This article presents the results of the analysis of a number of linguistic metaphors found in a corpus of opinion articles published in the Spanish newspaper El País. The authors included in the corpus, who tend towards the left of the political spectrum, use metaphor to express moral judgements on the actions and decisions of the conservative, centre-right People’s party, which governs Spain with an overall majority. With the aim of describing this discourse, we have undertaken a qualitative analysis with (...) a conceptual framework deriving from CDA and cognitive linguistics. First, therefore, we have made use of the methodology developed by Steen and the Pragglejaz group to extract the discourse units that could be considered as the lexical expression of an underlying mapping between domains, that is, the metaphors; second, according to the descriptions of Talmy, Croft, Sweetser, Sullivan, and Dancygier and Sweetser, we have verified that the different types of grammatical structure in which the lexical items appeared also indicated the existence of a metaphorical thought process; and third, in the words of van Dijk, we have studied the ideological semantics underlying conceptual structures and conceptual content. As we have demonstrated, all the samples of linguistic metaphors found led readers to construct the same interpretation of the meaning: The Spanish People’s party government is the past, a past that provokes rejection and which was thought to be definitively ended. Este artículo trata sobre las violencias entre estudiantes y las aborda como constitutivas de la conformación de un entramado de vinculación juvenil en la escuela media; allí donde se juegan cotidianamente procesos identitarios que implican la tensión entre identificación y diferenciación, a través de la re-constitución de taxonomías sociales. Dentro de la tradición de investigación cualitativa nos centramos en la perspectiva narrativa de análisis, en base a la cual construimos un esquema analítico que fue aplicado a micro relatos de situaciones (...) conflictivas entre jóvenes de primer año de escuelas secundarias de Córdoba, Argentina. II), una de las obras farmacológicas más importantes de la historia de la medicina. En este artículo compararemos desde una perspectiva filológica la entrada que Galeno dedicó a este simple en dos de sus traducciones medievales: la árabe de Ḥunayn ibn Isḥāq (s. IX) y la latina de (...) Gerardo de Cremona (s. XII). Nuestro análisis ayudará a profundizar en el estudio de estas dos traducciones y en la técnica de Gerardo de Cremona, el traductor más prolífico de obras de medicina griega y árabe al latín en la Edad Media. Far from offering an atemporal imaginary universe that bears no resemblance to historical specificity, romance is constructed as a response to it. Rather than simply projecting for the reader the naïve appeal of a prelapsarian escapism from the harsh realities of history, romance involves a continuous and sophisticated reinvention (...) of itself as a response to an ever-changing historico-political configuration. It is, in fact, a reciprocal relationship. We frequently see history appropriating romance paradigms explicitly, as, for example, when Bernal Díaz chooses to present Spain’s New World conquest and colonization as a continuation of the exploits of Amadís [see Gilman].Whatever form it takes, romance is committed to the celebration of a coherent system of socio-political values. This extra-textual frame of reference can take a variety of forms—from political propaganda that offers a self-aggrandizing depiction of the nobility or patron for whom the text is produced, to escapist fantasy—futuristic or archaizing. It is nostalgia for the lost world of chivalric romance which Cervantes embodies in the figure of Don Quijote, a foolish old man driven mad by his obsession with this perennial literary form. Cervantes is rightly credited with a brilliant and programmatic use of romance constructs to communicate the ongoing historical crisis of the Spanish empire. A byproduct of this romance scrutiny of history was his invention of the modern novel.Testimony to the long-standing interaction between romance and history in Spain, as elsewhere in Europe, is evident in the fact that its first romances were based on history, the so-called “romances of antiquity.” In those texts historical figures and events are evoked for the purpose of legitimating the present, vernacular poets as they celebrate the empowering myths projected by their society, as well as their own literary endeavors by invoking venerable Latin models. The well known translatio studii et imperii topos offers such allegory of empire.At the same time, the confrontation of romance and historical representation can also have a destabilizing effect, and this is programmatically explored in Pedro del Corral’s Crónica sarracina (c. 1430). His text ponders the possibilities of romance and historiography in an obsessive manner and he accomplishes his task by examining representation of the most iconic figures associated with the fall of Spain in 711, namely, La Cava and her father, Count Julián, King Rodrigo, and Pelayo, the messianic hope of the Reconquest effort which would last nearly 800 years.Of related and perhaps even broader importance, Corral’s text merits