There is wide agreement that children have human rights, and that their human rights differ from those of adults. What explains this difference which is, at least at first glance, puzzling, given that human rights are meant to be universal? The puzzle can be dispelled by identifying what unites children’s and adults’ rights as human rights. Here I seek to answer the question of children’s human rights – that is, rights they have merely in virtue of being human and of (...) being children – by exploring how children’s interests are different from adults’, and how respect for children’s and adults’ moral status yields different practical requirements. If human rights protect interests, then children have many, but not all, of the human rights of adults, and, in addition, have some human rights that adults lack. I discuss the way in which children’s human rights, as I conceive of them here are, or fail to be, reflected in the law; as an illustration, I use the most important legal document listing children’s rights, namely the 1990 United Nations Convention on the Rights of the Child. Childhood is foundational to the development of selfhood, the formation of interests, values and skills and to the lifespan as a whole. According to Brehm's intensity of emotion theory, if an emotion has motivational properties, its intensity should be non-monotonically affected by factors similar to those determining the intensity of motivational states. These factors are called deterrents. In the case of emotion, one category of deterrents consists of factors that can potentially interfere with feeling the emotion, such as reasons for not feeling the emotion. Two experiments were carried out to examine whether happiness is a motivational state and, thus, if its intensity (...) is non-monotonically determined by the importance of reasons for not feeling happy. We expected happiness to be reduced by a low importance reason for not feeling happy, to remain high in the presence of a moderately important reason, and to be reduced or eliminated by a very important reason. Both experiments supported the cubic function that results from these expectations, and when the results of the two studies were combined, each of the individual legs of the cubic function was found to be reliable along with the cubic function itself. Three claims about love and justice cannot be simultaneously true and therefore entail a paradox: (1) Love is a matter of justice. (2) There cannot be a duty to love. (3) All matters of justice are matters of duty. The first claim is more controversial. To defend it, I show why the extent to which we enjoy the good of love is relevant to distributive justice. To defend (2) I explain the empirical, conceptual and axiological arguments in its favour. Although (...) (3) is the most generally endorsed claim of the three, I conclude we should reject it in order to avoid the paradox. (shrink)

The Unconscious as Space explores the experience of being and the practice of psychoanalysis by thinking of the unconscious in mathematical terms. Anca Carrington introduces mathematical models of space, from dimension theory to algebraic topology and knot theory, and considers their immediate psychoanalytic relevance. The hypothesis that the unconscious is structured like a space marked by impossibility is then examined. Carrington considers the clinical implications, with particular focus on the interplay between language and the unconscious as related topological spaces (...) in which movement takes place along knot-like pathways. Defiendo la opinión de que la infancia es intrínsecamente valiosa en lugar de tener valor solo en la medida en que conduce a una buena edad adulta. Ni la visión de los “niños como adultos inacabados” ni la más extravagante de “los adultos como niños defectuosos” son convincentes por sí mismas porque ambas son formas incompletas de contar la historia de la infancia y la edad adulta. Un breve artículo no puede resolver la cuestión del valor relativo de la niñez (...) y la adultez, pero sugiero que es plausible que algunos tipos de valor que podemos disfrutar plenamente como niños sean, en el caso de la mayoría de las personas, diferentes de aquellos que podemos disfrutar como adultos. A medida que nos hacemos adultos mejoramos nuestros conocimientos y habilidades: acumulamos experiencia y controlamos mejor nuestras emociones. Por lo tanto, nos volvemos capaces de una plena agencia moral. Además, nos volvemos más decididos y adquirimos las habilidades ejecutivas necesarias para perseguir nuestros objetivos de manera efec-tiva y, por lo tanto, tenemos nuevos tipos de logros disponibles. Al mismo tiempo, en la transición a la edad adulta perdemos, en promedio, no solo habilidades físicas deseables como la agilidad y la flexibilidad, sino también gran parte de la plasticidad mental, la imaginación, la curiosidad y la percepción vívida, a veces sinestésica, del mundo (es decir, la capacidad de experimentar el mundo a través de más de un sentido a la vez). This article brings into relief two desiderata in childrearing, the importance of which the pandemic has made clearer than ever. The first is to ensure that, in schools as well as outside them, children have ample opportunities to enjoy goods that are particular to childhood: unstructured time, to be spent playing with other children, discovering the world in company or alone, or indeed pursuing any of the creative activities that make children happy and help them learn. I refer to these (...) as “special goods of childhood.” The second desiderata is to turn childrearing into a more communal practice, with lesser parental monopoly of care. For this, we need to give children access to multiple caring adults, and thus more opportunities to form secure and protected relationships. (shrink)

