This paper looks at the state of research on churchstate relations in post-communist Romania in order to provide an outline of the most important questions which need to be addressed in the coming years. The article consists of two parts. First, a survey of academic studies published over the past two decades on the relationship between the country’s churches and state after 1990. The paper discusses the context, substance and likely implications of the European Court of Human Rights’ very recent but, in our view, historic decision in the case of Lautsi v. Italy. The article offers an outline of the case and of the decision’s motivation, a presentation of the responses, and a brief discussion of its relevance to the similar Romanian case. We examine in some detail the objections leveled against the ruling, track the progress of the Court’s relevant jurisprudence on (...) the issue, and suggest some possible consequences. (shrink)

The paper offers a survey of the debate on the introduction, in the Preamble of the Treaty establishing a Constitution for Europe, of references to God and Europe’s Christian tradition. It examines the question of European identity and values which motivates these proposals in relation to (1) the nature of the EU as an essentially political construction; (2) the issue of human rights in the EU; (3) the protection of cultural and religious diversity within the EU. The study shows that (...) the confessionalization of Europe promoted by strong churches on the Continent, which are legitimate actors of civil society, betray a failure to understand the logic of the European construction. To the extent to which they represent an attempt to secure a privileged position with respect to other religious or non-religious actors, they run against the functional principles and values of the Union. The study discusses the paradox of the failure of the Romanian Church United with Rome, Greek-Catholic (RCUR) to assert itself after 1990, in the context of a revival of the life of all other religious communities. The significant decrease in the number of Greek-Catholic believers and the difficulties in exercising their rights are germane to the limits of democracy in Romania. No other vulnerable communities, neither immigrants, gays, Roma,nor Jehovah's Witnesses, have been denied, all this time, the protection of the (...) Romanian state, as Greek-Catholics have been. The systematic denial of the rights of the Romanian Church United with Rome (Greek-Catholic) is explained by the feature which distinguishes RCUR faithful from the members of other vulnerable communities: their organisation is perceived by the Romanian Orthodox Church (ROC) as an adversary. The Romanian Orthodox Church constantly proclaimed the illegitimacy of the RCUR in the first half of the twentieth century, and participated in its dissolution when the opportunity arose in 1948. It holds today the same explicit goal. The societal circumstances, specific to anarchic democracy, allow a major player like the ROC to impose its policy of undermining the RCUR. In accordance with Bruce Bueno de Mesquita and Alastair Smith's concept, the material and symbolic competition between the RCUR and the ROC is interpreted as an example of "bad behavior as good politics". The ROC strategy finds an optimal framework for maximizing gain in the circumstances of the Romanian anarchic democracy. (shrink)

The standard model of precedential constraint holds that a court is equally free to modify a precedent of its own and a precedent of a superior court—overruling aside, it does not differentiate horizontal and vertical precedents. This paper shows that no model can capture the U.S. doctrine of precedent without making that distinction. A precise model is then developed that does just that. This requires situating precedent cases in a formal representation of a hierarchical legal structure, and adjusting the constraint (...) that a precedent imposes based on the relationship of the precedent court and the instant court. This biography of Emil du Bois-Reymond, the most important forgotten intellectual of the nineteenth century, received an Honorable Mention for History of Science, Medicine, and Technology at the 2013 PROSE Awards, was shortlisted for the 2014 John Pickstone Prize (Britain's most prestigious award for the best scholarly book in the history of science), and was named by the American Association for the Advancement of Science as one of the Best Books of 2014. -/- In his own time (1818–1896) du Bois-Reymond (...) grew famous for his groundbreaking research in neuroscience and his provocative addresses on politics and culture. His discovery of the electrical transmission of nerve signals, his innovations in laboratory instrumentation, and his reductionist methodology all helped lay the foundations of modern neuroscience. -/- In addition to describing the pioneering experiments that earned du Bois-Reymond a seat in the Prussian Academy of Sciences and a professorship at the University of Berlin, this book also recounts du Bois-Reymond’s family origins, private life, public service, and lasting influence. In talks that touched on science, philosophy, history, and literature, du Bois-Reymond introduced Darwin to German students (triggering two days of debate in the Prussian parliament), asked on the eve of the Franco-Prussian War whether France had forfeited its right to exist, and proclaimed the mystery of consciousness, heralding the age of doubt. The first modern biography in any language, "Emil du Bois-Reymond" recovers an important chapter in the history of science, the history of ideas, and the history of Germany. (shrink)

