Deeply rooted structures of racism, ableism, misogyny, ageism, and transphobia hurt great numbers of people, exposing them to intolerance, economic exclusion, and physical harm around the globe. Billions of land animals suffer and die annually in concentrated feeding operations and slaughterhouses. Our planet and all who live here are in perilous straights as the climate changes. In the face of such grievous problems, people who want to find positive ways to respond often grapple with difficult questions about how to make (...) a difference. Effective Altruism has arisen as an attempt to help answer these questions, encouraging people to give as much money as they can in the most effective ways to address human and animal suffering. But the Effective Altruists’ answers support some of the very social structures that cause suffering, undermining its efforts to “do the most good.” The Good It Promises, The Harm It Does is the first book-length critique of Effective Altruism. It brings together a diverse group of activists and scholars to explore Effective Altruism’s failure to meaningfully address forms of human and animal suffering. (shrink)

In this paper, I sketch a Kantian account of duties of rescue, which I take to be compatible with Kant’s theory. I argue that there is in fact no “trumping relation” between imperfect and perfect duties but merely that “latitude shrinks away” in certain circumstances. Against possible demandingness objections, I explain why Kant thought that imperfect duty must allow latitude for choice and argue that we must understand the necessary space for pursuing one’s own happiness as entailed by Kant’s justification (...) of one’s duty to promote other’s happiness. Nevertheless, becoming worthy of happiness has always priority over one’s own happiness, even when circumstances are such that we cannot secure our own happiness without seriously neglecting more pressing needs of other persons. I conclude that Kant’s moral theory calls for complementation by the political and juridical domain. Implementing just political institutions and creating satisfactorily well-ordered societies create an external world which is friendlier to our attempts to reconcile moral integrity and a happy human life. This paper argues that independent auditors have lost sight of their obligation to be truly impartial, and have increasingly adopted an attitude of client advocacy. We argue that auditors have a professional obligation to go beyond merely passing judgment on whether client accounting methods are acceptable under GAAP, and to judge whether the principles adopted are the most appropriate under the circumstances. We then review recent evidence which suggests that auditors have abandoned this objective in favor of advocating client-preferred principles. (...) The results of a survey of public accountants employed by small CPA firms indicates that, in a scenario in which an auditor did not feel that the client's accounting treatment was the most appropriate under the circumstances but it was recognized as an acceptable alternative under GAAP, advocacy of the client-preferred approach is considered appropriate and is very likely to occur in practice. In less subtle cases (e.g., when the auditor did not feel that the client's treatment provided the best reflection of the economic substance of the underlying transactions), survey participants as a group were ambivalent regarding the appropriateness of client advocacy, and felt that subordination of judgment was likely to occur in practice. The results also indicate that engagement risk, or the risk that the firm will be harmed by aggressive behavior, affects judgments of both the appropriateness and likelihood of subordination of judgment. These findings suggest that auditors have adopted an ideology of client advocacy, within the constraints of engagement risk. (shrink)

In this paper, I analyze the least discussed of Kant’s four examples of duty in the first section of his Groundwork to the Metaphysics of Morals: the gout sufferer who is no longer motivated by natural interest in his long-term wellbeing, and is thus in a unique position to secure his own happiness from duty. This example has long been wrongly interpreted as a failure of prudential rationality, as recently illustrated by Allen Wood’s reading of that example. -/- I argue (...) that the gout sufferer example is meant to illustrate a violation of a duty to the self and should not be confused with mere prudential failure. The example also helps us understand the line between prudential reason and duties to the self. I show that given Kant’s conception of happiness as an indeterminate concept and his hedonistic account of non-moral ends, it can sometimes be more rational from the perspective of empirical practical reason to choose short term over long-term wellbeing when long term wellbeing seems uncertain in regard to expected pleasure. In other words: Kant’s account of empirical practical reason does not rule out as irrational choosing short term pleasure at the expense of long-term wellbeing. However, this is precisely why the gout sufferer’s long-term happiness can be directly morally required and so becomes the content of a duty to the self. To explain how there can be a direct duty to promote our own happiness under certain circumstances I also elucidate Kant’s distinction between direct and indirect duties. (shrink)

This article reports on a survey of DNA-related practices and procedures within District Attorneys' offices to obtain preliminary information about actual prosecutorial practices. The data obtained is preliminary but supportive of further study of areas targeted by the survey.

