The automatic prediction of court case judgments using Deep Learning and Natural Language Processing is challenged by the variety of norms and regulations, the inherent complexity of the forensic language, and the length of legal judgments. Although state-of-the-art transformer-based architectures and Large Language Models (LLMs) are pre-trained on large-scale datasets, the underlying model reasoning is not transparent to the legal expert. This paper jointly addresses court judgment prediction and explanation by not only predicting the judgment but also providing legal experts (...) with sentence-based explanations. To boost the performance of both tasks we leverage a legal named entity recognition step, which automatically annotates documents with meaningful domain-specific entity tags and masks the corresponding fine-grained descriptions. In such a way, transformer-based architectures and Large Language Models can attend to in-domain entity-related information in the inference process while neglecting irrelevant details. Furthermore, the explainer can boost the relevance of entity-enriched sentences while limiting the diffusion of potentially sensitive information. We also explore the use of in-context learning and lightweight fine-tuning to tailor LLMs to the legal language style and the downstream prediction and explanation tasks. The results obtained on a benchmark dataset from the Indian judicial system show the superior performance of entity-aware approaches to both judgment prediction and explanation. (shrink)

The book is an analysis of Kant’s uses and definitions of the three concepts ‘transcendental philosophy’, ‘ontology’ and ‘logic’. It first focuses on Kant’s definitions of ‘transcendental’ in the Critique of Pure Reason, where the term is used for the very first time with a programmatic meaning, as the qualification of Kant’s specific philosophical standpoint. Secondly, it reconstructs Kant’s position towards metaphysics and ontology in his pre-critical and critical writings, as well as its premises in the Leibnizian and Wolffian metaphysics. (...) Aristotle is a political scientist and a student of biology. Political science, in his view, is concerned with the human good and thus it includes the study of ethics. He approaches many subjects from the perspective of both political science and biology: the virtues, the function of humans, and the political nature of humans. In light of the overlap between the two disciplines, I look at whether or not Aristotle’s views in biology influence or explain some of his theses in (...) political science. I show that we should not seek a unified answer to this question, for the relationship between the two disciplines varies depending on the topic. In some cases, e.g. the nature of the human function, the biological background is likely to be endorsed as one of the presuppositions of the ethical enquiry. In other cases, e.g. the study of social hierarchies, even though the ethical works and the biological works come to similar conclusions, it is hard to establish that the biological approach is intended to provide support to the ethico-political approach. In conclusion, I show that Aristotle’s political science and his biology are in conflict at least in two important cases: his account of justice towards non-human animals and his exhortation to contemplate. Aristotle’s works on natural science show that he was aware of the affective powers of colour. At De an. 421a13, for example, he writes that hard-eyed animals can only discriminate between frightening and non-frightening colours. In the Nicomachean Ethics, furthermore, colours are the source of pleasures and delight. These pleasures, unlike the pleasures of touch and taste, neither corrupt us nor make us wiser. Aristotle’s views on the affective powers of colours raise a question about the limits he seems to (...) place on the affective powers of pictures at De an. 427b15-24, where he implies that pictures do not affect us immediately. In this paper, I examine the contrast between the affective powers of colour and the affective powers of pictures. I argue that colours can give rise to pleasure and pain in themselves and generate emotions incidentally. Similarly, pictures can please us or affect us in themselves and incidentally. In light of this account, I suggest that, on a plausible reading of De an. 427b15-24, the affective powers of pictures as mimetic objects are not immediate because they require an intervening cause in order to be effective. The representations of pictures and statues affect us either with the mediation of deception or with the mediation of interpretation. (shrink)

The article analyses Hegel's use of the expression >das Logische die Logik das Logische das Logische das Dialektische<. This shows in my point of view that the Jena logic is already conceived as metaphysics, and that dialectics is the very core of the identity of logic and metaphysics.

