If definitive evidence concerning treatment effectiveness becomes available from an ongoing randomized clinical trial, then the trial could be stopped early, with the public release of results benefiting current and future patients. However, stopping an ongoing trial based on accruing outcome data requires methodological rigor to preserve validity of the trial conclusions. This has led to the use of formal interim monitoring procedures, which include inefficacy monitoring that will stop a trial early when the experimental treatment appears not to (...) be working. For participants, inefficacy monitoring is especially important as it ensures that they are not being treated worse than if they had not enrolled on the trial. We discuss the importance of reporting with trial results the formal interim inefficacy monitoring guidelines that were utilized, and, if none were used, the reasons for their absence. A survey of two leading medical journals suggests that this is not current practice. (shrink)

Interim measures are procedural means that allow persons or States to have their rights preserved when a case is pending. Application of these measures especially in environmental cases is very important. In many of these cases (e.g. cases dealing with territorial planning, IPPC permits, environmental impact assessment, etc.) the claims deal with the protection of environment or its components (water, air, soil, etc.) as well as with the protection of public interest. Legal regulation of application of interim measures (...) provided by Lithuanian Law on Administrative Proceedings is not optimal. That is why the first part of the article is dedicated to the analysis of the possibilities and problems of application of interim measures in the administrative proceedings in Lithuania, paying special attention to environmental cases. The second part of the article reflects the findings of a workshop of the Association of European Administrative Judges on „Interim relief in environmental matters” held in Vilnius on 22 September 2011. It briefly describes various national rules on interim relief procedures, especially in the German and the French legislation, with an assessment from the German point of view. This part of the article focuses on provisional legal protection where a permit is challenged by a third party whose rights are allegedly afflicted. In such a constellation the rights of the plaintiff compete with the rights of the operator. The article concludes that, when deciding on the necessity of interim measures, it is vital to ensure the balance of interests: both by ensuring effective access to justice and by protecting the respondent and the third party (in environmental cases - usually the operator) from the violation of their rights and the damage caused by the abuse of the right to request interim measures. In such cases short time limits for procedural steps both of the parties and the court are not advisable and a prima facie prognosis on the outcome in the main proceedings meets the interests of the parties. Between States is the first book that assesses systematically the broad implications of interim governments in the establishment of democratic regimes and on the existence of states. Based on historical and contemporary democratisation experiences, the book presents four ideal types of interim government: opposition-led provisional governments, power-sharing interim governments, incumbent-led caretaker governments, and international interim government by the United Nations. In international arbitration, timely application and enforcement of interim measures can have a substantial effect on the possibility of the enforcement of final arbitration award, especially when issues relating to the protection of assets or evidence arise before or during the course of arbitration proceedings. Though the substantive amendments to the UNCITRAL Model Law on International Commercial Arbitration concerning the application and enforcement of interim measures in international arbitration were made in 2006, the legal regulation of these matters (...) in Lithuania by the Law on Commercial Arbitration remained as previous. Hence, the purpose of this article is to provide a brief analysis of the contemporary universal legal doctrine and international practice regarding the availability, application and enforcement of interim measures in international arbitration; to examine and evaluate the Lithuanian law and court practice, their compliance with the analyzed contemporary universal legal doctrine and international practice on the application and enforcement of interim measures in international arbitration. Advocates of extended cognition hold that the physical machinery of mind sometimes extends beyond the skull and skin. In the first part of this paper, I explain why, and more specifically the precise sense in which, consciousness presents such theorists with an extra hurdle to be cleared. The key challenge is posed by phenomenal consciousness, the what‐it's‐like‐ness of experience. I consider two arguments for the claim that the physical machinery of phenomenal consciousness sometimes extends beyond the skull and skin. The (...) first – the argument from sensory substitution – suggests that acceptance of extended phenomenal consciousness should follow from a careful analysis of the phenomenon in which technological augmentation enables one sensory modality, for instance touch, to support the kind of environmental access and interaction ordinarily supported by a different sensory modality, for instance vision. The second argument – the argument from the relational character of experience – suggests that acceptance of extended phenomenal consciousness should follow from a particular conception of conscious experience that is mandated by sensorimotor contingency theory. SummaryIn 1968, a prospective study was started in collaboration with the Family Planning Association to try to provide a balanced view of the beneficial and harmful effects of different methods of contraception. This investigation is now in progress at seventeen clinics and over 17,000 women are under observation. At the time of recruitment, all these women were married white British subjects, aged 25–39 years, who voluntarily agreed to participate. Fifty-six per cent were using oral contraceptives, 25% were using a diaphragm (...) and 19% were using an intrauterine device. During follow-up each woman is questioned at return visits to the clinic and a record of pregnancies and their outcome, hospital referrals, changes in contraceptive methods and the results of cervical smears, is accumulated. Women who default are sent a postal questionnaire and, if this is not returned, are telephoned or visited in their homes to collect the necessary information.So far, data obtained during 56,000 woman-years of observation