Because of the gradual aging of the population, hospital facilities for socio-sanitary care of the elderly are quite scarce relative to the very high number of elderly people present in the country. This has pushed a high number of families to privately hire home-care workers. The scientific literature gives a picture of the psycho-physical risks that this type of profession is exposed to; however, there is still a need for a more systemic reflection with regard to representations about their role (...) and competences. The aim of the present study is to outline the representations of the role and the skills it requires from home-care workers’ point of view. We reconstructed how home-care workers perceive and define the profession, and understand the necessary skills required from their point of view. Our results show that the professional profile of home-care workers still remains poorly defined and that professionals themselves struggle to find value and recognition, and to articulate what the skill set they develop is formed of. Graduate Papers from the 2022 Joint Session. It is often said that Aristotle takes geometrical objects to be absolutely unmovable and unchangeable. However, Greek geometrical practice does appeal to motion and change, and geometers seem to consider their objects apt to be manipulated. In this paper, I examine if and how Aristotle’s philosophy of geometry can account for the geometers’ practices and way of talking. First, I illustrate three different ways in which Greek geometry appeals to change. Second, I examine (...) Aristotle’s ontology of geometrical objects and argue that although the truth-makers of geometrical statements are in fact unmovable because they are properties of sensible objects, geometers ‘separate them in thought’ and treat them as substances apt to be modified. Finally, I examine whether allowing for the possibility of manipulating these semi-fictional geometrical individuals creates problems for the applicability of geometry. I find that it does not, insofar as one accepts that geometry is not meant to track physical change but merely to study the instantaneous geometrical configuration of sensible bodies, and is thus only applicable at the instant. This book offers a reflection on the central role that the ethics of informed consent plays in Rapid Tissue Donation. RTD is an advanced oncology procedure that involves the procurement, for research purposes, of “fresh” tissues within two to six hours of a cancer patient’s death. Since RTD involves the retrieval of tissues after death, and since the collected tissues are of great importance for medical research, the need for any form of informed consent to regulate this procedure has been (...) questioned. This book argues for the necessity of informed consent to govern RTD, and it provides the reader with a bespoke informed consent process applicable to cancer patients. The analysis unfolds at the intersection between applied ethics, public health ethics, and clinical ethics, and it is informed by philosophical theories of informed consent and by the social implications of individual choices. By viewing medical issues relating to informed consent in oncology from an ethical perspective, the book combines philosophical analysis with discussion of concrete cancer-related issues. As a result, the book is suitable for readers interested in ethical reasoning as well as for those with a medical background. It contributes to contemporary research by offering an original analysis that relies on a rigorous philosophical approach to address innovative issues at the cutting edge of medical research and policy making. In this article I analyse those that I consider the most powerful counterarguments that have been advanced against the non-identity objection to the idea of intergenerational harm, according to which an action cannot cause harm to a given agent if her biological identity does actually depend—in a partial but still determinant way—on the performance of this action. In doing this, I firstly go through the deontological criticisms to the person-affecting view of harm, before moving on to sufficientarian and communitarian accounts (...) of intergenerational harm. My argument is that neither of these theories manage to defuse the non-identity objection. Yet, I conclude by observing that a possible way out of the non-identity paradox might consist in developing an ethical account of intergenerational negative justice that focuses on the functional value of the natural and social structures in which humans develop their lives, rather than on their instrumental or intrinsic value. In this article, I firstly discuss the person-affecting view of harm, distinguishing between the liability and the structural models of responsibility, and also explaining why it is unsatisfactory, from a moral point of view, to interpret a given harm as a loss with respect to a diachronic baseline. Then, I take sweatshops as an example and I entertain two further issues that are related to the assessment of harm and that are necessary for operationalising a comprehensive model of responsibility, that (...) takes into account both liability and structural injustice. The first one is how to interpret harm when it is coexistent with a diachronic benefit and/or the parties involved in the social structures leading to harm seek to unload their responsibility by hiding behind a cooperative deadlock. The current situation around COVID-19 portrays a threat to us in several ways: It imposes uncertainty, a lack of control and reminds us of our own mortality. People around the world have reacted to these threats in seemingly unrelated ways: From stockpiling yeast and toilet paper to favoring nationalist ideas or endorsing conspiratorial beliefs. According to the General Process Model of Threat and Defense the confrontation with a threat - a discrepant experience - makes humans react with both proximal and (...) distal threat responses. While the proximal response manifests in behavioral inhibition that leads to heightened anxious arousal and vigilance, distal responses seek to lower behavioral inhibition and the associated state of anxiety and vigilance through engaging in distal defenses. In the present research, we propose that the reactions to COVID-19 may represent distal defense strategies to the pandemic (in the form of environmental or group related worldview defenses) and therefore can be explained and forecasted by the model. Thus we hypothesized increased perceived COVID-19 threat perception to lead to a proximal threat response in the form of heightened behavioral inhibition. This, in return, should enhance the use of distal defenses (i.e.: several ingroup biases, system justification and conspiratorial beliefs) overlapping with the reactions observed as a response to COVID-19. This hypothesized mediated effect of increased perceived COVID-19 threat on distal defenses was tested in two pre-registered studies: In Study 1 (N = 358) results showed perceived COVID-19 threat to be related to behavioral inhibition and in turn to be associated with increased distal defenses (i.e., higher entitativity, control restoration motivation, passive party support). In Study 2 (N = 348) we manipulated COVID-19 threat salience and found results suggesting the distal defenses of system justification and conspiratorial beliefs to be mediated by the proximal threat response. The results of the present research hint towards a common mechanism through which the seemingly unrelated reactions to COVID-19 can be explained. The results might help to predict future behavior during the COVID-19 pandemic and design measures to counteract detrimental effects of the pandemic. (shrink)

