British photographer Julia Margaret Cameron (1815-1879) has been described as "one of the Finest portraitists of the nineteenth century-in any medium.

Some argue that Lewisian realism fails as a reduction of modality because in order to meet some criterion of success the account needs to invoke primitive modality. I defend Lewisian realism against this charge; in the process, I hope to shed some light on the conditions of success for a reduction. In §1 I detail the resources the Lewisian modal realist needs. In §2 I argue against Lycan and Shalkowski’s charge that Lewis needs a modal notion of ‘world’ to ensure (...) that worlds correspond to possibilities. In §3 I respond to Divers and Melia’s objection that Lewis needs to invoke primitive modality to give a complete account of what worlds there are. In §4 I ask what it is for a notion to ‘involve’ modality. I conclude that the question is either in bad standing or at best offers little traction on the debate, and propose a different way of assessing when materials are appropriately included in a reductive base. I defend the view that a significant ethical distinction can be made between justified killing in self-defense and police use of lethal force. I start by opposing the belief that police use of lethal force is morally justified on the basis of self-defense. Then I demonstrate that the state’s monopoly on the use of force within a given jurisdiction invests police officers with responsibilities that go beyond what morality requires of the average person. I argue that the police should primarily (...) be concerned with preserving public safety. As a consequence, police have additional moral permissions to use lethal force. But this also means that the principle of restraint is inherent to the policing function and therefore police are obliged to go to greater lengths to avoid killing. I concede that the just use of police force can be made difficult in extreme situations such as a mass riot. In such cases, police should take proportionate actions necessary to protect the lives of inhabitants by restoring order, which might include calling on military support. I conclude with a cautionary note opposing militarization of the policing role. (shrink)

The conclusion of practical reasoning is commonly said to rest upon a diverse pair of representations—a “major” and a “minor” premise—the first of which concerns the end and the second, the means. Modern and contemporary philosophers writing on action and practical reasoning tend to portray the minor premise as a “means-end belief”—a belief about, as Michael Smith puts it, “the ways in which one thing leads to another,” or, as John McDowell puts it, “what can be relied on to bring (...) about what.” On this point there is little difference between followers of Davidson and followers of Anscombe, or between those who invoke Hume’s legacy and those who invoke Aristotle’s. But Aristotle himself held a very different position. According to him, the minor premise concerns particulars, a sphere controlled by perception. The perception of particulars—that is, of the really-existing people and things confronted in the field of action—plays no essential role in the modern account of rational agency. Because it does not, the modern account fails to explain how one could act for a reason, or how practical reasoning could deliver any conclusion. (shrink)

When an agent intentionally changes something separate from herself—when, say, she opens a bottle—what is the relation between what the agent does and what the patient suffers? This paper defends the Aristotelian thesis that action is to passion as the road from Thebes to Athens is to the road from Athens to Thebes: they are two aspects of a single material reality. Philosophers of action tend to think otherwise. It is generally taken for granted that intentional transactions must be analyzed (...) in terms of a causal relation. Controversy surrounds the question what the causal relata are: event-causalists claim that both of the relata are events; agent-causalists claim that the first relatum is an agent, and they dispute among themselves whether the second is an event or a terminal state of the patient. But the entire controversy assumes the necessity of some causal analysis of transactions. This paper argues that, far from being necessary, no such analysis is even possible. (shrink)