careful reading because its exploration of iconicity related to Spain’s fall offers meditations on the workings of ideology, which inevitably proposes “imaginary or formal solutions to unresolvable contradictions” [Jameson 79]. Ideology—its unmasking—is intriguingly posited by Corral in powerful ways.If we turn to Corral’s text, we find a work offering an extraordinary consideration of history and romance—their profound interaction—whose full title reads, La crónica [End Page 119] del rey don Rodrigo con la destrucción de España (The Chronicle of King Rodrigo with the Destruction of Spain). This paper elucidates how the thinking about opposition that we find in the surviving passages of Anaxagoras of Clazomenae and in the fragments of Heraclitus of Ephesus informs discussions of the separability of the body and the soul in the Phaedo. I offer a reconstruction of the way in which these pre-Socratic ideas of opposition are appropriated and refracted in Plato’s Phaedo (especially at 85e–86e, 92a–95a, 102c–e, 102b–107a). I treat Anaxagoras first, in order to explicate how his ideas make up (...) the background of the dialogical study of the separation of the soul from the body (102b–107a). My analysis of Heraclitus comes second and shows how his ideas inform the interlocutors’ assessment of the unity characteristic of the body and the soul (92a–95a). I set the stage for the discussion of Anaxagoras and Heraclitus by relating these thinkers to the broader Pythagorean background that is apparent in the dialogue. (shrink)

New technologies provide great opportunities for cultural heritage to become more widely accessible and for cultural experience to be more meaningful. The COVID-19 pandemic has highlighted the strengths and vulnerabilities of the cultural heritage sector and the need to accelerate its digital transformation to make the most of the opportunities it provides. The Commission Recommendation on the digitisation and online accessibility of cultural material and digital preservation (2011/711/EU) concluded that there is an urgent need to protect and preserve European cultural (...) heritage, and, in particular, endangered cultural heritage is still present. However, the diversity of legal approaches to cultural heritage by the Member States discourages the creation of a common European data space for cultural heritage as the European Commission recently proclaimed. In Greece, there have been significant efforts in recent decades to digitise and digitally preserve cultural heritage goods. However, the attention was not drew upon the accessibility and reuse of the digitized cultural heritage content. According to the relevant regulatory framework the existing rules on the use of digital technologies for the reproduction, use and preservation of cultural heritage content is obviously outdated. According to the paragraphs 4 and 5 of article 46 of the Greek Code for the protection of antiquities and cultural heritage in general (Law 4858/2021), a previous permission granted by the Ministry of Culture is required for the production, reproduction and dissemination to the public of impressions, copies or depictions of monuments belonging to the Public Sector, or immovable monuments that are located within archaeological sites and historical places or are isolated, or movable monuments that are kept in museums or public collections, in any way and by any means whatsoever, including Information Communication Technologies. Such permission is granted to natural or legal persons for a fee paid to the Hellenic Organization of Cultural Resources Development (HOCRED) upon the decision of the Minister of Culture, while the decision also specifies the temporal validity of the permission, the terms on which the permission is granted and the fee that must be paid. The production, reproduction and use of the aforementioned goods for other purposes, such as artistic, educational or scientific purposes, is again allowed for a fee paid to HOCRED, however, the fee can be waived upon the decision of the Minister of Culture. This Paper will examine the existing Greek legal framework and will attempt to propose an appropriate framework that will ensure open access to the digitized cultural heritage assets, enhance the recovery and transformation of the cultural heritage sector and support cultural heritage institutions in becoming more empowered and more resilient in the future. Are feelings an essential part or aspect of emotion? Cases of unconscious emotion suggest that this is not the case. However, it has been claimed that unconscious emotions are better understood as either (a) emotions that are phenomenally conscious but not reflectively conscious, or (b) dispositions to have emotions rather than emotions proper. Here, I argue that these ways of accounting for unconscious emotions are inadequate, and propose a view of emotions as non-phenomenal attitudes that regard their contents as relevant (...) to one's motivations. Human emotional expressions can communicate the emotional state of the expresser, but they can also communicate appeals to perceivers. For example, sadness expressions such as crying request perceivers to aid and support, and anger expressions such as shouting urge perceivers to back off. Some contemporary artificial intelligence (AI) systems can mimic human emotional expressions in a (more or less) realistic way, and they are progressively being integrated into our daily lives. How should we respond to them? Do we have reasons (...) to reply to the appeals made by AI emotional expressions? In this paper, we examine the conditions under which AI emotional expressions could give us prudential or even moral reasons to change our behavior. We argue that these conditions do not depend on whether the emotional expression is genuine or not, but rather on the presence of features some of which can be implemented in emotive AI given our current level of technological development. We extract recommendations and warnings for the development of emotive AI. (shrink)

