Discrimination is a negative, destructive and marginalizing attitude as old as the history of humanity. It becomes visible in many different forms such as racism, sexism, nationalism, sectarianism, religiousness, and classism. When we look at the sources of discriminatory attitudes and tendencies, we encounter a wide range of reasons. For example, factors such as wrong learning, created fears, distorted feelings of hatred, scientific, philosophical, political thoughts, religiouspolitical personalities, and flawed educational understandings can be shown as some of these. This paper puts under scrutiny Martha Nussbaum’s turn to political liberalism. In this paper, I intend to shed light on two problems that Nussbaum must face when she try to follow Rawls’ idea of political liberalism. First of all, I would like to show the limits of application of the technique of “overlapping consensus”. I try to argue that Nussbaum fails to prove that we can attain a universal list of political values (such as a list (...) of primary goods) through an “overlapping consensus”. By contrast she cannot avoid Rawls’ limitation of “overlapping consensus” to communities already ruled by liberal institutions. Secondly, I question Nussbaum’s “political liberal attitude” when she faces difficult issues such as non-discrimination inside religious institutions. I try to show that in this case Nussbaum’s arguments are weak because they are based on a clear-cut distinction between public and private realms. Yet, such a clear-cut distinction is practically impossible in liberal political communities. We cannot but argue about the boundaries between public spheres and private domains. (shrink)

Sympathetic with an anti-racist strategy that concerns itself not only with racism at the institutional level but also with racism on a more intimate scale, Elliot nevertheless laments that individual complicity in racism is frequently attributed to aproblematic attitude. As a consequence, anti-racist work among members of dominant groups often is arrayed along a narrow spectrum: in workshops or in-service seminars participants attempt to identify and acknowledge biased and discriminatory views. Elliot fears that consciousness-raising efforts ofthis kind are unlikely to effect social change ifthose who participate continue to favor the confessional stance. Urging her readers to develop a "critical consciousness," a concept she takes from bell hooks (hooks 118), Elliot asks that members ofdominant groups who desire to promote social change not only combat institutional racism, but also divest themselves oisubjective investments in racism (63). As 1 struggle to achieve hook's critical consciousness of racism, like Elliot (64), I find difficult the task ofexploring the construction ofmy own identity as a white academic.2 For example, when I discuss issues in women's lives in the classroom or at professional conferences, I not infrequently am challenged by women of color who note that unexamined privilege (race and class) skews my perspective.3 1 also find myselfspeaking for others, assuming their voices, when I should speak only for myself. As a consequence, I regularly have cause to ponder whether, under the guise of contributing to anti-racistwork, I am appropriating others' voices in ways that reinforce racism rather than challenge it. For instance, on what grounds do I, a white woman, in this essay propose to address the problem of racism by reflecting on a novella written by an African-American woman? Does white privilege foreground my choice, precluding me from reading a work of literature in ways that might challenge rather than further racism? Grappling with these issues while reflecting on the theme of a critical consciousness ofracism, I find instructive the Girardian notion of mimesis. The dynamics of mimesis account well for agents of racism who, simultaneously recognizing and denying difference, act in ways that inhibit social and subjective transformation. She argues that emotions are best conceived as thoughts, and she argues that emotion-thoughts can make valuable contributions to the moral life. She develops extensive accounts of compassion and erotic love as thoughts that are of great moral import. This article argues that political liberalism, of the type formulated by John Rawls and Charles Larmore and further developed in Amartya Sen and Martha Nussbaum's capabilities approach, is superior to more comprehensive political views both in domestic and in global affairs. Perfectionist liberalism as advocated by John Stuart Mill and Joseph Raz attempts to erase existing religions and replace them with the religion of utility or autonomy. This is wrong, because in the ethico-religious environment of reasonable disagreement (...) that we inhabit all comprehensive forms of political morality pose a threat to people's liberty and equality. Only thin and narrow conceptions of value like the ones suggested by Rawls, Larmore, Sen, and Nussbaum can guarantee the respect for diversity that is needed in a pluralistic world. Nietzsche claimed to be a political thinker in Ecce Homo and elsewhere. He constantly compared his thought with other political theorists, chiefly Rousseau, Kant and Mill, and he claimed to offer an alternative to the bankruptcy of Enlightenment liberalism. It is worthwhile re-examining Nietzsche's claim to offer serious criticisms of liberal political philosophy. I shall proceed by setting out seven criteria for serious political thought: understanding of material need; procedural justification; liberty and its worth; racial, ethnic and religious difference; (...) gender and family; justice between nations; and moral psychology. I shall argue polemically that on the first six issues Nietzsche has nothing to offer, but that on the seventh, moral psychology, he makes a profound contribution. Serious political theory, however, needs to forget about Nietzsche and turn to those thinkers he found so boring - the liberal Enlightenment thinkers. (shrink)

