This paper investigates the circumstances under which it is morally permissible to impose non-negligible risks of serious harm on innocent civilians in order not to endanger tangible cultural heritage during armed conflict. Building on a previous account of the value of cultural heritage, it is argued that tangible cultural heritage is valuable because of how it contributes to valuable and meaningful human lives. Taking this account as the point of departure I examine the claim that commanders should (...) be prepared to risk lives of innocent civilians in order to avoid harm to tangible cultural heritage. I argue that imposing high risks of serious harm on innocent civilians without their consent constitutes a wrong that can be justified only in order to avoid a greater evil. It is then argued that damage to cultural heritage sites rarely constitutes the greater evil when weighed against the imposition of non-consensual risks of serious harm on innocent civilians, especially when the risk is substantial. Still, imposing substantial risks might be morally permissible under the condition that they are consensually imposed, even if they are not the lesser evil. However, I argue that even if one has reason to suspect that there are civilians who might consent to at least some significant risks in order to avoid damage to their cultural heritage, it is not clear that commanders should take this into account when deciding what to do. Unless all of those who are at risk consent, the fact that some of those whose lives are at risk consent to the risk of being killed do not make it morally permissible to impose this risk on the group as a whole. Recent archaeological theory has show that images of the past have carried a particularly strong resonance within modern social groups. This volume explores the immeasurable impact that the phenomenon of archaeology has had on the representation of the past in the modern world. Modern society’s ‘archaeological imagination’ conceives of archaeology as a producer of images of the past which become representations of modern group identities. If archaeology is utilized by public groups to construct and represent identities, then what are archaeologists (...) to do with that public? The very fact that the public is interested in the past and in archaeological research is an opportunity for archaeology to engage that public. Participation in the public’s modern interest in archaeology, however, puts archaeology at risk. The growing role of archaeology and heritage within the economics of tourism, has led to a commodification of archaeological knowledge and experience for consumption. This volume begins a discourse on the implications of performing archaeology in a world dominated by modern trends of mass production, mass replication and representation of cultural forms and mass consumption of images of the past. The contributors explore to what extent we are experiencing a crisis of representation of the past due to contemporary consumption of mass-produced replicas, simulations, images and experiences of the past. To work through this crisis the contributors in this volume are exploring opportunities for development within archaeological thought and practice. Their arguments illustrate a move towards active, participatory and poetic archaeological thought and practice. Rather than focusing on what is produced through process (artifacts, monuments, interpretive centers, etc.), they are concerned with what they are doing, about taking part, about participating reflexively in the tradition of understanding and expressing understanding of the past. This volume does not conjure up romantic beliefs about the project of archaeology, but rather, it signals a fundamental revision of archaeology - not what it is, but what it can do. (shrink)

ABSTRACTThis article suggests that corporate responsibility should be interpreted to include concern about resources that cannot easily be treated as commodities. Heritage Sites are places of historical and cultural importance. Given the primacy of contingent valuation methods in creating policy, these sites are often at risk from development or tourism since there is pressure to treat them as revenue centers. The article moves to looking at the status of sites in terms of property rights, drawing on Locke's original (...) formulation. The article concludes that there is a normative justification for treating these sites as collective property that may warrant maintenance, preservation and restricted access. (shrink)

