In recent years consumer law has come more and more into the focus of legislation within the EU. One of the EU’s key objectives, completing the final stage of the internal market, is to place consumer rights in the centre of it. Following the adaption of various consumer law measures for some decades, the EU has undertaken a thorough review of its consumer acquis. After years of consultations, the Consumer Rights Directive 2011/83/ EU, which was supposed to set new standards (...) of consumer protection, came into force and will have to be implemented by the Member States by 13 December, 2013. Renouncing its principal practice of minimum harmonisation in the area of consumer law, i.e. allowing Member States on the basis of Directives to adopt more protective rules, the EU legislator now turned to a targeted full harmonisation approach by means of the Consumer Rights Directive, aiming at increasing the consumer protection across the EU by bringing together the currently distinct laws for distance selling and off-premises contracts as well as other types of consumer contracts in a single instrument. The article briefly introduces the background of the Directive and discusses the shift in means of harmonisation concepts. Then, it analyses the scope, concepts and content of the Directive, which mainly brings considerable reforms in the areas of information requirements and the right of withdrawal. Taking into account the Directive’s improvements and shortcomings, conclusions are drawn that further harmonisation and a uniform and universally applicable set of European consumer rights are needed. The Full Bayesian Significance Test (FBST) for precise hypotheses is presented, with some applications relevant to reliability theory. The FBST is an alternative to significance tests or, equivalently, to p-ualue.s. In the FBST we compute the evidence of the precise hypothesis. This evidence is the probability of the complement of a credible set "tangent" to the sub-manifold (of the para,rreter space) that defines the null hypothesis. Intelligence studies are confounded by an inability to image the mind, as well as by heterogeneity in intelligence constructs, gender, and age. The ghost (of future, not past) sitting at the table is a molecular one. Biochemistry and molecular biology factors can contribute to or take away from intelligence to a great and not yet fully explored extent.

Stalnaker, 169–199 2006) introduced a combined epistemic-doxastic logic that can formally express a strong concept of belief, a concept of belief as ‘subjective certainty’. In this paper, we provide a topological semantics for belief, in particular, for Stalnaker’s notion of belief defined as ‘epistemic possibility of knowledge’, in terms of the closure of the interior operator on extremally disconnected spaces. This semantics extends the standard topological interpretation of knowledge with a new topological semantics for belief. We prove that the belief (...) logic KD45 is sound and complete with respect to the class of extremally disconnected spaces and we compare our approach to a different topological setting in which belief is interpreted in terms of the derived set operator. We also study belief revision as well as belief dynamics by providing a topological semantics for conditional belief and belief update modalities, respectively. Our setting based on extremally disconnected spaces, however, encounters problems when extended with dynamic updates. We then propose a solution consisting in interpreting belief in a similar way based on hereditarily extremally disconnected spaces, and axiomatize the belief logic of hereditarily extremally disconnected spaces. Finally, we provide a complete axiomatization of the logic of conditional belief and knowledge, as well as a complete axiomatization of the corresponding dynamic logic. (shrink)

Resnik and Pugh recently explored the ethical implications of routinely integrating environmental concerns into clinical decision-making. While we share their concern for the holistic well-being of patients, our response offers a different clinical and bioethical stance on green informed consent and patient autonomy. Contrary to the authors’ lack of data to support their concerns about provider and patient willingness to engage in climate-related conversations, we provide evidence supporting their sustainability engagement and stress the importance of a proactive, anticipatory approach (...) in healthcare to align with evolving societal values. If climate change is perceived as a politicised issue, though it is not inherently so, healthcare providers are professionally trained to address sensitive subjects and have a duty to inform patients about potential health risks. Recognising the environmental crisis as a health crisis underscores the direct connection between environmental hazards and patients’ well-being. Our perspective advocates for integrating individual considerations, societal responsibilities and systemic changes to promote environmentally sustainable healthcare. (shrink)

In spectrum sharing cognitive radio networks, unauthorized users are allowed to use the spectrum of authorized users to improve spectrum utilization. Due to limited spectrum resources, how to formulate a reasonable spectrum allocation scheme is very important. As a mathematical analysis tool, game theory can solve the problem of resource allocation well. In recent years, it has been applied to the research of resource allocation in spectrum sharing networks by some literatures. In a cellular network consisting of multiple cellular users (...) and full-duplex end-to-end communication users D2D, the self-interference caused by full-duplex communication and the interference caused by the D2D users to the cellular users will significantly reduce system throughput. In order to reduce the interference in the network, this paper introduces a power control algorithm based on Stackelberg game, which sets the cellular users and D2D users as the leaders and followers, respectively. The cellular users and the D2D users compete with each other to minimize the cost, and we propose new utility functions. We build an optimization problem under the outage probability constraint and power constraint and the transmission power of the users is obtained by using the Lagrangian dual decomposition method. The simulation results show that the proposed game algorithm improves network performance compared with other existing schemes. (shrink)

In October 2008 the European Commission published its Proposal for a Consumer Rights Directive which puts forward far-reaching changes to the core of consumer contract law: Four current directives are to be replaced by a new, overarching piece of legislation and in doing so full harmonisation for the most part is to take the place of the minimum standard presently in force in the EU. Although a welcome initiative, the extent and possible effects of the Proposal have certainly (...) brought a number of issues to the fore. In January 2009, legal experts from universities, practice and the civil service met to address the points raised by the Proposal and the question of the extent to which it can indeed contribute to the modernisation and harmonisation of European consumer contract law. In this book, Ernest Sosa explains the nature of knowledge through an approach originated by him years ago, known as virtue epistemology. Here he provides the first comprehensive account of his views on epistemic normativity as a form of performance normativity on two levels. On a first level is found the normativity of the apt performance, whose success manifests the performer's competence. On a higher level is found the normativity of the meta-apt