This article examines the relationship between online dispute resolution (ODR) and trust. We discuss what trust is, why trust is important, and how trust develops. Our claim is that efforts to implement online dispute resolution on a site or service in a manner that promotes trust need to consider ODR as just one tool in a broader toolbox of trust-building tools and techniques. These techniques are amongst others marketing, education, trust seals, and transparency. By evaluating ODR in its proper context (...) as one component of a larger trust strategy, we can more accurately set expectations for its results and position our projects for success. (shrink)

Next we consider the position of economic and management theories in relation (...) to the social responsibility of the firm. We argue that instrumental stakeholder theory and business and society research can only partially solve the global governance issue, and that more recent concepts of corporate citizenship and republican business ethics deliver theoretically and practically helpful, fresh insights. It is argued that we need to expand the rather restricted perspectives that these frameworks provide, in order to explore new conceptual foundations that will not only enable us to travel the (...) confines of the different disciplines involved with the study of the changing role of business in shaping the global rules of the game, but that can also systematically connect normative and positive research questions at the conceptual level. We here report the findings of our investigation into the validity of the conjunction fallacy (Tversky & Kahneman, 1983), bearing in mind the role of conversational rules. Our first experiment showed that subjects found a logically correct answer unacceptable when it implied a violation of the conversational rules. We argue that tautological questions, such as those which concern the relationship of inclusion between a class and its sub-class, violate conversational rules because they are not informative. In this (...) sense, it is not understood that the question in a Linda-type problem involves a comparison between an inclusive and included class, but presumed that a different type of comparison is intended. Tautological questions (and, consequently, also their answers) do not become a matter of discussion except under certain specific conditions. Our second experiment showed that, providing the context was adequately marked (such as in the case of a rhetorical question), the conjunction fallacy disappears. In two further experiments, the implications of our view were compared with those of the other critical approaches to the heuristic programme: the classical pragmatic view (which we call logical complementarity) and the frequentist view. Science's priority rule rewards those who are first to make a discovery, at the expense of all other scientists working towards the same goal, no matter how close they may be to making the same discovery. I propose an explanation of the priority rule that, better than previous explanations, accounts for the distinctive features of the rule. My explanation treats the priority system, and more generally, any scheme of rewards for scientific endeavor, as a device for achieving an allocation of (...) resources among different research programs that provides as much benefit as possible to society. I show that the priority system is especially well suited to finding an efficient allocation of resources in those situations, characteristic of scientific inquiry, in which any success in an endeavor subsequent to the first success brings little additional benefit to society. After preliminaries concerning different accounts of the good and the distinction between actual-consequence consequentialism and expected-value consequentialism, this paper explains why consequentialists should prescribe a moral decision procedure dominated by rules. But act-consequentialists deny rules have a role in the criterion of moral rightness. Prescribing a decision procedure dominated by rules and then denying rules a role in the criterion of rightness can be problematic. Rule-consequentialism gives rules roles first in the decision procedure agents (...) should use and second in the criterion of moral rightness. But giving rules this second role has attracted objections, some of which are outlined and answered here. The final section of the paper considers some recent developments. (shrink)

Production is taking longer than expected but I will post the whole book sometime this summer.] One central aim of science is to provide explanations of natural phenomena. What role(s) does mathematics play in achieving this aim? How does mathematics contribute to the explanatory power of science? Rules to Infinity defends the thesis, common though perhaps inchoate among many members of the Vienna Circle, that mathematics contributes to the explanatory power of (...) science by expressing conceptual rules, rules which allow the transformation of empirical descriptions. Mathematics should not be thought of as describing, in any substantive sense, an abstract realm of eternal mathematical objects, as traditional platonists have thought. In Rules to Infinity, this view, which I call mathematical normativism, is updated with contemporary philosophical tools, and it is argued that normativism is compatible with mainstream semantic theory. This allows the normativist to accept that there are mathematical truths, while resisting the platonistic idea that there exist abstract mathematical objects that explain such truths. Furthermore, Rules to Infinity defends a particular account of the distinction between scientific explanations that are in some sense distinctively mathematical – those that explain natural phenomena in some uniquely mathematical way – and those that are only standardly mathematical, and it lays out desiderata for any account of this distinction. Normativism is compared with other prominent views in the philosophy of mathematics such as neo-Fregeanism, fictionalism, conventionalism, and structuralism. Rules to Infinity serves as an entry point into debates at the forefront of philosophy of science and mathematics, and it defends novel positions in these debates. (shrink)

Wittgenstein argues that understanding a language consists of mastery of techniques for playing language?games rather than some sort of mental state or episode such as mental imagery, rule invocation, or atmosphere investing our experience of words. His elimination of the three mentalistic alternatives presupposes the peculiar distinction, or its virtual lack, between speaker and listener presupposed by his positive claim, instead of establishing the latter. The Role of Dorsal Premotor Cortex in Resolving Abstract Motor Rules provides alternative hypotheses about the cognitive functions affected by the application of repetitive transcranial magnetic stimulation. Their model simulated the effect of stimulation of the left dorsal premotor cortex right as participants provide a Models were used to demonstrate that the increased variability in observed response times can result from interference in replanning during the process of responding to the uninstructed stimulus.

