With the waves of reform occurring in mental health legislation in England and other jurisdictions, mental capacity is set to become a key medico-legal concept. The concept is central to the law of informed consent and is closely aligned to the philosophical concept of autonomy. It is also closely related to mental disorder. This paper explores the interdisciplinary terrain where mental capacity is located. Our aim is to identify core dilemmas and to suggest pathways for future interdisciplinary research. The terrain (...) can be separated into three types of discussion: philosophical, legal and psychiatric. Each discussion approaches mental capacity and judgmental autonomy from a different perspective yet each discussion struggles over two key dilemmas: whether mental capacity and autonomy is/should be a moral or a psychological notion and whether rationality is the key constitutive factor. We suggest that further theoretical work will have to be interdisciplinary and that this work offers an opportunity for the law to enrich its interpretation of mental capacity, for psychiatry to clarify the normative elements latent in its concepts and for philosophy to advance understanding of autonomy through the study of decisional dysfunction. The new pressures on medical and legal practice to be more explicit about mental capacity make this work a priority. (shrink)

We investigated the coupling between a speaker's and a listener's eye movements. Some participants talked extemporaneously about a television show whose cast members they were viewing on a screen in front of them. Later, other participants listened to these monologues while viewing the same screen. Eye movements were recorded for all speakers and listeners. According to cross‐recurrence analysis, a listener's eye movements most closely matched a speaker's eye movements at a delay of 2 sec. Indeed, the more closely a listener's (...) eye movements were coupled with a speaker's, the better the listener did on a comprehension test. In a second experiment, low‐level visual cues were used to manipulate the listeners' eye movements, and these, in turn, influenced their latencies to comprehension questions. Just as eye movements reflect the mental state of an individual, the coupling between a speaker's and a listener's eye movements reflects the success of their communication. (shrink)

The text- and argument-focused histories of philosophy that we have are mainly interested in teasing out the details of the positions taken on philosophical issues by individual philosophers. But this is a long way from having a historical explanation of the larger-scale trajectory of philosophical development. An empirical history of philosophy, however, examines the institutionalized places and venues for philosophical work that provide a rich, shared structure for the promotion of particular sorts of work. Mid-twentieth-century philosophers of science such as (...) Herbert Feigl and Philipp Frank knew what they were doing—they were creating the space to promote certain sorts of work in venues such as the Institute for the Unity of Science and the Minnesota Center for Philosophy of Science and, ultimately, in publication venues such as Daedalus and the Minnesota Studies in Philosophy of Science. Here the engine of progress is the institution-building activity of committed philosophers making a space within the institutional structures of philosophy for their own projects and other projects aligned with them and transmitting these as live philosophical projects to the next generation. Regulation must target the financial sector, which often funds and profits from environmentally unsustainable development. In an era of global financial markets, the financial sector has a crucial impact on the state of the environment. The long-standing movement for ethically and socially responsible investment (SRI) has recently begun to advocate environmental standards for financiers. While this movement is gaining more adherents, it has increasingly justified responsible financing as a path to be prosperous, rather than virtuous. This trend partly owes to (...) how financial institutions view their legal responsibilities. The business case motivations that now predominantly drive SRI are not sufficient to make the financial sector a means to sustainable development. Some modest legal reforms to improve the quality and extent of SRI have yet to make a tangible difference. A more ambitious strategy to promote SRI for environmental sustainability is possible, based on reforming the fiduciary duties of financial institutions. Such duties, tied to concrete performance standards, could make financiers invest in more ethically responsible ways. Other collateral reforms to financial markets, including improved corporate environmental reporting, are required to promote sustainability. (shrink)

This Element offers a new account of the philosophical significance of logical empiricism that relies on the past forty years of literature reassessing the project. It argues that while logical empiricism was committed to empiricism and did become tied to the trajectory of analytic philosophy, neither empiricism nor logical analysis per se was the deepest philosophical commitment of logical empiricism. That commitment was, rather, securing the scientific status of philosophy, bringing philosophy into a scientific conception of the world.