performance, which manifests not necessarily first-order skill (...) or competence but rather the reflective good judgment required for proper risk assessment. Sosa develops this bi-level account in multiple ways, by applying it to issues much disputed in recent epistemology: epistemic agency, how knowledge is normatively related to action, the knowledge norm of assertion, and the Meno problem as to how knowledge exceeds merely true belief. A full chapter is devoted to how experience should be understood if it is to figure in the epistemic competence that must be manifest in the truth of any belief apt enough to constitute knowledge. Another takes up the epistemology of testimony from the performance-theoretic perspective. Two other chapters are dedicated to comparisons with ostensibly rival views, such as classical internalist foundationalism, a knowledge-first view, and attributor contextualism. What distinguishes full-on stating a proposition from merely communicating it? For instance, what distinguishes claiming/asserting/saying that one has never smoked crack cocaine from merely implying/conveying/hinting this? The enormous literature on ‘assertion’ provides many approaches to distinguishing stating from, say, asking and commanding: only the former aims at truth; only the former expresses one's belief; etc. But this leaves my question unanswered, since in merely communicating a proposition one also aims at truth, expresses a belief, etc. My aim is not (...) to criticize extant accounts of the state-versus-merely-convey contrast, but rather to draw on clues from Dummett, functional linguistics and moral theory, to offer a novel one. The main idea is that full-on stating is distinctively conventionalized in a way that conversationally implicating, hinting, giving to understand, etc., are not. Specifically, full-on stating is constitutively tied to a particular conventional, linguistic, function-bearing device, the declarative sentence. To full-on state that p is to hit that ‘target speech act’ which owes its existence to that special-purpose device. It is therefore also to make one's action lie-prone. Nonetheless, once that sui generis target is there to be aimed for, a person may reach it without using the special-purpose tool—e.g. one may full-on state using a mere word or phrase, or coded hand signals, or semaphore. I end by considering several philosophical implications of this means of capturing the contrast. (shrink)

The relationship between the physical world and technology is fraught with complications; and yet both physis and techne are necessary to create the environment in which humanity may flourish. Approaching the issue from a philosophical standpoint, this article introduces a series of papers that deal with the interface between philosophy and technology, the critical discussion of the challenges posed by technologies, and their impact or implications.

A system of logic usually comprises a language for which a model-theory and a proof-theory are defined. The model-theory defines the semantic notion of model-theoretic logical consequence (⊨), while the proof-theory defines the proof- theoretic notion of logical consequence (or logical derivability, ⊢). If the system in question is sound and complete, then the two notions of logical consequence are extensionally equivalent. The concept of full formalization is a more restrictive one and requires in addition the preservation of the (...) standard meanings of the logical terms in all the admissible interpretations of the logical calculus, as it is proof-theoretically defined. Although classical first-order logic is sound and complete, its standard formalizations fall short to be full formalizations since they allow non-intended interpretations. This fact poses a challenge for the logical inferentialism program, whose main tenet is that the meanings of the logical terms are uniquely determined by the formal axioms or rules of inference that govern their use in a logical calculus, i.e., logical inferentialism requires a categorical calculus. This paper is the first part of a more elaborated study which will analyze the categoricity problem from its beginning until the most recent approaches. I will first start by describing the problem of a full formalization in the general framework in which Carnap (1934/1937, 1943) formulated it for classical logic. Then, in sections IV and V, I shall discuss the way in which the mathematicians B.A. Bernstein (1932) and E.V. Huntington (1933) have previously formulated and analyzed it in algebraic terms for propositional logic and, finally, I shall discuss some critical reactions Nagel (1943), Hempel (1943), Fitch (1944), and Church (1944) formulated to these approaches. I offer an approach to Dreyer's film Ordet as a contribution to the phenomenology of a certain kind of religious experience. The experience in question is one of a moment that disrupts the chronological flow of time and that, in the lived experience of it, is charged with eternal significance. Most engineers Fwork within social structures governing and governed by a set of values that primarily emphasise economic concerns. The majority of innovations derive from these loci. Given the effects of these innovations on various communities, it is imperative that the values they embody are aligned with those societies. Like other transformative technologies, artificial intelligence systems can be designed by a single organisation but be diffused globally, demonstrating impacts over time. This paper argues that in order to design for this (...) broad stakeholder group, engineers must adopt a systems thinking approach that allows them to understand the sociotechnicity of artificial intelligence systems across sociocultural domains. It claims that value sensitive design, and envisioning cards in particular, provides a solid first step towards helping designers harmonise human values, understood across spatiotemporal boundaries, with economic values, rather than the former coming at the opportunity cost of the latter. In patient care, the judicial doctrines of consent and (...) informed consent are disclosure doctrines based on the obligation of physicians to inform their patients of the following types of information: the nature of the procedure the physician is recommending in the patent’s care (P), the alternatives to the physician‐recommendation (A), and the risks of procedure and its alternatives (R). In addition, the physician must provide truthful answers to the patient’s questions (Q) to the best of the physician’s abilities. In research on humans, the onus of disclosure by study sponsors and principal investigators is much greater than in patient care precisely because the purpose of research is not patient care. The purpose of research is the identification and development of new generalizable knowledge. Thus, participation in a research study or trial may not benefit the study volunteer at all. In addition, the participant may carry a heavy risk burden in relationship to any testing of a newly designed drug or device as part of their experiences in the research study. Presently, despite the risks borne by the research study participant, the raw data collected from volunteers in research trials are treated by courts as if they were the private property of the study sponsor rather than generally owed to the public as would be expected by an effort like research participation aimed at contributing to the development of generalizable knowledge. De‐Identified (Anonymized) Raw Data A current approach to identifying (anonymizinig) raw data is based on the Health Insurance Portability and Accountability Act (HIPAA) of 1996 (P.L.104‐191). HIPAA was enacted by the U.S. Congress in 1996 to keep a person’s medical information private. In a research study, a person’s private medical information can become research data. HIPAA’s Privacy Rule allows a covered entity to de‐identify data by removing all 18 elements that could be used to identify the individual or the individual’s relatives, employers, or household members; these elements are enumerated in the Privacy Rule. The covered entity must also have no actual knowledge that the remaining information could be used alone or in combination with other information to identify the individual who is the subject of the information. Under this method, the identifiers that must be removed are the following: 1 Names. 