As the world's leader inavocado production, Mexico produces anestimated 900,000 tons/year, of which the stateof Michoacán produces 83% of nationalproduction and 40% of world avocado productionwithin five regional districts. In 1914 theUnited States imposed a phytosanitary banagainst Mexican avocado exports to the USmarket, a non-tariff barrier that stood despiteNAFTA. This paper examines increasedstandardization of product quality in avocadoas a political process in Michoacán duringthe 1980s and 1990s, during which differentregional groups and firms struggled to imposetheir standards and defend their economicinterests (...) in the market. In the 1990s, alliedwith the Mexican government, elite avocadogrowers mounted a phytosanitary campaign thatconvinced the USDA and US government to liftthe ban and allow Mexican avocado imports intothe US market in 1997. Since 1997 the Mexicangovernment has expanded Michoacán'sphytosanitary campaign, imposing internationalstandards on all avocado growers, even thoseproducing for the national market. By expandingthe campaign and institutionalizing newstandards of quality, industry experts nowconsciously link phytosanitary quality tocommercial quality. They propose atransformation of previously acceptedproduction and post-harvest practices.Theoretically, increased standards of quality,accompanied by systematic methods of evaluationand verification, should benefit all producers.However those growers producing for thenational market adhere to new rules designed toimprove product quality yet receive noimmediate, tangible economic benefits. Thiscase study demonstrates that theinstitutionalization of product standards iscarried out within an existing politicalsystem. Understanding whose standards countrequires careful analysis of how powerfulactors in specific agricultural industriesreshape and define standards of quality interms that benefit themselves. The incredible achievements of modern scientific theories lead most of us to embrace scientific realism: the view that our best theories offer us at least roughly accurate descriptions of otherwise inaccessible parts of the world like genes, atoms, and the big bang. In Exceeding Our Grasp, Stanford argues that careful attention to the history of scientific investigation invites a challenge to this view that is not well represented in contemporary debates about the nature of the scientific enterprise. The historical (...) record of scientific inquiry, Stanford suggests, is characterized by what he calls the problem of unconceived alternatives. Past scientists have routinely failed even to conceive of alternatives to their own theories and lines of theoretical investigation, alternatives that were both well-confirmed by the evidence available at the time and sufficiently serious as to be ultimately accepted by later scientific communities. Stanford supports this claim with a detailed investigation of the mid-to-late 19th century theories of inheritance and generation proposed in turn by Charles Darwin, Francis Galton, and August Weismann. He goes on to argue that this historical pattern strongly suggests that there are equally well-confirmed and scientifically serious alternatives to our own best theories that remain currently unconceived. Hermann Cohen hat mit seiner wissenschaftslogischen Kantinterpretation und programmatischen Orientierung der Erkenntnislehre am ‚Faktum der Wissenschaft‘ das Verständnis von transzendentaler Logik bis in die Gegenwart maßgeblich mitgeprägt. Der zentrale Punkt seiner Kantinterpretation ist die Identifikation der „transzendentalen Methode“ mit der „regressiven Lehrart“ der Prolegomena und damit die Ersetzung der metaphysischen Deduktion der Kategorien durch eine wissenschaftstheoretische Rekonstruktion der synthetischen Grundsätze der mathematischen Naturwissenschaft. UMI Number: 3319553 This study is a historical ethnography of religious diversity in post-revolutionary Nicaragua from the vantage point of Catholics who live in the city of Masaya located on the Pacific side of Nicaragua at the end of the twentieth century. My overarching research question is: How may ethnographically observed patterns in Catholic religious practices in contemporary Nicaragua be understood in historical context? Utilizing anthropological theory and method grounded in Weberian historical theory, I explore Catholic ritual as contested