Jus post Bellum is, like Jus ad Bellum and Jus in Bello, a part of just war theory. Jus post Bellum is distinguished from the other parts of just war theory by being primarily concerned with the principles necessary for securing a just and lasting peace after the end of a war. Traditionally, jus post bellum has focused primarily on three goals: [1] compensating those who have been the victims of unjust aggression, while respecting the rights of the aggressors, [2] (...) punishing and rehabilitating those guilty of war crimes and other violations of the principles of Jus ad Bellum and Jus in Bello and [3] developing measures that will prevent future war and violence (Orend 2000 and May 2012). In this chapter, I outline an account of political forgiveness and explain the role that political forgiveness can have in promoting the goals of jus post bellum. My conception of political forgiveness requires some unpacking. Let me begin with individual forgiveness, which I understand along familiar Butlerian lines as the renunciation of resentment (Butler, Sermon IX in McNaughton 2017: 75-83), though with a bit of a twist. More exactly, ● An individual, I, forgives J for doing F if and only if I renounces all her own warrant for resenting J for doing F. Resentment is a judgment-sensitive attitude, and, therefore, it tends to track judgments concerning its warrant (Scanlon 1998: 20 and Smith 2015). In cases of perfect forgiveness, I’s renunciation causes her to cease feeling resentment toward J for doing F, though, of course, less perfect cases are possible. I reject the idea that there is a sharp discontinuity between individual and political forgiveness, a position argued for by, e.g., Peter Digeser (1998 and 2001). By contrast, I understand political forgiveness as the renunciation of resentment by the relevant political body in question. With greater precision, ● A sovereign political body, P, forgives J for doing F if and only if P renounces all warrant that its citizens have for resenting, as part of their public lives, J for doing F. A little more explanation is in order. Sovereign political bodies, such as national governments, claim degrees of control over the lives of their citizens, in both their public and their private aspects, though the claims with respect to the former tend to be considerably more expansive than the claims with respect to the latter. I assume here that, at least in the case of legitimate governments, these claims of control are often valid. Such governments may reasonably renounce certain grounds for motivating action in the public sphere. For example, governments may renounce all warrant that its citizens have, as part of their public lives, for hating members of marginalized groups. In practice, this means that, while citizens might continue to act in their private lives out of hatred for members of these groups, their appeal to this hatred is seen by the state as irrelevant to matters of law and public policy as well as being wholly out-of-place in public discourse. Political forgiveness toward J for doing F, as I understand it, involves an analogous rejection of resentment, on the part of citizens in their public lives, toward J for doing F. I turn now to the matter of how political forgiveness supports securing a just and lasting peace between former belligerents. With respect to the first goal of jus post bellum, political forgiveness helps to balance compensation for victims and respect for the rights of defeated aggressors by countering the all-too-human tendency to overvalue harms done to oneself and to members of one’s group. As regards the second goal, political forgiveness plays a similar role but also provides a model for rehabilitation by exemplifying among the victorious the behavior to be emulated by the vanquished. Finally, political forgiveness promotes the third goal of jus post bellum by providing a space for nations to meet as moral equals rather than allowing one nation to have the moral high ground over the other. None of this, of course, means that political forgiveness should be unearned or that it should be confused with condonation (Kolnai 1973 and Pettigrove 2004). However, the question of what is required to put oneself in a position to be forgiven as part of jus post bellum is a matter that goes beyond the scope of this chapter. (shrink)

The papers collected in this volume are a selection of papers that were presented - or scheduled to be presented - at a workshop entitled Forgiveness and Conflict, which took place from 8-10 September 2014, as part of the Mancept Workshops in Political Theory at the University of Manchester. Some of these contributions are now compiled in this volume. The selected papers draw from different philosophical traditions and conceptual frameworks, addressing many aspects of contemporary philosophical debates on the (...) nature and normativity of forgiveness, including its political aspects. The result is a rich collection of essays which covers a wide variety of philosophical issues, displaying cutting edge scholarship in this area. This introduction provides a brief overview of some of the central themes discussed in the volume with a particular emphasis on their innovative aspects. (shrink)