2 All geographic subdivisions smaller than a state, including street address, city, county, precinct, ZIP Code, and their equivalent geographical codes, except for the initial three digits of a ZIP Code if, according to the current publicly available data from the Bureau of the Census: 2a. The geographic unit formed by combining all ZIP Codes with the same three initial digits contains more than 20,000 people. 2b. Even though ‘raw data’ can be de‐identified (anonymized) so that there is no way to trace back the data to the study participant from which it was drawn, there are still questions whether the ‘de‐identified raw data’ can be given to other researchers or made public without the original study participant’s approval. It may be the case that this approval could be done at the start of any research study where the individual considering study participation would be counseled on what the process of de‐identification consists of and would be asked whether the participant would allow use of the data by other researchers or made available to the public in a de‐identified state. However, there may be questions of the study participants as to whether the data are truly de‐identified and untraceable back to the study participant since the participant would not be able to see the process actually being carried out in detail in all relevant circumstances. Using Raw Data in Context Simply being in possession of raw data is never enough to build on that data from a research perspective. Researchers need to understand the context of the scientific research study in which the data were collected. This research context includes (but is not limited to): (i) the scientific hypothesis of the research study, (ii) the inclusion and exclusion criteria selected by the research designers of the study to determine which study participants were included and which were excluded from the study, (iii) the methods used to collect the data and possibilities of errors in the data collection processes, and (iv) answers to questions regarding whether any data were excluded from the study data and why these data were excluded. Ownership Rights Over Data There are ownership rights over data. Ownership rights include court decision making related to the question which parties are to be considered as the owners of the data. Possible owners here include (but are not limited to) (i) the study sponsor whose only role was to fund that study, (ii) the principal investigator(s) who developed the scientific hypothesis, and (iii) individual study participants through special contracts made by individual participants who negotiate such contracts with study sponsors and principal investigators to share in the ownership of data. Examples of such data are participant sources of unique gene lines or unique cell lines to be used in future research. Objections to Data Sharing Finally, individual researchers may simply object to sharing data. A researcher’s arguments here may be simply stating that he or she has a right to fully analyze the data since the collection of the data was the researchers’ idea in the first place. These researchers may argue that they have the right to mine the data as fully as they can before deciding to make the data open to the public for others to analyze. Talking about ‘suffering’ in relation to ‘old age’ implies reflecting on its semantic fields, its various references and the relationship between the two in a dynamic way. We therefore propose to reflect first of all, in a philosophical way, on ‘suffering’ and its specificity in relation to other terms such as ‘pain’; then we will look at the meaning of ‘old age’ and its semantic field: ‘old age’, ‘third age’, ‘senectitude’; we will continue with the question of the relationship between (...) suffering and elderly people to detect if there is a determination and connection between both realities; to, finally, propose, in continuity with our conclusions, a practical look from the human activity in a humanistic paradigm of Occupational Therapy. Gene clustering is a useful exploratory technique to group together genes with similar expression levels under distinct cell cycle phases or distinct conditions. It helps the biologist to identify potentially meaningful relationships between genes. In this study, we propose a clustering method based on multivariate normal mixture models, where the number of clusters is predicted via sequential hypothesis tests: at each step, the method considers a mixture model of m components (m = 2 in the first step) and tests if (...) in fact it should be m - 1. If the hypothesis is rejected, m is increased and a new test is carried out. The method continues (increasing m) until the hypothesis is accepted. The theoretical core of the method is the full Bayesian significance test, an intuitive Bayesian approach, which needs no model complexity penalization nor positive probabilities for sharp hypotheses. Numerical experiments were based on a cDNA microarray dataset consisting of expression levels of 205 genes belonging to four functional categories, for 10 distinct strains of Saccharomyces cerevisiae. To analyze the method’s sensitivity to data dimension, we performed principal components analysis on the original dataset and predicted the number of classes using 2 to 10 principal components. Compared to Mclust (model-based clustering), our method shows more consistent results. (shrink)

As van Fraassen pointed out in his opening remarks, Henry Kyburg's lottery paradox has long been known to raise difficulties in attempts to represent full belief as a probability greater than or equal to p, where p is some number less than 1. Recently, Patrick Maher has pointed out that to identify full belief with probability equal to 1 presents similar difficulties. In his paper, van Fraassen investigates ways of representing full belief by personal probability which avoid (...) the difficulties raised by Maher's measure-theoretic version of the lottery paradox. Van Fraassen's more subtle representation dissolves the simple identification of full belief with maximal personal probability. Sophie Lewis's Full Surrogacy Now offers both a blistering polemic against work, the family, and capitalism and a grounded scholarly reflection on the current industry practices and future possibilities of surrogacy. Throughout, Lewis offers various formulations of the title's demand:"Full surrogacy now" … is an expression of solidarity with the evolving desires of gestational workers, from the point of view of a struggle against work. This special issue addresses the debate on personal identity from a phenomenological viewpoint, especially contemporary phenomenological research on selfhood. In the introduction, we first offer a brief survey of the various classic questions related to personal identity according to Locke’s initial proposal and sketch out key concepts and distinctions of the debate that came after Locke. We then characterize the types of approach represented by post-Hegelian, German and French philosophies of the