politico-religious (...) cultural terrain. The patron saint celebration of Masaya becomes a contested symbol in 1999 as those who carry Saint Jerome in street procession refuse to honor a sitting president, challenging his right to rule. The deep Marian devotion of the Nicaraguan people is reflected in the household and neighborhood celebrations of the Immaculate Conception of the Virgin Mary, while nation-building elites have a long history of claiming the Virgin as patron saint of the nation. While these traditional Catholic saint celebrations figure in imagining a nation, three "new" Catholic movements also compete for attention, while the polity is increasingly exposed to Protestant and Pentecostal groups. When Anastasio Somoza Debayle was overthrown in 1979, ending the 40-year family dictatorship, the Sandinista National Liberation Front (FSLN) ruled for a decade with the attention of the world placed on its religion of revolution, the Christian base community and liberation theology. At the same time, however, two other movements began growing quietly. They, like liberation theology, draw their justification from the second Vatican Council. In Masaya, Catholic Charismatic Renewal and the Neocatechumenal Way are "exemplary" prophetic movements gaining ground within the Catholic Church in competition with the "ethical" prophets of the Christian base community. Selectively adopting "protestant-like" forms of worship through these modern movements, the Nicaraguan Roman Catholic Church reacts to the challenge to its cultural hegemony coming from evangelical competitors. New history is continuously being made as people in this part of Nicaragua struggle over the direction of their country within a complex terrain of religious competition. (shrink)

Preliminary Reconnaissance: Realism, Instrumentalism, and Interpretation On the one hand, I think it is fair to say that philosophers recognize a special problem or question about how we are to “interpret” scientific theories only in light of their concerns about whether we are really entitled to believe what those theories say when they are interpreted in what we see as the most natural or straightforward or intuitive way. On the other hand, this fundamental worry reaches all the way back (...) to the inception of scientific inquiry itself, no matter how liberally we conceive of that enterprise. Before the relatively recent professionalization of academic fields, such concerns were well-represented among the figures who served simultaneously as both the leading practitioners and the leading philosophers of science. This is nicely illustrated by the strident debates throughout this community in the 18th and 19th centuries concerning whether only pure inductive methods were legitimate for scientific inquiry and/or whether the competing “method of hypothesis” could produce any genuine knowledge of nature (see Laudan 1981 Ch. 8). This article argues that the failure of certain theories of reflexive identity transformation to consider more fully issues connected to gender identity leads to an overemphasis on the expressive possibilities thrown up by processes of detraditionalization. By ignoring certain deeply embedded aspects, some theories of reflexive change reproduce the `disembodied and disembedded' subject of masculinist thought. The issues of disembodiment and disembeddedness are explored through a study of the work of Pierre Bourdieu on `habitus' and the `field'. The idea of (...) habitus yields a more dynamic theory of embodiment central to a feminist understanding of gender identity as a durable but not immutable norm. The idea of the `field' provides a more differentiated analysis of the social context in which the reflexive transformation of gender identity unfolds. This in turn offers a way of thinking of possible transformations within gender identity as uneven and non-synchronous phenomena. (shrink)

This paper shows how the mythology surrounding rape enters into a criterion of reasonableness which operates through the legal system to make women vulnerable to unscrupulous victimization. It explores the possibility for changes in legal procedures and presumptions that would better serve women's interests and leave them less vulnerable to sexual violence. This requires that we reformulate the criterion of consent in terms of what is reasonable from a woman's point of view.