In emotion research, both conceptual analyses and empirical studies commonly rely on emotion reports. But what do people mean when they say that they are angry, afraid, joyful, etc.? Building on extant theories of emotion, this paper presents four new studies (including a pre-registered replication) measuring the weight of cognitive evaluations, bodily changes, and action tendencies in people’s use of emotion concepts. The results of these studies suggest that the presence or absence of cognitive evaluations has the largest impact on (...) people’s emotion attributions, and that bodily changes and action tendencies are considered to depend on cognitive evaluations. This paper investigates the role that universities play in supporting social entrepreneurs (SEs) across their ecosystem. Adopting the resource-based view (RBV) approach, we argue that universities attract, mobilize, and deploy multiple resources that benefit SEs through four main mechanisms (i.e., teaching, research, outreach, and the development of partnerships). We use a qualitative approach of 62 semi-structured interviews and 8 focus groups in Ecuador, Bolivia, and Colombia. Our contribution shows that employing different resources and engaging in supportive activities of universities towards (...) SEs facilitate the development of university capabilities, such as an increased reputation, development of leadership skills for students and staff, and wider access to ecosystem resources that support other university activities related to teaching, research, and community outreach. The role that partnerships play in the development of these capabilities is fundamental, thanks to the different strategic alliances and mobilization of resources between universities and other actors while supporting SEs. This study contributes to our understanding of the role universities can play to intensify the nature of supportive ecosystems for SEs. This contribution is relevant not only to academics but also to practitioners, as this will shed light on the building, development, and scaling of a supportive ecosystem for SEs. (shrink)

The debate over the determination of death has been raging for more than fifty years. Since then, objections against the diagnosis of brain death from family members of those diagnosed as dead-have been increasing and are causing some countries to take novel steps to accommodate people’s beliefs and preferences in the determination of death. This, coupled with criticism by some academics of the brain death criterion, raises some questions about the issues surrounding the determination of death. A proliferation of tests exists for the assessment of auditory-verbal memory processes. However, from a clinical practice perspective, the situation is less clear when it comes to the ready availability of reliable and valid tests for the evaluation of visual/visuo-spatial memory processes. While, at face value, there appear to be a wide range of available tests of visual/visuo-spatial memory, utilizing different types of materials and assessment strategies, a number of criticisms have been, and arguably should be, leveled at the majority (...) of these tests. The criticisms that have been directed toward what are typically considered to be visual/visuo-spatial memory tests, such as the potential for verbal mediation, over-abstraction of stimuli, the requirement of a drawing response, and the lack of sensitivity to unilateral brain lesions, mean that, in reality, the number of readily available valid tests of visual/visuo-spatial memory is, at best, limited. This article offers a critical, historical review on the existing measures and resources for the neuropsychological assessment of visual/visuo-spatial memory, and it showcases some examples of newer tests that have aimed to overcome the challenges of assessing these important aspects of memory. The article also identifies new trends and examples of how technological advances such as virtual reality may add value to overcome previous obstacles to assessment, thereby offering professionals more reliable, accurate means to evaluate visual/visuo-spatial memory in clinical practice. This paper focuses on the consolidation of Molecular Evolution, a field originating in the 1960s at the interface of molecular biology, biochemistry, evolutionary biology, biophysics and studies on the origin of life and exobiology. The claim is made that Molecular Evolution became a discipline by integrating different sorts of scientific traditions: experimental, theoretical and comparative. The author critically incorporates