It is sometimes thought that the normative justification for responding to large-scale violations of human rights via the judicial appararatus of trial and punishment is undermined by the desirability of reconciliation between conflicting parties as part of the process of conflict resolution. I take there to be philosophical, as well as practical and psychological issues involved here: on some conceptions of punishment and reconciliation, the attitudes that they involve conflict with one another on rational grounds. But I shall argue that (...) there is a conception of political reconciliation available which does not involve forgiveness and this forms of reconciliation may be the best we can hope for in many conflicts. Reconciliation is nevertheless likely to require the expression of what Darrell Moellendorf has called 'political regret' and the denunciatory role aspect of punishment makes it particularly well-suited to this role. Regular reference is made, within the discourse around the South African Truth and Reconciliation Commission, to the fact that ubuntu, an indigenous world view, played a role in the process. This paper tries to show that despite these references, important analysts of the TRC had insufficiently accounted for this worldview in their critical readings of the Commission's work and therefore found aspects of the process incoherent and/or morally and legally confused. I am not arguing that the TRC was not a (...) deeply flawed process, but want to establish how powerfully this indigenous world view brought a coherency that not only enabled the TRC to do its work without incidences of revenge, but imbued politically and legally trapped concepts with new possibilities. The pervasiveness of this world view within eg. the second round of TRC testimonies is noticeable and show how often the critique on the TRC fails to take this dominant role into account and how many, seemingly contradictory or confusing, positions become coherent when regarded within this worldview. This view of interconnectedness, consistently expressed throughout the life of the commission, has wide implications for the interpretation of healing, the asking of amnesty, the rehabilitation of perpetrators, the interdependence of forgiveness and reconciliation in the process of achieving full personhood within a healed society. In the footsteps of Richard Bell, this paper locates this world view within a particular framework formulated as ubuntu by Desmond Tutu, as communitarianism by Kwame Gyekye, as ethnophilosophy by Paulin Hountondji etc. The paper also tries to understand how this interconnected moral self is formed and who the community could or should be that influences this moral self. This paper explores mourning and forgiveness not simply as sources of existential, political, or emotional meaning, but primarily as possible sites of reconciliation pedagogies . Reconciliation pedagogies are public and school pedagogical practices that examine how certain ideas can enrich our thinking and action toward reconciliation—not through a moralistic agenda but through an approach that views such ideas both constructively and critically. Mourning and forgiveness may constitute valuable points of departure for reconciliation pedagogies, if common pain is (...) acknowledged as an important aspect of rehumanizing the “enemy-other.” This work is difficult and the wider society may be skeptical; however, such work is about assisting a “never again” mentality develop in schools and civil society. The French studies scholar Patrick Coleman made the important observation that over the course of the eighteenth century, the social meanings of anger became increasingly democratized. The work of Jean-Jacques Rousseau is an outstanding example of this change. In Man or Citizen, Karen Pagani expands, in original and fascinating ways, the study of anger in Rousseau’s autobiographical, literary, and philosophical works. Pagani is especially interested in how and to what degree anger—and various reconciliatory responses to anger, such as forgiveness—functions (...) as a defining aspect of one’s identity, both as a private individual and as a public citizen. Rousseau himself was, as Pagani puts it, “unabashed” in his own anger and indignation—toward society on one hand (corrupter of our naturally good and authentic selves) and, on the other, toward certain individuals who had somehow wronged him (his famous philosophical disputes with Voltaire and Diderot, for example). In Rousseau’s work, Pagani finds that the extent to which an individual processes, expresses, and eventually resolves or satisfies anger is very much of moral and political concern. She argues that for Rousseau, anger is not only inevitable but also indispensable, and that the incapacity to experience it renders one amoral, while the ability to experience it is a key element of good citizenship. This dissertation is a philosophical investigation of forgiveness, in both interpersonal and political contexts. The aim of the dissertation is to demonstrate the merits of a broad, multidimensional account that remains faithful to the moral phenomenology of forgiving and being forgiven. Previous philosophical work has tended to see forgiveness primarily in terms of reactive attitudes: specifically, the struggle to overcome resentment. Yet defining forgiveness along these lines fails to do justice to common intuitions that, for example, (...) forgiveness may be a gift offered to another, that it may be the remission of a debt or burden, or that it may 'wipe clean' a stain. Against standard philosophical models that limit its nature to a single dimension, the multidimensional model acknowledges its affective, cognitive and socially performative aspects. -/- My investigation begins by considering characteristic features of forgiveness, the reasons we have to forgive, and its potential moral value. In my preliminary chapters, I present my case against narrow theories of forgiveness, particularly those that define it in terms of attitude alone. In Chapter Three, I situate forgiveness in the context of moral considerations, by analyzing its relationship to other important moral values (trust, compassion, and moral sensitivity) and by defending an account of elective forgiveness. My fourth chapter turns from the act of forgiving to the limits of forgiveness. I discuss forgiveness of hostile or absent wrongdoers, forgiveness of injuries to other people ('third party forgiveness'), and the 'unforgivable.' Some philosophical discussions of the unforgivable have confused what is conceptually unforgivable with what is morally or even empirically unforgivable. By disentangling these threads, I argue that there are, in principle at least, no moral limits on what we may forgive. My concluding chapter applies the multidimensional model of forgiveness to recent discussions of the topic in political philosophy. I argue that the multidimensional model can meaningfully connect a range of forgiving practices in a political context, from transitional justice to interpersonal reconciliation. (shrink)

