In his provocative new book, The Tyranny of the Ideal, Gerald Gaus lays out a vision for how we should theorize about justice in a diverse society. Gaus shows how free and equal people, faced with intractable struggles and irreconcilable conflicts, might share a common moral life shaped by a just framework. He argues that if we are to take diversity seriously and if moral inquiry is sincere about shaping the world, then the pursuit of idealized and perfect theories (...) of justice--essentially, the entire production of theories of justice that has dominated political philosophy for the past forty years--needs to change. Drawing on recent work in social science and philosophy, Gaus points to an important paradox: only those in a heterogeneous society--with its various religious, moral, and political perspectives--have a reasonable hope of understanding what an ideally just society would be like. However, due to its very nature, this world could never be collectively devoted to any single ideal. Gaus defends the moral constitution of this pluralistic, open society, where the very clash and disagreement of ideals spurs all to better understand what their personal ideals of justice happen to be. Presenting an original framework for how we should think about morality, The Tyranny of the Ideal rigorously analyzes a theory of ideal justice more suitable for contemporary times. (shrink)

The Indian Buddhist philosopher Vasubandhu is known for his critical contribution to Buddhist Abhidharma thought, his turn to the Mahayana tradition, and his concise, influential Yogacara-Vijñanavada texts. _Paving the Great Way_ reveals another dimension of his legacy: his integration of several seemingly incompatible intellectual and scriptural traditions, with far-ranging consequences for the development of Buddhist epistemology and the theorization of tantra. Most scholars read Vasubandhu's texts in isolation and separate his intellectual development into distinct phases. Featuring close studies of Vasubandhu's (...) _Abhidharmakosabhasya_, _Vyakhyayukti_, _Vimsatika_, and _Trisvabhavanirdesa_, among other works, this book identifies recurrent treatments of causality and scriptural interpretation that unify distinct strands of thought under a single, coherent Buddhist philosophy. In Vasubandhu's hands, the Buddha's rejection of the self as a false construction provides a framework through which to clarify problematic philosophical issues, such as the nature of moral agency and subjectivity under a broadly causal worldview. Recognizing this continuity of purpose across Vasubandhu's diverse corpus recasts the interests of the philosopher and his truly innovative vision, which influenced Buddhist thought for a millennium and continues to resonate with today's philosophical issues. Abstract:Our critics confuse the role normative ethical theory can take in business ethics. We argue that as a practical discipline, business ethics must focus on norms, not the theories from which the norms derive. It is true that our original work is defective, but not in its form, but in its neglect of contemporary advances in feminist ethics.

In virtue of its form [‘I am here’] must be true on any occasion on which [it is] asserted, and yet the proposition it expresses on each occasion [is] contingent. Intuitively, [‘I am here now’] is deeply, and in some sense universally, true. One need only understand the meaning of [it] to know that it cannot be uttered falsely. The sentence ‘I am here’ has the peculiar property that whenever I utter it, it is bound to be true. Even if (...) Kant argues that the “discipline” of reason holds us topublicargument and reflective thought. When we speak the language of reasoned judgment, Kant maintains, we “speak with a universal voice,” expecting and claiming the assent of all other rational beings. This language carries with it a discipline requiring us to submit our judgments to the forum of our rational peers. Remarkably, Kant does not restrict this thought to the realm of politics, but rather treats politics as the model for reason's authority (...) in all the provinces that rational beings inhabit. International agreements investigated are: NAFTA, Global Warming Treaty, OECD Anti-Bribery Treaty and Infant Formula Agreement. The codes examined are the Caux Round Table’s Principles for Business, The Global Sullivan Principles and The United Nations Global Compact with Business. Each of these three strategies is probed for its relative strengths and weaknesses, and its prospects (...) for developing ethical business practices—especially in the areas of improving the environment, human rights and working conditions. It is one of the remarkable and significant consequence of the AIDS epidemic that out of the context of enormous suffering and death there emerged a forceful set of ideas linking the domains of health and human rights. At first, the effort centered on the observation that protecting individuals from discrimination and unwarranted intrusions on liberty were, contrary to previous epidemics, crucial to protecting the public health and interrupting the spread of HIV But in fairly short order, the scope of (...) the health and human rights perspective expanded dramatically to focus on the ways in which the most fundamental social arrangements rendered individuals and communities vulnerable to HIV Racial and ethnic minorities, those who were marginalized, and women were at risk because of their subordinate status. In the face of such an understanding, nothing short of social change could be adequate to the challenge posed by the AIDS epidemic. (shrink)

