This paper draws on several projects over sixteen years which attempted to develop capacity in educational research at Addis Ababa University. It identifies what might be considered indicators of a thriving research environment as defined from a UK perspective, not simply the necessary skills and infrastructure requirements but also what might be considered 'academic' or 'intellectual' virtues. Having outlined specific project activities, our responses and mutual learning, the paper goes on to consider how such qualities might relate to an Ethiopian (...) academic setting where cultural norms and political contexts have tended to encourage silence and caution rather than critique and argument. Thus through these comparisons, I argue that research capacity building is not just a body of knowledge or set of techniques to be delivered through workshops, but is about the importance of developing a research culture which engages with the underlying attitudes that derive from the country context. According to the variety of evidence thesis items of evidence from independent lines of investigation are more confirmatory, ceteris paribus, than, for example, replications of analogous studies. This thesis is known to fail (Bovens and Hartmann; Claveau). However, the results obtained by Bovens and Hartmann only concern instruments whose evidence is either fully random or perfectly reliable; instead, for Claveau, unreliability is modelled as deterministic bias. In both cases, the unreliable instrument delivers totally irrelevant information. We present a model that (...) formalizes both reliability and unreliability differently. Our instruments either are reliable, but affected by random error, or are biased but not deterministically so.Bovens and Hartmann’s results are counter-intuitive in that in their model a long series of consistent reports from the same instrument does not raise suspicion of ‘too-good-to-be-true’ evidence. This happens precisely because they contemplate neither the role of systematic bias, nor unavoidable random error of reliable instruments. In our model, the variety of evidence thesis fails as well, but the area of failure is considerably smaller than for Bovens and Hartmann and Claveau, and holds for (the majority of) realistic cases (that is, where biased instruments are very biased). The essential mechanism that triggers variety of evidence thesis failure is the rate of false to true positives for the two kinds of instruments. Our emphasis is on modelling beliefs about sources of knowledge and their role in hypothesis confirmation in interaction with dimensions of evidence, such as variety and consistency. (shrink)

Philosophical discussions have critically analysed the methodological pitfalls and epistemological implications of evidence assessment in medicine, however they have mainly focused on evidence of treatment efficacy. Most of this work is devoted to statistical methods of causal inference with a special attention to the privileged role assigned to randomized controlled trials (RCTs) in evidence based medicine. Regardless of whether the RCT’s privilege holds for efficacy assessment, it is nevertheless important to make a distinction between causal inference of intended and unintended (...) effects, in that the unknowns at stake are heterogonous in the two contexts. However, although “lower level” evidence is increasingly acknowledged to be a valid source of information contributory to assessing the risk profile of medications on theoretical or empirical grounds, current practices have difficulty in assigning a precise epistemic status to this kind of evidence because they are more or less implicitly parasitic on the (statistical) methods developed to test drug efficacy. My thesis is that (1) “lower level” evidence is justified on distinct grounds and at different conditions depending on the different epistemologies which one wishes to endorse, in that each impose different constraints on the methods we adopt to collect and evaluate evidence; (2) such constraints ought to be understood to be different in the case of evidence for risk versus benefit assessment for a series of reasons which I will illustrate on the basis of the recent debate on the causal association between acetaminophen (a.k.a. paracetamol) and asthma. Understanding what numbers are means knowing several things. It means knowing how counting relates to numbers (called the cardinal principle or cardinality); it means knowing that each number is generated by adding one to the previous number (called the successor function or succession), and it means knowing that all and only sets whose members can be placed in one-to-one correspondence have the same number of items (called exact equality or equinumerosity). A previous study (Sarnecka & Carey, 2008) linked children's understanding (...) of cardinality to their understanding of succession for the numbers five and six. This study investigates the link between cardinality and equinumerosity for these numbers, finding that children either understand both cardinality and equinumerosity or they understand neither. This suggests that cardinality and equinumerosity (along with succession) are interrelated facets of the concepts five and six, the acquisition of which is an important conceptual achievement of early childhood. I argue for the possibility of posthumous harm based on an account of the harm of murder. I start with the deep-seated intuition that when someone is murdered he (or she) is harmed (over and above the pain of injury or dying), and argue that Feinberg's account that assumes that harm is an invasion of an interest cannot plausibly accommodate this intuition. I propose a new account of the harm of murder: it is an irreversible loss of functions necessary for (...) worthwhile existence. I suggest a (partial) loss analysis of harm in general, and then go on to apply it to posthumous harm and defend the idea that there can be posthumous losses. (shrink)