The assembly of products or components by operators in industries is a complex task with recurring problems. In these processes, operators often make errors that can lead to defective products. Therefore, they need to be inspected later to verify their correct assembly. The main problems are caused by several reasons including high employee turnover, lack of experience in manufacturing specific products or confusion in interpreting instructions to assemble similar components. In this paper, a novel structured language aimed to describe the (...) required actions to manufacture a product in industrial assembly environments is presented. The main contribution is to provide a formal language to feed automatic systems that can verify through visual control whether the actions performed by the operator are carried out following the standard described by this language. In general, the use of this formal language will allow to minimize the negative impact of errors during assembly and to reduce waste in many forms in the industry. (shrink)

Le concept de " care ", qui désigne tout à la fois une attitude morale - l'attention à l'autre, la sollicitude à son égard - et un ensemble de pratiques destinées à prendre soin des autres, a fait une entrée remarquée dans le débat public au printemps 2010. Tandis que certains y ont vu le pivot d'un projet de société alternatif, d'autres ont immédiatement répliqué que le care ne présentait aucun intérêt politique, voire constituait un concept écran masquant sous une (...) rhétorique en vogue un ensemble de problèmes politiques sérieux, tels que l'accroissement des inégalités ou la permanence des rapports de domination. Face à la polarisation du débat, comme aux malentendus concernant le care auxquels il a donné lieu, cet ouvrage collectif voudrait poser une double question : les théories du care sont-elles dotées d'une portée politique? Et si tel est le cas, en quoi consiste cette dernière? Nietzsche is usually presumed to be an atheist because of his proclaimation that God is dead. This dissertation argues, however, that the death of God is not atheistic but theistic, for Nietzsche's concept of Dionysus, Will to Power itself, entails an implicit commitment to theism. ;Chapter One indicates the enigmatic and nuanced quality of Nietzsche's style. Nietzsche wears masks. In order to decipher these masks with respect to the problem of God, six criteria of the traditional theistic understanding of God (...) are established. These six criteria are: Dionysus is eternal. He is the creative source of the world and man. The world and man exemplify the presence of Dionysus and yet they are not exhaustive of Him. Therefore Dionysus, as more than the world, can be spoken of as "other" than man and the world. This "otherness" entails a relationship between Dionysus and man/world. This relationship is not determinative of Dionysus. Man and world are an experiment on Dionysus' behalf; one that may "terminate," although Dionysus himself will not. ;Chapter Two sets out to formulate and expound upon the first four criteria of theism. This sets down the basic ontology. ;Chapter Three sets forth the problem of nihilism. Nihilism is the result of the death of God. ;Chapter Four discusses the relation of nihilism to morality. For Nietzsche, the moralization of life, and in particular the moralization of God, has led to God's death. Thus this chapter indicates the fifth criterion of theism, i.e., man's relation to God. ;Chapter Five sets out to decode hermeneutically the various masks that Nietzsche wears in reference to the problem of atheism. This chapter demonstrates how Nietzsche's own overt atheistic statements are proclaimations of iconotrophy, not godlessness. ;Chapter Six explicates Nietzsche's positive philosophy of God. This philosophy of God is formulated in terms of The Text of the Divine, God as Non-evaluatable, God and Eschatology, God and the Problem of Causality. Accordingly, this chapter deliniates the sixth criterion of theism, i.e., God's relationship to man. (shrink)