In an effort to theorize educational logics that are oppositional to capitalism, this article explores what it means to study like a communist. I begin by drawing out the tight connection between learning and capitalism, demonstrating that education is not a subset but a motor of political-economic relations. Next, I turn to the concept of study, which is being developed as an educational alternative to learning. While studying represents an educational challenge to capitalism, I argue that there are political limitations (...) to studying for which we need to account. Specifically, studying is not in itself political, but only represents the possibility of politics. To make this claim and to address these limitations, I turn to Jodi Dean’s work on the communist Party. Dean posits the Party not as a master, director, or prophet, but as an infrastructure of affective intensity that maintains a gap in the order of things. I show that the Party is one way to organize and to defend study. Throughout the article, I illuminate the ways in which educational philosophers can contribute to political movement building by showing, developing, and refining the educational components of politics that many organizers and theorists neglect. BackgroundUse of routinely collected patient data for research and service planning is an explicit policy of the UK National Health Service and UK government. Much clinical information is recorded in free-text letters, reports and notes. These text data are generally lost to research, due to the increased privacy risk compared with structured data. We conducted a citizens’ jury which asked members of the public whether their medical free-text data should be shared for research for public benefit, to inform an ethical (...) policy.MethodsEighteen citizens took part over 3 days. Jurors heard a range of expert presentations as well as arguments for and against sharing free text, and then questioned presenters and deliberated together. They answered a questionnaire on whether and how free text should be shared for research, gave reasons for and against sharing and suggestions for alleviating their concerns.ResultsJurors were in favour of sharing medical data and agreed this would benefit health research, but were more cautious about sharing free-text than structured data. They preferred processing of free text where a computer extracted information at scale. Their concerns were lack of transparency in uses of data, and privacy risks. They suggested keeping patients informed about uses of their data, and giving clear pathways to opt out of data sharing.ConclusionsInformed citizens suggested a transparent culture of research for the public benefit, and continuous improvement of technology to protect patient privacy, to mitigate their concerns regarding privacy risks of using patient text data. Background: Limited knowledge of the experiences of conflicts of conscience found in nursing literature. Objectives: To explore the individual experiences of a conflict of conscience for neonatal nurses in Alberta. Research design: Interpretive description was selected to help situate the findings in a meaningful clinical context. Participants and research context: Five interviews with neonatal nurses working in Neonatal Intensive Care Units throughout Alberta. Ethical consideration: Ethics approval from the Health Research Ethics Board at the University of Alberta. Findings: Three common (...) themes emerged from the interviews: the unforgettable conflict with pain and suffering, finding the nurse’s voice, and the unique proximity of nurses. Discussion and conclusion: The nurses described a conflict of conscience when the neonate in their care experienced undermanaged pain and unnecessary suffering. During these experiences, they felt guilty, sad, hopeless, and powerless when they were unable to follow their conscience. Informal ways to follow their conscience were employed before declaration of conscientious objection was considered. This study highlights the vital importance of respecting a conflict of conscience to maintain the moral integrity of neonatal nurses and exposes the complexities of conscientious objection. (shrink)

Starting with Houtkoop and Mazeland’s study of discourse units, and touching upon recent studies aimed at detailing unit projection in interaction, this article argues that the drive toward abstract and discrete models for units and unit projection is potentially misleading. While it has been established that to engage in talk-in-interaction, as it unfolds in real time, participants rely on projectable units, research aimed at defining units unintentionally backgrounds the contingency inherent in interaction. A central function of language for collaborative action (...) is the management of simultaneously unfolding facets of action, sound production, gesture, and grammar – produced by multiple participants. This article draws upon classic and current data analyses foregrounding linguistic/interactional practices designed to manage local contingencies. It is argued that attention to participants’ regular methods for managing and exploiting contingencies be incorporated from the outset in our descriptions of language and the nature of unit building in interaction. In this article I bring Giorgio Agamben’s notion of ‘whatever singularity’ into critical pedagogy. I take as my starting point the role of identity within critical pedagogy. I call upon Butler to sketch the debates around the mobilization of identity for political purposes and, conceding the contingent necessity of identity, then suggest that whatever singularity can be helpful in moving critical pedagogy from an emancipatory to a liberatory project. To articulate whatever singularity I situate the concept within the work in (...) which it appears, and then take a detour into Agamben’s general philosophical project. I propose that, for critical pedagogy to take whatever singularity seriously, it must uphold a respect for the ineffability of being, which entails in part the suspension of dialogue. To help flesh out what I mean by this proposal, I turn to a fragment of Lyotard’s philosophy and his critique of democracy. I conclude by addressing a pressing ontological critique of Agamben, which leads me to argue for a materialist appropriation of the figure of whatever singularity, one that is held in tension with ontological concerns of identity. I defend a modified rights-based unjust threat account for morally justified killing in self-defense. Rights-based moral justifications for killing in self-defense presume that human beings have a right to defend themselves from unjust threats. An unjust threat account of self-defense says that this right is derived from an agent’s moral obligation to not pose a deadly threat to the defender. The failure to keep this moral obligation creates the moral asymmetry necessary to justify a defender killing the unjust threat in (...) self-defense. I argue that the other rights-based approaches explored here are unfair to the defender because they require her to prove moral fault in the threat. But then I suggest that the unjust threat account should be modified so that where the threat is non-culpable or only partially culpable, the defender should seek to share the cost and risk with the threat in order for both parties to survive. The traditional Christian teaching is that engaging in sexual activity, whether heterosexual or homosexual, outside the marriage of one man and one woman is sinful. In direct contrast, there are those in the Church who quite recently have begun to insist that the traditional teachings concerning sexual sin need to be changed. In particular, the effort is being made to have the Church accept homosexual behavior as not sinful or problematic in any way—at least not for committed homosexuals, as comparable (...) to committed heterosexuals in a marriage. As we all know, this relatively recent view has been promoted heavily in the media and popular culture, and even by our national government. As we make our observations, we will particularly focus on traditional Orthodox Christianity as the fullness of the truth and, thus, the source of the true alternative to this “new” outlook that is gripping much of popular Western culture today. Benchmarks against which healthcare ethics consultation (HCEC) services can assess their performance are needed. As first-generation benchmarks continue to be developed, it is the obligation of the field to continually evaluate how these measures reflect the performance of any single HCEC service. This will be possible only with widespread reporting of standardized data points. In their article in this issue of The Journal of Clinical Ethics, Glover and colleagues provide a valuable preliminary approach for assessing appropriate consult volumes for a (...) HCEC service. The limitations of their study read as a call to action for the field of clinical ethics to expand and standardize data reporting so that more robust metrics can be developed. In response to this call by Glover and colleagues, the Cleveland Clinic HCEC service provides consult data from 2015 through 2019 for one of its medical centers, and offers an additional volumebased metric, consult-to-ICU-to-bed ratio (CiBR), that may add nuance to any normative assessment of HCEC service consult volume. Given that volume-based metrics are the native language of the clinical environment, efforts to improve such metrics in the field through transparency and standardization are warranted. However, the expositive power of volume-based metrics is limited; additional domains related to quality and outcomes are needed. (shrink)