Risk communication has been generally categorized as a warning act, which is performed in order to prevent or minimize risk. On the other side, risk analysis has also underscored the role played by information in reducing uncertainty about risk. In both approaches the safety aspects related to the protection of the right to health are on focus. However, it seems that there are cases where a risk cannot possibly be avoided or uncertainty reduced, this is for instance valid for the (...) declaration of side effects associated with pharmaceutical products or when a decision about drug approval or retirement must be delivered on the available evidence. In these cases, risk communication seems to accomplish other tasks than preventing risk or reducing uncertainty. The present paper analyzes the legal instruments which have been developed in order to control and manage the risks related to drugs – such as the notion of “development risk” or “residual risk” – and relates them to different kinds of uncertainty. These are conceptualized as epistemic, ecological, metric, ethical, and stochastic, depending on their nature. By referring to this taxonomy, different functions of pharmaceutical risk communication are identified and connected with the legal tools of uncertainty management. The purpose is to distinguish the different functions of risk communication and make explicit their different legal nature and implications. (shrink)

_Retrieving Political Emotion _engages the reader in an excursion through our ancient Greek heritage to recover a concept of emotion useful for enriching political philosophy today. Focusing on _thumos_, Barbara Koziak reveals misinterpretations of the concept that have hampered recognition of its possibilities for normative theory. Then, drawing especially on Aristotle's construal of it as a general capacity for emotion and relating this to contemporary multidisciplinary work on emotion, she reformulates _thumos_ to provide a more adequate theory of political (...) emotion, as an antidote to the modern fixation on rational self-interest as the key to explaining political behavior. The book proceeds by recounting the way _thumos_ is used in Homer's _Iliad_ and Plato's _Republic_ and then showing how, while borrowing from both, Aristotle went substantially beyond them. From the _Nicomachean Ethics and Politics_ we can see the activity of _thumos_—how a person with good _thumos_ acts and through which institutions. Through the _Poetics_ we observe the characteristic disposition of _thumos_—what patterns and objects typify a person's emotional capacity in the best regime. Her reconstructed Aristotelian theory of political emotion allows Koziak in the concluding chapter to show how it can help us better understand political behavior today, as manifested in recent congressional debates on welfare reform, and through constructive engagement with feminist thinking on the "ethics of care" lead political theory to pay more attention to the importance of passions in political life. Purpose The purpose of this paper is to suggest a definition of genetic information by taking into account the debate surrounding it. Particularly, the objections raised by Developmental Systems Theory to Teleosemantic endorsements of the notion of genetic information as well as deflationist approaches which suggest to ascribe the notion of genetic information a heuristic value at most, and to reduce it to that of causality. Design/methodology/approach The paper presents the notion of genetic information through its historical evolution and analyses (...) it with the conceptual tools offered by philosophical theories of causation on one side and linguistics on the other. Findings The concept of genetic information is defined as a special kind of cause which causes something to be one way rather than another, by combining elementary units one way rather than another. Tested against the notion of “genetic error” this definition demonstrates to provide an exhaustive account of the common denominators associated with the notion of genetic information: causal specificity; combinatorial mechanism; arbitrariness. Originality/value The definition clarifies how the notion of information is understood when applied to genetic phenomena and also contributes to the debate on the notion of information, broadly meant, which is still affected by lack of consensus. Findings about the desire for health-risk information are heterogeneous and sometimes contradictory. In particular, they seem to be at variance with established psychological theories of information-seeking behavior.The present paper posits the decision about treating illness with medicine as the causal determinant for the expected net value of information, and attempts to explain idiosyncrasies in information-seeking behavior by using the notion of decision sensitivity to incoming information.Furthermore, active information avoidance is explained by modeling the expected emotional distress potentially brought about by (...) “bad news” as a disutility factor in pay-off maximization.In this context two notions of uncertainty are distinguished: an epistemic uncertainty related to the prognostic probability assigned to the risk, and an emotional uncertainty related to the expected damage. Health-risk information can both reduce epistemic and increase emotional uncertainty, giving rise to idiosyncratic processing strategies. (shrink)

