From the above framework and context, ethnographies conducted in two educational establishments, during 2014-2018, will be analyzed. In them, it is possible to identify two relevant argumentative axes that account for the production of women as second-class subjects, accentuating the analysis in the crossing between the forms of economization of life in a neoliberal key, and the implications of this from a gender perspective. Black Feminist Sociology offers new writings by established and emerging scholars working in a Black feminist tradition. The book centers Black feminist sociology within the sociology canon and widens is to feature Black feminist sociologists both outside the U.S. and the academy. Inspired by a BFS lens, the essays are critical, personal, political and oriented toward social justice. Key themes include the origins of Black feminist sociology, expositions of BFS orientations to research that extend disciplinary norms, and contradictions of the (...) pleasures and costs of such an approach both academically and personally. Authors explore their own sociological legacy of intellectual development to raise critical questions of intellectual thought and self-reflexivity. In the context of multidimensional measures of well-being, a key question for policy is whether particular groups have differing priorities and are therefore likely to react differently to given economic or social shocks. We explore this issue by presenting the results of two related analyses that suggest positive answers on both counts. First, we apply reference class weights to unique data on adult capabilities in the UK and show that relative weights vary across some groupings. Furthermore, in some cases, deprivation (...) rankings of groups vary depending on which weights are used. Second, we explore possible behavioural consequences of different weights by examining the extent to which groups respond differently to three economic and social shocks (unemployment, widowhood and ill health). In this case, we find that weights and responses vary noticeably with age and region and sometimes with gender. We conclude that whilst equal weighting may be practically unavoidable when constructing indices of welfare in the absence of information on weights, their estimation from survey or experimental data is likely to be justified and may change views about policy needs or efficacy. En esta discusión abordo la hermenéutica analógica de Mauricio Beuchot comparándola con la hermenéutica filosófica de Hans-Georg Gadamer. Argumento que Beuchot vuelve a la idea clásica de la hermenéutica como método de interpretación y no la juzga, como Gadamer, como una fenomenología de la comprensión. Sin embargo, Beuchot no atiende las razones de Gadamer en contra de concebir la hermenéutica como una metodología. Si se considera como metodología centrada en la analogía, la hermenéutica analógica deja de lado otros recursos interpretativos (...) importantes. Finalmente, Beuchot adopta una teoría correspondentista de la verdad contra la que argumenta Gadamer y que es incompatible con una hermenéutica filosófica. In this paper I analyze Mauricio Beuchot's analogical hermeneutics by contrasting it with Hans-Georg Gadamer's philosophical hermeneutics. I argue that Beuchot goes back to the classical idea of hermeneutics as a method of interpretation, and does not see it, as Gadamer does, as a phenomenology of understanding. However, Beuchot does not address Gadamer's arguments against using hermeneutics as a methodology. Considered as a methodology centered on analogy, analogical hermeneutics overlooks other important interpretation resources. Finally, Beuchot adopts a correspondence theory of truth, which Gadamer objects and is incompatible with philosophical hermeneutics. (shrink)

This article examines the phenomenology of body shame in the context of the clinical encounter, using the television program ‘Embarrassing Bodies’ as illustrative. I will expand on the insights of Aaron Lazare’s 1987 article ‘Shame and Humiliation in the Medical Encounter’ where it is argued that patients often see their diseases and ailments as defects, inadequacies or personal shortcomings and that visits to doctors and medical professionals involve potentially humiliating physical and psychological exposure. I will start by outlining a phenomenology (...) of shame in order to understand more clearly the effect shame about the body can have in terms of one’s personal experience and, furthermore, one’s interpersonal dynamics. I will then examine shame in the clinical encounter, linking body shame to the cultural stigma attached to illness, dysfunction and bodily frailty. I will furthermore explore how shame can be exacerbated or even incited by physicians through judgment and as a result of the power imbalance inherent to the physician-patient dynamic, compounded by the contemporary tendency to moralise about ‘lifestyle’ illnesses. Lastly, I will provide some reflections for how health care workers might approach patient shame in clinical practice. (shrink)

Examines the lived experience of social encounters drawing on phenomenological insights.