This book examines the most controversial issues concerning the use of pre-drafted clauses in fine print, which are usually included in consumer contracts and presented to consumers on a take-it-or-leave-it basis. By applying a multi-disciplinary approach that combines consumer's psychology and seller's drafting power in the logic of efficiency and good faith, the book provides a fresh and unconventional analysis of the existing literature, both theoretical and empirical. Moving from the unconscionability doctrine, it criticizes (and in some cases refutes) its (...) main conclusions based on criteria which are usually invoked to sustain the need for public intervention to protect consumers, and specifically related to Law (contract complexity), Psychology (consumer lack of sophistication criterion) and Economics (market structure criterion). It also analyzes the effects of different regulations, such as banning vexatious clauses or mandating disclosure clauses, showing that none of them protect consumers, but in fact prove to be harmful when consumers are more vulnerable, that is whenever sellers can exploit some degree of market power. In closing, the book combines these disparate aspects, arguing that the solution (if any) to the problem of consumer exploitation and market inefficiency associated with the use of contracts of adhesion in these contexts cannot be found in removing or prohibiting hidden clauses, but instead has to take into account the effects of these clauses on the contract as a whole. Since it implies a reduction in the quality and the quantity of the natural resources, environmental degradation is a present day problem that requires immediate solutions. This situation is driving firms to undertake an environmental transformation process with the purpose of reducing the negative externalities that come from their economic activities. Within this context, environmental marketing is an emerging business philosophy by which organizations can address sustainability issues. Moreover, environmental marketing and orientation are seen as valuable strategies to improve a (...) firm's competitiveness. However, the literature that has analyzed the link between environmental strategies and firms' results has been inconclusive and contradictory. In this study, we propose and test a model that analyses how the implementation of ecological issues within a firm's marketing strategy and orientation influences organizational results. Data were obtained through a survey sent to Spanish manufacturing firms. The results show that environmental marketing positively affects firms' operational and commercial performance and this improvement will influence their economic results. Moreover, environmental marketing is revealed as an excellent strategy to obtain competitive advantages in costs and in product differentiation. Thus, this study agrees with the researchers who affirm that environmental strategies positively affect firm's competitiveness while reducing environmental impact. (shrink)

Russians and Westerners access, process and communicate information in different ways. Whilst Westerners favour detailed analysis of subject matter, Russians tend to focus on certain components that are, in their view, significant. This disparity makes it difficult to achieve constructive dialogues between Western and Russian stakeholders contributing to cross-cultural communication problems. The author claims that the difference in the ways Russians and Westerners negotiate information is a significant cultural difference between Russia and West rather than an irritating (and in principle (...) amenable) lack of analytical skills on the Russian partners’ part. Understanding the reasons behind the Russian-specific approaches to dealing with information would be a positive step towards a more effective cross-cultural communication, important in business situations and essential in diplomacy. This essay analyses Hegel’s use of the metaphor of «the cross and the rose», not only in the Preface to the Grundlinien der Philosophie des Rechts, which all major interpretations refer to, but also in two other texts: Wer denkt abstrakt? of 1807 and the 1829 review of Schubart's and Garganico’s Über Philosophie überhaupt... In Wer denkt abstrakt? Hegel criticizes a sentimental, as equivalent to a «non concrete», interpretation of the figure; in the Preface he claims that «reason is the (...) rose in the cross of the present», assimilating the image to a platonic idea of State; in the review of 1829 he criticizes a naïve interpretation of the figure. In the light of these observations, it is possible to conclude that Hegel sees the figure as the specific image of the relation of the platonic and the critical element, typical of dialectical rationality. The Hegelian use of the figure thus results, in this perspective, by far more subtle than the one envisaged by its “political” interpretations. (shrink)

