La crise de 2008 a jeté un coup de projecteur violent sur des pratiques contestables et collectivement nuisibles. Est-ce là toute la réalité de la finance? Est-ce une fatalité? La finance a un rôle central dans nos économies. Une finance au service de l'homme, et non pas centrée sur (...) elle-même, serait évidemment un idéal. Peut-on cependant avoir une finance orientée dans le bon sens sans se référer aux valeurs qui animent une société? Et que signifie être au service de l'homme, sinon avoir une conception définie du bien, et donc une forme de morale ou d'éthique? Ethique et finance : c'est par là qu'il faut commencer l'examen. Pour examiner la question de la façon la plus concrète possible, l'auteur aborde aussi la question de la banque et des marchés financiers, sans oublier la finance publique, et même le rôle du don. Misremembering is a systematic and ordinary occurrence in our daily lives. Since it is commonly assumed that the function of memory is to remember the past, misremembering is typically thought to happen because our memory system malfunctions. In this paper I argue that not all cases of misremembering are due to failures in our memory system. In particular, I argue that many ordinary cases of misremembering should not be seen as instances of memory’s malfunction, but rather as the normal result (...) of a larger cognitive system that performs a different function, and for which remembering is just one operation. Building upon extant psychological and neuroscientific evidence, I offer a picture of memory as an integral part of a larger system that supports not only thinking of what was the case and what potentially could be the case, but also what could have been the case. More precisely, I claim that remembering is a particular operation of a cognitive system that permits the flexible recombination of different components of encoded traces into representations of possible past events that might or might not have occurred, in the service of constructing mental simulations of possible future events. This study aims to examine the ethical decision-making model proposed by Schwartz, where we consider the factors of non-rationality and aspects that affect ethical judgments of auditors to make the decision to blow the whistle. In this paper, we argue that the intention of whistleblowing depends on ethical awareness and ethical judgment as well as there is a mediation–moderation due to emotion and perceived moral intensity of auditors. Data were collected using an online survey with 162 external auditors who worked (...) on audit firms in Indonesia as well as 173 internal auditors working in the manufacturing and financial services. The result of multigroup analysis shows that emotion can mediate the relationship between EAW and EJW. The nature of this relationship is more complex and then tested by adding moderating variables using consistent partial least squares approach. We found that EMT and PMI can improve the relationship between ethical judgments and whistleblowing intentions. These findings indicate that internal auditors are more likely to blow the whistle than external auditors; and reporting wrongdoing internally and anonymously are the preferred way of professional accountants to blow the whistle in Indonesia. En primer término, se estudia el modo en que este personaje, a partir de las referencias al castigo físico y a la pasividad sexual, es construido como un cuerpo subordinado al servicio de otros. Luego, se consideran sus apariciones como ladrón y como proveedor de placeres corporales. Proponemos que la forma en que los cocineros son representados en la palliata de Plauto pone en evidencia (...) el vínculo que la axiología republicana establece entre actores sociales subalternos, corporalidad y amenaza a los mores maiorum. This paper examines some characteristics of the coquus mask in the plautine corpus. First, we study how this character, from references to physical punishment and sexual passivity, is built as a subordinate body to the service of others. Then, we consider his appearances as a thief and a provider of bodily pleasures. We propose that the way cooks are represented in Plautus' palliata shows us the link established by Republican axiology between subaltern social actors, body and threat to mores maiorum. (shrink)

This article describes and proposes the “environmental subsidiarity principle” as a guiding ethical value in forestry governance. Different trends in environmental management such as local participation, decentralization or global governance have emerged in the last two decades at the global, national and local level. This article suggests that the conscious or unconscious application of subsidiarity has been the ruling principle that has allocated the level at which tasks have been assigned to different agents. Based on this hypothesis this paper describes (...) the principle of subsidiarity and its application to environmental policies within forest governance and proposes the “environmental subsidiarity” principle as a critical conceptual tool for sustainable resource management. The paper explains as an example how “environmental subsidiarity” is the key principle that can link payment for ecosystem services (PES) with environmental public policies and applies this principle with all its political consequences to reducing emissions from deforestation and forest degradation, and enhancing forest carbon stocks in developing countries (REDD+) architecture. It concludes by showing how the adoption of “environmental subsidiarity” as a ethical principle could help to maximize benefits to all stakeholders involved in PES schemes such as REDD+. (shrink)