In this article I focus on two issues concerning bioethics in Argentina: reproductive health and ethics in research. Although these topics are quite dissimilar, they share a particular feature: their special relationship with context.

In this article, the authors focus on Argentina's activity in the developing field of regenerative medicine, specifically stem cell research. They take as a starting point a recent article by Shawn Harmon (published in this journal) who argues that attempts to regulate the practice in Argentina are morally incoherent. The authors try to show first, that there is no such ‘attempt to legislate’ on stem cell research in Argentina and this is due to a number of reasons that they explain. (...) Second, by examining the role played by different values, conflicting legal and moral views, and the influence of various actors, they attempt to show that the legislative silence regarding stem cell research may not necessarily be a manifestation of a legal/moral disconnection but rather a survival strategy for navigating the long and heated battle on the moral status of the embryo and the kind of treatment it deserves. This paper analyzes a book on the afterlife, The Ransom of the Soul: Afterlife and Wealth in Early Western Christianity, by the well known scholar Peter Brown, published in English in 2015 and translated into Italian in 2016. The Author proceeds by examining thoroughly Brown’s insights and conclusions.

This article examines the problems that research ethics confronts in developing countries and the impact that research in developing countries has had on research ethics. In order to show this it analyzes the first paradigmatic cases that gave rise to the ‘classic’ analysis of research ethics. Hence, in this article, many of the ethical concerns apply wherever research is conducted and are not particular to developing countries. Secondly, the article describes the complex process of research by analyzing different research actors (...) and their interests in the current research process. Thirdly, it sketches some of the recent cases that have prompted fierce ethical debate surrounding research in developing countries. (shrink)

In this musing we consider how social distancing, the primary public health measure introduced to mitigate the spread of the COVID-19 virus, is creating social encounters characterized by a self-and-other-consciousness and an atmosphere of suspicion, leading to what we call “alienated embodied communication.” Whilst interaction rituals dominated by avoidance, fear and distrust are novel for many individuals who occupy positions of social privilege, Black and ethnic minority writers have demonstrated that the alienated bodily communication of COVID-19 social distancing is “nothing (...) new” for people who routinely experience marginalization as a result of racism. Our aim in this musing, then, is to reflect on how on-going experiences of stigma, shame, and marginalization can shape how social distancing is registered on an embodied and existential level, and therefore how social distancing may differentially impact individuals with lived experiences of racism. Experiences of shame are not always discrete, but can be recurrent, persistent or enduring. To use the feminist phenomenologist Sandra Lee Bartky’s formulation, shame is not always an acute event, but can become a “pervasive affective attunement” (Bartky, 1990 : 85). Instead of experiencing shame as a discrete event with a finite duration, it can be experienced as a persistent, and perhaps, permanent possibility in daily life. This sort of pervasive or persistent shame is commonly referred to as “chronic shame” (...) (Pattison, 2000 ; Nathanson, 1992 ; Dolezal, 2015 ). Chronic shame is frequently associated with political oppression and marginalization. In chronic shame, it is the potentiality of shame, rather than the actuality, that is significant. In other words, the anticipation of shame (whether explicit or implicit) comes to be a defining feature of one’s lived experience. Living with chronic shame has important socio-political consequences. Thus far, chronic shame has eluded simple phenomenological analysis, largely because chronic shame often does not have a clear experiential profile: it is frequently characterised by the _absence_ rather than the _presence_ of shame. The aim of this article is to provide a phenomenology of chronic shame, drawing from Edmund Husserl’s formulation of the ‘horizon’ as a means a to discuss structural aspects of chronic shame experiences, in particular how chronic shame is characterised by structures of absence and anticipation. Through positing that our capacity for physical vulnerability is at the core of original shame, Sartre’s account in Being and Nothingness reveals shame as an essential structure of human existence. Reading Sartre’s ontological account of ‘pure shame’ alongside recent writing about shame in early child development, particularly Martha Nussbaum’s account of ‘primitive shame,’ this article will explore the inherent links between shame, the body and vulnerability, ultimately positing that our human need for belonging is the fundamental driving force behind shame, (...) and what gives it its ontological status. In short, this article will argue that shame is not merely about a painful awareness of one’s flaws or transgressions with reference to norms and others, but about a deeper layer of relationality through our bodily vulnerability. Jean-Paul Sartre's account of the Look in Being and Nothingness is not straightforward and many conflicting interpretations have arisen due to apparent contradictions in Sartre's own writing. The Look, for Sartre, demonstrates how the self gains thematic awareness of the body, forming a public and self-conscious sense of how the body appears to others and, furthermore, illustrates affective and social aspects of embodied being. In this article, I will critically explore Sartre's oft-cited voyeur vignette in order to provide a coherent (...) account of the Look and to illustrate the significance of intersubjectivity and self-consciousness in Sartre's work. Through considering Sartre's voyeur vignette and other examples of reflective self-consciousness, this article will examine epistemological, self-evaluative and ontological concerns in the constitution of reflective self-consciousness. It will be contended that Sartre's accounts of the Look and reflective self-consciousness within social relations can provide insight into the intersubjective nature of the shaping of the body and the significance of self-presentation within the social realm. This paper will examine the experience of and drive for bodily invisibility in women through the theoretical approaches of phenomenology and social constructionism. An examination of the social disruptions of bodily invisibility and the compulsive avoidance of such instances, particularly with respect to the fastidious maintenance of body comportment and appearance within the narrow parameters afforded by social norms, will lead to an exploration of the conflation of biomedicine with the beauty industry.