On political and social life issue in Malaysia.

How can we respond in the aftermath of wrongdoing? How can social trust be restored in the wake of intense political conflict? In this challenging work, philosopher Trudy Govier explores central dilemmas of political reconciliation, employing illustrative material from Rwanda, Sierra Leone, South Africa, Australia, Canada, Peru, and elsewhere. Govier stresses that reconciliation is fundamentally about relationships. Whether through means of truth commissions, apologies, community processes, or criminal trials, the basic goal of reconciliation is improved social trust among (...) alienated individuals and groups. A major strength of Govier's approach is her creative practical framework for reflection. She explains that people should not to be identified with the roles they may have played, and she points out that, with reference to wrongs committed in political conflicts, individuals often play several roles. The perpetrators of some acts can be the victims of others; the victims in some circumstances may become responsive interveners in others. Rare is the political conflict in which one group commits all wrongs. Govier argues that, to build social trust and sustainable peace, acknowledgment of past wrongs is crucial. The need for mutuality in acknowledgment is an underappreciated aspect of the aftermath of conflicts. She further examines the themes of responsibility ; apology; forgiveness; reparations; the rehabilitation of child soldiers; the problems of monetary compensation; and truth-telling and truth commissions. Govier's lucid style and willingness to explore counterarguments make this a lively and thought-provoking work. (shrink)

In business, politics, marriage, indeed in any significant relationship, trust is the essential precondition upon which all real success depends. But what, precisely, is trust? How can it be achieved and sustained? And, most importantly, how can it be regained once it has been broken? In Building Trust, Robert C. Solomon and Fernando Flores offer compelling answers to these questions. They argue that trust is not something that simply exists from the beginning, something we can assume or take for granted; (...) that it is not a static quality or "social glue." Instead, they assert that trust is an emotional skill, an active and dynamic part of our lives that we build and sustain with our promises and commitments, our emotions and integrity. As the global economy makes us more and more reliant on "strangers," and as our political and personal interactions become more complex, Building Trust offers invaluable insight into a vital aspect of human relationships. This article explores the cognitive and epistemic dimensions of a harm-centered theory of evil, as set out in Card’s The Atrocity Paradigm: A Theory of Evil. Examining testimony of both survivors and perpetrators of the 1994 Rwandan genocide helps to support, clarify, and extend Card’s view. Of particular concern are questions of recognizing evil as such, whether the demand to avoid evil sets too high a standard of control over oneself and one’s circumstances, and how to understand agency within evil (...) contexts. This article introduces the concept of ‘recognition harm’, which is an epistemic harm presupposed by and often constitutive of the kinds of intolerable harms that constitute evil, arguing that it is consistent with Card’s account. Finally, the article addresses to the application of the atrocity paradigm to chronic, enduring, systemic harms like sexism. (shrink)