The paper examines the invariance principles proposed by the analytical and phenomenological traditions for demarcating the boundaries of formal and regional ontologies. The principle of invariance with respect to isomorphic transformations, generalizing Alfred Tarski’s criterion for logical concepts, is extended to formal ontology as the theory of manifolds in its phenomenological interpretation. Isomorphism types, which are abstract individuals of the highest order, hypostases of forms of all possible ontologies, are considered as model-theoretical analogs of manifolds. The correlativity of the phenomenological (...) principles of demarcation of ontological regions and the criterion of invariance with respect to isomorphic transformations is demonstrated, leading to the convergence of logic and formal mathematics in both traditions and, at the same time, to the exclusion of geometry from formal ontology. Particular attention is paid to the discussion of the analytical and phenomenological traditions of the synthetic (material) a priori and the contribution that Wittgenstein’s doctrine on internal relations at different stages of its evolution makes to this discussion. The paper reveals the basis for later Wittgenstein’s criticism of his earlier project of creating a phenomenological language for expressing internal regional relations (such as the colours exclusion). The paper shows how Wittgenstein’s doubts about the possibility of an ideal notation based on the dichotomy of the logical and phenomenological led him to the study of invariants arising in language games. These invariants are not determined by the special properties of the categorical objects of formal ontology or the structures of regional subject matter, but are stable equilibria generated by the “consensus of actions.” New perspectives are outlined that are opened for logic and phenomenology by switching focus from the invariants of ontological structures to the invariants of structured interactions of various agents. For Bergson, creating a masterpiece and perceiving it amounts to an act of intuitive communication between the artist and the spectator. Both the artist and the viewer intuit the work of art, which is something other than their own personal history, something that belongs to both of them and at the same time exists independently from them. The Bergsonian concept of heterogeneous duration, which primarily refers to consciousness and living processes, is extended in this instance to artistic communication as a (...) process that unites creation and contemplation. Artistic creation and communication constitute an intimate ontological bonding wherein human beings actualize their ability to intuit and where an artist shares with the audience his or her deep emotions without revealing personal data. This process of creation and perception of art could be named artistic duration or artistic communication. This duration is created by a joint participation of more than one individual and represents duration that escapes the boundaries of one mind because it is created by more than one mind. The artist initiates a continuity of emotion, by expressing it in art and making us feel it when we admire the masterpiece. By perceiving it, we do not return to the artist’s time and re-live his or her artistic creation vicariously, but pick up where the artist left this creation and let it live further on in our soul. The place occupied by Kant’s philosophical ideas in the reflections of the Russian philosopher, Nikolay Strakhov, needs further study. The material for a historical-philosophical reconstruction of Strakhov’s reception of Kant’s philosophy is the Russian thinker’s home library catalogue, his correspondence and his own philosophical works. Among Strakhov’s interlocutors were not only philosophers and natural scientists, but also writers, including Fyodor Dostoevsky, Leo Tolstoy and Afanasy Fet, who in many ways determined the cultural and intellectual horizon of the epoch. The many (...) years of correspondence with the last two writers went a long way to shape and develop Strakhov’s perception of Kant as a thinker. Indeed, without a virtual dialogue with Kant no modern philosophical system can be built. Strakhov’s reflections on the Kantian style of thinking, adoption of Kantian criticism as the model of epistemic analysis in many ways determined the features of his own philosophical work and became a catalyst of renewed interest in Russia in the Kantian philosophy in the last third of the nineteenth century. The study is devoted to construct a typology of discourses about a miracle. Discourses are interpreted in this case not in a linguistic, but in a philosophical sense, as a certain “way of talking” about a chosen phenomenon. This includes the ontological and ideological position of the speaker (writer), emotional and value pathos, a communicative attitude or lack thereof, a message to the listener (reader) of specific views and beliefs. The author distinguishes three groups of discourses on the ideological basis: (...) 1) a miracle, understood as supernatural, but accessible for communication; 2) a miracle understood as a man-made, purely human phenomenon; 3) a miracle as the result of a “dual determination” coming from both the transcendent and the person himself. The miracle is initially interpreted in the article as a positive phenomenon that can be described and expressed in speech without directly naming the word itself. Within the first group of discourses, the following are considered: religious (Christian), mythological and fairy-tale discourse, and the fate-providentialist discourse is also highlighted. The second approach, connected with the denial of the supernatural, speaks of a miracle in the context of its scientific and technical creation, as well as hopes for a miracle within the framework of progressive and utopian concepts. The third type of discourses, combining the view of a miracle as coming from above and from the person himself, includes mystical-magical, existential and creativistic discourses - interpreting the theme of creativity. The mystical-magical discourse describes a miracle as the result of illumination and as a consequence of persistent spiritual searches. In the existential discourse, represented by fiction, there is also a place for describing a miracle as a magical nature and a magical fate. In creative discourse, the miracle is the very act of the birth of a new one. Summing up what has been said, the author emphasizes that he presents readers with nothing more than a sketch that requires further work and thematic disclosure. (shrink)

