This article identifies the two currents that have divided the Left over the Zimbabwe question. It argues that in the course of the radicalisation of the Zimbabwean state, 'Two Lefts' emerged, the so-called 'internationalist' and the 'nationalist', to take up opposite positions over a series of political questions, most notably the agrarian question and the national question. The article defends the nationalist Left and offers a critique of the 'internationalist' Left through a discussion of contemporary imperialism, the neocolonial state, and (...) civil society. The opinion of Mr. Justice Francis of the English High Court which denied the parents of Charlie Gard, who had been born with an extremely rare mutation of a genetic disease, the right to take their child to the United States for a proposed experimental treatment occasioned world wide attention including that of the Pope, President Trump, and the US Congress. The case raise anew a debate as old as the foundation of Western medicine on who should decide and on (...) what standard when there is a conflict between a family and the treating physicians over a possible treatment. This paper will explore the different approaches of the British and American courts on the issue and the various proposals from that of John Rawls in his A Theory of Justice to a processed-based approach for resolving such disputes. As carefully crafted as the opinion of Mr Justice Nicholas Francis in the Gard case proved to be, it left commentators unsatisfied. A widespread criticism, captured in an article by Michael Dougherty in The National Review was for the state to ‘get out of the way of the parents trying to act in the best interests of the child’.1 Although he conceded the parents could be adding to the suffering of the child by taking Charlie to America for an experimental therapy and agreed that such a choice ‘may be the wrong decision,’ in Dougherty’s view, it should still be ‘their decision’. Dougherty’s stand was the popular response to the question of ‘Who should decide?’ It fails, however, to propose any rationale for the decision. It provided no norms, no standards and no guidelines for the parents. Their motive could equally well be indifference to the suffering of the child as concern for his well-being. Sartre claims, "One does not write for slaves."1 This takes place in the context of an argument Sartre makes in claiming literature is an appeal to the freedom of others.2 Furthermore, the acts of reading and writing are collaborative occasions that invent and re-invent the world by disclosing it and creating it.3 It is important to be precise about what Sartre believes must be presupposed in order for literature to function. Clarifying the concept of emotions is an essential task of 21st century societies. We cannot continue living if we ignore the importance they have in our everyday thinking and acting. Emotions are fundamental both to the private and the public sphere It is becoming increasingly important to learn to identify what we feel and what those around us feel, how we express these feelings and understand their consequences, in order to enable us to transform harmful emotions into others more favorable (...) to the well-being of our personal relationships and our relationship with the environment. With this objective in mind, my text proposes a form of emotional education in the framework of peace education, initiated in early childhood, which acts to develop the emotional capacity required for the realization of a form of critical, ethical and creative global citizenship. This work recovers the methodology of the school of philosophy with children, which gives a great sense of philosophical praxis to the text, by putting it in dialogue, also, with studies in philosophy for peace. Thus, it is essential to vindicate empathy and moral imagination from the time we are children. Through thinking based on care, fthe cultivation of an emotional education will stimulate to wonder about other emotional alternatives, escaping from our own limits and exploring the perspectives of others until we come to merge with their horizons. With the emergence and rapid growth of Social Media, a number of government departments in several countries have embraced Social Media as a privilege channel to interact with their constituency. We are exploring, in collaboration with the Australian Department of Human Services, the possibility to exploit the potential of social networks to support specific groups of citizens. To this end, we have developed Next Step, an online community to help people currently receiving welfare payments find a job and become financially (...) self-sufficient. In this paper, we explore some ethical issues that arise when governments engage directly with citizens, in particular with communities in difficult situations, and when researchers are involved. We describe some of the challenges we faced and how we addressed them. Our work highlights the complexity of the problem, when an online community involves a government department and a welfare recipient group with a dependency relationship with that department. It becomes a balancing act, with the need to ensure privacy of the community members whilst still fulfilling the government’s legal responsibilities. While difficult, these issues must be addressed if governments are to engage with their citizens using Social Media. (shrink)

Clinical trials of xenotransplantation may begin early in the next decade, with kidneys from genetically modified pigs transplanted into adult humans. If successful, transplanting pig hearts into children with advanced heart failure may be the next step. Typically, clinical trials have a specified end date, and participants are aware of the amount of time they will be in the study. This is not so with XTx. The current ethical consensus is that XTx recipients must consent to lifelong monitoring. While this (...) presents challenges to the right to withdraw in the adult population, additional and unanswered questions also linger in the paediatric population. In paediatric XTx, parents or guardians consent not only to the initial treatment of the child but also to lifelong monitoring, thus making a decision whose consequences will remain present as the child develops the capacity for assent, and finally the capacity for informed consent or refusal. This article presents and evaluates unanswered paediatric ethical questions in regard to the right to withdraw from XTx follow-up in the paediatric population. (shrink)

