La técnica de reproducción asistida trae consigo un número de embriones sobrantes. Se propone una revisión del estado de la cuestión de estos embriones en el Perú. Se revisa desde las perspectivas biológica, ética y jurídica. Se profundiza en el ordenamiento jurídico peruano, sobre el estado de desprotección de estos embriones y se contrasta con una posible solución: la adopción embrionaria. Se constata el estado de incertidumbre de la situación de estos embriones y se concluye como ilegítima la práctica de (...) la adopción embrionaria, por vulnerar la dignidad y condición de sujeto de derecho del embrión sobrante. In 2020, the European Union announced the award of the contract for the biometric part of the new database for border control, the Entry Exit System, to two companies: IDEMIA and Sopra Steria. Both companies had been previously involved in the development of databases for border and migration management. While there has been a growing amount of publicly available documents that show what kind of technologies are being implemented, for how much money, and by whom, there has been limited engagement (...) with digital methods in this field. Moreover, critical border and security scholarship has largely focused on qualitative and ethnographic methods. Building on a data feminist approach, we propose a transdisciplinary methodology that goes beyond binaries of qualitative/quantitative and opacity/transparency, examines power asymmetries and makes the labour of coding visible. Empirically, we build and analyse a dataset of the contracts awarded by two European Union agencies key to its border management policies – the European Agency for Large-Scale Information Systems (eu-LISA) and the European Border and Coast Guard Agency (Frontex). We supplement the digital analysis and visualisation of networks of companies with close reading of tender documents. In so doing, we show how a transdisciplinary methodology can be a device for making datafication ‘intelligible’ at the European Union borders. (shrink)

In this work we present some reflections about the interaction of preschool children (between 3 and 5 years old) with sound-producing objects. We implemented the phenomenological approach of Alfred Schutz, who under the influence of Edmund Husserl, elaborated his own notions concerning the Lebenswelt or life-world. We present some situations of interaction with musical instruments by children that have been documented in different research on musical education in early childhood, the same ones we use to exemplify possible analyses from the (...) perspective of the phenomenology of the social world. We conclude with some remarks that conceive of Schutz’s theory as a relevant perspective for the analysis of children’s experiences with sound-producing objects. (shrink)

Este trabajo se propone mostrar cómo la Teoría Neoclásica de la Ley Natural fundamenta la existencia de normas morales absolutas, cuál es su relevancia para la filosofía moral, y qué críticas pueden ser formuladas a la argumentación de los autores. Ellos postulan que la ley natural, mediante normas, lleva a elegir y proteger bienes humanos básicos, correspondientes a los diversos aspectos de la naturaleza humana, evitando su destrucción, daño o impedimento. Aunque la mayoría de las normas morales admiten excepción, nunca (...) lo hacen las que prohíben realizar un acto que siempre daña directamente un bien básico, pues tal acto no puede compatibilizarse con la propia autorrealización, y atenta contra la dignidad humana. La división del trabajo tomará la siguiente forma: en los primeros cuatro apartados se abordarán los conceptos clave para la defensa de una norma absoluta en la Teoría Neoclásica, en el quinto se enlazarán los conceptos al modo que los autores lo hacen para demostrar la existencia de absolutos morales y someter el consecuencialismo a crítica, y en el sexto se hará una breve revisión crítica de los argumentos presentados. Empathy is an emotional response that may facilitate prosocial behavior and inhibit aggression by increasing empathic concern for others. But the vicarious experience of other’s feelings may also turn into personal distress when the person has poor regulation skills and holds stigmatizing beliefs. In thinking about the processes that may trigger the experience of personal distress or empathic concern, research on the influence of psychological flexibility and inflexibility on stigma is showing promising results. Both processes are assessed with the Acceptance (...) and Action Questionnaire–Stigma. The current study sought to carry out a validity study of a Spanish version of the AAQ-S with a sample of adolescents aged 11–17 years. The study included an expanded test of its predictive validity with measures at three times to evaluate the role of psychological flexibility and inflexibility as risk or protective variables for the development of personal distress and/or empathic concern in the stigmatizer. Statistical analyses confirmed a two-correlated-factor solution, the adequate reliability of both factors, and their construct and predictive validity in the expected direction. The stigmatizer’s inflexible reaction to their stigmatizing thoughts predicted the occurrence of personal distress, whereas the stigmatizer’s flexible reaction to their stigmatizing thoughts predicted the occurrence of empathic concern for others. These findings confirm the importance of considering the role of regulatory skills in the experience of empathic concern or personal distress in the presence of stigmatizing thoughts, with possible implications for the promotion of prosocial behavior and the reduction of aggressive behavior among adolescents. Empirical research in bioethics has developed rapidly over the past decade, but has largely eschewed the use of technology-driven methodologies. We propose “design bioethics” as an area of conjoined theoretical and methodological innovation in the field, working across bioethics, health sciences and human-centred technological design. We demonstrate the potential of digital tools, particularly purpose-built digital games, to align with theoretical frameworks in bioethics for empirical research, integrating context, narrative and embodiment in moral decision-making. Purpose-built digital tools can engender situated engagement (...) with bioethical questions; can achieve such engagement at scale; and can access groups traditionally under-represented in bioethics research and theory. If developed and used with appropriate rigor, tools motivated by “design bioethics” could offer unique insights into new and familiar normative and empirical issues in the field. (shrink)