According to Pliny, he noted, grammarians did not believe the noun vita had a plural. More to the point, although "there is a diversity (...) of merits and virtues among [the saints], … the one life of the body sustains them all in this world."1 Just as the Church, the body of Christ, is one, so too the saints. Their project of imitatio Christi re-presents the one and only life of Christ for each new generation. As a literary genre, hagiography fleshes out this insight, for no other genre is so steeped in self-citation. Every vita is such a tissue of biblical verses that, to edit a saint's Life before Google, one had to know Scripture by heart or spend endless hours with a concordance. After the Bible, quotations from a few classic vitae were constantly recycled: Athanasius' Life of St. Antony, Sulpicius Severus' Life of St. Martin, Gregory the Great's Life of St. Benedict. With the passage of time, newer classics joined older ones to produce one vast, self-referential monument, incarnate in the Acta Sanctorum: Gregory's vita sanctorum multiplied ad infinitum. So deep did this tendency run that, when an obscure saint needed a vita to justify a cult, shameless hagiographers would plagiarize whole paragraphs, plundering stories and miracles from earlier vitae to serve their turn.2 [End Page 169]It is small wonder, then, that the hagiographic genre is so often characterized as "traditional" or "conservative." It is nostalgic, too, in the sense that each saint's words and deeds bring a glorious Golden Age back to life—most often the apostolic age or the time of the Desert Fathers, but sometimes the graced beginnings of a religious order. Such memorials enabled later generations to idealize their glorious founders. This tendency to exalt the new as a renovation of the old has deep roots in Christianity; even the evangelist Matthew systematically represents Jesus as a new Moses. In the same vein, it is not unusual to find a saint identified as a new Jacob or a second David. On the other hand, many saints' Lives make an insistent claim to newness, renovatio. For the saints were, and are, extraordinary—not merely good men and women, but radical figures whose words and deeds shocked those around them, beginning with their parents. Like Jesus, they had not only admirers, but detractors in plenty. If their publicists held them up as exemplars of virtue, theirs was no ordinary kind, for the heroic virtue that gave saints their charisma could look much like madness. Despite the precedents of earlier vitae, their ascetic feats and challenging behavior often struck observers as new and unheard-of. In hagiography, therefore, claims of novelty play a key role that balances the familiar topoi. Sometimes the newness of a saint's charism is cause for joyful celebration. Jesus, after all, had declared ecce nova facio omnia (Rev 21:5). But "novelties" also had to be handled with care, for they could easily be condemned as heresies or extreme practices deviating from the tradition of the elders.This tension between novelty and nostalgia emerges most clearly in the vitae of saints who founded genuinely new forms of religious life. In this paper I will explore the way it plays out in two early Lives of Francis of Assisi, perhaps the most popular saint of all time. After his death in 1226, Francis set a speed record for canonization—one that would be surpassed in the Middle Ages only by his disciple, St. Anthony of Padua, and by the Dominican martyr Peter of Verona.3 Aside from his charisma and the exponential growth of the Franciscan Order, the fast-track canonization is due to Pope Gregory IX, who as Cardinal Hugolino had been personally close to Francis and supported his movement. Medical diagnosis has been traditionally recognized as a privileged field of application for so called probabilistic induction. Consequently, the Bayesian theorem, which mathematically formalizes this form of inference, has been seen as the most adequate tool for quantifying the uncertainty surrounding the diagnosis by providing probabilities of different diagnostic hypotheses, given symptomatic or laboratory data. On the other side, it has also been remarked that differential diagnosis rather works by exclusion, e.g. by modus tollens, i.e. deductively. By drawing on a (...) case history, this paper aims at clarifying some points on the issue. Namely: 1) Medical diagnosis does not represent, strictly speaking, a form of induction, but a type, of what in Peircean terms should be called ‘abduction’ (identifying a case as the token of a specific type); 2) in performing the single diagnostic steps, however, different inferential methods are used for both inductive and deductive nature: modus tollens, hypothetical-deductive method, abduction; 3) Bayes’ theorem is a probabilized form of abduction which uses mathematics in order to justify the degree of confidence which can be entertained on a hypothesis given the available