are available for analysis. Follow-up has been maintained with an annual lapse rate of about 0.3%due to withdrawal of co-operation or loss of contact; adherence to the method of contraception in use at recruitment has been reasonably good, and the reporting of pregnancies and hospital admissions appears to have been both reliable and unbiased.The present data include only 24 deaths, so the mortality associated with different contraceptive methods cannot yet be estimated. With regard to morbidity, however, our preliminary results closely resemble those obtained in the prospective study carried out by the Royal College of General Practitioners and in the principal retrospective studies carried out in Britain and the United States. Women who used oral contraceptives at the start of the study experienced adeficiencyof hospital referrals for cancer, benign lesions of the breast, menstrual disorders other than amenorrhoea, duodenal ulcer, and retention cysts of the ovary; they showed anexcessof referrals for cerebrovascular disease, cervical erosion, skin disorders, self-poisoning, migraine, venous thrombosis and embolism, hayfever, gallbladder disease, amenorrhoea, and sterility. Women who used a diaphragm showed adeficiencyof hospital referrals for carcinoma-in-situ and dysplastic lesions of the cervix uteri and accidental injury; and anexcessof referrals for haemorrhoids and cystitis. Women who used an IUD experienced anexcessof hospital referrals for anaemia, varicose veins and salpingitis. About half of these differences were predicted from other studies while some suggestive evidence already existed for a further five. Of the remaining six, some probably reflect the influence of selective factors or chance.Multiple pregnancies, stillbirths, malformations, the sex ratio and birthweight showed no consistent relationship to method of contraception. The outcome of unplanned pregnancies occurring in women using an IUD, however, was remarkably unfavourable both in terms of ectopic gestation and miscarriage.Clear evidence was found of impairment of fertility after discontinuation of oral contraceptives. Whether this is likely to lead to permanent sterility in some women is uncertain.The study has provided data on the efficacy of a wide variety of contraceptive methods. In general the failure rates are in keeping with those obtained in other large-scale studies, save that those for the diaphragm and the sheath are much lower than those usually quoted.The available evidence does not yet allow a final balance to be struck between the benefits and risks associated with the new methods of contraception that have become widely used during the last two decades. It seems clear, however, that there are no material risks associated with the use of the diaphragm apart from the risk of pregnancy and that there may be some unintended benefits. (shrink)

Introduction: There is currently no binding, internationally accepted and successful approach to ensure global equitable access to healthcare during a pandemic. The aim of this ethical analysis is to bring into the discussion a legally regulated vaccine allocation as a possible strategy for equitable global access to vaccines. We focus our analysis on COVAX (COVID-19 Vaccines Global Access) and an existing EU regulation that, after adjustment, could promote global vaccine allocation. -/- Methods: The main documents discussing the two (...) strategies are examined with a qualitative content analysis. The ethical values reasonableness, openness and transparency, inclusiveness, responsiveness and accountability serve as categories for our ethical analysis. -/- Results: We observed that the decision-making processes in a legal solution to expand access to vaccines would be more transparent than in COVAX initiative, would be more inclusive, especially of nation states, and the values responsiveness and accountability could be easily incorporated in the development of a new regulation. -/- Discussion: A legal strategy that offers incentives to the pharmaceutical industry in return for global distribution of vaccines according to the Fair Priority Model is an innovative way to achieve global and equitable access to vaccines. However, in the long term, achieving the Sustainable Development Goals will require from all nations to work in solidarity to find durable solutions for global vaccine research and development. Interim solutions, such as our proposed legal strategy for equitable access to vaccines, and efforts to find long-term solutions must be advanced in parallel. (shrink)

This article examines the operation of “reasonable steps” as a statutory standard for analysis of the availability of the defence of belief in consent in sexual assault cases and concludes that application of section 273.2(b) of the Criminal Code, as presently worded, often undermines the legal validity and correctness of decisions about whether the accused acted with mens rea, a guilty, blameworthy state of mind. When the conduct of an accused who is alleged to have made a mistake about (...) whether a complainant communicated consent is assessed by the hybrid subjective-objective reasonableness standard prescribed by s. 273.2, many decision-makers rely on extra-legal criteria and assumptions grounded on their personal experience and opinion about what is reasonable. In the midst of debate over what the accused knew and what steps were “reasonable” given what the accused knew, the legal definition of consent in section 273.1 is easily over-looked and decision-makers focus on facts that are legally irrelevant and prejudice rational deliberation. -/- That is precisely what we see here; the result is often failure to enforce the law. The author proposes: -/- (a) that section 273.2 be amended to reflect the significant developments achieved in sexual consent jurisprudence since enactment of the provision in 1992; and -/- (b) that, in the interim, the judiciary act with resolve to make full and proper use of the statutory and common law tools that are presently available to determine whether the accused acted with mens rea in relation to the absence of sexual consent. This article analyses one of the variations of classic mediation,64 which is mandatory mediation. In foreign countries mandatory mediation is often used as a tool to encourage the use of mediation and to popularize this method of alternative civil dispute resolution. Started in 2005, mediation faces difficulties in Lithuania. Thus, making mediation mandatory at least in certain categories of disputes could give new impetus to the development of mediation in Lithuania. Therefore, the article deals with the concept of mandatory mediation, (...) analyses experience of foreign countries in the field of mandatory mediation, deals with practical problems while implementing mandatory mediation and presents