This paper expands the definition of gray-marketing to include some ethically problematic marketing activities and techniques used in personal selling in China. Based on this, a conceptual model of gray-marketing for a particular type of selling in which both the sellers and the buyers exhibit problematic ethics in an exchange and the associated hypotheses are developed and tested. The findings show that, first, the respondents have different ethical evaluations of different marketing practices used in personal selling such as giving and (...) accepting gifts, buying and accepting meals, and offering and accepting kickbacks. Some of these practices may not be considered unethical. Second, in terms of ethical assessment, gray-marketing practiced by buying agents is more unacceptable than when practiced by sales agents. Third, a person's ethical evaluation of gray-marketing behavior, empathy for gray-marketing, and belief that gray-marketing has serious consequences, significantly affects his inclination to use gray-marketing. This paper concludes with a discussion of some possible applications of our research findings. (shrink)

This essay presents an integrated account of Michael Wyschogrod's Zionism as a function of his broader theological anthropology, eschatology, and carnal interpretation of Israel's election. Against Leora Batnitzky, I show that Wyschogrod's Zionism, while definitively messianic, is decidedly not fanatical or fundamentalist. Against Meir Soloveichik, I show that Wyschogrod has maintained this non-fanatical messianism consistently throughout his career, and so his pacific political prescriptions are organically at one with his vigorous calls for Jewish sovereignty over the land.

The volume investigates the question of meaning of mystical phenomena and, conversely, queries the concept of "meaning" itself, via insights afforded by mystical experiences. The collection brings together researchers from such disparate fields as philosophy, psychology, history of religion, cognitive poetics, and semiotics, in an effort to ascertain the question of mysticism's meaning through pertinent, up-to-date multidisciplinarity. The discussion commences with Editor's Introduction that probes persistent questions of complexity as well as perplexity of mysticism and the reasons why problematizing mysticism (...) leads to even greater enigmas. One thread within the volume provides the contextual framework for continuing fascination of mysticism that includes a consideration of several historical traditions as well as personal accounts of mystical experiences: Two contributions showcase ancient Egyptian and ancient Israelite involvements with mystical alterations of consciousness and Christianity's origins being steeped in mystical praxis; and four essays highlight mysticism's formative presence in Chinese traditions and Tibetan Buddhism as well as medieval Judaism and Kabbalah mysticism. A second, more overarching strand within the volume is concerned with multidisciplinary investigations of the phenomenon of mysticism, including philosophical, psychological, cognitive, and semiotic analyses. To this effect, the volume explores the question of philosophy's relation to mysticism and vice versa, together with a Wittgensteinian nexus between mysticism, facticity, and truth; language mysticism and "supernormal meaning" engendered by certain mystical states; cognitive-poetic analysis of mystical poetry; and a semiotic scrutiny of some mystical experiences and their ineffability. Finally, the volume includes an assessment of the so-called New Age authors' contention of the convergence of scientific and mystical claims about reality. The above two tracks are appended with personal, contemporary accounts of mystical experiences, in the Prologue; and a futuristic envisioning, as a fictitious chronicle from the time-to-come, of life without things mystical, in the Postscript. Whilst previous observational studies have linked negative thought processes such as an external locus of control and holding negative cognitive styles with depression, the directionality of these associations and the potential role that these factors play in the transition to adulthood and parenthood has not yet been investigated. This study examined the association between locus of control and negative cognitive styles in adolescence and probable depression in young adulthood and whether parenthood moderated these associations. Using a UK prospective population-based birth (...) cohort study: the Avon Longitudinal Study of Parents and Children, we examined the association between external locus of control and negative cognitive styles in adolescence with odds of depression in 4,301 young adults using logistic regression models unadjusted and adjusted for potential confounding factors. Interaction terms were employed to examine whether parenthood moderated these associations. Over 20% of young adults in our sample were at or above the clinical threshold indicating probable depression. For each standard deviation increase in external locus of control in adolescence, there was a 19% higher odds of having probable depression in young adulthood, after adjusting for various confounding factors including baseline mood and different demographic and life events variables. Similarly, for each SD increase in negative cognitive styles in adolescence, there was a 29% higher odds of having probable depression in the adjusted model. We found little evidence that parenthood status moderated the relationship between external locus of control or negative cognitive styles in adolescence and probable depression following adjustment for confounding factors. Effect estimates were comparable when performed in the complete case dataset. These findings suggest that having an external locus of control and holding negative cognitive styles in mid- to late adolescence is associated with an increased likelihood of probable depression in young adulthood. What does the abundance of data and proliferation of data-making methods mean for the ordinary person, the person on the street? And, what could they come to mean? In this paper, we present an overview of a year-long project to examine just such questions and complicate, in some ways, what it is to ask them. The project is a collective exercise in which we – a mixture of social scientists, designers and makers – and those living and working on one (...) street in Cambridge, Tenison Road, are working to think through how data might be materialised and come to matter. The project aims to better understand the specificities and contingencies that arise when data is produced and used in place. Mid-way through the project, we use this commentary to give some background to the work and detail one or two of the troubles we have encountered in putting locally relevant data to work. We also touch on a methodological standpoint we are working our way into and through, one that we hope complicates the separations between subject and object in data-making and opens up possibilities for a generative refiguring of the manifold relations. We draw out significant consequences of a relatively popular theory of metaphysical modality—branching actualism—for cosmological arguments for God’s existence. According to branching actualism, every possible world shares an initial history with the actual world and diverges only because causal powers (or dispositions, or some such) are differentially exercised. We argue that branching actualism undergirds successful responses to two recent cosmological arguments: the Grim Reaper Kalam argument and a modal argument from contingency. We also argue that branching actualism affords a response (...) to one popular defense of the classic contingency argument. What results are new difficulties for several cosmological arguments arising from the metaphysics of modality. (shrink)