Because humans cannot know one another’s minds directly, every form of communication is a solution to the same basic problem: how can privately held information be made publicly accessible through manipulations of the physical environment? Language is by far the best studied response to this challenge. But there are a diversity of non-linguistic strategies for representation with external signs as well, from facial expressions and fog horns to chronological graphs and architectural renderings. The general thesis of this dissertation is that (...) there is an impressively wide spectrum of conventional systems of representation, corresponding to the many ways that the problem of communication can be solved, and that these systems can be described and explained using the tools of contemporary mathematical semantics. As a partial corrective to the countervailing norm, this work concentrates on the class of systems arguably most different from language— those governing the interpretation of pictorial images. Such representations dominate practical communication: witness the proliferation of maps, road signs, newspaper photographs, scientific illustrations, television shows, engineering drawings, and even the fleeting imagery of manual gesture. I argue that systems of depiction and languages embody a parallel technologies of communication. Both are based on semantics: systematic and conventional mappings from signs to representational content. But I also provide evidence that these semantics are profoundly divergent. Whereas the semantics of languages are based on arbitrary associations of signs and denotations, the semantics of systems of depiction are based on rules of geometrical transformation. Drawing on recent research in computer graphics and computational vision, I go on to develop a precise theory of pictorial semantics. This in turn facilitates a detailed comparison of iconic, image-based representation, and symbolic, language-based representation. A consequence of these conclusions is that the traditional, language-centric conception of semantics must be overhauled to allow for a more general semantic theory, one which countenances the wide variety of interpretive mechanisms actually at work in human communication. Studying evidence law as part of naturalized epistemology means using the tools and results of the sciences to evaluate evidence rules based on the accuracy of the verdicts they are likely to produce. In this chapter, we introduce the approach and address skeptical concerns about the value of systematic empirical research for evidence scholarship, focusing, in particular, on worries about the external validity of jury simulation studies. Finally, turning to applications, we consider possible reforms regarding eyewitness identifications and character evidence.

Multinational enterprises (MNEs) have long had a reputation of not doing enough for their host communities in developing countries. This study critically examines the role of MNEs in community development initiatives in developing countries, using the Nigeria oil industry and the South African mining industry as case study. Specifically, the study assessed the usefulness of MNE-supported community development projects as a means of demonstrating corporate social responsibility. The findings suggest that expectations for community development projects are greater in developing countries. (...) This paper is principally devoted to comparing and contrasting poverty of stimulus arguments for innate cognitive apparatus in relation to language and in relation to folk psychology. These days one is no longer allowed to use the term ‘innate’ without saying what one means by it. So I will begin by saying what I mean by ‘innate’. The financial crisis has led to new interest in the ethics of financial markets. In this article, we further the debate on the nature of banking contracts by showing that the fundamental subjective purposes of loan and deposit contracts are irreconcilable. Any resultant mixture of the two contracts is a legal aberration. We consider a mutual fund as an important and legitimate alternative to the common demand deposit to provide high liquidity and some yield without offering full availability of a (...) nominal sum. Besides being a close substitute for how many deposit accounts function today, the mutual fund has the additional benefit of satisfying all legal and ethical requirements. Loan and investment contracts allow for the “bank” to make use of their clients’ funds while the intents of money owners are clearly classified without running into legal or ethical problems. Fix a weakly minimal (i.e. superstable U-rank 1) structure M. Let M∗ be an expansion by constants for an elementary substructure, and let A be an arbitrary subset of the universe M. We show that all formulas in the expansion (M∗,A) are equivalent to bounded formulas, and so (M,A) is stable (or NIP) if and only if the M-induced structure AM on A is stable (or NIP). We then restrict to the case that M is a pure abelian group with (...) a weakly minimal theory, and AM is mutually algebraic (equivalently, weakly minimal with trivial forking). This setting encompasses most of the recent research on stable expansions of (Z,+). Using various characterizations of mutual algebraicity, we give new examples of stable structures of the form (M,A). Most notably, we show that if (G,+) is a weakly minimal additive subgroup of the algebraic numbers, A⊆G is enumerated by a homogeneous linear recurrence relation with algebraic coefficients, and no repeated root of the characteristic polynomial of A is a root of unity, then (G,+,B) is superstable for any B⊆A. Während die Bedeutung Freges für die Philosophie der Gegenwart, soweit sich diese der analytischen Philosophie verpflichtet fühlt, allgemeine Anerkennung gefunden hat, ist seine Stellung innerhalb der eigenen Zeit noch weitgehend unaufgeklärt geblieben. So herrscht die Auffassung vor, Frege habe seine Ideen ganz aus sich selbst oder geradezu im Gegensatz zur deutschen philosophischen Tradition seiner Zeit gewonnen. Bei genauerer Textanalyse weisen Freges Schriften dagegen vielfältige Beziehungen zur zeitgenössischen Logik, Erkenntnistheorie, Sprachphilosophie und Philosophie der Mathematik auf, so dass bei ihm von einem (...) Bruch mit der kontinentalen Philosophie nicht die Rede sein kann. Weil die historischen Voraussetzungen unberücksichtigt geblieben sind, ist ein unzutreffendes Bild von Freges Einsichten entstanden. Dieses Bild wird durch die Entfaltung des historischen Kontextes korrigiert. Bestimmend ist dabei ein problemorientierter Zugang, der sich systematischer Bewertungen und Weiterführungen nicht enthält. (shrink)

