Drawing on a career-long exploration of 1960s French philosophy, Leonard Lawlor seeks a solution to 'the problem of the worst violence'. The worst violence is the reaction of total apocalypse without remainder; it is the reaction of complete negation and death; it is nihilism. Lawlor argues that it is not just transcendental violence that must be minimised: all violence must itself be reduced to its lowest level. Derrida wrote extensively on "the question of the animal." In particular, he challenged Heidegger's, Husserl's, and other philosophers' work on the subject, questioning their phenomenological criteria for distinguishing humans from animals. Examining a range of Derrida's writings, including his most recent _L'animal que donc je suis_, as well as _Aporias_, _Of Spirit_, _Rams_, and _Rogues_, Leonard Lawlor reconstructs a portrait of Derrida's views on animality and their intimate connection to his thinking on ethics, names and singularity, sovereignty, and the (...) notion of a common world. Derrida believed that humans and animals cannot be substantially separated, yet neither do they form a continuous species. Instead, in his "staggered analogy," Derrida asserts that all living beings are weak and therefore capable of suffering. This controversial claim both refuted the notion that humans and animals possess autonomy and contradicted the assumption that they possess the trait of machinery. However, it does offer the foundation for an argument-which Lawlor brilliantly and passionately defines in his book-in which humans are able to will this weakness into a kind of unconditional hospitality. Humans are not strong enough to keep themselves separate from animals. In other words, we are too weak to keep animals from entering into our sphere. Lawlor's argument is a bold approach to remedying "the problem of the worst," or the complete extermination of life, which is fast becoming a reality. (shrink)

The majority of North American corporations awakened to the need for their own ethical guidelines during the late 1970s and early 1980s, even though modern corporations are subject to a surprising multiplicity of external codes of ethics or conduct. This paper provides an understanding of both internal and external codes through a discussion of the factors behind the development of the codes, an analysis of internal codes and an identification of problems with them.

Solidarity is a fundamental social value in many European countries, though its precise practical and theoretical meaning is disputed. In a health care context, I agree with European writers who take solidarity normatively to mean roughly equal access to effective health care for all. That is, solidarity includes a sense of justice. Given that, I will argue that precision medicine represents a potential weakening of solidarity, albeit not a unique weakening. Precision medicine includes 150 targeted cancer therapies (mostly for metastatic (...) cancer), all of which are extraordinarily expensive. Our critical question: Must a commitment to solidarity as defined mean that all these targeted cancer therapies should be guaranteed to all within each country in the European Union, no matter the cost, no matter the degree of effectiveness? Such a commitment would imply that cancer was ethically special, rightfully commandeering unlimited resources. That in itself would undermine solidarity. I offer multiple examples of how current and future dissemination of these targeted cancer drugs threaten a commitment to solidarity. An alternative is to fund more cancer prevention efforts. However, that too proves a threat to solidarity. Solidarity, with or without a sense of justice, is too abstract a notion to address these challenges. Further, we need to accept that we can only hope to achieve “rough justice” and “supple solidarity.” The precise practical meaning of these notions needs to be worked out through a fair and inclusive process of rational democratic deliberation, which is the real and practical foundation of just solidarity. We statisticians, with our specific concern for uncertainty, are even more liable than other practical men to encounter philosophy, whether we like it or not. For my part, I like it comparatively well. That is why the honor of opening this session of discussion has come to me, though my background makes my knowledge and idiom somewhat different from your own.