Knowing the level of quality from which the context is no longer valuable in a Context-Aware Data Mining (CADM) system is an important information. The main goal of this research is to study the variations of the predictions in case of different levels of noise and missing context data in practical scenarios for predicting soil moisture. The research has been performed on two locations from the Transylvanian Plain, Romania and two locations from Canada. The values predicted for the soil moisture (...) were compared in mixed scenarios that vary the quantity of noise and missing context data. The studied behavior was performed using Deep Learning, Decision Tree and Gradient Boosted Tree machine learning algorithms. It has been shown that when using the air temperature as context for predicting soil moisture, variations of noise and missing data do not influence the results proportionally with the levels of noise and missing data applied. Also, Gradient Boosted Tree algorithm proves to be the best algorithm from the ones studied, to be considered when predicting soil moisture with the CADM approach. (shrink)

En este contexto, el monográfico La creatividad en la filosofía para hacer las paces: Nuevos horizontes interdisciplinarios es una recopilación de nueve artículos en los que autores (...) y doctores internacionales han reflexionado sobre la importancia de la creatividad en la construcción de la cultura de paz, cada uno y cada una de ellas enfocando su teoría hacía ejemplos de edificación creactiva que parten de problemas cotidianos. Son aportaciones que abogan por una creatividad como competencia de dar un paso más para superar lo ordinario, yendo más allá de lo familiar y de lo habituado, orientando siempre la mirada hacia la paz. Le Phèdre est considéré comme un dialogue portant sur le beau. Mais du beau il n’est question qu’à travers trois discours qui portent sur l’amour. La tradition des commentaires du Phèdre, telles les scholies d’Hermias, fait état d’une forme d’initiation qui permet de passer de la beauté singulière d’un corps à la beauté des logoi (éloges, discours amoureux), puis à la connaissance de la seule beauté vraie puisque parfaite, la beauté intelligible. C’est la leçon de Diotime, du Banquet, qui serait (...) ainsi appliquée par Socrate à Phèdre dans le dialogue éponyme afin de transformer la fascination pour la rhétorique en amour de la sagesse et passer de l’imitation des belles paroles à la perfection de l’identité avec le beau dans l’Un. Cependant, la beauté évoquée par Socrate est visible et ne correspond pas à cette perfection de l’identité dans l’intelligible à laquelle aspire l’amant de la sagesse, puisque l’âme l’atteint non par un nécessaire exercice sur elle-même mais par un acte de reconnaissance qui la transcende. À l’inverse de ce qui se produit dans le Banquet, dans le Phèdre ce n’ est pas le beau qui conduit à l’amour, mais l’amour qui prépare l’âme à reconnaître le beau. Parler du beau revient alors à confier à l’âme, et à elle seule dans ce cas, l’accès aux vertus épiphaniques du logos. Ces dialogues sont revisités par Plotin dans deux textes consacrés à la question du beau (Ennéades I, 6, «Sur le Beau» [T.1] et V, 8, «Sur la beauté intelligible» [T.31]). Le modèle du discours amoureux demeure toujours le moyen privilégié pour définir le beau en même temps que pour s’exercer au perfectionnement de soi. Pourquoi la réflexivité de l’éros est-elle appelée à jouer un rôle essentiel à l’égard du beau, cette catégorie appelée plus tard transcendantale? (shrink)