Disability arts has traditionally been understood as that which is led, created, and/or curated by disabled artists. While disability arts and culture in Canada has continued to grow and develop over the last number of decades, I have perceived a notable lack of neurodivergent artists being included at disability arts events and community gatherings. I question if this lack of representation may be due in part to this perception of disability arts as having to be led exclusively by those with (...) lived experience of disability. In this paper, I will critically engage with concepts of inter-abled artistic collaboration, interdependency and the need to re-imagine disability arts leadership structures to better include neurodivergent artists and their allies. I will further position my ideas around this topic within the context of the roundtable discussion on the future of disability arts leadership that took place at the Cripping the Arts Symposium in 2019. In principle, all patients deserve to receive optimal medical treatment equally. However, in situations in which there is scarcity of time or resources, medical treatment must be prioritized based on a triage. The conventional guidelines of medical triage mandate that treatment should be provided based solely on medical necessity regardless of any non-medical value-oriented considerations (“worst-first”). This study empirically examined the influence of value-oriented considerations on medical triage decision–making. Participants were asked to prioritize medical treatment relating to four case scenarios (...) of an emergency situation resulting from a car collision. The cases differ by situational characteristics pertaining to the at-fault driver, which were related to culpability attribution. In three case scenarios most participants gave priority to the most severely injured individual, unless the less severely injured individual was their brother. Nevertheless, in the aftermath of a vehicle-ramming terror attack most participants prioritized the less severely injured individual (“victim-first”). Our findings indicate that when caregivers are presented with concrete highly conflictual triage situations their choices may be based on value-oriented considerations related to contextual characteristics of the emergency situation. Philosophical and practical ramifications of our findings are discussed. (shrink)

The machine as a social movement of today's “precariat”—those whose labor and lives are precarious. In this “concise philosophy of the machine,” Gerald Raunig provides a historical and critical backdrop to a concept proposed forty years ago by the French philosophers Félix Guattari and Gilles Deleuze: the machine, not as a technical device and apparatus, but as a social composition and concatenation. This conception of the machine as an arrangement of technical, bodily, intellectual, and social components subverts the opposition (...) between man and machine, organism and mechanism, individual and community. Drawing from an unusual range of films, literature, and performance—from the role of bicycles in Flann O'Brien's fiction to Vittorio de Sica's Neorealist film The Bicycle Thieves, and from Karl Marx's “Fragment on Machines” to the deus ex machina of Greek drama—Raunig arrives at an enhanced conception of the machine as a social movement, finding its most apt and concrete manifestation in the Euromayday movement, which since 2001 has become a transnational activist and discursive practice focused upon the precarious nature of labor and lives. The ethical choices faced by engineers today are increasingly complex. Competing and conflicting ethical demands from clients, communities, employees, and personal objectives combine to suggest that engineers employ ethical approaches that are adaptive yet grounded in three concrete professional circumstances: first, that engineers apply unique professional skills in the service of a client, subject to protecting the public interest; second, that engineers advance the state of knowledge of their professional field through reflection, research, and sharing experience in journals and conferences, (...) and third, that they develop new professionals by active mentoring. This paper examines five features of American pragmatism and suggests that its emphasis on specific, context-based ethical decision making can assist engineers in a postmodern setting. In particular, it considers the venues of interpersonal ethical choices, institutional ethical conflicts, and social choices that have ethical components. Pragmatism suggests that in such a complex ethical climate, there is a need for the co-evolution of judgment and action, for individual reflective judgment in particular situations, and for ceasing to search for a single, immutable principle for ethical choice. Postema is critically concerned with whether Dworkin commits himself to individualistic and privatistic sense of interpretation and how Dworkin articulates the logical independency of pre-interpretive paradigm instances or social facts which form the object of interpretation and the end which is interpretively posited in the act of interpretation. Criticisms, for the most part, appear to be compatible with Dworkin's overall theory and may simply be additional explication of the character (...) of interpretation. "There is nothing in Dworkin's meta-theory of interpretation of social practices that requires attention to the interpretive activities of fellow participants. Herein lies the strong "protestantism" of Dworkin's theory. Not only is each participant encouraged to take up the interpretive enterprise...but each individual participant also has access to the truth, as it were, about what the practice is and requires, though private interpretation of the practice-text. While Dworkin seems to recognize that the practice is common, he counsels participants to live as if each had a private understanding of his own." "It is problematic because it makes interpretation of social practices insufficiently practical, insufficiently intersubjective, and thus insufficiently political." Notes that the interpretive attitude when acting in a practice is relatively rare, usually becoming part of a practice is more like learning a discipline or technique. The basic concept of Bentham's moral and political philosophy was public utility. He linked it directly with the concept of the universal interest, which comprises a distinctive partnership of the interests of all members of the community. The ultimate end of government and aim of all of morality is ‘the advancement of the universal interest’. This essay articulates the structure of Bentham's notion of universal interest and locates it in his theory of value.