Decisions about targeting medical assistance in humanitarian contexts are fraught with dilemmas ranging from non-availability of basic services, to massive demographic and epidemiological shifts, and to the threat of insecurity and evacuations. Aid agencies are obliged, due to capacity constraints and competing priorities, to clearly define the objectives and the beneficiaries of their actions. That aid agencies have to set limits to their actions is not controversial, but the process of defining the limits raises ethical questions. In MSF, frameworks for (...) resource allocation are subject to constant reflection and reiteration, and perspectives are sought at all levels, from implementers at the programme level to the operational directors at headquarters. The perspectives of the programmes staff hold considerable weight as they have the knowledge and experience with particular communities to assess the degree of vulnerability and need, and are also the people who ultimately have to give explanations to beneficiaries when changes or closures are going to be instituted. Humanitarian agencies have a responsibility to ensuring that their workers are prepared to reflect on these dilemmas, and challenge the status quo when it costs lives. (shrink)

While there was a flurry of articles throughout the 1990s in philosophy of education on Lyotard, there are still several key concepts in his oeuvre that have import for but remain largely underdeveloped or absent in the field. One of the most interesting of these absent concepts is Lyotard’s notion of the figural. In this paper, I take the figural as an educational problematic and ask what new educational insights it can generate in regard to the existing literature. As such, (...) this article begins with a survey and synthesis of educational literature on Lyotard and the primary work on which most of it is based, exploring the relationship between knowledge, performativity, the differend, and “the system.” I then examine conceptions of education oriented toward defending the differend and disrupting the system and claim that, while helpful, these conceptions are limited in that they do not mention how educators and students might engage the alterity that the system seeks to repress. I believe that it is here that Lyotard’s notion of the figural can be productively engaged. The next section of the paper performs a partial and educationally partisan reading of Discourse, Figure. After this reading I move to formulate a figural education, which is composed of three educational processes and modes of engagement: reading, seeing, and blindness. A figural education, I argue, holds each of these practices in an uncertain and unsettling relation and, in so doing, can help educators defend the figural and the differend against the discursive demands of the system. Attentive readings of Deleuze’s works alongside the projects of his teachers show that they often share a common problem or set of problems. One of the most innovative and influential of these projects is the work of Jean Wahl. Wahl’s analysis of French existential phenomenology, here analyzed through a representative essay published in 1950, focuses on the problem of the pre-personal, pre-subjective elements of thinking and worldly existence. Background Nursing students must graduate prepared to bravely enact the art and science of nursing in environments infiltrated with ethical challenges. Given the necessity and moral obligation of nurses to engage in discourse within nursing ethics, nursing students must be provided a moral supportive learning space for these opportunities. Situating conversations and pedagogy within a brave space may offer a framework to engage in civil discourse while fostering moral courage for learners. Research Objective The aim of this research is to (...) explore the influence of a structured self-assessment tool called the ESA “Engagement Self-Assessment” on the alignment and creation of a brave space in a nursing ethics course. Research Design This study used an exploratory, cross-sectional survey design. Participants and Study Setting Data from 39 undergraduate nursing students enrolled in a nursing healthcare ethics & law course using the ESA were recruited. Ethical Considerations Participation was voluntary and informed without coercion. Written consent was obtained prior to participation. Research ethics approval was obtained by the Institutional Research Ethics Board of the recruited participants (Ethics # 2022-23-03). Findings The ESA provided structured self-reflection on the impact of shared vulnerability within a brave space. However, commitment to a brave space was not strongly influenced by the ESA, but rather by a mutual “commitment to others.” Conclusion A teaching tool such as an ESA can be used to facilitate instructor expectations of civil discourse and discussion of difficult topics. Rules of engagement such as those found in brave spaces can help transform fear of vulnerability into authentic growth for learners. A morally supportive learning space can support critical opportunities for ethical development. This study provides insight into how self-assessment and the use of a brave space in nursing ethics education can facilitate a morally supportive learning space. (shrink)