All modern liberal democracies have strong reasons to support an idea of toleration, understood as involving respect, not only grudging acceptance, and to extend it to all religious and secular doctrines, limiting only conduct that violates the rights of other citizens. There is no modern democracy, however, in which toleration of this sort is a stable achievement. Why is toleration, attractive in principle, so difficult to achieve? The normative case for toleration was well articulated by John Locke in his (...) influential A Letter Concerning Toleration , although his attractive proposal thus rests on a fragile foundation. Kant did much more, combining a Lockean account of the state with a profound diagnosis of ‘radical evil’, the tendencies in all human beings to militate against stable toleration and respect. But Kant proposed no mechanism through which the state might mitigate the harmful influence of ‘radical evil’, thus rendering toleration stable. One solution to this problem was proposed by Rousseau, but it has deep problems. How, then, can a respectful pluralistic society shore up the fragile human basis of toleration, especially in a world in which we need to cultivate toleration not only within each state, but also among peoples and states, in this interlocking world? Nussbaum wishes to go beyond this tradition, because in her view we are dealing with issues of justice. Her capabilities approach secures basic entitlements for animals, on the basis of their fundamental capacities. In particular, she finds in the late novels of Henry James an alternative to the reductive, pseudoscientific prose of contemporary analytic philosophy, which she argues inhibits the range of possible answers to the basic ethical question "How should one live?"1 James's prose shows "attention to particulars, a respect for the emotions, and a tentative and non-dogmatic attitude to the bewildering multiplicities of life" (LK, p. 27), and thus it exemplifies the Aristotelian ethical conception she advocates.In this essay I want to disentangle Nussbaum's theory of the ethical significance of fictional form—which I endorse—from her preoccupation [End Page 190] with James—which I do not. Unlike other philosophers who invoke literature only as a "rich source of examples awaiting illumination by philosophy," Nussbaum insists that analysis of a text's literary properties is the essential methodology of ethical criticism.3 Every aspect of form and style "expresses a sense of life and of value, a sense of what matters and what does not" (LK, p.5). In Upheavals of Thought, Martha Nussbaum offers a theory of the emotions. She argues that emotions are best conceived as thoughts, and she argues that emotion‐thoughts can make valuable contributions to the moral life. She develops extensive accounts of compassion and erotic love as thoughts that are of great moral import. This paper seeks to elucidate what it means, for Nussbaum, to say that emotions are forms of thought. It raises critical questions about her conception of the (...) structure of emotion, and about her conception of compassion, in particular. The aim of this study was to assess the links between religious discrimination and developmental and contextual variables. Based on the assumption that discrimination results from the interplay of prejudice and moral thinking, discriminatory behaviour was hypothesised to be linked to age, school environment, minority or majority group membership, and parental religious socialisation practices. The results indicate that discrimination is more frequent during childhood than during pre-adolescence or adolescence, more common in homogeneous schools than in heterogeneous schools, (...) and more likely when parents frequently express messages promoting mistrust of other religious groups. Participants from the minority group were more likely to discriminate against their own ingroup than were those from the majority group. Further studies are needed to determine whether these links are correlative or predictive, and to understand the underlying processes of religious discrimination. (shrink)

Human beings are both needy and dignified. How should we think about the relationship between our neediness and our worth? Card argues well that our vulnerability to luck is intertwined in the very conditions of moral agency. We can see the merit of her approach even more clearly by turning to some difficulties the Stoics have in preserving dignity while removing vulnerability. Stoicism does, however, help us to sort through the difficulties involved as we try to combine love of particular (...) people with respect for all human life. Richardson is correct to suggest that love itself can animate the concern for all humanity; I also agree with him that institutions must play a major role in any solution to problems of inequality between nations. Although the “capabilities approach” offers an attractive account of one part of the goal of just political institutions, combining, as Moody‐Adams suggests, respect for difference with a commitment to universal norms, I now believe that the capabilities account should be combined with a form of Rawlsian political liberalism that protects spaces within which citizens may pursue the good as they understand it. Using the bench trial of Colorado’s Amendment 2 as an example, this article focuses on the more general question of expert testimony in moral philosophy. It argues that there is indeed expertise in moral philosophy but argues against admitting such expert testimony in cases dealing with what John Rawls terms “constitutional essentials” and ‘matters of basic justice.” Developing the idea of public reason inherent in the Rawlsian concept of political liberalism, the article argues that philosophers can and should speak out (...) on public issues, if they do so with due respect for certain restrictions, but that they should not serve as expert witnesses on core constitutional questions, since doing so suggests that they claim a type of authority that would require fellow citizens to defer to their views. Such claims to authority in basic ethical matters threaten the mutual respect for divergent comprehensive doctrines that lies at the core of political liberalism. Philosophers have a duty to serve the public good, and they perform this service in fruitful ways. But they should refuse a public role that appears incompatible with equal respect for the committed ethical searching of their fellow citizens. (shrink)