The Black Lives Matter movement has called for the abolition of capital punishment in response to what it calls “the war against Black people” and “Black communities.” This article defends the two central contentions in the movement’s abolitionist stance: first, that US capital punishment practices represent a wrong to black communities rather than simply a wrong to particular black capital defendants or particular black victims of murder, and second, that the most defensible remedy for this wrong is the abolition of (...) the death penalty. We offer a new argument in favour of metanormative contextualism, the thesis that the semantic value of a normative ‘ought’ claim of the form ‘ S ought to Φ’ depends on the value of one or more parameters whose values vary in a way that is determined by the context of utterance. The debate over this contextualist thesis has centred on cases that involve ‘ought’ claims made in the face of uncertainty regarding certain descriptive facts. Contextualists, relativists, and invariantists all (...) have plausible ways of explaining these cases, and one could reasonably judge the debate between these views to be a stalemate. We argue that this stalemate can be broken by shifting focus to a case that involves normative uncertainty rather than descriptive uncertainty. While relativist and invariantist rivals of contextualism can give plausible accounts of the descriptive uncertainty cases, only contextualism can provide a plausible account of the normative uncertainty case. The present studies investigate how the intentions of third parties influence judgments of moral responsibility for other agents who commit immoral acts. Using cases in which an agent acts under some situational constraint brought about by a third party, we ask whether the agent is blamed less for the immoral act when the third party intended for that act to occur. Study 1 demonstrates that third-party intentions do influence judgments of blame. Study 2 finds that third-party intentions only influence moral (...) judgments when the agent's actions precisely match the third party's intention. Study 3 shows that this effect arises from changes in participants' causal perception that the third party was controlling the agent. Studies 4 and 5, respectively, show that the effect cannot be explained by changes in the distribution of blame or perceived differences in situational constraint faced by the agent. (shrink)

The papers in this volume reflect much of the current unease of a world that perceives itself once more at the edge of chaos. The authors present different vistas of that experience and their inherent dialectic, expressed in numerous and ceaseless conflicts between ordering and disordering processes. They can be read as comments on the ongoing processes that lead toward greater complexity.

The lack of attention to sustainability, as a concept with multiple dimensions, has presented a developmental gap in green marketing literature, sustainability, and marketing literature for decades. Based on the established premise of customer–corporate (C–C) identification, in which consumers respond favorably to companies with corporate social responsibility initiatives that they identify with, we propose that consumers would respond similarly to companies with sustainability initiatives. We postulate that consumers care about protecting and preserving favorable economic environments (an economic dimension of sustainability) (...) as much as they care about natural environments. Thus, we investigate how two sustainability dimensions (i.e., environmental and economic) and price can influence consumer responses. Using an experimental method, we demonstrate that consumers favor sustainability in both dimensions by giving positive evaluations of the company and purchase intent. In addition, consumers respond more negatively to poor company sustainability than to high company sustainability. In comparison, consumers respond more negatively to the company’s poor commitment to caring for the environment than to the company’s poor commitment to economic sustainability. We also find that consumers do not respond favorably to low prices when they have information about the firm’s poor environmental sustainability. Finally, we find support for an interaction effect between consumer support for sustainability and corporate sustainability; that is, consumers evaluate a company more favorably if the company shares the consumers’ social causes. Overall, we conclude, from our empirical study, support for the idea that consumers do respond to multiple dimensions of sustainability. (shrink)