The aim of this article is to explore some aspects of the significance of Simone Weil's work for the question of reconciliation. Focusing on Weil's notion of power, and investigating its plausibility, the article argues that her thinking is less useful than is sometimes supposed for grounding a cosmopolitan ethic. It further argues that Weil's philosophical outlook, with its emphasis on loving everything that happens as an expression of God's will, is in danger of being incapable of taking seriously others' (...) suffering. By picking up on the themes of punishment and forgiveness in her work, it is contended that she does not have readily available a proper conception in this context of our status as political agents. However, it is suggested that there is to be found a more promising line on reconciliation in her work in the notion of luck, and that this concept is one that, more generally, may have a more important role to play in understanding reconciliation than is often supposed. While the value of early detection of dementia is largely agreed upon, population-based screening as a means of early detection is controversial. This controversial status means that such screening is not recommended in most national dementia plans. Some current practices, however, resemble screening but are labelled “case-finding” or “detection of cognitive impairment”. Labelled as such, they may avoid the ethical scrutiny that population-based screening may be subject to. This article examines conceptualizations of screening and case-finding. It shows how the definitions (...) and delimitations of the concepts (the _what_ of screening) are drawn into the ethical, political, and practical dimensions that screening assessment criteria or principles are intended to clarify and control (the _how_ of screening, how it is and how it should be performed). As a result, different conceptualizations of screening provide the opportunity to rethink what ethical assessments should take place: the conceptualizations have different ethico-political implications. The article argues that population-based systematic screening, population-based opportunistic screening, and case-finding should be clearly distinguished. (shrink)

This article examines a population-based opportunistic screening practice for cognitive impairment that takes place at a hospital in Sweden. At the hospital, there is a routine in place that stipulates that all patients over the age of 65 who are admitted to the ward will be offered testing for cognitive impairment, unless they have been tested within the last six months or have been diagnosed with any form of cognitive impairment. However, our analysis shows that this routine is not universally (...) and mechanically applied. Rather, the health care professionals have developed and use an ethico-political judgment, concerning, for example,whomto test,whento offer the tests, andhowto explain and perform them. This article explores the role and practice of this form of judgment, emphasising its political and ethical nature. The analysis is based on qualitative interviews with professionals and patients, and draws on the theories of Aristotle and Hannah Arendt. (shrink)

The author describes Heller’s concept of ethics as a “quasi-sphere” intersecting with various fields relating to human relationships. Special attention is paid to the axiological aspects of her concept of ethics and the relationship between virtues and responsibility. The author also seeks to show how Heller integrated a traditional philosophical question—the relationship between “is” and “ought to be”—into her concept of “radical philosophy” at an earlier stage in the development of her philosophy. She initially considered the relationship between “is” and (...) “ought to be” to be contrasting. Later, when she had come to accept the political model of liberal capitalist society, the ideal of all-compassing equality became the ideal of “equality of opportunities”. The author interprets this shift as one in which the relationship becomes continual. He is also critical of Heller’s underestimation of the effect the “social a priori” has on the possibilities of human life. (shrink)

Dans la crise mondiale, écologique et économique, sociale et politique que nous traversons, la coexistence juste et pacifique des hommes devient un enjeu crucial. L'ampleur des crimes commis au XXe siècle pourrait laisser sceptique quant à notre capacité à relever un tel défi. Pourtant, ce même siècle a vu surgir un recours nouveau : le pardon. Jusque-là privilège de la conscience religieuse individuelle, il s'est invité au plan politique, avec succès. Depuis 1950 en effet, de nombreux pays ont recouru au (...) pardon pour constituer un espace politique durable là où des violences destructrices avaient dominé. Trois cas attirent l'attention : l'Europe, les Commissions vérité et réconciliation et les instances juridiques internationales. Les contours d'un pardon politique se dessinent. En retour se pose la question de sa réception par chacun. La phénoménologie est convoquée : elle conduit à une distinction radicale entre coupables et victimes, privilégiant parmi elles les plus fragiles. L'herméneutique prend alors le relai d'une anthropologie devenue aporétique, esquissant avec le pardon, le geste par lequel l'homme advient. The political passages in Polanyi’s Personal Knowledge are an integral part of his arguments against ‘objectivism’ and/or a post-critical, personalist, fiduciary and fallibilist philosophy. This paper elaboratesthe social and political implications of Polanyi’s emphasis upon acceptance of one’s situation and the exercise in it of a sense of responsibility to transcendent ideals, as against attempts to start with a clean slate, to overcome all imperfections and to find some simple rule for political policy. Prescriptive duties and rights, (...) and mutual trust and solidarity, are the bases of politics, anti responsible action must start with them. But much of modern politics expresses a Gnostic impatience of our created and finite existence which results in arbitrary commitment to some radical and destructive ideology. (shrink)

