  4. African Jurisprudence as Historical Co-extension of Diffused Legal Theories.Leye Komolafe - 2022 - Thought and Practice: A Journal of the Philosophical Association of Kenya 8 (1):51-68.
African jurisprudence, like African philosophy, continues to be hotly debated. This article contends that the debate straddles the uniqueness claim which either emphasises the existence or possibility of a peculiar legal framework on the continent, and a historical co-extensional position reiterating that African jurisprudence is a continuum of other legal traditions. The article argues that there is no uniquely African jurisprudence, and that what obtains within the structures of jurisprudence on the continent also exists within various legal traditions elsewhere, and (...)

    Critical Response II - Affect and Intention: A Reply to William E. Connolly.Ruth Leys - 2011 - Critical Inquiry 37 (4):799-805.
William Connolly is in error when he remarks that I begin my article with a discussion of scientific accounts that reduce the emotions to a few genetically wired categories and that I suggest that the cultural theorists who are interested in affect are driven in the same reductive direction.

IIIFacts and Moods: Reply to My Critics.Ruth Leys - 2012 - Critical Inquiry 38 (4):882-891.
The purpose of my article, “The Turn to Affect: A Critique,” was to show that the theorists whose work I analyzed are all committed to the mistaken idea that affective processes are responses of the organism that occur independently of cognition or intention.1 My aim was not to emphasize the differences among the authors under consideration—differences that, as I noted in my article, of course do exist—but rather to demonstrate that those theorists share certain erroneous assumptions about the separation presumed (...)

Touching at a Distance: Digital Intimacies, Haptic Platforms, and the Ethics of Consent.Madelaine Ley & Nathan Rambukkana - 2021 - Science and Engineering Ethics 27 (5):1-17.
The last decade has seen rise in technologies that allow humans to send and receive intimate touch across long distances. Drawing together platform studies, digital intimacy studies, phenomenology of touch, and ethics of technology, we argue that these new haptic communication devices require specific ethical consideration of consent. The paper describes several technologies, including Kiiroo teledildonics, the Kissenger, the Apple Watch, and Hey Bracelet, highlighting how the sense of touch is used in marketing to evoke a feeling of connection within (...)

The Welfare State amid Crime: How Victimization and Perceptions of Insecurity Affect Social Policy Preferences in Latin America and the Caribbean.Sandra Ley, Sarah Berens & Melina Altamirano - 2020 - Politics and Society 48 (3):389-422.
Criminal violence is one of the most pressing problems in Latin America and the Caribbean, with profound political consequences. Its effects on social policy preferences, however, remain largely unexplored. This article argues that to understand such effects it is crucial to analyze victimization experiences and perceptions of insecurity as separate phenomena with distinct attitudinal consequences. Heightened perceptions of insecurity are associated with a reduced demand for public welfare provision, as such perceptions reflect a sense of the state’s failure to provide (...)

The ascent of affect: genealogy and critique.Ruth Leys - 2017 - London: University of Chicago Press.
In recent years, emotions have become a major, vibrant topic of research not merely in the biological and psychological sciences but throughout a wide swath of the humanities and social sciences as well. Yet, surprisingly, there is still no consensus on their basic nature or workings. Ruth Leys’s brilliant, much anticipated history, therefore, is a story of controversy and disagreement. The Ascent of Affect focuses on the post–World War II period, when interest in emotions as an object of study began (...)

    Surveying the Emotions.Ruth Leys - 2010 - Emotion Review 2 (2):109-110.
A commentary on Robert Kagan’s What is Emotion? (2007). The commentary praises the author for the range and breadth of his analysis and for his skepticism concerning the common tendency to equate emotions with brain states. At the same time, I raise questions about the terms in which Kagan attempts to separate out the distinct components of the emotional “cascade.” In particular, I suggest that by treating the appraisal or interpretation of the changes in bodily feelings as a distinct phase (...)

The origin and early evolution of animals marks an important event in life's history. This event is historically associated with an important variable in Earth history – oxygen. One view has it that an increase in oceanic oxygen levels at the end of the Neoproterozoic Era (roughly 600 million years ago) allowed animals to become large and leave fossils. How important was oxygen for the process of early animal evolution? New data show that some modern sponges can survive for several (...)

Trade Marks as Property: A Philosophical Perspective.Dominic Scott, Alex Oliver & Miguel Ley-Pineda - 2008 - In Lionel Bently, Jennifer Davis & Jane C. Ginsburg (eds.), Trade Marks and Brands: An Interdisciplinary Critique. Cambridge University Press. pp. 285-305.
In this chapter, we investigate the idea of trade marks as property. Three questions need to be answered. The first is a conceptual matter: are trade marks capable of being property or are they ruled out as a matter of conceptual necessity? The second is conceptual-cum-descriptive: is the current law's treatment of trade marks treatment of them as property? The third is normative: if the current law does in fact treat them as property, is it right to do so? The (...)

A Speech-Act Model for Talking to Management. Building a Framework for Evaluating Communication within the SRI Engagement Process.Wim Vandekerckhove, Jos Leys & Dirk Van Braeckel - 2008 - Journal of Business Ethics 82 (1):77 - 91.
Socially Responsible Investment (SRI) has grown considerably over the past three decades. One form of SRI, engagement-SRI, is today by far the most practiced form of SRI (in assets managed) and has the potential to mainstream SRI even further. However, lack of formalized engagement procedures and evaluation tools leave the engagement practice too opaque for such a mainstreaming. This article can be considered as a first step in the development of a standard for the engagement practice. By developing an engagement (...)

As Socially Responsible Investment (SRI) enters the mainstream of professional and institutional investment practice, some perplexities arise. Some SRI market participants are well schooled in finance but are hesitative as to how to apply non-financial criteria in the management of portfolios. Governments too are giving SRI more attention and, in some countries, are discussion whether and how to regulate the SRI market. Advocacy groups are targeting SRI projects through media campaigns using political discourse. Many of the pertinent questions that come (...)

    Having a Look at the Effectiveness of SRI-endeavours.Jos Leys - 2007 - Philosophica 80 (2):121-130.
This paper, an epilogue to the special issue on socially responsible investment, is a first attempt to philosophically tackle information asymmetries that pertain to the consequences or the effectiveness of SRI-policies. The paper discerns four types or techniques of SRI: 1) shareholder engagement; 2) the selection of best-in-class entities; 3) the maintenance of categorical exclusions; 4) the financing of alternative economies. For each technique, the paper first briefly sketches the mechanism that is put to work by the SRI-investor. Then, I (...)

Social Capital and Managers’ Use of Corporate Resources.Ziqi Gao, Leye Li & Louise Yi Lu - 2019 - Journal of Business Ethics 168 (3):593-613.
This study investigates how social capital affects managers’ use of corporate resources. We find that for firms located in U.S. counties with a high level of social capital, (i) corporate cash holdings have higher marginal value, (ii) the contribution of capital expenditures to shareholder value is higher, and (iii) acquirers experience higher announcement-period abnormal stock returns. We further find that social capital decreases both over- and under-investment, and thus improves ex post corporate investment efficiency. Our evidence suggests that in communities (...)