Drawing on philosophy, law and political science, and on a wealth of practical experience delivering emergency medical services in conflict-ridden settings, Lepora and Goodin untangle the complexities surrounding compromise and complicity.

In the philosophy of science and epistemology literature, robustness analysis has become an umbrella term that refers to a variety of strategies. One of the main purposes of this paper is to argue that different strategies rely on different criteria for justifications. More specifically, I will claim that: i) robustness analysis differs from de-idealization even though the two concepts have often been conflated in the literature; ii) the comparison of different model frameworks requires different justifications than the comparison of models (...) that differ only for the assumption under test; iii) the replacement of specific assumptions with different ones can encounter specific difficulties in scientific practice. These claims will be supported by a case study in population ecology and a case study in geographical economics. (shrink)

In this article, I firstly discuss why a prioritarian clause can rescue the utilitarian doctrine from the risk of exacerbating inequality in the distribution of resources in those cases in which utility of income does not decline at the margin. Nonetheless, when in the presence of adaptive preferences, classic prioritarianism is more likely than utilitarianism to increase the inequality of resources under all circumstances, independently of the diminishing trend of utility. Hence, I propose to shift the informational focus of prioritarianism (...) from welfare to either social income or capabilities in order to safeguard those who are worse off. Following this, I argue that we may have reasons to limit the aggregative logic of priority-amended utilitarianism through one or more sufficiency thresholds, and that we can partially defuse the negative-thesis objection that is usually levelled against sufficientarianism, provided we interpret the threshold(s) as valid only as long as everyone is led above it. This chapter questions whether the objective circumstances of justice, and in particular the assumption of mutual advantage, apply to climate action. The first part of the chapter explains why two asymmetries, of benefits and costs, further exacerbated by intergenerational conflicts, both past and future oriented, make climate change an intricate multiplayer prisoner’s dilemma. The second part of the chapter analyses whether and how the two asymmetries can be scaled down, based on a series of empirical arguments: global vulnerability to local (...) economic setbacks, financial risks and security threats (benefit asymmetry), co-benefits of the energy transition immediately collectable, especially in developed and some emerging countries (cost asymmetry), moral, axiological and economic benefits of intergenerational sustainability (intergenerational conflicts). The conclusion is that the circumstances of justice, that make climate cooperation both possible and necessary, obtain, in spite of the two global asymmetries and of intergenerational conflicts. In this article we wonder how a person can discharge the political responsibility for supporting and benefiting from unjust social structures. Firstly, we introduce the concept of structural injustice and defend it against three possible objections: ‘explanatory nationalism’, a diachronic interpretation of the benefits of industry-led growth, being part of a social structure does not automatically mean being responsible for its negative consequences. Then, we hold that both Iris Marion Young’s ‘social connection model’ and Robin Zheng’s ‘role-ideal model’ provide clear (...) indications on how to unload responsibility for supporting/participating in unjust social structures, but fail to explain how to get rid of responsibility for unjust enrichment. We maintain that both models should be complemented with a global redistributive scheme that allows to disgorge the benefits that are unfairly obtained in the global economic system, besides undertaking collective transformative actions and assuming ideal-role responsibilities. In this article I argue that the non-reciprocity problem does not apply to intergenerational justice. Future generations impact, here and now, on the well-being of people now living. I firstly illustrate the economic-synchronic model of direct intergenerational reciprocity (DIR): future generations allow people now living to maintain the economic system future-oriented and capital-preserving. The rational choice for people now living is to guarantee transgenerational sufficiency to future generations. I then analyse the axiological-synchronic model of DIR: future generations give meaning and (...) value to many of the activities that people now living carry out, and this is a compelling reason for the latter to worry about the former. I argue that only the economic-synchronic model of DIR can consistently explain why we need future generations. I conclude by discussing the limits of indirect intergenerational reciprocity. This paper is an attempt to think through paranoia’s epistemic and affective features, which pervade both the worldview presented in Senecan tragedy and the inner life of many of its protagonists. Drawing upon recent literary-critical work, I argue that paranoia