Institutional operability refers to the normative conditions governing the exercise of power of office that makes an institution work. Because institutional action occurs by the interrelated actions of the officeholders, a focus on institutional operability requires the analysis and assessment of the officeholders’ conduct in their institutional capacity. This article distinguishes two perspectives on operability: ‘outward’ and ‘inward.’ The outward view emphasizes predefined instructions for efficient execution, focusing on rule-following to achieve institutional purposes. The inward perspective highlights role-playing and reflective (...) engagement among officeholders to uphold an institution’s raison d’être. The paper concerns the essential and permanent place of roles and rules in human life, or what I call ‘the dilemma of compliance.’ The paper begins with previous scholarship warning therapists and psychologists about the danger of unknowingly reinforcing violent and toxic social expectations. A distinction is drawn between conformity and compliance, with the former standing for rote and mindless following of rules, and the latter a self-conscious and flexible way of relating to rules and (...) class='Hi'>roles. The paper argues that following rules and filling roles is unavoidable, and, consequently, a human life is always a double-life, divided between pre-existing, generic roles, and our private and unique way of relating to those roles. The crucial difficulty is learning to comply with rules and roles rather than merely conforming to them. Two extreme cases are examined to develop this problem of rules, roles, and living a double-life: schizophrenia and censorship. It is argued that schizophrenia and censorship are cases in which the place of rules and roles become overbearing and urgent. Finally, the paper argues that attention to the dilemma of compliance highlights the significance of trauma-informed care, as trauma is often connected to how one fits or does not fit into a social milieu constituted by roles, rules, and expectations. The arguments are developed primarily in historical, philosophical, and clinical terms. (shrink)

Successfully navigating the norms of a society is a complex task that involves recognizing diverse kinds of rules as well as the relative weight attached to them. In the United States, different kinds of rules—federal statutes and regulations, scientific norms, and professional ideals—guide the work of researchers. Penalties for violating these different kinds of rules and norms can range from the displeasure of peers to criminal sanctions. We proposed that it would be more difficult for researchers working (...) in the U.S. who were born in other nations to distinguish the seriousness of violating rules across diverse domains. We administered a new measure, the evaluating rules in science task, to National Institutes of Health-funded investigators. The ERST assessed perceptions of the seriousness of violating research regulations, norms, and ideals, and allowed us to calculate the degree to which researchers distinguished between the seriousness of each rule category. The ERST also assessed researchers’ predictions of the seriousness that research integrity officers would assign to the rules. We compared researchers’ predictions to the seriousness ratings of 112 RIOs working at U.S. research-intensive universities. U.S.-born researchers were significantly better at distinguishing between the seriousness of violating federal research regulations and violating ideals of science, and they were more accurate in their predictions of the views of RIOs. Acculturation to the U.S. moderated the effects of nationality on accuracy. We discuss the implications of these findings in terms of future research and education. (shrink)

Difficulty of distinguishing rules and similarity in categorization comes from reliance on relatively simple manipulation-response designs and a style of modeling with abstract parameters, rather than assessment of intervening and controlling mental states. This commentary proposes a strategy in which rules and similarity would be distinguished by their different roles in a theory interrelating reportable conscious contents in deliberative categorization.

The question of rules is not an issue that separates the 'analytical' and 'Continental' traditions from one another; rather it is an issue that is a source of division within each tradition. Within Continental philosophy the problem of the rule-governed character of cognition goes back to Kant's dualism of sense and understanding. Many philosophers in the Continental tradition (notably, Nietzsche, Gadamer and Adorno) have retained a quasi-Kantian conception of judgement while rejecting the idea of it as rule-governed. But there (...) have been exceptions to this within Continental philosophy, most prominently, Jürgen Habermas. The rules thesis was implicit in much of analytical philosophy as it was practised in Britain from the 1950s to the 1970s. The doctrine gave support to a conception of philosophy (so-called 'ordinary-language philosophy') as essentially an exercise in the articulation of certain kinds of tacit knowledge. It was advocated explicitly in such works as Searle's Speech Acts and Winch's The Idea of a Social Science . The equation of meaning and rules enjoyed further prestige, for it was taken by many philosophers to be the central doctrine to be extracted from Wittgenstein's Philosophical Investigations . A most striking feature of the receding of the rules thesis has been the transformation of previously accepted interpretations of Wittgenstein's later philosophy (for example, by Stanley Cavell and John McDowell). Both adherents and opponents of the rules thesis have shared a common concern. In emphasizing the discontinuity between language and the subject-matter of the natural sciences both sides offer reassuringly positive answers to one of the besetting problems of twentieth-century philosophy: does philosophy have a distinctive subject-matter of its own? Using chess decision making as a model for ethical decision making, I show that ethical decisions rarely involve the conscious application of moral rules. I discuss the metaethical and normative implications of this aspect of ethical decision making in terms of the moral philosophies of Sartre, Hare, and Aristotle. I conclude with a discussion of the implications of the chess model in research and teaching in applied ethics.

