One debate that occupied Pratyabhijñā philosophers and their Buddhist interlocutors was the question of the reality of _sambandha_, or relation. A central treaty on the topic is Utpaladeva’s (∼10th c.) _Sambandhasiddhi_ [SS] (‘_Proof of Relation_’), a response to Dharmakīrti’s (∼7th c.) _Sambandhaparīkṣā_ [SP] (‘_Analysis of Relation_’). As the contrasting titles suggest, Dharmakīrti held that relations are merely conceptual constructions (_kalpanā_), inferred _post hoc_ from discrete perceptual cognitions (_pratyakṣa_)—and thus ultimately _unreal_. Utpaladeva, on the other hand, attempted to ‘prove’ (_siddhi_) the (...) truth (_satya_) of relation as a genuine ‘division-non-division,’ or ‘unity-in-diversity’ (_bhedābheda_). In this article, I reconstruct Utpala’s ‘proof’ as a pragmatic argument to the effect that Dharmakīrti, in virtue of his nominalist metaphysics, mistakenly treats the general form of relation as an inferential _concept_, rather than the mode of ‘intentional’ _action_ (_śakti_) manifest in reflexive judgment (_vimarśa_). In doing so, Utpala suggests that Dharmakīrti inadvertently renders the relational conditions for the recognition of determinate intentional content unintelligible. (shrink)

Some properties are discussed of regular polygons that may result from angular homeostatic processes in stable orbit. To characterize these homeostatic polygons we need to discuss the winding number, the sidedness (integer, fractional and irrational), multiplicity, envelopes, and density. A regular (i.e., equilateral, equiangular) polygon may be closed in one revolution about its unique center, in multiple revolutions, or not at all. A homeostatic polygon can be generated only if all vertices are included in a single polygon, which occurs if (...) and only if the number of vertices and the number of revolutions required to complete the polygon are relatively prime. For the homeostatic polygon to have a finite number of sides (without repeating itself) the angle subtended by any two successive vertices at the center must be a rational multiple of 2. In dem Buch ‘Rationalität in der Angewandten Ethik’, in dem sich verschiedene Autoren die Aufgabe gestellt haben, diese Umstände in das Licht der Betrachtung zu rücken, finden wir Fragen darüber, wie “Moral”, “Angewandte Ethik” und “Vernunft” (auch in der Anwendung) zu verstehen und zu vereinen sind.

We investigate 1 factor that influences the success of ideas or cultural representations by proposing that they have a habitat, that is, a set of environmental cues that encourages people to recall and transmit them. We test 2 hypotheses: (a) fluctuation: the success of an idea will vary over time with fluctuations in its habitat, and (b) competition: ideas with more prevalent habitats will be more successful. Four studies use subject ratings and data from newspapers to provide correlational support for (...) our 2 hypotheses, with a negative factoid, positive rumor, catchphrases, and variants of a proverb. Three additional experimental studies manipulate the topic of actual conversations and find empirical support for our theory, with catchphrases, proverbs, and slang. The discussion examines how habitat prevalence applies to a more extensive class of ideas and suggests how habitats may influence the process by which ideas evolve. (shrink)

The formal properties of orbits in a plane are explored by elementary topology. The notions developed from first principles include: convex and polygonal orbits; convexity; orientation, winding number and interior; convex and star-shaped regions. It is shown that an orbit that is convex with respect to each of its interior points bounds a convex region. Also, an orbit that is convex with respect to a fixed point bounds a star-shaped region.Biological considerations that directed interest to these patterns are indicated, and (...) the implications of the prospect of higher orders of star-shapedness mentioned. One obvious result of DNA exonerations has been the enactment of legislation regulating postconviction DNA testing. But the impact on our criminal justice system goes beyond formal statutory change. The DNA exonerations are changing attitudes towards the death penalty, are focusing attention on how forensic laboratories operate, and are leading to the stricter scrutiny of forensic science.