Worldwide interest in understanding art and creative practices as valid forms of knowledge production has led to the establishment of research-creation as an interdisciplinary academic field in the last twenty years in Canada as elsewhere. Its establishment relates to a growing interest in critical making and technological innovation and to the legacies of feminism(s) and its critique of the power dynamics of knowledge production within academia. This article outlines a series of interactive projects that bring visibility to Latin American women (...) in art, science and technology and speculates on the legacies of feminism(s) in the emergence of research-creation. The four projects discussed build on each other and explore re-mediation, re-activation and re-enactment as part of a collaborative feminist research-creation methodology. I theorize their potential to activate political memory by highlighting how these three approaches to creation share a preoccupation for revisiting the past through repetition, iteration and the facilitation of intergenerational encounters among humans, non-humans and across media and technologies. While discussing the feminist orientation of these approaches, I suggest a critique of dominant modes of knowledge production that have obscured the contributions of Latin American women and offer four research-creation interventions in the media arts archive. This paper challenges a widespread reading of Aristotle’s use of dialectic in the treatment of aporiai. According to this reading, the search for a resolution of an aporia is supposed to proceed by arguing against conflicting theses to refute one of them. I argue that this reading is not satisfactory and propose an alternative, based on an often overlooked distinction between two dialectical procedures, the refutation (elenchos) of a thesis and the resolution (lysis) of an argument. These two terms are (...) employed fairly consistently by Aristotle in the treatises as well. Since an aporia requires not merely conflicting theses, but conflicting arguments for those theses, I contend that the ideal way out of aporiai involves a critical analysis of those arguments, akin to that involved in the dialectical resolution. A relevant implication of this reading is that it expands the critical use of dialectic for philosophy, and points to the specific philosophical utility of the Sophistical Refutations. (shrink)

El artículo propone poner a prueba la idea comúnmente admitida de que en la concepción aristotélica las emociones tienen una función o fin en el ámbito biológico. Me propongo probar que esta concepción sería más propia de otras posturas, como la tomista y la cartesiana, y especialmente de la darwiniana y neo-darwiniana. Tras presentar en la sección 2 el tipo de explicaciones teleológicas que Aristóteles admite y emplea en biología, analizo en la parte 3 la concepción de las emociones de (...) Descartes y en especial de Darwin y muestro que ellas se adaptan bien al modelo explicativo teleológico aristotélico. En la sección 4, ofrezco varios argumentos con apoyo en los textos biológicos de Aristóteles para mostrar que, en cambio, este tipo de explicaciones teleológicas de las emociones no aparecen con claridad en los escritos biológicos del estagirita, toda vez que lo que encontramos allí es, más bien, explicaciones fisiológico materialistas del carácter de los animales. Por último, sugiero una asimetría con el tratamiento de las emociones desde el punto de vista de la racionalidad práctica que desarrollaré en trabajos ulteriores. (shrink)

