Do members of democratic societies have a moral right that others not actively prevent them from engaging in wrongdoing? Many political theorists think that they do. “It is a feature of democratic government,” Michael Walzer writes, “that the people have a right to act wrongly—in much the same way that they have a right to act stupidly”. Of course, advocates of a democratic right to do wrong may believe that the scope of this right is limited. A majority in a (...) democratic society, for example, may not have a moral right against being prevented from enslaving or arbitrarily disenfranchising a minority, or if it were to launch a wrongful aggressive war against another society. But many join Walzer in asserting that it would be wrong in principle to intervene to prevent some wrongs that democratic societies would inflict. This thesis, which we call the democratic right to do wrong thesis (DRTDWT), can be formulated as follows: DRTDWT – For democratic societies A and agents B, there is a class of wrongful policies and institutions X, such that if A chooses to implement members of this class pursuant to democratic procedures, B has a duty not to actively intervene to prevent the implementation of X. Our goal in this essay is to show that the DRTDWT should be rejected. (shrink)

The metaphor of “the ghastly kitchen” of life science research, the places that, said the nineteenth-century physiologist Claude Bernard, stirred “the fetid and throbbing ground of life,” is well known. In the seventeenth century, the kitchen, and particularly the scullery, was the site of the slaughter, butchery, and dismemberment by carving of a variety of animals. The tools and techniques employed in these activities overlapped considerably with those of animal and human dissection. Dissection often took place in residences and the (...) kitchen was the most likely place for this activity. This challenges historians’ identification of the kitchen as an exclusively female realm. The preparation of food and medicines occurred in tandem with experimental natural philosophy, sharing tools as well as the sensory apparatus of cooking, including tasting and smelling. (shrink)

Two conditions guiding permissible use of force in self-defence are proportionality and success. According to the proportionality condition the means used to prevent an attack can be permissible only if they are proportional to the interest at stake.1 According to the success condition, otherwise impermissible acts can be justified under the right to self-defence only if they are likely to succeed in preventing the perceived threat.2 These requirements should not always be interpreted narrowly. Sometimes people are permitted to kill culpable (...) aggressors in order to avoid a non-lethal harm. Concerns have been raised around the alleged commercialisation of South African genetic material by various research institutes nationally and abroad. We consider whether the Protection of Personal Information Act in South Africa will conflict with or complement existing protections in health law and research ethics. The Act is not applicable to de‐identified samples that cannot be re‐identified but we question whether genetic samples can ever be truly de‐identified. The research participants in this matter provided consent for use of their samples (...) for research but did not consent to commercialisation by global research institutions, and neither did the researchers. We suggest that consent models incorporating broad consent as an option should include explicit discussions around benefit sharing and commercialisation. Mistrust between researchers and participants impedes scientific research and can harm relationships built up over the years between South African researchers and local communities. (shrink)

Scientific knowledge should not only be true, it should be as objective as possible. It should refer to a reality independent of any subject. What can we use as a criterion of objectivity? Intersubjectivity (i.e., intersubjective understandability and intersubjective testability) is necessary, but not sufficient. Other criteria are: independence of reference system, independence of method, non-conventionality. Is there some common trait? Yes, there is: invariance under some specified transformations. Thus, we say: A proposition is objective only if its truth is (...) invariant against a change in the conditions under which it was formulated. We give illustrations from geometry, perception, neurobiology, relativity theory, and quantum theory. Such an objectivist position has many advantages. (shrink)

