The famous dispute between Protagoras and Euathlus concerning Protagoras’s tuition fee reportedly owed to him by Euathlus is solved on the basis of practical argumentation concerning actions. The dispute is widely viewed as a kind of a logical paradox, and I show that such treating arises due to the double confusion in the dispute narrative. The linguistic expressions used to refer to Protagoras’s, Euathlus’s and the jurors’ actions are confused with these actions themselves. The other confusion is the collision between (...) the pairs of incompatible actions ambiguously expressed by two different pairs of sentences, one of which is a propositionally consistent pair whereas the other is an inconsistent one. The actional paradox solution aims to clear up these confusions by means of two core borderlines, propositional and expressive, drawn between the actions and the propositions. The propositional distinction says that actions are empirical facts and they lack truth values unlike propositions, which are mental entities and are often employed for referring to the actions. This distinction helps to avoid the confusion between the empirical incompatibility of actions and the truth-functional inconsistency of propositions. The expressive distinction claims that although the same linguistic sentences can be used to refer both to actions and propositions, two empirically incompatible actions can be expressed both by a pair of inconsistent propositions as well as by a pair of consistent ones. Therefore, the action of Protagoras’s being paid may be linguistically symbolized in four different ways: Protagoras gets paid due to the verdict, Protagoras gets paid due to the contract that amount to Protagoras does not get paid by the contract and Protagoras does not get paid by the verdict respectively, and likewise for Euathlus’s actions. The two distinctions are used for classifying the two groups of paradox solutions, legal and logical, proposed so far depending on which of the two confusions they purport to escape from. The actional reconstruction of the paradox suggests that there is only one single agent in the dispute, Protagoras, while the other named Euathlus is a ‘phantom,’ which most probably was invented by Protagoras himself for the sake of creating this challenging sophism. In this paper, I propose a logical-cognitive approach to argumentation and advocate an idea that argumentation presupposes that intelligent agents engaged in it are cognitively diverse. My approach to argumentation allows drawing distinctions between justification, conviction and persuasion as its different kinds. In justification agents seek to verify weak or strong coherency of an agent’s position in a dialogue. In conviction they argue to modify their partner’s position by means of demonstrating weak or strong cogency of their positions before a (...) ‘rational judge’. My approach to argumentation employs a ‘light’ version of Dung’s abstract argumentative frameworks. It is based on Stich’s idea of agents’ cognitive diversity the epistemic aspect of which is argued to be close to Pavilionis’s conception of meaning continuum. To illustrate my contributions I use an example based on the Kitchen Debate (1959) between Khrushchev and Nixon. (shrink)

