The legal-ethical dynamism in Islamic law which allows it to respond to the challenges of modernity is said to reside in the institution of ijtihād (independent legal thinking and hermeneutics). However, jurists like Mohsen Kadivar and Ayatollah Faḍlalla have argued that the “traditional ijtihād” paradigm has reached its limits of flexibility as it allows for only minor adaptations and lacks a rigorous methodology because of its reliance on vague and highly subjective juridical devices such as public welfare (maṣlaḥa), imperative necessity (...) (ḍarūra), emergency (iḍtirār), need (ḥāja), averting difficulty (‘usr) and distress (ḥaraj), hardship (mashaqqa), and harm (ḍarar) without interrogating the fundamentals (uṣūl) of ijtihād. In contrast, in the “foundational ijtihād” model theology, ethics, intellect, epistemology, linguistics, hermeneutics, modern sciences, history, cosmology, anthropology, and the sources of Islamic legal theory (uṣūl al-fiqh) interact with one another to obtain resolutions that are just and non-discriminatory. In one of the earlier influential papers in the field of experimental philosophy titled Normativity and Epistemic Intuitions published in 2001, Jonathan M. Weinberg, Shaun Nichols and Stephen Stich reported that respondents answered Gettier type questions differently depending on their ethnic background as well as socioeconomic status. There is currently a debate going on, on the significance of the results of Weinberg et al. (2001) and its implications for philosophical methodology in general and epistemology in specific. Despite the debates, however, (...) to our knowledge, there has not been a replication attempt of the experiments of the original paper. We collected data from four different sources (two on-line and two in-person) to replicate the experiments. Despite several different data sets and in various cases larger sample sizes and hence greater power to detect differences, we failed to detect significant differences between the above-mentioned ethnic and socioeconomic groups. Our results suggest that epistemic intuitions are more robust across ethnic and socioeconomic groups than Weinberg et al. (2001) indicates. Given our data, we believe that the notion of differences in epistemic intuitions among different ethnic and socioeconomic groups that follows from Weinberg et al. (2001) needs to be corrected. In their paper titled “Gender and philosophical intuition,” Buckwalter and Stich argue that the intuitions of women and men differ significantly on various types of philosophical questions. Furthermore, men's intuitions, so the authors claim, are more in line with traditionally accepted solutions of classical problems. This inherent bias, so the argument goes, is one of the factors that leads more men than women to pursue degrees and careers in philosophy. These findings have received a considerable amount of attention and the (...) paper is to appear in the second edition of Experimental Philosophy edited by Knobe and Nichols , which itself is an influential outlet. Given the exposure of these results, we attempted to replicate three of the classes of questions that Buckwalter and Stich review in their paper and for which they report significant differences. Developmental processes in complex animals are directed by a hardwired genomic regulatory code, the ultimate function of which is to set up a progression of transcriptional regulatory states in space and time. The code specifies the gene regulatory networks (GRNs) that underlie all major developmental events. Models of GRNs are required for analysis, for experimental manipulation and, most fundamentally, for comprehension of how GRNs work. To model GRNs requires knowledge of both their overall structure, which depends upon linkage amongst regulatory (...) genes, and the modular building blocks of which GRNs are heirarchically constructed. The building blocks consist of basic transcriptional control processes executed by one or a few functionally linked genes. We show how the functions of several such building blocks can be considered in mathematical terms, and discuss resolution of GRNs by both “top down” and “bottom up” approaches. The method of phenomenal contrast (in perception) invokes the phenomenal character of perceptual experience as a means to discover its contents. The method implicitly takes for granted that ‘what it is like’ to have a perceptual experience e is the same as ‘what it is like’ to imagine or recall it; accordingly, in its various proposed implementations, the method treats imaginations and/or recollections as interchangeable with real experiences. The method thus always contrasts a pair of experiences, at least one of (...) which is imagined or remembered rather than occurrent. Surveying all eighteen forms of implementing the method, I argue that in all of the proposed pairings, the substitution of imagination or recollection for perceptual experience in the method, is either inconceivable or impermissible. I identify four reasons why I think imagination cannot be substituted for real experience, and three reasons why recollection cannot be substituted for real experience. If my argument works, there is no