Abstract:In this article, we present a pragmatic approach to neuroethics, referring back to John Dewey and his articulation of the “common good” and its discovery through systematic methods. Pragmatic neuroethics bridges philosophy and social sciences and, at a very basic level, considers that ethics is not dissociable from lived experiences and everyday moral choices. We reflect on the integration between empirical methods and normative questions, using as our platform recent bioethical and neuropsychological research into moral cognition, action, and experience. Finally, (...) we present the protocol of a study concerning teenagers’ morality in everyday life, discussing our epistemological choices as an example of a pragmatic approach in empirical ethics. We hope that this article conveys that even though the scope of neuroethics is broad, it is important not to move too far from the real life encounters that give rise to moral questions in the first place. Aristotle’s Metaphysics E 2 and 3 are devoted to the discussion about accidental being and its causes, with the aim of assessing its credentials as a possible object of first philosophy. The result of this discussion is, in this sense, negative. However, first philosophy has something to say about accidental being, if only through a second order speech. The nature of the accidental is thus explored in these pages of Metaphysics, with the ultimate aim of confirming the impossibility of a (...) scientific study about this way of being and its causes. The central part of this paper deals with E 2, 1026b27-1027a15, where Aristotle introduces the causes of accidental being. I endeavor to show that each of the three causes presented in these lines are compatible and relevant, as they can be understood, respectively, as the formal, efficient and material cause of what happens by accident. Evaluation studies of the Bayh-Dole Act are generally concerned with the pace of innovation or the transgressions to the independence of research. While these concerns are important, I propose here to expand the range of public values considered in assessing Bayh-Dole and formulating future reforms. To this end, I first examine the changes in the terms of the Bayh-Dole debate and the drift in its design. Neoliberal ideas have had a definitive influence on U.S. innovation policy for the last thirty (...) years, including legislation to strengthen patent protection. Moreover, the neoliberal policy agenda is articulated and justified in the interest of competitiveness. Rhetorically, this agenda equates competitiveness with economic growth and this with the public interest. Against that backdrop, I use Public Value Failure criteria to show that values such as political equality, transparency, and fairness in the distribution of the benefits of innovation, are worth considering to counter the policy drift of Bayh-Dole. In this article the relations between philosophy and applied ethics are considered. The presented deliberation is concentrated on the question whether philosophy has contributed to applied ethics, especially to business ethics. Trying to find an answer to this question I will refer to the discussion which was started by R. Rorty in which he presented his own point of view on the issues related to moral development and the role of philosophy and philosophers in the modern world. Rorty points at (...) proper tools which, in his opinion, can be helpful to business ethicists and formulates the goal they should try to aim at. His opinions has started a vivid discussion. Patricia H. Werhane, Daryl Koehn and Richard T. De George try to discuss with Rorty’s statement. They oppose Rorty’s argument that philosophy is not more relevant to applied ethics than any other academic disciplines. They point to the facts which document philosophers’ contribution in forming business ethics. This article presents their arguments as well as an attempt of their critical assessment. (shrink)

Patentowanie ludzkich genów jest zjawiskiem, które w obecnych czasach nabrało intensywności i znaczenia. Jest jedną z kluczowych form zabezpieczania praw własności przemysłowej, zwłaszcza dla ośrodków badawczych i koncernów farmaceutycznych. Ze względu na naturę produktu podlegającego opatentowaniu, pomysł patentowania genów budzi wiele kontrowersji i rodzi spory na różnych płaszczyznach. Celem artykułu jest naszkicowanie ram prawnych dla tego zjawiska (m.in. porównanie regulacji europejskich i amerykańskich) oraz krytyczne omówienie argumentów przemawiających zarówno w obronie tej procedury, jak i przeciwko niej, wysuwane z różnych perspektyw: (...) prawnej (kwestia posiadania przez geny tzw. zdolności patentowej, kontrowersje związane z prawem własności do ludzkiego ciała), społeczno-ekonomicznej (wpływ zjawiska na rozwój badań naukowych oraz na ceny leków i dostępność różnych terapii) oraz etycznej (omówionej na podstawie wybranych kazusów). Artykuł zarysowuje również kilka propozycji rozwiązań praktycznych, które mają usuwać przynajmniej niektóre kontrowersje związane z patentowaniem genów. (shrink)