In the paper contemporary approaches to argumentation are compared with a number of ways of understanding sophistic including ancient, medieval and contemporary ‘faces’ of the latter. It is argued that the current stage is characterized by a negative evaluative understanding of sophistic which is taken mostly as sophistry. In the paper, I also show how these different approaches to sophistic such as illegitimate argumentation, particular illegitimate arguments and scholastic method of formulating and solving tasks grow out of its ancient and (...) medieval historical forms, found in Aristotle, Plato, the Sophists and the Medieval thinkers. To illustrate this distinction I use a medieval sophism combined with a famous ancient anecdote. The distinction between three contemporary approaches which is set forward in the paper is based on semantic, procedural, pragmatic, communicative and speech-oriented criteria, and develops logical and cognitive approaches to argumentation. The ancient art of healing and practical argumentation are closely linked, and this link points to three substantial issues: that physicians enjoy certain social status, that medicine is recognized as a special area of knowledge and that the art of healing is a profession. We use the analogy between the medicine and the judiciary for demonstrating these issues. The analogy involves two groups of norms governing the activities of judges – the norms of competence and the norms of conduct which (...) we interpret as the actional and the practical aspects of the ancient art of healing. The actional aspect is similar to the norms of competence of a judge and sets the goal for the art of healing – restoring patient’s health, and defines a physician as a person who is publicly allowed to pursue this goal in his professional activities. The practical aspect is reminiscent of the judges’ norms of conduct and it outlines the terms and techniques which lead to achieving this goal by those who are considered physicians, according to the norms of competence. In order to become a real tekhne, it is necessary and sufficient for the art of healing to secure its actional and practical aspects in the body of theoretical knowledge, on the one hand, and in the appropriate professional code, on the other. Practical argumentation serves as the tools of this implementation, for it allows to combine the norms and actions in a set of strategies of conduct, aimed at restoring patient’s health, of which the physisian is now free to chose the one that appear to be the most effective. In 2018, three journalists accused one of the Members of the Russian Parliament of harassment at workplace. Many influential persons of the Russian elite engaged themselves in the public discussion of the conflict. We studied that high-profiled discussion using a hybrid method merging human- and logic-oriented approaches in argumentation studies. The method develops ideas of the new dialectics, the argumentation logic and the logical-cognitive approach to argumentation, on which is based the algorithm for determining of dispute resolution by aggregating formal (...) and informal tools of analysis. We have reconstructed the discussion as two disputes about questions A and B. A: Did the MP violate the code of conduct by making statements or actions against the journalists? B: Are actions like the behavior of the MP harassment? The opinions of the discussion participants were grouped into the four points of view: A1 – the MP did not violate the code of conduct, A2 – the MP violated the code of conduct, B3 – the actions are not harassment, B4 – the actions are harassment. We mapped arguments in support or against each of them using OVA software, evaluated the arguments with the help of the critical questions, a tool proposed in the new dialectics, and determined the ultimate A + B resolution by applying of the algorithm that combines elements of gradual and labelling semantics from the argumentation logic and the classification of disputes from the dialectical approaches. The resolution was a subset of four arguments that ensured the victory of A1+B4. However, the substantial incompatibility of those arguments highlighted a deep disagreement, an unresolvable difference of opinion, between the parties about the permissibility of courtship. The deep disagreement, a bonus result yielded by the application of the hybrid method, excluded the interpretation of the determined resolution as convincing for the parties, but pointed out a way to smooth the difference of opinions by elaborating of legal, social and moral aspects of the problem of harassment at workplace. In this paper we discuss L. Petrażycki’s idea of norm as a normative relation and show its repercussions in two perspectives connected to each other, in the legal theory in the framework of which it was originally introduced and where its role was straightforward, and in logic where it played a shadowy role of a fresh idea which in his expectation would have been the core of the novel logical theories capable of modelling reasoning in law and morals. We pay (...) attention to the scholarly environment in which Petrażycki has proposed those ideas and to the unlucky fate of his academic legacy which is now being rediscovered. (shrink)

In this paper, we introduce the subject of the special issue Trends in Argumentation Logic. Here we mainly describe two approaches to argumentation logic with explicating monotonic and non-monotonic, or defeasible, reasoning and explain the role of artificial intelligence in applying argumentation logic. Then we give a short overview of the papers contributed to the special issue.

We have identified a sample of 53 societies outside of the classical Himalayan and Marquesean area that permit polyandrous unions. Our goal is to broadly describe the demographic, social, marital, and economic characteristics of these societies and to evaluate some hypotheses of the causes of polyandry. We demonstrate that although polyandry is rare it is not as rare as commonly believed, is found worldwide, and is most common in egalitarian societies. We also argue that polyandry likely existed during early human (...) history and should be examined from an evolutionary perspective. Our analysis reveals that it may be a predictable response to a high operational sex ratio favoring males and may also be a response to high rates of male mortality and, possibly, male absenteeism. Other factors may contribute, but our within-polyandry sample limits analysis. (shrink)

Written in a clear and accessible style, the book explains why it is important to allow young children access to philosophy during primary-school education. Wartenberg also gives advice on how to construct a "learner-centered" classroom, in which children discuss philosophical issues with one another as they respond to open-ended questions by saying whether they agree (...) or disagree with what others have said. The aim of this study is to explore how nurses perceive patient participations of patients over 75 years old undergoing hemodialysis treatment in dialysis units, and of their next of kin. Ten nurses told stories about what happened in the dialysis units. These stories were analyzed with critical discourse analysis. Three discursive practices are found: (1) the nurses’ power and control; (2) sharing power with the patient; and (3) transferring power to the next of kin. The first and the predominant (...) discursive practice can be explained with an ideology of paternalism, in which the nurses used biomedical explanations and the ethical principle of benefice to justify their actions. The second can be explained with an ideology of participation, in which the nurses used ethical narratives as a way to let the patients participate in the treatment. The third seemed to involve autonomous decision-making and the ethical principle of autonomy for the next of kin in the difficult end-of-life decisions. (shrink)