Cloud computing is rapidly gaining traction in business. It offers businesses online services on demand (such as Gmail, iCloud and Salesforce) and allows them to cut costs on hardware and IT support. This is the first paper in business ethics dealing with this new technology. It analyzes the informational duties of hosting companies that own and operate cloud computing datacenters (e.g., Amazon). It considers the cloud services providers leasing ‘space in the cloud’ from hosting companies (e.g, Dropbox, Salesforce). And it (...) examines the business and private ‘clouders’ using these services. The first part of the paper argues that hosting companies, services providers and clouders have mutual informational (epistemic) obligations to provide and seek information about relevant issues such as consumer privacy, reliability of services, data mining and data ownership. The concept of interlucency is developed as an epistemic virtue governing ethically effective communication. The second part considers potential forms of government restrictions on or proscriptions against the development and use of cloud computing technology. Referring to the concept of technology neutrality, it argues that interference with hosting companies and cloud services providers is hardly ever necessary or justified. It is argued, too, however, that businesses using cloud services (banks, law firms, hospitals etc. storing client data in the cloud, e.g.) will have to follow rather more stringent regulations. The global financial crisis has led to a surprising interest in professional oaths in business. Examples are the MBA Oath, the Economist’s Oath and the Dutch Banker’s Oath, which senior executives in the financial services industry in the Netherlands have been obliged to swear since 2010. This paper is among the first to consider oaths from the perspective of business ethics. A framework is presented for analysing oaths in terms of their form, their content and the specific contribution they make (...) to business ethics management: oaths may foster professionalism, facilitate moral deliberation and enhance compliance. At the same time, this resumption is in charge of paying homage to this researcher who found the mistakes and gaps left by European scholars who were at the service of Eurocentric colonialism and its Eurocentric culture. Several studies have focused on the effects of corporate social responsibility fit on external stakeholders’ evaluations of CSR activities, attitudes towards companies or brands, and behaviors. The results so far have been contradictory. A possible reason may be that the concept of CSR fit is more complicated than previously assumed. Researchers suggest that there may be different types of CSR fit, but so far no empirical research has focused on a typology of CSR fit. This study fills this gap, describing (...) a qualitative content analysis of the congruence between six organizations and their various CSR activities. Ten annual reports and CSR reports were analyzed, and 102 specific CSR activities were identified. The results show that two levels of fit must be distinguished: based on the means for and the intended ends of the CSR activity. Furthermore, six different types of fit were found, focusing on products and services, production processes, environmental impact, employees, suppliers, and geographical location. Considering the above variety of fit possibilities, the findings emphasize the role of CSR communication as a means of creating fit perceptions. (shrink)

The problem is that this prophetic voice seems to have disappeared in many cases. A solution might be found if the point of view is taken that the prophetic voice in the congregational gathering is heard in the liturgical acts or rites. In the science of Liturgy attention must be given to the revitalisation of the gift of prophesy. In (...) this article the prophetic testimony of the Old Testament prophets and of the Prophet, Jesus Christ, were used as sources. Following in the footsteps of Brueggemann, an effort will be made to establish in relevant scripture passages what the attitude and practise of prophetic testimony should be. The possibility of rendering service through prophetic testimony as a liturgical act in the South African society is wide open. Prophetic testimony serves to criticise the dominant perception in order to