L'oeuvre de Foucault est toute entière traversée par la question théorique et pratique des usages. Question de méthode, d'abord : Foucault fait usage de l'archive à des fins de mise en intelligibilité du présent. Question thématique, ensuite : Foucault s'interroge sur la manière dont les individus font usage des normes qui les régissent dans un contexte historique donné. Question critique, enfin : le primat alloué à l'usage définit l'intellectuel non plus comme le détenteur d'un savoir réservé en position régalienne, mais (...) comme un usager et un utilisateur des savoirs. Lire Foucault aujourd'hui suppose de se saisir à nouveaux frais de ces dimensions multiples du motif de l'usage, ce qui implique de conjuguer la rigueur du commentateur et la liberté de l'utilisateur. Les contributions réunies dans le présent ouvrage donnent une vue d'ensemble des différents usages qu'il est possible de faire de Foucault aujourd'hui : tantôt en creusant des problèmes qu'il nous a légués et qui sont encore les nôtres (l'articulation du mental et du carcéral, la gouvernementalité, les régimes de vérité, la biopolitique), tantôt en mettant ses thèses à l'épreuve d'autres terrains, explorés notamment par les sciences sociales. La question est rarement posée car, trop souvent, on la considère comme d'emblée réglée: Sartre n'aurait pas été capable d'envisager la dimension institutionnelle autrement que sous une forme négative, celle de la pétrification et de la bureaucratisation de l'action insurrectionnelle d'un groupe. Fruit d'un travail collectif, cet ouvrage explore différentes déclinaisons de la notion d'institution dans la réflexion sartrienne des années 1950 et 1960, en montrant son importance pour articuler (...) la question de l'histoire, de la transformation politique et d'une éthique matérialiste. The increasing availability of brain data within and outside the biomedical field, combined with the application of artificial intelligence (AI) to brain data analysis, poses a challenge for ethics and governance. We identify distinctive ethical implications of brain data acquisition and processing, and outline a multi-level governance framework. This framework is aimed at maximizing the benefits of facilitated brain data collection and further processing for science and medicine whilst minimizing risks and preventing harmful use. Based on evidence from press articles covering 39 corporate fraud cases that went public during the period 1992-2005, the objective of this article is to examine the role of managers' behavior in the commitment of the fraud. This study integrates the fraud triangle (FT) and the theory of planned behavior (TPB) to gain a better understanding of fraud cases. The results of the analysis suggest that personality traits appear to be a major fraud-risk factor. The analysis was further validated through (...) a quantitative analysis of keywords which confirmed that keywords associated with the attitudes/rationalizations component of the integrated theory were predominately found in fraud firms as opposed to a sample of control firms. The results of the study suggest that auditors should evaluate the ethics of management through the components of the TPB: the assessment of attitude, subjective norms, perceived behavioral control and moral obligation. Therefore, it is potentially important that the professional standards that are related to fraud detection strengthen the emphasis on managers' behavior that may be associated with unethical behavior. Background Disclosure of obtaining informed consent from patients (ICP) and research ethics committee (REC) approval in published reports is sometimes omitted. To date, no disclosure data are available on surgical research. Objective Our aim was to assess whether REC approval and ICP were documented in surgical trials. Study design Overall, 657 randomised trials, published between 2005 and 2010 in 10 international journals, were included. We collected the report rate of REC approval and ICP and contacted the corresponding author when ethical (...) information was lacking. Results Among the 657 randomised controlled trials (RCT), 576 (87.7%) stated that an REC had approved the research, and 606 (92.2%) stated that ICP had been requested. Furthermore, 28 RCTs (4.3%) reported neither REC nor ICP. Conclusions The phase III randomised surgical trials that were analysed were shown to have respected fundamental ethical principles in approximately 90% of the cases examines. (shrink)