There is often substantial disparity between philosophical ideals and scientific practice. Philosophical reductionism is motivated by a drive for ontological austerity. The vehicle is conceptual parsimony: the fewer our conceptual primitives, the less are our ontological commitments. A general moral to be drawn from my “Functionalism and Reductionism” is that scientific reduction does not, and should not be expected to, facilitate conceptual economy; yet reduction it still is, and in the classical mold. Those who press for the irreducibility of a (...) functional psychology have been seduced by an inadequate account of scientific reduction. Patricia Kitcher is unhappy with my argument because it fails to live up to her philosophical ideals. “The claim that psychology is irreducible to neurophysiology,” she suggests, “rests to a large extent on the fact that, even in principle, neurophysiology is not capable of carrying out the explanatory work of a functional psychology”. Bodily awareness is a kind of perceptual awareness of the body that we do not usually count as a sense. I argue that that there is an overlooked agential difference between bodily awareness and perception in the five familiar senses: a difference in what is involved in perceptual activity in sight, hearing, touch taste and smell on the one hand, and bodily awareness on the other.

The Homeric Scholia are not the most obvious source for literary criticism in the modern sense. And yet if one takes the trouble to read through them one will find many valuable observations about poetic technique and poetic qualities. Nowadays we tend to emphasize different aspects from those which preoccupied ancient critics, but that may be a good reason for looking again at what they have to say.

Este ensaio examina o relacionamento possível entre o pensamento de Martin Heidegger enquanto emerge no Zollikon Seminaire na sua troca de idéias com Medard Boss e a perspectiva da psicanálise como aparece através do prisma da releitura de Freud oferecido por Jacques Lacan. Heidegger entende Freud como vítima de uma compreensão positivista da ciência que procura explicar o comportamento humano patológico por um complexo de causas discerníveis conscientemente. Quando determinados fenômenos não podem ser explicados desta maneira, Freud postula um jogo (...) de causas psíquicas que não são conscientes, cuja soma ele chama o "inconsciente". Desde que todos os fenômenos humanos são, para Heidegger, discerníveis via uma profunda fenomenologia do ser humano como o ser-no-mundo, a construção hipotética de Freud é desnecessária e, a longo prazo, perniciosa. Mas Lacan propõe uma nova maneira de compreender o inconsciente descoberto por Freud, a saber, que não deve ser entendido como um sistema físico de forças hidráulicas, mas como um processo que seja estruturado como um idioma. A pergunta levantada neste ensaio é se Heidegger seria ou não igualmente hostil à hipótese de Freud, apresentada a ele dentro da forma de Lacan, como algo "estruturado como um idioma". O ensaio sugere que a resposta poderia ser "provavelmente não". Baseado num exemplo clínico altamente simplificado, este ensaio esforça-se para mostrar a compatibilidade entre determinados conceitos básicos de Heidegger e diversos, de Lacan, em especial as noções da verdade e da liberdade.This paper examines the possible relationship between the thought of Martin Heidegger as it emerges in the Zollikon Seminaire through his exchange with Medard Boss and the perspective of psychoanalysis as it appears through the prism of Jacques Lacan's rereading of Freud. Heidegger takes Freud to be victim of a positivist conception of science that seeks to explain pathological human behaviour by a complex of consciously discernible causes. When certain phenomena cannot be explained in this way, Freud postulates a set of psychic causes that are not conscious, the sum total of which he calls the "unconscious." Since all human phenomena are, for Heidegger, discernible through a thorough-going phenomenology of human being as being-in-the-world, Freud's hypothetical construct is unnecessary and, in the long run, pernicious. But Lacan proposes a new way to understand the unconscious that Freud discovered, namely, that it is not to be thought of as analogous to a physical system of hydraulic forces but rather to a process that is structured like a language. The question raised in the paper is whether or not Heidegger would have been equally hostile to Freud's hypothesis, if it had been presented to him in Lacanian fashion as something "structured like a language". The paper suggests that the answer could be "probably not". On the basis of a highly simplified clinical example, it endeavors to show the compatibility between certain basic Heideggerean concepts and several of those essential to Lacan, especially the notions of truth and freedom. The received view of the anti-metaphysics of Camap's Aufbau finds that it rests exclusively on verificationism. Alberto Coffa has recently put forward an interpretation of the antimetaphysical stance that claims that Camap was confusedly moving from ontological to semantical ideahsm. After raising objections to both of these views another interpretation is put forward. The crucial aspect of Camap's rejection of metaphysics rests on his reinterpretation of epistemology as the logic of objective knowledge. This leads to a rejection of metaphysics inasmuch (...) as the peculiar status of logic as the framework constitutive of the possibility of rational inquiry means that it neither needs nor allows of completion or interpretation by traditional metaphysics. Exception from Informed Consent (EFIC) regulations detail specific circumstances in which Institutional Review Boards (IRB) can approve studies where obtaining informed consent is not possible prior to subject enrollment.To better understand how IRB members evaluate community consultation (CC) and public disclosure (PD) processes and results, semi-structured interviews of EFIC-experienced IRB members were conducted and analyzed using thematic analysis.Interviews with 11 IRB members revealed similar approaches to reviewing EFIC studies. Most use summaries of CC activities to determine community members’ attitudes; none (...) reported using specific criteria nor recalled any CC reviews that resulted in modifications to or denials of EFIC studies. Most interviewees thought metrics based on Community VOICES’s domains (feasibility, participant selection, quality of communication, community perceptions, investigator/IRB perceptions) would be helpful.IRB members had similar experiences and concerns about reviewing EFIC studies. Development of metrics to assess CC processes may be useful to IRBs reviewing EFIC studies. (shrink)

