Tem-se como temática central a atuação do poder judiciário no Brasil, em especial, do Supremo Tribunal Federal em relação ao fenômeno da judicialização da política. Por meio do estudo de processo judicial, a Ação Penal 937 no Supremo Tribunal Federal, procura-se constatar o movimento ativista de juízes que ganha forçano Brasil e no mundo, desde o fim da segunda guerra mundial. Tal prática, que se justifica na efetivação de direitos humanos e utiliza a retórica neoconstitucionalista, fere a separação de poderes (...) e ganha contornos evidentemente políticos. (shrink)

Empirical research in bioethics has developed rapidly over the past decade, but has largely eschewed the use of technology-driven methodologies. We propose “design bioethics” as an area of conjoined theoretical and methodological innovation in the field, working across bioethics, health sciences and human-centred technological design. We demonstrate the potential of digital tools, particularly purpose-built digital games, to align with theoretical frameworks in bioethics for empirical research, integrating context, narrative and embodiment in moral decision-making. Purpose-built digital tools can engender situated engagement (...) with bioethical questions; can achieve such engagement at scale; and can access groups traditionally under-represented in bioethics research and theory. If developed and used with appropriate rigor, tools motivated by “design bioethics” could offer unique insights into new and familiar normative and empirical issues in the field. (shrink)

As is well known, Heinrich Scholz and his academic society maintained good scientific contacts with Polish logicians before, during, and after the Second World War. My interest here is to examine the details of their collaboration by presenting Scholz’s unpublished correspondence with Fr. Józef M. Bocheński. Although a great deal has been written on Plato's ethics, his cosmology has not received so much attention in recent times and its importance for his ethical thought has remained underexplored. By offering accounts of Timaeus, Philebus, Politicus and Laws X, the book reveals a strongly symbiotic relation between the cosmic and human sphere. It is argued that in his late period Plato presents a picture of an organic universe, endowed with structure and intrinsic value, which both urges our respect (...) and calls for our responsible intervention. Humans are thus seen as citizens of a university that can provide a context for their flourishing even in the absence of good political institutions. The book sheds light on many intricate metaphysical issues in late Plato and brings out the close connections between his cosmology and the development of his ethics. (shrink)

Worldwide interest in understanding art and creative practices as valid forms of knowledge production has led to the establishment of research-creation as an interdisciplinary academic field in the last twenty years in Canada as elsewhere. Its establishment relates to a growing interest in critical making and technological innovation and to the legacies of feminism(s) and its critique of the power dynamics of knowledge production within academia. This article outlines a series of interactive projects that bring visibility to Latin American women (...) in art, science and technology and speculates on the legacies of feminism(s) in the emergence of research-creation. The four projects discussed build on each other and explore re-mediation, re-activation and re-enactment as part of a collaborative feminist research-creation methodology. I theorize their potential to activate political memory by highlighting how these three approaches to creation share a preoccupation for revisiting the past through repetition, iteration and the facilitation of intergenerational encounters among humans, non-humans and across media and technologies. While discussing the feminist orientation of these approaches, I suggest a critique of dominant modes of knowledge production that have obscured the contributions of Latin American women and offer four research-creation interventions in the media arts archive. El objetivo de esta reseña es presentar un libro que reflexiona acerca de los procesos históricos de constitución de la identidad masculina y femenina, buscando explicaciones posibles para la desigualdad de género y la dominación sexista que se ha evidenciado a lo largo de la historia y en distintas sociedades.