Many writers in various fields--philosophy, religion, literature, and psychology--believe that the question of the meaning of life is one of the most significant problems that an individual faces. In The Meaning of Life, Second Edition, E.D. Klemke collects some of the best writings on this topic, primarily works by philosophers but also selections from literary figures and religious thinkers. Because factory-farmed meat production inflicts gratuitous suffering upon animals and wreaks havoc on the environment, there are morally compelling reasons to become vegetarian. Yet industrial plant agriculture causes the death of many field animals, and this leads some to question whether consumers ought to get some of their protein from certain kinds of non factory-farmed meat. Donald Bruckner, for instance, boldly argues that the harm principle implies an obligation to collect and consume roadkill and that strict vegetarianism is thus immoral. (...) But this argument works only if the following claims are true: all humans have access to roadkill, roadkill would go to waste if those who happen upon it don’t themselves consume it, it’s impossible to harvest vegetables without killing animals, the animals who are killed in plant production are all-things-considered harmed by crop farming, and the best arguments for vegetarianism all endorse the harm principle. As I will argue in this paper, each claim is deeply problematic. Consequently, in most cases, humans ought to strictly eat plants and save the roadkill for cats. (shrink)

This chapter introduces and defends a pragmatist model of aesthetic disagreement that avoids many of the philosophical puzzles generated by the traditional, semantic, approach. Mainstream philosophical inquiry into aesthetic disagreement begins with a rather innocuous assumption: to understand what’s going on we must first explain what disputants are saying, which involves identifying the meaning of the relevant expressions or determining how aesthetic claims could be true. However, this task brings with it a new host of semantic and epistemic puzzles and (...) fails to vindicate the central role aesthetic disagreements occupy in our aesthetic lives more generally. Further, it isn’t clear how settling the meaning of aesthetic expressions bears on everyday aesthetic disagreements. Paying attention to what we do in an aesthetic disagreement will give us a better chance at identifying what matters for determining what we say. (shrink)

An adequate theory of rights ought to forbid the harming of animals to promote trivial interests of humans, as is often done in the animal-user industries. But what should the rights view say about situations in which harming some animals is necessary to prevent intolerable injustices to other animals? I develop an account of respectful treatment on which, under certain conditions, it’s justified to intentionally harm some individuals to prevent serious harm to others. This can be compatible with recognizing the (...) inherent value of the ones who are harmed. My theory has important implications for contemporary moral issues in nonhuman animal ethics, such as the development of cultured meat and animal research. (shrink)

In recent discussions, it has been argued that a theory of animal rights is at odds with a liberal abortion policy. In response, Francione (1995) argues that the principles used in the animal rights discourse do not have implications for the abortion debate. I challenge Francione’s conclusion by illustrating that his own framework of animal rights, supplemented by a relational account of moral obligation, can address the moral issue of abortion. I first demonstrate that Francione’s animal rights position, which grounds (...) moral consideration in sentience, is committed to the claim that a sentient fetus has a right to life. I then illustrate that a fully developed account of animal rights that recognizes the special obligations humans have to assist animals when we cause them to be dependent and vulnerable through our voluntary actions or omissions is committed to the following: a woman also has a special obligation to assist a sentient fetus when she causes it to be dependent and vulnerable through her voluntary actions or omissions. From these considerations, it will become evident that a fully developed and consistent animal rights ethic does in fact have implications for the abortion discussion. (shrink)

