In 1989 Smart problematised law as a masculinist knowledge which disqualified other forms of knowledge, particularly feminism. Twenty-one years later Smart characterises the relationship between law and feminism quite differently. In this account law responds to feminism and outcomes are progressive. Smart suggests that rather than continuing to focus on law’s disciplinary and normalising role, it is more productive to conceptualise contemporary family law as a creative kinning practice. We argue, however, that we must also bring into this account the (...) changes to the state brought about by neo-liberalism. The paper tests these observations about the trajectories of feminism, law and neo-liberalism by reflecting upon our study of the Albert Kennedy Trust (AKT). AKT was established in 1989, in the wake of gay and lesbian resistance to Clause 28, to provide homes with gay and lesbian adults for homeless gay and lesbian teenagers. We are interested in AKT’s shift in its description of the adults’ relationship with the teenagers in their care from ‘brothers and sisters’ to ‘carers’ as it moved from a marginal force to mainstream partner/provider. In this context we explore the complexity of law’s responsiveness to feminism’s dynamism, its contingent recognition of kinning practices and, in the light of neo-liberalism, its continuing disciplinary role. The problem of time involves an overlap between physics, philosophy, psychology and neuroscience. My talk will discuss the role of time in physics but also emphasize that physics may need to expand to address issues usually regarded as being in the other domains. I will first review the mainstream physics view of time, as it arises in Newtonian theory, relativity theory and quantum theory. I will then discuss the various arrows of time, the most fundamental of which is the passage (...) of time associated with consciousness. I will argue that this goes beyond both relativity theory and quantum theory, so that one needs some new physical paradigm to accommodate it. A new paradigm is required anyway to describe quantum gravity and this may elucidate the nature of both time and consciousness. (shrink)

Phenomenological questions differ from those of metaphysics and epistemology. Regarding history, rather than asking: What is history? Or: How do we know history? a phenomenology of history inquires into history as a phenomenon, and into the experience of the historical. How does history present itself to us, how does it enter our lives, and what are the forms of experience in which it does so? The purpose of this essay is to outline a distinctively phenomenological approach to history. History is (...) usually associated with social existence and its past, and so this essay will ask about the experience of the social world and of its temporality. Experience in this context connotes not just observation but also involvement and interaction. We experience history not just in the social world around us but also in our own engagement with it. Philosophers have asked both metaphysical and epistemological questions about history, and some of the best-known philosophies of history have resulted from this questioning. The phenomenological approach is different, but it is not unrelated to these traditional philosophical questions. The later part of this essay will turn in some detail to how phenomenology, though distinct, may connect to these questions. (shrink)

'Categorial description' concerns the fundamental features of our conceptual scheme: the categories described are those of substance, accident, cause, space and time. ;Following Aristotle's distinction between primary and secondary substances, these two notions are addressed as equivalent to those individual or particular things and their kinds. (...) A particular thing is characterised as not being capable of occuring in the predicate position in a proposition; and as having criteria or principles of individuation and reidentification. Accidents or properties can appear in the predicate position and do not have criteria of identity. ;Secondary substances, or natural kinds, being a species of property, also fail to have criteria for individuation and reidentification. It follows that the recently revived Aristotelian essentialism, as exhibited in particular in the work of Kripke, fails to correctly characterise the category of natural kinds: in that theory, natural kinds have essential properties which enable individuation and reidentification across possible worlds. ;Efficient causation is described, against the background of the Locke-Hume dispute, as involving the concept of necessary connection between cause and effect. Rejecting the theory of Harre and Madden on causal powers, an approach by Mackie is defended whereby this connection is a reflection of our counterfactual thinking. The possible worlds essentialist approach of Lewis to counterfactuals is rejected too, as inadequate. ;Space and time, spatial and temporal relations, and places and moments in time are approached in terms of the other categories of particular and property. The obscurity of fit between these categories is identified as responsible for many philosophical puzzles concerning space and time: for example, McTaggart's 'proof' of the unreality of time; and the recent debate on the possibility of multiple times and multiple spaces. ;In the final chapter, the logical commitments of categorial description concerning conceptual relativism and the nature of reality in itself are explored. It is argued that, since categories are in large part responsible for the kinds of acts there are, a description of our categories is a description of reality itself. Since our categories do not involve the machinery of possible worlds offered by contemporary essentialist theories, those theories fail to describe reality. (shrink)