nineteenth and twentieth centuries. We argue that whereas (...) the Anglophone debates on personal identity were initially formed by the persistence question and the characterization question, the “Continental” tradition included remarkably intense debates on the individual or the self as being unique or “concrete,” deeply temporal and—as claimed by some philosophers, like Sartre and Foucault—unable to have any identity, if not one externally imposed. We describe the Continental line of thinking about the “self” as a reply and an adjustment to the post-Lockean “personal identity” question. These observations constitute the backdrop for our presentation of phenomenological approaches to personal identity. These approaches run along three lines: debates on the layers of the self, starting from embodiment and the minimal self and running all the way to the full-fledged concept of person; questions of temporal becoming, change and stability, as illustrated, for instance, by aging or transformative life-experiences; and the constitution of identity in the social, institutional, and normative space. The introduction thus establishes a structure for locating and connecting the different contributions in our special issue, which, as an ensemble, represent a strong and differentiated contribution to the debate on personal identity from a phenomenological perspective. The practice of adult learning and education in Hong Kong is lesser known to the wider community of ALE practitioners due to lack of exchanges with international peers. There is a small community of full-time ALE practitioners working mainly in university continuing education schools but a larger body of uncharacterised or alternative practitioners can also be found. Essentially, both types of practitioners are conservative in their outlook and they adopt strategies that align with market needs and priorities set by (...) public funders. Under the backdrop of neoliberalism which has harmonised ALE practice worldwide, a dominant form of individualised learning makes it difficult to promote group learning for societal advancement. ALE practitioners in Hong Kong are no exception to this influence and have been found to profess philosophical orientations favouring the behaviourist/narrowed progressivist notions of learner empowerment for economic and personal gains. Given recent worldwide renewed enthusiasm in making ALE responsive to societal issues, this paper examines the options and learning areas that ALE practitioners in Hong Kong can make their contributions to, such as: health advocacy, climate justice, and media literacy. Through engaging in these aspects of work, practitioners will have to incorporate methods of facilitating group learning in formal and non-formal ALE programmes and courses. An embrace by practitioners of the original notion of progressivist philosophy in adult education may emerge as one of the outcomes to make ALE practice inclusive, relevant and socially responsible. Even with the ongoing COVID-19 health crisis, it is deemed even more pressing to pursue a balanced practice approach that can take care of individual's skills transformation for post-COVID economy as well as developing human bonds that would help to make society progressive as a countercheck to neoliberal-inspired individualistic adult learning. Information and communication technology is changing many aspects ofhuman endeavour and existence. This is beyond dispute for most. Whatare contested are the social and ethical implications of thesechanges. Possible sources of these disputes are the multiple ways inwhich one can conceptualize and interpret the informationtechnology/society interrelationship. Each of these ways ofconceptualization and interpretation enables one to see theinformation technology/society relationship differently and thereforeconstrue its social and ethical implications in a different manner. Atthe center of this technology/society interrelationship we find manycomplex (...) questions about the nature of the human, the technical,agency, autonomy, freedom and much more. This is indeed a vastintellectual landscape, which can obviously not be explored here inits fullness. This entry is about just one particular perspective onthis landscape. It is primarily concerned with the phenomenologicalapproach to interpreting information technology and its social andethical implications. It should be noted from the start that there isnot a unified phenomenological tradition or approach to informationtechnology in particular, or other phenomena more generally. Thephenomenological tradition consists of many different approaches thatshare certain characteristics but not all. We may however suggest, with Don Ihde,that they all accept that “phenomenology investigates theconditions of what makes things appear as such [as that which we takethem to be].” Differently stated, phenomenology suggests thatthere is a co-constitutive relationship between us and the phenomenawe encounter in our engagement with the world. In this sensephenomenologists would suggest that to understand thetechnology/society relationship we need to reveal how theyco-constitute each other—i.e. draw on each other for theirongoing meaning and sense. We will elaborate more precisely what thismeans in section 2 below. However, in order to understand the distinctiveness of thephenomenological approach other possible ways of interpreting thistechnology/society relationship will also be outlined brieflybelow., It can be said that information technology has become in a very realsense ubiquitous. Most everyday technologies such as elevators,automobiles, microwaves, watches, and so forth depend onmicroprocessors for their ongoing operation. Most organizations andinstitutions have become reliant on their information technologyinfrastructure to a lesser or greater degree. Indeed informationtechnology is seen by many as a cost-efficient way to solve amultitude of problems facing our complex contemporary society. One canalmost say that information technology has become construed as thedefault technology for solving a whole raft of technical and socialproblems such as health provision, security, governance, etc. Onecould also argue that it has become synonymous with society’sview of modernization and progress. For most it seems obvious thatinformation technology has made it possible for humans to continue toconstruct increasingly complex systems of coordination and socialordering—systems without which contemporary society would not beable to exist in its present form. To say the least, we, ascontemporary human beings, have our manner of being made possiblethrough a rather comprehensive entanglement with information andcommunication technology. Indeed, the economic, organizational andsocial benefit of information technology is not widely disputed. Thedispute is more often about the way information technology is changingor transforming the social domain, and in particular, the ethicaldomain. This dispute is largely centered around different ways ofconceptualizing and interpreting the nature of our entanglement withinformation technology. This debate is not merely an academic debateabout different and competing theoretical ‘models.’Rather, these different ways of conceptualizing it is central to ourunderstanding of how we go about managing our increasingly entangledrelationship with information technology. Dynamic doxastic logic (DDL) is the modal logic of belief change. In basic DDL a modal operator [* ϕ ] carries the informal meaning "after the agent has revised his beliefs by ϕ " or "after the agent has accepted the information that ϕ "; it is assumed that the arguments of the star operator * are pure Boolean formulae. That assumption is