is temporally and epistemically ambivalent: subjects simultaneously attempt to “get ahead” of a looming cataclysm—looking to the future in an attempt to avert disaster—while inevitably “falling behind,” failing to predict or preempt the future in time to protect themselves. Much of (...) Senecan tragedy plays out paranoia’s future-oriented vigilance on the formal level. Foreshadowing, allusions, and meta-literary flourishes serve to render both readers and characters hyperaware of the earth-shattering horrors to come; however, in doing so, they also reveal that this forward-oriented bracing only serves to dredge up negative affect in advance. By contrast, I argue that Seneca’s Phoenissae thematizes in the character of Oedipus not only paranoia’s future-looking vigilance but also its inherent lagging, the failure to know and act in advance. These elements of slowness, stuckness, and delay open a space for stillness, relief, and intimacy, even within a narrative which hurtles toward cataclysm. (shrink)

Compromise arises in contexts where irreconcilable claims must nonetheless somehow be resolved. Ordinary people in everyday life, politicians and artists, doctors engaging in research, humanitarian workers providing aid in the midst of war – all of them will have faced situations where compromise appeared to be the only reasonable option, and yet will have felt that there was nevertheless something deeply wrong with it. The aim of this paper is to help make sense of that sentiment. The focus of this (...) paper will be on some aspects of the morality of compromise. Its lynchpin will be to construe compromise as a joint action, in particular, a joint wrongdoing – taking part in, and sharing responsibility for, the doing of things that are wrong from the point of view of those who are the parties to the compromise. The question of ‘what is wrong with compromise?’ is thus recast as a question of ‘what is my part in the wrongs being done as part of the compromise?’ It is tempting to suppose that a compromise serves to dilute personal responsibility, parsing it out among parties to the compromise. Viewing a compromise as a joint action, in contrast, will help us to see how a compromise actually increases responsibility among parties to it. They are now jointly collaborating in some action that each of them sees as wrong, at least in part (albeit in differing parts). Discussions of compromise traditionally prioritize the inter-personal aspect – compromise, in the transitive form of ‘compromising with’ someone. But I argue that the intransitive form – ‘compromise of’ – deserves pride of place. The reason for prioritizing the intransitive ‘compromise of’ is simple: that is what is involved in the intra-personal calculation that must, of necessity, go on inside one's own head in the process of deciding whether or not to agree to a 'compromise with' someone else. In this paper I shall concentrate specifically on compromises of principles, or (more precisely) on ‘matters of principled concern to the compromising parties’. Not only is that the most troubling and morally problematic sort of compromise, it is also logically the most central case. I demonstrate that that is so by shifting the focus from inter-personal compromise to the more fundamental intra-personal process underlying it – the compromise we are involved in when adjudicating among our own conflicting values, to decide whether or not to agree to a compromise of the inter-personal sort. This is the subject of the first section of the paper below. Compromise involves resolving conflicts of principles through mutual concessions that are accepted and undertaken by all parties. Doing so may be on-balance desirable, not only from some larger perspective (of social peace, or whatever) but also from each party's own perspective. Nevertheless, from each party's perspective, compromise necessarily involves interacting with, and sometimes contributing to, wrongdoing. In this article we address the so-called argument of «individual causal inefficacy» (ICI), according to which CO2-emission-generating actions are morally neutral with regards to climate change, in so far as, taken in their singularity, they are neither sufficient nor necessary to cause climate change. In the first part, we address the main substantive objection to ICI: if a single emission, analysed in isolation, does not cause any disutility, it is impossible to explain why climate change (which is the result of (...) a sum of emissions) is the source of an enormous disutility; thus, ICI should be rejected in so far as it leads to a conclusion that is logically inconsistent. We argue, contrary to this, that it is possible to hold together ICI and individual moral responsibility for climate change, given the characteristics of the natural carbon cycle and of net-zero emissions. In the second part, accordingly, we propose a theory of individual responsibility for climate change which is based on the distinction between individual and collective freedom to emit, compatibly with a given mitigation target. This theory allows us to maintain that there exists a moral duty to reduce individual emissions, without having to demonstrate the fallacy of ICI. This duty is based on distributive reasons, which can prescind from the direct causal relationship between individual polluting actions and climate damage. (shrink)