Faculty continue to address academic dishonesty in their classes. In this follow-up to an earlier study on general perceived faculty student cheating, using a sample of business school faculty, we compared three levels of faculty classification: full-time non-tenure track, full-time tenured/tenure-track, and part-time adjuncts. Results showed that NTTs perceived higher levels for three different types of student cheating, i.e., paper-based, forbidden teamwork, and hiring someone to take an exam. In addition, NTTs were more likely to report a student for cheating. (...) NTTs reported a higher course load and average class size, and average class size was positively related to all five types of cheating measured. Given the predicted increase in NTTs across all disciplines, making sure that all faculty,, have the resources needed to deter student cheating is important. All faculty have an obligation to hold students accountable for their behavior. Individual integrity is paramount; and it is what employers expect. Regardless of the chosen field or discipline, an employer’s expectations, in terms of character, is to hire individuals who possess a level of honesty that is above reproach. Addressing cheating is an obligation that all faculty need to address purposefully. Providing resources to help faculty address cheating is critical. Resources might include conflict resolution training to provide instructors with the necessary guidance so that they can better handle these difficult situations. This is important not only for the student while in school, but also for a university/college’s reputation. (shrink)

In face of the multiple controversies surrounding the DSM process in general and the development of DSM-5 in particular, we have organized a discussion around what we consider six essential questions in further work on the DSM. The six questions involve: 1) the nature of a mental disorder; 2) the definition of mental disorder; 3) the issue of whether, in the current state of psychiatric science, DSM-5 should assume a cautious, conservative posture or an assertive, transformative posture; 4) the role (...) of pragmatic considerations in the construction of DSM-5; 5) the issue of utility of the DSM – whether DSM-III and IV have been designed more for clinicians or researchers, and how this conflict should be dealt with in the new manual; and 6) the possibility and advisability, given all the problems with DSM-III and IV, of designing a different diagnostic system. Part 1 of this article took up the first two questions. Part 2 took up the second two questions. Part 3 now deals with Questions 5 & 6. Question 5 confronts the issue of utility, whether the manual design of DSM-III and IV favors clinicians or researchers, and what that means for DSM-5. Our final question, Question 6, takes up a concluding issue, whether the acknowledged problems with the earlier DSMs warrants a significant overhaul of DSM-5 and future manuals. We are affected by the world: when I place my hand next to the fire, it becomes hot, and when I plunge it into the bucket of ice water, it becomes cold. What goes for physical changes also goes for at least some mental changes: when Felix the Cat leaps upon my lap, my lap not only becomes warm, but I also feel this warmth, and when he purrs, I hear his purr. It seems obvious, in other words, that perception (...) (at least, and at least under ordinary conditions) is a matter of being affected by the agency of perceptible objects. Call this doctrine affectionism. Durand of St.-Pourçain rejects affectionism. The paper has three parts. In the first part, I sketch, briefly, what motivates Durand to reject affectionism. In the second part, I will take up the affectionist doctrine as defended by Durand's older contemporary at Paris, Godfrey of Fontaines, who holds that the object of all our mental acts (not just perceptions, but also thoughts and desires) is the efficient cause of those acts, or, in other words, all mental acts (not just perception) come about owing to the affection of the relevant mental faculty by the agency of the object. As it turns out, Godfrey develops a celebrated argument against the thesis that the object is not the efficient cause but a mere sine qua non cause. Hence his position offers a challenge to Durand's position, a challenge, I argue in the third part, Durand meets. (shrink)

Abstract:This joint response to the roundtable takes the form of a written dialogue, based on longer conversations via video link and instant messaging. The written dialogue seems an especially apt format for this response, so interconnected is it with the traditions of utopian thinking from Plato onward, and one which moreover has much to do with utopian heuristics.