The relationship between smell and politics could appear obscure; and yet, when it comes to smell, questions about freedom and constriction, social and ontological mingling or distinctions, clearly arise. In this paper, I will especially focus on the domain of food as a clear example for describing some of the political ambivalences characterizing the sense of smell. The aim is to pave the way for a more detailed ‘sociopolitical aesthetics of smell’ to come. I will stress epistemological and social features (...) of odors in order to highlight their ambivalence in knowledge and community life. Perceivers and odors will emerge as mingled bodies, highlighting an ongoing process of material as well as emotional affection. Moreover, I will present some relevant examples of smell as social status symbols in relation to the aesthetic values linked to class hierarchy. Consumerism and scented goods will be lastly discussed in order to shade light on contemporary perceptual phenomena and their role in the socioeconomic dimension. (shrink)

Most studies examining children's understanding of transitive sentences focus on the morphosyntactic properties of the construction and ignore prosody. But adults use prosody in many different ways to interpret ambiguous sentences. In two studies we investigated whether 5-year-old German children use prosody to determine participant roles in object-first (OVS) sentences with novel verbs (i.e., whether they use prosodic marking to overrule word order as a cue). Results showed that children identify participant roles better in this atypically ordered construction when sentences (...) are realized with the marked, OVS-typical intonational pattern, especially in combination with case marking (Study 1). In a second study, we embedded these sentences into an appropriate discourse context. The results show that, even in the absence of any case marking, children understand participant roles when they are realized with the appropriate intonational pattern. These findings demonstrate that young children can use intonation to help identify participant roles in transitive sentences, at least in marked constructions such as the German object-first (OVS) construction. More than a decade has passed since North American Indigenous scholars began a public dialogue on how we might “Indigenize the academy.” Discussions around how to “Indigenize” and whether it’s possible to “decolonize” the academy in Canada have proliferated as a result of the Truth and Reconciliation of Canada, which calls upon Canadians to learn the truth about colonial relations and reconcile the damage that is ongoing. Indigenous scholars are increasingly leading and writing about efforts in their institutions; efforts include (...) land- and Indigenous language-based pedagogies, transformative community-based research, Indigenous theorizing, and dual governance structures. Kim Anderson’s paper invites dialogue about how Indigenous feminist approaches can spark unique Indigenizing practices, with a focus on how we might activate Indigenous feminist spaces and places in the academy. In their responses, Elena Flores Ruíz uses Mexican feminist Indigenizing discourse to ask what can be done to promote plurifeminist indigenizing practices and North-South dialogues that acknowledge dynamic Indigenous pasts and diverse contexts for present interactions on Turtle Island. Georgina Tuari Stewart proceeds to describe Mana Wahine indigenous feminist theory from Aotearoa before proceeding to develop a “kitchen logic” of mana, which parallels Anderson’s understanding of tawow. Finally, Madina Tlostanova reflects on how several ways of advancing indigenous feminist academic activism described by Anderson intersect with examples from her own native Adyghe indigenous culture divided between the neocolonial situation and the post-Soviet trauma. In recent years, a change in attitude in particle physics has led to our understanding current quantum field theories as effective field theories. The present paper is concerned with the significance of this EFT approach, especially from the viewpoint of the debate on reductionism in science. In particular, it is a purpose of this paper to clarify how EFTs may provide an interesting case-study in current philosophical discussion on reduction, emergence and inter-level relationships in general.

Coordination is a widely employed term across recent quantitative and qualitative approaches to intersubjectivity, particularly approaches that give embodiment and enaction central explanatory roles. With a focus on linguistic and bodily coordination in conversational contexts, I review the operational meaning of coordination in recent empirical research and related theorizing of embodied intersubjectivity. This discussion articulates what must be involved in treating linguistic meaning as dynamic processes of coordination. The coordination approach presents languaging as a set of dynamic self-organizing processes and (...) actions on multiple timescales and across multiple modalities that come about and work in certain domains (those jointly constructed in social, interactive, high-order sense-making). These processes go beyond meaning at the level that is available to first-person experience. I take one crucial consequence of this to be the ubiquitously moral nature of languaging with others. Languaging coordinates experience, among other levels of behavior and event. Ethical effort is called for by the automatic autonomy-influencing forces of languaging as coordination. (shrink)

