Quite different from translation for general purposes, transplanted legal discourse is often unmatchable to the target discourse community. In reality, exact equivalence could not be found in terms of translation in legal transplant, which means the major task of translation in legal transplant is to solve lacunae, discursive gaps between the source text and the target text. In legal translation, a lacuna seems to constitute a factor of untranslatability. This paper, based on a study of four cases, argues that equivalence (...) can be achieved within the proposed Translational Triangle. The sociosemiotic approach is adopted in this study to explore the complexity in legal translation, and provide insights into legal translation, both theoretically and practically. (shrink)

BackgroundThe triangle completion test has been used to assess egocentric wayfinding for decades, yet there is little information on its reliability. We developed a virtual reality based test and investigated whether either test of spatial navigation was reliable.ObjectiveTo examine test-retest reliability of the real-world and VR triangle completion tests. A secondary objective was to examine the usability of the VR based test.Materials and methodsThirty healthy adults aged 18–45 years were recruited to this block randomized study. Participants completed two (...) sessions of triangle completion tests in the real-world and VR on the same day with a break between sessions.ResultsIn both test versions distance from the endpoint and angle of deviation showed poor test-retest reliability. Distance traveled had moderate reliability in both the real-world and VR tests. The VR triangle test showed poor correlation with the real-world test.ConclusionThe triangle completion test has poor test-retest reliability and demonstrates poor concurrent validity between the real-world and VR. Nevertheless, it was feasible to translate a real-world test of spatial navigation into VR. VR provides opportunities for development of clinically relevant spatial navigation tests in the future. Apart from few exceptions to be mentioned shortly, the translations of the Timaeus, which I am aware of spanning the period from the second half of the nineteenth century up to recent times, have usually rendered this passage as meaning that such an elementary triangle is that which, when two are combined, the equilateral (...) triangle forms as a third figure. For instance, Bury and Zeyl respectively translate: out of which, when two are conjoined, the equilateral triangle is constructed as a third. and from [a pair of] which the equilateral triangle is constructed as a third figure. Ṣāliḥ bin ʿAbd al-Quddūs of Persian origin was born in Basra, the crossroad of religions and teachings with its socio-cultural, scientific and intellectual structure. He grew up in a family that values religion, politics and literature. Rich scientific background and cross-cultural integration of Basra significantly influenced his scientific and intellectual development. However, in historiographical sources, he is an intellectual who has come to the fore with his literary identity. His ‘sectarian’, ‘political’, ‘wise’ (ḥikami), ‘didactic’ and 'gnomic' poems form the main (...) theme of his literary writings. Various titles have been attributed to him by the authors of history and biography. "Master of poets, street preacher, storyteller, theologian and philosopher" are a number of them. Before the translation of philosophical works, he became one of the important representatives of the 'literary theology', the dialectical technique of the period. Thus, besides his poetic and literary identity, he is mentioned as one of the six theologians of Basra. Over time, he was able to attract the attention of the political power with his theoretical and literary works for both theo-political and social adjustment. However, he was not understood adequately, and his poems did not attract the necessary attention since philosophical/wise expressions were widely found in them. In his poems, it is possible to see every tone of hope and hopelessness. He reflects hope, rights, justice, equality, freedom, moral virtues, but more often; despair, death, transience of the world, ascetism and distancing from people. For this reason, he is also referred to as the "poet of despair." From this point of view, his call to the life of ascetism was interpreted as dualism. The opinions of Ṣāliḥ calling for social adjustment, justice and equality were perceived as a threat by the political authority and he was killed with the accusation of heresy. Although it is generally accepted that he was executed due to heresy, there is much speculative information about the subject. Of two examples are that he subjected to ethnic discrimination due to his Persian origin, and that he was a philosopher of dualism and a follower of Manichaeism. However, the reason for the murder of Ṣāliḥ was neither his theological choice nor ethnic origin. His poetry, which motivated social morality, intellectual development, freedom and social enlightenment, turned him into a threat to the political power. It would appear that his opposition to Arab nationalism and privilege in the ranks of Šuʿūbiyya, a populism movement and his demand that justice and equality should spread throughout all layers of society, caused political prosecution. In this process, the rule chose the easiest way to silence any opposing voice by implementing