L’article tente de saisir le rapport entre exégèse, rhétorique et philosophie dans les textes de Philon à partir d’un angle particulier : l’usage philonien croisé des images bibliques et du rôle spécifique assigné à l’image dans la pensée hellénique. S’il y a chez l’Alexandrin une réflexion sur les vertus du langage déployée entre l’exégèse des textes bibliques et le recours constant aux modèles théoriques de la philosophie, cette réflexion vise explicitement à établir une science, la théologie rationnelle, légitimée par sa (...) fondation sur la lettre biblique et validée en même temps par une démarche et un lexique spécifiquement philosophiques. Or la pratique des images s’inscrit dans cette tentative philonienne de fonder la réflexion théologique sur les rapports de la langue avec les facultés sensibles et intellectives, depuis les figures et les concepts avec lesquels travaille le langage philosophique jusqu’à l’établissement d’un savoir à partir du paradigme des vertus épiphaniques dont la lettre biblique est pourvue. Il est question de l'analogie et de la comparaison selon la démarche dialectique platonicienne, ainsi que des topoi empruntés aux textes anciens: la chasse, le labyrinthe, le vase, la statue intérieure que l'on doit polir, le Soleil pour désigner de manière visible le Bien, ou la caverne pour rappeler la parabole de laconnaissance, mais aussi pour évoquer le lieu de transit de l'âme. Les principaux textes utilisés sont extraits des Discours théologiques de Grégoire de Nazianze. Un passage du Traité sur (...) le Saint Esprit (149 B-C) de Basile de Césarée, cité à la fin, illustre dans un contexte un peu différent le même procédé que celui utilisé par Grégoire. Dans tous ces passages il est question de travailler le langage sous le double aspect ontologique et sémantique, afin de trouver les modalités discursives les plus appropriées à la définition de la substance divine, à la nature de l'unité divine et à la détermination du caractère spécifique des hypostases. La théologie chrétienne se sert donc des moyens de la philosophie et emprunte des figures à la rhétorique, mais se défend de toute confusion avec ces disciplines. Invente-t-elle alors un genre nouveau, le «discours théologique», sur le modèle fourni par les Cappadociens? Encore faut-il savoir si le discours pouvait être perçu au IVᵉ siècle comme un genre approprié à la théologie, ou seulement comme un contrepoint à l'exégèse et au traité: un contrepoint par lequel les Pères ne rechignent pas à faire concurrence aux Sophistes pour les besoins politiques, et subsidiairement polémiques, de l'institution nouvellement créée. Concerns about the under-representation of female academic philosophers and about the stereotype that philosophy is best done by men have recently led to efforts to make academic philosophy a more inclusive discipline. An example is the Gendered Conference Campaign, encouraging event organisers and volume editors to include women amongst invited speakers and authors. Initiatives such as the GCC raise worries about tokenism. Potential invitees may be concerned about unfairness towards whose who would have been invited in their place in the (...) absence of affirmative action and about the way in which affirmative action can affect the quality of the conference or volume in question. And women philosophers often worry that, if formal rules or significant social pressures towards gender inclusiveness play a role in selection processes, their achievements will be discounted. I argue there is no good reason for these fears: there is no pure meritocracy in academia, nor is the ideal of pure meritocracy either feasible or desirable. There are several legitimate grounds — independent of professional competence — for including people in positions of visibility and prestige; gender is such a legitimate reason. (shrink)

Recent corporate governance literature on gender diversity within boards has linked the effect of an increase in gender diversity to the firm’s corporate reputation. This paper analyzes the media impact of appointing new directors of Spanish companies at a particularly significant moment, during the period from 2007 to 2010, just a year before and 3 years after the Gender Equality Act was passed. By analyzing female and male board nominations in Spanish IBEX-35 companies, the paper examines whether appointing a female (...) does have greater visibility than appointing a male, and thus a potential signaling effect for corporate stakeholders and an effect on the firm’s reputation. Results indicate that the effect on press visibility of appointing a female versus a male is negligible, although there is significant media visibility for new executive directors, in particular for the case of the only woman nominated as an executive director during the period. The paper contributes to the existing literature on gender diversity in corporate governance, specifically its effect on corporate reputation. The paper also offers information relevant to policy making and in particular to the current debate over quotas for women on boards. (shrink)