a review of arguments for and against mandatory mediation. On the basis of a study performed, the author of the article submits proposals for the introduction of mandatory mediation in the Lithuanian legal system. In this article mandatory mediation is defined as a form of mediation where the parties are directed to use mediation by judge or by law. Mandatory mediation can also be imposed on the parties by procedural and economic sanctions against parties for the unjustified refusal to use mediation. In all cases, the main condition for the application of mandatory mediation is the right of the parties to the dispute to go to court. Under this condition, mandatory mediation for its expected social and economic benefits is not considered to be an obstacle to access justice. The practice of foreign countries that implemented mandatory mediation shows that drastic imposition of mandatory mediation naturally induces rejection. Thus, consistent, systematic, based on the results of the interim analysis of the gradual introduction of mandatory mediation, starting with certain categories of disputes particularly susceptible to the effects of mediation is necessary. The author of the article proposes to promote mediation in Lithuania by introducing mandatory mediation for at least certain categories of disputes. The introduction of mandatory mediation in Lithuania could be started from the family disputes including interests of children. At a later stage it is possible to decide on the feasibility of application of the mandatory mediation for other categories of disputes, as well (e.g., labour, small sum property disputes, disputes between relatives and neighbours, etc.). In order to encourage not only the parties to use mediation, but also judges to direct parties to mediation, it would be appropriate to introduce mandatory mediation by the law (the Civil Procedure Code of the Republic of Lithuania) that would have an exemption provision to allow a party to petition the court for good cause to be exempt from the referral to mediation. Ethically permissible clinical trials must not expose subjects to risks that are unreasonable in relation to anticipated benefits. In the research ethics literature, this moral requirement is typically understood in one of two different ways: as requiring the existence of a state of clinical equipoise, meaning a state of honest, professional disagreement among the community of experts about the preferred treatment; or as requiring an equilibrium between individual and collective ethics. It has been maintained that this second interpretation makes it (...) mandatory to minimize the number of patients receiving the treatment that will eventually be shown to be inferior by the trial. This requirement has led to the development of adaptive trials, i.e., trials in which treatment allocation is determined by data accumulated during interim analysis. Many statisticians argue that in some circumstances—typically with potentially high benefits, as in the much discussed ECMO trial—adaptive design is the only ethically permissible experimental design. Nevertheless, some proponents of clinical equipoise argue that adaptive trials are neither ethically required nor permissible. More specifically, they argue that clinical trials using adaptive designs fail to meet the moral requirement of clinical equipoise, since these trials presuppose an epistemic state that is incompatible with a physician’s duty of care to her subjects. This paper emphasizes that the debate is to a large extent resting on an epistemological confusion. Specifically, I argue that this response conflates two different conceptions of statistical evidence, and that recognizing this distinction elucidates an epistemological framework in which adaptive trials are both consistent with and recommended by the moral requirement of clinical equipoise. Thomas Aquinas presents an account of human immortality and bodily resurrection intended to be both faithful to Christian Scripture and metaphysically sound as following from the Aristotelian view of human nature. One central question is whether a human person persists between death and resurrection by virtue of her soul, given Aquinas’s hylomorphic account of human nature and assertion that a human person is not identical to her soul. Robert Pasnau contends that only a part of a person exists between death (...) and resurrection; whereas Eleonore Stump argues that a person substantially exists, albeit deficiently, during the interim period as composed of, but not identical to her soul. The debate on whether insurance companies should be allowed to use results of individuals’ genetic tests for underwriting purposes has been both lively and increasingly relevant over the past two decades. Yet there appears to be no widely agreed upon resolution regarding appropriate and effective regulation. There exists today a gamut of recommendations and actual practices addressing this phenomenon ranging from laissez-faire to voluntary industry moratoria to strict legal prohibition. One obvious reason for such a variance in views and approaches (...) is that there are competing bases for evaluating the outcomes of restricting insurers’ use of such information. For example, an outright ban on the use of genetic test results may seem the best method for protecting against unfair discrimination, while allowing their use may seem to be the best way to foster efficiency in the market for insurance. However, there is also a lack of understanding about how restricting the use of genetic information would play out in the market through the so-called phenomenon of adverse selection. Using economic analysis, we discuss how the type of adverse selection that occurs in insurance markets affects various arguments both in favour and against an outright ban on insurers’ use of genetic tests for pricing insurance. We review arguments based on moral principles . Practical concerns from the insurance industry based on actuarial principles and economic efficiency are also compared. Each perspective is shown to lead to a range of conflicting recommendations about how genetic information should be regulated and these conclusions depend critically on whether one conducts the analysis from the ex ante temporal perspective , from the interim temporal perspective , or from the ex post temporal perspective. Most contemporary interpreters of Aquinas have assumed that Thomas subscribed to a “non-repeatability principle” such that created entities, once destroyed entirely, cannot be “brought back" into existence, even by God's power. Souls persisting in the interim between death and resurrection thus play an essential identity-preserving role between our death and rising again. No separated souls, no resurrection. Two of Aquinas’s best medieval interpreters, however, reject this