Following a usage-based approach to language acquisition, lexically specific patterns are considered to be important building blocks for language productivity and feature heavily both in child-directed speech and in the early speech of children (Arnon, Inbal & Morten H. Christiansen. 2017. The role of multiword building blocks in explaining L1-L2 differences. Topics in Cognitive Science 9(3). 621–636; Tomasello, Michael. 2003. Constructing a language: A usage-based theory of language acquisition. Cambridge: Harvard University Press). In order to account for patterns, the traceback (...) method has been widely applied in research on first language acquisition to test the hypothesis that children’s utterances can be accounted for on the basis of a limited inventory of chunks and partially schematic units (Lieven, Elena, Dorothé Salomo & Michael Tomasello. 2009. Two-year-old children’s production of multiword utterances: A usage-based analysis. Cognitive Linguistics 20(3). 481–508). In the current study, we applied the method to code-mixed utterances (n = 1,506) of three German-English bilingual children between 2 and 4 years of age to investigate individual differences in each child’s own inventory of patterns in relation to their input settings. It was shown that units such as I see X as in I see a Kelle ‘I see a trowel’ could be traced back to the child’s own previous productions. More importantly, we see that each child’s inventory of constructions draws heavily on multiword chunks that are strongly dependent on the children’s language input situations. (shrink)