Este trabajo se propone mostrar cómo la Teoría Neoclásica de la Ley Natural fundamenta la existencia de normas morales absolutas, cuál es su relevancia para la filosofía moral, y qué críticas pueden ser formuladas a la argumentación de los autores. Ellos postulan que la ley natural, mediante normas, lleva a elegir y proteger bienes humanos básicos, correspondientes a los diversos aspectos de la naturaleza humana, evitando su destrucción, daño o impedimento. Aunque la mayoría de las normas morales admiten excepción, nunca (...) lo hacen las que prohíben realizar un acto que siempre daña directamente un bien básico, pues tal acto no puede compatibilizarse con la propia autorrealización, y atenta contra la dignidad humana. La división del trabajo tomará la siguiente forma: en los primeros cuatro apartados se abordarán los conceptos clave para la defensa de una norma absoluta en la Teoría Neoclásica, en el quinto se enlazarán los conceptos al modo que los autores lo hacen para demostrar la existencia de absolutos morales y someter el consecuencialismo a crítica, y en el sexto se hará una breve revisión crítica de los argumentos presentados. Abstract:In this article, we present a pragmatic approach to neuroethics, referring back to John Dewey and his articulation of the “common good” and its discovery through systematic methods. Pragmatic neuroethics bridges philosophy and social sciences and, at a very basic level, considers that ethics is not dissociable from lived experiences and everyday moral choices. We reflect on the integration between empirical methods and normative questions, using as our platform recent bioethical and neuropsychological research into moral cognition, action, and experience. Finally, (...) we present the protocol of a study concerning teenagers’ morality in everyday life, discussing our epistemological choices as an example of a pragmatic approach in empirical ethics. We hope that this article conveys that even though the scope of neuroethics is broad, it is important not to move too far from the real life encounters that give rise to moral questions in the first place. In this article the relations between philosophy and applied ethics are considered. The presented deliberation is concentrated on the question whether philosophy has contributed to applied ethics, especially to business ethics. Trying to find an answer to this question I will refer to the discussion which was started by R. Rorty in which he presented his own point of view on the issues related to moral development and the role of philosophy and philosophers in the modern world. Rorty points at (...) proper tools which, in his opinion, can be helpful to business ethicists and formulates the goal they should try to aim at. His opinions has started a vivid discussion. Patricia H. Werhane, Daryl Koehn and Richard T. De George try to discuss with Rorty’s statement. They oppose Rorty’s argument that philosophy is not more relevant to applied ethics than any other academic disciplines. They point to the facts which document philosophers’ contribution in forming business ethics. This article presents their arguments as well as an attempt of their critical assessment. (shrink)

Patentowanie ludzkich genów jest zjawiskiem, które w obecnych czasach nabrało intensywności i znaczenia. Jest jedną z kluczowych form zabezpieczania praw własności przemysłowej, zwłaszcza dla ośrodków badawczych i koncernów farmaceutycznych. Ze względu na naturę produktu podlegającego opatentowaniu, pomysł patentowania genów budzi wiele kontrowersji i rodzi spory na różnych płaszczyznach. Celem artykułu jest naszkicowanie ram prawnych dla tego zjawiska (m.in. porównanie regulacji europejskich i amerykańskich) oraz krytyczne omówienie argumentów przemawiających zarówno w obronie tej procedury, jak i przeciwko niej, wysuwane z różnych perspektyw: (...) prawnej (kwestia posiadania przez geny tzw. zdolności patentowej, kontrowersje związane z prawem własności do ludzkiego ciała), społeczno-ekonomicznej (wpływ zjawiska na rozwój badań naukowych oraz na ceny leków i dostępność różnych terapii) oraz etycznej (omówionej na podstawie wybranych kazusów). Artykuł zarysowuje również kilka propozycji rozwiązań praktycznych, które mają usuwać przynajmniej niektóre kontrowersje związane z patentowaniem genów. (shrink)

O artigo trata do tema hegeliano do reconhecimento (Anerkennung), que, graças aos cursos de Alexandre Kojève sobre a Fenomenologia do Espírito, ministrados na École des Hautes Études de 1933 a 1939, exerceu um forte impacto no pensamento francês do século XX. São explicitadas nele duas abordagens, uma otimista, a de Kojève, outra critico-construtiva, a de Jean-Paul Sartre.