Actin performs structural as well as motor‐like functions in eukaryotic cells. Orthologues of actin have also been identified in bacteria, where they perform an essential function during cell growth. Bacterial actins are implicated in the maintenance of rod‐shaped cell morphology, and appear to form a cytoskeletal structure, localising as helical filaments underneath the cell membrane. Recently, a plasmid‐borne actin orthologue has been shown to perform a mitotic‐like function during segregation of a plasmid, and chromosomally encoded actin proteins were found to (...) play an important role in chromosome segregation. Based on the findings that actin filaments are dynamic structures in two bacterial species, we propose that actins perform motor functions rather than a purely structural role in bacteria. We suggest that an intracellular motor exists in bacteria that could be derived from an ancestral actin motor that was present in cells early in evolution. Several studies have explored differences between North American and European doctor patient relationships. They have focused primarily on differences in philosophical traditions and historic and socioeconomic factors between these two regions that might lead to differences in behaviour, as well as divergent concepts in and justifications of medical practice. However, few empirical intercultural studies have been carried out to identify in practice these cultural differences. This lack of standard comparative empirical studies led us to compare differences between France and the (...) USA regarding end-of-life decision-making. We tested certain assertions put forward by bioethicists concerning the impact of culture on the acceptance of advance directives in such decisions. In particular, we compared North American and French intensive care professional's attitudes toward: (1) advance directives, and (2) the role of the family in decisions to withhold or withdraw life-support. Background and objective: Assuming the hypothesis that the general practitioner can and should be a key player in making end-of-life decisions for hospitalised patients, perceptions of GPs’ role assigned to them by hospital doctors in making withdrawal decisions for such patients were surveyed.Design: Questionnaire survey.Setting: Urban and rural areas.Participants: GPs.Results: The response rate was 32.2% , and it was observed that 70.8% of respondents believed that their participation in withdrawal decisions for their hospitalised patients was essential, whereas 42.1% believed that (...) the hospital doctors were sufficiently skilled to make withdrawal decisions without input from the GPs. Most respondents were found to believe that they had the necessary skills and enough time to participate in withdrawal decisions. The last case of treatment withdrawal in hospital for one of their patients was described by 40% of respondents, of whom only 40.0% believed that they had participated actively in the decision process. The major factors in the multivariate analysis were the GP’s strong belief that his or her participation was essential , information on admission of the patient given to the GP by the hospital department , rural practice , visit to the patient dying in hospital and a request by the family to be kept informed about the patient .Conclusion: Strong interest was evinced among GPs regarding end-of-life issues, as well as considerable experience of patients dying at home. As GPs are more closely corrected to patients’ families, they may be a good choice for third-party intervention in making end-of-life decisions for hospitalised patients. (shrink)

The problem of measurement is often considered an inconsistency inside the quantum formalism. Many attempts to solve it have been made since the inception of quantum mechanics. The form of these attempts depends on the philosophical position that their authors endorse. I will review some of them and analyze their relevance. The phenomenon of decoherence is often presented as a solution lying inside the pure quantum formalism and not demanding any particular philosophical assumption. Nevertheless, a widely debated question is to (...) decide between two different interpretations. The first one is to consider that the decoherence process has the effect to actually project a superposed state into one of its classically interpretable component, hence doing the same job as the reduction postulate. For the second one, decoherence is only a way to show why no macroscopic superposed state can be observed, so explaining the classical appearance of the macroscopic world, while the quantum entanglement between the system, the apparatus and the environment never disappears. In this case, explaining why only one single definite outcome is observed remains to do. In this paper, I examine the arguments that have been given for and against both interpretations and defend a new position, the “Convivial Solipsism”, according to which the outcome that is observed is relative to the observer, different but in close parallel to the Everett’s interpretation and sharing also some similarities with Rovelli’s relational interpretation and Quantum Bayesianism. I also show how “Convivial Solipsism” can help getting a new standpoint about the EPR paradox providing a way out of the seemingly unavoidable non-locality of quantum mechanics. (shrink)

