Owing to this double need, Kant seems to be against himself and consequently the most critical and dialectical interpretation of Kant's thought is opposed to the (...) formalistic absolutism used by the Kantian jurists, who reject the most vital and profound critical philosophy for a metaphysical framework which confuses everything as though all were homogeneous. In fact, what appears more valid in Kant's philosophy is the continuous tension between formalism and dialectics, a tension which, even though it is never definitively overcome in a dialectical sense by Kant himself, nevertheless reveals the need for a legal dialectic rather than a formalism. It shows "the destiny of legal right to cease being a coercive apparatus, and of being transformed into rules for human society taken from civil society" (p. 390). Of course, this dialectical perspective suggests new horizons and also new problems and a wide plan of work. However, I agree with the author that the uncertainties which will inevitably emerge in this work must be met urgently and radically. For we know that "on the other scale-pan there are in fact the raw metaphysics of legal positivism, the conservatism of the jurists, and at best the formalistic, paralyzing ascetics" (p. 390). The merit of Negri's book seems to me to lie above all in the lively problematical tension with which he examines the Kantian thought. Following in the paths of G. Gurwitch, Metzger and Goldmann, as well as of Luk~s' History and Class Consciousness, he appreciates and understands the interpenetration of ethical motivations with the social and cultural environment. This historical and philosophical awareness of problems is particularly lively in the pages where the author notices the begging of principle in Kantian thought; a begging of principle consisting in the fact that "the definition of limit presupposes a limit to the principle itself, but the examination of this presupposition is neglected" (p. 77 ft.). Because of this critical and historical tension, Negri's book can be of great interest to the jurist, the philosopher and the historian. And if this ensues, it is because the conception of legal right which the author seeks to assert throughout his theoretical tension is deep-rooted humanly, dialectically, concretely. Rousseau's Lawgiver is not a philosopher inventing a doctrine but a statesman and educator establishing the reign of law among his own people. Did Rousseau really see himself in this position? The texts do not, in our judgment, support this view. Broome vacillates between seeing in the Lawgiver analogy a doctrinal necessity and an idiosyncrasy (...) born out of Rousseau's near-madness, a consequence of his ambiguous belief that for Rousseau all philosophical problems are personal ones (p. 12). The author is much indebted to current French and Swiss Rousseau studies whose findings he introduces, often with independent, sometimes with wilful adaptations. Since he gives no footnote references to this literature, the reader to whom the book is addressed has no way of distinguishing established critical opinion from the author's own interpretations which have not yet passed the critical test. (The Fall-and-Redemption theme, e.g., is well established, but nowhere has it been made the foundation of exegesis, for the good reason that it is not central enough.) The book should therefore not be taken as a synthesis of current Rousseau research. (Padova: 1962) In his book At the Origins of Legal Formalism, realizing the problematic nature of the idea of form in Kantian thought, Negri goes back to the origins and the historical, ethical, and political motivations of this ambiguity. Then he examines the prolonging of this ambivalence in the tortuous involutions of the thought of post-Kantian jurists, and points out the consequences. Negri notices how Kant puts form into the frame of reference of intelligible totality and how this leads to very ambivalent interpretations. In fact, as Goldmann too noted, the idea of transcendental totality, when applied to the historical world, becomes a universe that is humanly and concretely dialectical; but at the same time, the idea of form appears in another aspect as a sign of the development of transcendental totality. This means that Kant has both a critical and a metaphysical ideal, and this duplicity is found in the ambivalence of the idea of form, conceived from one point of view as a condition of critical research and from the other point of view as constitutive of metaphysical reconstruction (p. 65). Corresponding to this double conception of form is the ambiguous conception of freedom which Kant uses in legal philosophy. On one hand following Rousseau's opinion, Kant interprets freedom as autonomy of mind, and to this conception of freedom there corresponds the conception of form as constitutive of objectivity. This is developed in the Critique of Practical Reason. But on the other hand, following Montesquieu's opinion, as G. Gurwitch noted, Kant interprets freedom as independence, and, of course, to this conception of freedom there corresponds the conception of form as a "rational structure, as a registration of relations of wills" (p. 74). In this last case Kant appears to accept concretely "legal formalism as a liberal and ideological foundation, rejecting the formative element of democratic ideology to the limbo of a well-intentioned morality" (p. 74). However, these two conceptions of freedom and form complement each other because "independence conditions autonomy, and then reciprocally the autonomous contents of the right are interpreted as independence" (p. 71). But in this way, as Negri subtly notes, independence overburdens itself with that metaphysical character which is peculiar to autonomy, whereas autonomy then loses much of its metaphysical and constitutive importance, because it is used to define individual independence and is therefore bound to a "doctrinaire individualism" (p. 76). Does action always arise out of desire? G. F. Schueler examines this hotly debated topic in philosophy of action and moral philosophy, arguing that once two senses of "desire" are distinguished - roughly, genuine desires and pro attitudes - apparently plausible explanations of action in terms of the agent's desires can be seen to be mistaken. Desire probes a fundamental issue in philosophy of mind, the nature of desires and how, if at all, they motivate and justify our actions. At (...) least since Hume argued that reason "is and of right ought to be the slave of the passions," many philosophers have held that desires play an essential role both in practical reason and in the explanation of intentional action. G. F. Schueler looks at contemporary accounts of both roles in various belief-desire models of reasons and explanation and argues that the usual belief-desire accounts need to be replaced. Schueler contends that the plausibility of the standard belief-desire accounts rests largely on a failure to distinguish "desires proper," like a craving for sushi, from so-called "pro attitudes," which may take the form of beliefs and other cognitive states as well as desires proper. Schueler's "deliberative model" of practical reasoning suggests a different view of the place of desire in practical reason and the explanation of action. He holds that we can arrive at an intention to act by weighing the relevant considerations and that these may not include desires proper at all. (shrink)