interpretation. Leaning largely on one of Aquinas’s late quodlibetal questions, they deny that Thomas (...) held any non-repeatability principle strong enough to bar God’s resurrecting us even from complete destruction, souls and all. Here the chapter argues that careful analysis of the quodlibet and other texts largely vindicates the contemporary interpretation. It does so in a surprising way, however, since it turns out Aquinas’s non-repeatability principle applies only to corruptible, material entities like us, and not to incorruptible entities like angels. BackgroundWhenever South African research institutions share human biological material and associated data for health research or clinical trials they are legally compelled to have a material transfer agreement in place that uses as framework the standard MTA newly gazetted by the South African Minister of Health.Main bodyThe article offers a legal analysis of the SA MTA and focuses on its substantive fit with the broader legal environment in South Africa, and the clarity and practicality of its terms. The following (...) problematic aspects of the SA MTA are highlighted: Where only data and no human biological material are transferred, the SA MTA does not apply, leaving a lacuna; Health Research Ethics Committees are required to be parties to a MTA despite it being outside their legal mandate and undermining their oversight function; the SA MTA’s consent provisions are not aligned with extant law; and, similarly, its provision on donor ownership is misaligned with extant law; its creation of fictitious performance can only cause frustration on the part of an injured party; its benefit-sharing provision is vague and will have little practical effect; its dispute-resolution provisions fail to adequately protect South African research institutions and research participants; it fails to provide substantive guidance regarding intellectual property as its provisions relating to intellectual property may cause practical problems; and, finally, its data privacy provision is insufficiently specific, is overbroad, and fails to provide terms that in general would facilitate the international sharing of human biological material and associated data in terms of existing privacy law.ConclusionsWhile some of the problematic aspects of the SA MTA are intricate and require consultative processes with stakeholders and others, to develop comprehensive solutions, most of the problematic aspects can be resolved immediately through amendments by the South African Minister of Health. Over the past decade, in contrast to the traditional analytic version of metaphysics, a brand of metaphysics that prioritizes collaboration and corroboration with sciences has emerged in the form of scientific metaphysics. While there has been a shift from the methodological dependence of analytic metaphysis on intuition, and conceptual analysis to the methodological preference for empirically-motivated metaphysical insights in scientific metaphysics, such a shift has not penetrated the foundational aims. Scientific metaphysics continues to probe the nature and structure of (...) reality, much like its analytic counterpart and in this process, develops ontologies. Broadly two kinds of ontologies are furnished - global metaphysical ontologies and local scientific ontologies. In this paper, I highlight the challenges with developing such ontologies in scientific metaphysics. With Ladyman-Ross’ Information Theoretic Structural Realism as a case in point, I contest that the former suffers from representational indeterminacy and redundancy. Further, I note the possibility that eventually, local scientific ontologies might be replaced by scientific theories and in such a scenario, the former are best conceived as interim metaphysical supports for the latter. This paper provides a brief analysis of the concepts of ethics, professionalism and fitness to practice, and an examination of the GDC’s First Five Years and Standards for Dental Professionals guidance, as well as providing an insight into the innovative ethics strand of the BDS course at the University of Glasgow. It emerges that GDC (...) guidance is flawed inasmuch as it advocates a virtue-based approach to ethics and professionalism, and fails to distinguish clearly between these two concepts. (shrink)

If the "crime against humanity" involved a targeting of entire communities for racial and ethnic cleansing and policing, individualizing the victim obliterated this particular—many would argue central—characteristic of apartheid. Limiting the definition of harm and remedy to individuals center-staged political activists as victims of apartheid, as indeed happened with the victim hearings. The consequence was to narrow the TRC perspective to a political reconciliation between state agents and political activists, individual members of a fractured political elite, rather than the "national unity and reconciliation" mandated by the legislation that set it up. To pursue its actual mandate, the TRC needed to broaden its perspective: to work for a social reconciliation between perpetrators and victims required that the relationship between the state and the entire South African people be addressed.Second, by focusing on individuals and obscuring the victimization of communities, the TRC was unable to highlight the bifurcated nature of apartheid as a form of power that governed natives differently from non-natives. This essay comprises a selection of commentaries aimed at creating dialogue around the theme Technology, Megatrends and Work. Of all the profound changes in business, technology is perhaps the most ubiquitous. There is not a facet of our lives unaffected by internet technologies and artificial intelligence. The Journal (...) of Business Ethics established a dedicated section that focuses on Technology and Business Ethics, yet issues related to this phenomenon run right through all the sections. Kirsten Martin, editor of the Technology and Business Ethics section, joins our interim social media editor, Hannah Trittin-UIbrich, to advance a human-centric approach to the development and application of digital technologies that places Business Ethics at centre of the analysis. For Shuili Du, technology is the defining condition for a new era of Corporate Social Responsibility—CSR 3.0—which she defines as “a company’s socially responsible strategies and practices that deal with key ethical and socio-technical issues associated with AI and related technologies on the one hand and leverage the power of AI and related technologies to tackle social and environmental problems on the other hand.” It is not just technologies that are a determining feature of our lives but technology companies, an argument made by Glen Whelan as he examines Big Business and the need for a Big Business Ethics as we try to understand