Family relationships are often believed to have a unique value; this is reflected both in the special expectations that family members have from each other and in the various ways in which states protect family relationships. Commitment appears to set apart family relationships from other close relationships; however, commitment is in fact present in other close relationships. I conclude that family relationships do not have any special value; love does. In the case of families with children, however, a high degree (...) of commitment between adults may be useful or even necessary for advancing children's wellbeing. We consider inverting the logical order, making nonlocality an axiom and indeterminism a theorem. The paper examines the meaning of a Hegelian expression: “the ascension of the human spirit to God”, which was formulated in the philosopher’s 1829 summer course dedicated to the proofs of God’s existence. We argue that the Hegelian formula describes a double movement: the first one refers to the departure of thinking from the Phenomenon and its arrival to the Ideal, and the second one describes the opposite movement, in which thinking crosses the barrier between the Ideal and the Phenomenon.

Background: The health professionals are involved in the paths of care for patients with different medical conditions. Their life is frequently characterized by psychopathological outcomes so that it is possible to identify consistent burdens. Besides the possibility to develop pathological outcomes, some protective factors such as resilience play a fundamental role in facilitating the adaptation process and the management of maladaptive patterns. Personal characteristics and specific indexes such as burdens and resilience are essential variables useful to study in-depth ongoing conditions (...) and possible interventions. The study was aimed at highlighting the presence and the relations among factors as personal variables, burdens, and resilience, to understand health professionals' specific structure and functions.Methods: The observation group was composed of 210 participants, 55 males, and 155 females, aged from 18 to 30 years old with a mean age of 25.92 years old. The study considered personal characteristics of the subjects, such as age, gender, years of study, days of work per week, hours of work per week, and years of work. Our study had been conducted with the use of measures related to burdens and resilience.Results: The performed analyses consisted of descriptive statistics, correlations, and regressions among the considered variables. Several significant correlations emerged among personal characteristics, CBI, and RSA variables. Specifically, age and work commitment indexes appeared to be significantly related to the development of burdens, differently from the years of study. Significant correlations emerged among personal and RSA variables, indicating precise directions for both domains. Age and gender were identified as predictors to perform multivariate regression analyses concerning CBI factors. Significant dependence relations emerged with reference to all CBI variables.Conclusion: Pathological outcomes and resilience factors represent two sides of the health professionals' experiences, also known as “invisible patients.” Greater knowledge about present conditions and future possibilities is a well-known need in literature so that the current analyses considered fundamental factors. In line with state of the art, future studies are needed in order to deepen elusive phenomena underlying maladjustment. (shrink)

Rationing health care by ordeals is likely to have different effects on women and men, and on distinct groups of women. I show how such putative effects of ordeals are relevant to achieving gender justice. I explain why some ordeals may disproportionately set back women’s interest in discretionary time, health and access to health care, and may undermine equality of opportunity for positions of advantage. Some ordeals protect the interests of the worse-off women yet set back the interests of better-off (...) women in equal opportunities. I suggest how we can use ordeal design to advance particular aims of gender justice. (shrink)