The Covid-19 pandemic has confronted humanity with a complex and unexpected challenge. One part of this challenge concerned individual ethics, i.e., the behaviour of individuals with respect to the rules and restrictions that have been imposed by health authorities in the collective interest. Another part concerned, instead, the social organisation of immunisation campaigns. In this article I wonder whether the lessons we have learned in the fight against the Covid-19 pandemic can be applied to climate change mitigation. My first argument (...) is that at least some of the ethical successes obtained at the individual level can be repeated with respect to climate change, but only if we stop focusing solely on the risks of climate change and offer a convincing picture of the benefits and opportunities of a more sustainable world. The second argument is that the Covid-19 pandemic offered us a new perspective on the relationship between global systemic threats and social justice: no one can adapt in isolation, neither medically nor economically. An out-of-control climate will lead to the same situation, so the asymmetry of vulnerability between developed and developing countries is only a short-term illusion. (shrink)

For the last twenty years John Corvino has traversed the US responding to moral and religious arguments against same-sex relationships. In this timely book, he shares that experience-both by addressing the standard objections and by offering insight into the culture wars more generally. In the process, he makes a fresh case for moral engagement, forcefully rejecting the idea that morality is a 'private matter'.

A uniform carbon tax with equal per capita dividends is usually advocated as a cost-effective way of reducing greenhouse gas (GHG) emissions without increasing, and in many cases even reducing, economic inequality, in particular because of the positive balance between the carbon taxes paid by the worse off and the carbon dividends they receive back. In this article, I argue that a uniform carbon tax reform is unjust regardless of how the revenue is used, because it does not discourage the (...) rich from indulging in wasteful emissions. This is at odds with a normative account of the distribution of the GHG budget that I define as emissions limitarianism, which is a climate derivative of economic limitarianism. Emissions limitarianism holds that, under low GHG budget conditions, emissions permits should not be used to achieve functionings that over-consume the GHG budget without producing significant welfare gains relative to the achievement of alternative functionings. Accordingly, I argue that a uniform carbon tax should be complemented by a limitarian carbon tax, which restricts the capabilities of the rich to achieve wasteful emission-generating functionings. The article adopts a methodological multi-level perspective on capabilities as a measure of welfare, distinguishing between basic, secondary and tertiary capabilities. (shrink)

Friedrich Albert Lange is usually regarded as a representative of physiological neo-Kantianism or as a forerunner of the Marburg school of neo-Kantianism. In this paper I try to reconstruct Lange’s theory of values to argue that his philosophy is better framed as an intermediate point in the development of the two-world theory (facts/values) between Hermann Lotze and Southwestern neo-Kantianism.