the impact of Big Tech on our post-work world. Indeed, as noted by Ernesto Noronha and Premilla D’Cruz, megatrends in addition to advancement in technologies, namely globalization, the greening of economies, and changes in demographics and migration, are shaping the future for workers in ways previously unimaginable. Contributing to this important debate, Praveen Parboteeah considers the influence of another longstanding but oft overlooked megatrend, the role of religion in the workplace. Given the enormity of the influence of technology and other megatrends in our world, it is not surprising that this essay introduces ground-breaking ideas that speak to the future of business ethics research. Storytelling pivots around stance seen as a window unto emotion: storytellers project a stance expressing their emotion toward the events and recipients preferably mirror that stance by affiliating with the storyteller’s stance. Whether the recipient’s affiliative stance is at the same time expressive of his/her emotional resonance with the storyteller and of emotional contagion is a question that has recently attracted intriguing research in Physiological Interaction Research. Connecting to this line of inquiry, this paper concerns itself with storytellings of sadness/distress. (...) Its aim is to identify factors that facilitate emotion contagion in storytellings of sadness/distress and factors that impede it. Given the complexity and novelty of this question, this study is designed as a pilot study to scour the terrain and sketch out an interim roadmap before a larger study is undertaken. The data base is small, comprising two storytellings of sadness/distress. The methodology used to address the above research question is expansive: it includes CA methods to transcribe and analyze interactionally relevant aspects of the storytelling interaction; it draws on psychophysiological measures to establish whether and to what degree emotional resonance between co-participants is achieved. In discussing possible reasons why resonance is (not or not fully) achieved, the paper embarks on an extended analysis of the storytellers’ multimodal storytelling performance (reenactments, prosody, gaze, gesture) and considers factors lying beyond the storyteller’s control, including relevance, participation framework, personality, and susceptibility to emotion contagion. This study, conducted by the Dr. Edgar Mitchell Foundation for Research into Extraterrestrial and Extraordinary Experiences (FREE), represents the first comprehensive investigation on individuals (N = 3,256) who have reported to have had various forms of contact experience (CE) with a non-human intelligent being (NHI) associated with or without an unidentified aerial phenomenon (UAP). Our research methodology utilized two comprehensive quantitative surveys totaling 554 questions administered in subjects with reported non-hypnotic memory recall of their CE. This survey addressed a diverse (...) range of physical, psychological, perceptual, and paranormal aspects of reported non-hypnotic based recall of both physical and/or non-physical interactions with a NHI being. The results revealed complex reported CEs that involve both physical and non-physical (psychological outcomes, non-ordinary states of consciousness, and paranormal experiences) events. What may be the most significant aspect of the interim results is that approximately 70% (N=2,279) of the study population claimed that their CE changed their life in a “positive way.” In contrast, only 15-20% reported a “negative” impact from their CE. Further, the majority of subjects did not report events typically associated with the traditional held beliefs regarding the “alien-abduction” phenomena. That is, the results suggest that the reported CE with NHI is largely non-physical and can occur via telepathy, during an out-of body experience, being floated into a "matrix-like" reality, as well as through physical interaction on board a craft. Consequently, the results suggest that a non-physical (“contactee”) CE is distinctly different than the physical (“abduction”) CE and should be studied as separate but interrelated anomalous events. In fact, the CE associated with a UAP is not the predominant form of CE and that sighting a UAP is not necessarily associated with a CE. Consequently, future studies should not focus exclusively on the analysis of UAP sightings and traces alone which, based on decades of research, have not advanced our understanding of the possible force which governs and regulates this complex phenomenon. This is an important consideration since the FREE study dispels the notion that contact with NHI beings must always entail either a physical abduction or a landed craft with beings interacting with humans. This study may serve as a needed foundation for researchers to build upon for validation purposes to better understand a unique and diverse range of reported physical and non-physical type CEs with a NHI associated with or without a UAP. Background Adherence to ethical guidelines and regulations and protecting and respecting the dignity and autonomy of participants by obtaining a valid informed consent form (ICF) prior to participation in research are crucial; The subjects did not add signatures next to the corrections made to signatures or dates on the ICF, Multiple signatures in other fields, ICF missing/missing signature, Incorrect ICF version Signed after modification, Correction tape used to correct signature, Impersonated signature, Non-research-member signature, however, ICFs are often not properly completed, (...) which must be addressed. This study analyzed ICF signing errors and implemented measures to reduce or prevent these errors. Methods We used the plan–do–check–act (PDCA) cycle to help improve the correctness and validity of ICF signing. Results Interim and final reports from January 2016 to February 2020 including 363 ICFs were studied. The total proportion of correct ICF signatures (200, 83.3%) following the PDCA intervention was significantly higher than that before the intervention (P < 0.05). Analysis of the types of signing error demonstrated that signature errors were significantly reduced after the intervention, particularly for subjects did not add signatures next to the corrections made to signatures or dates on the ICF (16, 6.7%) and impersonated signature (0; P < 0.05). Conclusions The proportions of other error types—multiple signatures in other fields, missing or unsigned ICF, incorrect signature order, incorrect ICF version, use of correction tape to correct signature, and non-medical profession members signing the ICF—did not differ significantly. The article analyses the key issues of the legal status of the sole managing body from the perspective of the valid legal regulation, the established case-law and doctrine. The first