the accusation of heresy. The concept of heresy, especially with the Abbasids, quickly turned away from its religious concerm and changed into a political notion. As a result, academic discussions conducted at the scientific and intellectual level in Basra were moved to a practical arena by politics, and the dose of criticism and violence increased. First of all, with its scientific and bureaucratic elements, the state embarked on an intellectual and actual struggle with heretical teachings, which aims to distort the essential principles of Islam by dissimulation (taqīyya). Although this political attitude towards heresy, which aims to break down Islamic values, can somehow be considered reasonable, the area of accusation of heresy expanded in time; causing every opposing movement to be evaluated within this scope. However, when the main theme of his poems is examined, the first point, attracting attention is his call to believe in God, the truth of the hereafter, reckoning consciousness, responsibility, justice, equality, freedom, etc. In fact, referring to the Qur’ān and ḥadīth in his poems already proves that he was a Muslim. Nevertheless, his poems were sometimes interpreted and presented as an evidence of his heresy and whenever he was found stating the right, his statements were found invalid because of accusation of dissimulation. Considering all these facts, this article will make a logical consistency analysis of the information and narrations about Ṣāliḥ. It will also examine the validity of the accusations of heresy against him, based on his literary discourses, religious identity and political attitude. As a result, it will determine whether the negative (theological) attribution to him is really an accusation or truth by an analytical inference. (shrink)

The thesis of 3D/4D equivalence states that every three-dimensional description of the world is translatable without remainder into a four-dimensional description, and vice versa. In representing an object in 3D or in 4D terms we are giving alternative descriptions of one and the same thing, and debates over whether the ontology of the physical world is "really" 3D or 4D are pointless. The twins paradox is shown to rest, in relativistic 4D geometry, on a reversed law of triangle inequality. (...) But considering the twins as 3D beings who age through time, the paradox implies that time passes at different rates in different reference frames, and therefore that the concept of a single global or Absolute time is unsustainable. According to a grand narrative that long ago ceased to be told, there was a seventeenth century Scientific Revolution, during which a few heroes conquered nature thanks to mathematics. This grand narrative began with the exhibition of quantitative laws that these heroes, Galileo and Newton for example, had disclosed: the law of falling bodies, according to which the speed of a falling body is proportional to the square of the time that has elapsed since the beginning of its fall; the (...) law of gravitation, according to which two bodies are attracted to one another in proportion to the sum of their masses and in inverse proportion to the square of the distance separating them -- according to his own preferences, each narrator added one or two quantitative laws of this kind. The essential feature was not so much the examples that were chosen, but, rather, the more or less explicit theses that accompanied them. First, mathematization would be taken as the criterion for distinguishing between a qualitative Aristotelian philosophy and the new quantitative physics. Secondly, mathematization was founded on the metaphysical conviction that the world was created pondere, numero et mensura, or that the ultimate components of natural things are triangles, circles, and other geometrical objects. This metaphysical conviction had two immediate consequences: that all the phenomena of nature can be in principle submitted to mathematics and that mathematical language is transparent; it is the language of nature itself and has simply to be picked up at the surface of phenomena. Finally, it goes without saying that, from a social point of view, the evolution of the sciences was apprehended through what has been aptly called the "relay runner model," according to which science progresses as a result of individual discoveries. Grand narratives such as this are perhaps simply fictions doomed to ruin as soon as they are clearly expressed. In any case, the very assumption on which this grand narrative relies can be brought into question: even in the canonical domain of mechanics, the relevant epistemological units crucial to understanding the dynamics of the Scientific Revolution are perhaps not a few laws of motion, but a complex set of problems embodied in mundane objects. Moreover, each of the theses just mentioned was actually challenged during the long period of historiographical reappraisal, out of which we have probably not yet stepped. Against the sharp distinction between a qualitative Aristotelian philosophy and the new quantitative physics, numerous studies insist that Rome wasn't built in a day, so to speak. Since Antiquity, there have always been mixed sciences; the emergence of pre-classical mechanics depends on both medieval treatises and the practical challenges met by Renaissance engineers. It is indeed true that, for Aristotle, mathematics merely captures the superficial properties of things, but the