This article analyzes the legal-philosophical situation of Artificial Intelligence and the intelligent robot on being a subject of Law to be considered a creative person or author. The contradiction involved in allowing an object to present the legal duality of being protected as an object that it is and at the same time being considered a subject by the resulting work is analyzed, an impairment or vulgarization for the subject of Law as a moral subject when proposing the fictio legis (...) de a moral object, which is not conceivable. The autopoietic theory and the enactive approach are two theoretical streams that, in spite of their historical link and conceptual affinities, offer very different views on the nature of living beings. In this paper, we compare these views and evaluate, in an exploratory way, their respective degrees of internal coherence. Focusing the analyses on certain key notions such as autonomy and organizational closure, we argue that while the autopoietic theory manages to elaborate an internally consistent conception of living beings, the (...) enactive approach presents an internal tension regarding its characterization of living beings as intentional systems directed at the environment. In this paper we will demonstrate that a computational system can meet the criteria for autonomy laid down by classical enactivism. The two criteria that we will focus on are operational closure and structural determinism, and we will show that both can be applied to a basic example of a physically instantiated Turing machine. We will also address the question of precariousness, and briefly suggest that a precarious Turing machine could be designed. Our aim in this paper is to challenge (...) the assumption that computational systems are necessarily heteronomous systems, to try and motivate in enactivism a more nuanced and less rigid conception of computational systems, and to demonstrate to computational theorists that they might find some interesting material within the enactivist tradition, despite its historical hostility towards computationalism. Philosopher Ludwig Wittgenstein had an enormous influence on twentieth-century philosophy even though only one of his works, the famous Tractatus Logico-Philosophicus, was published in his lifetime. Beyond this publication the impact of his thought was mainly conveyed to a small circle of students through his lectures at Cambridge University. Fortunately, many of his ideas have survived in both the dictations that were subsequently published, and the notes taken by his students, among them Alice Ambrose and the late Margaret Macdonald, (...) from 1932 to 1935. These notes, now edited by Professor Ambrose, are here published, and they shed much light on Wittgenstein's philosophical development. Among the topics considered are the meaning of a word and its relation to common usage, rules of grammar and their relation to fact, the grammar of first person statements, language games, and the nature of philosophy. Many current problems surrounding science revolve around the complex epistemological framework that shapes a new vision of knowledge about reality. The traditional epistemological positions are characterized by the explanation of nature by means of concatenated facts; that is, as bricks attached to each other giving shape to the edifice of science. A conception of this nature showed that the idea of certainty was nothing more than a mere illusion, opening the way, on the contrary, to the idea of the uncertainty (...) of knowledge based on the descriptions of quantum physics, also a product of the non-reductionist conception of reality, thus criticizing the specular representation. This article addresses the main problems surrounding the critical conceptions that the emerging epistemology reveals about knowledge, pointing towards a much more complex vision of reality. (shrink)

This paper examines a fundamental philosophical difference between two radical postcognitivist theories that are usually assumed to offer the same view of cognition; namely the autopoietic theory and the enactive approach. The ways these two theories understand cognition, it is argued, are not compatible nor incompatible but rather incommensurable. The reason, so it is argued, is that while enactivism, following the traditional stance held by most of the cognitive theories, understands cognitive systems as constituting a natural kind, the autopoietic theory (...) understands them as constituting only a conventional kind. Additionally, the paper shows that AT’s conventionalist stance about cognition, far from being an undesirable or useless position, offers some methodological virtues that might be timely and welcome in the agitated and revolutionary climate of current cognitive science. How we understand Descartes’s physics rests on how we interpret his ontological commitment to individual bodies, and in particular on how we account for their individuation. However, Descartes’s contemporaries as well as contemporary philosophers have seen Descartes’s account of the individuation of bodies as deeply flawed. In the first part of this paper, I discuss how the various problems and puzzles involved in Descartes’s account of the individuation of bodies arise, and the relevance of these problems for his physics. With (...) an eye toward resolving these puzzles, I argue for an interpretation of the Cartesian ontology in which bodies are not individuated by motion but, instead, are mind-dependent. As part of this reading, I demonstrate the sense in which we can clearly and distinctly perceive bodies, and also the senses in which the real, conceptual, and modal distinctions apply to them. I conclude by explaining how this account of the mind-dependent individuation of bodies is consistent with Descartes’s definition of ‘motion’ and ‘a body’ in Principles, Part II, section 25—the very passage that prima facie entails the most troubling of the individuation puzzles. Finally, I show that this account is consistent with Descartes’s general goal in constructing his physics. (shrink)