Timothy Lenoir’s treatment of disciplines , as well as ideas developed by Stephen Toulmin on the same subject. On their account disciplines (...) are spaces where the social and epistemic dimensions of science are deeply and complexly interwoven. However, a more detailed account of discipline formation and the dynamics of an emerging disciplinary field is lacking in their analysis. The present essay suggests focusing on the role of scientific concepts in the double configuration of disciplines: the social/political and the epistemic order. In the case of Molecular Evolution the concepts of molecular clock and informational molecules played a central role, both in differentiating molecular from classical evolutionists, and in promoting communication between the different sorts of traditions integrated in Molecular Evolution. The paper finishes with a reflection on the historicity of disciplines, and the historicity of our concepts of disciplines. (shrink)

This article aims to explore how epistemic status is negotiated during talk about the life memories of one speaker. Direct questions which foreground ‘remembering’ can lead to troubled sequences of talk. However, interlocutors sometimes frame their first parts as ‘co-rememberings’, and the sequential positioning of these can be crucial to the outcome of the talk. We draw on almost 10 hours of video data from dementia settings, where memory is a talked-about matter. Our focus is on 30 sequences which are (...) initiated with a question or other first part taking a K-stance, selecting one person as next speaker, and topically relating to the recipient’s past life. We show how type 2 knowables can be used alongside markers of tentativeness, to jointly construct the recipient’s epistemic primacy. (shrink)

This study assessed the International Critical Thinking Essay Test (ICTET-A) for inter-rater reliability, internal reliability, and criterion validity. A self-selecting sample of participants (N = 100) completed the ICTET-A and a comparison test online. We found the ICTET-A items to have moderate to good levels of inter-rater reliability, and overall excellent inter-rater consistency for total test scores. The test had good internal reliability. There was a strong correlation between scores on the ICTET-A and the comparison test. Factor analysis showed that (...) scores were best explained with one factor, suggesting the test measures a single construct. The ICTET-A can therefore be considered a valid measure of critical thinking. Additionally, we propose a short form of the test. (shrink)

This paper presents the collective reflection of a temporary community of inquiry (COI) created during an international workshop at the 20th biennial ICPIC conference--“Philosophy In And Beyond the Classroom: P4wc Across Cultural, Social, and Political Differences”-- and the suggestions emerging from that event. The workshop, entitled “Pedagojazz—improvising and inquiring, community interplay”, was conducted via Zoom, but participants were both online and present in person. The topic focused on the pedagojazz perspective, and the short activities proposed were aimed at involving the (...) (temporary) COI in a collective discussion about how it would be possible to transform a community of inquiry into an inquiring-jazzing community. Three premises were introduced as common background on which to develop our reflections: the pedagojazz perspective; the connection between pedagojazz idioms and the different roles of the facilitator in P4wC; and the idea that jazz, and collective improvisation in particular, can inform COI development. The principles and practices of pedagojazz and collective improvisation are presented in detail here. During the workshop, Zoom chat and the Wooclap site were used to involve all participants and to gather their contributions and suggestions. A word cloud and three tables were produced and are presented here. Interesting themes, questions and perspectives emerged that can help us reflect in a more complex way on the education of P4wC facilitators across cultural, social and political differences. Cybersecurity aggregates are numerical data obtained by aggregation on features along a database of cybersecurity reports. These aggregates are obtained by integration of time-stamped tables using some recent results of non-standard calculus. Time-series of aggregates are shown to contain relevant information about the concrete system dealt with. Trend time series is also forecasted using known data-driven methods. Although absolute forecasting of trend time series is not obtained, a directional forecasting of trend time series is achieved thence validated by means of (...) a rolling cross validation scheme on a public database of Scareware reports. Are emotions bodily feelings or evaluative cognitions? What is happiness, pain, or “being moved”? Are there basic emotions? In this chapter, I review extant empirical work concerning these and related questions in the philosophy of emotion. This will include both (1) studies investigating people’s emotional experiences and (2) studies investigating people’s use of emotion concepts in hypothetical cases. Overall, this review will show the potential of using empirical research methods to inform philosophical questions regarding emotion.