Aristotelianisms were many during the Renaissance and the Early Modern period, with some of them being compatible with the introduction of mathematics in natural philosophy. In addition, the gap between the alleged program of mathematizing nature and its effective realization was underlined as most natural phenomena actually escaped mathematization; at best they were enrolled in what Thomas Kuhn began to rehabilitate under the appellation of the "Baconian sciences," i.e., empirical investigations aiming at establishing isolated facts, without relating them to any overarching theory. Hence, mathematization of nature cannot pretend to capture a historical fact: at most, it expresses an indeterminate task for generations to come. On top of these first two considerations, and against the thesis of the neutrality of the mathematical language, it was urged that mathematics is not "only a language" and that, exactly as other symbolic means or cognitive tools, it has its own constraints. For example, it has been thoroughly explained that the Euclidean theory of proportions both guides and frustrates the Galilean analysis of motion; its shortages were particularly clear with respect to the expression of continuity, which is crucial in the case of motion. Consequently, when calculus was invented and applied to the analysis of motion, it was not a transposition that left things as they stood. Even more clearly than in the case of a translation from one natural language to another, the shift from one symbolic language to another entails that certain possibilities are opened while others are closed. The cognitive constraints imposed by established mathematical theories, as seen in the theory of proportions or calculus, were not the only ones to be studied in relation to mathematization. Certain schemes dependent on the grammar of natural languages, e.g., the scheme of contrariety, or certain symbolic means of representation, e.g. geometrical diagrams and numerical tables, were also subject to such scrutiny. Lastly, it was insisted that, even if we concede the existence of scientific geniuses, mathematics is largely produced by intellectual communities and embedded within social practices. More attention was consequently paid to the forms of communication in given mathematical networks, or to the teaching of the discipline in, for example, Jesuit colleges and universities. The set of mathematical practices specific to specialized craftsmen, highly-qualified experts and engineers began to be studied in its own right. All these reflections may have helped us change our perspectives on the question of mathematization. It seems, however, that they were instead set aside, both because of a general distrust towards sweeping narratives that are always subject to the suspicion that they overlook the unyielding complexity of real history, and because of a shift in our interests. The more obscure and idiosyncratic they are, an alchemist, a patron of the sciences or a lunatic collector is nowadays honored in journals of the history of sciences. As for the general issues involved in the question of mathematization, they are rejected as obsolete, or reserved for specialized journals in the history of mathematics. Consequently, before presenting the essays of this fascicle, I would like to say a few words in favor of a renewed study of the forms of mathematization in the history of the early sciences. While claiming that diagrams can only be admitted as a method of strict proof if the underlying axioms are precisely known and explicitly spelled out, Hilbert praised Minkowski’s Geometry of Numbers and his diagram-based reasoning as a specimen of an arithmetical theory operating “rigorously” with geometrical concepts and signs. In this connection, in the first phase of his foundational views on the axiomatic method, Hilbert also held that diagrams are to be thought of as “drawn formulas”, and formulas as “written (...) diagrams”, thus suggesting that the former encapsulate propositional information which can be extracted and translated into formulas. In the case of Minkowski diagrams, local geometrical axioms were actually being produced, starting with the diagrams, by a process that was both constrained and fostered by the requirement, brought about by the axiomatic method itself, that geometry ought to be made independent of analysis. This paper aims at making a twofold point. On the one hand, it shows that Minkowski’s diagrammatic methods in number theory prompted Hilbert’s axiomatic investigations into the notion of a straight line as the shortest distance between two points, which start from his earlier work focused on the role of the triangle inequality property in the foundations of geometry, and lead up to his formulation of the 1900 Fourth Problem. On the other hand, it purports to make clear how Hilbert’s assessment of Minkowski’s diagram-based reasoning in number theory both raises and illuminates conceptual compatibility concerns that were crucial to his philosophy of mathematics. This book contains English translations of nearly all Frege's published writings other than Begriffsschrift, Grundlagen, and Grundgesetze. The works translated are selected from Kleine Schriften. About thirty percent of Collected Papers has never appeared in English before. This includes Frege's Göttingen dissertation, "On a Geometrical Representation of Imaginary Forms in the Plane", and his Jena Habilitationsschrift, "Methods