ZusammenfassungSeit Jahren steigt in Indien die Anzahl der spezifisch gegenüber Frauen, hierarchisch tieferstehenden Geburts- (varṇa) und Berufsgruppen (jāti) sowie Kastenlosen (dalits;scheduled castes) und indigenen Gemeinschaften (ādivāsī;scheduled tribes) angezeigten Gewalttaten kontinuierlich an. Diese Gewaltakte und Tötungsdelikte sind aufgrund ihrer Qualität und vor allem aufgrund ihrer quantitativen Größenordnung als systemisch anzusehen. Dass sie in dieser Form noch immer ein akutes Gegenwartsproblem von allerhöchster sozialer und politischer Brisanz im vordergründig säkularisierten Indien darstellen, legt einen gesamtgesellschaftlichen Konsens über deren grundsätzliche Rechtmäßigkeit nahe, der sich (...) anhand tradierter Normen- und Wertvorstellungen sowie prämoderner Denk- und Handlungsmuster legitimiert, die auf traditionell hinduistischen Ideen basieren. Dabei kann der politische Aufstieg der nationalreligiös argumentierenden und agitierenden „Indischen Volkspartei“ (BJP:Bhāratīya Janatā Pārṭī) sowie ihr politisch forcierter Rückgriff auf den Hinduismus als einzelner, aber dennoch entscheidender Einflussfaktor gesehen werden, der die anhaltende Verschärfung innergesellschaftlicher Gegensätze und die kontinuierliche Intensivierung der Gewaltdynamiken ursächlich zu erklären vermag. Um diese Zusammenhänge zu beleuchten, vollzieht der Beitrag die ideengeschichtlichen Grundlagen religiös legitimierter Entmenschlichung und Gewalt sowie latenter wie offener Misogynie im Hinduismus von seinen vedischen Ursprüngen im 2. vorchristlichen Jahrtausend bis zur Gegenwart nach. The article recapitulates the different phases of the western interpretation of Nāgārjuna and aims, proceeding from a foundation enriched by a critique of them, to obtain elements of a renewed transcendental-philosophical interpretation of the philosophy of emptiness, such as was initiated by Fyodor Ippolitovich Stcherbatsky in his approach inspired by Immanuel Kant. Based primarily on Johann Gottlieb Fichte’s transcendental logic and Wissenschaftslehre a systematic reconstruction of Nāgārjuna’s thought is undertaken. Taking up an insight of Bhavya/Bhāviveka, we suggest that the absolute (...) known by Nāgārjuna as pre-reflexive being-conscious is the concept-bound appearance of the absolute in the medium of prapanca and not the absolute itself dispensed from prapanca, which as the unthinkable beyond of all thinking can be immediately realized in actuality only by the self-annihilation of thinking. This will bring to light the cognitive yield of Nāgārjuna’s effort, which is of a transcendental nature avant la lettre, and which makes him a witness for the claim to universality of transcendental-philosophical knowledge, beyond Europe.Der Aufsatz rekapituliert die verschiedenen Phasen der westlichen Rezeptionsgeschichte Nāgārjunas und plädiert für eine erneute transzendentalphilosophische Interpretation der Philosophie der Leerheit, wie sie die von Immanuel Kant inspirierte Interpretation Fyodor Ippolitovich Stcherbatskys inauguriert hat. Ausgehend von Johann Gottlieb Fichtes transzendentaler Logik und Wissenschaftslehre wird eine systematische Rekonstruktion von Nāgārjunas Denken unternommen und das von Nāgārjuna affirmierte Absolute als präreflexives Bewusst-Sein interpretiert. Im Anschluss an Bhavya/Bhāviveka wird das präreflexive Bewusst-Sein Nāgārjunas als absolute Erscheinung des Absoluten vom Absoluten selbst unterschieden, das als undenkbares Jenseits allen Denkens nur durch die faktische Selbstvernichtung des Denkens unmittelbar realisiert werden kann. Anhand dieser exemplarischen Untersuchung wird die These vertreten, dass Nāgārjuna Erkenntnisse errungen hat und zwar – ante litteram – transzendentale, die ihn zu einem Zeugen des Universalitätsanspruches transzendentalphilosophischer Erkenntnis außerhalb Europas machen. Die Geschichte der genetischen Pränataldiagnostik ist bislang als Teil der Geschichte der Humangenetik und deren Neuorientierung als klinisch-laborwissenschaftliche Disziplin in der zweiten Hälfte des 20. Jahrhunderts betrachtet worden. Anhand neuen Quellenmaterials soll in diesem Beitrag gezeigt werden, dass das Interesse an der Pränataldiagnostik in Westdeutschland auch im Kontext von Forschungen entstand, die sich mit Gefahren für den Menschen in der Umwelt befassten. Anhand der Debatten um die Einrichtung des DFG-Schwerpunktprogramms „Pränatale Diagnostik genetischer Defekte“ 1970 untersuchen wir, wie die Technik der (...) Amniozentese in Westdeutschland von einer interdisziplinären Forschungsgruppe eingeführt wurde, die sich mit Schädigungen des Organismus durch Strahlen, Arzneimittel und andere Gebrauchsstoffe und Konsumgüter befasste. In einer als ökologische Wende bezeichneten Zeit wachsenden Umweltbewusstseins, so unsere These, sollte durch die Förderung der Pränataldiagnostik eine wahrgenommene Lücke in der Prävention umweltbedingt auftretender genetischer Anomalien geschlossen werden. Für die Pränataldiagnostik als „Schutzmaßnahme“ sprach unter anderem ihre erwartete Finanzierung als Krankenkassenleistung im Zuge der Reform des Abtreibungsrechts. Erst in einem zweiten Schritt führten Veränderungen von Strukturen der Forschung, vor allem aber Erfahrungen in der gynäkologischen Praxis zu einer Neuausrichtung auf die Diagnostik und Prävention mehrheitlich erblicher oder spontan auftretender Anomalien. Die Pränataldiagnostik, so wie sie schließlich in Westdeutschland ab den frühen 1980er Jahren routinemäßig Einsatz fand, hatte mit Fragen der „Umwelt“ kaum noch zu tun. Diese Fallstudie zur Frühgeschichte der genetischen Pränataldiagnostik handelt von dem noch wenig untersuchten Verhältnis von humangenetischer Forschung, klinischer Praxis und Umweltforschung und hat zum weiteren Ziel, den bisher in anderen Kontexten beschriebenen Wandel von Perspektiven in der Vorsorge um 1970 zu beleuchten. We discuss the interplay between the axiomatic and the semantic approach to truth. Often, semantic constructions have guided the development of axiomatic theories and certain axiomatic theories have been claimed to capture a semantic construction. We ask under which conditions an axiomatic theory captures a semantic construction. After discussing some potential criteria, we focus on the criterion of ℕ-categoricity and discuss its usefulness and limits.

