Recent work on conditional reasoning argues that denying the antecedent [DA] and affirming the consequent [AC] are defeasible but cogent patterns of argument, either because they are effective, rational, albeit heuristic applications of Bayesian probability, or because they are licensed by the principle of total evidence. Frank Ramsey was the greatest of the remarkable generation of Cambridge philosophers and logicians which included G. E. Moore, Bertrand Russell, Ludwig Wittgenstein and Maynard Keynes. Before his tragically early death in 1930 at the age of twenty-six, he had done seminal work in mathematics and economics as well as in logic and philosophy. This volume, with a new and extensive introduction by D. H. Mellor, contains all Ramsey's previously published writings on philosophy and the foundations of mathematics. This paper analyzes and evaluates the 2007 majority opinion of the German National Ethics Council which seeks to establish new information (as to the inferior quality of legally procurable human embryonic stem cells) as a sufficient reason for a relaxation of the 2002 Stem Cell Law. A micro-level analysis of the opinion’s central section is conducted and evaluated vis à vis the strongest known opponent position in the national debate at that time. In this article, I consider an important challenge to the popular theory of scientific inference commonly known as ‘inference to the best explanation’, one that has received scant attention.1 1 The problem is that there exists a wide array of rival models of explanation, thus leaving IBE objectionably indeterminate. First, I briefly introduce IBE. Then, I motivate the problem and offer three potential solutions, the most plausible of which is to adopt a kind of pluralism about the rival models of (...) explanation. However, I argue that how ranking explanations on this pluralistic account of IBE remains obscure and pluralism leads to contradictory results. In light of these objections, I attempt to dissolve the problem by showing why IBE does not require a ‘model’ of explanation and by giving an account of what explanation consists in within the context of IBE. In this paper, I examine Cicero’s oft-neglected De Divinatione, a dialogue investigating the legitimacy of the practice of divination. First, I offer a novel analysis of the main arguments for divination given by Quintus, highlighting the fact that he employs two logically distinct argument forms. Next, I turn to the first of the main arguments against divination given by Marcus. Here I show, with the help of modern probabilistic tools, that Marcus’ skeptical response is far from the decisive, proto-naturalistic assault (...) on superstition that it is sometimes portrayed to be. Then, I offer an extended analysis of the second of the main arguments against divination given by Marcus. Inspired by Marcus’ second main argument, I formulate, explicate, and defend a substantive principle of scientific methodology that I call the “Ciceronian Causal-Nomological Requirement” (CCR). Roughly, this principle states that causal knowledge is essential for relying on correlations in predictive inference. Although I go on to argue that Marcus’ application of the CCR in his debate with Quintus is dialectically inadequate, I conclude that De Divinatione deserves its place in Cicero’s philosophical corpus, and that ultimately, its significance for the history and philosophy of science ought to be recognized. I present a “reduced” version of the fifteen Pragma-dialectical rules and inquire into their theoretical status as necessary conditions for a critical discussion. Questions: In what respect is PD’s non-sufficiency a deficiency, can and must it be remedied? Brief answers: with respect to defining the concept ‘critical discussion,’ possibly, yes, if, and only if, one seeks to identify the concept ‘critical discussion’; no, if PD is for fallacy-detection.

In light of recent empirical data, many psychologists and philosophers have turned away from rationalism about moral judgment and embraced sentimentalism. In the process, they have rejected the classical “moral signature” as a way of distinguishing moral from conventional norms in favor of a sentimentalist approach to carving out the moral domain. In this paper, we argue that this sentimentalist turn has been made prematurely. Although we agree that the experiments reveal that the classical approach is flawed, we propose to (...) replace it with an alternative, according to which a norm is moral precisely if it is justifiable to all. This does not hold for most norms based on disgust or loyalty to a particular community. We accommodate the fact that such norms are not merely conventional by introducing a third domain, the domain of ethics. Our proposal reveals that (psychological) rationalism is still a viable option, as a lot of the experimental evidence that features emotions concerns the domain of ethics rather than morality. The frame model, originating in artificial intelligence and cognitive psychology, has recently been applied to change-phenomena traditionally studied within history and philosophy of science. Its application purpose is to account for episodes of conceptual dynamics in the empirical sciences suggestive of incommensurability as evidenced by “ruptures” in the symbolic forms of historically successive empirical theories with similar classes of applications. This article reviews the frame model and traces its development from the feature list model. Drawing on extant literature, examples of (...) frame-reconstructed taxonomic change are presented. This occurs for purposes of comparison with an alternative tool, conceptual spaces. The main claim is that conceptual spaces save the merits of the frame model and provide a powerful model for conceptual change in scientific knowledge, since distinctions arising in measurement theory are native to the model. It is suggested how incommensurability as incomparability of theoretical frameworks might be avoided. Moreover, as nontranslatability of worldviews, it need not to be treated as a genuine problem of conceptual representation. The status of laws vis à vis their dimensional bases as well as diachronic similarity measures are discussed. (shrink)