of Calculation based on an Extension of the Concept of Quantity". Also translated for the first time are six brief reviews of mathematical works, (...) a reply to Cantor's review of Grundlagen, two short mathematical lectures: "Lecture on a Way of Conceiving the Shape of a Triangle as a Complex Quantity" and "Lecture on the Geometry of Pairs of Points in the Plane", and a satire, "On Mr. H. Schubert's Numbers". Everything else in Collected Papers has appeared in English before in various journals and books. Frege's only published works not translated here are three explanations of Begriffsschrift and a short lecture, "Ueber den Briefwechsel Leibnizens und Huygens mit Papin", which apparently has not been translated into English. Thus, with the exception of the complete Grundgesetze, the publication of this book, together with The Foundations of Arithmetic, Conceptual Notation, Philosophical and Mathematical Correspondence, and Posthumous Writings, makes almost all Frege's known surviving work, both published and unpublished, available in English. Tripura Upanishad is a minor Shakta or Tantra Upanishad explaining the structure of and meditation on Sri Chakra or Sri Yantra—a diagrammatic representation of the universe through nine interlocking triangles coming out of a central point. To date, there are two English translations of this Upanishad. The first and the earliest, by A G Krishna Warrier done in 1967, is a verse translation and because of the obvious constraints of such translation, fails to explain the intricacies and implied meanings of (...) this cryptic Upanishad. The second translation done many years later, is by Douglas Renfrew Brooks, who has also beautifully translated the commentary on this Upanishad by Bhaskararaya in the book 'The Secret of the Three Cities' published by the University of Chicago Press in 1990. While maintaining a high level of accuracy and bringing out the intricate nuances of this Upanishad, the emphasis of Brooks' translation seems to be more on the geometrical aspects of the Sri Chakra. In this book, the authors provide a clear range of views to explain the complexity of policy development and its future implementation, embracing factors such as social context, economic condition, political evolution, assessment, and research, as well as diverse populations including academics, principals, school teachers, parents, and students. The epistemological foundations of cultural and social anthropology -a relation established between a set (...) of native cultural phenomena and our own academic culture- can be seen in terms of translation. If I utter the sentence: Hitler caused the outbreak of the second world war, some interested logician may translate my sentence into the words: Hitler necessitated the outbreak of the second world war, If that translation be made I do not accept it, unless the dragoman makes it clear to me that by the word “necessitate” he means nothing more than I mean by the word “cause.” In which case I can dispense with his services. But if he is embodying (...) in his translation the thought that the outbreak of war followed from the existence of Hitler at a given moment of time, as the equality of the angles in a triangle follows from the equality of the sides, then I repudiate his translation, because I do not agree that a statement or proposition such as event x caused event y is a hypothetical proposition of the type if x then y. The twelfth century was a period of transmission and absorption of Arabic learning though it filtered outside of the Arabic world as early as the second half of the tenth century. In general, the lure of Spain began to act only in the twelfth century, and the active impulse toward the spread of Arabic mathematics came from beyond the Pyrenees and from men of diverse origins. The chief names are Adelard of Bath, Robert of Chester, Hermann of Carinthia and Gerard (...) of Cremona. In this time the Latin world became acquainted with the Hindu numerals, the Arabic Algebra and Euclid'sElements. However, not only Spain, but also the Norman kingdom of southern Italy and Sicily occupies a position of peculiar importance, though the works of the translators did not become very influential. There were made direct translations from Greek into Latin. One had to wait a century more to obtain a translation from Greek into Latin of the chief Archimedean scientific and mathematical treatises by William of Moerbeke. In the thirteenth century Fibonacci and Jordanus Nemorarius stand at the threshold of European mathematics. Not only was Fibonacci the first to explain Arabic arithmetic, but his works, especially his later ones, contain many original ideas. Jordanus continued the Greco-Roman tradition rather than the Greco-Arabic one, but he did so with much independence. To Nicole Oresme (fourteenth century) was due a broadened view of proportionality, a geometric proof to determine the summation of convergent infinite series and the proof, evidently the first in the history of mathematics, that the harmonic series is divergent. Meaning in life has been widely recognized as a hallmark of psychological well-being and positive youth development. The goal of this study was to validate the Korean version of the Meaning in Life in Children Questionnaire utilizing the framework suggested by the Standards for Educational and Psychological Testing. Data were obtained from 277 fifth graders aged 10–11 in three elementary