Esse artigo propõe uma reflexão ontológica não-essencialista e não-naturalista acerca do humano, a partir de alguns conceitos próprios a hermenêutica filosófica de Gadamer, que sirva de fundamentação para o desenvolvimento de uma filosofia da educação hermenêutica que, por sua vez, avança preocupada com o papel da filosofia nas escolas. Enquanto parte de um trabalho maior, que vem sendo desenvolvido enquanto tese de doutorado, o objetivo desse texto é apresentar, de um modo geral e introdutório, os principais argumentos que sustentam a (...) proposta de uma educação filosófica e hermenêutica, a qual se insere no processo de formação existencial dos educandos. This work is the first monograph devoted to the interpretation of Aristotle’s theory of chance in Physics II 4-6 and its implications and projections in other treatises, including an original and comprehensive account of the Aristotelian conception of chance, of accidental causality in the realm of nature, and of accidental causality in the realm of human action. One of the main interpretative issues around Aristotle’s discussion of chance is its relation to the four causes and to teleology. In this sense, (...) it is particularly difficult to find the common features which fortune (tyche) and spontaneity (automaton) share. This work, offers such an interpretation of Aristotle’s general concept of chance (i.e. common to fortune and spontaneity), which shows clearly its relation with his theory of causality (Phys. II 3), with teleology, and with the application of this theory to the study of nature. It also shows how fortune and spontaneity can be interpreted consistently with this general characterization of chance, and how the specific differences between them can be accounted for paying attention to the different structures of causality in the realm of nature and in the realm of human action. Regarding the specific concept of spontaneity (automaton), a crux interpretum, the book offers one of the few independent discussions this issue in Aristotelian literature, and proposes a sub-classification in two kinds of spontaneity based on an analysis of Aristotle’s different examples and characterizations: ‘mixed spontaneity’ (which shares some features with fortune), and ‘pure spontaneity’ (which takes place strictly in the realm of nature). These different structures had not been recognized in specialized literature before. The problem of chance has projections into Aristotle’s natural philosophy, as well as into Aristotle’s theory of action and practical philosophy. This ample perspective of Aristotle’s work, and of the different explanatory models and ontological structures therein involved, constitutes an interesting groundwork for future developments in some or many of these realms of investigation. Although a great deal has been written on Plato's ethics, his cosmology has not received so much attention in recent times and its importance for his ethical thought has remained underexplored. By offering accounts of Timaeus, Philebus, Politicus and Laws X, the book reveals a strongly symbiotic relation between the cosmic and human sphere. It is argued that in his late period Plato presents a picture of an organic universe, endowed with structure and intrinsic value, which both urges our respect (...) and calls for our responsible intervention. Humans are thus seen as citizens of a university that can provide a context for their flourishing even in the absence of good political institutions. The book sheds light on many intricate metaphysical issues in late Plato and brings out the close connections between his cosmology and the development of his ethics. (shrink)