Time travel has been a staple of science fiction. With the advent of general relativity it has been entertained by serious physicists. But, especially in the philosophy literature, there have been arguments that time travel is inherently paradoxical. The most famous paradox is the grandfather paradox: you travel back in time and kill your grandfather, thereby preventing your own existence. To avoid inconsistency some circumstance will have to occur which makes you fail in this attempt to kill your grandfather. Doesn't (...) this require some implausible constraint on otherwise unrelated circumstances? We examine such worries in the context of modern physics. (shrink)

Gerhard Schurz [2001, Journal for General Philosophy of Science, 32, 65-107] has proposed to reconstruct auxiliary hypothesis addition, e.g., postulation of Neptune to immunize Newtonian mechanics, with concepts from non-monotonous inference to avoid the retention of false predictions that are among the consequence-set of the deductive model. However, the non-monotonous reconstruction retains the observational premise that is indeed rejected in the deductive model. Hence, his proposal fails to do justice to Lakatos' core-belt model, therefore fails to meet what Schurz coined (...) "Lakatos' challenge". It is argued that Lakatos's distinction between core and belt of a research program is not mapable onto premise-set and consequence-set and that Schurz's understanding of a ceteris paribus clause as a transfinite list of interfering factors is problematic. I propose a simple reading of Lakatos's use of the term ceteris paribus clause and motivate why the term hypothesis addition, despite not being interpretable literally, came to be entrenched. A proposal by Ferguson [2003, Argumentation 17, 335–346] for a fully monotonic argument form allowing for the expression of defeasible generalizations is critically examined and rejected as a general solution. It is argued that (i) his proposal reaches less than the default-logician’s solution allows, e.g., the monotonously derived conclusion is one-sided and itself not defeasible. (ii) when applied to a suitable example, his proposal derives the wrong conclusion. Unsuccessful remedies are discussed.

This paper discusses an example of social policy argumentation from an opinion of the 2007 majority among the German National Ethics Council. It is employed to problematize argument reconstruction with respect to the Informal Logic quality criteria relevance, sufficiency, acceptability. The main thesis is conditional and rather weak: If the RSA criteria are sub-stitutes for the notion of soundness, then—next to premise-truth and validity—they also substitute recon-structive charity.