evidence; 4) although theoretically irreconcilable, in practice, both the hypothetical- deductive method and the Bayesian one, are used in the same diagnosis with no serious compromise for its correctness; 5) Medical diagnosis, especially differential diagnosis, also uses a kind of “probabilistic modus tollens”, in that, signs (symptoms or laboratory data) are taken as strong evidence for a given hypothesis not to be true: the focus is not on hypothesis confirmation, but instead on its refutation [Pr (¬ H/E1, E2, …, En)]. Especially at the beginning of a complicated case, odds are between the hypothesis that is potentially being excluded and a vague “other”. This procedure has the advantage of providing a clue of what evidence to look for and to eventually reduce the set of candidate hypotheses if conclusive negative evidence is found. 6) Bayes’ theorem in the hypothesis-confirmation form can more faithfully, although idealistically, represent the medical diagnosis when the diagnostic itinerary has come to a reduced set of plausible hypotheses after a process of progressive elimination of candidate hypotheses; 7) Bayes’ theorem is however indispensable in the case of litigation in order to assess doctor’s responsibility for medical error by taking into account the weight of the evidence at his disposal. Dworkin's theoretical disagreement argument, developed in Law's Empire, is presented in that work as the motivator for his interpretive account of law. Like Dworkin's earlier arguments critical of legal positivism, the argument from theoretical disagreement has generated a lively exchange with legal positivists. It has motivated three of them to develop innovative positivist positions. In its original guise, the argument from theoretical disagreement is presented as ‘the semantic sting argument’. However, the argument from theoretical disagreement has more than one version. (...) This article briefly discusses two versions and the leading replies to them, then focuses on the most influential version, directed at Hartian positivism. The article surveys the leading positivist rejoinders to the recast version, indicating key Dworkinian replies or assessing the strength of these rejoinders, and concludes with a rejoinder of its own, making a new case that the argument from theoretical disagreement isn't fatal for Hartian legal positivism. A familiar jurisprudential view is that a judicial decision functions as a legal precedent by laying down a rule and that the content of this rule is set by officials. Precedents can be followed only by acting in accordance with this rule. This view is mistaken on all counts. A judicial decision functions as a precedent by being an example. At its best, it is an example both for officials and for a target population. Even precedents outside of law function (...) as examples when they have conduct-guiding significance. Examples may be rule-like in their scope, but need not be. Their import is independent of their justification; this point has implications for coherence theories of precedent meaning. The content and scope of a legal decision’s extension is not set exclusively by officials. It is socially set and depends upon social salience. (shrink)

A lengthy debate in the philosophy of the cognitive sciences has turned on whether the phenomenon known as ‘systematicity’ of language and thought shows that connectionist explanatory aspirations are misguided. We investigate the issue of just which phenomenon ‘systematicity’ is supposed to be. The much-rehearsed examples always suggest that being systematic has something to do with ways in which some parts of expressions in natural languages (and, more conjecturally, some parts of thoughts) can be substituted for others without altering well-formedness. We show that under one construal this yields a grossly weak claim that is not just compatible with a narrow version of associationist psychology but essentially coincides with a formalization of its descriptive power. Under another construal we get a claim (apparently unintended) that requires natural languages to fall within the context-free class, a claim that most linguists regard as too strong. Looking more closely at this proposed reconstruction of systematicity leads us to endorse, with further illustrations, the suggestion of Johnson (2004) that systematicity as a matter of substitutability of co-categorial constituents for one another does not appearto hold of natural languages at all. The appeal of the ill-delineated notion of systematicity may lie in the fact that within certain subclasses of lexical items mutual intersubstitutability does seem to hold, and theexplanation for that lies in a limitation on human memory: we simply cannot learn separate privileges of syntactic distribution for all of the huge number of words and phrases that we know. In the special section ‘Body Hacking: Self-Made Cyborgs and Visions of Transhuman Corporeality’, attention is drawn to cyborgism, a set of cultural and very personal practices of experimentation with the human body that often take place outside the confines of institutionalised technoscience. Known, for example, as ‘body hackers’, ‘grinders’ or ‘self-made cyborgs’ and engaging in unusual forms of body modification, the practitioners are enthusiasts who do not necessarily have any ‘disability’ in the conventional sense of the term. They consider the (...) body a highly malleable material, a transformable, improvable, augmentable entity. This essay develops its idiosyncrasy by concentrating primarily on the trend of body hacking. The practitioners, self-defined as body hackers, self-made cyborgs or grinders, work in different ways to develop functional and physiological modifications through the contributions of technology. Their goal is to develop by themselves an empirically man-technique fusion. These dynamic “scientific” subcultures are producing astonishing innovations. From pocket-sized kits that sample human DNA, microchip implants that keep tabs on our internal organs, blood sugar levels or moods, and even (...) 