Perhaps the most pressing issue concerning teacher education and training since the end of the Second World War has been that of the role of theory—or principled reflection—in professional expertise. Here, although the main post‐war architects of a new educational professionalism clearly envisaged a key role for theory—considering such disciplines as psychology, sociology and philosophy as indispensable for reflective practice—there are nevertheless well‐rehearsed difficulties about crediting such disciplines with quite the (applied) role in educational practice of (say) physiology or anatomy (...) in medical practice. This paper argues that while recent developments in professional teacher education and training may have moved on from erstwhile instrumentalist and/or applied science (competence and other) perspectives, there may yet be a case for further progress towards a rather more sophisticated philosophical psychology of teacher knowledge and expertise. Albert Lautman (1908-1944) was a French philosopher of mathematics whose work played a crucial role in the history of contemporary French philosophy. His ideas have had an enormous influence on key contemporary thinkers including Gilles Deleuze and Alain Badiou, for whom he is a major touchstone in the development of their own engagements with mathematics. Mathematics, Ideas and the Physical Real presents the first English translation of Lautman's published works between 1933 and his death in 1944. Rather than being (...) preoccupied with the relation of mathematics to logic or with the problems of foundation, which have dominated philosophical reflection on mathematics, Lautman undertakes to develop an understanding of the broader structure of mathematics and its evolution. The two powerful ideas that are constants throughout his work, and which have dominated subsequent developments in mathematics, are the concept of mathematical structure and the idea of the essential unity underlying the apparent multiplicity of mathematical disciplines. In the recent literature on concepts, two extreme positions concerning animal minds are predominant: the one that animals possess neither concepts nor beliefs, and the one that some animals possess concepts as well as beliefs. A characteristic feature of this controversy is the lack of consensus on the criteria for possessing a concept or having a belief. Addressing this deficit, we propose a new theory of concepts which takes recent case studies of complex animal behavior into account. The main aim (...) of the paper is to present an epistemic theory of concepts and to defend a detailed theory of criteria for having concepts. The distinction between nonconceptual, conceptual, and propositional representations is inherent to this theory. Accordingly, it can be reasonably argued that some animals, e.g., grey parrots and apes, operate on conceptual representations. (shrink)

Abstract:This paper argues that moral judgment is suffering at the hands of instrumental rationality and identity thinking, concepts from the tradition of the Frankfurt School of Critical Theory that help explain degradations in human relations. These concepts are not new, but they are realized in novel ways, and the implications continue to be significant, contributing to human suffering and prominent anti-intellectual sentiment. Working through the shared intellectual ground of Adorno, Edmundson, Stivers, and Ellul, the paper takes a critical look at (...) our culture through the objectification of genuine human relations that comes with techno-rational prioritization. The endpoint of such a culture is the compromise of human subjectivity in the service of efficiency, objectivity, and measurability. Extending the analysis to educational practice, Joas’s notion of situational creativity and Dewey’s aesthetics are proposed as possible points of resistance, highlighting positive actions to be taken to remediate these narrow and dehumanizing phenomena. Introspection, or looking inward to observe one's experience, is inherent in many methods used to study feelings, the experiential component of emotion. Challenges of introspection make faithful, high-fidelity descriptions of feelings difficult to attain. A method that (1) cleaves to a specific moment, (2) cleaves to pristine inner experience, (3) brackets presuppositions, and (4) utilizes an iterative process may be particularly well suited to this task. We review some contemporary introspective methods from the perspective of these four methodological constraints, finding (...) that Descriptive Experience Sampling (DES) addresses the constraints most fully. We present DES findings on feelings to highlight the unique contributions careful introspective methods make to emotion science. High-fidelity descriptions of feelings are necessary for a complete understanding of emotion. (shrink)

An accurate classification of bacteria is essential for the proper identification of patient infections and subsequent treatment decisions. Multi-Locus Sequence Typing (MLST) is a genetic technique for bacterial classification. MLST classifications are used to cluster bacteria into clonal complexes. Importantly, clonal complexes can serve as a biological species concept for bacteria, facilitating an otherwise difficult taxonomic classification. In this paper, we argue for the inclusion of terms relating to clonal complexes in biomedical ontologies.

Tyler Burge offers a theory of testimony that allows for the possibility of both testimonial a priori warrant and testimonial a priori knowledge. I uncover a tension in his account of the relationship between the two, and locate its source in the analogy that Burge draws between testimonial warrant and preservative memory. I contend that this analogy should be rejected, and offer a revision of Burge's theory that eliminates the tension. I conclude by assessing the impact of the revised theory (...) on the scope of a priori knowledge. (shrink)

The study examines the argumentative competencies of people with Asperger syndrome (AS) and compares this with those of normal – or what are called neurotypical (NT) – subjects. To investigate how people with AS recognise, evaluate and engage in argumentation, we have adapted and applied the empirical instrument developed by van Eemeren, Garssen and Meuffels to study the conventional validity of the pragma-dialectical freedom rule (van Eemeren, Gars- sen & Meuffels 2003a; 2003b; 2005a; 2005b; van Eemeren & Meuffels, 2002). Our (...) paper begins with some background information on Asperger syndrome and how it impacts upon communication and argumentation; then it addresses the research questions and methods used; thirdly, it presents some initial findings; finally, it will conclude with some im- plications for those people with AS, for those they come into contact with and for the pragma-dialectic model in general. Paul Ricoeur was one of the foremost interpreters and translators of Edmund Husserl's philosophy. These nine essays present Ricoeur's interpretation of the most important of Husserl's writings, with emphasis on his philosophy of consciousness rather than his work in logic.