Sustainable Development Goal (SDG) 2 relates to ending hunger, achieving food security and improving nutrition, and promoting sustainable agriculture. The SDGs mention only a few political indicators and SDG2 in particular is largely devoid of political considerations to end hunger and achieve food security. Nobel Laureate Amartya Sen famously observed the absence of famine in democracies, suggesting that a democratic system provides checks and balances that prevent famine. His observation has elicited further debate and triggered empirical studies in (...) recent years. Going beyond Sen’s hypothesis, this essay examines other political factors that would explain vulnerability to famine and that need to be addressed more explicitly in SDG 2 and similar initiatives. By taking the case of pastoralists in the Afar region of Ethiopia, this research explores selected political determinants of vulnerability to famine. The Eritrea-Ethiopia war and the ensuing border closure have had a detrimental effect on the livelihood of pastoralists in Afar – many pastoralists were deprived of a market and a reliable source of income. In addition, Afar pastoralists were sidelined from the informal salt sector on which they used to rely. The state facilitated this expropriation, leaving pastoralists even more vulnerable to famine. I argue that political considerations are crucial in successfully ending hunger and achieving food security. The essay uses a qualitative case study design and is based on a PhD dissertation. The paper attempts to clarify the concept of political forgiveness, distinguishing it from individual forgiveness and illustrating its presence in contemporary politics. It proceeds to explore grounds for criticism of political forgiveness - an authority criticism, a specificity criticism and a temporal distance criticism - and suggests that, although these difficulties can be overcome, they provide serious challenges to putative cases of political forgiveness.

Evidence affirms that aesthetic engagement patterns our movements, often with us barely aware. This invites an examination of pre-reflective engagement within cities and also aesthetic experience as a form of the pre-reflective. The invitation is amplified because design has political implications. For instance, it can draw people in or exclude them by establishing implicitly recognized public-private boundaries. The Value Sensitive Design school, which holds that artifacts embody ethical and political values, stresses some of this. But while emphasizing that (...) design embodies implicit values, research in this field lacks sustained attention to largely unconscious background biases or values, rooted in cultural attitudes and personal interests, that lead theorists and planners—often too narrowly—to promote design organized around specific values such as defensibility. In examining these points, I draw on J. J. Gibson, a central figure for some writing on aesthetics and cities, and whom pragmatists and phenomenologists in turn influenced. Taking a cue from pragmatists in particular, I argue Gibson’s perceptual theory of affordances entails a theory of values, meaning our perception and therewith movements are inherently value-based. I advocate design that accounts for relatively constantly held values such as safety, while also handling the vast pluralism that exists and not crushing the aesthetic vibrancy of city life. A stereoscopic view on a particular historical event, in which contemporary assessments are combined with mental stereotypes of a medieval man, allows a slightly different assessment of the chronicle plot about the posthumous “baptism of bones” of Oleg and Yaropolk, Princes of Kyivan Rus, in 1044. While from theological positions it is perceived as an absurdity and a direct violation of the rules of the church, in the Middle Ages this act did not contradict the mass religious beliefs. From an (...) ethical point of view, the action of Yaroslav the Wise was regarded as concern for the souls of the ancestors who died pagans and therefore did not claim for the salvation. The soteriological optimism that prevailed in the eleventh century in countries of the late Christianization, including Kyivan Rus, gave hope that living people were able to influence the fate of the souls of the dead. From a political point of view, the baptism of the ashes of the ancestors and their reburial in the family tomb of the Princes of Kyiv in the Church of the Tithes was aimed at expanding the circle of heavenly patrons and protectors of the princely dynasty, expanding the period of the Christian history of Kyivan Rus, and, as a result, legitimizing the power of Yaroslav the Wise. The Israel-Palestine conflict stands at the heart of tensions in the Middle East and, more than that, at the heart of tensions between the West and the Islamic world. It is sometimes suggested that the resolution of this conflict will require forgiveness on the part of both Palestine and Israel. However, what such forgiveness would involve has not been adequately explored. Our aim is to remedy this gap in the discussion. Our consideration of Palestinian political forgiveness (...) will address three principal questions. The first is a definitional question: what is political forgiveness? Our answer to this question will involve, among other things, articulating an account of collective emotions. The second question is an agential question: is there a Palestinian agent capable of forgiving Israel? Finally, there is the normative question: should Palestinians forgive Israel? (shrink)

