Society has historically not taken a benign view of genetic disease. The laws permitting sterilization of the mentally re tarded~ and those proscribing consanguineous marriages are but two examples. Indeed as far back as the 5th-10th centuries, B.C.E., consanguineous unions were outlawed (Leviticus XVIII, 6). Case law has traditionally tended toward the conservative. It is reactive rather than directive, exerting its influence only after an individual or group has sustained injury and brought suit. In contrast, state legislatures have not been (...) inhibited in enacting statutes. Many of their products can be characterized as hasty, unnecessary, ill-conceived, and based on the heart rather than the head. Moreover the lack of expert consultation sought has also been remarkable. One state legislature, for example, has advocated immunization for sickle cell anemia! Many others have enacted laws for the screening of inborn errors of metabolism, e.g., phenylketon uria, but have poorly defined the lines of responsibility to secure compliance. A spate of specific disease-related bills has emerged in the u.S. Congress, each seeking recognition and appropriations. Sickle cell anemia, hemophilia, Cooley's anemia and Tay-Sachs disease have been among the front-runners for support. Finally, in 1975, Congress has begun to examine an omnibus bill concerning all forms of genetic disease. The bill, termed the National Genetic Diseases Act is, however, still far from being enacted. In such settings Osler was able to demonstrate to his pupils the principles, ethics, and standards of medical (...) practice that he espoused and thought fundamental to the profession of medicine. His monumental text book, The Principles and Practice of Medicine, first published in 1892, transformed the medical profession and remained a standard text for more than four decades (Leon 1995, p. 13). Renowned medical historians, such as Pedro Laín Entralgo, Henry Sigerist, and Richard Shyrock, recognize him as the greatest clinician that North America has ever produced.Osler, who had observed bedside teaching in his post-graduate studies, recognized that this method had much to offer in the instruction of medical students. Erect posture and large brain are two of the most significant anatomical traits that distinguish us from nonhuman primates. But humans are also different from chimpanzees and other animals, and no less importantly, in their behavior, both as individuals and socially. Distinctive human behavioral attributes include tool-making and technology; abstract thinking, categorizing, and reasoning; symbolic (creative) language; self-awareness and death-awareness; science, literature, and art; legal codes, ethics and religion; complex social organization and political institutions. These traits may all be (...) said to be components of human culture, a distinctively human mode of adaptation to the environment that is far more versatile and successful than the biological mode. Cultural adaptation is more effective than biological adaptation because its innovations are directed, rather than random mutations; because it can be transmitted "horizontally", rather than only "vertically", to descendants; and because cultural heredity is Lamarckian, rather than Mendelian, so that acquired characteristics can be inherited. I explore ethics as a distinctive human trait. The question whether ethical behavior is biologically determined may refer either to the capacity for ethics (i.e., the proclivity to judge human actions as either right or wrong), or to the moral norms accepted by human beings for guiding their actions. I will propose: (1) that the capacity for ethics is a necessary attribute of human nature; and (2) that moral norms are products of cultural evolution, not of biological evolution. (shrink)

Martha Nussbaum has argued in support of the view (supposedly that of Aristotle) that we can, through thought-experiments involving personal identity, find an objective foundation for moral thought without having to appeal to any authority independent of morality. I compare the thought-experiment from Plato’s Philebus that she presents as an example to other thought-experiments involving identity in the literature and argue that this reveals a tension between the sources of authority which Nussbaum invokes for her thought-experiment. I also argue that (...) each of her sources of authority presents further difficulties for her project. Finally, I argue that it is not clear that her thought-experiment is one that actually involves identity in any crucial way. As a result, the case she offers does not offer any satisfactory support for her view on the relation between identity, morality and thought-experiments, but we do gain some insights into what that relation really is along the way. My dissertation explores the foundations of ethics—the question of whether and where practical justification comes to an end. What reason do we have to be moral? Is the fact that something is pleasurable at least a defeasible reason to pursue it, and if so, why? I argue that the only way to answer such questions is to look at what is constitutive of action. Nonnormative facts about the nature of agency can ground the normative authority of reasons for (...) action. Recently, an influential group of externalists about reasons for action have argued that normativity is sui generis and cannot be further explained. Recently, too, many of the most prominent internalists to offer an explanation of normative force have merely assimilated the problem to one about motivational force. I argue that neither position is satisfactory. We need answers to our practical questions, and externalism has none to offer beyond brute intuitions. A purely motivational internalism, on the other hand, seems to fall well short of a normative theory. Appeals to facts about motivation do not answer the question of what we have reason to do; they bypass it in favor of the question of what we are going to do. Fortunately, there is a middle way that combines the best of both views: constitutivism. An account of practical normativity based on action’s constitutive aim can explain both how we are governed or moved by reasons and how those reasons have genuine, objective authority. The constitutive aim of action sets the agenda for practical reasoning, and considerations that engage this aim are the ones that bring such reasoning to a close. They settle the practical question of what to do. But if, as I maintain, the normative question of what I ought to do (or what I have reason to do) seeks considerations that bear on the practical question of what to do, then answers to the latter are ipso facto answers to the former. In this way, nonnormative facts about what closes practical deliberation can ground fully normative facts about what we have reason to do. (shrink)