While the 1970's have been called the environmental years, the 1990's could be seen as the genome years. As the challenge to map and to sequence the human genome mobilized the scientific community, risks and benefits of information and uses that would derive from this project have also raised ethical issues at the international level. The particular interest of the 1997 UNESCO Declaration relies on the fact that it emphasizes both the scientific importance of genetics and the appropriate reinforcement of (...) human rights in this area. Rock art - paintings, and pecked or engraved images on rocks, whether in caves, shelters, or in the open-air - exists in all but a couple of countries of the world [Bahn, 1998], It spans a period from at least 35,000 years ago to historic times, comprises many millions of images from hundreds of thousands of sites, and thus constitutes the vast majority of the world's art, and art history. It is a phenomenon that has seen a huge upsurge of (...) interest in the last few decades, with not only numerous publications and conferences, but also a proliferation of calendars, T-shirts, mugs, jewellery, and garments bearing rock art images. Many people who are famous for other things have worked on or published rock art - for example, scholars such as Mary Leakey or authors like Joy Adamson or Erle Stanley Gardner. Rock art studies have always been the domain of the “amateur” as well as the “professional”, and amateurs remain of huge importance in this field. Indeed, most of the principal rock art organisations, along with their journals, were created by, are run by, and consist largely of amateur enthusiasts who include some of the world's foremost specialists. The growing popularity of the art brings an ever-increasing risk of pollution, damage, and vandalism, as well as outright thefts of wall or cave images. The rock art associations are dedicated to the discovery, recording, and conservation of rock art, and play a major role in striving to teach schoolchildren and adults alike about the incalculable importance of this irreplaceable, universal heritage and about the need to respect and protect it. To better understand ethical issues involved in the field of human genetics and promote debate within the scientific community, the author surveyed scientists who engage in human genetics research about the pros, cons, and ethical implications of genetic testing. This study contributes systematic data on attitudes of scientific experts. The survey finds respondents are highly supportive of voluntary testing and the right to know one's genetic heritage. The majority consider in utero testing and consequent pregnancy termination acceptable for cases (...) involving likelihood of serious disease but disapprove for genetic reasons they consider arbitrary, leaving a gray area of distinguishing between treatment of disorders and enhancement still to be resolved. While safeguarding patient confidentiality versus protecting at-risk third parties presents a dilemma, preserving privacy from misuse by institutional third parties garners strong consensus for legislation against discrimination. Finally, a call is made for greater genetic literacy. (shrink)

A virtually infinite array of new discoveries are bringing increasingly evident transformations to all that we do, how we live, how all of us relate to each other, ourselves and the world. To think about this new time, it is necessary to experience the vertigo of placing our mind at risk. We are immersed in a comparatively new context of existence. A new humanity is being built, and it will thus represent a new society and a unique conception of (...) what a person is. We have established ourselves as the cities we pass through daily, as sets of flows, relations of power and strengths. Like a city, we are also information networks; power fields constantly brought into play, as we connect with spaces in an imbricated and interdependent way. We are a kind of species that, in face of its desire, is capable of putting this very existence at risk; of suicidal artists, kamikazes, who risk themselves and the planet. What is the specificity of this species? What is the possible (psycho)analysis? The aim of this article is to present and articulate the current changes and the absolute artificialism of our species in the transformation of its corporeity that devours and appropriates whatever presents itself, and which produces means and prostheses for the compulsive realization of our fantasies; new realities that increasingly appear on the horizon and affect our daily lives. ABSTRACT Chemsex is a phenomenon in which typically gay, bisexual, trans, queer, and/or related communities of men take psychoactive drugs while having sex, often without a condom. The practice can lead to increased rates of HIV transmission, sexual assault, and in extreme cases murder. GBTQ+ men are already a stigmatised group so those who engage in chemsex face multiple stigmas. This study examines the ways that two types of media report on chemsex while negotiating these stigmas. We take a large (...) data set of newspaper articles written for the general British public and a smaller data set of magazines aimed at GBTQ+ men to examine how chemsex is represented in the media. We find that the mainstream press focus on extreme criminal cases involving chemsex, while the media aimed at GBTQ+ men focus on counselling services and discuss chemsex in relation to gay culture. Chemsex is unlikely to go away, and so we address how information about it is conveyed in different media and call for more research in this area. (shrink)

Student cheating has always been a problem in higher education, but detection of cheating has become easier with technology. As a result, more students are being caught and reported for cheating. While reporting cheating is not a negative, the rippling effects of reported cheating may be felt by some populations more than others. Thus, preventing cheating would be a preferable option for all involved.Identifying those at risk for being reported for cheating is a first step in developing preventive measures. (...) Previous research has attempted to do this through the use of self-report surveys, but such research takes considerable time and resources to conduct and suffers from low response rates and social desirability bias. To address this limitation in existing research, this study links existing data from records of other-reported cheating to university registration data in order to examine 6 cheating risk factors identified in previous research: maturity level, gender, grade point average, major, international student status, and fear of punishment. The results of the study suggest that international and transfer students, particularly those who are male, in high-risk majors, and have lower grade point averages, are in particular need of preventative education. Likewise, those faculty who teach in computer science, engineering and economics majors should do more to educate implement practices to reduce the likelihood of cheating. (shrink)