Understanding the mechanisms and the time and spatial evolution of penumbra following an ischemic stroke is crucially important for developing therapeutics aimed at preventing this area from evolving towards infarction. To help in integrating the available data, we decided to build a formal model. We first collected and categorised the major available evidence from animal models and human observations and summarized this knowledge in a flow-chart with the potential key components of an evolving stroke. Components were grouped in ten sub-models (...) that could be modelled and tested independently: the sub-models of tissue reactions, ionic movements, oedema development, glutamate excitotoxicity, spreading depression, NO synthesis, inflammation, necrosis, apoptosis, and reperfusion. Then, we figured out markers, identified mediators and chose the level of complexity to model these sub-models. We first applied this integrative approach to build a model based on cytotoxic oedema development following a stroke. Although this model includes only three sub-models and would need to integrate more mechanisms in each of these sub-models, the characteristics and the time and spatial evolution of penumbra obtained by simulation are qualitatively and, to some extent, quantitatively consistent with those observed using medical imaging after a permanent occlusion or after an occlusion followed by a reperfusion. The Inforare project aims to set up a system for the sharing of clinical and familial data, in order to study how genes are related to the severity of sickle cell disease. While the computerisation of clinical records represents a valuable research goal, an ethical framework is necessary to guarantee patients' protection and their rights in this developing field. Issues relating to patient information during the Inforare study were analysed by the steering committee. Several major concerns were discussed by the (...) committee and formalised in the patients' information letter: educating patients to aid the recruitment of family members, rules of confidentiality and the disclosure of aggregate, individual and unexpected research results. Matrix models are widely used in biology to predict the temporal evolution of stage-structured populations. One issue related to matrix models that is often disregarded is the sampling variability. As the sample used to estimate the vital rates of the models are of finite size, a sampling error is attached to parameter estimation, which has in turn repercussions on all the predictions of the model. In this study, we address the question of building confidence bounds around the predictions of matrix (...) models due to sampling variability. We focus on a density-dependent Usher model, the maximum likelihood estimator of parameters, and the predicted stationary stage vector. The asymptotic distribution of the stationary stage vector is specified, assuming that the parameters of the model remain in a set of the parameter space where the model admits one unique equilibrium point. Tests for density-dependence are also incidentally provided. The model is applied to a tropical rain forest in French Guiana. (shrink)

Developing countries face numerous barriers to conducting effective and efficient ethics reviews of international collaborative research. In addition to potentially overlooking important scientific and ethical considerations, inadequate or insufficiently trained ethics committees may insist on unwarranted changes to protocols that can impair a study's scientific or ethical validity. Moreover, poorly functioning review systems can impose substantial delays on the commencement of research, which needlessly undermine the development of new interventions for urgent medical needs. In response to these concerns, the Drugs (...) for Neglected Diseases Initiative, an independent nonprofit organization founded by a coalition of public sector and international organizations, developed a mechanism to facilitate more effective and efficient host country ethics review for a study of the use of fexinidazole for the treatment of late stage African Trypanosomiasis. The project involved the implementation of a novel ‘pre-review’ process of ethical oversight, conducted by an ad hoc committee of ethics committee representatives from African and European countries, in collaboration with internationally recognized scientific experts. Pour répondre à cette question, nous avons demandé à un groupe d’experts et un groupe de novices de décrire des vins à l’aide d’une liste de termes organisée en trois niveaux de catégorisation allant du plus général au plus spécifique. Nous avons ensuite demandé aux mêmes sujets d’apparier les descriptions réalisées par une autre personne avec les vins correspondants. Les résultats montrent que les descriptions (...) effectuées par les experts sont plus précises et conduisent à de meilleures performances d’appariement que celles effectuées par les novices. De plus, la distance entre les descriptions d’experts et celles de novices augmente avec le niveau de précision des termes. (shrink)