schools in Seoul and Gyeonggi through a paper-and-pencil survey. We translated the MIL-CQ, a 21-item self-report measure developed based on Frankl’s (...) “meaning triangle,” into Korean. Psychological well-being measures were also assessed. Validity and reliability data were collected. The content of domains and items was appropriate for measuring MIL among children. A three-factor model consisting of attitude, creativity, and experience pathways was extracted via exploratory factor analysis, and a three-factor hierarchical model including attitude, creativity, and experience as first-order factors and MIL as a second-order factor was confirmed via confirmatory factor analysis. Higher levels of MIL were related to higher levels of satisfaction with life, self-esteem, positive affectivity, and lower levels of negative affectivity. All item fit statistics were acceptable based on the Rasch model. The analysis of the measurement invariance of each item showed that the responses to one item varied by gender, suggesting that additional items might facilitate better measurement of MIL in children. This study provides validity and reliability evidence that K-MIL-CQ is appropriate for measuring MIL among South Korean elementary school students. (shrink)

Some theorists (such as Kristeva) accept the notion of an unalterable Lacanian Symbolic, while others (such as Irigaray) maintain that the current Symbolic is a manifestation of male fantasy, and suggest that feminist (...) thinkers explore the possibility of reorganizing the Symbolic. Amber Jacobs, in her recent work On Matricide (2007), takes up this challenge by analyzing matricide in myth in order to reveal matricide as latent content untheorized within psychoanalysis. Jacobs claims that the structure of the Lacanian Symbolic illegitimately asserts the "law of the father" as the only possible law, excluding any possibility of a "law of the mother" by erasing the maternal role in theory and symbolization. Her project, following Irigaray, is to make visible those unconscious contents excluded by the patriarchal imaginary in order to "be able to intervene into psychoanalysis for the purpose of working toward theorization of unconscious structures that are not reducible to the structure of Oedipus alone" (Jacobs 2007, x). If Jacobs's suggestion is correct, then analysis of Freud's evidence for the Oedipus Complex (and its accompanying concepts) will reveal repressed contents and traces of these untheorized unconscious structures—particularly those associated with the maternal body.With these considerations in mind, I take up the Freudian case of Little Hans, where Freud finds his most seminal evidence for castration anxiety [End Page 158] and the Oedipus Complex. I will demonstrate Freud's systematic occlusion of the maternal body through his overvaluation of the male body/the phallus in order to expose the elements of male fantasy that construct the Oedipus Complex. I organize these psychical elements in a configuration called "The Medusa Complex," since Freud uses the image of Medusa to explain his theory of castration. In rereading the details of this case, a powerful male fantasy begins to emerge: the desire to appropriate the female generative power. This is achieved through the theory of castration, which the decapitation of Medusa symbolizes, and the unconscious wish for male parthenogenesis—one product of this wish is the Lacanian Symbolic structure, where only the male principle of the phallus is generative. The Medusa Complex is comprised of the two intertwined male fantasies of female castration and male parthenogenesis, as well as the associated resistances that result from initiation into this paradigm. The theory of castration and the Oedipus Complex are attempts to conceal the powerful maternal body and assert male superiority and dominance.In the case of Little Hans, "Analysis of a Phobia in a Five Year Old Boy" (1909), Little Hans develops a fear of horses (especially biting horses) and is afraid to go out into the street. Hans's treatment is undertaken by his father, a medical doctor, who keeps careful notes and acts under Freud's supervision (mostly via letters). The boy's phobia begins around the time his little sister Hanna is born, as Freud and the father eventually admit, though her role in their narrative is nonexistent.1 They interpret Hans's phobia as a classic Oedipal triangle in which he desires his mother and fears the hostility of his father; his fear is translated into fear of the castrating father. Throughout the case, Freud and the father emphasize the boy's alleged awe of the adult male genital organ. In this paper, I will revisit the case (preserved in careful detail by the boy's father) and systematically return the maternal body to its rightful place within the narrative, shifting both the structure and the meaning of the phobia.I am here reading the case as an example of manifest content—like the surface content of a dream—in order to expose the male desires that create it. The current Symbolic is essentially a dream of the male imaginary, and my method is to reveal the latent content of the dream, especially the fantasies that inform it. New Haven and London: Yale University Press, 1986. Pp. 131. $12.95. This is not a new work. As Umberto Eco himself states in the Preface of this book, the text was written in 1958 and published in 1959 as a single chapter of a four volume handbook on the history of