This view of children requires an expanded understanding of the whole gospel moving past children-at-risk as subjects of evangelism and advocacy. Children are seen as vulnerable agents of God, participants in their own development, and co-participants with the Church in the missio Dei. Patients in specialist mental healthcare services who are at risk of suicide may experience their struggles as existential in nature. Yet, research on meaning in life has been relatively scarce in suicidology. This qualitative study aimed to explore how patients at risk of suicide perceived their encounters with specialist healthcare professionals after a suicide attempt (SA), with special reference to meaning in life experiences. The study was conducted in specialised mental healthcare services in Norway. Data were collected via (...) individual interviews with eight patients aged 20–75 years. Using a four-step procedure, the interviews were analysed by systematic text condensation. The participants understood their feelings of shame, self-contempt and challenging life experiences as contributing factors to their SA. They perceived that existential themes in relation to financial difficulties, shame and trauma were resolved, while issues associated with the SA, such as death, loss and beliefs, were given less attention. The participants were either ambivalent about continuing to live or wished to rebuild a meaningful life. Overall, their experiences of meaningfulness were hampered. Assisting patients with meaning in life experiences may help them alter their life interpretations and increase their ability to rebuild their lives as meaningful. The present study should be seen as a contribution to meaning-informed approaches in specialist mental healthcare services. More research is needed to equip healthcare personnel in their overall aims of preventing suicide and supporting patients at risk in their efforts to live a meaningful life. (shrink)

This article reviews arguments that, in the process of action formation and ascription, the relative status of the participants with respect to a projected action can adjust or trump the action stance conveyed by the linguistic form of the utterance. In general, congruency between status and stance is preferred, and linguistic form is a fairly reliable guide to action ascription. However incongruities between stance and status result in action ascriptions that are at variance with the action stance that is otherwise (...) conveyed in the turn. This argument is presented, first, in relation to epistemic status and stance where the process is argued to be both fundamental and universal across all declarative and interrogative utterances. Some consequences of this way of viewing action are discussed. The argument is then briefly extended to deontics and benefactives. (shrink)

The Expected Shortfall or Conditional Value-at-Risk (CVaR) has been playing the role of main risk measure in the recent years and paving the way for an enormous number of applications in risk management due to its very intuitive form and important coherence properties. This work aims to explore this measure as a probability-dependent utility functional, introducing an alternative view point for its Choquet Expected Utility representation. Within this point of view, its main preference properties will be characterized (...) and its utility representation provided through local utilities with an explicit dependence on the assessed revenue’s distribution (quantile) function. Then, an intuitive interpretation for the related probability dependence and the piecewise form of such utility will be introduced on an investment pricing context, in which a CVaR maximizer agent will behave in a relativistic way based on his previous estimates of the probability function. Finally, such functional will be extended to incorporate a larger range of risk-averse attitudes and its main properties and implications will be illustrated through examples, such as the so-called Allais Paradox. This book examines historical approaches and current research and practice related to the education of adolescents placed at risk of school failure as a result of social and economic conditions. One major goal is to expand the intellectual exchange among researchers, policymakers, practitioners, and concerned citizens on factors influencing the achievement of poor and minority youth, specifically students in middle and high schools. Another is to encourage increased dialogue about policies and practices that can make a difference in educational (...) opportunities and outcomes for these students. Although the chapters in this volume are not exhaustive, they represent an array of theoretical and methodological approaches that provide readers with new and diverse ways to think about issues of educational equality and opportunity in the United States. A premise that runs through each chapter is that school success is possible for poor and minority adolescents if adequate support from the school, family, and community is available. *The conceptual approach places the research and practice on students placed at risk in a historical context and sets the stage for an important reframing of current definitions, research, policies, and practices aimed at this population. *Multiple research methodologies allow for comparisons across racial and ethnic groups as well as within groups, and contribute to different and complementary insights. Section III, "Focus on African-American Students," specifically addresses gender and social class differences among African-American adolescents. *Current reform strategies presently being implemented in schools throughout the United States are presented and discussed. These strategies or programs highlight how schools, families, and communities can apply research findings like the ones this book presents, thus bridging the often wide gap between social science research and educational practice. A few years ago, Stanley Rosen, sensing a tide of alien thinkers threatening the territory of canonical interpretation, raised the following anthem to stiffen the spirit of the resisting troops.