Drawing upon empirical studies of racial discrimination dating back to the 1940’s, the Movement for Black Lives platform calls for the abolition of capital punishment. Our purpose here is to defend the Movement’s call for death penalty abolition in terms congruent with its claim that the death penalty in the U.S. is a “racist practice” that “devalues Black lives.” We first sketch the jurisprudential history of race and capital punishment in the U.S., wherein courts have occasionally expressed worries about racial (...) injustice but have usually taken such evidence to warrant reform but not outright abolition. We argue that the racial discrimination at issue flows in significant part from implicit biases concerning race, criminality, and violence, which do not fit comfortably within the picture of racial bias advanced by the courts. The case for abolition, we contend, rests on Black Americans as a class (not merely those who interact with the criminal justice system as capital defendants or as murder victims) being subject to such bias and thereby not being accorded equal status under the law. Brains enjoy a bodily life. Therefore animals are subjects with a point of view. Yet, coding betrays an anthropomorphic bias: we can, therefore they must. Here I propose a reformulation of Brette's question that emphasizes organismic perception, cautioning for misinterpretations based on external ideal-observer accounts. Theoretical ethology allows computational neuroscience to understand brains from the perspective of their owners.

In Australia and Oregon, USA, legislation to permit statutory sanctioned physician-assisted dying was enacted. However, opponents, many of whom held strong religious views, were successful with repeal in Australia. Similar opposition in Oregon was formidable, but ultimately lost in a 60-40% vote reaffirming physician-assisted dying. This paper examines the human dilemma which arises when technological advances in end-of-life medicine conflict with traditional and religious sanctity-of-life values. Society places high value on personal autonomy, particularly in the United States. We compare the (...) potential for inherent contradictions and arbitrary decisions where patient autonomy is either permitted or forbidden. The broader implications for human experience resulting from new legislation in both Australia and Oregon are discussed. We conclude that allowing autonomy for the terminally ill, within circumscribed options, results in fewer ethical contradictions and greater preservation of dignity. (shrink)

In recent years, a number of philosophers have conducted empirical studies that survey people's intuitions about various subject matters in philosophy. Some have found that intuitions vary accordingly to seemingly irrelevant facts: facts about who is considering the hypothetical case, the presence or absence of certain kinds of content, or the context in which the hypothetical case is being considered. Our research applies this experimental philosophical methodology to Judith Jarvis Thomson's famous Loop Case, which she used to call into question (...) the validity of the intuitively plausible Doctrine of Double Effect. We found that intuitions about the Loop Case vary according to the context in which the case is considered. We contend that this undermines the supposed evidential status of intuitions about the Loop Case. We conclude by considering the implications of our findings for philosophers who rely on the Loop Case to make philosophical arguments and for philosophers who use intuitions in general. (shrink)

In this introduction to the Special Issue, we undertake a little ground clearing in order to make room in International Relations for thinking differently about anarchy and world politics. Anarchy’s roots in, and association with, social contract theory and the state of nature has unduly narrowed how we might understand the concept and its potential in International Relations. Indeed, such is the consensus in this regard that anarchy is remarkably uncontested, considering its centrality to the field. Looking around, both inside (...) and outside International Relations, for alternative accounts, we find ample materials for helping us think anew about the nature of and possibilities for politics in anarchy. In the second part of the introduction, we show how our contributors develop and expand on these resources and what we hope the Special Issue brings to International Relations. (shrink)

His “interface theory of perception” is a peculiar blend of metaphorical ontology (objects are icons, space-time is a desktop) and mathematical modelling (the game-theoretical argument that fitness trumps truth. Conflating abstractions with concrete experience, evolution is used to refute everything (including evolution itself. Neuroscience needs theory. Ideas without data are blind, and yet mechanisms without concepts are empty. Friston's free energy principle paradigmatically illustrates the power and pitfalls of current theoretical biology. Mighty metaphors, turned into mathematical models, can become mindless metaphysics. Then, seeking to understand everything in principle, we may explain nothing in practice. Life can't live in a map.

By Aristotle’s own admission, homonymy and amphiboly, or syntactic homonymy, are unlikely to be accidental features of the Greek language (nor of any language, nor of language as such), but rather a radical evil that can at best be subdued, through recourse to categories, for example. Or we could choose to follow the sophists and exploit it by aiming at an essentially sonorous consensus. But then such texts would constitute a radical evil for translation.