dismantle it, but is also serves to energise persons and communities by its promise of another time and situation towards which the community of faith could move. When the COVID-19 surge hit New York City hospitals, the Division of Medical Ethics at Weill Cornell Medical College, and our affiliated ethics consultation services, faced waves of ethical issues sweeping forward with intensity and urgency. In this article, we describe our experience over an eight-week period (16 March through 10 May 2020), and describe three types of services: clinical ethics consultation (CEC); service practice communications/interventions (SPCI); and organizational ethics advisement (OEA). We tell this narrative through the prism of (...) time, describing the evolution of ethical issues and trends as the pandemic unfolded. We delineate three phases: anticipation and preparation, crisis management, and reflection and adjustment. The first phase focused predominantly on ways to address impending resource shortages and to plan for remote ethics consultation, and CECs focused on code status discussions with surrogates. The second phase was characterized by the dramatic convergence of a rapid increase in the number of critically ill patients, a growing scarcity of resources, and the reassignment/ redeployment of staff outside their specialty areas. The third phase was characterized by the recognition that while the worst of the crisis was waning, its medium- and long-term consequences continued to pose immense challenges. We note that there were times during the crisis that serving in the role of clinical ethics consultant created a sense of dis-ease as novel as the coronavirus itself. In retrospect we learned that our activities far exceeded the familiar terrain of clinical ethics consultation and extended into other spheres of organizational life in novel ways that were unanticipated before this pandemic. To that end, we defined and categorized a middle level of ethics consultation, which we have termed service practice communication intervention (SPCI). This is an underappreciated dimension of the work that ethics consult services are capable of in times of crisis. We believe that the pandemic has revealed the many enduring ways that ethics consultation services can more robustly contribute to the ethical life of their institutions moving forward. (shrink)

L'itinéraire singulier d'une femme que l'on pourrait, par bien des aspects, considérer comme appartenant à un passé déjà lointain, suscite pourtant chez nombre de nos contemporains un intérêt de plus en plus grand. Edith Stein - connue également sous le nom, qu'elle prit au Carmel, de Thérèse-Bénédicte de la Croix - reste aux yeux de beaucoup un témoin particulièrement saisissant des drames fondamentaux qui ont jalonné le XXe siècle européen et dont nous sommes, pour le meilleur comme peut-être pour le (...) pire, les héritiers. C'est à ce titre que sa vie et son message peuvent constituer pour notre avenir une lumière digne d'être interrogée. S'il est vrai que l'Europe doit d'abord et avant tout être un espace où vivent et se rencontrent des êtres humains capables de promouvoir une culture empreinte de dignité et de responsabilité, il était alors tout naturel de prendre comme fil conducteur de ce colloque le thème essentiel de la réflexion steinienne : la question de la personne humaine. Quatre approches complémentaires ont été choisies pour déployer quelques-unes des composantes de cette interrogation : L'enracinement philosophique d'Edith Stein dans le milieu phénoménologique de Göttingen, sa situation dans l'histoire de son temps, son activité d'éducatrice au service de la formation intégrale de la personne humaine, l'accomplissement de son engagement intellectuel dans la réflexion théologique et l'expérience du mystère de la Croix. The commons have emerged as a key notion and underlying experience of many efforts around the world to promote justice and democracy. A central question for political theories of the commons is whether the visions of social order and regimes of political economy they propose are complementary or opposed to public goods that are backed up by governmental coordination and compulsion. This essay argues that the post-Marxist view, which posits an inherent opposition between the commons as a sphere of inappropriable (...) usage and statist public infrastructure, is mistaken, because justice and democracy are not necessarily furthered by the institution of inappropriability. I articulate an alternative pluralist view based on James Tully’s work, which discloses the dynamic interplay between public and common modes of provision and enjoyment, and their civil and civic orientations respectively. Finally, the essay points to the Janus-faced character of the commons and stresses the co-constitutive role of public goods and social services for just and orderly social life while remaining attentive to the dialectic of empowerment and tutelage that marks provision by government. This article applies