Previous studies have addressed many different kinds of confessions in police investigations – real, false, coerced, fabricated – and highlighted both psychological and social mechanisms that underlie them. Here, we focus on inadvertent confessions and admissions, which occur when a suspect appears to be confessing without being fully aware of doing so, or when police officers believe they have a confession or admission of guilt when in fact this is not the case. The goal of the study is to explain (...) when, how and why these confessions and admissions occur as well as how they are dealt with in two different jurisdictions, the United States and the United Kingdom. We use a discourse analysis approach because inadvertent confessions and admissions of guilt are the product of miscommunication – they happen because the speaker’s meaning and the hearer’s meaning are misaligned. The data consist of 50 interviews from the United Kingdom and 50 interrogations from the United States with both English-speaking and non-English speaking suspects. Our results demonstrate that inadvertent confessions can occur in both locales due to reliance on inference, which is inevitable since inference is the backbone of any human communication, as well as due to additional factors such as linguistic, cultural and procedural issues. We found that these phenomena are more frequent and less well controlled for in the United States context due to no systematic checking of understanding, adversarial questioning techniques and an absence of legal representation, and lack of professional, high-quality interpreting. We discuss the implications of our findings for current efforts to improve access to justice, custodial procedures and language services, and we make recommendations for the implementation of our research in professional practice. Self-presentation is a term that indicates conscious and unconscious strategies for controlling or managing how one is perceived by others in terms of both appearance and comportment. In this article, I will discuss the phenomenology of self-presentation with respect to the phenomenological insights of Edmund Husserl and Merleau-Ponty regarding the visibility of the body within intercorporeal relations through ‘behaviour’ and ‘expression.’ In doing so, I will turn to the work of the Canadian sociologist and social theorist Erving Goffman. Goffman’s account (...) of self-presentation suggests why embodied subjects adopt certain styles of ordered bodily behaviour as determined by the broader social order, giving existential and social significance to the ontological structures of intercorporeal bodily communication. Following Goffman, I will suggest that the embodied subject is continuously—and constitutionally—engaged in implicit and explicit strategies to manage how the body is presented to others. In articulating self-presentation as a feature of intercorporeality, my aim in this article is to use Goffman’s insights to extend Husserl’s and Merleau-Ponty’s accounts of bodily communication by demonstrating that bodily communication that is instantiated at the level of intercorporeality is always expressed through social life with its various historical, cultural and linguistic dimensions. This target article considers the ethical implications of providing prenatal diagnosis (PND) and antenatal screening services to detect fetal abnormalities in jurisdictions that prohibit abortion for these conditions. This unusual health policy context is common in the Latin American region. Congenital conditions are often untreated or under-treated in developing countries due to limited health resources, leading many women/couples to prefer termination of affected pregnancies. Three potential harms derive from the provision of PND in the absence of legal and safe abortion (...) for these conditions: psychological distress, unjust distribution of burdens between socio-economic classes, and financial burdens for families and society. We present Iran as a comparative case study where recognition of these ethical issues has led to the liberalization of abortion laws for fetuses with thalassemia. We argue that physicians, geneticists and policymakers have an ethical and professional duty of care to advocate for change in order to ameliorate these harms. (shrink)