Genetic regulatory networks are complex, involving tens or hundreds of genes and scores of proteins with varying dependencies and organizations. This invites the application of artificial techniques in coming to understand natural complexity. I describe two attempts to deploy artificial models in understanding natural complexity. The first abstracts from empirically established patterns, favoring random architectures and very general constraints, in an attempt to model developmental phenomena. The second incorporates detailed information concerning the genetic structure, organization, and dependencies in actual systems (...) in an attempt to explain developmental differences. The results offered by these models, pitched at these different levels of abstraction, are different. The more detailed models are more continuous with classical developmental approaches. (shrink)

Bounded rationality is a fundamental feature of cognition. We make choices between alternatives in light of our goals, relying on incomplete information and limited resources. As a consequence, PROBLEM SOLVING cannot be exhaustive: we cannot explore all the possibilities which confront us, and search must be constrained in ways that facilitate search efficiency even at the expense of search effectiveness. If we think of problem solving as a search through the space of possibilities as it was conceptualized by Allen Newell (...) and Herbert A. Simon, limitations on search entail that for all but the simplest problems we can investigate at most a small proportion of the possibilities. Moreover, our evaluation of these possibilities will be uncertain and incomplete. We must rely on heuristic methods for pruning the tree of possibilities and for evaluating the possibilities we consider. In medical diagnosis, for example, the problem is one of inferring what disease is present from a given set of symptoms, when no one symptom is invariably present with a given disease, and the same symptom can have various causes. Moreover, patients can be suffering from more than one disease, a fact which compounds the difficulties of accurate diagnosis. Given that symptoms cannot generally be assumed to be independent and are noisy indicators of the underlying disease, the size of the search space turns out to be large, and inference concerning underlying diseases is inevitably uncertain. One solution is to limit the range of the search, eliminating some candidates as implausible; that is, we may adopt assumptions limiting the range of diseases considered to a narrow range of those antecedently likely. Good diagnosticians evidently narrow the range to no more than a handful of candidates. Search must be limited in order to be efficient. (shrink)

A generic grounding claim is a grounding claim that isn’t about any particular entity or fact. For example, consider the claim: an act is right in virtue of maximizing happiness. One natural idea is that generic grounding claims state mere regularities of ground. So if an act is right in virtue of maximizing happiness, then every possible right act is right in virtue of maximizing happiness. The generic claim generalizes over particular grounding relations. In this essay, I argue that this (...) simple story is wrong. Generic grounding claims are not merely quantificational; rather, they express real definitions, where real definitions are (in part) claims about essence. My view has two major upshots: ('i') it makes better sense of debates where generic grounding claims are at issue (like debates about moral laws); ('ii') it clarifies the distinction between reductive and non-reductive metaphysical theories. In this paper I argue that the program of L. Laudan et al for empirically testing historiographical philosophies of science ("the VPI program") does not succeed in providing a consistent naturalist program in philosophy of science. In particular, the VPI program endorses a nonnaturalist metamethodology that insists on a hypothetico-deductive structure to scientific testing. But hypothetico-deductivism seems to be both inadequate as an account of scientific theory testing in general and fundamentally at odds with most of the historiographic philosophies under (...) test. I sketch an account of testing historiographic philosophies of science more consistent with the views about scientific testing of those philosophies and argue that such a program is neither viciously circular nor necessarily self-refuting. Machine Learning (ML) and Artificial Intelligence (AI) are for many the defining features of the early twenty-first century. With such a provocation, this essay considers how one might understand the relational philosophies articulated by Indigenous learning scientists, Indigenous technologists and feminine philosophers of education as co-constitutive of an ensemble mediating or regulating an educative philosophy interfacing with ML/AI. In these mediations, differing vocabularies – kin, the one caring, cooperative – are recognized for their ethical commitments, yet challenging epistemic claims in (...) the contexts of ML. Similarly, ML poses some questions to claims made about relational and Indigenous epistemologies, where the latter is perceived as separated from and unaffected by computation specifically or algorithmic societies generally. This essay seeks to gain several vantage points to explore and complicate how diverse relational philosophies can address ML and perhaps reconsider their own critical practices. (shrink)