We study 944 shareholder proposals submitted to 343 U.S. firms on climate change issues during 2009–2022. We use logistic and two-stage regression to estimate the propensity for a firm to be targeted or subjected to a vote at the annual general meeting and, for voted proposals, the determinants of that vote. We also examine whether climate-related proposals affect investor returns and how they relate to firms’ future environmental performance and greenhouse gas emissions. Compared to a matched sample, we first find (...) that activists target larger, more carbon-intensive, and less R&D-active firms. Second, voting likelihood is higher for firms with repeated and operations-related proposals and lower pre-proposal environmental ratings. By contrast, disclosure-related proposals are likelier to be negotiated and withdrawn. Third, repeated and operations-related proposals receive higher votes in favor, whereas votes on carbon-intensive firms do not. Fourth, building on the theory that investors act as if they distinguish among the different shareholder proposals based on the expected cost to the firm, we find evidence to support this idea. We find that investors respond negatively to ex-ante costlier proposals, such as those that relate to emissions reduction and target carbon-intensive firms. Fifth, targets’ future environmental performance rating is almost twenty percent higher after a proposal than before compared to the matched sample, whereas emissions do not budge appreciably. Este artículo presenta una lectura crítica de la filosofía de Enrique Dussel, donde se consideran los quiebres y continuidades de su proyecto ético temprano y maduro. El objetivo de la investigación es explorar y exponer el pensamiento del autor en relación con las problemáticas, críticas y polémicas que presenta. Para esto se esclarecen las posiciones éticas y políticas tempranas de su filosofía, la atingencia de la crítica de Horacio Cerutti, la estructura de la ética madura, el debate con Karl-Otto Apel, (...) la estructura de la política de la liberación y la crítica de Santiago Castro-Gómez. Education is a fundamental pillar in human development, and its evolution throughout history has been influenced by a variety of factors, including imaginative culture and human nature. In this study, we explore how educational methods have evolved in response to the interaction between these two aspects. We look at how human creativity, imagination, and adaptation have influenced the way we teach and learn, from early forms of knowledge transmission to more contemporary approaches focused on active student engagement and the development (...) of practical skills. Our research is based on a comprehensive review of the academic literature in the fields of education, evolutionary psychology, cultural anthropology, and imagination studies. We explore how societies have used imagination as a tool to transmit knowledge and values, as well as to foster creativity and individual expression. We also examine how adaptive aspects of human nature, such as the ability to learn collaboratively and adapt to changing environments, have influenced the way educational methods are designed. Our results show a clear evolution in educational methods over time, from approaches focused on the one-way transmission of knowledge to more interactive and participatory models that encourage exploration and discovery. We identify common patterns in the way societies have used imagination and adaptation to promote learning and socialization and discuss the implications of these findings for contemporary education. In conclusion, this study highlights the importance of understanding the relationship between imaginative culture, human nature, and education. It provides a solid foundation for the design of educational methods that harness the innate creativity and adaptability of human beings and offers guidance for educators and policymakers on how to promote meaningful and lasting learning in today's world. Three arguments summarize opposition to laws protecting LGBTQ+ persons from discrimination: (1) The pseudo-democratic argument (social change should be free of governmental coercion); (2) The clinical argument (homosexuality is an illness); (3) The choice argument (homosexuality is a choice). My purpose is to show the three are vulnerable to damaging objections. This article reflects conditions as they were in 1987 in the USA. For example, the expression LGBTQ+ had not been coined. Background and Objectives People living with dementia have historically been excluded from qualitative research and their voices ignored due to the perception that a person with dementia is not able to express their opinions, preferences and feelings. Research institutions and organizations have contributed by adopting a paternalistic posture of overprotection. Furthermore, traditional research