Bei Bauch reichte er 1920 eine Arbeit mit dem Titel Welche philosophische Bedeutung hat das Problem der „Grundlegung der Geometrie“ für die Lehramtsprüfung (...) und 1921 seine darauf aufbauende Dissertation Der Raum. Ein Beitrag zur Wissenschaftslehre ein. Rickert war das Haupt der von Wilhelm Windelband begründeten Südwestdeutschen Schule des Neukantianismus, zu der auch Cohn und Bauch gezählt werden. Bauch war jedoch auch von der von Hermann Cohen begründeten Marburger Schule des Neukantianismus, deren herausragenste Vertreter Paul Natorp und Ernst Cassirer sind, beeinflusst. Vor allem Natorps Die logischen Grundlagen der exakten Wissenschaften (1910a) und Cassirers Substanzbegriff und Funktionsbegriff (1910) beeinflussten Carnaps Verständnis der methodischen Grundlagen der Mathematik und der Physik (Richardson 1998, 115-117, 138-139; Mormann 2000, 44-46). In persönlichem Kontakt war Carnap seit seinem Umzug nach Buchenbach Anfang der 1920er Jahre auch mit dem Rickert-Schüler Broder Christiansen. (shrink)

Friedrich Adolf Trendelenburg war einer der akademischen Lehrer Hermann Cohens und die Debatte zwischen Trendelenburg und Kuno Fischer über die Interpretation der transzendentalen Ästhetik gilt gemeinhin als Anlass für Cohens Kantstudien und seine Abwendung von der Völkerpsychologie und damit als Geburtsstunde des Marburger Neukantianismus. Über die nähere persönliche Beziehung Cohens zu Trendelenburg ist allerdings wenig bekannt und auch die Frage, ob und inwiefern Cohen als „Schüler“ Trendelenburgs bezeichnet werden kann ist nicht eindeutig zu beantworten, zumindest scheint Cohens Verhältnis zu Trendelenburg (...) eher distanziert gewesen zu sein und es ist nicht klar, ob nicht Cohens Trendelenburg gegenüber teilweise auch kritische Haltung in seiner Stellungnahme zur Kontroverse zwischen Trendelenburg und Fischer auch zum Scheitern seiner Habilitationsversuche in Berlin beigetragen hat. Andererseits wurde darauf hingewiesen, dass sich Cohen durch die von Trendelenburg aufgeworfene Frage, ob Kant die ausschließliche Subjektivität von Raum und Zeit bewiesen habe, vor das für seine Philosophie und Kantkritik zentrale Problem einer nicht bloß „subjektiven“ Begründung des Idealismus gestellt sah und diesbezüglich (in Abgrenzung von Kuno Fischer und Friedrich Albert Lange) im wesentlichen Trendelenburgs Absicht, „das Ideale im Realen zu befestigen“, weiterverfolgte (Klaus Christian Köhnke). This article considers Foucault’s analysis of ordoliberal and neoliberal governmental reason and its reorganization of social relations around a notion of enterprise. I focus on the particular idea that the generalization of the enterprise form to social relations was conceptualized in such exhaustive terms that it encompassed subjectivity itself. Self as enterprise highlights, inter alia, dynamics of control in neoliberal regimes which operate through the organized proliferation of individual difference in an economized matrix. It also throws into question conceptions of (...) individual autonomy that underpin much political thought and upon which ideas about political resistance are based. Self as enterprise also problematizes the viability of Foucault’s later work on ethics of the self as a practice of resistance. I go on to argue that Foucault’s discussion of an unresolved clash in civil society between monarchical and governmental power, between law and norm, offers an elliptical but more promising account of opposition to normalizing bio-power. We explore the extent to which Boards use executive compensation to incite firms to act in accordance with social and environmental objectives (e.g., Johnson, R. and D. Greening: 1999, Academy of Management Journal 42(5), 564-578; Kane, E. J.: 2002, Journal of Banking and Finance 26, 1919-1933.). We examine the association between executive compensation and corporate social responsibility (CSR) for 77 Canadian firms using three key components of executives' compensation structure: salary, bonus, and stock options. Similar to prior research (McGuire, J., (...) S. Dow and K. Argheyd: 2003, Journal of Business Ethics 45(4), 341-359), we measure three different aspects of CSR, which include Total CSR as well as CSR Strengths and CSR Weaknesses. CSR Strengths and CSR Weaknesses capture the positive and negative aspects of CSR, respectively. We find significant positive relationships between: (1) Salary and CSR Weaknesses, (2) Bonus and CSR Strengths, (3) Stock Options and Total CSR; and (4) Stock Options and CSR Strengths. Our findings suggest the importance of the structure of executive compensation in encouraging socially responsible actions, particularly for larger Canadian firms. This in turn suggests that executive compensation can be an effective tool in aligning executives' welfare with that of the "common good", which results in more socially responsible firms (Bebchuk, L., J. Fried and D. Walker: 2002, The University of Chicago Law Review 69, 751-846; Zalewski, D.: 2003, Journal of Economic Issues 37(2), 503-509). In addition, our findings suggest the importance of institutional context in influencing the association between executive compensation and CSR. This article presents a fairness principle for evaluating decision-making based on predictions: a decision rule is unfair when the individuals directly impacted by the decisions who are equal with respect to the features that justify inequalities in outcomes do not have the same statistical prospects of being benefited or harmed by them, irrespective of their socially salient morally arbitrary traits. The principle can be used to evaluate prediction-based decision-making from the point of view of a wide range of antecedently specified (...) substantive views about justice in outcome distributions. There is a need to feminize the research on entrepreneurs — to include the experiences of women in what we know to be true about entrepreneurs and the entrepreneurial