Aureoli rifiuta il modello tradizionale di causalità esemplare, secondo cui Dio avrebbe creato il mondo (...) sulla base di modelli archetipi esistenti dall’eternità nella sua mente. Ricorrendo al concetto di aequivocatio, stabilisce che l’essenza di Dio è in maniera equivoca l’unico esemplare per tutte le creature ed elabora, così, la teoria della causalità esemplare equivoca. In this article, we deal with the evaluation of the losses suffered by persons living in urban areas as a result of energy services. In the first part, we analyse how by adopting different informational foci we obtain contrasting interpersonal evaluations regarding the same loss. In the second part, we distinguish between a diachronic and a hypothetical/moralised threshold for harm in order to assess whether individuals are benefiting from or being harmed by a given energy service. Our argument is that (...) the most accurate evaluation of an individual damage caused by an energy service can be obtained by using capabilities as informational focus, instead of realised wellbeing or means to wellbeing, and by interpreting the loss in relation to a hypothetical/moralised threshold that corresponds to a list of central capabilities. In the last part, we address monetary and non-monetary compensations for a loss that is evaluated in terms of capabilities. Accordingly, we expound how compensation policies can either restore the capabilities lost due to energy services or monetarily compensate the individual for the fact that a given capability (or set of capabilities) has been irremediably lost. In this article, I discuss whether the theory of justice as fairness famously proposed by John Rawls can justify the implementation of global principles of socioeconomic justice, contrary to what Rawls himself maintains. In particular, I dwell on the concept of the basic structure of society, which Rawls defines as “the primary subject of justice” and considers as a prerogative of domestic societies. In the first part, I briefly present Rawls’s theory of socio-economic justice and his account of justice between (...) peoples. I then proceed with the analysis of the cosmopolitan counterarguments that have been levelled against Rawls’s dualism between domestic and international justice, which mainly revolve around the outlining of a global basic structure as a consequence of globalisation. Between these two opposing poles, I also discuss the intermediate stance taken by those authors who maintain that the empirical dispute between a domestic and a global basic structure is misleading, because the pressing question is whether the unfair practices and norms that characterise the global economy demand the existence of a global basic structure, regardless of the fact that it already exists or not. Lastly, I collect some points, both theoretical and empirical, that have emerged from the analysis and I argue that the theoretical requirement of a global basic structure can have practical implications even if its existence is contradicted in empirical terms. Globalisation has come under severe pressure at the exact moment when some of those we used to regard as the winners of the global market have started to lose from it. Or, in other words, globalisation is going through the most serious drawback since the post-war era just when divergent growth between countries has inverted its trend, thus becoming convergent. In this article I argue that convergent globalisation poses a serious theoretical challenge to the idea of global justice. More precisely, (...) the recent equalisation in the international distribution of wealth, together with the technological developments in automation and communication, render classic models of global justice obsolete. For the struggle for a more just globalisation is now realigned on the national level and sees deployed on the one side those who control enough capital to cut down on labour costs, and on the other one those others who are redundant in production. This study analyses for the first time whether and when moral distress may be related to work-family conflict and burnout. Additionally, this study examines whether resilience and positive refocusing might protect healthcare professionals from the negative effects of moral distress. A total of 153 Italian healthcare professionals completed self-report questionnaires. Simple and moderated mediation models revealed that moral distress was positively related to burnout, directly and indirectly, as mediated by work-family conflict. Highly resilient professionals experienced low work-family conflict, regardless of (...) moral distress levels. Moreover, professionals who frequently used positive refocusing were less vulnerable to burnout following moral distress. (shrink)

Discussions of loyalty in business typically assume that employees have a prima facieduty of loyalty to their companies, one that sometimes conflicts with other duties, such as the duty to blow the whistle in response to dangerous or unethical practices. Ronald Duska, however, denies the existence of any such duty. According to Duska, one does not have an duty of loyalty to a company, even a prima facieone, because companies are not proper objects of loyalty. He bases this conclusion on (...) two premises: first, that loyalty is appropriate only in relationships that demand self-sacrifice without expectation of reward, and second, that the employee-company relationship does not demand such sacrifice.In this paper I pose a dilemma for Duska. Briefly put: one can interpret Duska''s phrase relationships that demand self-sacrifice without expectation of reward" either narrowly or broadly. If one interprets it narrowly, then Duska''s first premise is false; if broadly, then his second premise is false. Either way, Duska''s argument is unsound. However, after rejecting his conclusion about loyalty in business, I go on to argue that Duska is right to deny that the duty of loyalty conflicts with the duty to blow the whistle. More generally, the paper is an attempt to elucidate the proper application of loyalty in business. (shrink)

