What does it take for a scientific model to represent? Scientific models have received a great deal of attention in recent philosophical literature. Following Morgan and Morrison’s account of “Models as Mediators”, analysis of how models represent has changed from questioning what properties of models can be said to correlate with the world to asking how models are used to relate to an intended target-system. This turn to a practice-oriented approach of understanding models was a response to a general philosophical (...) problem that attends the empirical application of scientific representations such as models. In the State of Bernstein, operating a motor vehicle on a suspended license is a misdemeanor, punishable by permanent loss of one’s license. Officer Krupke arrests everyone who does this, as Tony has. But Tony says, “Gee, Officer Krupke, can’t you bend the rules? I went to your high school, you know.” Tony’s using a euphemism. He’s really asking Krupke to break the rules. Is there, however, a non-euphemistic way to bend a rule of law, without breaking it? More (...) precisely, can we ever bend a rule while still applying it, in some sense, or is this just doubletalk? Consider the case of Maria, whose driver’s license has also been suspended. Maria lives with her mother in a remote area, twenty miles from the nearest doctor. Maria’s mother comes down with a fever of one hundred two. It’s not life-threatening, but Maria wants to spare her mother suffering and hasten recovery, so she drives to the hospital herself, rather than waiting for an ambulance to make the trip out and back. Unfortunately for Maria, the statute contains no applicable exception. I stipulate that this statute is not unjust or otherwise defective, as written. Suppose there are conclusive reasons for legislators not to complicate the statute with exceptions broad enough to cover cases such as Maria’s. Writing such exceptions would encourage sub-optimal misapplication of the exception by judges and sub-optimal misconduct by legal subjects who would anticipate judicial misapplication of the statutory exception. Nevertheless, most will agree that Maria has strong reasons to act as she does. Rare is the writer who insists that rules of law trump all other reasons that bear on legal subjects. Some will insist that we give Maria’s mother a condition more life-threatening before they’ll assent. (shrink)

Generalising what is learned about one stimulus to other but perceptually related stimuli is a basic behavioural phenomenon. We evaluated whether a rule learning mechanism may serve to explain such generalisation. To this end, we assessed whether inference rules communicated through verbal instructions affect generalisation. Expectancy ratings, but not valence ratings, proved sensitive to this manipulation. In addition to revealing a role for inference rules in generalisation, our study has clinical implications as well. More specifically, we argue that targeting (...) inference rules might prove to be an effective strategy to affect the excessive generalisation that is often observed in psychopathology. (shrink)

ABSTRACT Aristotle says in the Rhetoric that leading judges into passions is like warping a rule or kanon before using it. Rather than seeing this as an exclusion of emotion from rhetoric, I argue that the ability for the pathe to bend judgment has its appropriate use in achieving equity. The pathe are themselves a kanon, resembling the soft, leaden rule used by Lesbian masons, referred to in his discussion of equity in the Nicomachean Ethics. In problematic cases, (...) the rigidity of law requires the correction of a judge's pathetic capacity. I then read Lysias's Against Simon, a speech given under strict relevancy requirements, to show how the pathe are used in the narration of the accused party in seeking an equitable judgment. In this chapter, the author reflects on her long personal association with the Society for the Protection of Science and Learning /Council for Assisting Refugee Academics and many of its South African grantees. The academic refugees who came to the SPSL's notice in the 1960s, specially the South Africans, bent the ‘rules’ and signalled the new ways in which the SPSL was going to have to work in a very changed social and educational environment in Britain, and equally great changes (...) in the nature of the academic refugees. Before the rise of Hitler, German scholars had advanced the frontiers of knowledge in the sciences, the social sciences, and the humanities. And in many of these fields the Jews of Central Europe had played a crucial role. Increasingly from the 1960s, however, many of the refugee academics to the UK were from the so-called ‘third world’, especially Latin America and countries just emerging from colonialism in Africa. Academic refugees from South Africa formed something of a bridge between the old and the new. While most of the South African grantees were white and from institutions modelled on British universities, they were on the whole younger and less highly qualified than the earlier generation of grantees. The very small number of Africans assisted at this time were in fact far more eminent; significantly, however, they were the very first Africans to be assisted by the Society. (shrink)

The dead donor rule—that persons must be dead before their organs are taken—is a central part of the moral framework underlying organ procurement. Efforts to increase the pool of transplantable organs have been forced either to redefine death (e.g., anencephaly) or take advantage of ambiguities in the current definition of death (e.g., the Pittsburgh protocol). Society's growing acceptance of circumstances in which health care professionals can hasten a patient's death also may weaken the symbolic importance of the dead donor (...) rule. We consider the implications of these efforts to continually revise the line between life and death and ask whether it would be preferable to abandon the dead donor rule and rely entirely on informed consent as a safeguard against abuse. We investigate what determines a multinational enterprise’s propensity to engage in lobbying and bribing in host countries where the overall institutional development for market exchanges is insufficient, and thus, their governance systems are relatively weak. We extend the current literature on institutional strategies by theorizing and showing the persistent and significant impacts of home country institutions on an MNE’s choice of influencing activities to address institutional constraints overseas. More specifically, our results demonstrate that the MNEs from a home country with (...) a stronger governance system are less involved in bribery, but have a higher tendency to lobby in transition economy countries, which have been characterized by relatively weaker institutional development, particularly in the area of governance. This tendency still holds even when these MNEs rely more on the local market for sales. We draw theoretical and practical implications from these observations. (shrink)

