abstract Applied ethics engages with concrete moral issues. This engagement involves the application of philosophical tools. When the philosophical tools used in applied ethics are problematic, conclusions about applied problems can become skewed. In this paper, I focus on problems with the idea that comparison cases must be exactly alike, except for the moral issue at hand. I argue that this idea has skewed the debate regarding the moral distinction between killing and letting die. I begin with problems that can (...) arise from attempts to produce comparison cases that are exactly alike, except for the moral issue at hand. I then argue that attempts to produce such examples are doomed to failure. In some medical cases there is a moral distinction between killing and letting die, but in others there is not. In this paper I present an original and principled account of the moral distinction between killing and letting die. The account provides both an explanation of the moral distinction and an explanation for why the distinction does not always hold. If these explanations are correct, the moral distinction between killing and letting die must be taken seriously in medical contexts. Defeasibly, (...) when an agent kills she takes responsibility, but when an agent lets die she does not take responsibility. Therein lies the moral distinction between killing and letting die. The distinction, however, is defeated when an agent is already responsible for the surrounding situation. In such cases, killing does not involve taking any further responsibility and letting die does not avoid taking any responsibility. Medical examples are frequently complicated because patients' autonomous choices impact upon medical practitioners' surrounding responsibility. (shrink)

This chapter proceeds from the standard picture of the relation between intuitions and experimental philosophy: the alleged evidential role of intuitions about hypothetical cases, and experimental philosophy’s challenge to these judgments, based on their variation with philosophically irrelevant factors. I will survey some of the main defenses of this standard picture against the x-phi challenge, most of which fail. Concerning the most popular defense, the expertise defense, I will draw the bleak conclusion that intuitive expertise of the envisaged kind is (...) largely a myth. Next, I will consider the mischaracterization objection, which has mainly been developed by Deutsch and Cappelen on the basis of textual evidence: that philosophers do not appeal to intuitions as evidence for their case judgments, but instead argue for them. This would render the x-phi challenge mostly irrelevant, due to its focus on intuitions about hypothetical cases. I will then consider a few instructive replies to the mischaracterization objection, which are all unconvincing on further inspection. Finally, I will discuss some potential normative consequences of the mischaracterization objection, and I will argue that it recommends a shift away from the excessive focus on intuitions about cases in metaphilosophy and experimental philosophy, towards more work on the role of argumentation in the method of cases. More speculatively, I claim that philosophers should always argue for their case judgments, even if they have strong intuitions about them, because an argument-based methodology would be more transparent and philosophically fruitful than one that mainly relies on intuition. Algorithmic predictions are promising for insurance companies to develop personalized risk models for determining premiums. In this context, issues of fairness, discrimination, and social injustice might arise: Algorithms for estimating the risk based on personal data may be biased towards specific social groups, leading to systematic disadvantages for those groups. Personalized premiums may thus lead to discrimination and social injustice. It is well known from many application fields that such biases occur frequently and naturally when prediction models are applied to (...) people unless special efforts are made to avoid them. Insurance is no exception. In this paper, we provide a thorough analysis of algorithmic fairness in the case of insurance premiums. We ask what “fairness” might mean in this context and how the fairness of a premium system can be measured. For this, we apply the established fairness frameworks of the fair machine learning literature to the case of insurance premiums and show which of the existing fairness criteria can be applied to assess the fairness of insurance premiums. We argue that two of the often-discussed group fairness criteria, independence (also called statistical parity or demographic parity) and separation (also known as equalized odds), are not normatively appropriate for insurance premiums. Instead, we propose the sufficiency criterion (also known as well-calibration) as a morally defensible alternative that allows us to test for systematic biases in premiums towards certain groups based on the risk they bring to the pool. In addition, we clarify the connection between group fairness and different degrees of personalization. Our findings enable insurers to assess the fairness properties of their risk models, helping them avoid reputation damage resulting from potentially unfair and discriminatory premium systems. The aim of this paper is to show that Graham Priest's dialetheic account of semantic paradoxes and the paraconsistent logics employed cannot achieve semantic universality. Dialetheism therefore fails as a solution to semantic paradoxes for the same reason that consistent approaches did. It will be demonstrated that if dialetheism can express its own semantic principles, a strengthened liar paradox will result, which renders dialetheism trivial. In particular, the argument is not invalidated by relational valuations, which were brought into paraconsistent logic (...) in order to avoid strengthened liar paradoxes. (shrink)