form of implementing the method that is useful for discovering the contents of experience, and thus the method is not a well‐functioning tool to study the contents of perception. One of the earliest and most‐fundamental pattern‐ formation events in embryonic development is endoderm and mesoderm specification. In sea urchin embryos, this process begins with blimp1 and wnt8 gene expression at the vegetal pole as soon as embryonic transcription begins. Shortly afterwards, wnt8/blimp1 expression spreads to the adjacent ring of mesoderm progenitor cells and is extinguished in the vegetal‐most cells. A little later, the ring of wnt8/blimp1 activity moves out of the mesoderm progenitors and into the neighboring endoderm cells. Fronto-parietal activity has been frequently observed in fMRI and PET studies of attention, working memory, and episodic memory retrieval. Several recent fMRI studies have also reported fronto-parietal activity during conscious visual perception. A major goal of this review was to assess the degree of anatomical overlap among activation patterns associated with these four functions. A second goal was to shed light on the possible cognitive relationship of processes that relate to common brain activity across functions. For all reviewed functions we (...) observed a consistent and overlapping pattern of brain activity. The overlap was most pronounced for the bilateral parietal cortex , and dorsolateral prefrontal cortex . In recent years a new discussion on the nature of philosophical expertise has emerged: whether philosophers possess a special kind of expertise, what such expertise would entail, how to measure it, and related concerns. The aim of the present article is to clarify certain related points across these debates in the hope of paving a clearer path forward, by addressing the following. (1) The expertise defense, which seems central to many discussions on methodology and expertise, has been misconstrued at times. (...) (2) Questions of expertise and methodology could be separated more clearly. (3) The study of expertise may be important in its own right; however, there may be good reasons to give priority to methodological concerns. (4) Finally, when viewed in light of methodological concerns, a new project emerges when engaging with recent contributions to the expertise debate. The field of experimental philosophy has received considerable attention, essentially for producing results that seem highly counter-intuitive and at the same time question some of the fundamental methods used in philosophy. A substantial part of this attention has focused on the role of intuitions in philosophical methodology. One of the major contributions of experimental philosophy on this topic has been concrete evidence in support of intuitional diversity; the idea that intuitions vary systematically depending on variables such as ethnicity, socioeconomic background, (...) or gender. Because of the important implications, these findings have been the subject of extensive debate. Despite the seeming significance of the findings and despite all the debates that the experimental philosophy movement has prompted, what has not been examined systematically is the reproducibility of the results. Instead, the reported findings have been simply accepted as established facts. We set out to replicate a wide range of experiments and surprisingly failed to reproduce many of the reported findings, some of which are from the most cited and attention grabbing papers of the field. We draw two conclusions from our findings. The first is that the instability of intuitions has been exaggerated by experimental philosophers. Intuitions appear to be more uniform across different demographic groups. The argument that intuitions need to be discarded because they depend on arbitrary factors such as ethnicity, socioeconomic background, or gender does not seem tenable anymore. The second conclusion is that experimental philosophy needs a better system to ensure the reproducibility of published findings. The current research-publication system of various empirical fields, especially those employing statistical methods, leads to an overproduction of false-positive findings in the published literature. Unless changes are made to the current research-publication system, this overproduction is likely to continue, in experimental philosophy as well as other disciplines. (shrink)

Even if religiosity has long been introduced as the major cause for backwardness by anti-religion philosophers, the divine religion has been an important source of value for individuals and society, encouraging them to shape economic and sociocultural outcomes. In this manner, religiosity and religious capital (RC) are the stimuli for society-wide development. Against this background, religion can have positive implications for enriching individual and social economy. Assigning tasks, providing guidance on productivity and more effort, living a purposeful life, establishing effective (...) socio-economic institutions and assessing functional behaviours in organisational settings are accordingly among the ways in which RC induces economic behaviours. On the other hand, job engagement (JE) has been one of the relatively common concepts within the novel approaches to human resource management. Considering employment and the promotion of standard Islamic culture, how religion and JE are associated is thus of utmost importance. Hence, this study aimed to investigate the effect of RC on JE among 2500 Malaysian Muslim nurses working in Kuala Lumpur and Penang hospitals during the coronavirus disease 2019 (COVID-19) pandemic in 2021, as the statistical population selected via random sampling. A standardised questionnaire was also administered as the data collection tool, whose validity and reliability were confirmed. The SPSS and LISREL software packages were further utilised to analyse the data. The study results revealed that RC had a significant positive effect on nurses’ JE in the course of COVID-19 (p = 0.83, t = 11.94).Contribution: The research findings suggest that reinforcing RC in Islamic societies, such as Malaysia, even during the COVID-19 pandemic, affects nurses’ sense of hope, faith and beliefs regarding their capabilities to achieve career success. We study the structure of stable economic networks and their associated stable payoff allocations by analyzing the conditions under which complete networks and star networks (both with desirable property of inclusiveness) are stable. We also address conditions for existence and uniqueness of stable set of networks.

This book sheds new light on the history of the philosophically crucial notion of intentionality, which accounts for one of the most distinctive aspects of our mental life: the fact that our thoughts are about objects. Intentionality is often described as a certain kind of relation. Focusing on Franz Brentano, who introduced the notion into contemporary philosophy, and on the Aristotelian tradition, which was Brentano’s main source of inspiration, the book reveals a rich history of debate on precisely the relational (...) nature of intentionality. It shows that Brentano and the Aristotelian authors from which he drew not only addressed the question whether intentionality is a relation, but also devoted extensive discussions to what kind of relation it is, if any. The book aims to show that Brentano distinguishes the intentional relation from two other relations with which it might be confused, namely, causality and reference, which also hold between thoughts and their objects. Intentionality accounts for the aboutness of a thought; causality, by contrast, explains how the thought is generated, and reference, understood as a sort of similarity, occurs when the object towards which the thought is directed exists. Brentano claims to find some anticipation of his views in Aristotle. This book argues that, whether or not Brentano’s interpretation of Aristotle is correct, his claim is true of the Aristotelian tradition as a whole, since followers of Aristotle more or less explicitly made some or all of Brentano’s distinctions. This is demonstrated through examination of some major figures of the Aristotelian tradition (broadly understood), including Alexander of Aphrodisias, the Neoplatonic commentators, Thomas Aquinas, Duns Scotus, and Francisco Suárez. This book combines a longue durée approach – focusing on the long-term evolution of philosophical concepts rather than restricting itself to a specific author or period – with systematic analysis in the history of philosophy. By studying Brentano and the Aristotelian authors with theoretical sensitivity, it also aims to contribute to our understanding of intentionality and cognate features of the mind. (shrink)

The unsettling fear of COVID-19 infections has caused a new trend in consumer behavior in the food and beverage industry. The unprecedented COVID-19 pandemic has shifted consumers’ preferences from eat-in to online delivery. This research aims to measure the impact of consumers’ motivation to protect themselves from contracting COVID-19, which explains why people switch from eat-in to online food delivery. We adopted the theory of protection motivation to explain consumer switching behavior during the COVID-19 pandemic. The present study investigated the (...) mediating effect of switching intention on the relationship between vulnerability, altruistic fear, anticipated regret, and switching behavior. Simultaneously, we examined the role of brand awareness as a moderator of behavioral choices of consumers switching from eat-in to online delivery. We collected data from 681 eatery consumers in Kuala Terengganu, Malaysia, using scenario-based survey questionnaires. Then, the data were analyzed using structural equation modeling. This new generation analysis was conducted using the analysis of moment structure and the statistical package for social science. The results indicated that consumer vulnerability, altruistic fear, and anticipated regret of COVID-19 increased consumers’ propensity to shift from eat-in to online food delivery. Allegedly, consumer behavioral control and intention of switching toward online delivery were pointedly affected by switching behavior. The results indicated that consumer vulnerability, altruistic fear, and anticipated regret of COVID-19 increased the shifting of restaurant dine-in patterns and made the intention to switch to online delivery. Consumers’ alleged behavioral control and their intention of switching toward online delivery were pointedly affected by switching behavior. We also found that brand awareness moderately affects switching behavior toward restaurant settings. The present research contributes to developing the consumer behavior model of switching from eat-in to online delivery. This study also provides eatery customers and the business community with a safer and healthier proposition of shifting to online food delivery during the pandemic. (shrink)