methods have proven to be exclusionary towards this group. The objective of this paper is to address the issue of inclusion of people with dementia in research and (...) provide an evidence-based framework for dementia researchers based on the five principles of human rights: Participation, Accountability, Non-discrimination and equality, Empowerment and Legality (PANEL). Design This paper adapts the PANEL principles to the research context, and uses evidence from the literature to create a framework for qualitative research in people with dementia. This new framework aims to guide dementia researchers in designing studies around the needs of people with dementia, to improve involvement and participation, facilitate research development and maximize research outcomes. Results A checklist is presented with questions related to the five PANEL principles. These questions cover ethical, methodological and legal issues that researchers may need to consider while developing qualitative research for people with dementia. Conclusions The proposed checklist offers a series of questions and considerations to facilitate the development of qualitative research in patients with dementia. It is inspired by current human rights work of recognized dementia researchers and organizations who have been directly involved in policy development. Future studies need to explore its utility in improving participation, facilitating ethics approvals and ensuring that outcomes are relevant to people with dementia. (shrink)

For companies involved in the supply chain, proper warehousing management is crucial. Warehouse layout arrangement and operation play a critical role in a company’s ability to maintain and improve its competitiveness. Reducing costs and increasing efficiency are two of the most crucial warehousing goals. Deciding on the best warehouse layout is a remarkable optimization problem. This paper uses an optimization method to set bin allocations within an automated warehouse with particular characteristics. The warehouse’s initial layout and the automated platforms limit (...) the search and define the time required to move goods within the warehouse. With the help of historical data and the definition of the time needed to move goods, a mathematical model of warehouse operation was created. An optimization procedure based on the well-known Variable Neighbourhood Search algorithm is defined and applied to the problem. Experimental results demonstrate increments in the efficiency of warehousing operations. (shrink)

En el presente trabajo intentamos realizar un ejercicio filosófico reflexivo de la noción de ecosofía de Félix Guattari, desde un entrecruzamiento con la estética, las micropolíticas y la educación. Expandiendo los resultados conceptuales de un trabajo de investigación realizado sobre ecología y biopolítica en la educación, nos interesa problematizar las tramas microfísicas con las que el Capitalismo Mundial Integrado gestiona las afecciones y produce las subjetividades sensibles que hoy habitan en las instituciones educativas. Con ello, pretendemos pensar las posibles prácticas (...) de libertad o revoluciones moleculares, con las cuales habitar los espacios pedagógicos y vitales, en medio de una avanzada intensificación temática de las emociones en las agendas educativas. Finalmente, como última instancia, deseamos pensar la educación desde la interacción de las tres ecologías, mentales, sociales y cosmológicas, delineando un horizonte posible para desplegar el imaginario de una práctica ecosófico-estética en los haceres pedagógicos. During the course of this article, we examine the use of membership categorisation practices by a high-profile celebrity public social media account that has been understood to generate interest, attention and controversy across the UK media ecology. We utilise a data set of harvested tweets gathered from a high-profile public ‘celebrity antagonist’ in order to systematically identify types of antagonistic formulation that have generated different levels of interest within the social media community and beyond. Drawing from classic ethnomethodological studies of (...) banner headlines and other means of generating public interest and ‘making sense’, we respecify high-profile antagonistic tweets as category formulations that exhibit particular and regular membership category features that are reflexively bound to potential antagonistic readings, interest and controversy. In conclusion, we consider how such formulations may be understood to represent resources that constitute ignition points within antagonistic flows of communication and information that can be metaphorically understood as ‘digital wildfires’. Lo icónico siempre se ha empleado para vehicular conocimientos de un modo propio con distintos grados de validez. En este artículo se busca pensar esta cuestión a propósito