aesthetics, written by various authors (Momenti e problemi di storia dell' estetica, Milano, Marzorati, 1959, vol. 1: 'Dall'antichita classica al barocco, pp. 115-230). No doubt it was due to the recent popularity in Europe and America of Mr. Eco's novel, The Name of the Rose (which subsequently inspired the film of the same title) that Yale University Press saw fit to translate and reissue this seminal work of the author. He wrote it when he was 26 years old and serving in the Italian army. Hugh Bredin, a senior lecturer in scholastic philosophy at Queen's University, Belfast, has simplified in the translation what the author claims was the "tortured syntax" of his impressionable youth. Nevertheless, one suspects that the style and context of this slim volume will appeal primarily to philosophers and not art historians, despite its ubiquitous presence in art bookstores and museum giftshops. The scope of Mr. Eco's work enables the reader to gain an overview of aesthetic problems which developed in Europe in the period between the sixth to the :fifteenth centuries, when the classical tradition inherited by the medieval world no longer provided adequate solutions. A thousand years of artistic and philosophical history are barely penetrated in so few pages, but Mr. Eco forthrightly proceeds to catalogue ideas and thinkers in chapters devoted to such topics as Transcendental Beauty, Symbol and Allegory, and the Aesthetics of Proportion and Light. As 18~ BOOK REVIEWS was evident in The Name of the Rose, the author has an encyclopedic knowledge of both classical and medieval sources (he gently chides Maritain for his ignorance of one of Bonaventure's definitions of beauty, p. 24). As professor of semiotics his understanding of words and images is impressive (he takes a whole page to explain the visual applications of Vitruvius's use of the word euritmia, pp. 65-66). But after repeated eitings of relevant quotations from various medieval works-some in outright conflict with one another-the reader has no satisfying sense of what was the "medieval " view of art and beauty. Rather a mosaic of interesting and diverse facts emerges in the thematic structure of the book which cuts across chronological, geographical, and cultural boundaries. Thus, for instance, one learns in the chapter on the Aesthetics of Light that St. Augustine preferred equilateral to scalene triangles, Hugh of St. Victor considered green to be the most beautiful of colors, the Limbourg brothers in painting miniatures had no use for sfiirnatura just as Chretien de Troyes had no use for it in literature, and the Christian image of God as Light traced its pedigree to the Semitic Baal and the Egyptian Ra with heavy doses of Plato and Arab pantheism thrown in as contributing influences. This dizzying effect of so much intelligent trivia, forcibly pieced together in an effort to arrive at a persuasive conclusion, backfires and ultimately works ag:iinst Art and Beaiity in the Middle Ages in much the same way that the plot in The Name of the Rose suffered from a surfeit of scholastic argumentation. Mr. Eco, in an attempt to bedazzle his readers with facts, merely blinds them to the point. Other authors have written about art in the Middle Ages, and they were successful... (shrink)

The shift towards "empirical bioethics" was largely triggered by a recognition that stakeholders' views and experiences are vital in ethical analysis where one hopes to produce practicable recommendations. Such perspectives can provide a rich resource in bioethics scholarship, perhaps challenging the researcher's perspective. However, overreliance on a picture painted by a group of research participants—or on pre‐existing literature in that field—can lead to a biased view of a given context, as the subjectivity of data generated in these ways cannot (and (...) should not wholly) be escaped. In response, we propose the implementation of a complementary approach of ethno‐immersion in bioethics research. By positioning oneself in the context being researched, the researcher can better understand the realities of that context. The researcher's understanding will, naturally, be subjective too. However, it will act as a better developed and more informed outsider view, when considering the picture painted by participants and previous studies, thus enabling the researcher to introduce more nuance when analysing data. We introduce this approach after examining what we call the context detachment problem, whereby some bioethics scholarship—empirical or otherwise—fails to reflect the reality of the healthcare setting it concerns. Our proposed ethno‐immersion (which differs from formal ethnography) is then explored as a response, highlighting its benefits, and answering the question of timing within a research project. Finally, we reflect on the applicability of our proposal to non‐empirical bioethics scholarship, concluding that it remains important but may require some adjustments. (shrink)

The basic problem affecting humanitarian law today remains that of its implementation. As of now, requests made by individuals before national courts to assess the compatibility of certain acts with international humanitarian law failed. The present case study and commentaries focus on the decision of a German civil court sitting Bonn to deny the victims of a NATO air raid the right to sue Germany and claim compensation for alleged violations of international humanitarian law.