part of the article analyses the dualism of the manager’s legal status from the perspective of civil law and labour law. The analysis of the latest case-law presented herein shows that the rule of “internal” and “external” relations between the manager and the company formulated in the case-law is applied (...) differently, and the criterion of distinguishing the manager’s as the subject of the labour law and that of the civil law statuses still remains unclear. The authors of the article are of the view that due to insufficient legal regulation in force rules established by the case-law to regulate the manager’s legal status cannot ensure the required legal certainty. Thus, the reform of the manager’s legal regulation is essential. The second part of the article strives to answer the question what legal regulation models exist and what are the main criteria of quality legal regulation. The comparative analysis of the legal status regulation of the sole managing body allows to determine the main available regulation models of the manager’s legal status and to distinguish their advantages and disadvantages. The authors of the article believe that it is necessary to take regard to other states’ practices regulating the relations at issue, however, while creating such legal regulation, the evaluation of economic, cultural and social peculiarities of Lithuania is also required. In search for the most appropriate model of the manager’s legal status, attention should be drawn to the fact that in some aspects the labour law regime is too restrictive (e.g., shareholders cannot recall the manager, who is on maternal leave, and the manager at interim does not have full authority) and uncoordinated with the doctrine of the companies’ law. Moreover, quite a few questions directly related to the issues of the manager’s authority do not fall or only partially fall into the scope of the labour law. On the other hand, the problem of the manager’s legal status involves a broader scope of points of the companies’ law than the dualism of the manager’s status, and a part of these points has already been regulated by the Law on Companies (the agreement conclusion, termination, removal from the register of legal persons, terms of notice). In regard to this, a question can be raised if it not be better to regulate the issues of the manager’s legal status by the provisions of the Law on Companies and not of the Labour Code. It is proposed to create a specific legal regulation of the companies’ law, which could meet the needs of business and match up to the doctrine of the companies’ law, which is already being applied. But of the dozen or more major meetings of this sort held across the country, the one held at the National Institutes of Heakh (NIH) in Bethesda, MD, June 2-4, 1991, was distinctive in several respects.1As (...) its name implies, "Human Genome Research in an Interdependent World" was a global look at the issues raised by gene mapping and sequencing. Unlike previous conferences, however, this meeting looked beyond a comparative analysis of clinical and domestic legal issues, and concentrated on topics that may require responses on a truly international level if they are to be successfully resolved.The meeting's organizers gathered an impressive group of more than seventy participants from fifteen countries, including the first significant contingent of Soviet and Japanese scientists, physicians, and philosophers at an ELSI meeting. In addition to talks by the heads of the genome projects in the Soviet Union, Japan, and the United States, the meeting was keynoted by Dr. James Wyngaarden, director general of the Human Genome Organization (HUGO), and I had the honor of serving as its general chairman.The goal of the meeting was to consider an array of issues that scientists, philosophers, and lawyers from around the world suggested might have international significance, with an eye to deciding three things: (1) Does the issue deserve further attention? (2) Is the issue best addressed in an international or domestic context? and (3) Do structures exist to which the issue can be referred for resolution? In the final sessions, the entire group debated proposed resolutions on the various topics and narrowed the list needing further, intensive exploration.To provide an international framework for this process, the conference [End Page 247] established a Global Steering Committee on Ethical and Social Issues in Genome Research, which will coordinate the efforts of several task forces charged with refining the tentative resolutions adopted by the conference participants on June 4. The task forces are expected to be able to complete work on some topics by the time of the steering committee's first meeting, which was described by one participant as a "check point," probably within the coming year; on other topics, the task forces will provide interim reports and arrange to continue their analysis. The paper aims at analyzing the production of creditworthiness within the context of commercial banking in international banks. Taking the interim financing in the Polish automobile sector as an example, the paper reconstructs the process between legal framing of the financial instrument, marketing, and risk management. Firstly, it shows that changes in the state vehicle registry function as a prerequisite upon which the bank uses the newly introduced vehicle registration document as a security. Secondly, it analyzes the change of (...) perspectives which takes place between the marketing of the product and the analysis of documents . This research is conducted by the Intellectual Property and Policy Research Group at the W. Maurice Young Centre for Applied Ethics at the University of British Columbia. It is part of the GE3LS component of the Genome Canada Project "Dissecting Gene Expression Networks in Mammalian Organogenesis," MORGEN, which is located principally at the British Columbia Cancer Agency, Vancouver, British Columbia, Canada. The project is involved in upstream, basic genomic research. Part of this work includes the characterization of gene regulatory mechanisms (...) governing organogenesis with a special focus on the heart, liver and pancreas. This paper serves as an introduction to both the MORGEN case study and the role of alternative mechanisms, such as open source. For bioethicists, these topics include: equity in the allocation of resources for treatment and research; forgoing life-sustaining care and proxy decision (...) making; informed consent in the context of HIV testing and screening; the ethical duties of health care workers to provide care for persons with HIV disease; and competing obligations of health care professionals to patients and to third parties who may be put at risk.The Role of CommissionsIf AIDS is the quintessential case study for bioethicists, it