Empirical evidence indicates that conscious states, distinguished by the presence of phenomenal qualities, are closely linked to synchronized neural activity patterns whose dynamical characteristics can be attributed to self-organized criticality and phase transitions. These findings imply that insight into the mechanism by which the brain controls phase transitions will provide a deeper understanding of the fundamental mechanism by which the brain manages to transcend the threshold of consciousness. This article aims to show that the initiation of phase transitions and the (...) formation of synchronized activity patterns is due to the coupling of the brain to the zero-point field (ZPF), which plays a central role in quantum electrodynamics (QED). The ZPF stands for the presence of ubiquitous vacuum fluctuations of the electromagnetic field, represented by a spectrum of normal modes. With reference to QED-based model calculations, the details of the coupling mechanism are revealed, suggesting that critical brain dynamics is governed by the resonant interaction of the ZPF with the most abundant neurotransmitter glutamate. The pyramidal neurons in the cortical microcolumns turn out to be ideally suited to control this interaction. A direct consequence of resonant glutamate-ZPF coupling is the amplification of specific ZPF modes, which leads us to conclude that the ZPF is the key to the understanding of consciousness and that the distinctive feature of neurophysiological processes associated with conscious experience consists in modulating the ZPF. Postulating that the ZPF is an inherently sentient field and assuming that the spectrum of phenomenal qualities is represented by the normal modes of the ZPF, the significance of resonant glutamate-ZPF interaction for the formation of conscious states becomes apparent in that the amplification of specific ZPF modes is inextricably linked with the excitation of specific phenomenal qualities. This theory of consciousness, according to which phenomenal states arise through resonant amplification of zero-point modes, is given the acronym TRAZE. An experimental setup is specified that can be used to test a corollary of the theory, namely, the prediction that normally occurring conscious perceptions are absent under experimental conditions in which resonant glutamate-ZPF coupling is disrupted. The extent to which machine metaphors are used in synthetic biology is striking. These metaphors contain a specific perspective on organisms as well as on scientific and technological progress. Expressions such as “genetically engineered machine”, “genetic circuit”, and “platform organism”, taken from the realms of electronic engineering, car manufacturing, and information technology, highlight specific aspects of the functioning of living beings while at the same time hiding others, such as evolutionary change and interdependencies in ecosystems. Since these latter aspects are (...) relevant for, for example, risk evaluation of uncontained uses of synthetic organisms, it is ethically imperative to resist the thrust of machine metaphors in this respect. In addition, from the perspective of the machine metaphor viewing an entity as a moral agent or patient becomes dubious. If one were to regard living beings, including humans, as machines, it becomes difficult to justify ascriptions of moral status. Finally, the machine metaphor reinforces beliefs in the potential of synthetic biology to play a decisive role in solving societal problems, and downplays the role of alternative technological, and social and political measures. The notion of the highest good used to occupy a primary role in ethical theorising, but has largely disappeared from the contemporary landscape. The notion was central to both Aristotle's and Kant's ethical theories, however--a surprising observation given that their approaches to ethics are commonly conceived as being diametrically opposed. The essays in this collection provide a comprehensive treatment of the highest good in Aristotle and Kant and show that, even though there are important differences in terms of content, there (...) are also important similarities in terms of the structural features of Aristotle's and Kant's value theories. By carefully analysing Aristotle's and Kant's theories of the highest good, a team of experts in the field shed light on their respective ethical theories and highlight the richness, complexity, and fruitfulness of the notion of the highest good. In natural kind debates, Boyd's famous Homeostatic Property Cluster theory (HPC) is often misconstrued in two ways: Not only is it thought to make for a normative standard for natural kinds, but also to require the homeostatic mechanisms underlying nomological property clusters to be uniform. My argument for the illegitimacy of both overgeneralizations, both on systematic as well as exegetical grounds, is based on the misconstrued view's failure to account for functional kinds in science. I illustrate the combination of these (...) two misconstruals with recent entries into the natural kind debate about emotions. This paper reports research on the influence of corporate and individual characteristics on managers'' social orientation in Germany. The results indicate that mid-level managers expressed a significantly lower social orientation than low-level managers, and that job activity did not impact social orientation. Female respondents expressed a higher social orientation than male respondents. No impact of the political system origin (former East Germany versus former West Germany) on social orientation was shown. Overall, corporate position had a significantly higher impact on social (...) orientation than did the characteristics of the individuals surveyed. (shrink)