This paper addresses the issue of how to best account for the diversity of our (synchronic) mental activities. The discussion starts with Mark Textor’s mental monism. According to mental monism, our mental life is constituted by just one simple mental act, in which different sub-acts can be conceptually distinguished. Textor grounds this view in the work of the early Brentano and contrasts it with the theory of the later Brentano, who introduces a mental substance into his philosophy. According to Textor, (...) Brentano needs a substance because he is unable to explain how mental monism can account for the separability of our mental activities, e.g. the fact that I can stop hearing F while still seeing blue. Textor argues, however, that mental monism can solve this problem. I address two issues regarding Textor’s view. First, I challenge his interpretation of Brentano by arguing that the early Brentano imports ontological complexity into our mental life; I defend Brentano’s view against possible criticisms, and I address some objections to mental monism. Second, I oppose Textor’s narrative about the mental substance. I argue that Brentano needs a substance not to explain separability, but rather to individuate our mental acts. I still argue, however, that Brentano’s earlier view (understood in my sense) is better than the substance account for dividing the mind. (shrink)

This paper aims to present and evaluate Brentano’s account of the individuation of mental acts. In his early works, Brentano assimilated mental acts to tropes; however, he encountered difficulties in explaining their individuation, since the usual solutions for the individuation of tropes were not readily applicable to his theory of mental acts. In a later period, Brentano introduced into his psychology what he called the “soul”, and this allowed him to explain the individuation of mental acts. Finally, after his “reistic” (...) turn, he excluded mental acts from his ontology, for he rejected abstracta of any kind, including abstract particulars, and admitted only things, or res (in Latin), that is, concrete particulars; in his late philosophy, there are no “thinkings”, but only “thinkers”. However, he still needed to explain what individuates different thinkers, and this was again the soul. In the conclusion, the paper critically compares the different theoretical options considered by Brentano. (shrink)

Trade secret theft is a problem that almost all organizations face. The greatest threat is employee mobility and potential unethical post-employment behavior. This study investigates the role of individual personality traits in judgments about trade secret misappropriation. Our hypotheses were tested in three studies addressing three different situational contexts: current employees, employees about to be laid off, and students who had quit their job. Relationships were estimated with robust regression. The results show that some personality traits predict judgment about another (...) person's trade secret misappropriation, and that the situational context in which individuals formulate their ethical judgment moderates the impact of personality traits on ethical judgment. But a stylistic TME occurs in ‘Abe knows whether or not Ben draws or not’. One can say “Abe knows how Ben looks” using ‘Abe knows what Ben looks like’. But syntactical TMEs are in ‘Abe knows what Ben looks’ and in ‘Abe knows how Ben looks like’. One can deny that Abe knows Ben by prefixing ‘It isn’t that’ or by interpolating ‘doesn’t’. But a pragmatic TME occurs in trying to deny that Abe knows Ben by using ‘It isn’t that Abe doesn’t know Ben’. There are several standard ways of defining truth using sequences. Quine’s discussions in the 1970 first printing of Philosophy of logic [3] and in previous lectures were vitiated by mixing two [1, p. 98]. The logical TME in [3], which eluded Quine’s colleagues, was corrected in the 1978 sixth printing [2]. But Quine never explicitly acknowledged, described, or even mentioned the error. This paper discusses the thesis defended by Edith Stein that certain acts can be attributed to the State. According to Stein, the State is a social structure characterized by sovereignty. As such, it is responsible for the production, interpretation, and application of law. These tasks require the performance of acts, most of which are what Stein calls “social acts” like enactments and orders. For Stein, the acts in question are made by the organs of the State, but in the name (...) of the State, and are thus attributed to the State via a relation of