The rising cost of the opioid antagonist and overdose reversal agent naloxone is an urgent public health problem. The recent and dramatic price increase of Evzio, a naloxone auto-injector produced by Kaléo, shows how pharmaceutical manufacturers entering the naloxone marketplace rely on market exclusivity guaranteed by the patent system to charge prices at what the market can bear, which can restrict access to life-saving medication. We argue that 28 U.S.C. § 1498, a section of the federal code that allows the (...) government to use patent-protected products for its own purposes in exchange for reasonable compensation, could be used to procure generic naloxone auto-injectors, or at least bring Kaléo to the negotiating table. Precedent exists for the use of § 1498 to procure pharmaceuticals, and it could give meaning to the federal government's recent declaration of a public health emergency around the opioid epidemic, discourage new market entrants from charging exorbitant prices, and yield important public health benefits. Focus on the evolutionary origins of musicality has been neglected relative to attention on language, so these new proposals are welcome stimulants. We argue for a broad comparative approach to understanding how the elements of musicality evolved, and against the use of overly simplistic evolutionary accounts.

An extended scale relativity theory, actively developed by one of the authors, incorporates Nottale's scale relativity principle where the Planck scale is the minimum impassible invariant scale in Nature, and the use of polyvector-valued coordinates in C-spaces (Clifford manifolds) where all lengths, areas, volumes⋅ are treated on equal footing. We study the generalization of the ordinary point-particle quantum mechanical oscillator to the p-loop (a closed p-brane) case in C-spaces. Its solution exhibits some novel features: an emergence of two explicit scales (...) delineating the asymptotic regimes (Planck scale region and a smooth region of a quantum point oscillator). In the most interesting Planck scale regime, the solution recovers in an elementary fashion some basic relations of string theory (including string tension quantization and string uncertainty relation). It is shown that the degeneracy of the first collective excited state of the p-loop oscillator yields not only the well-known Bekenstein–Hawking area-entropy linear relation but also the logarithmic corrections therein. In addition we obtain for any number of dimensions the Hawking temperature, the Schwarschild radius, and the inequalities governing the area of a black hole formed in a fusion of two black holes. One of the interesting results is a demonstration that the evaporation of a black hole is limited by the upper bound on its temperature, the Planck temperature. (shrink)

This volume examines general ethical principles and controversies in the social sciences by looking specifically at the recent three-year revision process to the American Anthropological Association’s code of ethics. The book’s contributors were members of the task force that undertook that revision and thus have first-hand knowledge of the debates, compromises, and areas of consensus involved in shaping any organization’s ethical vision. The book -reflects the broad diversity of opinion, approach, and practice within anthropology and the social sciences; -develops ethical (...) principles that reflect core values rather than the latest ethical controversies; -crafts clear, broad statements, increasing the likelihood that the ethical code will be a meaningful part of the daily discourse of practicing anthropologists; -develops the ethical code as a living document, or a process of experience and debate, subject to future revision and amplification; -provides explanation through internet links and other resources, ensuring that the finished product be relevant and vibrant. Holtby, Allen and Fairchild are both recent and revolutionary decisions that address an important aspect of the indeterminate causation problem that frequently arises in tort litigation. In Holtby and Allen, the Court of Appeal departed from the traditional binary approach, under which a tort claimant either recovers compensation for his or her entire injury or is altogether denied recovery—depending on whether his or her case against the defendant is more probable than not. Holtby and Allen substituted this approach by the (...) proportionate recovery principle, under which the defendant compensates the claimant for a fraction of his or her injury that represents the defendant's statistical share in that injury. This article analyses this development within the particular domain of indeterminate causation, over which the proportionate recovery principle has been licensed to exercise control. The article claims that this development would constitute an improvement of the law from the perspectives of both optimal deterrence and corrective justice, if the courts properly formulate its scope. First, the proportionate recovery principle needs to be explicitly confined to cases that deal with recurrent wrongs. Second, determination of the defendant's share in the claimant's injury ought to be grounded on the probability of causation, rather than the risk of inflicting that injury. Third, judges must not apply unarticulated intuitions in determining the magnitude of the relevant risk or probability: their decisions in that area would be better informed by the statistical principle of ‘insufficient reason’, also known as the ‘indifference principle’. Fourth, courts are yet to relieve the doctrinal tension between the proportionate recovery principle, as recognized in Holtby and Allen, and the previous rejection of that principle by the House of Lords. Subsequently, the article analyses the House of Lords' decision in Fairchild—yet another instance of indeterminate causation in which proportionate recovery is preferable to the ‘all or nothing’ approach. In this case, the House of Lords allowed the claimants full recovery. This holding was grounded in the Law Lords' innovative approach to indeterminate causation, and the article unfolds the problematics of this approach. Finally, the article offers an adoption of yet another legal mechanism—the ‘evidential damage doctrine’—that replaces liability under uncertainty with liability for uncertainty. (shrink)

The “fair benefits” approach to international research is designed to produce results that all can agree are fair without taking a stand on divisive questions of justice. But its appealing veneer of collaboration masks ambiguities at both a conceptual and an operational level. An attempt to put it into practice would look a lot like an auction, leaving little reason to think the outcomes will satisfy even minimal conditions of fairness.