Currently fashionable among critics of enlightenment thought is the charge that Kant's ethics fails to provide an adequate account of character and its formation in moral and political life. G. Felicitas Munzel challenges this reading of Kant's thought, claiming not only that Kant has a very rich notion of moral character, but also that it is a conception of systematic importance for his thought, linking the formal moral with the critical, aesthetic, anthropological, and biological aspects of his philosophy. Many hold that (1) consciousness poses a uniquely hard problem. Why is this so? Chalmers considers 12 main answers in 'The Meta-Problem of Consciousness'. This paper focuses on number 11, and is principally addressed to those who endorse (1) because they think that (2) consciousness can't possibly be physical. It argues that to hold (2) is to make the mistake of underestimating the physical, and that almost all who make this mistake do so because they think they know more about (...) the physical than they do. When we see things right, we see that there is nothing in physics nor in our everyday experience of the physical that gives us any good reason to hold (2). This leaves us free to embrace the overwhelmingly strong reasons for accepting that (3) consciousness is wholly physical. The correct general response is the same as the response to wave-particle duality: acceptance without expectation of understanding. (shrink)

We analyse a recent paper in which an alleged devastating criticism of the so called GRW proposal to account for the objectification of the properties of macroscopic systems has been presented and we show that the author has not taken into account the precise implications of the GRW theory. This fact makes his conclusions basically wrong. We also perform a survey of measurement theory aimed to focus better on the physical and the conceptual aspects of the so-called macro-objectification problem.

After briefly reviewing the standard set-theoretic resolutions of the Burali-Forti paradox, we examine how the paradox arises in set theory formalized with plural quantifiers. A significant choice emerges between the desirable unrestricted availability of ordinals to represent well-orderings and the sensibility of attempting to refer to ‘absolutely all ordinals’ or ‘absolutely all well-orderings’. This choice is obscured by standard set theories, which rely on type distinctions which are obliterated in the setting with plurals. Zermelo's attempt ( 1930 ) to secure (...) ordinal representability of arbitrary well-orderings through relativization of quantification to set-theoretic models is reviewed and found wanting. The natural modal-structural recasting provides, it is claimed, a good repair. (shrink)

We tend to assume that our map of the intellectual disciplines is valid cross-culturally. G. E. R. Lloyd challenges this in relation to eight main areas of human endeavour, namely philosophy, mathematics, history, medicine, art, law, religion, and science, by examining how the disciplines were conceived and developed in different times and places.