is a potential quagmire for politicians. The association of HIV disease with drug use and sexual behavior makes it a topic that all but the most courageous (or the most homophobic) politicians shy away from. A frequent political response is to form a commission.Alexander Capron, who was executive director of the President's Commission for the Study of Ethical Problems in Medicine, has described some roles commissions play: a watchdog, overseeing the work of particular government agencies; a crucible, providing a means for "publicly hammering out conclusions on controversial issues when consensus, both in the public and in the relevant disciplines, is not yet apparent"; and "a lightning rod for public concern—or viewed less charitably, dumping ground for an issue that is too difficult for the ordinary political process to handle" (Capron 1983, p. 9).Nearly every state has created a gubernatorial-level task force or commission on AIDS. The EU Collective Redress Recommendation has invited Member States to introduce collective redress mechanisms by July 26, 2015. The claim of the well-known reservations concerns the potentially abusive litigation and potential settlement of not well-founded claims resulting from controversial funding of cases by means of contingency fees and from “opt-out” class action procedures. The Article posits that apart from that claim, at bottom there may be some danger that the European Commission and private interest-groups may try to pursue the enforcement (...) of their regulatory agendas in this way at the expense of individual claimants’ interests. However, in contrast to the situation in the United States, the need to complement regulatory enforcement by collective action may not appear as strong because of the relatively strict regulatory control and enforcement, which may explain EU Member States’ longstanding reluctance to adopt collective proceedings due to their concern for plaintiffs’ individual rights. Therefore, a comparative analysis is carried out to see to what extent individual rights as opposed to regulatory goals are taken into account in the different newly revised systems in place across Europe. As an interim result, the Dutch settlement procedure for mass damage claims, the English Group Litigation Order and the German test case procedure turn out to be relatively well-suited to dealing with mass damage claims. At the same time, none of them can quite reach an optimal balance between individual rights and regulatory goals and therefore each of them is subject to criticism. That is why the further question is raised as to how far these procedures could complement each other, thus contributing to the enforcement of individual rights without overregulating markets in Europe. Its main influence is on Hume's claims concerning the place of causal reasoning in forming our belief in continued existence. Since we are accustomed in other instances to seeing the fire burn down, we here reason from what he calls the coherence of the change to the beliefthat the fire existed when we were not in the room. We have in the past observed five log fires burn down to four log fires and then to three log fires. We light a five log fire, leave the room, and return to a three log fire. This article examines a particular kind of business-opening activity found in a specific, and little analysed, type of institutional group meeting: group supervision for psychotherapeutic counsellors. The data consist of a particular set of activities that occur in the initial stages of these meetings, which are neither the kind of pre-meeting talk identified by previous research on interaction in meetings, nor specifically the business of group supervision itself. This phase, referred to as the ‘check-in’, functions as an interim stage (...) between small talk and getting down to business. The analysis shows how the check-in comprises a highly structured set of linguistic sequences whose production is bound up with one of the key interactional features of group supervision: the collaborative orientation to the production and relevance of ‘feelings-talk’. But he is, as far as it is possible to judge, the only animal who knows that he knows, and who seeks to understand the nature and meaning of the act of knowing itself. Michael Polanyi has been engaged in this search for more than twenty years, and the book here under review is an ‘interim report’ on the development of his thought since the publication of Personal (...) Knowledge and The Study of Man just ten years ago. Its three short chapters are substantially the Terry Lectures which he delivered at Yale University in 1962. This review will attempt no more than to summarise the central theme of Polanyi’s argument. A detailed, critical analysis of its philosophical significance is beyond the competence of a biologist. This book, written by two central figures of generative grammar, represent the culmination of some ten years work on phonological theory and specifically on the sound system of English. As such, it is of interest to anyone concerned with phonology in general no less than to the student of English. Their description of the phonological structure of modern English, while not claiming to be exhaustive, reveals the deep and hitherto largely uncharacterized, regularities underlying this system in at least two major (...) areas: in the analysis of English stress, which is shown to be in large measure predictable at the level of both word and phrase; and in the account of vowel and consonant alternations in such cases as sane-sanity, deceive-deception, decide-decision, cone-conic and democrat-democracy respectively. Secondly the book constitutes a major contribution to general phonological theory. Thus, for example, the note of the phonological component of a generative grammar is viewed as the mapping of the abstract string of formatives that constitute the surface structure output of the syntax onto concrete phonetic space, via a series of carefully formalized rules; a clearly-defined, highly abstract view is taken of underlying phonological representations, which in turn are related in a non-arbitrary fashion to the actual phonetic output; and the choice of phonological primes is motivated in terms of certain crucial departures from the earlier set of distinctive features established by Roman Jakobson--to whom the book is dedicated. Thirdly, the book is of major importance for general linguistic theory, as it makes substantive contributions to areas such as: language change and the relation between diachrony and synchrony; the nature and ordering of grammatical rules ; or the key notion of the "cyclical" applications of rules--first introduced in this work in order to handle the assignment of English stress to words and phrases beyond the single-morpheme level, and by now a crucial feature of