The concept of vulnerability is widely used in bioethics, particularly in research ethics and public health ethics. The traditional approach construes vulnerability as inherent in individuals or the groups to which they belong and views vulnerability as requiring special protections. Florencia Luna and other bioethicists continue to challenge traditional ways of conceptualizing and applying the term. Luna began proposing a layered approach to this concept and recently extended this proposal to offer two new concepts to analyze the concept (...) of vulnerability, namely understanding external conditions that trigger vulnerability and layers of vulnerability with cascading effects. Luna's conception of vulnerability is useful, which we demonstrate by applying her layered view and the new analyses in multiple contexts. We begin by outlining Luna's view and we use vignettes from healthcare involving transgender patients, the care of patients in psychiatric contexts, and research involving prisoners to illustrate how each part of Luna's concept elucidates important moral issues. This work is an effort to philosophize about the scientific words we must use to describe behaviors. It was written as an essay thus it is left here for further development; the issue before us is an ethological one, it addresses the question: which words are the most convenient to use in rigorous behavioral studies in order to produce scientific knowledge? We discuss the historical and philosophical roots of this behavioral-scientific problem. We admit anthropomorphic inference of organisms’ behaviors, as a (...) mean to create scientific-novel knowledge. We present two examples –based on the ethological study of triatomines –, where our anthropomorphic approach resulted in the discovery of novel meanings. (shrink)

La intuición no es tratada por la etología, lo cual la excluye de los animales no humanos, sin embargo, psicólogos, neurólogos y filósofos reconocen que la intuición, del latín intueri «mirar hacia dentro», es percibir y decidir instantáneamente, sin la participación de la razón, y con la intervención de la parte más primitiva del sistema nervioso central de los animales humanos. La fenomenología apela a la experiencia intuitiva como fundamento del estudio de la realidad, manifiesta al ser, tal como es. (...) La intuición se asocia con experiencias previas, y de acuerdo al controversial misticismo cuántico: incluso con el futuro. Pero no se puede explicar con claridad racional, sino con expresiones emotivas, de por qué, luego de procesar tal información, se llega a tal conclusión, decisión o creación. La intuición es un fenómeno de animales humanos, y de animales no humanos, y más que eso. Es un fenómeno de las cosas vivas. The objective of this article is double: first, to analyze, using a descriptive analysis, the main differences in the level and components of social behaviour between European and North American firms and, second, to contrast empirically, using a multiple linear regression model, whether the motives behind corporate social behaviour are different depending on the region or country of the firm. With this aim, an indicator of social behaviour (termed effort in sustainability) has been constructed by aggregating the firm's social effort (...) with customers, employees, community and environment for a sample of the 40 European and North American companies most highly reputed in the years 2003 and 2004. The results obtained indicate that the region or country of the firm influences the level, components and motivation of its social behaviour. (shrink)