This essay frames systemic patterns of mental abuse against women of color and Indigenous women on Turtle Island (North America) in terms of larger design-of-distribution strategies in settler colonial societies, as these societies use various forms of social power to distribute, reproduce, and automate social inequalities (including public health precarities and mortality disadvantages) that skew socio-economic gain continuously toward white settler populations and their descendants. It departs from traditional studies in gender-based violence research that frame mental abuses such as gaslighting--commonly (...) understood as mental manipulation through lying or deceit--stochastically, as chance-driven interpersonal phenomena. Building on structural analyses of knowledge in political epistemology (Dotson 2012, Berenstain 2016), political theory (Davis and Ernst 2017), and Indigenous social theory (Tuck and Yang 2012), I develop the notion of cultural gaslighting to refer to the social and historical infrastructural support mechanisms that disproportionately produce abusive mental ambients in settler colonial cultures in order to further the ends of cultural genocide and dispossession. I conclude by proposing a social epidemiological account of gaslighting that a) highlights the public health harms of abusive ambients for minority populations, b) illuminates the hidden rules of social structure in settler colonial societies, and c) amplifies the corresponding need for structural reparations. The enactive approach to cognition distinctively emphasizes autonomy, adaptivity, agency, meaning, experience, and interaction. Taken together, these principles can provide the new sciences of language with a comprehensive philosophical framework: languaging as adaptive social sense-making. This is a refinement and advancement on Maturana’s idea of languaging as a manner of living. Overcoming limitations in Maturana’s initial formulation of languaging is one of three motivations for this paper. Another is to give a response to skeptics who challenge enactivism to connect “lower-level” (...) sense-making with “higher-order” sophisticated moves like those commonly ascribed to language. Our primary goal is to contribute a positive story developed from the enactive account of social cognition, participatory sense-making. This concept is put into play in two different philosophical models, which respectively chronicle the logical and ontogenetic development of languaging as a particular form of social agency. Languaging emerges from the interplay of coordination and exploration inherent in the primordial tensions of participatory sense-making between individual and interactive norms; it is a practice that transcends the self-other boundary and enables agents to regulate self and other as well as interaction couplings. Linguistic sense-makers are those who negotiate interactive and internalized ways of meta-regulating the moment-to-moment activities of living and cognizing. Sense-makers in enlanguaged environments incorporate sensitivities, roles, and powers into their unique yet intelligible linguistic bodies. We dissolve the problematic dichotomies of high/low, online/offline, and linguistic/nonlinguistic cognition, and we provide new boundary criteria for specifying languaging as a prevalent kind of human social sense-making. East Asia’s economy is leading the world into the new Asian century. While meritocratic practices in the educational and private sectors are often considered pivotal conditions for East Asia’s economic success, experts have pointed out that the path ahead requires new approaches to ensure social cohesion and stability, which depend on the quality of relations across social divides. These considerations raise multiple questions for philosophers: What forms of social meritocracy are necessary to sustain social cohesion? Moreover, how can the detrimental (...) effects of meritocratic practices be contained? Is it possible to utilise some of the intellectual resources indigenous to East Asia to generate innovative solutions? This paper argues that the answers to these questions lie in the indigenous Confucian conceptual resources. Confucian ideas can inspire a more desirable societal ideal for the future of East Asia. In particular, the Confucian emphasis on cultivating reciprocal harmonious human relationships and others’ morality can guide new approaches to fostering social cohesion. As Confucian personal cultivation through harmonious relations is a process of social cohesion, these ideas inspire a) a multiple approach to policymaking that is not only grounded in economic redistribution, b) a richer understanding of societal progress, and c) a democratic approach to fostering social cohesion. Unlike Confucian meritocrats and scholars who defend the Confucian roots of East Asian forms of political and social meritocracy, this paper proves that Confucian conceptual resources can help formulate a societal vision that strengthens cohesion and mitigates the adverse effects of meritocratic practices. The question whether AI systems have agency is gaining increasing importance in discussions of responsibility for AI behavior. This paper argues that an approach to artificial agency needs to be teleological, and consider the role of human goals in particular if it is to adequately address the issue of responsibility. I will defend the view that while AI systems can be viewed as autonomous in the sense of identifying or pursuing goals, they rely on human goals and other values incorporated (...) into their design, and are, as such, dependent on human agents. As a consequence, AI systems cannot be held morally responsible, and responsibility attributions should take into account normative and social aspects involved in the design and deployment of the said AI. My argument falls in line with approaches critical of attributing moral agency to artificial agents, but draws from the philosophy of action, highlighting further philosophical underpinnings of current debates on artificial agency. In recent years postcolonial and decolonial feminisms have become increasingly salient in philosophy, yet they are often deployed as conceptual stand-ins for generalized feminist critiques of eurocentrism (without reference to the material contexts anti-colonial feminisms emanate from), or as a platform to re-center internal debates between dominant European theories/ists under the guise of being conceptually ‘decolonized’. By contrast, this article focuses on the specific contexts, issues and lifeworld concerns that ground anti-colonial feminisms and provides a brief survey of the literature. (...) Because the terms implicated in the analysis (Third World, transnational, women of color, postcolonial, decolonial and indigenous feminisms) are highly contested on their own, I only provide provisional and non-foundational histories and definitions for the purposes of resisting philosophical appropriations of anti-colonial feminist theory. Bioethics is a field in which innovation is required to help prevent and respond to zoonotic diseases with the potential to cause epidemics and pandemics. Some of the developments necessary to fight pandemics, such as COVID-19 vaccines, require public debate on the benefits and risks of individual choice versus responsibility to society. While these debates are necessary, a more fundamental ethical innovation to rebalance human, animal, and environmental interests is also needed. One Health (OH) can be characterized as a strategy (...) that recognizes and promotes the synergy between human, animal, and environmental health. Yet, despite the recognition that these entities are interdependent, there is a pronounced inequality in the power relations between human, non-human animal, and the environmental interests which threatens the well-being of all. Until OH can ensure the moral status of animals and the environment and thereby the equal consideration of these interests, it will struggle to protect non-human interests and, as a result, human health. To create a sustainable health system requires a renewed concept of justice that is ecocentric in nature and an application of OH that is flexible and responsive to different ethical interests (e.g., person-centred care and physician responsibilities). Ultimately, to save themselves, humans must now think beyond themselves. Bioethics must assume a key role in supporting the developments required to create and maintain relationships able to sustain environmental and human health. (shrink)