Research traditions on cognition and depression focus on relatively unconnected aspects of cognitive functioning. On one hand, the neuropsychological perspective has concentrated on cognitive control difficulties as a prominent feature of this condition. On the other hand, the clinical psychology perspective has focused on cognitive biases and repetitive negative patterns of thinking for emotional information. A review of the literature from both fields reveals that difficulties are more evident for mood-congruent materials, suggesting that cognitive control difficulties interact with cognitive biases (...) to hinder cognitive switching, working memory updating, and inhibition of irrelevant information. Connecting research from these two traditions, we propose a novel integrative cognitive model of depression in which the interplay between mood-congruent cognitive control difficulties, cognitive biases, and rumination may ultimately lead to ineffective emotion-regulation strategies to downregulate negative mood and upregulate positive mood. Recently, Michael Wheeler has argued that despite its sometimes revolutionary rhetoric, the so called 4E cognitive movement, even in the guise of ‘radical’ enactivism, cannot achieve a full revolution in cognitive science. A full revolution would require the rejection of two essential tenets of traditional cognitive science, namely internalism and representationalism. Whilst REC might secure antirepresentationalism, it cannot do the same, so Wheeler argues, with externalism. In this paper, expanding on Wheeler’s analysis, we argue that what compromises REC’s externalism is (...) the persistence of cognitively relevant asymmetries between its purported cognitive systems and the environment. Complementarily, we argue that an antirepresentationalist ancestor of enactivism, the autopoietic theory of cognition, is able to deliver and secure externalism, thus offering the explosive combination that Wheeler claims us needed for a revolution in cognitive science. Although machine intelligence is increasingly employed in healthcare, the realm of decision-making in medical ethics remains largely unexplored from a technical perspective. We propose an approach based on fuzzy cognitive maps (FCMs), which builds on Beauchamp and Childress’ prima-facie principles. The FCM’s weights are optimized using a genetic algorithm to provide recommendations regarding the initiation, continuation, or withdrawal of medical treatment. The resulting model approximates the answers provided by our team of medical ethicists fairly well and offers a high degree (...) of interpretability. Possible applications of such a system include informal guidance on medical ethics dilemmas as well as educational purposes. (shrink)

The strong version of the life-mind continuity thesis claims that mind can be understood as an enriched version of the same functional and organizational properties of life. Contrary to this view, in this paper I argue that mental phenomena offer distinctive properties, such as intentionality or representational content, that have no counterpart in the phenomenon of life, and that must be explained by appealing to a different level of functional and organizational principles. As a strategy, and following Maturana’s autopoietic theory (...) of cognition, I introduce a conceptual distinction between mind and cognition. I argue that cognition corresponds to the natural behaviour that every living being exhibits in the realization of its existence, and that, viewed in that way, cognition is a dynamic process of structural coupling that, unlike mental phenomena, involves no representational contents. On the basis of this distinction, I try to show that while life suffices for cognition, it does not suffice for mind. That is, that the strong continuity is not between life and mind but between life and cognition. (shrink)

RESUMO Este texto discute alguns problemas metodológicos e históricos concernentes à fenomenologia da consciência de imagem elaborada por Edmund Husserl e algumas de suas repercussões teóricas. Primeiramente será tematizado o escopo mais amplo em que a abordagem filosófica das imagens auferiu relevância no século XX, a saber, a assim chamada “virada icônica” ou “pictórica”, conforme as respectivas formulações de Gottfried Boehm e William Mitchell. Será situada nesse contexto a fenomenologia da imagem e, mais especificamente, a fenomenologia da consciência de imagem (...) elaborada por Husserl, considerando-se, em especial, os eixos norteadores dos três direcionamentos que sobressaem nas teorias contemporâneas da imagem, a saber: as abordagens antropológica, semiótica e perceptiva. A partir da retomada de nuances semióticas remanescentes na fenomenologia da consciência de imagem, serão apresentados alguns pontos críticos acerca da classificação das análises de Husserl no escopo do direcionamento perceptivo e, finalmente, apontadas implicações do copertencimento à apresentação intuitiva da imagem daquilo que se denominará “circunstancialidade indicativa”. ABSTRACT This text addresses some methodological and historical problems concerning the phenomenology of image consciousness elaborated by Edmund Husserl as well as some of its theoretical repercussions. At first, I examine the broader scope in which the philosophical approach to images became relevant in the 20th century, the so-called “iconic turn” or “pictorial turn”, according to the respective terms proposed by Gottfried Boehm and William Mitchell. In this context I situate the phenomenology of image and, more specifically, the phenomenology of image consciousness elaborated by Husserl, considering, in particular, the guiding axes of three directions that stand out in contemporary theories of image, namely: the anthropological, the semiotic and the perceptual approach. By the resumption of semiotic nuances remaining in the phenomenology of image consciousness I present some critical points about the classification of Husserl’s analyses in the scope of perceptual approach. Finally, I point out some implications of the co-belonging to the intuitive image presentation of what can be called “indicative circumstantiality”. (shrink)