In The Case for Animal Rights, Tom Regan argues that although all subjects-of-a-life have equal inherent value, there are often differences in the value of lives. According to Regan, lives that have the highest value are lives which have more possible sources of satisfaction. Regan claims that the highest source of satisfaction, which is available to only rational beings, is the satisfaction associated with thinking impartially about moral choices. Since rational beings can bring impartial reasons to bear on decision making, (...) Regan maintains that they have an additional possible source of satisfaction that nonrational beings do not have and, consequently, the lives of rational beings turn out to have greater value.. This grounded study investigated the negotiation of authorship by faculty members, graduate student mentors, and their undergraduate protégés in undergraduate research experiences at a private research university in the northeastern United States. Semi-structured interviews using complementary scripts were conducted separately with 42 participants over a 3 year period to probe their knowledge and understanding of responsible authorship and publication practices and learn how faculty and students entered into authorship decision-making intended to lead to the publication of peer-reviewed technical papers. Herein (...) the theoretical model for the negotiation of authorship developed through the analysis of these interviews is reported. The model identifies critical causal and intervening conditions responsible for the coping strategies faculty and students employ, which, in our study, appear to often produce unfortunate consequences for all involved. The undergraduate student researchers and their graduate student mentors interviewed in this study exhibited a limited understanding of authorship and the requirements for authorship in their research groups. The power differential between faculty and students, the students’ limited epistemic development, the busy-ness of the faculty, and the faculty’s failure to prioritize authorship have been identified as key factors inhibiting both undergraduate and graduate students from developing a deeper understanding of responsible authorship and publication practices. Implications for graduate education and undergraduate research are discussed, and strategies for helping all students to develop a deeper understanding of authorship are identified. (shrink)

Este número é o primeiro fruto de um sonho antigo e de um inconformismo com a falta de um veículo como este, entre nós. Pretendemos incentivar e divulgar trabalhos de natureza interdisciplinar nas áreas de Educação e Filosofia. Mas, se a Revista vier a ter uma linha preferencial — e isto depende muito mais dos nossos colaboradores, que da direção — essa linha não (...) será exclusiva nem excludente, pois a Revista estará aberta às mais diversas correntes de pensamento, não se fechando, pois, com quaisquer grupos. Isto é consequência de nossa visão de Universidade como lugar onde se deve estimular a heterogeneidade de tendências e o debate. Entendemos que uma filosofia que propugne posições dogmáticas inviabiliza o debate sobre seus próprios pressupostos, deixando de ser filosofia para tornar-se mera ideologia. Ademais, a discussão de questões de princípio tem razão de ser e há momentos em que apenas ela pode contribuir para a superação de impasses de ordem teórica ou prática, sobretudo nas ciências sociais; somente uma abordagem crítica — o que equivale a dizer: sem preconceitos — pode contribuir para os debates de questões fundamentais tanto para a filosofia, quanto para a educação, ou ainda quanto para uma filosofia de educação. A REVISTA EDUCAÇÃO E FILOSOFIA deve representar um fórum de permanentes debates aberto a todo educador, todo pensador e, sobretudo, a todo pensador-educador. Propomo-nos a acolher e divulgar contribuições que sintetizem os resultados de investigações empíricas e teóricas e de projetos práticos, preferencialmente, mas não exclusivamente, desenvolvidos na região do Triângulo Mineiro. Dentro do princípio de que o caráter objetivo e preciso do conhecimento científico não é incompatível com os conformismos diante das injustiças de toda ordem, pretendemos, ainda, ser um estímulo aos balanços críticos. A REVISTA EDUCAÇÃO E FILOSOFIA é a soma do que temos e somos, mas será um veículo para atingirmos aquilo que queremos ser e ter. Deverá abrir caminho para a reflexão filosófica, a reflexão sobre educação, a reflexão sobre o ensino da filosofia e possibilitará o diálogo com os pensadores e educadores presentes e pretéritos visando à construção do futuro. One currently popular methodology of metaphysics has it that ‘intuitions’ play an evidential role with respect to metaphysical claims. This chapter defends a realist methodology of metaphysics that implies that any rational being, simply in virtue of being rational, is necessarily capable of grasping the essences of at least some mind-independent entities. The notion of essence in play here is Aristotelian, whereby an entity’s essence is captured by an account of what that entity is, or what it is to be (...) that entity. Concepts are just ways of thinking of things and, as such, may or may not be adequate to the real natures — the essences — of the things being thought of. Our ‘intuitions’, particularly as revealed by aptly constructed thought experiments, may cast interesting light on some of our concepts, but they are not and cannot be reliable guides to mind-independent truths of essence.