The ‘Principal Principle’ states, roughly, that one's subjective probability for a proposition should conform to one's beliefs about that proposition's objective chance of coming true. David Lewis has argued (i) that this principle provides the defining role for chance; (ii) that it conflicts with his reductionist thesis of Humean supervenience, and so must be replaced by an amended version that avoids the conflict; hence (iii) that nothing perfectly deserves the name ‘chance’, although something can come close enough by playing the (...) role picked out by the amended principle. We show that in fact there must be ‘chances’ that perfectly play what Lewis takes to be the defining role. But this is not the happy conclusion it might seem, since these ‘chances’ behave too strangely to deserve the name. Richard Feynman has claimed that anti-particles are nothing but particles `propagating backwards in time'; that time reversing a particle state always turns it into the corresponding anti-particle state. According to standard quantum field theory textbooks this is not so: time reversal does not turn particles into anti-particles. Feynman's view is interesting because, in particular, it suggests a nonstandard, and possibly illuminating, interpretation of the CPT theorem. In this paper, we explore a classical analog of Feynman's view, in the context of (...) the recent debate between David Albert and David Malament over time reversal in classical electromagnetism. For the past seventy years, a host of scientific and public health bodies in the United States have strongly endorsed the practice of adding fluoride compounds to public water supplies as a prophylactic against dental caries. Throughout that period, a constant undercurrent of skepticism and outright opposition has slowed the adoption of the practice in the United States and limited its spread to just a handful of countries around the world. One of the attractions of water fluoridation is its affordability: (...) the fluoride compounds are sourced from the phosphate and aluminum industries, for whom they would otherwise constitute an annoying toxic waste disposal problem. Despite this, proponents have nonetheless succeeded in shaping a narrative that casts fluoridation as “natural” or at least mimicking nature. I demonstrate how fluoridationists were able to persuasively argue that adding a pollutant to the water supply was safe and natural. In the process, I examine how environmental historians and historians of science approach topics such as fluoridation. I suggest that as a result of the influence of science and technology studies and an ontological turn toward hybridity, the two subdisciplines are becoming increasingly convergent. (shrink)

This work contrasts conservative or minimally mutilating revisions of empirical theories as they are identified in the presently dominant AGM model of formal belief revision and the structuralist program for the reconstruction of empirical theories. The aim is to make understandable why both approaches only partly succeed in substantially informing and formally restraining the issue. With respect to the rationality of minimal change, the overall result is negative. Readers with an interest in formal epistemology are provided with application cases, the (...) historically inclined reader is offered a systematic perspective. With the advent of synthetic biology, scientists are increasingly relying on digital sequence information, instead of physical genetic resources. This article examines the potential impact of this shift on the access and benefit-sharing (ABS) regime of the Convention on Biological Diversity (CBD) and the Nagoya Protocol. These treaties require benefit-sharing with the owners of genetic resources. However, whether “genetic resources” include digital sequence information is unsettled. The CBD conceives genetic resources as genetic material containing functional units of heredity. “Material” implies (...) tangibility, and for some scholars, “functional units of heredity,” undefined in both treaties, mean full-coding sequences. This article argues that digital sequence information obtained from physical genetic resources, full-coding or not, should be treated as genetic resources. Literal construction of the CBD risks eroding its usefulness and the ABS regime. This is because through bioinformatics, sequence information can easily be obtained from genetic resources for utilization, without physically moving them or concluding ABS agreement with owners. The CBD must evolve with scientific progress also because sequence functionality depends on the state of knowledge. These arguments are vindicated by domestic ABS laws equating genetic information with genetic resources; Nagoya Protocol provisions deeming research exploiting the genetic composition of genetic resources as utilization of genetic resources; and CBD provisions requiring the sharing of benefits from the utilization of genetic resources. Moreover, treaty interpretation and case law demand that generic, scientific terms, such as “genetic resources” and “functional units of heredity” be interpreted in an evolutionary manner to capture scientific developments. Like many governments in this COVID-19 pandemic, the Nigerian government imposed a lockdown on the country. As a consequence of the lockdown, many businesses shutdown and effectively had no source of revenue. Yet, without receiving any bailout or palliatives from the government, these businesses are required to meet their tax obligations to the government. Bearing in mind that this time (COVID-19 era) is different, one wonders what is required of businesses in view of the taxation problem and the social contract (...) between the businesspersons and the government. In view of social contract obligations, in this COVID-19 pandemic should businesses pay tax to a government that seems to have delegitimised itself by its exploitative actions in terms of taxation and delinquent omission in terms of the provision of public goods and social services? The Nigerian government at all tiers (federal, state and local) seldom respect the essence of taxation. Therefore, businesses often pay tax for nothing. For many businesses, as far as taxation is concerned, to pay or not to pay? that is the question. This article is aimed at teasing out this taxation problem that may or may not be a moral dilemma. In view of certain ethical considerations, this article shows why in spite of social contract obligations, there is no consensus or canonical agreement on whether, as law-abiding citizens and juridical persons (legal entities), businesspersons and businesses ought to or ought not to pay tax to the Nigerian government in this COVID-19 pandemic.