ABSTRACT In 1730, shortly before his death, the Paris anatomist Joseph‐Guichard Duverney wrote his will, leaving his anatomical specimens to the Académie des Sciences, of which he was a member. But the will was disputed by Pierre Chirac, supervisor of the Jardin du Roi where Duverney, as professor of anatomy, had performed most of the dissections that produced the specimens. The ensuing debate between Chirac and René‐Antoine Ferchault de Réaumur, arguing for the Académie, reveals the tensions surrounding both the concept (...) of intellectual property in this period and the collective enterprise in natural philosophy. The differing roles and audiences of the Académie and the Jardin were central to this debate. In addition, this essay explores the origins and significance of the anatomical specimens themselves and their changing role in instruction and display, as well as the transition from the cabinet of curiosities to the natural history museum. Summary This essay explores the place of natural philosophy among the patronage projects of Louis XIV, focusing on the Mémoires pour servir à l'histoire naturelle des animaux (or Histoire des animaux) of the 1670s, one of a number of works of natural philosophy to issue from Louis XIV's printing house. Questions particular to the Histoire des animaux include the interaction between text and image, the credibility and authority of images of exotic animals, and the relationship between comparative anatomy and natural (...) history, and between human and animal anatomy. At the same time that the Histoire des animaux contributed to Jean-Baptiste Colbert's management of patronage and of Louis's image, it was a work of natural philosophy, representing the collaborative efforts of the new Paris Academy of Sciences. It examined natural history and comparative anatomy in new ways, and its illustrations broke new ground in their depiction of animals in a natural setting. However, the lavishly formatted books were presentation volumes and did not gain wide circulation until their republication in 1733. Sources consulted include Colbert's manuscript memoires on the royal printers and engravers. (shrink)

Defining experiment was particularly vexed in the realm of anatomical dissection and vivisection. Was dissection merely descriptive, or something more? Harvey's discovery of the circulation of the blood and Aselli's discovery of the so-called lacteal veins shaped much anatomical research between the late 1620s and the 1650s. While the techniques of dissection and vivisection gained wide use, there was much debate on the validity of the circulation in particular, and its relationship to the lacteal veins. Critics, particularly the French anatomist (...) Jean Riolan, but also the natural philosopher Pierre Gassendi, focused on the lack of causation in Harvey's method and the lack of medical use and not on his use of vivisection. Jean Pecquet's discovery of the thoracic duct in 1651 changed the terms of the debate by definitively connecting the circulation with the lacteals. Riolan's critiques of Pecquet in the 1650s show profoundly differing notions of the purpose of dissection. While Gassendi eventually accepted Harvey's concept of the circulation, Riolan never did. Historians who work with materials in languages other than their own inevitably do quite a bit of translation in the course of their research and writing. Much of this consists of words, phrases, or sentences, and much remains unpublished. This essay looks at the author’s experiences with this sort of translation as well as with more formal published translation, with a focus on early modern French and Latin.

In the enquiry into the import and function of the basic norm in Hans Kelsen's legal theory, the interpretations of special interest are those dealing with the notion of the basic norm as the ‘logico-transcendental’ condition for cognition in legal science, or with the relation of Kelsen's juridico-scientific method to Kant's practice philosophy. Two thinkers in particular have written along these lines, Norbert Leser and Ralf Dreier, respectively. This chapter begins by describing the positions taken up by the two authors. (...) It then asks, whether in terms of Leser's thesis, it is in fact possible to maintain the notion of the transcendental character of the basic norm. It then turns to Dreier's suggested reinterpretation of the basic norm by appeal to the law of reason, examining the suggestion from the point of view of Kant's philosophy. (shrink)

This paper on the occasion of the 500th birthday of the great Saxon humanistic scholar Georgius Agricola deals with his contributions to geology in the narrow sense. These, contrary to his voluminous works on mining, metallurgy and mineralogy (De re metallica and De natura fossilium, resp.) are parts of the booksDe ortu et causis subterraneorum andDe natura eorum, quae effluunt ex terra. In those we find statements on the causes of earthquakes, on volcanos and the subterranean fire as well as (...) the effects of the running water in mountain-building. Agricola's ideas on geological time and his statements on dynamics of the Earth's crust are remarkable. (shrink)

The way in which midwives relate to expectant parents during the process of childbirth greatly influences the parents’ childbirth experiences for a long time. We believe that examining and describing ways of relating in naturally occurring interactions during childbirth should be considered as an ethical responsibility. This has been highlighted in relation to parents’ experiences and in the light of the relational ethics of Løgstrup. Four couples’ and nine midwives’ ways of relating were documented by 27 hours of observation, including (...) 14.5 hours of video-recorded sessions. A qualitative content analysis was conducted. The midwives strongly influenced the different ways of relating and three aspects of professional competence were disclosed. The results can contribute to reflections about current praxis as an ethical demand for midwives. (shrink)
