This dissertation advances a solution to a problem intrinsic to understanding the dialogues of Plato. How are we to understand Plato's thought when he never speaks in his own name in any of his dialogues? Many writers assume that Plato's characters speak for him. With this assumption, they study the thought articulated by Plato's characters as if it were his own, and elaborate a so-called "doctrinal" interpretation. A variety of subjective readings follows, since what Socrates and other characters say in (...) the dialogues is often inconsistent or contradictory. To resolve these problems the dissertation constructs a method for interpreting Socratic dialogue which is true to the genre. Extending the work of Bakhtin, Clay, and Kahn, it develops a metalanguage for specifying the structure, plot, aim , and effect of a dialogue as well as the thought , character , and pathos of its participants, by applying concepts in Plato's dialogues and in Aristotle's Poetics, Ethics, Politics, Metaphysics, Physics, and other works. The dissertation shows that the Republic represents Glaucon as subject to erotic desire and desires for luxury and honor, and that the aim of Socrates' discourse is to induce a catharsis in Glaucon in order to change these states of character. ;To support this interpretation, the dissertation shows: Aristotle does not apply a doctrinal reading to Plato's dialogues; he does not attribute the remarks of the character Socrates to Plato. Irwin's claims in "Plato's Ethics" are not supported by the texts of Aristotle which he cites. Aristotle's treatment of the Republic in Politics II is consistent with a mimetic interpretation of the dialogue. His treatment of the Republic is peirastic: he refutes Socrates' proposals with premisses and arguments that Socrates himself expresses in the dialogue. The dissertation discusses Aristotle's treatment of Socrates' proposals for unity in the city of the guardians, the sharing of women and children, gender, sacrilegious acts and incest, property, and the minimum necessary elements for a city. Nearly one year has passed since the release of the Committee’s final report and recommendations, and it seems an appropriate time to invite discourse and reflection on the influence and impact of the Committee and (...) its efforts. Our intent is to advance understanding of the Committee and its work, its place in the evolution of bioethics and public policy, as well as the broader legacy of restoring trust in the conduct of human subjects research.In 1993, President Clinton and Secretary of Energy Hazel O’Leary initiated an investigation of America’s involvement in radiation experiments on its citizens during the Cold War. The investigation resulted in the appointment of the Committee in January 1994. Some issues raised by these radiation experiments were brought to the attention of the nation by revelations contained in a Pulitzer Prize-winning series of newspaper stories about plutonium injections carried out by the government on allegedly unsuspecting subjects during the Cold War. The Committee faced a broad mandate, which included piecing together the history of Cold War radiation experiments and human subjects research, as well as recommending remedies for past wrongs and mechanisms to ensure that such wrongs could not be repeated in the future.This issue of the Journal consists of articles and accompanying commentaries on historical, philosophical, policy, and political aspects of the Committee’s work that are important to bioethics. This collection of articles, authored by Committee members, staff, and leading scholars, is designed to paint a picture of the breadth and complexity of the Committee’s efforts and to provide context and to stimulate discussion of significant issues.In the first article, Ruth Faden provides her unique perspective as chair of the Committee. She goes beyond the necessary overview and background of the Committee to reflect on the impact and meaning of the Committee’s work to bioethics and public policy.Much of the Committee’s effort was directed at gathering and uncovering information about the history of Cold War radiation experiments, an endeavor fairly foreign to bioethics but critically important to understanding the context in which to make moral judgments about the past. Nancy Kass and Jeremy Sugarman discuss the results of the Committee’s attempts to measure the operation and effectiveness of the current system for protection of human subjects. Paul Appelbaum comments on the relevance and value of the Committee’s empirical projects to contemporary human subjects research.The Committee’s work, and the products of any commission’s work, must be viewed partly in light of the place of commissions in bioethics scholarship and policymaking. In “Internalism and Externalism,” Laurence BonJour suggests that the contemporary epistemological debate over internalism and externalism concerns the formulation of the justification or warrant condition in an account of knowledge. The internalist requires that for a belief to meet this condition, all of the necessary elements must be cognitively accessible to the believer, whereas the externalist claims that at least some such elements do not need to be accessible to the believer. BonJour gives an overview of this dispute. He (...) suggests that the opposition between the two views is less straightforward than has usually been thought. He proposes, in addition, that each of them has valuable roles to play in major epistemological issues, even though the internalist approach is more fundamental in an important way. (shrink)