discarded in full DDL where any pure doxastic formula may be an argument. As noted by other (...) authors, a straight-forward extension of the theory from basic DDL to full DDL invites problems of the kind first discussed by G. E. Moore. In this paper it is argued that a way to escape those problems is to redefine revision in a way that seems appropriate for this semantically richer context. As engineers propose constructing humanlike automata, the question arises as to whether such machines merit human rights. The issue warrants serious and rigorous examination, although it has not yet cohered into a conversation. To put it into a sure direction, this paper proposes phrasing it in terms of whether humans are morally obligated to extend to maximally humanlike automata full human rights, or those set forth in common international rights documents. This paper’s approach is to consider the ontology (...) of humans and of automata and whether ontological difference between them, that pertains to the very bases of human rights, affects the latter’s claims to full human rights. Considering common bases of human rights, can these bases tell us whether a certain ontological distinction of humans from automata—or a de facto distinction about humans tacitly acknowledged by full-rights-recognizing societies—makes a difference in whether humans are morally obligated to assign these entities full rights? Human rights to security also arise. The conclusion is that humans need not be under any moral obligation to confer full human rights on automata. The paper’s ultimate point is not to close the discussion with this ontological cap but to set a solid moral and legal groundwork for opening it up tout court. (shrink)

Yet, the legal doctrines of consent and informed consent differ in their applications. In patient care, the judicial doctrines of consent and (...) informed consent are disclosure doctrines based on the obligation of physicians to inform their patients of the following types of information: the nature of the procedure the physician is recommending in the patent’s care (P), the alternatives to the physician‐recommendation (A), and the risks of procedure and its alternatives (R). In addition, the physician must provide truthful answers to the patient’s questions (Q) to the best of the physician’s abilities. In research on humans, the onus of disclosure by study sponsors and principal investigators is much greater than in patient care precisely because the purpose of research is not patient care. The purpose of research is the identification and development of new generalizable knowledge. Thus, participation in a research study or trial may not benefit the study volunteer at all. In addition, the participant may carry a heavy risk burden in relationship to any testing of a newly designed drug or device as part of their experiences in the research study. Presently, despite the risks borne by the research study participant, the raw data collected from volunteers in research trials are treated by courts as if they were the private property of the study sponsor rather than generally owed to the public as would be expected by an effort like research participation aimed at contributing to the development of generalizable knowledge. De‐Identified (Anonymized) Raw Data A current approach to identifying (anonymizinig) raw data is based on the Health Insurance Portability and Accountability Act (HIPAA) of 1996 (P.L.104‐191). HIPAA was enacted by the U.S. Congress in 1996 to keep a person’s medical information private. In a research study, a person’s private medical information can become research data. HIPAA’s Privacy Rule allows a covered entity to de‐identify data by removing all 18 elements that could be used to identify the individual or the individual’s relatives, employers, or household members; these elements are enumerated in the Privacy Rule. The covered entity must also have no actual knowledge that the remaining information could be used alone or in combination with other information to identify the individual who is the subject of the information. Under this method, the identifiers that must be removed are the following: 1 Names. 2 All geographic subdivisions smaller than a state, including street address, city, county, precinct, ZIP Code, and their equivalent geographical codes, except for the initial three digits of a ZIP Code if, according to the current publicly available data from the Bureau of the Census: 2a. The geographic unit formed by combining all ZIP Codes with the same three initial digits contains more than 20,000 people. 2b. Even though ‘raw data’ can be de‐identified (anonymized) so that there is no way to trace back the data to the study participant from which it was drawn, there are still questions whether the ‘de‐identified raw data’ can be given to other researchers or made public without the original study participant’s approval. It may be the case that this approval could be done at the start of any research study where the individual considering study participation would be counseled on what the process of de‐identification consists of and would be asked whether the participant would allow use of the data by other researchers or made available to the public in a de‐identified state. However, there may be questions of the study participants as to whether the data are truly de‐identified and untraceable back to the study participant since the participant would not be able to see the process actually being carried out in detail in all relevant circumstances. Using Raw Data in Context Simply being in possession of raw data is never enough to build on that data from a research perspective. Researchers need to understand the context of the scientific research study in which the data were collected. This research context includes (but is not limited to): (i) the scientific hypothesis of the research study, (ii) the inclusion and exclusion criteria selected by the research designers of the study to determine which study participants were included and which were excluded from the study, (iii) the methods used to collect the data and possibilities of errors in the data collection processes, and (iv) answers to questions regarding whether any data were excluded from the study data and why these data were excluded. Ownership Rights Over Data There are ownership rights over data. Ownership rights include court decision making related to the question which parties are to be considered as the owners of the data. Possible owners here include (but are not limited to) (i) the study sponsor whose only role was to fund that study, (ii) the principal investigator(s) who developed the scientific hypothesis, and (iii) individual study participants through special contracts made by individual participants who negotiate such contracts with study sponsors and principal investigators to share in the ownership of data. Examples of such data are participant sources of unique gene lines or unique cell lines to be used in future research. Objections to Data Sharing Finally, individual researchers may simply object to sharing data. A researcher’s arguments here may be simply stating that he or she has a right to fully analyze the data since the collection of the data was the researchers’ idea in the first place. These researchers may argue that they have the right to mine the data as fully as they can before deciding to make the data open to the public for others to analyze. Reductionism’s approach brings together many of the most interesting questions today in philosophy and in science . It also presents a brief history of how reductionism has developed in Western philosophy and religion, with reference to Indian philosophy on certain issues.