We agree with Vaesen that there is evidence for cognitive differences between humans and other primates. However, it is too early to draw firm conclusions about the uniqueness of the cognitive mechanisms underlying human tool use. Tests of causal understanding are in their infancy, as is the study of animals more distantly related to humans.

In this article, we offer a detailed study of two important episodes in the early history of high-energy physics, namely the development of the Chew and the Nambu-Jona-Lasinio models. Our study reveals that both models resulted from the combination of an old Hamiltonian, which had been introduced by earlier researchers, and two new approximation methods developed by Chew and by Nambu and Jona-Lasinio. These new approximation methods, furthermore, were the key component behind the models’ success. We take this historical investigation (...) to support two philosophical theses about the manner in which scientific modelling operates in high-energy physics. Both of these theses run counter to a view that is commonly accepted among philosophers of science: the view that all approximations can be embedded within an equivalent idealized system, and that whatever role the former might play in scientific modelling is therefore parasitic on the much more substantial work performed by the latter. Our first thesis, which we call “Distinctness,” states that approximation methods constitute an independent category of theoretical output from idealized systems. We thus believe that approximations and idealized systems constitute two independent types of objects, both of which are essential to the practice of modelling. Our second, more radical thesis is called “Content Determination.” Our claim here is that approximation methods can in fact be essential to assigning determinate physical content to the idealized systems with which they jointly operate. As we show, this is due to the fact that quantum field theory allows for a very thin characterization of idealized systems only, making the use of approximations necessary to supply additional content. We conclude the paper with a few reflections about the manner in which our two theses can be used to articulate David Kaiser’s views on the “vanishing of scientific theory” in physics after WWII. This paper explores relational syllogistic logics, a family of logical systems related to reasoning about relations in extensions of the classical syllogistic. These are all decidable logical systems. We prove completeness theorems and complexity results for a natural subfamily of relational syllogistic logics, parametrized by constructors for terms and for sentences.

Agitation is one of the most common behavioural and psychological symptoms in people living with dementia. This behaviour can cause tremendous stress and anxiety on family caregivers and healthcare providers. Direct observation of PLwD is the traditional way to measure episodes of agitation. However, this method is subjective, bias-prone and timeconsuming. Importantly, it does not predict the onset of the agitation. Therefore, there is a need to develop a continuous monitoring system that can detect and/or predict the onset of agitation. (...) In this study, a multi-modal sensor platform with video cameras, motion and door sensors, wristbands and pressure mats were set up in a hospital-based dementia behavioural care unit to develop a predictive system to identify the onset of agitation. The research team faced several barriers in the development and initiation of the study, namely addressing concerns about the study ethics, logistics and costs of study activities, device design for PLwD and limitations of its use in the hospital. In this paper, the strategies and methodologies that were implemented to address these challenges are discussed for consideration by future researchers who will conduct similar studies in a hospital setting. Should we embrace nihilism, as Nolen Gertz suggests, or try to overcome it? For Nietzsche, nihilism must be overcome – if we're strong enough. The key, argues Alex Silk, is to see how nihilistic beliefs – that, say, nothing matters – derive from nihilistic feelings and bodily states. Understanding the basic features of human nature and experience at the root of nihilism paves the way toward a healthier, affirming perspective on ourselves and human life. Purpose There is a contradictive debate on factors influencing mobile phone usage awareness among scholars. This study aims to examine factors influencing mobile phone usage awareness for accessing agricultural marketing information. Design/methodology/approach A descriptive cross-sectional research design was used with 400 smallholder grape farmers. The use of structured questionnaires, focus group discussions and key informant interviews helped to collect primary data. Data analysis was subjected to descriptive, ordinal logistic regression and thematic approaches. Findings This study found that farmers were mostly (...) aware of voice calls helping to access buyers and price information. Education, age and sex were the critical factors influencing mobile phone usage awareness among grape smallholder farmers. Originality/value This study contributes to scientific knowledge by providing an understanding of the perceived factors on mobile phone usage awareness within the grape subsector to inform policymakers.