The article examines the political challenge and significance of forgiveness as an indispensable response to the inherently imperfect and tragic nature of political life through the lens of the existential, narrative-inspired judging sensibility. While the political significance of forgiveness has been broadly recognized in transitional justice and reconciliation contexts, the question of its importance and appropriateness in the wake of grave injustice and suffering has commonly been approached through constructing a self-centred, rule-based framework, defining (...) class='Hi'>forgiveness in terms of a moral duty or virtue. Reliant on a set of prefabricated moral standards, however, this approach risks abstracting from the historical, situated condition of human political existence and thus arguably stands at a remove from the very quandaries and imperfections of the political world, which it purports to address. Against this background, this article draws on Albert Camus’s and Hannah Arendt’s aesthetic, worldly judging sensibility and its ability to kindle the process of coming to terms with the absurd, and perhaps unforgivable character of reality after evil. As an aptitude to engage the world in its particularity, plurality and contingency rather than seeking to subdue and tame it under prefabricated standards of thought, namely, worldly judgement is able to reveal how past tragedies have arisen from the ambiguity of human engagement in the world and thereby also elicit the distinctly human capacities of beginning anew and resisting such actions in the future. As such, I suggest, it is well-suited to bring into clearer focus and confront the main political challenge and significance of forgiveness: how to acknowledge the seriousness of the wrongs committed, yet also enable the possibility of a new beginning and restore among former enemies the sense of responsibility for the shared world. Evil, Political Violence and Forgiveness: Essays in Honor of Claudia Card is a collection of new philosophical essays written in tribute to Claudia Card, exploring her leading theory of evil and other theories of evil. The collection brings together an international cohort of distinguished moral and political philosophers who mediate with Card upon an array of twentieth-century atrocities and on the nature of evil actions, persons and institutions.

The human history has evidenced a great number of systems of hierarchy and power, various manifestations of power and hierarchy relations in different spheres of social life from politics to information networks, from culture to sexual life. A careful study of each particular case of such relations is very im-portant, especially within the context of contemporary multipolar and multicultural world. In the meantime it is very important to see both the general features, typical for all or most of the hierarchy (...) and power forms, and their variation. This set of issues has been treated by a series of international conferences titled ‘Hierarchy and Power in the History of Civilizations’ held in 2000–2006. Most articles of this volume were originally presented at the 4th conference of this series (Moscow, 2006). Needless to mention that all those presentations have been substantially re-worked for the publication in this volume. Notwithstanding the fact that the relations of hierarchy and power are rele-vant for all the spheres as they penetrate the whole of social life, establishing a sort of framework for the human agency, they are naturally most visible in the political sphere. They existed long before the formation of the earliest states – ethologists maintain that complex systems of hierarchy and power can be found among many highly organized animals. Yet, this was with the formation of the state and civilization when the power and hierarchy relations acquired their mature forms. Although ancient and medieval systems of government and domination always attract special attention, contemporary systems are much closer for every scholar. At the same time relations of power and hierarchy in the modern political world system demonstrate a great number of variants, levels and dimensions. In the present edited volume we only focus on three aspects of this important subject. These are revolutionary transformations (in the broad sense of this notion), violence, and globalization. The conventional interpretation of Hannah Arendt's accounts of forgiveness considers them secularistic. The secular features of her thinking that resist grounding the act of forgiving in divine criteria offer a good corrective to religious forgiveness that fosters depoliticization. Arendt's vision of free politics, however, calls for much more nuance and complexity regarding the secular and the religious in realizing forgiveness for transitional politics than the secularist rendition of her thinking allows. After identifying an area of ambiguity in (...) Arendt's thoughts that invites further investigation of religious forgiveness, this study seeks to relieve her misgivings about religion's role in politics by engaging with Dietrich Bonhoeffer's theology, which emphasizes worldliness and altruism in religious faith. Through constructive engagements with both thinkers, the article presents a balanced Arendtian position that is neither solely secularist nor complacent about religion in politics. (shrink)