Recent attempts to develop and apply digital ethics principles to address the challenges of the digital transformation leave organisations with an operationalisation gap. To successfully implement such guidance, they must find ways to translate high-level ethics frameworks into practical methods and tools that match their specific workflows and needs. Here, we describe the development of a standardised risk assessment tool, the Principle-at-Risk Analysis (PaRA), as a means to close this operationalisation gap for a key level of the ethics (...) infrastructure at many organisations – the work of an interdisciplinary ethics panel. The PaRA tool serves to guide and harmonise the work of the Digital Ethics Advisory Panel at the multinational science and technology company Merck KGaA in alignment with the principles outlined in the company’s Code of Digital Ethics. We examine how such a tool can be used as part of a multifaceted approach to operationalise high-level principles at an organisational level and provide general requirements for its implementation. We showcase its application in an example case dealing with the comprehensibility of consent forms in a data-sharing context at Syntropy, a collaborative technology platform for clinical research. This book examines matters of religious freedom in Europe, considers the work of the European Court of Human Rights in this area, explores issues of multiculturalism and secularism in France, of women in Islam, and of Muslims in the West. The work presents legal analysis and ethnographic fieldwork, focusing on concepts such as laïcité, submission, equality and the role of the state in public education, amongst others. Through this book, the reader can visit inside a French public school located in (...) a low-income neighborhood just south of Paris and learn about the complex dynamics that led up to the passing of the 2004 law banning Muslim headscarves. The chapters bring to light the actors and cultures within the school that set the stage for the passing of the law and the political philosophy that supports it. School culture and philosophy are compared and contrasted to the thoughts and opinions of the teachers, administrators and students to gage how religious freedom and identity are understood. The book goes on to explore the issue of religious freedom at the European Court of Human Rights. The author argues that the right to religious freedom has been too narrowly understood and is being fenced in by static visions of Islam. This jeopardizes the idea of religious freedom more broadly. By becoming entangled with regional and domestic politics, the Court is neglecting important nuances and is jeopardizing secularism, pluralism and democracy. Macroeconomic dynamics and the at-risk-of-poverty population in Slovakia This paper deals with analysis and presentation of the core findings under the EU SILC 2009 project. Particularly we are oriented on study of the socially vulnerable groups of population identified according their income situation. As a sorting criterion for this purpose we use the standard methodology set by OECD and Eurostat. It means the 60% of the national median equivalized disposable income is applied for this criterion as the poverty threshold. (...) The national income variable is firstly calculated as a total income for each surveyed household and dived by the equivalized size of household. By this procedure the households of various structures are transformed onto generally accepted scale. The special attention of our study is oriented on the cluster of population living on income below the poverty threshold. For this population we calculate so called social deficit. Through this value we show the volume of financial means needed to upgrade the living standard of the population living bellow poverty threshold at least to the poverty threshold level.Special section of the paper is devoted to study of relation among the core macroeconomic indicators and level and size of the at-risk-of-poverty population during the period of last economic development, including both economic growth and economic recession. According our tentative findings we did not find the significant impact of economic growth on the status of socially vulnerable population. This finding however should be studied in broader context, with longer time series of relevant data and with broader set of explanatory variables. (shrink)