philosophical work on epistemic injustice and cognate concepts to study gender and racial disparity in financial markets. Members of disadvantaged groups often receive inferior financial services. In most jurisdictions, it is illegal to provide discriminatorily disparate treatment to groups defined by gender and skin colour. Racial disparity in financial services is generally considered to be discriminatory. The standard view among most regulators is that gender disparity is not discriminatory, though. Through an analysis of various exemplary cases, I (...) propose testimonial injustice as a candidate explanation for some of the existing forms of racial disparity found in financial services. I show how prejudices about gender and finance decrease epistemic self-confidence, and how this leads to gender disparity. ABSTRACT Monoclonal antibodies played a key role in the development of the biotechnology industry of the 1980s and 1990s. Investments in the sector and commercial returns have rivaled those of recombinant DNA technologies. Although the monoclonal antibody technology was first developed in Britain, the first patents were taken out by American scientists. During the first Thatcher government in Britain, blame for the missed opportunity fell on the scientists involved as well as on the National Research and Development Corporation, which had (...) been put in place after World War II to avoid a repeat of the penicillin story, when patent rights were not sought. Instead of apportioning the blame, this essay suggests that despite past experiences and despite the new channels that were in place, Britain was not in a “patent culture” in the 1970s. It traces the long and painful process that made a commercial attitude among publicly funded British research scientists and in a civil service institution like the Medical Research Council both possible and desirable. In this process the meaning of the term “public science” also changed dramatically. (shrink)

One area of ethical concern in higher education is writing services for graduate students, which can range from simple proofreading to rewriting content for flow, coherence, and structure to extensive content creation akin to ghostwriting. There are various ways to look at the use of writing services: 1) as a clear violations of ethics, presenting the student as a more capable writer than he or she is; 2) as a “necessary evil” resulting from greater numbers of individuals with inadequate writing (...) preparation entering university graduate programs; and 3) as a routine part of professional practice utilized by published writers who uniformly benefit from editing and proofreading. Professors, research advisors, and writing center tutors must face a range of ethical questions regarding writing assistance, particularly given that many graduate students, particularly those at the doctoral level, will soon be established professionals expected to guide others in the production of scholarly work. What are the ethical differences between types of writing assistance? What is the appropriate level of writing help for those in graduate programs? How does a strict stance on the editing of student papers reflect on the common practice of professional editing for publication—which can make published writers appear perhaps more capable than they really are? This article examines the complex issues those working with graduate students can face in trying to improve the writing they produce while also maintaining strong ethical standards regarding authorship and encouraging the learning process. It provides an overview of the ethical issues involved in writing services and extensive outside writing help provided to graduate students, and offers suggestions for creating a balance between compassion, professionalism, and honesty in graduate writing. It also proposes general ideas for offering appropriate assistance based on the type of writing in question—assistance that honors the learning process, demonstrates respect for the concept of authorship, and adheres to the concepts of Respect for Persons, Beneficence, and Justice outlined in the Belmont Report. As Christ left his example, Christians should love and assign themselves tasks on community service, be dedicated and taking responsibility for others. This article aims to reflect on the pastoral implications concerning the concept of "new creatures" with (...) a focus on self-giving and responsibility for others. Therefore, at first, it reflects on the concept of "new creatures", emphasizing the love of Christ as motivation for the practice on Christian life. Then presents discipleship in self-giving, a result of the new life in Christ, elements that allow us to present the concept of responsibility for others from the community service. It concludes that "living for Christ" implies a pastoral practice in which: a) the redeeming love of Christ compels a person to a new life and requires attitudes according to this love; b) Serving the community in self-giving is