the transformational rules of generative syntax. That this is true is attested to by the debate now being waged on nearly every aspect of phonological theory by followers of Chomsky and Halle. The book has already given rise to considerable critical discussion, ranging from specific points such as the correctness of the particular set of distinctive features established by the authors, to far deeper issues concerning the abstractness of phonological representations, the inter-relation between phonology and the syntactic and semantic components of grammar, the place of phonetics within the field of linguistics. This paper presents a preliminary analysis of homeopathy from the perspective of the demarcation problem in the philosophy of science. In this context, Popper, Kuhn and Feyerabend’s solution to the problem will be given respectively and their criteria will be applied to homeopathy, aiming to shed some light on the controversy over its scientific status. It then examines homeopathy under the lens of demarcation criteria to conclude that homeopathy is regarded as science by Feyerabend and is considered as pseudoscience (...) by Popper and Kuhn. By offering adequate tools for the analysis of the foundations, structure and implications of homeopathy, demarcation issue can help to clarify this medical controversy. The main argument of this article is that a final decision on homeopathy, whose scientific status changes depending on the criteria of the philosophers mentioned, cannot be given. (shrink)

In his seventieth year, paralleling Ezra Pound’s life work of 117 Cantos, Phil McShane began a long project of writing 117 essays, a new one to be published on the Web on the first day of every month. So far he has kept successfully to this gruelling schedule. He calls these essays ‘Cantowers’, the name involving a multi-levelled pun, partly on the word ‘canto’ itself, but also hinting at the notion that persons ‘can tower’ above the partial and confused perspectives (...) of what McShane would describe as our interim ‘axial’ state, this long dark night in our thinking. Confronting the challenges of the 20th century, from modernity and the Great War to the Holocaust and postmodern culture, Jewish thinkers have wrestled with such fundamental issues as redemption and revelation, eternity and history, messianism and politics. From the turn of the century through the 1920s, European Jewish intellectuals confronted alienation and the challenges of modernity by seeking secure grounds for a meaningful life. After the Holocaust and the fall of Nazism, the rich results of their thinking—on topics such as (...) transcendence, redemption, revelation, and politics—were reinterpreted in an atmosphere of increasing disillusion and fragmentation. In Interim Judaism, Michael L. Morgan traces the evolution of this shift in values, as expressed in the work of social thinkers, novelists, artists, and poets as well as philosophers and theologians at the beginning and end of the century. Focusing on the problem of objectivity, the experience of the transcendent, and the relationship between redemption and politics, he argues that the outcome for contemporary Jews is a pragmatic style of religiosity that has abandoned traditional conceptions of Judaism and is searching and waiting for new ones, a condition that he describes as "interim Judaism." In the US, stem cell research is at a moral impasse—many see this research as ethically mandated due to its potential for ameliorating major diseases, while others see this research as ethically impermissible because it typically involves the destruction of embryos and use of ova from women. Because their creation does not require embryos or ova, induced pluripotent stem cells offer the most promising path for addressing the main ethical objections to stem cell research; however, this technology is still in (...) development. In order for scientists to advance induced pluripotent stem cell research to a point of translational readiness, they must continue to use ova and embryos in the interim. How then are we to ethically move forward with stem cell research? We argue that there is personal integrity and value in adopting a ‘moral compromise’ as a means for moving past the moral impasse in stem cell research. In a moral compromise, each party concedes part of their desired outcome in order to engage in a process that respects the values and desires of all parties equitably. Whereas some contend that moral compromise in stem cell research necessarily involves self-contradiction or loss of personal integrity, we argue that in the US context, stem cell research satisfies many of the key pre-conditions of an effective moral compromise. To illustrate our point, we offer a model solution wherein eggs and embryos are temporarily used until non-egg and non-embryonic sources of pluripotent stem cells are developed to a state of translational readiness. The present ‘healthfare’ state in the United States in neither practically nor morally justified. The nation currently fails to provide adequate access to health care for tens of millions of uninsured citizens. To suggest that the United States' half-million physicians should provide their care as charity is an inadequate solution. The transfer of assets from the ‘haves’ to the ‘have-nots’ through taxation in a ‘healthfare state’ undermines human compassion, and fails to respect minimal moral requirements. However, alternative strategies are possible. (...) During the next 20 years health care could come to be financed on the basis of sound quasi-libertarian moral and prudential principles. In the interim deliberate political action is required to achieve novel health policy, available and affordable job and career training, and universal employment. It is possible to achieve universal access to adequate health care while sustaining individual choice, and at the same time to reduce or virtually eliminate taxpayersubsidised health care. This approach would, in time, eliminate the healthfare state and eventually encourage and even require citizens to go off the healthfare dole. (shrink)

It was proposed that the data from Monte Carlo statistical investigations be subjected to analysis of variance methods rather than the conventional techniques of tabling, graphing, and inspecting the data. Two examples in which analysis of variance methods were applied to published Monte Carlo studies were presented. It was suggested that balanced factorial designs should be used whenever possible in Monte Carlo studies so that analysis of variance methods would be directly applicable. Finally, three advantages of (...) class='Hi'>analysis of variance methods over conventional techniques were described and analysis of variance methods were contrasted with a possible alternative analytical method, multiple regression analysis.