Prior research has documented the continued existence of an expectation gap, defined as the divergence between the public’s and the profession’s conceptions of auditor’s duties, despite the auditing profession’s attempt to adopt standards and practices to close this gap. In this paper, we consider one potential explanation for the persistence of the expectation gap: the role of media bias in shaping public opinion and views. We analyze press articles covering 40 U.S. corporate fraud cases discovered between 1992 and 2011. We (...) compare the auditor’s duties, described by the auditing standards, with the description of the fraud cases as found in the press articles. We draw upon prior research to identify three sources of the expectation gap: deficient performance, deficient standards, and unreasonable expectations. The results of our analysis provide evidence that the performance gap can be reduced by strengthening auditor’s willingness and ability to apply existing auditing standards concerning fraud detection; the standards gap can be narrowed by improving existing auditing standards; and unreasonable expectations, however, involve elements beyond the profession’s sphere of control. As a result, the expectation gap is unlikely to disappear given the media’s tendency to bias, with an overemphasis of unreasonable expectations in their coverage of frauds and press articles tending to reinforce the view that the auditor should take more responsibility for detecting fraud, irrespective of whether this is feasible at a reasonable cost. In addition to the primary role of the press in perpetuating the expectation gap, a second reason for continuation of the expectation gap is that the rational auditor will have difficulty in assessing subjective components of fraudulent behavior. Larousse -/- La hausse des prix des carburants proposée pour lutter contre le changement climatique et mettre en œuvre les principes de la « transition écologique » adoptés par la France lors de la COP21, a fait naître le mouvement des gilets jaunes. Plus globalement c’est une bonne partie des français qui se trouve concernée, celle qui vit (...) dans des zones excentrées et qui ne bénéficie pas d'un réseau de transports très efficient tel celui qui émaille par exemple le territoire parisien. Ainsi, augmenter les prix des carburants, en particulier le diesel, a été perçu comme un contresens économique anti-populaire. Pendant des en, les producteurs d’automobiles, avec le support des politiques publiques, ont présenté le diesel comme le carburant le moins polluant. Mais aujourd’hui devenu le carburant « satanique », les consommateurs qui l’ont choisi, en toute bonne conscience, se sentent manipulés. La reconversion vers l’achat d’une voiture électrique est hors de la portée de la plupart de ceux qui aujourd’hui manifestent. Les aides du gouvernement ne changent pas cette réalité socioéconomique. Sous quel angle, les média ont-ils restitué le mouvement des gilets jaunes ? Alors qu’on voit émerger au sein de ce mouvement des revendications pour plus de justice sociale, qu’en est-il de la justice environnementale ? Peut-on dire qu’il s’agit d’une révolte sociale anti-écologique ? Ou autrement dit, les gilets jaunes sont-ils un mouvement anti-écologique ? (shrink)

Theoretical minimal RNA rings are candidate primordial genes evolved for non‐redundant coding of the genetic code's 22 coding signals (one codon per biogenic amino acid, a start and a stop codon) over the shortest possible length: 29520 22‐nucleotide‐long RNA rings solve this min‐max constraint. Numerous RNA ring properties are reminiscent of natural genes. Here we present analyses showing that all RNA rings lack dinucleotide CG (a mutable, chemically instable dinucleotide coding for Arginine), bearing a resemblance to known CG‐depleted genomes. CG (...) in “incomplete” RNA rings (not coding for all coding signals, with only 3–12 nucleotides) gradually decreases towards CG absence in complete, 22‐nucleotide‐long RNA rings. Presumably, feedback loops during RNA ring growth during evolution (when amino acid assignment fixed the genetic code) assigned Arg to codons lacking CG (AGR) to avoid CG. Hence, as a chemical property of base pairs, CG mutability restructured the genetic code, thereby establishing itself as genetically encoded biological information. (shrink)

