Collingridge’s dilemma is one of the most well-established paradigms presenting a challenge to Technology Assessment (TA). This paper aims to reconstruct the dilemma from an analytic perspective and explicates three assumptions underlying the dilemma: the temporal, knowledge and power/actor assumptions. In the light of the recent transformation of the science, technology and innovation system—in the age of technoscience —these underlying assumptions are called into question. The same result is obtained from a normative angle by Collingridge himself; he criticises the dilemma (...) and advances concepts on how to keep a technology controllable. This paper stresses the relevance of the dilemma and of Collingridge’s own ideas on how to deal with the dilemma. Today, a positive interpretation of technoscience for effective TA is possible. This article contributes to the analysis of refusal to license cases as abuse of a dominant position pursuant Article 82 EC from an economic perspective. In the Microsoft case, the European Commission introduced an "Incentives Balance Test" to assess whether the refusal to give access to interface information can be justified by arguing that this information is protected by Intellectual Property Rights (IPRs): The Commission argued that if the overall innovative effects evoked by a compulsory license are significantly higher than (...) without this access, the IPR owner is obliged to license. This should be assessed through balancing the different incentives to innovate between the dominant firm and its competitors. In the paper we pursue two objectives: Firstly, we analyze to what extent the decision of the Court of First Instance, which confirmed the decision of the Commission, helps to clarify the criteria in refusal to license cases; in fact, it is disappointing in this regard. Secondly, we demonstrate that the basic idea of the Incentives Balance Test can be interpreted as a test whether the specific IPRs of the dominant firm can be defended from the perspective of the economics of IPRs. This implies that Article 82 allows competition law to correct economically not optimal IPRs through a specific economic analysis. This is followed by a broad overview on theoretical and empirical insights from economics of IPRs, innovation economics and competition and network economics that can help to develop a more general and sophisticated Innovation Effects Test that can be applied in Article 82 refusal to license cases. The objective of this paper is to contribute to the expanding discourse on conceptual elements of TA. As a point of departure, it takes the recent transformation of the science, technology and innovation system ( technoscience ). We will show that the age of technoscience can be regarded as presenting not only a challenge, but also a chance and opportunity for TA. Embracing this opportunity, however, implies imposing several requirements on TA. In order to specify these requirements and to foster (...) the ongoing discourse on the foundations of TA, this paper suggests a programmatic term: prospective technology assessment (ProTA). This term is intended mainly as a reflection framework, aimed at providing an extension and complement—and not a replacement—of well-established TA concepts. Three requirements for ProTA are sketched: (1) early stage orientation—the temporal dimension, (2) intention and potential orientation—the knowledge dimension, (3) shaping orientation—the power/actor dimension. Examples from fusion and nano research will illustrate the need for ProTA, as well as its specific focus. The paper concedes that ProTA is in its infancy and that there is a clear need for further clarification. (shrink)

I argue that there is an important problem with framing the value of a liberal arts education through a contrast between intrinsic and instrumental value. The paper breaks down into three sections. First, I argue that the traditional divide between intrinsic and instrumental value conflates two pairs of related concepts and that distinguishing those concepts frees us from an important impasse found in contemporary discussions about the liberal arts. Second, I argue that a liberal arts education is only intelligible as (...) a practice if we value it for its own sake. Third, I explain how we can value a liberal arts education as an end even if we reject the possibility of intrinsic value. I conclude with a brief statement of the practical implications my account has for the way we approach the liberal arts. (shrink)

Recent discussions about the cognitive value of fiction either rely on a background theory of reference or a theory of imaginative pretense. I argue that this reliance produces a tension between the two central or defining claims of literary cognitivism that: (1) fiction can have cognitive value by revealing or supporting insights into the world that properly count as true, and (2) that the cognitive value of a work of fiction contributes directly to that work’s literary value. I address that (...) tension by looking at the formal devices present in a work of fiction that enable it to realize the fictional world described by a text. When we focus on those formal elements, we can identify a connection between a work of literary fiction and the insights we gain through an encounter with the fictional world that work realizes. One common set of arguments against universal markets contends that the special status of certain goods (e.g., organs, reproductive services, or native artifacts) makes it inappropriate or wrong to compare their worth to the value of a commodity or to some amount of money. These arguments rest on the fear that market valuations would distort the way we value the goods in question rather than the fear that their sale could exploit or directly harm the people involved in the exchange. In this paper I use behavioral economics to explain why these arguments persuade so many people despite the fact that we already engage in a wide range of economic valuations with respect to those contested domains. I conclude by identifying the implications this has for the broader debate over contested markets. (shrink)