Molti esperti concordano sul fatto che la pandemia di Covid-19 sia l'occasione giusta per iniziare a tassare l’anidride carbonica, ora che la domanda e quindi anche il prezzo dei combustibili fossili sono scesi. Tuttavia, la carbon tax continua ad essere vista con sospetto, soprattutto tra i progressisti, che temono che questa misura abbia effetti regressivi. Allo stesso tempo, i sostenitori di una carbon tax a entrate positive, che finanzi investimenti in progetti ecologici, rischiano di allarmare eccessivamente l’elettorato conservatore. In questo (...) articolo, sostengo dunque che una carbon tax neutra dal punto di vista delle entrate e che miri a ridurre il cuneo fiscale può combinare gli obiettivi redistributivi della sinistra europea, la lotta contro il cambiamento climatico e un’ampia accettabilità sociale. Tuttavia, il modo in cui la carbon tax viene proposta deve essere invertito: non più “mitigare il cambiamento climatico e così facendo raggiungere anche un secondo obiettivo sociale (in questo caso l'aumento del reddito salariale)”, ma “raggiungere un certo obiettivo sociale attraverso la tassazione dell’anidride carbonica”. There is a vast class of things that science has so far almost entirely neglected. They are central to the understanding of physical reality both at an everyday level and at the level of the most fundamental phenomena in physics, yet have traditionally been assumed to be impossible to incorporate into fundamental scientific explanations. They are facts not about what is--the actual--but about what could be: counterfactuals. According to physicist Chiara Marletto, laws about things being possible or impossible may (...) generate an alternative way of providing explanations. This fascinating, far-reaching approach holds promise for revolutionizing the way fundamental physics is formulated, but also for providing essential tools to face existing technological challenges, from delivering the next generation of information-processing devices, beyond the universal quantum computer, to designing AIs. Each chapter in the book delineates how an existing vexed open problem in science can be solved by this radically different approach; and it is augmented by short fictional stories that explicate the main point of the chapter. As Marletto demonstrates, contemplating what is possible can give us a more complete and hopeful picture of the physical world. (shrink)

This study conducted on a sample of 295 Dutch and Italian undergraduate and graduate students aims to investigate how psychopathic personality traits (meanness, boldness and disinhibition) may lead to cheating behavior, and to study whether there are correlations between psychopathic traits, motivation, moral disengagement, the perception of seriousness of academic dishonesty and frequency of academic dishonesty to try to better understand what causes students to cheat and engage in dishonest conduct. Results confirmed the key role of psychopathic traits, particularly the (...) disinhibition aspect in predicting academic dishonesty. In addition, it was shown that students’ perceptions of what constitutes academic dishonesty and what does not are also important in predicting the frequency of dishonest behavior. Furthermore, the role of motivation and moral disengagement in predicting and mediating the relationship between traits of psychopathy and academic dishonesty were analyzed through mediation and regression analysis. Here I present the first version of the transcription of the Commentarius in Metaphysicam by Konrad Graf from Cod. Pp 183 4°, Teil 2, Zentral- und Hochschulbibliothek Luzern [ZHB], Sondersammlung (ff. 1r-56v), which collects Graf's lectures in metaphysics, held at the Lucerne Gymnasium in 1635-36. The transcription of the text was carried out at the Lucerne Faculty of Theology within the SNSF project "Zwischen monastischer und reformierter Metaphysik. Die schweizerische 'Wiege' der Ontologie im Zeitalter der Reformation" (SNSF project 100012_192559 - (...) applicant: Prof. Dr. Giovanni Ventimiglia (TF- University of Lucerne), Employees: Marco Lamanna, Chiara Paladini. The project aimed to redefine the "cartography" of the Reformation in Switzerland on the traces of metaphysics teaching (Reportationes) in Swiss educational institutions and monastic poles, and thereby to gain a precise place for Swiss studies in the panorama of research on metaphysics and ontology in the early modern period. The project was based on a preliminary investigation that made it possible to recover new texts transmitting lessons on metaphysics held in Lucerne and Engelberg. The method was 1. to produce a systematic and comprehensive documentation based on an index of manuscripts and printed texts, most of them already identified, which testify to the existence of a cultural flourishing in Switzerland that has so far remained unexplored. 2. this documentation should be placed on a solid textual basis by transcribing and eventually critically editing those texts judged to be of interest in terms of their content and influence, in order to make them accessible to the scholarly community and to readers. 3. finally, we will examine the specific aspects of the teachings transmitted in these manuscripts. In 2012, baker Jack Phillips of Masterpiece Cakeshop refused to create a wedding cake for a same-sex couple, citing religious beliefs. Colorado Public Accommodations law prohibits business owners from denying the “full and equal enjoyment” of their services on the basis of sexual orientation, and Phillips refused to sell the couple the very same items he would sell to a heterosexual couple. But Phillips, who fashions himself as a “cake artist,” argues that applying the law here would interfere with his (...) free-speech rights. Moreover, he argues that he is not actually discriminating on the basis of sexual orientation but on the basis of a particular understanding of marriage; he is happy to sell Lesbian, Gay, Bisexual, and Transgender people a wide range of other items. In this chapter, I evaluate both arguments. In the postscript, I briefly explain the US Supreme Court's June 2018 ruling on the case. (shrink)