In this strikingly original work, Paul W. Kahn rethinks the meaning of political theology. In a text innovative in both form and substance, he describes an American political theology as a secular inquiry into ultimate meanings sustaining our faith in the popular sovereign. Kahn works out his view through an engagement with Carl Schmitt's 1922 classic, _Political Theology: Four Chapters on the Concept of Sovereignty_. He forces an engagement with Schmitt's four chapters, offering a new version of each (...) that is responsive to the American political imaginary. The result is a contemporary political theology. As in Schmitt's work, sovereignty remains central, yet Kahn shows how popular sovereignty creates an ethos of sacrifice in the modern state. Turning to law, Kahn demonstrates how the line between exception and judicial decision is not as sharp as Schmitt led us to believe. He reminds readers that American political life begins with the revolutionary willingness to sacrifice and that both sacrifice and law continue to ground the American political imagination. Kahn offers a political theology that has at its center the practice of freedom realized in political decisions, legal judgments, and finally in philosophical inquiry itself. (shrink)

The influential political philosopher Leo Strauss has been credited by conservatives with the recovery of the great tradition of political philosophy stretching back to Plato. Among Strauss's most enduring legacies is a strongly negative assessment of Nietzsche as the modern philosopher most at odds with that tradition and most responsible for the sins of twentieth-century culture--relativism, godlessness, nihilism, and the breakdown of family values. In fact, this apparent denunciation has become so closely associated with Strauss that it is often seen (...) as the very core of his thought. In Leo Strauss and Nietzsche, the eminent Nietzsche scholar Laurence Lampert offers a controversial new assessment of the Strauss-Nietzsche connection. Lampert undertakes a searching examination of the key Straussian essay, "Note on the Plan of Nietzsche's Beyond Good and Evil." He shows that this essay, written toward the end of Strauss's life and placed at the center of his final work, reveals an affinity for and debt to Nietzsche greater than Strauss's followers allow. Lampert argues that the essay comprises the most important interpretation of Nietzsche ever published, one that clarifies Nietzsche's conception of nature and of human spiritual history and demonstrates the logical relationship between the essential themes in Nietzsche's thought--the will to power and the eternal return. _The Enduring Importance of Leo Strauss_ takes on the crucial task of separating what is truly important in the work of Leo Strauss from the ephemeral politics associated with his school. Laurence Lampert focuses on exotericism: the use of artful rhetoric to simultaneously communicate a socially responsible message to the public at large and a more radical message of philosophic truth to a smaller, more intellectually inclined audience. Largely forgotten after the Enlightenment, exotericism, he shows, deeply informed Strauss both (...) as a reader and as a philosophic writer—indeed, Lampert argues, Strauss learned from the finest practitioners of exoteric writing how to become one himself. Examining some of Strauss’s most important books and essays through this exoteric lens, Lampert reevaluates not only Strauss but the philosophers—from Plato to Halevi to Nietzsche—with whom Strauss most deeply engaged. Ultimately Lampert shows that Strauss’s famous distinction between ancient and modern thinkers is primarily rhetorical, one of the great examples of Strauss’s exoteric craft. Celebrating Strauss’s achievements while recognizing one main shortcoming—unlike Nietzsche, he failed to appreciate the ramifications of modern natural science for philosophy and its public presentation—Lampert illuminates Strauss as having even greater philosophic importance than we have thought before. Qualitative research poses ethical issues and challenges unique to the study of human beings. In developing the interpersonal relationship that is critical to qualitative research, investigator and participant engage in a dialogic process that often evokes stories and memories that are remembered and reconstituted in ways that otherwise would not occur. Ethical issues are raised when this relationship not only provides qualitative research data, but also leads to some degree of therapeutic interaction for the participant. The purpose of this article (...) is to examine some of the controversies inherent in the researcher's dilemma when this occurs, set within the context of a nursing caring theory (Swanson), and the International Council of Nurses Code of ethics for nurses, which provides guidance on global nursing practice. Efficiency as quantified and promoted by cost-effectiveness analysis sometimes conflicts with equity and other ethical values, such as the “rule of rescue” or rights-based ethical values. We describe the utilitarian foundations of cost-effectiveness analysis and compare it with alternative ethical principles. We find that while fallible, utilitarianism is usually superior to the alternatives. This is primarily because efficiency – the maximization of health benefits under a budget constraint – is itself an important ethical value. Other ethical frames may be irrelevant, (...) incompatible with each other, or have unacceptable implications. When alternatives to efficiency are considered for precedence, we propose that it is critical to quantify the trade-offs, in particular, the lost health