This paper aims to establish three major theses: (1) Not only declarative sentences, but also interrogatives and imperatives, may be classified as true or as false. (2) Declarative, imperative, and interrogative utterances may also be classified as honest or as dishonest. (3) Whether an utterance is honest or dishonest is logically independent of whether it is true or is false. The establishment of the above theses follows upon the adoption of a principle for identifying what is meant by any sentence, (...) declarative, interrogative, or imperative. The analysis aims to show that meaning is to be attributed to the uttered or written sentence-token, rather to the thereby exhibited sentence-type. Further, the meaning of the sentential token is to be identified with a purpose of the speaker, that the speaker would reveal to the addressee by uttering the sentence. The to be revealed purpose is analysed into two components: an ultimate concern (that the addressee stand in such and such a relation--e.g., of believing, or informing the speaker about, or making it true that) and an ultimate topic of concern (the state of affairs, i.e., proposition, relative to which the speaker would have the addressee stand in the specified relation). Sentential utterances "signify" different purposes by "expressing" different ultimate concerns and "indicating" different ultimate topics of concern. Variations in expressed concern are correlated with variations in sentential form, such as declarative, interrogative and imperative. Variations in indicated topic of concern are correlated with variations in the subject and predicate of the uttered sentence. Thus, for example, utterances of "Johnny will jump in the lake," "Will Johnny jump in the lake?" and "Johnny, go jump in the lake!" all indicate one and the same ultimate topic of concern but express different ultimate concerns with this topic. A sentential utterance is true or false according as its indicated topic of concern is true or false. Hence, declaratives, interrogatives and imperatives may all be classified as true or as false. But honesty or dishonesty is a function (explained in the paper) of the expressed concern, rather than of the topic of concern. Hence, although utterances of all sentential forms are honest or dishonest, their honesty or dishonesty is logically independent of their truth or falsity. (shrink)

Can Rawlsian public reason sufficiently justify public policies that regulate or restrain controversial medical and technological interventions in bioethics (and the broader social world), such as abortion, physician aid-in-dying, CRISPER-cas9 gene editing of embryos, surrogate mothers, pre-implantation genetic diagnosis of eight-cell embryos, and so on? The first part of this essay briefly explicates the central concepts that define Rawlsian political liberalism. The latter half of this essay then demonstrates how a commitment to Rawlsian public reason can ameliorate (not completely resolve) (...) many of the policy disagreements related to bioethically controversial medical interventions today. The goal of public reason is to reduce the size of the disagreement by eliminating features of the disagreement that violate the norms of public reason. The norms of public reason are those norms that are politically necessary to preserve the liberal, pluralistic, democratic character of this society. What remains is reasonable disagreement to be addressed through normal democratic deliberative processes. Specific issues addressed from a public reason perspective include personal responsibility for excessive health costs, the utility of a metaphysical definition of death for organ transplantation, and the moral status of excess embryos generated through IVF and/or their use in medical research. Scientific method interests the linguist not only as it interests every scientific worker, but also in a special way, because the scientist, as part of his method, utters certain very peculiar speech-forms. The linguist naturally divides scientific activity into two phases: the scientist performs “handling” actions and utters speech. The speech-forms which the scientist utters are peculiar both in their form and in their effect upon hearers.

The phrase "personalized medicine" has a built-in positive spin. Simple genetic tests can sometimes predict whether a particular individual will have a positive response to a particular drug or, alternatively, suffer costly and debilitating side effects. But little attention has been given to some challenging issues of justice raised by personalized medicine. How should we determine who would have a just claim to access particular treatments, especially very expensive ones? How effective do those treatments need to be?If there were a (...) thick, bright line separating minimal responders from maximal responders, then we could allocate these treatments in a fair and cost-effective way. This article reviews key philosophical and legal underpinnings of mental health professionals' obligation to obtain informed consent from consumers of their services. The basic components of informed consent are described, and strategies for clinically and ethically appropriate methods of obtaining informed consent are discussed. Emerging issues in informed consent involving duty to assess and protect against client dangerousness, obligations to third parties, and issues of deception are considered as well. The article proposes that part of the process of obtaining informed (...) consent is the cultivation of a treatment environment that emphasizes beneficence and client autonomy. (shrink)

THE ZERO NONVARIANT PROBLEM. Decide in the limit if a recursive function f presented as f(0), f(1), f(2),... has value unequal to zero for infinitely many (...) arguments. I agree with Professor ter Meulen that there is no need to make a forced choice between “justice” and “solidarity” when it comes to determining what should count as fair access to needed health care. But he also asserts that solidarity is more fundamental than justice. That claim needs critical assessment. Ter Meulen recognizes that the concept of solidarity has been criticized for being excessively vague. He addresses this criticism by introducing the more precise notion of “humanitarian solidarity.” However, I (...) argue that these notions are still not precise enough and are in need of behavioral translation, especially in relation to the problem of fair health care rationing. More specifically, I argue that translation ought to take the form of a well-ordered process of rational democratic deliberation, which I describe and defend in this essay.