representation. In the first section, the paper presents Stein’s thesis that the sovereignty of the State entails a series of legal prerogatives, which in turn result in various social acts being ascribed to the State through its representatives. In the second section, the paper critically discusses Stein’s views, notably her theory of representation, and her account of the nature of the State, while emphasizing its most interesting aspects, namely, its fine-grained analyses of the various acts that are attributed to the State. Brentano distinguishes between intentionality and reference. According to Brentano, all mental acts are intentionally directed toward something. Some mental acts also refer to something, which is the case when their object exists in reality. For Brentano, such acts, besides their intentionality, have a peculiar relation of similarity to their object. However, there is no mention of Brentano’s distinction between intentionality and reference in the literature. In this study, we solve analytically the Schrödinger equation for a macroscopic quantum oscillator as a central system coupled to two environmental micro-oscillating particles. Then, the double-slit interference patterns are investigated in two limiting cases, considering the limits of uncertainty in the position probability distribution. Moreover, we analyze the interference patterns based on a recent proposal called stochastic electrodynamics with spin. Our results show that when the quantum character of the macro-system is decreased, the diffraction pattern becomes more similar to (...) a classical one. We also show that, depending on the size of the slits, the predictions of quantum approach could be apparently different with those of the aforementioned stochastic description. (shrink)

A large body of evidence supports the idea that a common fronto-parietal network is activated across a range of diverse cognitive functions. Jung & Haier's (J&H's) review demonstrates a very similar pattern of activity, which correlates with individual differences in intelligence. We propose that these converging lines of evidence are best interpreted as a general role of the fronto-parietal network in integration and control.

According to the thesis of epistemic conservatism it would be unreasonable to change one's beliefs in the absence of any good reasons. Although it is claimed that epistemic conservatism has informed and resolved a number of positions and problems in epistemology, it is difficult to identify a single representative view of the thesis. This has resulted in advancing a series of disparate and largely unconnected arguments to establish conservatism. In this paper, I begin by casting doubt on the claim of (...) widespread and genuine applications of the conservative policy. I then distinguish between three main varieties of epistemic conservatism, namely, differential, perseverance and generation conservatism Having evaluated various arguments that have been offered or may be considered on behalf of the conservative thesis, I close by concluding that those versions of the thesis that survive critical scrutiny fail to live up to the aspirations of the thesis as a substantive canon of rationality, that to the extent that principles of conservatism are epistemically promising, they are not plausible. Corporate activities conducted under the banner of creating shared value (CSV) have gained popularity over the last decade, and some MNCs have espoused that CSV has entered the heart of their practices. There has, however, been criticism about the lack of a standard definition of CSV. The purpose of the current study was to develop a working definition of CSV by identifying distinctions between CSV and various conceptions of corporate social responsibility (CSR). We conducted 26 semi-structured interviews with managers and (...) stakeholder representatives of five multinational corporations (MNCs) and three small and medium enterprises (SMEs), all headquartered or rooted in Asia. These firms had received public recognition for their CSV engagement. We compared and contrasted interviewees’ conceptions and descriptions of CSV and traditional CSR (philanthropy) and mapped these against Carroll’s four-layer model of responsible corporate management. Interviewees tended to frame CSV as a sustainable business model that generates social and economic value simultaneously. Traditional CSR was characterized as “giving back” some of the surplus from economic returns. In addition, interviewees described examples of strategic CSR, which involved pump-priming interventions for empowering and enabling stakeholders of the CSV practices of the focal firm to participate in the associated wealth and well-being co-creation. Quantum theory is a powerful framework for probabilistic modeling of cognition. Strong empirical evidence suggests the context- and order-dependent representation of human judgment and decision-making processes, which falls beyond the scope of classical Bayesian probability theories. However, considering behavior as the output of underlying neurobiological processes, a fundamental question remains unanswered: Is cognition a probabilistic process at all?