3D printers that produce tailored hip replacements, the technical innovations of the body hacking trend are beginning to filter into mainstream use, and the repertoire increases every day. These physical transformations with intersecting techniques actively challenge long-held normative beliefs about what bodies do, what they should look like and how they should behave. They provide an alternative discourse on man’s correlation with the world and its biocenosis. Sculpting oneself has become an existential data. Medical technoscience crystallizes the effectiveness of new powers over the organism. Scientific temptation to recreate and enhance the human according to its normative principles has brought up experimental practices that have become the edge of a radical activism operating in the core of western societies, which will be the theme of this paper. Everyone agrees that law is a constituent of social reality. Law seems to be a system by which conduct is governed and guided. Its usefulness consists, in part, on its ability to govern and guide conduct in its characteristic way. If laws guides the conduct of lay law subjects, then it must be (really) possible for the content of the laws governing their conduct to be known by them under standard social conditions. Moreover, if some degree of efficacy in guiding (...) and governing the conduct of lay law subjects is an existence condition for a legal system, then in existing legal systems enough of the content of directive law is epistemically accessed by enough law subjects so that they can apply it to their situations and correctly determine the act-tokens required of them. In this chapter, I argue that these modest epistemic reflections have important implications for a theory of legal content that have been largely ignored. Holistic theories of legal content, such as Greenberg’s and Dworkin’s, are inconsistent with an adequate account of epistemic access. After demonstrating the same problem in two mainstream non-holistic theories of legal content -- the view that legal content is set entirely by official interpretive conventions, and the view that legal content is set entirely by official intentions – I propose a theory of legal content that meets the epistemic access challenge. On my approach, law is, at its core, centered upon the understandings of law subjects. (This view is meant to exempt constitutional provisions.) More precisely, the legal content of statutes and judicial decisions is built around, and preserves, a core of understandings and meaning-assignments that is the province of anyone with sufficient linguistic ability and relevant socialization. The details of this view are, roughly: (1) in the case of judicial decisions in a common law system, the social salience of the example the decision sets concerning behavior sets the default legal content; (2) in the case of statutory directives, the set of socially salient applications (behavior in situations) sets the default legal content. I say `default’ because my account of legal content is a two-stage account beginning with the default content and permitting a second stage in which considerations from other sources can operate on the default. Yet if a certain amount of efficacy in guiding lay law subjects’ behavior is a requirement for the existence of a legal system, there must be a core of legal content undistorted from its default social salience by a second stage operation. Este artigo trata da inteligência artificial, com ênfase na computação cognitiva, como uma problemática contemporânea no contexto da cibercultura. Teve como objetivo investigar na literatura científica os principais aspectos da computação cognitiva em unidades de informação. Procurou levantar as perspectivas da computação cognitiva em unidades de informação e mapear como essas unidades têm utilizado (ou podem utilizar) a inteligência artificial em suas atividades e interação com o usuário. A metodologia utilizada se inscreve como pesquisa bibliográfica. Reflete com ênfase, principalmente, em (...) outras leituras a partir do levantamento bibliográfico realizado na base de dados Ebsco e na Brapci, com recorte de 2009 a 2019. Foi realizada uma análise do discurso simples e a categorização dos assuntos dos artigos a partir das abordagens teóricas do ponto de vista da cibercultura. Destaca como resultado as principais definições encontradas na literatura, um case empírico que está sendo desenvolvido pela autoria deste artigo, a abordagem teórica com base na cibercultura, as perspectivas e aplicações dos artigos investigados. Finalmente se considera que a literatura sobre computação cognitiva trata da biblioteca e do bibliotecário no contexto contemporâneo. Os artigos são predominantes estrangeiros, na sua maioria são populistas tecnocráticos, possuem abordagens qualitativas e se referem a computação cognitiva como inteligência artificial. (shrink)