Friedrich Albert Lange was a neo-Kantian and a socialist. Scholars have questioned whether there is a connection between these two aspects of Lange’s work. The paper argues that such a connection is apparent once Lange’s philosophy is understood in light of Schiller’s Kantianism. According to Lange, Schiller’s aesthetic redemption consists of two tasks: to create the beautiful image of an ideal reality; and to realize this ideal model in the actual world. Accordingly, I show that Lange’s political analysis points to (...) three different types of social evolution: 1) one corresponding to the natural state of humanity, based on Darwin’s and Malthus’s concept of the struggle for survival; 2) one corresponding to ideal evolution, in which all human beings achieve full development of their talents (first task of the esthetic redemption); 3) one corresponding to the actual realization of this ideal, in which human beings advance step by step thanks to social experimentation and the resulting progress in knowledge (second task of esthetic redemption). Whereas “professional vision” has been mostly analyzed in apprenticeship and other settings where knowledge is made explicit or reflected upon, I focus on how expertise tacitly plays out in task-oriented interaction among practitioners. The paper considers orientation both to the coworker’s and one’s own expertise in the collaborative accomplishment of airport security work. I show how screeners recruit action from colleagues in largely underspecified ways, based on shared access to the visibility field and expected professional vision. Requesting is tacitly accomplished (...) via “highlighting,” which also accounts for one’s request. Accepting is silently achieved via locomotion, which also serves as a display of understanding. Embodied action is systematically preferred to verbal one. Talk is employed in larger proportions when the domain of scrutiny is not equally accessible to interactants, and when “face-work” is required. (shrink)

In June 2018 the Supreme Court of the United States decided the case of Masterpiece Cakeshop, in which baker Jack Phillips refused to provide a cake for a same-sex wedding. The Court decided the case on fairly narrow grounds; in particular, it set aside the question of whether Phillips illegally discriminated on the basis of sexual orientation by refusing to sell the same cake to a gay couple that he would sell to a heterosexual couple. Concurring opinions by Justices Kagan (...) and Gorsuch do address that question, however, and in this paper I explore the debate between them. By distinguishing between design-based and use-based refusals of service and then arguing that some use-based refusals are tantamount to discrimination on the basis of protected traits, I argue that Jack Phillips did indeed discriminate on the basis of sexual orientation. I also argue that another baker, who refused to create a “Leviticus 18:22 ‘Homosexuality is a detestable sin’ ” cake, did not discriminate on the basis of religion. I thus side with Justice Kagan against Justice Gorsuch on the question of whether the Colorado commission treated the two bakers inconsistently. (shrink)