IntroductionGratitude is commonly known as a positive emotion, but it can also be understood as a disposition—one’s inherent quality that includes being grateful for the positive aspects of one’s life and appreciating altruistic gifts. A growing body of research suggests that having a disposition of gratitude is positively related to wellbeing and psychological adjustment. The present study examined the extent to which acceptance of illness—a measure of adjustment to a distressing condition—mediated relationships between dispositional gratitude and wellbeing among women who (...) had elevated levels of depressive symptoms.MethodsParticipants were 131 women who, based on scores on the Center for Epidemiological Studies Depression scale, were at-risk for experiencing clinical depression. Thirty-five of these participants had been diagnosed as depressed at some point in their lives and 96 had not. Participants completed measures of dispositional gratitude, wellbeing, anxiety, and acceptance of illness.ResultsDispositional gratitude was positively correlated with wellbeing and was negatively correlated with depression and anxiety. Dispositional gratitude was also positively correlated with acceptance of illness. Mediational analyses found that acceptance of illness mediated relationships between dispositional gratitude and wellbeing, between dispositional gratitude and anxiety, and between dispositional gratitude and depression. Moreover, such mediation varied as a function of whether women had ever been diagnosed as depressed. Acceptance of illness was related more strongly to wellbeing for women who had been diagnosed as depressed at some time in their lives than it was for women who had never been diagnosed as depressed.ConclusionWomen with elevated depressive symptoms who were more grateful were more accepting of their condition, which was related to increased wellbeing and decreased feelings of depression and anxiety. The current COVID-19 pandemic has raised many questions and dilemmas for modern day ethicists and healthcare providers. Are physicians, nurses and other healthcare workers morally obligated to put themselves in harm’s way and treat patients during a pandemic, occurring a great risk to themselves, their families and potentially to other patients? The issue was relevant during the 1918 influenza epidemic and more recently severe acute respiratory syndrome epidemic in 2003. Since the risk to the healthcare workers was great, (...) there was tension between the ethical duty and responsibility to treat and the risk to one’s own life. This tension was further noted during the 2014 Ebola outbreak in West Africa that left hundreds of healthcare workers dead. The AMA Code of Ethics states that physicians are to ‘provide urgent medical care during disasters…even in the face of greater than usual risk to physicians’ own safety, health or life.’1 Classic Jewish sources have dealt with this question as well. There is an obligation ‘to not stand by idly when your friends life is in danger’; however, the question arises as to whether there are limits to this obligation? Is one required to risk one’s own life to save another’s? There is a consensus that one is not required but the question open to debate is whether it is praiseworthy to do so. However, regarding healthcare workers, there is agreement for ethical, professional and societal reasons that they are required to put themselves in harm’s way to care for their patients. (shrink)

Our aim in this article is twofold. First, we challenge the essentialized notion of adolescents and young people as perpetually driven to resist the authority of adults. At the same time, we disrupt linguistic conceptions of adolescent discourse, along with the discourse of youth at risk, by analyzing a transcript of classroom discourse that reflects an exchange between a highly regarded and well liked preservice teacher and his students. This representative transcript highlights the preservice teacher's ability to query, without (...) a concomitant ability to listen, respond, and build a classroom dialogue with his students; what we call here a Socratic monologue. Second, we link the notions of dialogue and responsiveness to Bakhtin's concept of answerability, emphasizing the joint construction of classroom discourse as an ethically answerable relation between teacher and students. He is currently doing research on new Asian pedagogies. Her research interests include applying sociocultural and critical lenses to the study of identity construction, in particular, the social construction of “at risk” identities for young people. Her current research documents the experiences of students and teachers in alternative high school programs. As a key constituent of China's approach to fighting COVID-19, Health Code apps (HCAs) not only serve the pandemic control imperatives but also exercise the agency of digital surveillance. As such, HCAs pave a new avenue for ongoing discussions on contact tracing solutions and privacy amid the global pandemic. This article attends to the perceived privacy protection among HCA users via the lens of the contextual integrity theory. Drawing on an online survey of adult HCA users in Wuhan and Hangzhou (...) (N = 1551), we find users’ perceived convenience, attention towards privacy policy, trust in government, and acceptance of government purposes regarding HCA data management are significant contributors to users’ perceived privacy protection in using the apps. By contrast, users’ frequency of mobile privacy protection behaviors has limited influence, and their degrees of perceived protection do not vary by sociodemographic status. These findings shed new light on China's distinctive approach to pandemic control with respect to the state's expansion of big data-driven surveillance capacity. Also, the findings foreground the heuristic value of contextual integrity theory to examine controversial digital surveillance in non-Western contexts. Put tougher, our findings contribute to the thriving scholarly conversations around digital privacy and surveillance in China, as well as contact tracing solutions and privacy amid the global pandemic. The global demand for information has brought in new developments in the publicity of discursive practices of many professional areas. This study takes the professional practice of International Commercial Arbitration, a mechanism to resolve business disputes outside the courts and traditionally considered as private, to explore the process of resemiotization of information, from the strategies used by corporations in their press releases to the news reports published by national and international media. It takes the theoretical concept of interdiscursivity in critical (...) genre analysis to show that texts are the result of a combination of a very complex range of resources brought about by genres, professional practices and professional cultures, which derive not only from the ‘local’ representation of the transnational arbitration process, but also from the different corporate identities and their ways of coping with the increasing publicity of the facts of arbitration.