process. This paper highlights some of the most significant methodological problems in researching women's entrepreneurial experience, problems which in the past, have prevented researchers from gaining an understanding of this experience, and which continues to stand in the way of developing female perspectives. Instead of using the existing male-based models, new approaches (...) are called for in incorporating women's experiences into entrepreneurship theory. In this paper, I will discuss the need for a theory of essences within Object-Oriented Ontology (OOO) and then formulate one. I will do so by drawing on Graham Harman’s work on OOO and Martin Heidegger’s thought on the essence of being, presented in his Introduction to Metaphysics. Harman touches on essences, describing them as the tension between a withdrawn object and its withdrawn qualities, but fails to distinguish between essential and inessential qualities within this framework. To fill in the (...) gaps, I will turn to Heidegger’s explication of phusis in order to show that an essential aspect of being is how one enters into causal relations and continually reveals oneself to other beings. In bringing OOO and Heidegger together, I will find that each object has a unique way of exerting itself in the world and that the domestic relations that make up this unique profile are essential to it, while other domestic relations, those that do not influence its particular way of exerting itself, are inessential. Thus, the essence will be found to be the set of domestic relations that make up the determinate form, or unique causal profile, of the object. (shrink)

A number of recent books bridging the academic world and the reading public stress that at least a portion of decision-making depends not on conscious reasoning, but instead on cognition that occurs below awareness. Scientific realists have suggested that changes in our scientific communities over the course of their history have rendered those communities progressively less vulnerable to the problem of unconcieved alternatives over time. I argue in response not only that the most fundamental historical transformations of the scientific enterprise have generated steadily mounting obstacles to revolutionary, transformative, or unorthodox scientific theorizing, but also that we have substantial independent evidence that the institutional apparatus of contemporary scientific inquiry fosters an exceedingly and increasingly theoretically (...) conservative form of that inquiry. I conclude that contemporary scientific communities are actually more vulnerable to the problem of unconceived alternatives than their historical predecessors, and I briefly suggest how we might seek to pursue scientific inquiry in a less theoretically conservative way. This article considers two themes in Butler's work: the dialectic of subject formation - that the autonomous subject is instituted through constraint - and the relation between the psyche and the social. With regard to the former, the introduction of a notion of historicity into a conception of the symbolic yields a concept of agency. Nonetheless, this concept of agency still lacks social specificity. By reconfiguring the psyche as an effect of the interiorization of social norms, Butler introduces the destabilizing (...) force of the category of the unconscious into constructivist accounts of identity. This sociocentric reworking of the psyche-social relations provides a nuanced account of gender identity, but it results in a negative model of action as the displacement of constraining social norms. It is also important for a conception of agency to include an account of the creative dimensions of action where actors actively appropriate conflicting socio-cultural values to institute new collective forms of identity. This paper evaluates four recent randomized clinical trials in which the informed consent of participants was either not sought at all, or else was conducted with critical information missing from the consent documents. As these studies have been taking place, various proposals to conduct randomized clinical trials without consent have been appearing in the medical literature. Some of the explanations offered for why it is appropriate to bypass consent or disclosure requirements appear to represent a fundamental misunderstanding of applicable government (...) regulations and even the research enterprise. Others are the result of conceptual disagreements about the importance and application of traditional research ethics norms to ‘comparative effectiveness research’ and modern research environments. Common among these explanations, however, is a failure to appreciate when a research intervention, rather than merely an observation or review of data, is taking place. Review committees and investigators are failing to see, or choosing to ignore, interventions in the lives of research subjects. When these studies have come to light, government agencies with oversight authority have done little or backed down. Prestigious medical journals have published research results knowing that the required consent was not obtained, or they have stood by the published studies even after the inadequacy of consent is discovered. This article critically examines this erosion of consent in theory and practice and calls for restoring the requirement of informed consent to its proper place as a priority in human subjects research. This paper considers the advantages of incorporating Foucault's anti-essentialist theory of the body into feminist explanations of women's oppression. There are also problems in that Foucault neglects to examine the gendered character of the body and reproduces a sexism endemic in "gender neutral" social theory. The Foucauldian body is essentially passive resulting in a limited account of identity and agency. This conflicts with an aim of feminism: to rediscover and revalue the experiences of women.

