heil's ontological conception is a no-levels account of reality, according to which there is just one class of basic properties and relations, while all higher-level entities are configurations of these base-level entities. I argue that if this picture is not to collapse into an eliminativist picture of the world – which, I contend, should be avoided –, Heil's ontological framework has to be supplemented by an independent theory of which configurations of basic entities should count as (...) complex entities. However, such an amendment represents a substantial ontological enhancement, so that the ensuing ontological picture is not as parsimonious as Heil claims it to be. (shrink)

We argue that the epistemic functions of replication in science are best understood by their role in assessing kinds of experimental error. Direct replications serve to assess the reliability of an experiment through its precision: the presence and degree of random error. Conceptual replications serve to assess the validity of an experiment through its accuracy: the presence and degree of systematic errors. To illustrate the aptness of this view, we examine the Hubble constant controversy in astronomy, showing how astronomers have (...) responded to the concordances and discordances in their results by carrying out the different kinds of replication that we identify, with the aim of establishing a precise, accurate value for the Hubble constant. We contrast our view with Machery’s “re-sampling” account of replicability, which maintains that replications only assess reliability. (shrink)

Im Beitrag werden Veränderungen der Kommunikation durch digitale Medien, ihre psychischen Bedeutungen und Folgen, u. a. anhand von empirischen Befunden zu Social-Media-Praktiken von Jugendlichen und von Eltern thematisiert. Bezugsrahmen der Analyse sind dabei kulturelle Wandlungen sowie soziale und psychische Bedeutungen von Aufmerksamkeit: geteilte Aufmerksamkeit als ein Kern der Kommunikation, aber auch die für psychische Entwicklung notwendige geschenkte, für den anderen oder für anderes offene Aufmerksamkeit als ein wesentliches Moment der Zuwendung, Empathie und Bezogenheit – im Gegensatz zu selbstbezogener Aufmerksamkeit und (...) instrumenteller Aufmerksamkeitslenkung. Aspects of the current practice of prenatal diagnostics in Russia are surveyed. In the light of this, various ethical concerns are highlighted: (1) the requirement of parental informed consent to testing is not always sufficiently respected either in state regulation or in the practice of physicians; (2) not all Russian physicians are aware of international guidelines or standards of good practice in areas such as non-directive counselling, patient confidentiality with respect to genetic information and the patient’s right to maintain control (...) over his or her information; (3) abortion is viewed increasingly as an aspect of preventive medicine. The utility of recognising emotion expressions for coordinating social interactions is well documented, but less is known about how continuously changing emotion displays are perceived. The nonlinear dynamic systems view of emotions suggests that mixed emotion expressions in the middle of displays of changing expressions may be decoded differently depending on the expression origin. Hysteresis is when an impression (e.g., disgust) persists well after changes in facial expressions that favour an alternative impression (e.g., anger). In expression changes based on photographs (...) (Study 1) and avatar images (Studies 2a–c, 3), we found hystereses particularly in changes between emotions that are perceptually similar (e.g., anger–disgust). We also consistently found uncertainty (neither emotion contributing to the mixed expression was perceived), which was more prevalent in expression sequences than in static images. Uncertainty occurred particularly in changes between emotions that are perceptually dissimilar, such as changes between happiness and negative emotions. This suggests that the perceptual similarity of emotion expressions may determine the extent to which hysteresis and uncertainty occur. Both hysteresis and uncertainty effects support our premise that emotion decoding is state dependent, a characteristic of dynamic systems. We propose avenues to test possible underlying mechanisms. The aim of this paper is to define a notion of supervenience which can adequately describe the systematic dependence of extrinsic as well as of intrinsic higher-level properties on base-level features. We argue that none of the standard notions of supervenience—the concepts of weak, strong and global supervenience—fulfil this function. The concept of regional supervenience, which is purported to improve on the standard conceptions, turns out to be problematic as well. As a new approach, we develop the notion of property-dependent (...) supervenience. This notion is founded on a criterion of relevance adapting the supervenience base to the considered higher-level properties in a specific way, such that only features which are relevant to the instantiation of the higher-level properties under consideration are taken into account. One dimension of cognitive success concerns getting it right: having many true beliefs and no false ones. Another dimension of cognitive success concerns using the right concepts. For example, using a concept of a person that systematically excludes people of certain demographics from its extension is a sort of cognitive deficiency. This view, if correct, tasks inquirers with critically examining the concepts they are using and perhaps replacing those concepts with new and better ones. This task is often referred to (...) as “conceptual engineering”. However, so far it is unclear what exactly happens in cases of conceptual engineering. How does language change when we engineer a concept? This article offers an answer. I propose a view on which, when speakers assess the truth of propositions, they often rely on assumptions with regard to what is required for their truth. For example, when speakers assess whether unborn fetuses are people, they rely on assumptions with regard to what is required to be a person. Based on this idea, I develop a model of conceptual engineering according to which speakers “engineer concepts” when they change how they assess the truth of propositions.