del fenómeno pictorial de nuestra época: las “nuevas imágenes técnicas”. Así, tras delimitar sus características, se especificarán sus modulaciones en el campo científico, tomando las neuroimágenes como estudio de caso, y en el artístico, haciendo hincapié en el arte algorítmico. Se pondrán en tela de juicio cinco nociones estético-epistémicas: verdad, realidad, novedad, imaginación (...) y creatividad; perfilando finalmente la posibilidad de genuina creatividad en la estética algorítmica a partir del concepto de “probabilidad’’. La filosofía deleuziana ha pasado por reiteradas críticas desde la ortodoxia de la academia, debido a su fuerte impronta de innovación en muchos de los aspectos estrictamente disciplinares que la filosofía tradicionalmente ha tomado como propios. En el presente trabajo, siguiendo fundamentalmente la propuesta de su última obra ¿Qué es la filosofía? (1991), se intenta un retrato de la concepción deleuziana de la filosofía, entendida como creación de conceptos, a partir de una serie de movimientos (dramatizar, fabular e intervenir) que (...) subyacen a la elaboración conceptual de la filosofía. Estos movimientos se entienden como operaciones coextensivas con la tríada deleuziana de trazar el plano de inmanencia, inventar personajes conceptuales y crear conceptos. En definitiva, se propone una posible lectura de la filosofía deleuziana como una actividad lúdica que pervierte los ámbitos y procedimientos habituales de la filosofía occidental. (shrink)

After two years of discussions and revisions, the World Anti-Doping Agency (WADA) published the 2021 World Anti-Doping Code on June 16, 2020. Among the most significant additions to this iteration of the Code was the inclusion of new categories of athletes subject to differential treatment by WADA, including the “protected person” category. In this paper, we examine the recent case of figure skater Kamila Valeryevna Valieva, the first athlete given differential treatment due to her being categorized as a “protected person.” (...) We apply a relational justice framework to the case to provide a nuanced, descriptive analysis of the case generally, and the application of the “protected person” category in particular.We first describe details of the athlete, her performances and anti-doping rule violation, and the “protected person” category, to provide context. We then describe and analyze the relations between several institutional actors, principally WADA and the International Court for the Arbitration of Sport (CAS), the athlete and her team, and other figure skating athletes at the Beijing Winter Olympic Games. To do so, we use two concepts of justice, conservative and ideal, and their component parts, entitlement, desert, and need.Our description and analyses demonstrate that (1) WADA’s notions of justice are essentially conservative, while CAS acted toward more ideal notions, creating a fundamental disagreement in what was owed and to whom. We show (2) that CAS’ decision may have nonetheless caused harm to the athlete, raising questions about the efficacy and capability of the “protected person” category. Finally, (3) our analyses show the influence that notions of justice necessarily have these actors shape each other, thus change the sporting institutions and activities themselves. (shrink)

RESUMEN Este artículo propone reinterpretar la noción de cuerpo en la filosofia de Nietzsche contrastada con dos perspectivas relevantes de los estudios nietzscheanos en habla hispana: primero, la idea de que el cuerpo es sinónimo de naturaleza; y segundo, la idea de que el cuerpo es causa del sujeto. Pasando la mirada sobre una parte de la obra -publicada e inédita- de Nietzsche posterior al año 1885, se observa que la noción de cuerpo funge el papel de una metodologia que (...) permite llevar a cabalidad una renovada tarea de su filosofia, a saber, la tarea de conocerse a si mismo. Asi, la noción de cuerpo en Nietzsche, más allá de ser un concepto innovador o reivindicado, es una herramienta interpretante que le permite al autor establecer nuevas dimensiones "entre" el conocer y la experimentación corporal. ABSTRACT This paper proposes a re-interpretation of the idea of Body in Nietzsche's philosophy to distinguish it from two important perspectives of Nietzsche-studies in Spanish: The first one maintains that the Body is comparable with Nature, and the second one, states that the Body is a cause of subjectivity. Analyzing part of Nietzsche's work after 1885 -published and unpublished- shows that the idea of the Body works as a methodology that allows Nietzsche to accomplish a new task of his philosophy, such as the task of self-knowledge. In this way, the Body in Nietzsche's philosophy, besides being an innovative and redeemable concept, is a performative tool that establishes new dimensions "in-between" human knowing and bodily experimentation.