With the waves of reform occurring in mental health legislation in England and other jurisdictions, mental capacity is set to become a key medico-legal concept. The concept is central to the law of informed consent and is closely aligned to the philosophical concept of autonomy. It is also closely related to mental disorder. This paper explores the interdisciplinary terrain where mental capacity is located. Our aim is to identify core dilemmas and to suggest pathways for future interdisciplinary research. The terrain (...) can be separated into three types of discussion: philosophical, legal and psychiatric. Each discussion approaches mental capacity and judgmental autonomy from a different perspective yet each discussion struggles over two key dilemmas: whether mental capacity and autonomy is/should be a moral or a psychological notion and whether rationality is the key constitutive factor. We suggest that further theoretical work will have to be interdisciplinary and that this work offers an opportunity for the law to enrich its interpretation of mental capacity, for psychiatry to clarify the normative elements latent in its concepts and for philosophy to advance understanding of autonomy through the study of decisional dysfunction. The new pressures on medical and legal practice to be more explicit about mental capacity make this work a priority. (shrink)

The present study investigates whether quantifier scope is computed incrementally during online sentence processing. We exploited the free word order in German to manipulate whether the verbal predicate preceded or followed the second quantifier in doubly quantified sentences that required the computation of inverse scope. A possessive pronoun in the first quantifier that had to be bound by the second quantifier was used to enforce scope inversion. We tested whether scope inversion causes difficulty and whether this difficulty emerges even at (...) a point before comprehenders have encountered the main verb. We report three pretests and two reading time experiments. The first two pretests were offline tests that established (1) that the sentences exhibited the assumed scope preferences and (2) that variable binding forced scope inversion. The third pretest employed self-paced reading to show that interpreting a bound variable is not difficult per se and that difficulty in the critical construction must thus be due to inverting scope. Incremental processing of quantifier scope was investigated in a self-paced reading experiment. We observed difficulty right after the second quantifier, but only if it appeared after the main verb, that is, after the predication was complete. Further evidence for late scope inversion comes from an eyetracking experiment. Again, a scope inversion effect could only be observed at the end of the sentence. Taken together, our study demonstrates that in German inverse scope is only computed at the sentence boundary. (shrink)