The evaluation of labour markets and of particular jobs ought to be sensitive to a plurality of benefits and burdens of work. We use the term 'the goods of work' to refer to those benefits of work that cannot be obtained in exchange for money and that can be enjoyed mostly or exclusively in the context of work. Drawing on empirical research and various philosophical traditions of thinking about work we identify four goods of work: 1) attaining various types of (...) excellence; 2) making a social contribution; 3) experiencing community; and 4) gaining social recognition. Our account of the goods of work can be read as unpacking the ways in which work can be meaningful. The distribution of the goods of work is a concern of justice for two conjoint reasons: First, they are part of the conception of the good of a large number of individuals. Second, in societies without an unconditional income and in which most people are not independently wealthy, paid work is non-optional and workers have few, if any, occasions to realize these goods outside their job. Taking into account the plurality of the goods of work and their importance for justice challenges the theoretical and political status quo, which focuses mostly on justice with regard to the distribution of income. We defend this account against the libertarian challenge that a free labour market gives individuals sufficient options to realise the goods of work important to them, and discuss the challenge from state neutrality. In the conclusion, we hint towards possible implications for today’s labour markets. (shrink)

The article addresses a common difficulty of counselors in confronting clients with the problems in their thinking and behavior in a way that they could start benefiting from a constructive self-reflective state in the long run, a state that would replace the common tendency to hide oneself, to blame, to victimize or to repress aspects of their humanity connoted as negative in order to maintain a positive self image. The highlight is on the main characteristics of efficient confrontations with oneself (...) and others, so as to engender reasoning competence training without an unnecessary loss in the quality of the consultative relationship. Working in psychotherapy and having progressively integrated more philosophical work into this professional practice, the author puts together a few concepts and ideas that are likely to facilitate the processes in the psychotherapeutic and the philosophical approaches to intrapsychic and interpersonal dialogue. One of the main problems one is faced while dealing with Roma issues is to find reliable statistics. The Roma refuse to declare themselves as Roma, if they participate at all in the research. Whether it is a problem related to their Roma identity, if their refusal is a well thought action we will try to find out in this paper. We will discuss the issue of Roma identity, we will present data showing the discrepancy between the official number of (...) Roma living in different countries and approximations made by competent organizations, as well as reasons one can consider for Romaís refusal do declare their identity. Theoretical aspects related to decision making will also be reviewed in the final attempt to establish whether the attitude Roma have towards declaring their identity is a result of a difficult decision making process, or just an instant rejection reaction. As such, the course is not only an attempt to do justice to a “subject,” to which, Barthes insists, we should not hold on once the course is over, but also to meditate on the very situation of teaching.2 The course on the neutral offers the occasion to ask, What is it to teach? And teaching, we soon find out, is a matter of desire: the course should have been called The Desire for the Neutral. The teacher follows his desire and, in doing so—Barthes is reminded by a student—inflects and curbs the student’s desire. What is it, then, that one desires when one desires the neutral? The teacher is pressed to offer something by way of definition:I define the Neutral as that which outplays [déjoue] the paradigm, or rather I call Neutral everything that baffles the paradigm. For I am not trying to define a word; I am trying to name a thing: I gather under a name, which here is the Neutral.[6]The neutral is a “thing” (no qualifying adjective) that outplays, baffles, or dodges the “implacable binarism” of language as seen through Saussurian linguistics: in order to [End Page 32]produce meaning, one is in the same breath choosing A and refusing B. The search here is for a ”thing” that might suspend, thwart, or elude the paradigm, what Barthes calls its arrogance. Indeed, what would it mean to escape the necessity of choosing, say—this is Barthes’s first example—between je ris (I laugh) and je lis (I read)?A problem for the teaching theater unfolds: the moment one names the “thing,” one brings it into the paradigm, constructing an opposition between the neutral and arrogance. The scene of teaching performs an aporia: “Neutral = impossible; to speak it is to defeat it but not to speak it is to miss its ‘setting up’ [...] to speak this cacophony, I need a course” [29]. There is an obvious tension between teaching, its demands for clear and transparent meaning-making and inherent institutional arrogance, and the neutral. “Arrogance”: “the taking of too much upon oneself as one’s right; the assertion of unwarrantable claims in respect of one’s own importance; undue assumption of dignity, authority, or knowledge” [OED]. The teacher is inevitably occupying the place of arrogance. Indeed, foregrounding its righteousness and authority, arrogance is standing, a position Barthes associates with a certain kind of fascism. The neutral teacher struggles to dodge the arrogance inherent to the teaching scene. Sitting, he stammers, cacophonizes. Artă Reinterpretată is a Facebook page that offers posts on various aspects of life during the pandemics quarantine and lockdown, including isolation or exploiting love, couple and family difficulties; during the relaxation measurement and, finally, during rights restriction for those (...) whom do not have The Green Covid Card. It does so by reinterpreting classical paintings, by adding to them a text or an image or both and thus creating a humourist situation meant to ease upon the hardships of a situation we cannot change. Following the spirit of Walter Benjamin’s Arcades Project, this volume acts as a kaleidoscope of change in the 21st century, tracing its different reflections in the international contemporary while seeking to understand both individual and collective reactions and adjustments to change through a series of questions: Is there something significantly different about the way in which ‘change’ occurs in the 21st century?; Is change mainly reflected in the material and visual environment surrounding us or someplace else?; What are the sensibilities (...) through which we perceive change, and more importantly, have those sensibilities been increased or dulled by modern technology? We review the hypothesis that the brain uses a generative model to explain the causes of sensory inputs, using prediction schemes that operate based upon assimilation of time-series sensory data. We put this hypothesis in the context of psychopathology, in particular, schizophrenia's positive symptoms. Building upon work of Helmholtz and upon theories in computational cognitive processing, we hypothesize that delusions in schizophrenia can be explained in terms of false inference. An impairment in inferring appropriate information from the sensory input reflects (...) upon the ability to assess the environment and predict outcomes. Although the inference mechanism likely involves both conscious and unconscious processes, we hypothesize that the trigger of delusions may lie within the unconscious neural pathways. A collection of computational predictive codes have been proposed for modeling perception. We discuss two examples, which may be eligible as substrates for intuitive coding. We argue that failure of the psychotic patient to choose the correct computational scheme, or the optimal range of parameters, may readily lead to an altered reconstruction of the object and false inference, feeding into the delusion mechanism. We finally propose using these models in conjunction with cognitive and imaging data, in order to obtain more testable predictions. (shrink)