The network approach to psychopathology posits that mental disorders can be conceptualized and studied as causal systems of mutually reinforcing symptoms. This approach, first posited in 2008, has grown substantially over the past decade and is now a full-fledged area of psychiatric research. In this article, we provide an overview and critical analysis of 363 articles produced in the first decade of this research program, with a focus on key theoretical, methodological, and empirical contributions. In addition, we (...) turn our attention to the next decade of the network approach and propose critical avenues for future research in each of these domains. We argue that this program of research will be best served by working toward two overarching aims: (a) the identification of robust empirical phenomena and (b) the development of formal theories that can explain those phenomena. We recommend specific steps forward within this broad framework and argue that these steps are necessary if the network approach is to develop into a progressive program of research capable of producing a cumulative body of knowledge about how specific mental disorders operate as causal systems. Currently, in the United States, there is no legal obligation for medical professionals or civil courts to uphold patients’ Advance Directives (ADs) regarding end-of-life care. The applicability and standing of ADs prepared by Alzheimer’s patients is a persistent issue in bioethics. Those who argue against giving ADs full status take two main approaches: (1) appealing to beneficence on behalf of the Alzheimer’s patient and (2) claiming that there is no longer any personal equivalence between the AD’s creator and the (...) subject of the AD. In this paper, I present profound arguments against both approaches. Firstly, I argue that the principle of beneficence cannot apply in the case of Alzheimer’s patients, and, secondly, that the moral and legal authority of the AD need not depend on strict equivalence of personal identity. I conclude by arguing that valid ADs protect the dignity and autonomy of Alzheimer’s patients and that, therefore, there are moral obligations to uphold ADs which should be reflected in public policy and legislation. I will briefly discuss the history of research-related projects that Mark Burgin and I worked on together. I will then discuss our joint research related to the circle of sense and nonsense. One paper was entitled In a search for deeper meanings: navigating the circle of Sense and Nonsense and in turn articulating logical varieties as knowledge illuminators and the second was entitled In the Circle of Sense and Nonsense, Including A Mathematic Model of Meaning. This research represents a bridge (...) between the media arts and sciences (my artwork) as a means of embodying ideas exploring a particular approach to meaning production and related computation, as well as Burgin’s concepts related to logical varieties and mathematical models of meaning. I will refer to the full papers and links because they present a very robust and full articulation of the concepts discussed here. We investigate several approaches to resolution based automated theoremproving in classical higher-order logic (based on Church's simply typedλ-calculus) and discuss their requirements with respect to Henkincompleteness and full extensionality. In particular we focus on Andrews' higher-order resolution (Andrews 1971), Huet's constrained resolution (Huet1972), higher-order E-resolution, and extensional higher-order resolution(Benzmüller and Kohlhase 1997). With the help of examples we illustratethe parallels and differences of the extensionality treatment of these approachesand demonstrate that extensional higher-order resolution is the sole approach thatcan (...) completely avoid additional extensionality axioms. We prove that the observational equivalence of third-order finitary Idealized Algol is decidable using Game Semantics. By modelling the state explicitly in our games, we show that the denotation of a term M of this fragment of IA is a compactly innocent strategy-with-state, i.e. the strategy is generated by a finite view function fM. Given any such fM, we construct a real-time deterministic pushdown automaton that recognizes the complete plays of the knowing-strategy denotation of M. Since such plays characterize observational (...) equivalence, and there is an algorithm for deciding whether any two DPDAs recognize the same language, we obtain a procedure for deciding the observational equivalence of third-order finitary IA. Restricted to second-order terms, the DPDA representation cuts down to a deterministic finite automaton; thus our approach gives a new proof of Ghica and McCusker’s regular-expression characterization for this fragment. Our algorithmic representation of program meanings, which is compositional, provides a foundation for model-checking a wide range of behavioural properties of IA and other cognate programming languages. Another result concerns second-order IA with full recursion: we show that observational equivalence for this fragment is undecidable. (shrink)

Critics of reliability theories of epistemic justificationoften claim that the `generality problem' is an insurmountabledifficulty for such theories. The generality problem is theproblem of specifying the level of generality at which abelief-forming process is to be described for the purposeof assessing its reliability. This problem is not asintractable as it seems. There are illuminating solutionsto analogous problems in the ethics literature. Reliabilistsought to attend to utilitarian approaches to choices betweeninfinite utility streams; they also ought to attend towelfarist approaches to social (...) choice situations that donot demand full aggregation of individual welfares.These analogies suggest that the traditional `single number'approach to reliability is misguided. A new theoretical approach to language has emerged in the past 10–15 years that allows linguistic observations about form–meaning pairings, known as ‘construc- tions’, to be stated directly. Constructionist approaches aim to account for the full range of facts about language, without assuming that a particular subset of the data is part of a privileged ‘core’. This study focuses on examining the thematic landscape of the history of scholarly publication in business ethics. We analyze the titles, abstracts, full texts, and citation information of all research papers published in the field’s leading journal, the Journal of Business Ethics, from its inaugural issue in February 1982 until December 2016—a dataset that comprises 6308 articles and 42 million words. Our key method is a computational algorithm known as probabilistic topic modeling, which we use to examine objectively the (...) field’s latent thematic landscape based on the vast volume of scholarly texts. This “big-data” approach allows us not only to provide time-specific snapshots of various research topics, but also to track the dynamic evolution of each topic over time. We further examine the pattern of individual papers’ topic diversity and the influence of individual papers’ topic diversity on their impact over time. We conclude this study with our recommendation for future studies in business ethics research. (shrink)