This essay argues that the overuse of the idiom of forgiveness has distorted our understanding of the nature and requirements of political reconciliation, and proposes its supplementation by a notion of grace. This is a mode of response to wrongs that is less hedged around by conventions and conditions, and grace complements forgiveness in contexts in which the latter is inappropriate; it is also more serviceable for maintaining inter-community harmony in the long term. Rather than focusing on political and legal debates surrounding attempts to determine if and when genocidal rape has taken place in a particular setting, this essay turns instead to a crucial, yet neglected area of inquiry: the moral significance of genocidal rape, and more specifically, the nature of the harms that constitute the culpable wrongdoing that genocidal rape represents. In contrast to standard philosophical accounts, which tend to employ an individualistic framework, this essay offers a situated understanding of harm (...) that features the importance of interdependence and relationality and that conceptualizes harms as embodied and contextual. The paper ultimately reveals what is distinctive about this particular crime of sexual violence by exploring the logic of genocidal rape: genocidal rape involves the harm of forced self-betrayal unleashed relationally, causing victims as representatives of their group to participate inadvertently in the destruction of that group. The question of forgiveness in politics has attained a certain cachet. Indeed, in the fifty years since Arendt commented on the notable absence of forgiveness in the political tradition, a vast and multidisciplinary literature on the politics of apology, reparation, and reconciliation has emerged. To a novice scouring the relevant literatures, it might appear that the only discordant note in this new veritable symphony of writings on political forgiveness has been sounded by philosophers. There is (...) a more-than-healthy cynicism directed at what many philosophers see as an uncritical promotion of forgiveness, which – they fear – risks distorting and cheapening forgiveness as a moral ideal, on the one hand, and ignoring the moral and political values of justice, accountability and the cessation of harmful relationships, on the other. Are philosophical fears about the dangers of thinking about forgiveness in political terms warranted – or do they perhaps depend in part on conceptual conservatism regarding what exactly political forgiveness might be? I argue that most, if not all, standard objections to political forgiveness emerge from theoretical reliance on a picture of forgiveness I will call the Emotional Model. Once we make conceptual space for descriptions of forgiveness in performative and social terms, the concept is more easily adapted to a political account without at least some of the risks feared by philosophers. In this paper, I discuss some central ethical aspects of self-forgiveness. A first comparison is made between interpersonal forgiveness and self-forgiveness. It would seem that self-forgiveness follows much of the same structure as interpersonal forgiveness, although with some exceptions. One noticeable difference is that with self-forgiveness, the forgiver and forgiven is one and the same person. The main ethical question discussed is when self-forgiveness is morally permissible. I argue that self-forgiveness is only (...) morally permissible when the wrongdoer acknowledges wrongdoing and display genuine repentance. He must also, insofar as possible, ask the victim for forgiveness before contemplating self-forgiveness. (shrink)