I propose, defend and illustrate a principle of gender justice meant to capture the nature of a variety of injustices based on gender:A society is gender just only if the costs of a gender-neutral lifestyle are, all other things being equal, lower than, or at most equal to, the costs of gendered lifestyles.The principle is meant to account for the entire range of gender injustice: violence against women, economic and legal discrimination, domestic exploitation, the gendered division of labor and gendered (...) socialization. The sense of “costs” employed is similarly wide. Costs can be material, psychological and social.I defend the principle by appeal to the values at the core of liberal egalitarian justice: equality of access and the good of individual choice. I illustrate my case through a discussion of the injustice of a gendered division of labor. Some feminists doubt that liberal egalitarianism has the theoretical resources to recognize the unjust nature of the gendered division of labor. I argue that it does.If the principle advanced here is correct, then gender injustice is pervasive. At the same, it does not affect only women but also men. Liberal egalitarianism is capable of acknowledging this fact without denying that, overall, gender norms oppress women more than they oppress men: Arguably, women who wish to lead a gender-neutral lifestyle have to pay higher costs that men who wish to do the same. Because families disrupt fair patterns of distribution and, in particular, equality of opportunity, egalitarians believe that the institution of the family needs to be defended at the bar of justice. In their recent book, Harry Brighouse and Adam Swift have argued that the moral gains of preserving the family outweigh its moral costs. Yet, I claim that the egalitarian case for abolishing the family has been over-stated due to a failure to consider how alternatives to the family would also disturb (...) fair distributions and, in particular, equality of opportunity. Absent the family, children would continue to be exposed to care-givers of different levels of ability, investment in childrearing and beneficial partiality. In addition, social mechanisms other than the family would lead to the accumulation of economic inequalities. Any kind of upbringing will fail to realise equality for reasons that go deeper than the family: our partiality and unequal abilities to nurture. (shrink)