Plato's Philebus contains an intricate difficulty. Plato seems to hold both (a) that all pleasures are processes of becoming, a crucial premise in the argument that no pleasure is good (53c?55c) and (b) that some pleasures contribute in their own right to the goodness of the best life (64c?67b). Since it seems also plausible that only things which are good can contribute to the goodness of the best life in their own right, Plato's view seems to be inconsistent. Interpreters usually (...) reject either (a) or (b). As Plato seems firmly committed to both (a) and (b), I propose a third way of dealing with the inconsistency. The apparent inconsistency highlights a vital contrast between what is independently good (good per se), what is dependently good (good through participating in what is independently good), and what is derivatively good (good through standing in a certain relation to dependent goods). I argue that while pleasure's being a process of becoming marks it out as derivatively good, some kinds of pleasure are also dependent goods in virtue of their objects ? irrespective of their being processes of becoming. Synthetic biology can be understood as expanding the abilities and aspirations of genetic engineering. Nonetheless, whereas genetic engineering has been subject to criticism due to its endangering biodiversity, synthetic biology may actually appear to prove advantageous for biodiversity. After all, one might claim, synthesizing novel forms of life increases the numbers of species present in nature and thus ought to be ethically recommended. Two perspectives on how to spell out the conception of intrinsic value of biodiversity are examined in order (...) to assess this line of thought. At the cost of introducing two separate capacities of human knowledge acquisition, the ‘admiration stance’ turns out to reject outright the assumption of a synthetic species' intrinsic value and of an imperative to create novel species. The ‘kinship stance’ by contrast does ascribe value to both synthetic and natural species and organisms. Nonetheless, while from this perspective creating novel species may become an ethical demand under certain conditions, it favours changing organisms by getting in contact with them rather than synthesizing them. It is concluded that neither the admiration nor the kinship stance warrants a supposed general moral obligation to create novel species to increase biodiversity. (shrink)

According to the ‘expertise defence’, experimental findings suggesting that intuitive judgments about hypothetical cases are influenced by philosophically irrelevant factors do not undermine their evidential use in (moral) philosophy. This defence assumes that philosophical experts are unlikely to be influenced by irrelevant factors. We discuss relevant findings from experimental metaphilosophy that largely tell against this assumption. To advance the debate, we present the most comprehensive experimental study of intuitive expertise in ethics to date, which tests five well- known biases of (...) judgment and decision-making among expert ethicists and laypeople. We found that even expert ethicists are affected by some of these biases, but also that they enjoy a slight advantage over laypeople in some cases. We discuss the implications of these results for the expertise defence, and conclude that they still do not support the defence as it is typically presented in (moral) philosophy. (shrink)

Since intelligent design (ID) advocates claimed the ubiquitous mouse trap as an example of systems that cannot have evolved, mouse trap history is doubly relevant to studying material culture. On the one hand, debunking ID claims about mouse traps and, by implication, also about other irreducibly complex systems has a high educational value. On the other hand, a case study of mouse trap history may contribute insights to the academic discussion about material culture evolution. Michael Behe argued that mouse traps (...) cannot trap mice with any part missing; therefore, they cannot have a precursor with one part less, therefore, cannot have a continuous history, and therefore, cannot have evolved. The patented and seminal precursor of current flat snap traps, however, had one part less, because spring and striker were formed of one wire. Secondly, historical records that reach back into the Bronze Age suggest that its history continued for a very long time. Thirdly, all prerequisites for evolution (variation, transmission, and selection) abound in mouse trap populations. Hence, Behe’s triple-jump conclusion about mouse traps is false each step. There is no, in principle, impossibility for mouse traps to evolve. An evolutionary account of mouse trap history also has academic merits beyond its educational value. Three important conclusions can be drawn: (1) reticulate phylogenies of artifact systems may be resolvable as overlapping, but branching, phylogenies of parts; (2) homologous ideas may be realized by analogous material, that is, phylogenies of information do not necessarily coincide with those of material parts; (3) recombination of parts between different artifact systems increases the cumulative nature of cultural evolution. Synthetic biology is a new biotechnology that is developing at an impressive pace and attracting a considerable amount of attention from outside the scientific community as well. In this article, two main philosophically and ethically relevant characteristics of this field of research will be laid bare, namely its reliance on mechanistic metaphors to denominate simple forms of life and its appeal to the semantic field of creativity. It is argued that given these characteristics synthetic biology can be understood as a (...) prime example of a kind of human interference with reality that German philosopher Hannah Arendt called “fabrication.” This kind of self-world-relation contrasts to “action,” a relation that introduces, among other things, the idea of an inherent value of the object acted upon. Taking up this latter perspective, one scientific and two ethical challenges to synthetic biology’s take on the realm of life are identified. (shrink)

The present article asks what lessons the empirical case of institutional change in post-Soviet Russia yields for the recent research on ideas and institutions. Its main point is that in post-Soviet Russia a clash between imported foreground ideas and deep domestic background ideas led to an ideational division among the elite of the country that became a main obstacle to the provision of coherent economic reforms. This story stands in some contrast to much of the newer literature on ideas and (...) institutions, which tends to see critical junctures as leading from one equilibrium to another. I argue that tensions between imported foreground ideas and deep domestic backgrounds are likely to occur in other cases of far-reaching processes of institutional change based on Western ideas but taking place beyond the realm of Western, industrialized countries. Therefore, I argue, some general lessons on the interplay between ideas and institutions might be drawn from this case study. (shrink)