Strategically pursuing the time-honoured notion of tactical essentialism I explore some of the unworked themes from my old porno-theories concerning the sexual as a site of reflection, the literal deferral of jouissance in favour of a moment of insight. In order to do this I locate my argument in pages from the diaries of an old friend and bar colleague in Paris, J, which extend over three decades of gay life and contain innumerable scenes of sexual abandonment, written in (...) a lucidly quotidian prose. I work from a series of Thursdays, which contain descriptions of J's weekly visits to the Keller Bar and in which, from the early 1990s, I figure from time to time. The unfolding of queer theory from early Butler onwards will thus be exposed to the light of ‘witness’ or ‘oral experience’, rethinking this old contradiction of people's history and cultural studies and taking some measure of theory's adequacy to make abstractions of such material. J was a founder member of Act Up-Paris and of the Sex Grenades, friend of Guillaume Dustan and others, so his accounts are anyway charged with an environment whose figuring in queer theory is essential to its ongoing development. In this article, I argue that members of the Women's Caucus of ACT UP/la formed a boundary between themselves and male members to increase the WC's power within the feminist-friendly organization. The WC's boundary-making strategies—formalizing women's space and reinscribing gender difference—combatted “slippage” of ACT UP/la's focus away from women's issues precipated by men's greater numbers in the group. ACT UP/la's feminist-friendly politics, legitimated WC efforts, and caused male members to defer to the WC; the WC became “official women,” gaining control (...) over their agenda, over their participation within ACT UP/la, and over male contributions to the WC itself. Boundary making had an unintended effect, compartmentalization, whereby women's issues became the sole responsibility of the WC. I conclude that the WC's boundary making in ACT UP/la's feminist-friendly milieu was at once successful and problematic, and that the efforts of feminists in such organizations deserve greater scrutiny. With the passage of the Physician Payment Sunshine Act as part of the federal health care reform law, pharmaceutical manufacturers are now required to disclose a wide range of payments made by manufacturers to physicians. We review current state regulation of pharmaceutical marketing and consider how the federal sunshine provision will affect existing marketing regulation. We analyze the legal and practical implications of the Physician Payment Sunshine Act.

In 2008 pharmaceutical companies spent over $12 billion on product promotion and detailing aimed at U.S. health care practitioners. Drug and device manufacturers rely on a workforce of detailers and physician speakers to reach health care practitioners and nudge their prescribing habits. To prevent undue influence and protect the public fisc, a number of states began regulating these marketing practices, requiring companies to disclose all gifts to practitioners, prohibiting the commercialized sale of prescription data, and prohibiting certain gifts altogether. The (...) 2010 enactment of the Physician Payment Sunshine Act marks the first Congressional involvement in the regulation of disclosure related to pharmaceutical marketing. Overall, the Act improves transparency in pharmaceutical marketing to physicians and expands the regulation of disclosure of pharmaceutical marketing activities in important substantive ways. People respond to moral criticism of their speech by claiming that they were joking. In this paper, I develop a speech act analysis of the humor excuse consisting of a negative stage, in which the speaker denies he or she was making an assertion, and a positive stage, in which the speaker claims she or he was engaged in non-serious/humorous speech instead. This analysis, however, runs afoul of the group identity objection, according to which there is a moral distinction between (...) jokes targeting members of vulnerable groups made by members of those groups and similar jokes made by non-members. In order to avoid this objection, I offer a revision to the speech act analysis that draws upon Perry’s distinction between beliefs and belief-states. (shrink)

This essay examines the so-called phenomenon of defensive medicine and the problematic aspects of attempting to maintain the safest legal position possible. While physicians face genuine litigation threats they frequently overestimate legal peril. Many defensive practices are benign, but others alter patient care and increase costs in ways that are ethically suspect. Physicians should learn to evaluate realistically the legal risks of their profession and weigh the emotional, physical, and financial costs to the patient before employing a defensive measure.

Bergson Professeur rassemble les actes d'un colloque international qui s'est tenu a Paris, a l'Ecole Normale Superieure, en novembre 2010. On y trouve les contributions des meilleurs bergsoniens contemporains sur un theme habituellement peu traite : le role exact des cours de Bergson et des notes de cours relativement a ses ouvrages publies. Ce volume vient ainsi combler un manque dans les publications academiques sur Bergson, puisqu'il permet de restituer, dans le sillage des travaux engages il y a deux (...) decennies par Henri Hude, ce qui est trop souvent considere comme la part la moins importante de sa philosophie. En tentant de faire entendre de nouveau la voix vivante du professeur Bergson, ce travail ne rend donc pas seulement un hommage au maitre admire par tous ses auditeurs, il nous fait entrer, comme par effraction, dans l'atelier ou, a n'en pas douter, furent mises au point plusieurs des grandes trouvailles d'un genie philosophique.