O modelo escolar moderno que foi universalizado durante o século XX, mostrou-se incapacitado de responder todas as demandas sociais que lhe foram impostas. Dessa forma, durante a segunda metade deste século a crise do sistema de ensino formal deu abertura a diversos debates sobre questões que permeiam a ação de educar, como os espaços, os atores e porque não sobre próprio conceito: o que é educar? Sendo assim, neste artigo trago reflexões sobre a educação formal, dentre outras formas, analisando o (...) contexto da educação no Brasil e em Cabo Verde, para compreender de que maneira determinados atores sociais, como os rappers, podem contribuir para a construção de uma educação emancipadora. In this review, we present some ethical imperatives observed in this pandemic from a data ethics perspective. Our exposition connects recurrent ethical problems in the discipline, such as, privacy, surveillance, transparency, accountability, and trust, to broader societal concerns about equality, discrimination, and justice. Este artigo discute a influência da segunda parte do Parmênides de Platão, e mais especificamente a sua 3ª hipótese, na obra de Plotino e Jâmblico. Ou seja, a inter- elação entre a apropriação do conceito central da 3ª hipótese, o instante (exaiphnes), (1) em Plotino através da apropriação original do conceito de presença (parousia) e (2) em Jâmblico quando da modificação da estrutura das hipóteses parmenidianas, ao introduzir antes da primeira hipótese, o Inefável, e deslocar a alma para a 4ª (...) hipótese, alocando na 3ª hipótese, os daemons, os anjos e os heróis. A posição da alma na estrutura das hipóteses irá determinar a ascese proposta por cada um deles: se para Plotino a ascese é intelectual, para Jâmblico a mesma se realiza, depois de esgotados os recursos filosóficos, através da teurgia, entendida como um complemento e não em oposição à filosofia, sendo esta a sua novidade. The main objective of this work is to discuss the materiality of relationships and experiences of infants in early childhood education, based on a dialogue with the Brazilian curriculum guidelines for Early Childhood Education in 3 municipalities in the state of São Paulo, and with the concepts of technical objects and individuation developed by Simondon. This is a qualitative research that uses bibliographic and documentary research as a methodology and the production of cartographies of scenes in which relationships between babies (...) and objects are observed. The cartography used here is inspired by the records developed by Fernand Deligny (2015) and its appropriation for research with babies, as proposed by Julia Oliveira (2016). Research was carried out on this topic in the field of education, going through scientific articles and guiding documents for early childhood education. The authors mapped the paths and affections of babies and their relationships with objects in two distinct scenes that were collected within the scope of a collective project. It is a work that contributes to early childhood education in general and, specifically, to baby studies (Infantology, Babyhood studies). (shrink)

El presente trabajo intenta delimitar algunas de las ideas centrales del mesianismo benjaminiano y de las lecturas en torno a esta temática, fundamentalmente, el debate entre Giorgio Agamben y Jacques Derrida. Nuestra hipótesis es que habría dos mesianismos diferenciables en el pensamiento de Benjamin, en la medida en que uno de ellos se correspondería con la idea de ruptura, de pura interrupción, mientras que el otro estaría anclado en la idea de cripta o debilidad de las voces de los vencidos. Ses origines sont multiples mais il s’enracine dans une opposition frontale, toujours active et de plus en plus nombreuse. Il s’emploie à créer des formes de coopération nouvelles.

CRISIS, RENOVACIÓN PARTIDARIA Y TRANSFORMACIONES POLÍTICAS EN EL PERONISMO DE CÓRDOBA, 1983 - 1987.