The fate of root epidermal cells is controlled by a complex interplay of transcriptional regulators, generating a genetically determined, position‐biased arrangement of root hair cells. This pattern is altered during postembryonic development and in response to environmental signals to confer developmental plasticity that acclimates the plant to the prevailing conditions. Based on the hypothesis that events downstream of this initial mechanism can modulate the pattern installed during embryogenesis, we have developed a reaction diffusion model that reproduces the root hair patterning (...) previously observed experimentally. Under all growth conditions, an almost equal spacing between root hair forming cells was observed both in vitro and in silico, indicating that long‐range intercellular communication is crucial for the trichoblasts' decision to form a root hair. We assume that a hair growth promoter (HGP) is upregulated in root‐hair‐forming cells by a trichoblast‐specific component. Once established, HGP production is self‐enhancing. The autocatalytic regulation of HGP is antagonized by an HGP‐produced hair growth inhibitor (HGI). HGI is exported from trichoblasts and diffuses to neighboring cells, where it inhibits further HGP production and promotes the non‐hair cell fate. Under conditions of phosphate deficiency, we hypothesise that HGP production is increased and HGI diffusion rate is reduced, leading to a position‐independent formation of extra root hairs. I Die vermeintliche „Überwindung“ der politischen Theologie Die Geschichte der politischen Theologie in der Moderne erweist sich vorläufig immer noch als die Geschichte ihrer misslungenen Überwindungen. Trotz ihrer vielfachen Erledigungen zeigt die politische Theologie, entgegen Hans Blumenbergs Prognose, eine erstaunliche Fähigkeit zur „Selbstbehauptung“. Ihre Resistenz verdankt sie dabei nicht zum Geringsten der Prätention all derjenigen Gegner, die meinten, man könne, indem man eine spezifische Form von politischer Theologie kritisiert, gleich mit allen Spielarten des politisch-theologischen Diskurses aufräumen. Ohnehin werden die meisten (...) Überwindungen der politischen Theologie im Namen einer anderen politischen Theologie vorgenommen. So die berühmteste, von Erik Peterson stammende Widerlegung, die als Fazit der Untersuchung zum „Monotheismus als politisches Problem“ gegen Carl Schmitts politische Theologie gewendet war und den eher anstößigen Sprachgebrauch von der „Erledigung“ in Umlauf gebracht hat. Sie wurde von Peterson jedenfalls im Namen der trinitarischen Theologie des Augustinus vorgenommen, wobei Peterson eine solche Erledigung schon im Rahmen einer an Paulus' Römerbrief orientierten Theopolitik erprobt hatte. Darüber hinaus muss der Begriff der politischen Theologie nicht notwendig gegen die „Legitimität der Moderne“ eingesetzt sein, sondern versteht sich oft genug als deren dialektische Kritik, wie etwa bei Martin Buber, Paul Tillich oder später bei Jürgen Moltmann und Johann Baptist Metz. Many of our attitudes are non-culpable: there was nothing that we should have done to avoid holding them. I argue that we can still be blameworthy for non-culpable attitudes: they can impair our relationships in ways that make our full practice of apology and forgiveness intelligible. My argument poses a new challenge to indirect voluntarists, who attempt to reduce all responsibility for attitudes to responsibility for prior actions and omissions. Rationalists, who instead explain attitudinal responsibility by appeal to reasons-responsiveness, can (...) make sense of blameworthiness for non-culpable attitudes. In response, voluntarists could propose a revision of our actual practices. This would lead us into a quite different debate. (shrink)

Forms, Matter and Mind. Three Strands in Plato’s Metaphysics -/- This book offers a new interpretation of Plato’s conception of man and of how it develops in the Corpus. Commonly, Plato’s anthropology is considered to be a version of naïve Orphism with the soul being a heavenly, but fallen, daemon. This is shown to be a misleading over-simplification. An examination of three basic and interrelated strands in Plato’s thought (Forms, Matter and Mind) demonstrates how Plato’s conception of man is an (...) integrated part of his metaphysics and develops with it. Thus, a change can be seen from a fairly unreflecting Socratic beginning via a transcendent soul to a rather sophisticated ‘Aristotelianism’. What is at issue is a non-materialistic, or more precisely, a dualistic view of man that has been discredited in modern times by two preconceptions: a widespread opinion that dualism must mean or involve Cartesianism, which seems untenable, and an equally widespread and, until recently, unshaken belief that man can be exhaustively described in materialistic terms. Both assumptions are questioned today. The present work shows that Plato’s view of man is fundamentally different from Cartesianism and furthermore that he rejects the materialist view as well. Hence, the book shows Plato’s increasing relevance for the current debate on the nature and possibilities of man. (shrink)

For the purpose of contributing to a clarification of the term “process”, different kinds of musical processes are investigated: A rule-determined phase shifting process in Steve Reich's Piano Phase (1966), a model for an indeterminate composition process in John Cage's Variations II (1961), a number of evolution processes in György Ligeti's In zart fliessender Bewegung (1976), and a generative process of fractal nature in Per Nørgård's Second Symphony (1970). In conclusion I propose that six process categories should be included in (...) a typology of processes: Rule-determined, goal-directed and indeterminate transformation processes, and rule-determined, goal-directed and indeterminate generative processes. There are several theses in political science that are usually explicitly called ‘laws’. Other theses are generally thought of as laws, but often without being explicitly labelled as such. Still other claims are well-supported and arguably interesting, while no one would be tempted to call them laws. This situation raises philosophical questions: which theses deserve to be called laws and which not? And how should we decide about this? In this paper we develop and motivate a strategy for thinking about (...) laws in political science which integrates two core concepts: spatio-temporal stability and social mechanisms. The proposed strategy is a set of guidelines that political scientists can use to reflect on and argue about specific cases within their discipline, not a clear-cut demarcation criterion. We defend and motivate this strategy and apply it to two cases (one with respect to state repression, one about parliamentary elections). After we have developed and motivated our strategy for political science, we show that our proposal is relevant for other disciplines in the social sciences. We explain how our views fit into critical realism and embed them in the debate on laws in general philosophy of science and in the philosophy of the social sciences. (shrink)