Ceramics workshops and exchange networks in the south-western Black Sea in the Classical period and the beginning of the Hellenistic period Within the archaeometrical programmes carried out in the framework of the National Research Agency project «Pont-Euxin » and thereafter within the French archaeological team at Apollonia Pontica, a representative sampling of 123 sherds focusing on Apollonia but also extending to the main Greek settlements along the Western Black Sea coast was submitted to XRF chemical analyse. Their data processing revealed (...) the existence of several distinct geochemical groups potentially corresponding to local or regional products. Concerning Apollonia itself, it evidenced the prominent role played by this city in pottery manufacture and distribution throughout the SW Pontic area, unveiling pottery trade networks along the Western Black Sea coast during the classical period. The justification of democracy, while widely debated, is hindered by a sub-optimal conceptual framework. For a start, there is confusion about the basic terms in the discussion. Many theorists claim to support either the ‘intrinsic’ or the ‘instrumental’ value of democracy, but it is unclear what this exactly means. Can democracy have other kinds of values? What does it mean to value democracy intrinsically? As a result, at certain points, scholars are talking past one another and their assessments of their (...) respective approaches to democracy are less clear than what they intended. This paper develops a conceptual framework of the values of democracy. I use this framework to classify theories of democracy under three main groups: theories that value democracy intrinsically, instrumentally, or contributorily (necessarily and non-necessarily). Through this analysis, the points of engagement among the different approaches will emerge and flawed arguments about democracy will be revealed. (shrink)

The article discusses the challenges, benefits, and risks that, from a bioethical perspective, arise because of the the development of eHealth projects. The conceptual framework of the research is based on H. Jonas’ principles of the ethics of responsibility and B.G. Yudin’s anthropological ideas on human beings as agents who constantly change their own boundaries in the “zone of phase transitions.” The article focuses on the events taking place in the zone of phase transitions between humans and machines in eHealth. (...) It is shown that for innovative practices related to digitalization and datafication in medicine, it is needed to rethink central bioethical concepts of personal autonomy and informed consent. In particular, the concept of broad or open informed consent is discussed, which allows the idea of moral responsibility in the field of biomedical technologies to be extended to events of uncertain future. The authors draw attention to the problems associated with the emergence of new autonomous subjects/agents in relationship between doctors and patients. The humanization of machines occurring in eHealth is accompanied by a counter trend – the formation of conceptions and practices of the quantified self. There emerges the practices of self-care and bio-power caused by the datafication and digitization of personality. The authors conclude that bioethics should proactively develop norms for the evolving interaction between doctor and patients. (shrink)

Ideal theory in social and political philosophy generally works to hide philosophical theories’ complicity in sustaining the structural violence and maintenance of white supremacy that are foundational to settler colonial societies. While non-ideal theory can provide a corrective to some of ideal theory’s intended omissions, it can also work to conceal the same systems of violence that ideal theory does, especially when framed primarily as a response to ideal theory. This article takes a decolonial approach to exploring the limitations of (...) non-ideal theory in its ability to respond to and redress the continuing harms done to Indigenous peoples by settler colonialism, including by outlining non-ideal theory’s relationship to a colonial politics of recognition. Intersectionality is a term that arose within the black feminist intellectual tradition for the purposes of identifying interlocking systems of oppression. As a descriptive term, it refers to the ways human identity is shaped by multiple social vectors and overlapping identity categories (such as sex, race, class) that may not be readily visible in single-axis formulations of identity, but which are taken to be integral to robustly capture the multifaceted nature of human experience. As a diagnostic term, it captures the (...) confluence of power and domination on the social construction of identity in order to remedy concrete harms that result from this convergence. It is not a prescriptive methodology or closed system of analysis, but rather an open-ended hermeneutic lens through which interconnected systems of oppression can come into focus in the fight for social justice. Research on the role of values in science and objectivity has typically approached trust through its epistemic aspects. Yet, recent work on public trust in science has emphasized the role of non-epistemic values in building and maintaining trust. This paper will use a concept of trust that adds concerns about justice to epistemic conditions to investigate this problem in relation to public health. I will argue that trust-conducive values, particularly justice, are relevant in deciding which value influences are legitimate in (...) scientific decision-making. Drawing on public health ethics, I will provide a consequentialist justification for employing trust-conducive values. While several concepts of justice have been explored in the context of public health, I will further draw on public health ethics, focusing on a view that brings together both distributive and procedural aspects. For illustration, I will use the case of cardiovascular disease prevention, particularly how concerns about justice apply when choosing between population-based and individual-based approaches. Following Marx, he regarded the sense of Beauty, the supreme mental feeling, as a product of history. Il'enkov insisted on the universal character of this feeling, for its basis is an activity of imagination which also lies at the root of any creative work. His criticism of modern art rested on analysis of the process of disintegration of personality, its capabilities within (...) industrial civilisation to break the natural tie between Truth, Good and Beauty.