Modernity is marked by the advent of technologies capable of storing data almost indefi­nitely. On the other hand, the data collection takes place without the conscious permission of the users. The storage and collection of personal data is a potential problem, since the digital footprint of a person on the Internet has an impact on the social and political rep­resentation of the individual, its perception by other actors. Compromising the content of a digital footprint can expose information that is (...) not intended for others. There is cur­rently an increasing trend of misuse of stored data, both by criminals and by companies that use the data for sale or surveillance. The need to control how data is collected, stored and used leads to the emergence in the academic literature and the legal field of the “right to be forgotten”, which allows a person to actively moderate the process of collecting and storing data, to participate in determining the circle of those to whom they can be accessed, and delete personal data. The adoption of such a right not only allows the state to influence the collection and storage of data, regulating interactions through law-making activities, but also to realize the potential of an autonomous individual. The prospect of legislating the right to be forgotten has sparked debate in the academic and professional community about the destruction of the free marketplace of ideas and the imposition of political censor­ship on the Internet. The article deals with the philosophical, ethical and political founda­tions of the right to be forgotten. The article substantiates the conclusion that the right to be forgotten has a positive heuristic potential, but at the same time it has conceptual flaws, and is also not able to completely correct the current situation of data processing. However, the implementation of the right to be forgotten in the future can have a beneficial effect on the current situation in the field of collection and storage of personal data. (shrink)

Our century has witnessed violence on an unprecedented scale, in wars that have torn deep into the fabric of national and international life. And as we can see in the recent strife in Bosnia, genocide in Rwanda, and the ongoing struggle to control nuclear weaponry, ancient enmities continue to threaten the lives of masses of human beings. As never before, the question is urgent and practical: How can nations--or ethnic groups, or races--after long, bitter struggles, learn to live side by (...) side in peace? In An Ethic for Enemies, Donald W. Shriver, Jr., President Emeritus of Union Theological Seminary, argues that the solution lies in our capacity to forgive. Taking forgiveness out of its traditional exclusive association with personal religion and morality, Shriver urges us to recognize its importance in the secular political arena. The heart of the book examines three powerful and moving cases from recent American history--our postwar dealings with Germany, with Japan, and our continuing domestic problem with race relations--cases in which acts of forgiveness have had important political consequences. Shriver traces how postwar Germany, in its struggle to break with its political past, progressed from denial of a Nazi past, to a formal acknowledgement of the crimes of Nazi Germany, to providing material compensation for survivors of the Holocaust. He also examines the efforts of Japan and the United States, over time and across boundaries of race and culture, to forgive the wrongs committed by both peoples during the Pacific War. And finally he offers a fascinating discussion of the role of forgiveness in the American civil rights movement. He shows, for instance, that even Malcolm X recognized the need to move from contempt for the integrationist ideal to a more conciliatory, repentant stance toward Civil Rights leaders. Malcolm came to see that only through forgiveness could the separate voices of the African-American movement work together to achieve their goals. If mutual forgiveness was a radical thought in 1964, Shriver reminds us that it has yet to be realized in 1994. "We are a long way from ceasing to hold the sins of the ancestors against their living children," he writes. Yet in this poignant volume, we discover how, by forgiving, enemies can progress and have progressed toward peace. A timely antidote to today's political conflicts, An Ethic for Enemies challenges to us to confront the hatreds that cripple society and threaten to destroy the global village. (shrink)

After decades of armed conflict in Colombia, how do those most affected by that conflict understand forgiveness? While others have researched Colombians’ views of forgiveness, this study is the first to do so through discussion of a narrative of forgiveness. Readings of the biblical narrative chosen for this study, the Parable of the Unforgiving Debtor, can enable North Atlantic scholars to discover dimensions of the parable revealed by those who live lives that mirror the realities of the (...) parable, unlike such scholars. The study aims to understand how conflict survivors, especially internally displaced persons, understand forgiveness and its relation to politics. The study also aims to identify how these women and men read Matthew 18:21–35 differently from academics. Groups in eight locations around Colombia discussed Matthew 18:21–35. Researchers led lectura popular de la Biblia [people’s readings of the Bible], inviting participants to say how the parable related to their lives and to discuss the political consequences that would come from imitating characters in the parable. Conflict survivors said that forgiving was essential if their communities were going to be communities at all, especially communities at peace, offering freedom and economic opportunity. Unlike commentators, they read Matthew 18:21–35 as enjoining forgiveness towards those beyond their local church and for wrongs involving money and violence. As Colombian churches seek to counter resentment with forgiveness, they should be aware of the power of lectura popular, especially of this parable, to create a safe environment where conflict survivors can speak candidly.