Scientific realists have suggested that changes in our scientific communities over the course of their history have rendered those communities progressively less vulnerable to the problem of unconcieved alternatives over time. I argue in response not only that the most fundamental historical transformations of the scientific enterprise have generated steadily mounting obstacles to revolutionary, transformative, or unorthodox scientific theorizing, but also that we have substantial independent evidence that the institutional apparatus of contemporary scientific inquiry fosters an exceedingly and increasingly theoretically (...) conservative form of that inquiry. I conclude that contemporary scientific communities are actually more vulnerable to the problem of unconceived alternatives than their historical predecessors, and I briefly suggest how we might seek to pursue scientific inquiry in a less theoretically conservative way. In the concluding chapter of Exceeding our Grasp Kyle Stanford outlines a positive response to the central issue raised brilliantly by his book, the problem of unconceived alternatives. This response, called "epistemic instrumentalism", relies on a distinction between instrumental and literal belief. We examine this distinction and with it the viability of Stanford's instrumentalism, which may well be another case of exceeding our grasp.

In this paper we argue that transparency of machine learning algorithms, just as explanation, can be defined at different levels of abstraction. We criticize recent attempts to identify the explanation of black box algorithms with making their decisions (post-hoc) interpretable, focusing our discussion on counterfactual explanations. These approaches to explanation simplify the real nature of the black boxes and risk misleading the public about the normative features of a model. We propose a new form of algorithmic transparency, that consists in (...) explaining algorithms as an intentional product, that serves a particular goal, or multiple goals (Daniel Dennet’s design stance) in a given domain of applicability, and that provides a measure of the extent to which such a goal is achieved, and evidence about the way that measure has been reached. We call such idea of algorithmic transparency “design publicity.” We argue that design publicity can be more easily linked with the justification of the use and of the design of the algorithm, and of each individual decision following from it. In comparison to post-hoc explanations of individual algorithmic decisions, design publicity meets a different demand (the demand for impersonal justification) of the explainee. Finally, we argue that when models that pursue justifiable goals (which may include fairness as avoidance of bias towards specific groups) to a justifiable degree are used consistently, the resulting decisions are all justified even if some of them are (unavoidably) based on incorrect predictions. For this argument, we rely on John Rawls’s idea of procedural justice applied to algorithms conceived as institutions. (shrink)

Advocates have sought to prove that underdetermination obtains because all theories have empirical equivalents. But algorithms for generating empirical equivalents simply exchange underdetermination for familiar philosophical chestnuts, while the few convincing examples of empirical equivalents will not support the desired sweeping conclusions. Nonetheless, underdetermination does not depend on empirical equivalents: our warrant for current theories is equally undermined by presently unconceived alternatives as well-confirmed merely by the existing evidence, so long as this transient predicament recurs for each theory and body (...) of evidence we consider.