Thus it would not be the content or meaning of a written Torah that Jeremiah would attack; rather it would be the Deuteronomic “claim to final and exclusive authority by means of writing” . Jeremiah’s problem is political rather than theological. He knows that writing is more powerful than prophecy and that he will not be able to withstand it—and he knows that the Deuteronomists know no less. As Blenkinsopp says, “Deuteronomy produced a situation in which prophecy could not continue (...) to exist without undergoing profound transformations” —that is, without ceasing to be “free prophecy,” or prophecy unbound by any text, including its own. “It might be considered misleading or flippant to say that for [Deuteronomy], as for rabbinic orthodoxy, the only good prophet is a dead prophet. But in point of fact the Deuteronomic scribes, despite their evident debt to and respect for the prophets, contributed decisively to the eclipse of the kind of historically oriented prophecy represented by Jeremiah and the emergence in due course of quite different forms of scribal prophecy” .It is at this point that we reach a sort of outer limit of biblical criticism—a threshold that scholars, with their foundations in literary criticism, their analytical attitude toward texts, and their theological concerns, are not inclined to cross. In any case, it is no accident that the political meaning of the conflict of prophecy and canon has received its most serious attention not from a biblical scholar but from a radical historian, Ellis Rivkin. In The Shaping of Jewish History, a brilliant and tendentious book, Rivkin proposes to treat the question of canon-formation and the promulgation of canonical texts of the Scriptures, not according to literary criteria but according to power criteria. For Rivkin, the production of the Hebrew Scriptures “was not primarily the work of scribes, scholars, or editors who sought out neglected traditions about wilderness experience, but of a class struggling to gain power.”23 23. That the Bible rejoices in humour might come as a surprise to many. Yet since humour can be the most powerful method of communicating serious information in an appealing, relaxing and respectful manner, we must surely expect to find humour in the Scriptures. In fact, as this article explains, it is there in abundance. It is at the heart of our salvation history. The Bible 'revels in a profound laughter, a divine and human laughter that is endemic to the whole (...) narrative of creation, fall and salvation, and finally a laughter that results in a wondrous, all-encompassing comic vision'. We surely find divine humour in our attempts as humans to judge the actions of God according to our expectations and then to discover that our conclusions are dramatically wrong. (shrink)

Walter Sinnott-Armstrong has recently criticized moral intuitionism by bringing to light some compelling empirical evidence indicating that we are unreliable at forming moral judgments non-inferentially. The evidence shows that our non-inferentially arrived-at moral convictions are subject to framing effects; that is, they vary depending on how the situation judged is described. Thomas Nadelhoffer and Adam Feltz, following in Sinnott-Armstrong's footsteps, have appealed to research indicating that such judgments are also subject to actor-observer bias; that is, they vary depending on whether (...) the situation judged includes the judger as an actor in, or an observer of, the situation. The accuracy of this empirical evidence will not be challenged in what follows. What will be called into question is its purported relevance for moral intuitionism. To that end we will consider a version of moral intuitionism developed by Iris Murdoch that not only accommodates but essentially relies on the existence of various kinds of distorting factors including framing effects and actor-observer bias. Under the title of ‘the axiom of existence’, hereafter, John R. Searle has reduced to compact dictum a view to which many philosophers subscribe: ‘Whatever is referred to must exist’. In this paper I shall offer two major arguments against adopting, at least on certain assumptions. There have been a number of defenses of, among them those arguing that it is fundamental to any systematic philosophy of language or logic.