This paper re-evaluates the role that Plato confers to pleasure in the "Philebus." According to leading interpretations, Plato there downplays the role of pleasure, or indeed rejects hedonism altogether. Thus, scholars such as D. Frede have taken the "mixed life" of pleasure and intelligence initially submitted in the "Philebus" to be conceded by Socrates only as a remedial good, second to a life of neutral condition, where one would experience no pleasure and pain. Even more strongly, scholars such as Irwin (...) have seen the "Philebus'" arguments against false pleasures as an actual attack on hedonism, showing -- in Irwin's words -- "why maximization of pleasure cannot be a reasonable policy for the best life." Against these claims, I argue that the mixed life of pleasure and intelligence is presented in the "Philebus" as a first best and not just as a second best for humans, and that, accordingly, Socrates proposes to incorporate -- rather than reject -- pleasure as one of the intrinsically desirable aspects of the happy life. Thus, I offer alternative readings of controversial passages that have given rise to the prevalent interpretation criticized here, and advance positive evidence that at least some pleasures are seen by Plato as inherently good. In addition, I demonstrate that Plato's arguments against false pleasures do not by themselves constitute an attack on hedonism. Rather, they can be seen as a strategy to show the hedonist that, in order to be a maximal, or even a consistent, hedonist, he should go for true, and not fake pleasures, if after all pleasure is the object of his pursuit. But, since this cannot be achieved without intelligence, then the mixed life of pleasure and intelligence is to be accepted even by hedonist themselves. (shrink)