What is the best strategy to construct an information society that is ethically sound? This is the question I discuss in this paper. The task is to formulate aninformation ethics that can treat the world of data, information, knowledge and communication as a new environment, the infosphere. This information ethics must be able to address and solve the (...) ethical challenges arising in the new environment on the basis of the fundamental principles of respect for information, its conservation and valorisation. Dummett’s The Logical Foundations of Metaphysics (LFM) outlines an ambitious project that has been at the core of his work during the last forty years. The project is built around a particular conception of the theory of meaning (or philosophy of language), according to which such a theory should constitute the corner stone of philosophy and, in particular, provide answers to various metaphysical questions. The present paper is intended as a critical evaluation of some of the main features of that (...) approach. My negative answer to the title’s question notwithstanding, I find Dummett’s analyses, which both inform and are guided by his project, of very high value. Among the subjects to be discussed here, which relate to but are not fully reflected in the title, are the concept of a full-blooded theory (in 4.) Davidson’s program (in 5.) and holism, to which the last third of this paper (section 6.) is devoted. The object of this paper is to make a study of four systems of modal logic (S4, S5, and their intuitionistic analogues IM4 and IM5) with the techniques of the theory of abstract logics set up by Suszko, Bloom, Brown, Verdú and others. The abstract concepts corresponding to such systems are defined as generalizations of the logics naturally associated to their algebraic models (topological Boolean or Heyting algebras, general or semisimple). By considering new suitably defined connectives and by distinguishing between (...) having the rule of necessitation only for theorems or as a full inference rule (which amounts to dealing with all filters or with open filters of the algebras) we are able to reduce the study of a modal (abstract) logic L to that of two nonmodal logics L - and L + associated with L. We find that L is "of IM4 type" if and only if L - and L + are both intuitionistic and have the same theorems, and logics of type S4, IM5 or S5 are obtained from those of type IM4 simply by making classical L -, L + or both. We compare this situation with that found in recent approaches to intuitionistic modal logic using birelational models or using higher-level sequent-systems. The treatment of modal systems with abstract logics is rather new, and in our way to it we find several general constructions and results which can also be applied to other modal systems weaker than those we study in detail. The field of of imprecise probability has matured, in no small part because of Teddy Seidenfeld’s decades of original scholarship and essential contributions to building and sustaining the ISIPTA community. Although the basic idea behind imprecise probability is (at least) 150 years old, a mature mathematical theory has only taken full form in the last 30 years. Interest in imprecise probability during this period has also grown, but many of the ideas that the mature theory serves can be difficult (...) to apprehend to those new to the subject. Although these fundamental ideas are common knowledge in the ISIPTA community, they are expressed, when they are expressed at all, obliquely, over the course of years with students and colleagues. -/- A single essay cannot convey the store of common knowledge from any research community, let alone the ISIPTA community. But, this essay nevertheless is an attempt to guide those familiar with the basic Bayesian framework to appreciate some of the elegant and powerful ideas that underpin the contemporary theory of lower previsions, which is the theory that most people associate with the term ‘imprecise probabilities’. The biblical creation of woman in which she was taken from man’s rib is one of the passages that are misinterpreted to solidify the subjection and oppression of women with the two Cameroonian Churches, Presbyterian and Full Gospel Mission (FGM). This implies that the complementarity that existed in pre-colonial leadership was eroded as a result. This article will use the qualitative approach to unmask and analyse the practices of gender inequality within the Presbyterian and FGM of Cameroon and (...) the challenges that they are facing with gender equality issues between males and females. The sampling of 22 participants was used to formulate how the findings that will target to unveil the coordination, managerial and financial positions within these two churches are elected or chosen. The stereotypes that are involved in the elections of people who must hold these offices will be explained, discussed and analysed and even exposed in order to seek ways to avoid the manipulations of biblical texts in justifying the exclusion of females from leading church leading positions. This article argues that the misuse of misinterpretation or misrepresentation of scriptures cannot be condoned to justify the marginalisation of women from leadership within the Presbyterian Church in Cameroon (PCC) and the FGM. As much as women are working hard for the church, they should also be allowed to continue growing the church even from the managerial or leadership positions. Contribution: To work towards gender imbalances in the African context are not only unmasked and exposed, but some meaningful suggestions are made as to how this inhuman practice can be eliminated or even destroyed completely, with a case example of the two churches mentioned, the PCC and FGM in Cameroon. Many Sides is the first full-length study of Protagorean antilogic, an argumentative practice with deep roots in rhetorical history and renewed relevance for contemporary culture. Founded on the philosophical relativism of Protagoras, antilogic is a dynamic rather than a formal approach to argument, focused principally on the dialogical interaction of opposing positions (anti-logoi) in controversy. In ancient Athens, antilogic was the cardinal feature of Sophistic rhetoric. In Rome, Cicero redefined