Background and Aims Progress towards validating amyloid beta as an early indicator of Alzheimer’s disease (AD) heightens the need for evaluation of stakeholders’ perspectives of the benefits and harms of preclinical testing in asymptomatic individuals. Methods Investigators conducted and analyzed 14 semi-structured interviews with family members of patients diagnosed with AD. Results Participants reported benefits, including the potential to seek treatment, make lifestyle changes, and prepare for cognitive impairment. Participants identified harms, including social harms, adverse life decisions, and psychological harms. (...) Nine participants reported either a “positive global perspective” or a “positive global perspective (qualified).” Conclusion Results from this study characterized stakeholders’ perspectives on the potential benefits and harms of clinical use of preclinical testing for AD. Investigators used data from this study to develop a framework that contributes to ongoing discussions that will evaluate widespread adoption of preclinical testing and will inform future research. Seeking to derive the manifestly qualitative world of objects and entities without recourse to fundamental categoricity or qualitativity, I offer an account of how higher-order categorical properties and objects may emerge from a pure-power base. I explore the possibility of ‘fields’ whose fluctuations are force-carrying entities, differentiated with respect to a micro-topology of curled-up spatial dimensions. Since the spacetime paths of gauge bosons have zero ‘spacetime interval’ and no time-like extension, I argue that according them the status of fundamental entities (...) would support a pure-power ontology. Such entities, circulating within self-sustaining micro-topological ‘networks’, feasibly maintain definite spatial configurations of conserved physical quantities, including energy-momentum. Perceived as time-like and massy, and representing fermionic entities, they give rise to the manifest world. (shrink)

Modern philosophers writing on action and practical reasoning rarely discuss perception. This is remarkable, not only because acting on the particular objects in one’s environment obviously requires a perceptual awareness of them, but also because perception is central to the account of action and practical reasoning offered by Aristotle, from whom many contemporary philosophers take their inspiration. The pivotal role that Aristotle assigned to perception is now uniformly given to belief, an act of mind or propositional attitude that might concern (...) particulars, but that might equally well concern general laws of nature, probabilities, or rules of logic. This paper aims to recover and demystify the idea of a practical perception. On the one hand, it argues that in order to mediate between a general end and an action performed in pursuit of that end, the minor premise of practical reasoning must concern particulars and must therefore be perceptual. On the other hand, it argues that this same minor premise must be practical, in the sense that it must represent the particular objects about which the agent is reasoning as constituting a field of obstacles and opportunities, or of things to be avoided and pursued. In the course of remarking on the “parodic” nature of Nietzsche’s “doctrine” of Eternal Return, Klossowski writes of “laughter, this infallible assassin.” (Amir 2021, 272) The laughter of homo risibilis does not err in its elimination of human despair, nor does it errantly dispose of any other portion of human existence. A question that I will develop over the course of these remarks is the question of this assassination by laughter: what, precisely, is assassinated? and, what might be lost in (...) such an assassination? In pursuing this question, I want to explore the temporal overlap between the academic acceptance of Nietzsche in France in the early 1960s and the discussion of Spinoza in France at the same time—a discussion that was closely linked to the Holocaust—in order to raise the question of the relation of humor and history. -/- My question to Prof. Amir is: do laughter and humor have a role to play even in the face of world-shattering wrongs? In her account of homo risibilis and in her account of Nietzsche’s philosophy of laughter and its French inheritors, the focus seems squarely on the present and the future. Deleuze’s laughter is that of the human being who has embraced fate but also of the individual who, with their laughter, would overturn norms and conventions. Prof. Amir writes that “Deleuze … focuses on the iconoclastic force of humor, its capacity to break any boundary or law.” (Amir 2021, 282) But is such a focus recalcitrant to ethical efforts to reckon with past evils and injustices? In the overcoming of the tragic by the comic, is there room for remembrance? Is there room for honor to be paid to history? Or, are laughter and humor a-historical forces—is laughter, after all, in Klossowski’s words, an infallible assassin? Is no historical event secure from its transformative and iconoclastic work? -/- . (shrink)

Systematic pluralism does not purport to be a new philosophy. Rather, it is a position on positions, a discovery of something previously unrecognized in the nature of philosophical thought. Further, “since the special arts and sciences are particular embodiments of philosophic principles, a pluralism at the level of philosophy implies a similar pluralism at the level of the special arts and sciences.” Therefore, the claims of systematic pluralism are not limited to philosophy but the position has something fundamental to report (...) about all departments of human thought, resulting in the characteristic movement between levels of generality, from widest philosophical import to narrowest disciplinary application, which appears over and over again in the writings of systematic pluralists and which is well exemplified by the essays in this issue of The Monist, the first of any publication dedicated entirely to the examination of discoveries which are now over half a century old.