consequence of this new life; c) Community dimension leads to participation in building the Kingdom of God and takes to the responsibility for others. There are inherent difficulties in a subject like chemistry particularly the notion of a chemical reaction. In this paper the difficulties are discussed from a teaching and learning perspective and from a history of chemistry perspective. Three teaching/learning studies of the incompleteness of the iron thiocyanate reaction in chemical equilibrium are reviewed and it is shown that a recent historical study of the iron thiocyanate reaction has the potential to challenge the interpretation of the incompleteness of the reaction. This establishes (...) a controversial context where students can be introduced to epistemic thinking, that is, how to interrogate chemistry data and form a conclusion which resonates with what we know about the nature of science. A curriculum suggestion for pre-service chemistry teachers is provided. (shrink)

Background In neonatal intensive care, a child's death is often preceded by a medical decision. Nurses, social workers and pastors, however, are often excluded from ethical case deliberation. If multiprofessional ethical case deliberations do take place, participants may not always know how to perform to the fullest. Setting A level-IIID neonatal intensive care unit of a paediatric teaching hospital in the Netherlands. Methods Structured multiprofessional medical ethical decision-making (MEDM) was implemented to help overcome problems experienced. Important features were: all professionals (...) who are directly involved with the patient contribute to MEDM; a five-step procedure is used: exploration, agreement on the ethical dilemma/investigation of solutions, analysis of solutions, decision-making, planning actions; meetings are chaired by an impartial ethicist. A 15-item questionnaire to survey staff perceptions on this intervention just before and 8 months after implementation was developed. Results Before and after response rates were 91/105 (87%) and 85/113 (75%). Factor analysis on the questionnaire suggested a four-factor structure: participants' role; structure of MEDM; content of ethical deliberation; and documentation of decisions/conclusions. Effect sizes were 1.67 (p<0.001), 0.69 (p<0.001) and 0.40 (p<0.01) for the first three factors respectively, but only 0.07 (p=0.65) for the fourth factor. Nurses' perceptions of improvement did not significantly exceed those of physicians. Conclusion Professionals involved in ethical case deliberation perceived that the process of decision-making had improved; they were more positive about the structure of meetings, their own role and, to some extent, the content of ethical deliberation. Documentation of decisions/conclusions requires further improvement. (shrink)

BackgroundThe quality of ethics consults is notoriously difficult to measure. Survey-based assessments cannot capture nuances of consultations. To address this gap, we conducted interviews with health professionals who requested ethics consults during the initial phase of the COVID-19 pandemic.MethodHealthcare professionals requesting ethics consultation between March 2020 and May 2020 at a tertiary academic medical centre were eligible to participate. We asked participants to comment on the consults they called and thematically analysed responses to identify features associated with optimal quality consultations.ResultsOf (...) 14 healthcare providers, 8 (57%) were women and professions were as follows: 11 (79%) medical doctors, 1 (7%) social worker, 1 (7%) physician assistant and 1 (7%) nurse practitioner. Two aspects of quality emerged: satisfaction and value. Themes within the domain of satisfaction included: responsiveness of the ethics consultant, willingness to consult, institutional role of the ethics service and identifying areas for improvement. When describing value, respondents spoke of the intrapersonal and interpersonal worth of consultation.ConclusionParticipants were generally satisfied with ethics consultation services, similar to opinions of those found in pre-COVID-19 survey studies. Our qualitative approach allowed for a richer exploration of the value of ethics consultation during the pandemic and has implications for ethics consultation services more broadly. Ethics consultation—emphasising both the process and outcome—created valuable moral spaces, promoting thoughtful and ethical responses to dilemmas in patient care. In Mexico, significant ethical and social issues have been raised by the COVID-19 pandemic. Some of the most pressing issues are the extent of restrictive measures, the reciprocal duties to healthcare workers, the allocation of scarce resources, and the need for research. While policy and ethical frameworks are being developed to face these problems, the gender perspective has been largely overlooked in most of the issues at stake. Domestic violence is the most prevalent form of violence against women, which can (...) be exacerbated