Kant argues that morals should not only constrain politics, but that morals and politics properly understood cannot conflict. Such an uncompromising stance on the relation of morals to politics has been branded unrealistic and even politically irresponsible. While justice can afford to be blind, politics must keep its eyes wide open. In response to this charge I argue that Kant’s position on the relation of morals to politics is both morally uncompromising and yet politically flexible, both principled and practical. Kantian (...) justice is not blind to circumstances, and we need not abandon our convictions in order to be politically responsible. Indeed, Kant argues that future political progress can only be achieved when the coerced rule of right is coupled with the non-coerced rule of virtue. For Kant, freedom and justice are intertwined with publicity, and publicity depends upon the critical acumen and moral candour of an enlightened and virtuous citizenry. (shrink)

The conception of the doctor–patient relationship under Australian law has followed British common law tradition whereby the relationship is founded in a contractual exchange. By contrast, this article presents a rationale and framework for an alternative model—a “Trust Model”—for implementation into law to more accurately reflect the contemporary therapeutic dynamic. The framework has four elements: an assumption that professional conflicts with patient safety, motivated by financial or personal interests, should be avoided; an onus on doctors to disclose these conflicts; a (...) proposed mechanism to contend with instances where doctors choose not to disclose; and sanctions for non-compliance with the regime. The role of the Home Office in the Peterloo Massacre remains contentious. This article assesses the available evidence from the Home Office and the private correspondence of Home Secretary Viscount Sidmouth to contest E. P. Thompson’s claim that the Home Office ‘assented’ to the arrest of Henry Hunt at St Peter’s Fields. Peterloo is placed within the context of government’s response to political radicalism to show how the Tory ministry had no clear counter-radical strategy in the months leading up to (...) the August event. The article further argues that although the Home Office may not have assented to forceful intervention on the day, the event and its aftermath were needed to justify the Six Acts which would ultimately cripple the reform movement. In 1792, with the aim of defending Kant's doctrine of freedom, Reinhold redefined freedom of will as the ability to decide for or against the moral law. Thus freedom of will represents a foundation of moral philosophy, if not of philosophy as a whole. The present volume seeks to reinterpret and to discuss this chapter of the post-Kantian discourse on freedom from various perspectives.

Jesus of Nazareth, like Socrates, left nothing behind written by himself. Yet, the records of his teaching indicate a rich interest in dialogic pedagogy, reflected in his use of the parable, primarily an oral genre, as a dialogic provocation. Working at the interface of pedagogy, theology and philosophy, this article explores the parable of the Good Samaritan from the perspective of dialogic pedagogy. It employs an analytical approach termed diacognition, developed from the notions of dialogue, position and cognition, to analyse (...) the moves within the parable and the teaching situation in which it is located. The article explores how Jesus engages the dialogue of and around the parable to position and reposition his interlocutor, provoking a re-cognition of what it means to love one’s neighbour. The information explosion and digital modes of learning often combine to inform the quest for the best ways of transforming information in digital form for pedagogical purposes. This quest has become more urgent and pervasive with the ‘turn’ to online learning in the context of COVID-19. This can result in linear, asynchronous, transmission-based modes of teaching and learning which commodify, package and deliver knowledge for individual ‘customers’. The primary concerns in such models are often technical and economic – technology as (...) a cost-effective ‘solution’ to educational challenges. In this paper I argue for the importance of dialogic learning space in teaching and learning by means of Information and Communication Technologies, whether in the form of fully online learning, blended learning or face-to-face encounters using ICT affordances. Although the 20th Century theorists Mikhail Bakhtin (1895–1975) and Hans-Georg Gadamer (1900–2002) produced their seminal works before the advent of ICTs, they were both concerned with the quality and authenticity of human engagement with texts and with other persons and contexts. Besides a shared interest in dialogue as an ontological feature of human life and being, they both used spatiotemporal concepts for understanding and interpreting texts. The article draws on Gadamer’s notions of dialogue and horizon, and Bakhtin’s notions of dialogue and chronotope, to conceptualize dialogic possibilities for online education. Its purpose is to provide a framework, grounded in Bakhtin’s and Gadamer’s ideas, for a dialogic approach to online teaching and learning in higher education. (shrink)

Dialogue is a seminal concept within the work of the Brazilian adult education theorist, Paulo Freire, and the Russian literary critic and philosopher, Mikhail Bakhtin. While there are commonalities in their understanding of dialogue, they differ in their treatment of dialectic. This paper addresses commonalities and dissonances within a Bakhtin-Freire dialogue on the notions of dialogue and dialectic.