This article argues that the practice of child adoption among Igbo Christians of Nigeria is some kind of “paradox.” This is because, Igbo Christians reject and practice child adoption at the same time. This applies to Igbo Christians irrespective of denominations. Igbo cultural practices like the quest for children to partake in inheritance, the denial of participation in some traditional roles, the individualized nature of Igbo contemporary society, and Christian teaching on love contribute to this. The findings in this article (...) challenge previous scholarship which claims that Igbo Christians do not practice Child adoption although they are sympathetic to it. (shrink)

In this paper, we argue that corruption research can benefit from studying corrupt transactions as a particular form of social interaction. We showcase the usefulness of a theoretical focus on social interaction by investigating online user reports on the website Frontdesktip.com. Through this focus, we can observe users sharing experiences and tips on the best ways of bribing hotel clerks in Las Vegas for attaining room upgrades and other complimentary extras. We employ a logistic regression analysis to examine what factors (...) influence the “successful” performance of this bribery practice. Our study makes a twofold contribution to existing research on corruption. First, on the theoretical level, we show that the typified and scripted character of social interactions can help explain the occurrence of corrupt transactions. Second, on a methodological level, our study showcases online self-reports as a useful data source to study corrupt transactions in an unobtrusive way. (shrink)

Sophocles's classical tragedy, Antigone, is continually reinvented, particularly in the Americas. Theater practitioners and political theorists alike revisit the story to hold states accountable for their democratic exclusions, as Antigone did in disobeying the edict of her uncle, Creon, for refusing to bury her brother, Polynices. Antigone in the Americas not only analyzes the theoretical reception of Antigone, when resituated in the Americas, but further introduces decolonial rumination as a new interpretive methodology through which to approach classical texts. Traveling between (...) modern present and ancient past, Andrés Fabián Henao Castro focuses on metics (resident aliens) and slaves, rather than citizens, making the feminist politics of burial long associated with Antigone relevant for theorizing militant forms of mourning in the global south. Grounded in settler colonial critique, black and woman of color feminisms, and queer and trans of color critique, Antigone in the Americas offers a more radical interpretation of Antigone, one relevant to subjects situated under multiple and interlocking systems of oppression. A frequentist confidence interval can be constructed by inverting a hypothesis test, such that the interval contains only parameter values that would not have been rejected by the test. We show how a similar definition can be employed to construct a Bayesian support interval. Consistent with Carnap’s theory of corroboration, the support interval contains only parameter values that receive at least some minimum amount of support from the data. The support interval is not subject to Lindley’s paradox and provides an (...) evidence-based perspective on inference that differs from the belief-based perspective that forms the basis of the standard Bayesian credible interval. Recent studies suggest that vertebrate genetic material ingested by invertebrates (iDNA) can be used to investigate vertebrate ecology. Given the ubiquity of invertebrates that feed on vertebrates across the globe, iDNA might qualify as a very powerful tool for 21st century population and conservation biologists. Here, we identify some invertebrate characteristics that will likely influence iDNA retrieval and elaborate on the potential uses of invertebrate‐derived information. We hypothesize that beyond inventorying local faunal diversity, iDNA should allow for more profound insights (...) into wildlife population density, size, mortality, and infectious agents. Based on the similarities of iDNA with other low‐quality sources of DNA, a general technical framework for iDNA analyses is proposed. As it is likely that no such thing as a single ideal iDNA sampler exists, forthcoming research efforts should aim at cataloguing invertebrate properties relevant to iDNA retrieval so as to guide future usage of the invertebrate tool box. This article examines the legitimization process of the public health preventive measures implemented in many Western countries following the SARS-CoV-2 outbreak. Through concepts such as governmentality, disciplinarization and security mechanisms proposed by Foucault, we trace some of the basic principles and implications of the relationship between biopower and medicine, as well as the media dissemination of an official narrative on scientific truth. These reflections are complemented by the contributions of Francois Lyotard and Jean Baudrillard. Lyotard reflects on the relationship between (...) science and a “performative game”, whose own staging is the core of its criteria of truth. Baudrillard shows the relevance of a “hyperreality” in which the signs presented by the media take precedence over the experience of the subjects. We argue that a mediatized version of science, defined through a strong disciplinarization of knowledge and the censorship of dissident voices, played a key role in the establishment of consensus and the legitimization of policies that granted extraordinary power to governments and transnational elites. Although the work of Foucault in this demonstration is essential, the contributions of Lyotard and Baudrillard provide additional elements to understand a fundamental problem: the public acceptance of “truth” as an instrument of governmentality on a global scale. Reciprocals with all-antecedents are expected to preferably receive a strong interpretation (Dalrymple et al., 1998), but reciprocals with proportional or numerical quantifier antecedents should be interpreted weakly. Experiment 1, where participants completed pictures according to their preferred interpretation, provides (...) evidence for these predictions. Experiment 2 was a picture verification task. The results show that the strong interpretation was in fact possible for tractable all but one-reciprocals, but not for exactly n. También se pretende entender hasta qué punto la filosofía naturalista contemporánea puede estar vinculada con la neuroteología -sobre todo cuando el naturalismo implica, en la mayoría de los casos, un reduccionismo que conduce al materialismo-, teniendo en conside ración que en las distintas áreas neurocientíficas tiene lugar un fisicalismo, (...) esto es, una reducción de las propiedades o procesos cognitivos a meros procesos cerebrales e interacciones neuronales, que, gracias a la tecnología, hoy pueden ser visualizados por distintos instrumentos y técnicas.In this work an exploratory analysis is carried out on what has been conceived as a new field of scientific knowledge for some decades, we refer to neurotheology. It is also intended to under- stand to what extent contemporary naturalistic philosophy can be linked to neurotheology - especially when naturalism implies, in most cases, a reductionism that leads to materialism -, taking into account that in the different neuroscientific areas it has instead a physicalism, that is, a reduction of cognitive properties or processes to mere brain processes and neural interactions, which, thanks to technology, can now be visualized by different instruments and techniques. At the centre of the traditional discussion of truth is the question of how truth is defined. Recent research, especially with the development of deflationist accounts of truth, has tended to take truth as an undefined primitive notion governed by axioms, while the liar paradox and cognate paradoxes pose problems for certain seemingly natural axioms for truth. In this book, Volker Halbach examines the most important axiomatizations of truth, explores their properties and shows how the logical results impinge on the (...) philosophical topics related to truth. In particular, he shows that the discussion on topics such as deflationism about truth depends on the solution of the paradoxes. Adorno notoriously asserted that there is no 'right' life in our current social world. This assertion has contributed to the widespread perception that his philosophy has no practical import or coherent ethics, and he is often accused of being too negative. Fabian Freyenhagen reconstructs and defends Adorno's practical philosophy in response to these charges. He argues that Adorno's deep pessimism about the contemporary social world is coupled with a strong optimism about human potential, and that this optimism explains his (...) negative views about the social world, and his demand that we resist and change it. He shows that Adorno holds a substantive ethics, albeit one that is minimalist and based on a pluralist conception of the bad - a guide for living less wrongly. The article argues that persons should be conceived as self-owners and entitled to acquire private property within justifiable property conventions because they should be able to live as project pursuers. This is the ‘project pursuit argument’. It leads to a conception of self-ownership that is stringent, but weaker than standard libertarian notions of self-ownership, and to an understanding of private property as a convention that has to meet a sufficientarian threshold in order to be justifiable.