In 1813 Isaak von Sinclair published a poem entitled “The New Acquaintance.” It recounts a meeting between himself, his friend Friedrich Hölderlin, and one other unidentified guest whom Sinclair awaited with keen anticipation. Because of Hölderlin’s well established friendship with Hegel it has been assumed in the past that the unknown acquaintance was in fact Hegel. However, at the time to which the poem refers, Hegel was a relatively obscure and unknown figure with no reputation. If we are therefore to (...) accept that the poem does indeed allude to Hegel then we must assume that Sinclair, as early as 1813, had recognized Hegel’s genius and wanted retrospectively to associate his name with the newly rising star of German philosophy. In that case we must ask why he refrained from mentioning Hegel by name or at least making the character of the unknown unambiguously clear? In translating this poem for the first time into English I offer for consideration another candidate as the “acquaintance,” namely, Wilhelm Heinse. (shrink)

How much violence can a society expect its members to accept? A comparison between the language theories of Julia Kristeva and Jacques Lacan is the starting point for answering this question. A look at the early stages of language acquisition exposes the sacrificial logic of patriarchal society. Are those forces that restrict the individual to be conceived in a martial imagery of castration or is it possible that an existing society critically questions those points of socialization that leave their members (...) in a state of homelessness? The label ‘Translational Research’ (TR) has become ever more popular in the biomedical domain in recent years. It is usually presented as an attempt to bridge a supposed gap between knowledge produced at the lab bench and its use at the clinical bedside. This is claimed to help society harvest the benefits of its investments in scientific research. The rhetorical as well as moral force of the label TR obscure, however, that it is actually used in very different ways. (...) In this paper, we analyse the scientific discourse on TR, with the aim to disentangle and critically evaluate the different meanings of the label. We start with a brief reconstruction of the history of the concept. Subsequently, we unravel how the label is actually used in a sample of scientific publications on TR and examine the presuppositions implied by different views of TR. We argue that it is useful to distinguish different views of TR on the basis of three dimensions, related to (1) the construction of the ‘translational gap’; (2) the model of the translational process; and (3) the cause of the perceived translational gap. We conclude that the motive to make society benefit from its investments in biomedical science may be laudable, but that it is doubtful whether the dominant views of TR will contribute to this end. Background: Patients undergoing invasive neurosurgical procedures offer researchers unique opportunities to study the brain. Deep brain stimulation patients, for example, may participate in research during the surgical implantation of the stimulator device. Although this research raises many ethical concerns, little attention has been paid to basic studies, which offer no therapeutic benefits, and the value of patient-participant perspectives.Methods: Semi-structured interviews were conducted with fourteen individuals across two studies who participated in basic intraoperative research during their deep brain stimulator surgery. Interviews (...) explored interpretations of risks and benefits, enrollment motivations, and experiences of participating in awake brain research. Reflexive thematic analysis was conducted.Results: Seven themes were identified from participant narratives, including robust attitudes of trust, high valuations of basic science research, impacts of the surgical context, and mixed experiences of participation.Conclusion: We argue that these narratives raise the potential for a translational misconception and motivate intraoperative re-consent procedures.