This paper focuses on a crucial question of social ontology addressed by Gerda Walther, namely, whether a social community has its own reality over and above that of its members and its cultural “products”, such as language, religion, infrastructure, and works of art. Walther has a nuanced answer which combines elements of phenomenology and Marxism. She praises Marxists for drawing our attention to the “community as such”, taken as an object distinct from its members and their relations. She maintains the (...) thesis, defended according to her by “certain socialists and Hegelians” (which presumably includes Marxists), that communities have their own reality. However, she develops it one step further, arguing that these social structures are “higher-order” unitary realities that exist over and above their members and cultural products. In addition, she enriches this realist position from a phenomenological point of view by identifying with precision the kinds of mental act on which communities are founded, namely, “unifications” and “we-experiences”. As such, Walther’s theory is an early encounter between phenomenology and Marxism, prior to Trần Đức Thảo and Jean-Paul Sartre, and thus deserves much more attention than it has received in the history of philosophy. Belief is generally thought to be the primary cognitive state representing the world as being a certain way, regulating our behavior and guiding us around the world. It is thus regarded as being constitutively linked with the truth of its content. This feature of belief has been famously captured in the thesis that believing is a purposive state aiming at truth. It has however proved to be notoriously difficult to explain what the thesis really involves. In this paper, I begin (...) by critically examining a number of recent attempts to unpack the metaphor. I shall then proceed to highlight an error that seems to cripple most of these attempts. This involves the confusion between, what I call, doxastic and epistemic goals. Finally, having offered my own positive account of the aim-of-belief thesis, I shall underline its deflationary nature by distinguishing between aiming at truth and hitting that target (truth). I end by comparing the account with certain prominent inflationary theories of the nature of belief. (shrink)

In the famous Appendix to paragraphs 11 and 20 of his 5th Logical Investigation, Husserl criticizes the concept of ‘immanent object’ defended by Brentano and his pupils. Husserl holds that intentional objects, even non-existent ones, are ‘transcendent’. Yet long before Husserl’s criticism, Brentano and his pupils, in their theories of intentionality, besides immanent objects also took into account transcendent ones, in a similar way to Husserl, since such transcendent objects were not necessarily objects that exist. The ‘immanent object’ (immanenter Gegenstand) (...) was also called ‘presented-thing as presented’ (Vorgestelltes als Vorgestelltes), whereas the ‘transcendent object’ was called ‘object tout court’ (Gegenstand schlechtweg) or ‘presented-thing tout court’ (Vorgestelltes schlechtweg). Even if it is in Marty that one finds the clearest distinction between these two kinds of objects, other pupils of Brentano, and Brentano himself, made similar distinctions. Despite its importance, this point has been neglected in the Brentanian literature. In the first part of this article, I present the way in which immanent and transcendent objects have been distinguished in the School of Brentano. In the second part of the article, I present some problems linked to the distinction of two objects for every mental act, an immanent and a transcendent one; these problems could explain the abandonment of the notion of ‘immanent object’ by many philosophers of the Brentanian tradition. I conclude with some remarks on the distinction between content and object in the School of Brentano. (shrink)