Monetary exchange abstracts from the personal loyalties that bind small groups together, but at the same time it creates an overarching commitment to norms that bind people more loosely in national societies—as long as monetary exchanges are enforced by the state. In the Soviet Union, conversely, the abolition of (...) money as a universal medium of exchange led both to a deterioration of the norms of impersonal morality and to a loss of state capacity. The state lost control of the economy to informal, personally binding economic networks, and it lost its monopoly on violence in competition with sub-state, personal enforcers of impersonal economic commitments between these networks. Thus, capitalism can be seen as diverting people from norms of loyalty to the members of the relatively small groups of which they are a part toward loyalty to the abstract norms that make it possible for anonymous people to deal with each other reliably. Eine prädikatenlogische Sprache erster Stufe sowie eine modallogische Sprache werden aufgebaut und miteinander verglichen. Für jede dieser Sprachen werden drei verschiedene modelltheoretische Interpretationsmethoden vorgeführt. Es wird gezeigt, daß, wenn man die prädikatenlogischen Sprachen als Versuche ansieht, Teile der Umgangssprache zu formalisieren, sie alle wesentlichen Eigenschaften intensionaler Sprachen aufweisen.

In der 1970 gegründeten Reihe erscheinen Arbeiten, die philosophiehistorische Studien mit einem systematischen Ansatz oder systematische Studien mit philosophiehistorischen Rekonstruktionen verbinden. Neben deutschsprachigen werden auch englischsprachige Monographien veröffentlicht. Gründungsherausgeber sind: Erhard Scheibe (Herausgeber bis 1991), Günther Patzig (bis 1999) und Wolfgang Wieland (bis 2003). Von 1990 bis 2007 wurde die Reihe von Jürgen Mittelstraß mitherausgegeben.

In this paper, I am going to offer a reconstruction of a challenge to intuition-based armchair philosophy that has been put forward by experimental philosophers of a restrictionist stripe, which I will call the 'master argument'. I will then discuss a number of popular objections to this argument and explain why they either fail to cast doubt on its first, empirical premise or do not go deep enough to make for a lasting rebuttal. Next, I will consider two more promising (...) objections, the grounding objection and the expertise objection, which aim at the second, epistemic premise of the argument. Against this background, I will then suggest what I call 'conservative restrictionism' as the most reasonable default reaction to the experimentalist challenge, which is a combination of the two views of local restrictionism and methodological conservativism. Experimental restrictionists have challenged philosophers’ reliance on intuitions about thought experiment cases based on experimental findings. According to the expertise defense, only the intuitions of philosophical experts count—yet the bulk of experimental philosophy consists in studies with lay people. In this paper, we argue that direct strategies for assessing the expertise defense are preferable to indirect strategies. A direct argument in support of the expertise defense would have to show: first, that there is a significant difference between expert and lay (...) intuitions; second, that expert intuitions are superior to lay intuitions; and third, that expert intuitions accord with the relevant philosophical consensus. At present, there is only little experimental evidence that bears on these issues. To advance the debate, we conducted two new experiments on intuitions about knowledge with experts and lay people. Our results suggest that the intuitions of epistemological experts are superior in some respects, but they also pose an unexpected challenge to the expertise defense. Most strikingly, we found that even epistemological experts tend to ascribe knowledge in fake-barn-style cases. This suggests that philosophy, as a discipline, might fail to adequately map the intuitions of its expert practitioners onto a disciplinary consensus. (shrink)

In this paper, we first briefly survey the main responses to the challenge that experimental philosophy poses to the method of cases, given the common assumption that the latter is crucially based on intuitive judgments about cases. Second, we discuss two of the most popular responses in more detail: the expertise defense and the mischaracterization objection. Our take on the expertise defense is that the available empirical data do not support the claim that professional philosophers enjoy relevant expertise in their (...) intuitive judgments about cases. In contrast, the mischaracterization objection seems considerably more promising than its largely negative reception has suggested. We argue that the burden of proof is thus on philosophers who still hold that the method of cases crucially relies on intuitive judgments about cases. Finally, we discuss whether conceptual engineering provides an alternative to the method of cases in light of the challenge from experimental philosophy. We argue that this is not clearly the case, because conceptual engineering also requires descriptive information about the concepts it aims to improve. However, its primarily normative perspective on our concepts makes it largely orthogonal to the challenge from experimental philosophy, and it can also benefit from the empirical methods of the latter. Complex problem solving (CPS) emerged in the last 30 years in Europe as a new part of the psychology of thinking and problem solving. This paper introduces into the field and provides a personal view. Also, related concepts like macrocognition or operative intelligence will be explained in this context. Two examples for the assessment of CPS, Tailorshop and MicroDYN, are presented to illustrate the concept by means of their measurement devices. Also, the relation of complex cognition and emotion in the (...) CPS context is discussed. The question if CPS requires complex cognition is answered with a tentative “yes.”. (shrink)