The imagination poses fascinating philosophical questions across a range of subjects including philosophy of mind, aesthetics and epistemology. In this paper, I describe and discuss two mental phenomena which are somewhat neglected in the philosophy of mind: focused daydreaming and mind-wandering. My aim is to show that their natures are rather distinct, despite the fact that we tend to classify both as instances of daydreaming. The first difference between the two, I argue, is that, while focused daydreaming is an instance of imaginative mental agency, mind-wandering is not—though this does not mean that mind-wandering cannot involve mental agency at (...) all. This personal-level difference in agency and purposiveness has, furthermore, the consequence that instances of mind-wandering do not constitute unified and self-contained segments of the stream of consciousness—in stark contrast to focused daydreams. Besides, the two kinds of mental phenomena differ in whether they possess a narrative structure, and in how we may make sense of the succession of mental episodes involved. (shrink)

Solutions to semantic paradoxes often involve restrictions of classical logic for semantic vocabulary. In the paper we investigate the costs of these restrictions in a model case. In particular, we fix two systems of truth capturing the same conception of truth: of the system KF of Feferman formulated in classical logic, and the system PKF of Halbach and Horsten, formulated in basic De Morgan logic. The classical system is known to be much stronger than the nonclassical one. We assess the (...) reasons for this asymmetry by showing that the truth theoretic principles of PKF cannot be blamed: PKF with induction restricted to non-semantic vocabulary coincides in fact with what the restricted version of KF proves true. In this article, I present two objections against the view that aesthetic judgements – that is, judgemental ascriptions of aesthetic qualities like elegance or harmony – are justified non‐inferentially. The first is that this view cannot make sense of our practice to support our aesthetic judgements by reference to lower‐level features of the objects concerned. The second objection maintains that non‐inferentialism about the justification of aesthetic judgements cannot explain why our aesthetic interest in artworks and other objects is limited to (...) only some of their lower‐level features that realise their higher‐level aesthetic qualities. Although my concern with the view that aesthetic judgements are subject to non‐inferential justification is very general, my discussion is primarily structured around Sibley's well‐developed and influential version of this view.