This paper argues that the choice of backing to certify the authority of a warrant requires a legitimation inference. When brought into question, such an inference becomes a claim defended by showing sound reasons for the selection of backing pertinent to a shared context. Legitimation controversies ensue when an attributed consensus meets objection. It is argued that attention to legitimation controversies renders the Toulmin model a more useful critical paradigm for investigating the development and risks of communicative reasoning in a (...) public forum. The nomination of John Tower as Secretary of Defense is employed to illustrate how critical analysis of legitimation controversies reflexively expands the domain of inquiry for informal reasoning. The dictum ‘“ought” implies “can”’ has a status in moral philosophy in some respects like that of ‘a good player needs good co-ordination’ in talk about ball-games. Clearly, you say something important but not conclusive about proficiency in playing a ball-game when you say that it requires good co-ordination: similarly, you say something important but not conclusive about obligation when you say that it implies a certain possibility or power or ability. Each dictum is a reminder: the one about such (...) courses of physical instruction, the other about such exhortations to duty, as are worth persevering with. It would be hopeless to keep on teaching a boy the moves and tricks of rugby football if he could never co-ordinate well enough to get his eye in, so to speak. Correspondingly, it would be meaningless to recommend that someone ought to do something the specification of which involved a contradiction, and pointless to suggest that he ought to do something which, for quite general reasons, was not, and was certain to remain not, within his power. So each dictum expresses a bluff, no-nonsense wisdom which we should count on before involving ourselves in certain more detailed commitments. But probably this is as far as the comparison between the two sayings can well be taken. (shrink)

We explore three questions about Earth system modeling that are of both scientific and philosophical interest: What kind of understanding can be gained via complex Earth system models? How can the limits of understanding be bypassed or managed? How should the task of evaluating Earth system models be conceptualized?

Decompressive craniectomy is a technically straightforward procedure whereby a large section of the cranium is temporarily removed in cases where the intracranial pressure is dangerously high. While its use has been described for a number of conditions, it is increasingly used in the context of severe head injury. As the use of the procedure increases, a significant number of patients may survive a severe head injury who otherwise would have died. Unfortunately some of these patients will be left severely disabled; (...) a condition likened to the RUB, an acronym for the Risk of Unacceptable Badness. Until recently it has been difficult to predict this outcome, however an accurate prediction model has been developed and this has been applied to a large cohort of patients in Western Australia. It is possible to compare the predicted outcome with the observed outcome at 18 months within this cohort. By using predicted and observed outcome data this paper considers the ethical implications in three cases of differing severity of head injury in view of the fact that it is possible to calculate the RUB for each case. Poor medication adherence in patients with a psychosis is associated with relapse. It has been proposed that outcomes might be improved by using financial incentives for treatment adherence (FITA). However, a strong moral intuition against this practice has been found. This paper examines the ethics of FITA. Three arguments are presented, which if accepted would severely restrict or even prohibit the practice. These are based on (1) “incommensurable values”, where FITA denigrates an aspect of “respect for the person”, (2) “exploitation”, (...) where unfair advantage is taken of the patient, and (3) “fairness”, where it is difficult to draw a line between those who should and should not be offered payment. This article explores the relationship between rhetoric and violence by running this pairing through a corresponding couplet: rhetoric and race. Arguing for a common substrate between these two pairs of terms—coloniality—this article proposes that rhetorics of "nonviolence" are better understood as rhetorics of anti-violence.

There is a strong need to connect agricultural research to social movements and community-based food system reform efforts. Participatory research methods are a powerful tool, increasingly used to give voice to communities overlooked by academia or marginalized in the broader food system. Plant breeding, as a field of research and practice, is uniquely well-suited to participatory project designs, since the basic process of observing and selecting plants for desirable traits is accessible to participants without formal plant breeding training. The challenge (...) for plant breeders engaged in participatory research is to consider not only how their work incorporates farmer input in developing new varieties, but also how it interacts with broader questions of food sovereignty, food justice, diversity and democratization in the food system. This article examines these issues in the context of the Seed to Kitchen Collaborative, a participatory variety evaluation and breeding project at the University of Wisconsin-Madison. (shrink)