Cette question est pourtant importante. Une confrontation avec l’alternative que pourrait constituer le tirage au sort d’une assemblée représentative permet d’identifier les vertus spécifiques de l’élection au regard de quatre critères de légitimité démocratique : le consentement et la responsabilité des gouvernés, (...) l’inclusion égalitaire des citoyens, le contrôle des décideurs et la contestabilité des décisions, la qualité épistémique de la décision. L’analyse conduit à conclure au caractère essentiel de l’élection dans des démocraties de masse. C’est à partir d’elle, et non en dépit d’elle, que doit être surmontée la crise de la représentation. This article proposes a new reading of transformative learning theory (TAT), proceeding from an examination of three concepts: the function of habit in the processes of constructing experience, the notion of trial and its potential, and the biographical dimensions of Transformative Learning Theory. This approach leads us to question the theories of experience that tacitly underlie the learning models proposed by Mezirow. Les sciences en général, et les sciences de la vie en particulier, ont un tel impact sur le quotidien des personnes que les scientifiques ont un devoir d’anticipation. Probablement en raison de sa fonction si particulière de support de l’information héréditaire, l’ADN, sa caractérisation, son décryptage, ses modifications, ont été l’objet d’une attention particulière depuis une cinquantaine d’années. C’est de nouveau le cas depuis la découverte puis l’adaptation récente des techniques de modifications ciblées du génome. Des découvertes scientifiques ont lieu (...) chaque jour, elles font rarement la une de l’actualité même si régulièrement des média en manque de sensations fortes nous annoncent une nouvelle révolution. Mais la réalité pratique est rare parce que les découvertes qui amènent à un changement de paradigme sont rares. C’est parce qu’une découverte académique donne rarement lieu à une application technologique et que même si celle-ci est envisagée, le transfert est long, difficile et peu souvent couronné de succès. Il est donc d’autant plus nécessaire aujourd’hui de souligner que c’est à l’une de ces révolutions technologiques que nous assistons avec la nouvelle maîtrise de modifications ciblées du génome grâce au système CRISPR-Cas9 et à ses dérivés. Les enjeux scientifiques et médicaux mais également économiques et environnementaux sont énormes. Il convient donc d’évaluer au plus vite le cadre légal, éthique et sociétal permettant de bénéficier au mieux de ces techniques sans en subir les dangers. Seul un cadre international associant une expertise scientifique pluridisciplinaire à la gouvernance est envisageable, c’est donc à la création d’un Groupe International d’Experts du Génome que nous appelons. Pour ce faire une première position de consensus européen a été élaborée et mise en discussion lors de plusieurs colloques internationaux. (shrink)

Through a close analysis of various moments within two hours of video-taped interaction, we investigate properties of the setting that the participants cannot ignore even as they transform them in various ways. These properties are not under local control. What is under control is revealed in the participants' “play” with the properties, including dangerous, “deep” play. In this process, some properties of the participants are rarely mentioned (e.g., that the laboring woman is an MD), others are repeatedly emphasized (e.g. the (...) strength of contractions). And others appear in ways that have not been dealt with adequately in current theoretical frameworks. To deal with life-threatening lies, and jokes about lies, we must move away from theories of hegemonic particularity that rely on a habitus. Rather we must acknowledge the practical understandings revealed in the collective submergence of that which may be actively noted as potentially relevant and then set aside so that other tasks can be foregrounded and achieved. Wie aber kann das gelingen? In vielen verfügbaren Unterrichtsmaterialien werden argumentative Fähigkeiten eher vorausgesetzt als systematisch gefördert. Auch curriculare Vorgaben bleiben zumeist sehr unspezifisch. Lehrpersonen werden so weitgehend allein gelassen mit der Aufgabe, Lernende beim Erwerb (...) argumentativer Fähigkeiten zu fördern. Die vorliegende Aufgabensammlung soll dazu beitragen, diese Lücke zu schließen. Sie bietet Lehrpersonen reichhaltige Materialien für die spiralcurricular angelegte, systematische Förderung argumentativer Fähigkeit anhand exemplarischer Inhalte. Orientiert an klaren fachlichen Standards finden sich hier Aufgaben auf vier Niveaustufen, jeweils in Verbindung mit übersichtlichen Merkblättern. Die Aufgaben der beiden unteren Niveaustufen lassen sich bereits für jüngere Lernende der Sekundarstufe einsetzen, Aufgaben der obersten Niveaustufe richten sich an Lernende von Abschlussklassen oder der Studieneingangsphase. Für die Hand der Lehrpersonen werden die Aufgaben und Merkblätter durch fachliche und didaktische Kommentare sowie Lösungshinweise ergänzt. (shrink)

Gleïzès, philosophe proche des Méditateurs et des dormeuses, avait écrit une épopée pionnière du mouvement végétarien se déroulant sur la Montagne noire dans le Sud-Ouest de la France. Ce livre en main, Louise Hervé et Clovis Maillet ont été à la rencontre des maraîchers et des végétarien·nes de la région en 2023, au lendemain d’une grande manifestation contre la construction de l’autoroute Toulouse-Castres. Leur cri de ralliement était : « Moins de bitume, plus de légumes ».