El propósito del presente artículo es el explorar la connotación que el vocablo ¿democracia¿ presenta para Alexis de Tocqueville, en particular en su obra paradigmática, La democracia en América. Para ello, se establecerán comparaciones con las diversas acepciones previas de dicha palabra, a fin de establecer continuidades y rupturas con las mismas. De éstas últimas es preciso rescatar principalmente el hecho de que el bisnieto de Malherbes utilizase el apelativo de democrático en función de una experiencia de vida que él (...) percibía de forma absolutamente divergente con cualquier modo de convivencia implementado en el pasado. La democracia será a su juicio un nuevo estado social, y en su carácter de tal, modificará los patrones de conducta político-sociales de manera radical. Si el pasado deja de iluminar el porvenir, si nos encontramos en una situación crítica, si la oposición entre democracia directa y representativa pierde su validez, debemos tratar de comprender lo que nos rodea con una palabra que refleje un mundo enteramente nuevo. In this paper I re-examine the status of the mind-body relation in several of Plato’s late dialogues. A range of views has been attributed to Plato here. For example, it has been thought that Plato is a substance dualist, for whom the mind can exist independently of the body; or an attribute dualist, who has left behind the strong dualistic commitments of the Phaedo by allowing that the mind may be the subject of spatial movements. But even in cases where (...) a classification of Plato as a holder of a particular ontology of the mind has been left undefined, it has been a shared assumption that in the late dialogues the mind itself must be immaterial. I take issue with these various views and show that none of them is necessitated by the text. In the first place, I argue there is strong evidence against the view that Plato should, in his late period, be committed not only to substance dualism, but also to attribute dualism. Furthermore, it is possible that Plato may have allowed that the mind itself be a three-dimensional corporeal entity (in a way that sets up a precedent for later Stoic developments). But even if this is not the only possible reading of the text, it is shown how at any rate the mind must be seen in late Plato as the principle of organization of a body and ontologically inseparable from it. Despite prima facie affinities with Aristotle here, we shall see a Plato emerge for whom the mind (without exception) and the body cannot exist without one another – a thesis more radical than that of Aristotle’s. To bring out the provocative nature of this suggestion, I start, in section I, by laying out the state of the question and compare what I shall argue is the late Platonic view with standard interpretations of his previous work, stressing the historical force that I expect this thesis to have. Afterwards, in three respective sections, I proceed to pay heed to relevant passages in the Timaeus, Philebus and Laws in order to establish the main point of this paper. Finally, in section V, I consider the challenge apparently introduced against my thesis by Plato’s occasional talk of immortality and eschatology in those dialogues, and argue instead that many of those passages add further strength to the view defended in this essay. El presente artículo intenta realizar, por un lado, una genealogía histórica que hace de la noción derrideana de ‘hospitalidad’ el fin de la indagación. Es por ello que, al inicio de nuestro trabajo abordaremos someramente algunos rasgos de la hospitalidad antigua desde la Odisea, para pasar luego a un análisis de la noción de tolerancia en la modernidad, a través de tres de sus grandes defensores: John Locke, Voltaire y John Stuart Mill. Frente a dichos pensamientos, por otro lado, intentaremos (...) esbozar la problemática de la hospitalidad desde el pensamiento derrideano y la influencia de la filosofía de Emmanuel Levinas, a fin de señalar la importancia de un pensamiento ético y político del otro como otro. Given that it seems uncontroversial that Socrates displays considerable contempt towards rhetoric in theGorgias,the title of this paper might strike one as an oxymoron. Indeed, a reading of the text has more than once encouraged scholars to posit an Opposition between the elenctic procedures championed by Socrates and the rhetorical procedures of his interlocutors. At least three features have been highlighted that seem to indicate this contrast:1.the Socratic interest in short questions and answers versus his interlocutors’ use of long speeches;2.the (...) Socratic interest in truth regardless of the opinion of the many, the latter seeming an important concern of the rhetorician;3.the supposed Socratic appeal to the intellectual powers of the interlocutor, which is usually contrasted with the appeal to the emotions which is distinctive of rhetoric. En este trabajo se presenta una comparación de los tiempos de respuesta, optimización de la ruta y complejidad del grafo en métodos de planificación de trayectoria para robots móviles autónomos. Se contrastan los desarrollos de Voronoi, Campos potenciales, Roadmap probabilístico y Descomposición en celdas para la navegación en un mismo entorno y validándolos para un número variable de obstáculos. Las evaluaciones demuestran que el método de generación de trayectoria por Campos Potenciales, mejora la navegación respecto de la menor ruta obtenida, (...) el método Rapidly Random Tree genera los grafos de menor complejidad y el método Descomposición en celdas, se desempeña con menor tiempo de respuesta y menor coste computacional. The new developments in our social context, the recent pandemic outbreak, caused a series of changes in everyday practices. The student population represents a particular case, both their safety and future education were under duress during this period. However, their views over the situation have not been present in the scientific literature. The present qualitative research aimed to explore students' perceptions, attitudes, views, and representations on the Covid-19 pandemic. Three focus groups, each containing twelve participants, were organised to explore these (...) aspects and students’ particular experiences. Focus group sessions were audio-recorded and the transcripts were analysed. The results revealed four dimensions of the students' representations: change – as a constant of the present, prospective scenarios, the pulse of the moment, and surrounding risks. The limitations and the importance of the study are discussed. The consequences of these representations are particularly important due to the influence they can have on people’s practices during the crisis and the extent of measures’ acceptance. The results offer precious insights on why some communication strategies used by the authorities had a low compliance rate, what should be done differently, and what should be considered in order to promote adaptive health behaviors during the latter phases of the pandemic. In the present study the impact of need for cognitive closure manipulations via time pressure and explicit closure goal activation on executive control was investigated. Although there is some evidence that NFC, measured as an individual variable, is related to better performing in attentional tasks involving executive control, these results have never been validated across different manipulations of NFC. Thus, in the present study we induced NFC via internal and external time pressure and tested the impact of these manipulations on (...) the performance in tasks that measure executive control, i.e., the Stroop and switching tasks. The results revealed that induced high NFC, indeed boosted performance in executive control tasks. Moreover, there was no difference in the effect of both NFC manipulations on task performance. The implications regarding the role of executive control and specific NFC manipulations in social cognition are discussed. (shrink)

THE TENTH BOOK OF THE LAWS, which contains Plato's last word on cosmology and theology, has often been considered as presenting Plato's views in a more exoteric way in contrast with the more esoteric style of the Timaeus. And there are good reasons to think that this view is correct. Whereas the Timaeus stresses that "to find the maker and father of this All is difficult, and, having found it, it is impossible to communicate it to the crowd", Plato is (...) in Laws 10 intending to establish a "proemium" or rational foundation for his laws against impiety, which are supposed to be known by all. In this proemium Plato tries to argue for three propositions: that the gods exist ; that they take care of human affairs ; that they cannot be bribed by sacrifices or prayers. The underlying assumption is that learning these facts about the gods will also help to prevent impiety which, like any kind of vice, is often due to ignorance. (shrink)