Can one be fooled into believing that one intended an action that one in fact did not intend? Past experimental paradigms have demonstrated that participants, when provided with false perceptual feedback about their actions, can be fooled into misperceiving the nature of their intended motor act. However, because veridical proprioceptive/perceptual feedback limits the extent to which participants can be fooled, few studies have been able to answer our question and induce the illusion to intend. In a novel paradigm addressing this (...) question, participants were instructed to move a line on the computer screen by use of a phony brain–computer interface. Line movements were actually controlled by computer program. Demonstrating the illusion to intend, participants reported more intentions to move the line when it moved frequently than when it moved infrequently. Consistent with ideomotor theory, the finding illuminates the intimate liaisons among ideomotor processing, the sense of agency, and action production. (shrink)

This study investigated the attitudinal responses of 403 undergraduate students with respect to nine hypothetical marketing moral dilemmas. Participants varied by gender, major, and age.It was found that undergraduate women responded more ethically on the hypothetical marketing moral dilemmas, as hypothesized. Secondly, chosen major did not make a difference on cognitive, affective, or behavioral responses. Further, the overall means for each scenario were in the morally correct direction in every case. Also, all intercorrelations for each story were significant. Finally, whenever (...) there was a nonchance finding for age, the oldest participants answered more morally than the youngest subjects. Does cross-cultural philosophy stand in need of a hermeneutical expansion? In engaging with this question, the symposium focuses upon methodological issues salient to cross-cultural inquiry. Douglas L. Berger lays out the ground for the debate by arguing for a methodological approach, which is able to rectify the discipline’s colonial legacies and bridge the hermeneutical distance with its objects of study. From their own perspectives, Hans-Georg Moeller, Paul Roth and A. Raghuramaraju analyze whether such a processual and hermeneutically-sensitive approach can indeed (...) open up new hermeneutic horizons. Their responses shed light upon cross-cultural philosophy’s continued embedment in Euroamerican professional philosophy and how the locality of its knowledge-seeking endeavors may indeed have repercussions on attempts to bridge temporal and spatial distances. According to Rosenthal's higher-order thought (HOT) theory of consciousness, one is in a conscious mental state if and only if one is aware of oneself as being in that state via a suitable HOT. Several critics have argued that the possibility of so-called targetless HOTs—that is, HOTs that represent one as being in a state that does not exist—undermines the theory. Recently, Wilberg (2010) has argued that HOT theory can offer a straightforward account of such cases: since consciousness is a (...) property of mental state tokens, and since there are no states to exhibit consciousness, one is not in conscious states in virtue of targetless HOTs. In this paper, I argue that Wilberg's account is problematic and that Rosenthal's version of HOT theory, according to which a suitable HOT is both necessary and sufficient for consciousness, is to be preferred to Wilberg's account. I then argue that Rosenthal's account can comfortably accommodate targetless HOTs because consciousness is best understood as a property of individuals, not a property of states. (shrink)

BACKGROUND: Little is known about how hospitalized patients share decisions with physicians. METHODS: We conducted an observational study of patient-doctor communication on an inpatient medicine service among 18 hospitalized patients and 9 physicians. A research assistant (RA) approached newly hospitalized patients and their physicians before morning rounds and obtained consent. The RA audio recorded morning rounds, and then separately interviewed both patient and physician. Coding was done using integrated analysis. RESULTS: Most patients were white (61%) and half were female. Most (...) physicians were male (66%) and of Southeast Asian descent (66%). All physicians explained the plan of care to the patients; most believed that their patient understood. However, many patients did not. Physicians rarely asked the patient for their opinion. In all those cases, the decision had been made previously by the doctors. No decisions were made with the patient. Patients sometimes disagreed. CONCLUSIONS: Shared decision-making may not be the norm in hospital care. Although physicians do explain treatment plans, many hospitalized patients do not understand enough to share in decisions. When patients do assert their opinion, it can result in conflict. PRACTICE IMPLICATIONS: Some hospitalized patients are interested in discussing treatment. Improving hospital communication can foster patient autonomy. (shrink)

For decades Japan and the Federal Republic of Germany have gone to extraordinary lengths to cultivate as low a profile as possible on defense and national security policy matters. However, since the Gulf War, the Federal Republic has come under growing pressure from its allies to assume a greater international security role. Slowly, reluctantly it has acceded to these demands, albeit at the expense of considerable internal angst and turmoil. At the same time, German decision makers have sought to preserve (...) as much as possible the old approach to security policy. Consequently, the long-standing German norms eschewing the use of military force have been gradually displaced, although not wholly replaced, by norms of multilateralism. Rather than a dramatic break with the past, the Federal Republic's actions in Kosovo and Afghanistan can be seen as the culmination of a series of incremental steps that had begun a decade ago. An estimated 700,000 people in the United States have "long COVID," that is, symptoms of COVID-19 persisting beyond three weeks. COVID-19 and its long-term sequelae are strongly influenced by social determinants such as poverty and by structural inequalities such as racism and discrimination. Primary care providers are in a unique position to provide and coordinate care for vulnerable patients with long COVID. Policy measures should include strengthening primary care, optimizing data quality, and addressing the multiple nested domains of inequity.