during a pandemic: stress and economic uncertainty are triggers for abuse, and confinement limits access to support networks. Confinement also exacerbates the unfair distribution of unpaid labor, which is disproportionately assigned to women and girls, and highlights inequality in the overall labor market. Lack of security measures has resulted in attacks towards health workers, particularly female nurses, due to fear of contamination. Finally, resource results in lack of access to other health necessities, including sexual and reproductive health services. Research across all disciplines to face—and to learn from—this crisis should be done through a gender lens, because understanding the realities of women is essential to understand the pandemic’s true effects in Mexico and the world. Étudier les actes de requête dans les discours prononcés aux Nations Unies s’avère d’une utilité certaine dans le travail de caractérisation de ce sous-genre diplomatique. La formulation indirecte des actes de langage et les procédés linguistiques qui éloignent les sources potentielles de confrontation révèle des discours contraints par l’exercice de la « politesse », au service de l’impératif institutionnel de valorisation du consensus. Ces discours qui s’éloignent du fonctionnement du langage ordinaire transfèrent la prise en charge de l’énonciation aux (...) États-membres qui sont ici de véritables locuteurs et qui partant parlent en leur propre nom. L’on observe alors l’impact d’un contexte socio-discursif sur le fonctionnement de langue. Les requêtes formulées dans ces discours reflètent les problématiques qui préoccupent les États membres, puisque dans bien des cas, une requête peut être l’aveu d’un manque. Les verbes illocutoires donnent un bon aperçu des « façons de parler » et témoignent d’ores-et-déjà d’une routinisation des pratiques langagières. (shrink)

ABSTRACTThe massive influx of refugees into Europe in the past few years has given rise to different kinds of challenges among which is the challenge to successfully communicate with newly arrived immigrants. In this article, we will focus on the public service provision sector where quality of service is to a large extent determined by the capability of a service provider and his or her “client” to understand one another. The article centres on a study involving public (...) organisations providing asylum services or healthcare services in the multilingual and multicultural city of Brussels. Several interviews were conducted to gain insight into the communication problems such organisations face, as well as their communication requirements and solutions when providing services to people of different linguistic and cultural backgrounds. This study aimed to evaluate the food production and then act to increase the quality and security of a service, in order to meet the requirements for qualification HAPPC, using good manufacturing procedures as starting point for implementation. It is characterized as an intervention study, emphasizing the quality of foods and the use of good manufacturing procedures at the foodservice and nutrition units, located in Botucatu-SP. It was composed of 2 moments. In the first, we applied a check-list for (...) ascertainment of non-conformity and in the second moment a training “in loco” was given for the collaborators. The lack of hygienic cleaning of hands is seen as an important negative point. We verified that the biggest difficulties and irregularities are related to the manipulators which don´t follow the rules. Good manufacturing procedures were obtained to increase the quality and the security of foods in the unit, but these must be kept constantly adjusted to the standards. (shrink)

The purpose of this paper is to analyse the Spanish mobile phone industry to determine how mobile phone companies and certain institutions can improve protection for children who use mobile phones. We carried out a multivariate statistical analysis using anonymous primary data from mobile phone companies, and institutions and associations that protect children, to compare these stakeholders’ opinions and to put forward solutions. We proved that, even though some European countries have made an effort to provide safer ICT services, all (...) stakeholders still need to cooperate and agree on solutions to the commercial problems associated with children using mobile phones. This can be done by signing codes of conduct. We found that even though some companies implement measures to protect children from accessing harmful content via their mobile phones, they do so for reasons of legal and not social responsibility. Créée par Éric Rochant, Le Bureau des légendes (Canal +, 2015-2020) explore le monde du renseignement en décrivant le travail du service des agents clandestins de la DGSE. Face aux incertitudes et aux complexités géopolitiques du monde contemporain, elle fait le choix d’une immersion au cœur du « renseignement humain ». Cet article envisage l’hypothèse selon laquelle une telle fiction permet