Second, that the linear/additive model of genetic causes of form and variation is not supported by recent progress in molecular biology. It concludes with an appeal for a (biologically and psychologically) more realistic model of such causes.

Pour aider ces populations de façon effective, et de façon efficace du point de vue de l’État, beaucoup de pays visent à réaliser une meilleure intégration des services sociaux. a re-analysis of Old Babylonian letters reveals the construction of class identity for men called “gentlemen” through their use of sympathetic expressions positioning correspondents as brothers, friends, colleagues, etc. While this observation is not new, this article makes two further points. First, I argue that class consciousness was created through the policing of failures to enact the social relations expressed in the letters, rather than superficial claims that such relations existed in the first place. This reading requires that we engage (...) seriously with the contingent nature of class identity—that fears and anxieties about falling out of status were more in evidence as the motor for and incentive towards class membership than simple claims of inclusion or group solidarity. Second, I argue that the sympathy enjoined by the letters simulated the affective-spatial cognitive states necessary for group identity. Group problems of geographic and physical distance and even loneliness were solved by the letters’ production of sympathy. Not only does a sincere consideration of the subjective experience of class formation require an understanding of individual and group emotional states, the letters themselves, filled with expressions of pathos and worry, invite it. Much recent work in sociobiology can be understood as designed to demonstrate the sufficiency of selection operating at lower levels of organization by the development of models at the level of the gene or the individual. Higher level units are accordingly viewed as artifacts of selection operating at lower levels. The adequacy of this latter form of argument is dependent upon issues of the complexity of the systems under consideration. A taxonomy is proposed elaborating a series of types, or grades, (...) of hierarchically organized systems. These range from aggregative systems, in which there is no organization relevant to systemic properties, through several graded variations reflecting various degrees of functional interdependence of components, to integrated systems, which manifest component specialization and diversification as well as a subordination of component function to systemic function. It is suggested that the most complex form of organization is plausibly treated as indicative of higher level units of selection. (shrink)

The retrotransposon Long Interspersed Element 1 (LINE‐1 or L1) has played a major role in shaping the sequence composition of the mammalian genome. In our recent publication, “Heritable L1 retrotransposition in the mouse primordial germline and early embryo,” we systematically assessed the rate and developmental timing of de novo, heritable endogenous L1 insertions in mice. Such heritable retrotransposition events allow L1 to exert an ongoing influence upon genome evolution. Here, we place our findings in the context of earlier studies, and (...) highlight how our results corroborate, and depart from, previous research based on human patient samples and transgenic mouse models harboring engineered L1 reporter genes. In parallel, we outline outstanding questions regarding the stage‐specificity, regulation, and functional impact of embryonic and germline L1 retrotransposition, and propose avenues for future research in this field. -/- . This article considers how diplomacy can be refined and amplified within the field of multicultural education. Focusing on Native American peoples in particular, I argue that the multiculturalist emphasis on cultural diplomacy overlooks the political difference of First Nations peoples. In contrast to a multiculturalist cultural diplomacy, the article develops diplomacy according to a decolonial framework that seeks to dismantle colonial perspectives of Native American political difference. Drawing upon theorists and historians of diplomacy, as well as Indigenous and decolonial writers, (...) the article seeks to provide the terms through which teacher identifications as decolonial diplomats can be fostered toward Native Americans. This chapter briefly reviews the historical development of research into differences between women and men as it relates to contemporary discussions concerning actual or potential differences in cognition. In addition, methodological issues that are involved in research on differences between men and women and the broad variety of theoretical accounts that tend to be put forward in order to explain the findings obtained in such research are considered. Some of these issues are shown by discussing the research findings obtained in (...) the case of one particular measure of spatial ability, the Rod and Frame Test. In general, the range of theoretical options that have been exploited in endeavoring to explain observed differences between men and women in terms of their cognitive performance are described.