This compact and innovative book tackles one of the central issues in drug policy: the lack of a coherent conceptual structure for thinking about drugs. Drugs generally fall into one of seven categories: prescription, over the counter, alternative medicine, common-use drugs like alcohol, tobacco and caffeine; religious-use, sports enhancement; and of course illegal street drugs like cocaine and marijuana. Our thinking and policies varies wildly from one to the other, with inconsistencies that derive more from cultural and social values than (...) from medical or scientific facts. Penalties exist for steroid use, while herbal remedies or cold medication are legal. Native Americans may legally use peyote, but others may not. Penalties may vary for using different forms of the same drug, such as crack vs. powder cocaine. Herbal remedies are unregulated by the FDA; but medical marijuana is illegal in most states. Battin and her contributors lay a foundation for a wiser drug policy by promoting consistency and coherency in the discussion of drug issues and by encouraging a unique dialogue across disciplines. The contributors are an interdisciplinary group of scholars mostly based at the University of Utah, and include a pharmacologist, a psychiatrist, a toxicologist, a trial court judge, a law professor, an attorney, a diatary specialist, a physician, a health expert on substance abuse, and Battin herself who is a philosopher. They consider questions like the historical development of current policy and the rationales for it; scientific views on how drugs actually cause harm; how to define the key notions of harm and addiction; and ways in which drug policy can be made more consistent. They conclude with an examination of the implications of a consistent policy for various disciplines and society generally. The book is written accessibly with little need for expert knowledge, and will appeal to a diverse audience of philosophers, bioethicists, clinicians, policy makers, law enforcement, legal scholars and practitioners, social workers, and general readers, as well as to students in areas like pharmacy, medicine, law, nursing, sociology, social work, psychology, and bioethics. In this article I examine several criticisms of the concept of vulnerability. Rather than rejecting the concept, however, I argue that a sufficiently rich understanding of vulnerability is essential to bioethics. The challenges of international research in developing countries require an understanding of how new vulnerabilities arise from conditions of economic, social and political exclusion. A serious shortcoming of current conceptions of vulnerability in research ethics is the tendency to treat vulnerability as a label fixed on a particular subpopulation. My (...) paper examines the role of this “label” metaphor in current statements of research ethics. In contrast to this prevailing “label” metaphor, my own positive account of vulnerability develops a dynamic way of understanding the structure of the concept of vulnerability based on the idea of “layers of vulnerability.” I examine several cases involving women, as they are sometimes labeled as a vulnerable population and sometimes not. My analysis demonstrates the essential role of this revised concept of vulnerability in bioethics and research ethics. (shrink)

Through exploring some of the foundational and structural aspects of the experience of home from a feminist perspective, this article will draw from Iris Marion Young’s reflections on home, female experience and embodiment to argue that home is central to our ontological and subjective constitution. While acknowledging that home can be a problematic concept in the socio-political realm, particularly for feminist thinkers, this article contends that a feminist reading of the phenomenology of home is crucial to understanding some of the (...) foundational features of human subjectivity. In doing so, it will explore aspects of some existing phenomenological accounts of home and dwelling which posit that home is an ontological structure, outlining a feminist phenomenology of home that explores three interwoven aspects: (1) home as forming an on-tological ground of human subjectivity; (2) home as a gendered space; (3) and pregnant embodiment as the “first home.” Dans cet article, nous explorerons quelques aspects fondamentaux de l’expérience du « chez-soi » dans une perspective féministe, inspirée par les réflexions d’Iris Marion Young à propos du chez-soi, de l’expérience féminine et du corps vécu. Nous affirmerons que le chez-soi est au centre de notre constitution ontologique et subjective. Tout en prenant acte du caractère problématique du « chez-soi » dans le champ sociopolitique, et ce, tout particulièrement pour les philosophes féministes, nous soutiendrons qu’une approche féministe de la phénoménologie du « chez-soi » est nécessaire pour comprendre plusieurs aspects fondamentaux de la subjectivité hu-maine. Pour ce faire, nous présenterons d’abord quelques théories phénoménologiques existantes du chez-soi et de l’habitation [dwelling] qui considèrent le chez-soi comme une structure ontologique. Ensuite, nous insisterons sur trois aspects entrelacés d’une phénoménologie féministe du chez-soi : (1) le chez-soi comme fondation ontologique de la subjectivité humaine; (2) le chez-soi comme un espace genré; et (3) l’expérience corporelle d’être enceinte comme le « premier chez-soi ».