In the U.S.A., advocates of academic freedom—the ability to pursue research unencumbered by government controls—have long found sparring partners in government officials who regulate technology trade. From concern over classified research in the 1950s, to the expansion of export controls to cover trade in information in the 1970s, to current debates over emerging technologies and global innovation, the academic community and the government have each sought opportunities to demarcate the sphere of their respective authority and autonomy and assert themselves in (...) that sphere. In this paper, we explore these opportunities, showing how the Social Contract for Science set the terms for the debate, and how the controversy turned to the proper interpretation of this compact. In particular, we analyze how the 1985 presidential directive excluding fundamental research from export controls created a boundary object that successfully demarcated science and the state, but only for a Cold War world that would soon come to an end. Significant changes have occurred since then in the governance structures of science and in the technical and political environment within which both universities and the state sit. Even though there have been significant and persistent calls for reassessing the Cold War demarcation, a new institutionalization of how to balance the concerns of national security and academic freedom is still only in its nascent stages. We explore the value of moving from a boundary object to a boundary organization, as represented in a proposed new governance body, the Science and Security Commission. (shrink)

In this review, we present some ethical imperatives observed in this pandemic from a data ethics perspective. Our exposition connects recurrent ethical problems in the discipline, such as, privacy, surveillance, transparency, accountability, and trust, to broader societal concerns about equality, discrimination, and justice. The paper attempts to demonstrate the contemporary relevance of Spinoza’s ethics of virtue and responsibility—a non-deontic ethics whose foundation is not obligation and duty, not the normative laws which regulate the relations with the fellows, or the prescriptions, but an intuitive knowledge on the essence of things and on the choice of a proper way of life. The choice of the best way of life is equivalent with the responsibility to identify the opportunities to control the own life.

O artigo apresenta os resultados de uma pesquisa que investigou a apropriação do referencial teórico de Paulo Freire em teses e dissertações nas áreas de Ensino de Ciências e Educação CTS. Através de uma análise bibliométrica e epistemológica de quatro matrizes que agregam os niveis epistemológico, ontológico e gnosiológico foi identificada a presença do referencial teórico de Paulo Freire nesses trabalhos.