Sophistic argument in a concrete set of dialogical procedures. (...) In turn, Quintilian inherited this dialogical tradition and made it the centrepiece of his own rhetorical practice and pedagogy. Many Sides explores the history, theory, and pedagogy of this neglected rhetorical tradition and, by appeal to recent rhetorical and philosophical theory, reconceives the enduring features of antilogical practice in a dialogical approach to argumentation especially suited to the pluralism of our own age and the diversity of modern classrooms. In The Idea of Justice , Amartya Sen argues for an approach to justice that is comparative and realization-based rather than transcendental and institutional. While Sen’s arguments for such an approach may not be as convincing as he thought, there are additional arguments for it, and one is that it provides a unique and valuable platform on which an account of justice as a virtue of social and political actors (including institutions and social movements) can be built. Hence (...) new dimensions of comparison are opened up: some actors are better disposed and more successful than others at leading social change in the direction of greater justice. The main objective of this article is to use the capability approach to construct such an account. Six dimensions of acting justly are identified: (1) reducing capability shortfalls; (2) expanding capabilities for all; (3) saving the worst-off as a first step towards their full participation in economy and society, (4) which is also to be promoted by a system of entitlements protecting all from social exclusion; while (5) supporting the empowerment of those whose capabilities are to expand; and (6) respecting ethical values and legitimate procedures. This paper contains a joint study of two sentential logics that combine a many-valued character, namely tetravalence, with a modal character; one of them is normal and the other one quasinormal. The method is to study their algebraic counterparts and their abstract models with the tools of Abstract Algebraic Logic, and particularly with those of Brown and Suszko's theory of abstract logics as recently developed by Font and Jansana in their "A General Algebraic Semantics for Sentential Logics". Nonetheless, I still find Lacroix' thoroughgoing teleological interpretation of Kant a bit bothersome, at points strained, although there is little doubt that teleology plays a large part in Kant's thought with respect to the realm of reason. Moreover, I'm not convinced that Kant's thought is as unified and internally (...) consistent as Lacroix would like to find it. In all fairness, however, it should be mentioned that he does not ignore the inconsistencies in Kant's thought. Lacroix' Kant interpretation certainly warrants serious consideration, for it has at least two outstanding features: It makes Kant's doctrine of the noumenal realm much more palatable than most other interpretations. Secondly, it goes a long way toward drawing out the full significance of Kant's comment, "I have therefore found it necessary to deny knowLedr in order to make room for jaith." And it is only by bringing out the significance of this statement that Kant's work can be shown to be primarily metaphysical in intention. Finally, the work's greatest virtue may be that it pulls the shroud of formalism off Kant's thought and shows it to possess a dynamic concern for living man, a concern that few, if any, have seen in it before. Incidentally, Lacroix' book is full of observations on the reception and interpretation of Kant's thought by various twentieth-century French philosophers, and these offer some nice insights into the different directions French thought is taking today. Wordsworth's poems have brought tears to many a rational mind, but Melvin Rsder manages to keep sane and sober while he expounds the poet's ideas in plain prose and interprets critically the wealth of feeling, imagination, metaphor and myth in which the ideas are clothed. This rendering of Wordsworth's mind is eloquent in its own way, sad performs a useful service to readers who are apt to miss the train of thought within the flow of poetry and of communion with the landscapes of the English Lakes. The analysis shows how, after an early enthusiasm for Locke's and Hartley's "chemistry" of experience, the poet expresses philosophically dimensions of human nature and experience that had been neglected by the more clinical models of "association~sm." Wordsworth's own statement reveals this aspect of his thinking: "Imagination...is that chemical faculty by which elements of the most different nature and distant origin are blended together into one harmonious and homogeneous whole" (p. 139). Here the words "different" and "d'tstant," as Racier points out, exclude the types of association by resemblance and contiguity that are basic to Locke and Hartley. The hberation of Coleridge, and the imaginative transcendence of Wordsworth from these limitations of rationalistic empiricism is a major theme of Rader's work. However, Ruder shows that much of Wordsworth's naturalism is traceable to Hartley's influence. Cudworth's "dynamic idealism" which pictured nature as alive and insisted on the power of ideas, was another major source. Shaftesbury's analysis of the emotional aspects of human nature which his tutor, John Locke, excluded from his Essay because they are not in "the understanding" was also an inspiration to Wordsworth. The definite conversion to transcendentalism was completed by the Kantian romanticists, who suggested to Coleridge that the categorical imperative could be transformed into an a pr/or/gospel. The subsequent divergence of Coleridge and Wordsworth is described in detail by Ruder, and reveals the fact that naturalism retained a stronger hold on Wordsworth than it did on Coleridge. Wordsworth did not follow Coleridge into his romantic spiritual nationalism, but developed a nature-mysticism and "animism" (to use Rader's term). Though this mysticism is not an articulate philosophy, Rader follows it with sympathy and under- BOOK REVIEWS 187 standing. ABSTRACTIn this paper, I discuss my personal experience of the issues that can arise when adopting critical realism in academic contexts dominated by irrealist methodological approaches. I draw inspiration for my analysis from the concept of Gramscian hegemony and the concept of ‘authenticity’. These concepts are related because hegemonic processes prevent individuals from freely expressing themselves. In my case, academic hegemony has resulted in social pressure to sacrifice my authentic critical realist self in order to achieve academic success. I also (...) discuss groupthink dynamics, suggesting that they are a mechanism by which hegemony – and denial of individual authenticity – can be achieved.
