In this article I contextualise Álvar Núñez Cabeza de Vaca’s Shipwrecks within the framework of the moral and political debates that were prevalent in Spain in the late 1530s, when the explorer redacted his chronicle. Cabeza de Vaca’s ideas are not just a product of his extraordinary American experience. Shipwrecks also reflects official ethical policies of the Spanish Empire with which he was familiar. These were being shaped by authors such as Francisco de Vitoria, whose Relectio prior de Indis (...) recenter inventis planted the early seeds of international law. (shrink)

The ultimate source of explanation in biology is the principle of natural selection. Natural selection means differential reproduction of genes and gene combinations. It is a mechanistic process which accounts for the existence in living organisms of end-directed structures and processes. It is argued that teleological explanations in biology are not only acceptable but indeed indispensable. There are at least three categories of biological phenomena where teleological explanations are appropriate.

In this paper we claim that Rawls’s theory is compatible with the absence of rectification of extremely important historical injustices within a given society. We hold that adding a new principle to justice-as-fairness may amend this problem. There are four possible objections to our claim: First, that historical rectification is not required by justice. Second, that, even when historical rectification is a matter of justice, it is not a matter of distributive justice, so that Rawls’s theory is justified in leaving (...) it unaddressed. Third, that dealing with historical injustice is outside of the scope of ideal theory, so that even when historical rectification is required by justice, Rawls’s theory starts with the assumption that no such historical injustice has occurred. Fourth, that while historical injustice is within the scope of Rawls’s theory, there is no need for further principles of justice to deal with it, so that the correct regulation of the principles of justice-as-fairness would ensure the rectification of all relevant historical injustices of a particular society. While we offer several arguments against the first and second objections, we address the last two at length and show that both fail. (shrink)

We defend the moral and legal right to secede in accordance with plebiscitary theory. Our paper has three main goals. First, by offering a schematic characterization of plebiscitary theory, the main arguments in its favour (and the main objections to them), we contribute to clarify the structure of this complex debate. Second, we stress the point that, if the moral right to secede is established, the resistance for its inclusion into positive law is unjustified. Finally, by addressing old and new (...) objections to plebiscitary theory, we hope to make a compelling case for a wider recognition of secessionist rights. (shrink)

It is an intimate experience for us to think, to understand and to perceive things as being identical to themselves, and to suppose, consequently, that things are truly “what” they are. Something is always conceived as itself. The given is given full of itself in all its modifications. For instance, I can think or perceive partially some lips, I can see them almost in their whole or in some of their aspects, or just see them disappear. But it does not (...) seem to be possible to think or to perceive a given as almost itself, as an aspect or as part of itself. It is the aim of this work to study the assumptions and conditions for the original position of sameness in experience, just as it occurs in the synthesis of the datum singular and distinct. The polarization of single tone (einstimmig) intentional rays in an αvτó already contains the aporiae peculiar to the experience of the identical, whose revelation shall lead us, on the one hand, to one of the nuclei of the analysis of passive synthesis, and, on the other hand, to point up how critical revision of the numerical or extensional model of self-identity is for the unity of meaning. Then, it will be a question of pointing out the reasons why in a phenomenology of identity, the renunciation of the phenomenological legitimacy of the αvτó as a guarantee for the different positions of identity must be observed. A dominant trend in the philosophical literature on abortion has been concerned with the question of whether the fetus has moral status and how such a status might or might not conflict with women's liberties. However, a new and powerful trend against abortion requires philosophical examination. We refer to this trend as the paternalistic argument. In a nutshell, this argument holds that, insofar as motherhood is a constitutive end of women's well-being, abortion harms women; thus, abortion is wrong and should (...) be prohibited, restricted, or avoided when possible regardless of the moral status of the fetus. In this article we undertake three tasks. First, we analyze four variations of this reasoning: what we call the Kantian PA, the Aristotelian PA, the Catholic Church PA, and the Psychological PA. Second, we show how some public policies that regulate or prohibit abortion around the world are now in fact following paternalistic justifications and imposing distinctive paternalistic restrictions ; we refer to these policies as “the new abortion laws.” Finally, we argue that both the four paternalistic arguments presented and the new abortion laws are at times ill-intentioned, comprehensive in nature and thus unsuited for guiding public policy, empirically flawed, or else unjustified. The study of conscious experience per se has not kept pace with the dramatic advances in PET, fMRI and other brain-scanning technologies. If anything, the standard approaches to examining the 'view from within' involve little more than cataloguing its readily accessible components. Thus the study of lived subjective experience is still at the level of Aristotelian science, leading to a widespread scepticism over the possibility of a truly scientific study of conscious experience. Drawing on a wide range of approaches -- (...) from phenomenology to meditation -- The View From Within examines the possibility of a disciplined approach to the study of subjective states. That is, morally evolved as an exaptation, not as an adaptation. Since Darwin’s time there have been evolutionists proposing that the norms of morality are derived from biological evolution. Sociobiologists represent the most recent and most subtle version of that proposal. The sociobiologists' argument is that human ethical norms are sociocultural correlates of behaviors fostered by biological evolution. I argue that such proposals are misguided and do not escape the naturalistic fallacy. The isomorphism between the behaviors promoted by natural selection and those sanctioned by moral norms exist only with respect to the consequences of the behaviors; the underlying causations are completely disparate. José Otero Espasandín (1900-1987) was an important science popularizer in Argentina during the 1940´s, who belonged to the Misiones Pedagógicas (Educational Missions) group in Spain. This paper presents his biography and his work as a science and technology popularizer. It focused on his features, value and significance for that period.