This article begins by examining the importance that critical intercultural dialogues have within the Modernity/Coloniality Research Program toward reaching an alternative geopolitics and body-politics of knowledge, in order to raise the question whether the colonial difference creates conditions for dialogical situations that bring together critiques of coloniality emerging from different experiences of coloniality. The answer it offers is twofold. On the one hand, if one imagines such situations to be communicative exchanges à la Bakhtin that put logos at the center, (...) given what is termed the coloniality of language and speech, the possibility of such exchanges is feasible only as an abstract gesture. On the other hand, when one faces the complications of the erasure of dialogue produced by coloniality, the kind of decolonial communicative relations that seem possible among people thinking and acting from the colonial difference are less conscious or agential than emotive. By articulating the relations between coalitional methodologies and a global sense of connection the article proposes a nondialogical theory of decolonial communication: a way of orienting ourselves with a sense of permeability and recognition of being on the same side that doesn't need to be politically motivated but is always active. José Antonio Valdivia Fuenzalida | Résumé : Pendant le xiiie siècle, plusieurs auteurs scolastiques ont adopté des théories aristotéliciennes pour expliquer la connaissance humaine. Ces théories supposent que l’homme est capable d’acquérir la science en se servant de ses forces naturelles. Notre âme est capable de saisir l’essence des choses en obtenant une connaissance certaine à leur propos. Pourtant, un bon nombre de ces auteurs estimaient que, même en admettant les théories mentionnées, on ne saurait se passer de l’assistance (...) de Dieu afin d’expliquer l’acquisition des connaissances scientifiques. Cet article s’interroge sur les raisons qui ont conduit lesdits auteurs à adopter une telle position. L’analyse de certains textes de saint Bonaventure permet de comprendre ce que la doctrine de l’illumination divine veut expliquer, à savoir : que nous pouvons obtenir de la certitude malgré le fait que les choses créées ne possèdent qu’une « nécessité conditionnelle ». En effet, même l’essence des choses créées n’aurait pas le degré minimum de nécessité qui est requis pour fonder la certitude absolue présupposée dans le concept médiéval de scientia. |: During the 13th century, several scholastic authors adopted Aristotelian theories to explain human knowledge. These theories assume that man is capable of acquiring science by using his natural powers. Our soul is able to grasp the essence of things by obtaining a knowledge that is certain about them. Yet, many of these authors believed that even admitting those theories, God’s assistance could not be dispensed with in order to explain the acquisition of scientific knowledge. This paper examines the reasons that led these authors to such a position. The analysis of several texts by St. Bonaventure allows one to understand what the doctrine of divine illumination aims to explain : namely that we can obtain certainty in spite of the fact that created things only possess a “conditional necessity”. Indeed, even the essence of created things would not have the minimum level of necessity that is required to be the foundation of the absolute certainty presupposed in the medieval concept of Scientia. El propósito del presente artículo es el explorar la connotación que el vocablo ¿democracia¿ presenta para Alexis de Tocqueville, en particular en su obra paradigmática, La democracia en América. Para ello, se establecerán comparaciones con las diversas acepciones previas de dicha palabra, a fin de establecer continuidades y rupturas con las mismas. De éstas últimas es preciso rescatar principalmente el hecho de que el bisnieto de Malherbes utilizase el apelativo de democrático en función de una experiencia de vida que él (...) percibía de forma absolutamente divergente con cualquier modo de convivencia implementado en el pasado. La democracia será a su juicio un nuevo estado social, y en su carácter de tal, modificará los patrones de conducta político-sociales de manera radical. Si el pasado deja de iluminar el porvenir, si nos encontramos en una situación crítica, si la oposición entre democracia directa y representativa pierde su validez, debemos tratar de comprender lo que nos rodea con una palabra que refleje un mundo enteramente nuevo. Doing research in a globalized context – regardless of the discipline – requires language decisions at different stages of the research process. Many of these language decisions have ethical implications. Existing literature and ethical guidance tend to focus on ethical concerns that arise in communication with participants who use a language different from the main research language. As this article shows, language decisions with potential ethical implications can occur in many additional ways. Two questions guided this work: how do language (...) decisions and research ethics intersect at different stages of the research process, and what potential harm is related to language decisions and how can such concerns be mitigated? Relevant literature – combined with practical research experiences – show that language decisions can potentially result in harm at the conception stage of research projects, when working with participants, during data analysis, interpretation, and dissemination, as well as when managing a research project. Thus, the article highlights that the role of language-related ethical dilemmas is not only organizational (e.g., ensuring participants can understand what the research is about), but also social (e.g., developing trust and relationships in research teams) as well as ideological (e.g., awareness of power structures and diverse worldviews). In order to support researchers in globalized contexts, this article offers a reflective framework that complements regulatory guidance issued by ethical bodies and facilitates a deeper awareness of ethical implications related to language decisions in a multilingual world. En el marco del desafío que implica abordar el fenómeno de la informalidad urbana a escala metropolitana en términos cuantitativos, el presente trabajo se propone recuperar fuentes de datos secundarias que han georreferenciado las urbanizaciones informales en el territorio y ponerlas en diálogo con las posibilidades que brindan los datos censales para trabajar a nivel microespacial. De esta manera, se busca dar cuenta de las características sociodemográficas y habitacionales de las urbanizaciones informales de la aglomeración Gran Buenos Aires en 2010 (...) y las especificidades que adquieren dos formas que condensan aspectos socio-urbanos distintos: las villas y los asentamientos. Se evalúan posibilidades y limitaciones de esta metodología y, como resultado, se analizan las particularidades que atraviesan a estos tipos de hábitat en términos de estructura etaria, origen migratorio, nivel educativo, composición y tamaño de los hogares, condiciones habitacionales, y los contrastes que emergen entre ellos y respecto del conjunto urbano. Este trabalho constata a necessidade de uma formação de professores emancipada do sistema capitalista e discute a possibilidade de o movimento estudantil proporcionar uma formação política aos estudantes e futuros profissionais. A formação de professoras e professores é cada vez mais influenciada pelas determinações dos organismos internacionais, e mais difícil fica organizar a resistência ao capitalismo. As atividades das entidades do movimento estudantil, seu histórico de ação e questionamentos das condições do ensino e da sociedade brasileira podem permitir uma formação (...) contra-hegemônica.