benefits associated with divergence from strict efficiency criteria. Using an example from HIV prevention in a high-prevalence African country, we show that favoring a rights-based decision could result in 92–118 added HIV infections per $100,000 of spending, compared to one based on cost-effectiveness. Plato’s dialogues show Socrates at different ages, beginning when he was about nineteen and already deeply immersed in philosophy and ending with his execution five decades later. Ethical egoism and Kantian ethics constitute radically different and incompatible moral traditions. Speaking rather broadly, one might go so far as to say that each tradition is a source of inspiration for criticisms of the other, each tradition reminding us of the limitations of the other. For Kantian ethics, with its extreme other-regarding and abstract approach to morality, would sometimes seem to lose sight of the self, leaving a self that seems somewhat eviscerated. Ethical egosim, by contrast, with its extreme (...) self-centered conception, would seem to lose sight of the importance of others, positing a self that can only give instrumental value to others. Though both traditions have been criticized, these criticisms have travelled independently of one another—no line of argument being at once a criticism of both. Perhaps no such argument is to be had. However, when two traditions trade off of one another this suggests an underlying text or theme. That theme, I suggest, is about the metaphysics of the moral self—that is, the way in which the self is morally constituted. I want to offer an account of the way in which the self is morally constituted which is at once a criticism of both ethical egoism and Kantian ethics. (shrink)

At a White House ceremony in October 1995, the Advisory Committee on Human Radiation Experiments presented its Final Report to President Bill Clinton. The 925-page report and the over 2,000 pages of supplemental volumes summarized eighteen months of investigative research, debate, and deliberation on historical and contemporary issues in human subjects research. The Advisory Committee's efforts were aided by unprecedented support from the highest levels of the executive branch, including the heads of eight cabinet-level agencies and their departments' resources. In this anthropological investigation of the nature of an underdeveloped peasant economy, Joel S. Kahn attempts to develop the insights generated by Marxist theorists, by means of a concrete case study of a peasant village in the Indonesian province of West Sumatra. He accounts for the specific features of this regional economy, and, at the same time, examines the implications for it of the centuries-old European domination of Indonesia. The most striking feature of the Minangkabau economy is the predominance (...) of petty commodity relations in agriculture, handicrafts and the local network of distribution. Dr Kahn illustrates this with material on local economic organization, which he collected in the field in the highland village of Sungai Puar, the site of a blacksmithing industry, and with published and unpublished data from other parts of Indonesia. Dr Kahn's book is unusual for its combination of a theoretical analysis of underdevelopment with a detailed regional study. It will appeal to those interested in South-east Asian studies, in development, and in neo-Marxist approaches in anthropology. (shrink)

There is a way of doing moral philosophy which goes something like this: If it can be shown that it is rational for perfectly selfish people to accept the constraints of morality, then it will follow, a fortiori, that it is rational for people capable of affective bonds, and thus less selfish, to do so. On this way of proceeding the real argument – that is, the argument for the actual constraints to be adopted – proceeds with only fully rational (...) individuals who have no other concern than to maximize their nontuistic preferences. Then it is noted that the affective capacities of human beings actually make quite palatable the constraints that the fully rational persons with wholly nontuistic preferences have agreed upon. _An examination of how two fundamental concepts of order influence our ideas about sovereignty, citizenship, law, and history_ Western accounts of natural and political order have deployed two basic ideas: project and system. In a project, order is produced by the intentional act of a subject; in a system, order is immanent in the world. In the former, order is made; in the latter, discovered. Paul W. Kahn shows how project and system have long been at work in our (...) theological and philosophical tradition. Against this background, Kahn explains the development of the modern legal imagination in the nineteenth century as a movement from project to system. Americans began the century imagining the constitutional order as their common project: a deliberate construction of We the People. They ended the century imagining that order is continuous with the common law: an immanent development of the principles of civilization. But it would seem that this idea has less of a foothold in reality (...) than it does in our hearts. It is far too difficult to deny that there are unjust persons who are happy. Indeed, some even seem to be happier than many a just person.So I shall lower my sights. Rather than attempting to defend as sound the Platonic view, I shall argue that the just person is favored to be happier than a certain kind of unjust person whom I shall simply call a masquerader - this is, an individual who is frequently concerned to masquerade as a deeply caring person.