Il presente contributo mira a gettare luce sulla figura ebraica dello Schlemihl, per come questa è venuta ad assumere, nei discorsi di Rahel Varnhagen, Hannah Arendt e Lea Ritter Santini, la funzione extra-letteraria di dispositivo di riconoscimento e schema esistenziale. È nella triangolazione dei discorsi e delle vite di queste tre intellettuali appartenenti, ognuna a suo modo, alla cultura tedesca, che la figura dello Schlemihl ha esemplarmente dispiegato la sua forza genetica, come metafora di un destino in cui, fin dal (...) momento del suo apparire letterario nella società dei salotti berlinesi di primo Ottocento grazie ad Adelbert von Chamisso, hanno riconosciuto se stesse coloro che hanno dovuto ritagliare la propria vita sul fondamento dello sradicamento e di una esclusione primigenia. In quella che potrebbe essere compresa come una vera e propria genealogia, il riferirsi allo Schlemihl di Rahel Varnhagen, Hannah Arendt e Lea Ritter Santini restituisce il senso comune di uno sfaccettato subire e agire lo sradicamento, entro la cornice di un discorso prismatico – sotto forma di lettere, saggi e poesie – che nel nutrirsi di vita e pensiero ha saputo raccontare la marginalità nelle sue forme differenti e contigue. EU co-legislators recently approved the EU carbon border adjustment mechanism (CBAM), which establishes a uniform carbon price on both EU and imported products, in ETS covered sectors. This violates the CBDR-RC principle. Yet, CBAM advocates claim that the resulting unfair mitigation can be offset by scaling up climate finance, to the benefit of poorer countries. I argue that the CBAM’s unfairness is compounded by previous climate injustice, as avoidable emissions by developed countries pushed the climate crisis to the point where (...) fair mitigation is no longer viable. This implies that a disadvantage within the distributive sphere of emissions abatement cannot be counterbalanced by additional advantages within the distributive sphere of climate finance. (shrink)

Climate justice demands polluters to take responsibility for both present and future harm caused by past GHG emissions and for future harm caused by future GHG emissions. One problem with this is double climate taxation: people living in historical polluting countries must both shoulder the burden of an effective and inclusive climate transition and repay the climate debt incurred by their predecessors. Although double climate taxation might be defensible on normative grounds, it risks making climate justice politically infeasible. I therefore (...) maintain that global climate justice should focus on future, rather than past, climate harms. The forward-looking polluter pays principle (FL-PPP) can ensure both a cost-effective climate transition and a fair distribution of the climate burden, provided it is applied as follows: i) each country must introduce a carbon price calibrated to the global social cost of carbon; ii) each country must transfer part of carbon revenues collected at the country level to an international fund; iii) global carbon revenues must be redistributed on the basis of the country-level social cost of carbon. The FL-PPP burden can be made more progressive, moreover, if the formula for allocating global carbon revenues is adjusted through two coefficients, one consumption-based and one priority-sensitive. The development of artificial agents for social interaction pushes to enrich robots with social skills and knowledge about (local) social norms. One possibility is to distinguish the expressive and the functional orders during a human-robot interaction. The overarching aim of this work is to set a framework to make the artificial agent socially-competent beyond dyadic interaction – interaction in varying multi-party social situations – and beyond individual-based user personalization, thereby enlarging the current conception of “culturally-adaptive”. The core idea is to (...) provide the artificial agent with the capability to handle different kinds of interactional disruptions, and associated recovery strategies, in microsociology. The result is obtained by classifying functional and social disruptions, and by investigating the requirements a robot’s architecture should satisfy to exploit such knowledge. The paper also highlights how this level of competence is achieved by focusing on just three dimensions: (i) social capability, (ii) relational role, and (iii) proximity, leaving aside the further complexity of full-fledged human-human interactions. Without going into technical aspects, End-to-end Data-driven Architectures and Modular Architectures are discussed to evaluate the degree to which they can exploit this new set of social and cultural knowledge. Finally, a list of general requirements for such agents is proposed. (shrink)

This study offers a new interpretation of the poem of the founder of Western philosophy: Parmenides. It shows that there is more in his poem than the description of Being by means of negative adjectives such as ingenerated and immobile. His words ask his audience to question their habits, to modify their goals, to engage in new enterprises and to look with a critical eye at their previous attempts to get knowledge. It operates as a travel guide that leads the (...) audience on a journey that will educate them and help them to gradually become philosophically mature, to become true themselves, which can also be described as the encouragement to become Being. Virgilio desarrolló en sus obras el mito de la edad de oro y lo concibió como posible en el tiempo presente. El objetivo de nuestro trabajo es analizar en Eneida las menciones de los gobernantes itálicos de la edad de oro, Saturno y Augusto, como un continuum mítico-histórico. Nos proponemos demostrar que el regreso áureo en Eneida, en consonancia con sus anteriores obras (Ecl. y G.), solo es factible si existe un buen gobernante que cumpla determinadas condiciones, como promover la (...) paz entre guerras (Zetzel, 1997) y dar leyes al pueblo para fomentar la agricultura (Johnston, 1980).