Medical stem cell research is currently the cause of much moral controversy. Those who would confer the same moral status to embryos as we do to humans consider that harvesting such embryonic cells entails sacrificing embryos. In this paper, the author analyses critically the arguments given for such a perspective. Finally, a theory of moral status is outlined that coherently and plausibly supports the use of embryonic stem cells in therapeutic research.

Sobre el libro: El presente libro recoge las ponencias presentadas en la reunión anual del Seminario Spinoza que tuvo lugar en la Facultad de Filosofía de la UNED los días 13 y 14 de marzo de 2009, así como la presentación del cuadro de Espinosa pintado por Sorolla procedente de la Donación Simarro y perteneciente al fondo artístico de la Universidad Complutense, que tuvo lugar en El Escorial en el verano de 2008. Los trabajos se articulan en cuatro apartados: la (...) política, la ciencia, la proyección de Espinosa en la Ilustración y la iconografía de Espinosa, y sitúan a Espinosa en su siglo, destacando su carácter anómalo en relación con el resto de autores de su entorno. Espinosa no se adaptó a la crisis, sino que se esforzó por comprenderla sin ceder en sus ideales, lo que permitió que las ilusiones renacentistas se desarrollaran en la ilustración, superando el hiato de la crisis barroca. Œuvre de maturité de François Suarez (1548-1617), Des lois et du Dieu législateur a été publié en latin en 1612. Parmi les dix livres que comprend cet ouvrage, nous avons choisi de présenter pour la première fois les deux premiers en langue française. À partir de l'héritage retravaillé de la philosophie politique antique et médiévale, Suarez élabore une théorie originale de la loi et de la communauté en renouvelant leur rapport à l'éthique et à la jurisprudence. Dans une période marquée (...) notamment par la controverse de Valladolid (1550) et la Contre-Réforme, l'auteur redéfinit le contenu et la finalité des concepts fondamentaux de la théorie politique (l'état de nature, le droit naturel, le droit subjectif, la loi naturelle, le pacte social, la souveraineté, l'État et le droit des gens) en les articulant à une compréhension historique de l'homme conçu comme être libre, raisonnable et fini. Suarez instaure ainsi les conditions d'un basculement du théologico-politique dans la modernité dont les effets se feront sentir, entre autres, chez Grotius et l'École du droit naturel. Les conséquences de ce mouvement seront perceptibles jusqu'au XVIIIe siècle avec Wolf. Des lois et du Dieu législateur permet précisément d'apprécier à sa juste mesure la place privilégiée qu'il convient de redonner à la théorie suarézienne de la loi dans l'histoire de la pensée politique. Este artículo se construye en el marco del proyecto de investigación Democracia, igualdad y desacuerdo: conceptos teóricos-metodológicos de Jacques Rancière para pensar la educación en el mundo contemporáneo. El objetivo del proyecto fue la exploración de conceptos como democracia, igualdad y desacuerdo para pensar los sujetos y las realidades educativas desde las lógicas políticas contemporáneas. Como desdoblamiento de la investigación, este artículo explora algunas premisas de Jacques Rancière que permiten pensar las potencialidades políticas de la infancia a partir del reconocimiento (...) de la palabra y del tiempo infantil como formas de experiencia comunitaria. La perspectiva metodológica asume una escritura que elimina las distancias entre los discursos de los filósofos y las voces de las niñas y los niños para afirmar la potencia que tienen sus palabras al momento de pensar un problema filosófico. En este ejercicio de escritura y lectura no jerárquicas se puede apreciar que las palabras de la infancia no son el reflejo, la expresión ni el símbolo de una realidad teórica más elevada, sino que funcionan como condición de posibilidad para que el pensamiento no se detenga. Precisamente, no se busca escribir sobre la infancia, sino con la infancia. No se intenta hallar la verdad de la infancia, sino aprovechar la potencia de sus voces para acorralar al sentido común. De tal forma, se establece la relación entre conflicto político, estatuto de la palabra, infancia e igualdad, lo cual indica la capacidad de la infancia para renovar el sentido de los conceptos sobre los que se fundamenta la sociedad. Por último, se expone que la infancia es una forma de subjetividad que experimenta la temporalidad a partir de la afirmación de intensidades signadas por la curiosidad y la creatividad. Por esto, se constituye como una forma de experiencia política que es capaz de inventar temporalidades múltiples que subvierten el orden de la dominación. (shrink)

En la ética y la filosofía política contemporáneas es común apelar a alguna for-ma de consenso hipotético para justificar contenidos normativos. En el presente artículo llamo a esta posición “contractualismo” y defiendo tres tesis al respecto. Primera, es correcta la objeción común al contractualismo de que la estipulación de un consenso hipotético en una situación ideal de deliberación no añade nada a la justificación del contenido normativo en cuestión. Segunda, esta objeción da pie a lo que llamo “el dilema contractualista”: (...) cuando hay una situación de des-acuerdo entre dos agentes sobre si un contenido normativo x es correcto, apelar a un acuerdo hipotético en condiciones ideales de deliberación como medio para justificar x, equivale a caer en petición de principio o a establecer una trivialidad. Tercera, a la luz del “dilema contractualista”, el contractualismo no debe ser en-tendido como un método de justificación normativa. (shrink)