Periods of transition are often symbolically associated with death, making the latter the paradigm of liminality. Yet, many volumes on death in the social sciences and humanities do not specifically address liminality. This book investigates these "ultimate ambiguities," assuming they can pose a threat to social relationships because of the disintegrating forces of death, but they are also crucial periods of creativity, change, and emergent aspects of social and religious life. Contributors explore death and liminality from an interdisciplinary perspective and (...) present a global range of historical and contemporary case studies outlining emotional, cognitive, artistic, social, and political implications. L. M. de Rijk supposed in 1982 that two anonymous logical tracts in the Viennese Codex 4698, fol. 18r–27v, may be the work of Martinus Anglicus to whom a tract on consequences and one on obligations are ascribed in that codex. The tract on supposition of which the Viennese codex hands down only a fragment of the beginning is contained completely in Hs I 613 of the Stadtbibliothek Mainz, fol. 20vb–21vb. This finding ensures the authorship of Martinus Anglicus and allows (...) to ascribe an Introduction into Logic in some seven parts to him. Martin’s tract on supposition and the more detailed one by Thomas Manlevelt show some resemblances in structure and content, the first being presumably the later one. This paper presents an edition of Martin’s Tractatus de suppositione from the Mainz manuscript and an introduction regarding the author and his work. (shrink)

A critical examination of Susan Blackmore’s psi experiment database was undertaken to assess the claims of consistent “no ESP†across these studies. Many inconsistencies in the experimental reports were found, and their serious consequences are discussed. Discrepancies were found between the unpublished experimental reports and their published counterparts. “Flaws†were invoked to dismiss significant results while other flaws were ignored when studies produced nonsignificant results. Experiments that were admittedly flawed in the unpublished reports were mixed with supposedly unflawed studies and (...) published without segregation, creating the impression of methodological soundness. Two instances in which study chronology was reordered were found. Overall, it is concluded that Blackmore’s claims that her database shows no evidence of psi are unfounded, because the vast majority of her studies were carelessly designed, executed, and reported, and, in Blackmore’s own assessment, individually flawed. As such, no conclusions should be drawn from this database. (shrink)

The ‘best interests’ decision making standard is used in clinical care to make necessary health decisions for non-capacitated individuals for whom neither explicit nor inferred wishes are known. It has been also widely acknowledged as a basis for enrolling some non-capacitated adults into clinical research such as emergency, critical care, and dementia research. However, the best interests standard requires that choices provide the highest net benefit of available options, and clinical research rarely meets this criterion. In the context of modern (...) norms of bioethics, the best interests standard rarely supports surrogate consent for research and should not be accepted as a routine provision. (shrink)

The emergence of post-conviction DNA testing has had profound effects on the American criminal justice system. Although changes in the formal legal landscape are readily noticeable, the DNA exonerations have also produced other consequences that may have potentially more significance. To comprehend and assess the influence of post-conviction DNA testing one must examine more than just the law on the books. After some introductory material, Part I of this essay looks at repercussions DNA exonerations are having on the basic operation (...) of the criminal justice system, Part II examines new statutes that govern procedures for post-conviction DNA testing requests, and Part III briefly considers how these current developments may affect Supreme Court jurisprudence.Post-conviction DNA testing has evolved in little more than a decade. Before 2000, only two states, New York and Illinois, had statutes that authorized post-conviction DNA testing. In other jurisdictions, no formally authorized procedures existed that allowed inmates to make requests for DNA testing of crime scene evidence. (shrink)

This paper proposes a reading of Kelsen’s basic norm based on Kant’s regulative ideas. I begin by exposing Kant’s conception of the principles of reason. Then I criticize an interpretation of the basic norm along the same lines made by Stanley Paulson. Thirdly I analyze two theses from Hermann Cohen that influenced Kelsen greatly and reinforce my stance on the basic norm. Lastly, I explain how the Kelsenian tenet that the basic norm is the transcendental grounding of the normativity of (...) law can be comprehended based on the role the ideas of reason play in the systematization of knowledge. Neoclassical economic theory assurnes that people pursue utility maximization within an obiective framework, evident to all, that serves as the basis for the interaction. Agents are assumed to be detached observers who see the situation as it is in obiective reality. It is argued in this article that there is no obiective ground for interaction that exists apart from the understanding of economic agents. Agents have orientations that change over time depending on the way that the situation is currently understood. (...) Depth of understanding and the extent of common ground depend on the quality of attention and the will to openness and honesty. Efforts to maintain connections with others make possible mutual understanding and visions of the common good that enable the coordinated pursuit of desired states of the world. (shrink)