Our position is critical of the dominant method in psychology, and critical of the social use of psychological models. We assert that the scientific approach in psychology must break with modernist claim, but without sinking into post-modernist relativism. We consider that the epistemology associated with experimental psychology should be a specific epistemology associated with the particular objects studied. By calling on pragmatism and realism, psychology can find the resources to use quantitative studies as an action deployed within a complex, interactive (...) and dynamic social space, and thus break with its normative practice and function. BackgroundAt the start of 2021, oncologists lacked the necessary scientific knowledge to adapt their clinical practices optimally when faced with cancer patients refusing or reluctant to be vaccinated against COVID-19, despite the marked vulnerability of these patients to severe, and even fatal forms of this new viral infectious disease. Oncologists at Foch Hospital were confronted with this phenomenon, which was observed worldwide, in both the general population and the population of cancer patients.MethodsBetween April and November 2021, the Ethics and Oncology (...) Departments of Foch Hospital decided to investigate this subject, through an empirical and interdisciplinary study in bioethics. Our scientific objective was to try to identify and resolve the principal bio-ethical issues, with a view to improving clinical practices in oncology during future major pandemics of this kind, from a highly specific bio-ethical standpoint. We used a mainly qualitative methodological approach based on questionnaires and interviews.ResultsIn April 2021, 29 cancer patients refused or were reluctant to be vaccinated. Seventeen of these patients said that making vaccination mandatory would have helped them to accept vaccination. In October 2021, only 10 cancer patients continued to maintain their refusal. One of the main reasons for the decrease in refusals was probably the introduction of the “pass sanitaire” in July 2021, which rendered vaccination indispensable for many activities. However, even this was not sufficient to convince these 10 cancer patients.ConclusionWe identified a key bio-ethical issue, which we then tried to resolve: vaccination policy. We characterized a major tension between “the recommendation of anti-COVID-19 vaccination” and “free will”, and the duty to “protect each other”. Mandatory vaccination, at least in France, could resolve this tension, with positive effects on quality of life, or survival, in cancer patients initially refusing or reluctant to be vaccinated, but only if collective and individual scales are clearly distinguished. Suppose we can save either a larger group of persons or a distinct, smaller group from some harm. Many people think that, all else equal, we ought to save the greater number. This article defends this view (with qualifications). But unlike earlier theories, it does not rely on the idea that several people's interests or claims receive greater aggregate weight. The argument starts from the idea that due to their stakes, the affected people have claims to have a say in (...) the rescue decision. As rescuers, our primary duty is to respect these procedural claims, which we must do by doing what these people would decide, in a process where each is given an equal vote on the matter. So in cases where each votes in their own self-interest, respect for their equal right to decide, or their autonomy, will lead us to save the greater number. The argument is explained in detail, with special attention to the questions of how, exactly, it avoids aggregation, and of why majority rule is superior to lottery procedures. The view has further advantages. Especially, it explains the “partial” relevance of numbers in cases involving unequal harms, and it does so in a way that dissolves the appearance of paradox that besets theories of “partial aggregation.”. A large number of physicists now admit that quantum mechanics is a non-local theory. The EPR argument and the many experiments showing the violation of Bell’s inequalities seem to have confirmed convincingly that quantum mechanics cannot be local. Nevertheless, this conclusion can only be drawn inside a standard realist framework assuming an ontic interpretation of the wave function and viewing the collapse of the wave function as a real change of the physical state of the system. We show that this (...) standpoint is not mandatory and that if the collapse is not considered an actual physical change it is possible to recover locality. (shrink)