I believe that Wright’s constructivist account of intention is funda- mentally flawed [Wright 1984, 1986, 1987a, 1987b, 1988, 1989a, 1989b, 1991, 1992]. To understand why it fails it is necessary first to locate the account in its broader strategic context. That context is Wright’s response to Wittgenstein’s account of rule following. When so located the diagnosis of the account’s failure is clear. Wright’s account of intention is a species of the interpretative approach to mental content which is explicitly rejected by (...) In this paper, I develop an ecological-enactive perspective on the role rules play in linguistic behaviour. I formulate and motivate the hypothesis that metalinguistic reflexivity – our ability to talk about talking – is constitutive of linguistic normativity. On first sight, this hypothesis might seem to fall prey to a regress objection. By discussing the work of Searle, I show that this regress objection originates in the idea that learning language involves learning to follow rules from the very (...) start. I propose an ecological-enactive response to the regress objection. The key move is to deny that language learning consists initially in learning rules. A child first engages in regular communicative behaviour, by learning first-order linguistic skills, and then retroactively interprets her own behaviour in normative metalinguistic terms, i.e., as being guided by rules by relying on reflexive or second-order linguistic skills. On this view, metalinguistic reflexivity enables regulation of already regular communicative behaviour, and thereby constitutes linguistic normativity. Finally, I argue that linguistic rules are resources: they are available to participants in order to (re)negotiate properties of situated language behaviour and thereby reorganize linguistic practices. The account developed in this paper thus allows us to understand the constitutive role of metalinguistic reflexivity for linguistic normativity without falling prey to the regress objection. The study aimed to identify the role of administrative procedures and systems in enhancing the performance of the educational institutions in the Islamic University in Gaza. To achieve the research objectives, the researchers used the analytical descriptive approach to collect information. The researchers used the questionnaire distributed to three categories of employees at the Islamic University (senior management, faculty members, their assistants and members of the administrative board). A random sample of 314 employees was selected and 276 questionnaires were retrieved (...) with a recovery rate of 88.1%. The Statistical Analysis Program (SPSS) was used to enter process and analyze data. The results of the research showed a positive role for the administrative procedures and systems in enhancing the performance of the Islamic University from the point of view of the members (senior management, teaching staff and their assistants and the administrative body), where the relative weight of all the paragraphs (73.728%). The analysis of the results revealed that the administrative procedures at the Islamic University in Gaza are used to an acceptable degree. The relative weight of all the paragraphs is 70%. This indicates a relationship between administrative procedures and regulations and the performance of the Islamic University in the Gaza Strip. The study found that there was a good degree of approval from the sample regarding the administrative procedures and their relationship to the job performance. There exist a sufficient degree of powers to the deans and department managers to carry out their tasks, with the use of plans as control tools. And that there are rules and procedures provided for decision-making in the University Council. It also has full powers to manage the university to improve the teaching and learning environment. The researchers also recommended a number of recommendations, including the need to follow up on the procedures and systems of management and update them continuously in the light of changes that may occur and to ensure the existence of a strong system of electronic information systems within the university. There is a need to provide mechanisms for obtaining information about the surrounding external environment, and effective mechanisms to provide managers with the necessary information in a timely manner. The importance of providing channels of communication that enables staff to communicate information about any violations and breaches. The study also recommended the follow-up, review, procedures and administrative systems, and work to modify them in line with the mission of the university and the objectives that the university seeks to reach. Sentimental Rules is an ambitious and highly interdisciplinary work, which proposes and defends a new theory about the nature and evolution of moral judgment. In it, philosopher Shaun Nichols develops the theory that emotions play a critical role in both the psychological and the cultural underpinnings of basic moral judgment. Nichols argues that our norms prohibiting the harming of others are fundamentally associated with our emotional responses to those harms, and that such 'sentimental rules' enjoy an advantage in (...) cultural evolution, which partly explains the success of certain moral norms. This has sweeping and exciting implications for philosophical ethics. Nichols builds on an explosion of recent intriguing experimental work in psychology on our capacity for moral judgment and shows how this empirical work has broad import for enduring philosophical problems. The result is an account that illuminates fundamental questions about the character of moral emotions and the role of sentiment and reason in how we make our moral judgments. This work should appeal widely across philosophy and the other disciplines that comprise cognitive science. (shrink)