This paper shows that the logic known as Information-friendly logic (IF-logic) introduced by Jaakko Hintikka and Gabriel Sandu defines its own truth-predicate. The result is interesting given that IF logic is a much stronger logic than ordinary first-order logic and has also a well behaved notion of negation which, on its first-order subfragment, behaves like classical, contradictory negation.

This paper is based on a study of therapists’ experiences of working with suicidal clients. Using a hermeneutic-phenomenological methodology informed by Heidegger, the study provides an understanding of the meaning of therapists’ experiences from their perspective as mental health professionals in New Zealand. In this regard, the findings of the study identified three themes: Therapists’ reaction of shock upon learning of the suicide of their client; Therapists’ experience of assessing suicidal clients as a burden; and finally, Therapists’ professional and personal (...) crises as a result of their experiences and struggling to come to terms with events.The study sheds light on how the experiences of therapists whose clients have committed suicide can be understood. The findings show how mainstream prevention and intervention strategies result from the misrepresentation and misinterpretation of our traditional way of knowing what it means to be human. When therapists discover that phenomena are not necessarily what they appear to be, they feel unsettled and confused about their responsibilities and what it means to live and die as a human being. The study reveals that therapists experience a profound legacy of guilt, doubt and fear when a client commits suicide. Finally, the study proposes that the time has come for the profession to care for its own in order to allow therapist, in turn to care for (and about) the vulnerable other. (shrink)

Asimismo, la cuestión del cronotopo y subjetividad, como también el espacio biográfico en la construcción de la propia subjetividad serán de gran ayuda para comprender las vicisitudes en la actualización biográfica sobre Gabriela Mistral. La metodología se basa en la reconstrucción de su memoria y archivo contra el olvido de la autora en su diversidad. The concept of implicit definition has played a central role in the controversies about the foundations of geometry. The history of this concept, however, exhibits several important confusions. The term has been used in at least three different senses—Gergonne's position, Hilbert's position of the so-called definitions by axioms , and that of Pasch and Dubislav in the sense of Russell's contextual definition. Frege's contribution to the explication of Hilbert's view has occasioned an adequate appraisal in recent years. A summary account (...) is given. The main purpose of the paper is to present some details about the historical development of the transfer of Gergonne's term ‘implicit definition’ to the Hilbert position, a transfer which goes back to the Peano School and was disseminated by Enriques.