de restaurer la confiance des spectateurs vis-à-vis de la capacité d’une démocratie à lutter contre ce qui la menace. (...) En plongeant son spectateur dans les coulisses du renseignement, en le familiarisant avec des personnages complexes, la série questionne la légitimité de la confiance qu’il est possible d’accorder à un service de renseignement. La faillibilité des agents, mise en scène de façon détaillée, réfléchie par la série elle-même, rassure parce qu’elle permet de comprendre et de partager une forme de vie spécifique qui est celle de l’action secrète. L’espionnage, le contre-espionnage et le contre-terrorisme apparaissent alors comme des pratiques reposant en dernier ressort, non pas sur une maîtrise absolue, mais sur la décision de faire confiance ou au contraire de se méfier. Mobilisant les recherches de la sociologie contemporaine à propos de la confiance (Giddens, 1994 et Luhmann 2006), il s’agit de décrire Le Bureau des légendes comme une fiction projetant sur nos écrans, la possibilité d’une restauration de la confiance ou pour le dire à la manière de Stanley Cavell, une issue possible au scepticisme. George Stigler soutenait que l’économiste, quand il prêchait, ne pouvait faire plus que de recommander une éthique de la rationalité instrumentale, ou de la manière intelligente d’accorder les moyens aux fins. Les fins les plus importantes appartiendraient toutes à un maximande unique, la richesse, tempérée par un altruisme de proximité.L’agnosticisme moral radical de Stigler le conduisit à nier toute distinction entre les choix forcés et libres, les actes licites et illicites, le vol et le commerce dans la mesure où (...) ils aboutissaient de manière égale à l’augmentation de l’utilité. En considérant que le concept de coercition était sans fondement, il identifia la liberté avec la richesse. L’utilitarisme de Bentham transforme profondément la doctrine antérieure de la liberté de parole en la mettant au service de la recherche de la vérité et en réfléchissant à la portée du contrôle exercé par le gouvernement. Il préserve la distinction entre les affirmations portant sur des opinions et celles portant sur des faits et accorde aux premières une moindre protection. Comme l’avait fait son père James Mill, John Stuart Mill conserve cette distinction dans ses écrits de jeunesse mais ces (...) analyses souffrent de faiblesses logiques et de naïveté politique. Dans De la liberté, John Stuart Mill cherche à dépasser ces difficultés et propose une nouvelle défense de la liberté d’expression en tant que liberté de délibération. Contrairement à la plupart des interprétations, cet article démontre que cette nouvelle approche ne remet pas en cause la distinction fondamentale entre l’expression des opinions (qui sont protégées de façon absolue) et les affirmations portant sur des faits, qui ne sont protégées que de façon contingente, ce qui laisse ouverte la possibilité de restreindre l’expression d’affirmations fausses portant sur des faits. C’est en grande partie grâce à sa connaissance de l’œuvre de la prophétesse Antoinette Bourignon (1616-1680) que le cartésien Pierre Poiret est devenu un fervent défenseur de la mystique. Après leur rencontre en 1676, Poiret devint son disciple le plus dévoué et l’éditeur en chef de ses écrits. Cependant, à l’époque de leur première rencontre il n’était pas du tout prévu qu’il assume ce rôle. En fait, de nouvelles recherches montrent que pendant deux ans, Bourignon a continué à mettre Poiret (...) à l’épreuve. Les épreuves auxquelles Bourignon l’a soumis ne l’ont pas détourné d’elle, ce qui ne fait que montrer à quel point il la croyait vraiment prophétesse de Dieu. Cet article se concentre d’une part sur l’importance de Bourignon pour Poiret, et d’autre part sur la question de son rôle dans la postérité de cette femme mystique. The consequences of foreign direct investment (FDI) for human rights protection are poorly understood. We propose that the impact of FDI varies across industries. In particular, extractive firms in the oil and mining industries go where the resources are located and are bound to such investment, which creates a status quo bias among them when it comes to supporting repressive rulers (“location-bound effect”). The same is not true for nonextractive multinational corporations (MNCs) in manufacturing or services, which can, in comparison, (...) exit problematic countries more easily. We also propose that strong democratic institutions can alleviate negative impacts of extractive FDI on human rights (“democratic safeguard effect”). Using U.S. FDI broken up into extractive and nonextractive industries in 157 host countries (1999–2015), we find support for these propositions.1 Extractive FDI is associated with more human rights abuse, but nonextractive FDI is associated with less abuse, after controlling for other factors, including concerns about endogeneity. We find also that the negative human rights impact of extractive FDI vanishes in countries where democratic institutions are stronger.