Around the turn of the thirteenth century, however, the literature of edification shows a sudden upsurge of interest in demoniacs. They begin to proliferate not only in saints' lives but also in the new genre of the exemplum, associated with the friars and the rise of vernacular preaching. At the same time that these sources (...) are directing heightened attention toward the possessed, the symptoms of possession itself conspicuously alter. Unlike the violent and self-destructive persons who had always qualified for saintly exorcism, the energumens of the new exemplum literature are lucid and articulate, inspiring responses more of curiosity and respect than of pity or horror. Speaking in persona diaboli, they were viewed as sources of supernatural authority, treated with circumspect awe by priests, and sometimes even allowed to preach. In their diabolically inspired, charismatic role, such demoniacs bear a startling, if superficial, resemblance to prophetic female saints, who gained their religious authority by speaking in persona Dei. In New Zealand public policy on Assisted Reproductive Technology is being worked out in a society committed to the development of bicultural partnership honouring the Treaty of Waitangi, a treaty with the indigenous people.Strong claims to the cultural significance of genetic heritage by Maori have made apparent to non-Maori their own assumptions. These claims also resist reductive understandings of genetics.In this paper I review, as a Pakeha ethicist, (...) initiatives taken in New Zealand, and the impact of bicultural development on public policy on ART. I also discuss some of the issues this raises for western bioethics as it relates to non-western approaches and include reference to the significance of genetic heritage as it is affecting guidelines for donor insemination and surrogacy. The article shows how it is possible to present students’ abilities, skills and views in public. It was mostly focused on class and school presentations. The following forms of activities which enable promoting students in public were taken into account: participating in competitions, circles оf interests (for example Polish language, theatre, film or culture) and school organisations (school committee); editting school newspapers; taking part in scientific sessions; organizing trips. The statment includes both the theoretical part and the examples of activities (...) (checked in the pedagogical practise). It was emphasized that presenting skills, interests and views by students adjusted to the age and needs of young people prepared them to achieve the full maturity both in individual and social aspect. Ce programme a été représenté par les auteurs qui entouraient A. Czechow, c’est-a-dire les romantiques du réalisme. En fait, cette idée de «petites affaires» n’était qu’un mirage.

According to the Variety of Evidence Thesis items of evidence from independent lines of investigation are more confirmatory, ceteris paribus, than e.g. replications of analogous studies. This thesis is known to fail Bovens and Hartmann, Claveau. How- ever, the results obtained by the former only concern instruments whose evidence is either fully random or perfectly reliable; instead in Claveau, unreliability is modelled as deterministic bias. In both cases, the unreliable instrument delivers totally irrelevant information. We present a model which formalises (...) both reliability, and unreliability, differently. Our instruments are either reliable, but affected by random error, or they are biased but not deterministically so. Bovens and Hartmann’s results are counter-intuitive in that in their model a long series of consistent reports from the same instrument does not raise suspicion of “too-good-to- be-true” evidence. This happens precisely because they neither contemplate the role of systematic bias, nor unavoidable random error of reliable instruments. In our model the Variety of Evidence Thesis fails as well, but the area of failure is considerably smaller than for Bovens and Hartmann, Claveau and holds for realistic cases. The essential mechanism which triggers VET failure is the rate of false to true positives for the two kinds of instruments. Our emphasis is on modelling beliefs about sources of knowledge and their role in hypothesis confirmation in interaction with dimensions of evidence, such as variety and consistency. (shrink)

Many contemporary philosophers of law agree that a necessary condition for a decision to be legally justified, even in a hard case, is that it coheres with established law. Some, namely Sartorius and Dworkin, have gone beyond that relatively uncontroversial claim and described the role of coherence in legal justification as analogous to its role in moral and scientific justification, on contemporary theories. In this, I argue, they are mistaken. Specifically, coherence in legal justification is sometimes specific to a branch (...) of law, and there is nothing isomorphic to this in the models of moral and scientific justification. Although Dworkin and Sartorius rely on the concept of coherence, they do not explicate it. In the course of examining their views, this essay offers a partial analysis of coherence on their models. Finally, two canons of relevance, governing when global coherence considerations are appropriate to legal justification, are presented. (shrink)
