The contributors analyse the key roles in constructing peaceful international couple relationships and their foreign-policy outcomes, at a time of acute trust deficit in international affairs. They show that to establish prospects of conflict transformation and sustainable international policy cooperation, the most positive long-term impact derives from sub-state intermediary levels and middle-class elites promoting integration through incremental identity-change, rather than from diplomatic engagement between rivals (despite the relevance of leaders embedded in institutional frameworks for facilitating rapprochement). The Common Foreign and Security Policy (CFSP) objectives are an integral part of the overall objectives of the European Union and the policy area has developed from a purely intergovernmental form of cooperation in the days of the European political cooperation to an area in which the member states have increasingly accepted new forms of institutionalization. CFSP decisions are taken by the General Affairs Council, consisting of the ministers for foreign affairs of the member states. In spite (...) of the growing pains in the development of Common Security and Defence Policy (CSDP), the European Union has made significant strides in deploying crisis management operations. However, the issue of defining success of the CSDP is no longer measured in terms of merely launching missions, ensuring mission output, and gathering operational experience. The Twelve Member States agreed in December 1991 in Maastricht on an EconomicMonetary Union, including a single currency and an autonomous European central bank by the turn of the century, and on "an ever closer union among the peoples of Europe". The structure of the European Political Union resembles a temple with three pillars : more powers for the European Parliament on a wider ranger of policy issues, a separate framework for a common foreign and security policy, and intergovernmental (...) cooperation on justice and internal aff airs. The new Treaty wilt replace the Treaty of Rome only after ratification in all twelve member states. White EMU and EPU dominated the public agenda, the internal market programme was drawing to a close with nearly all White paper measures adopted. Emphasis shifted to implementation problems. The prolonged conflict between Commission, Parliament and Council on the 1992 budget gave a taste of increasing tensions on budgetary issues, especially between "northern" and "southern" interests. That divide wilt deepen with or without ratification of the Maastricht Treaty. The budgetary battle of 1991 was partly on external relations. The external activities of the EC were all but successful in 1991: disparate conduct in the Gulf War, failure to contain conflict in Yugoslavia, near-collapse of negotiations with the EFTA countries, deadlock in Gatt-talks and the threat of a trade war between the three trade blocks. Ibe European Common Agricultural Policy remained a major stumblingblock in the Gatt-talks. The Commission proposed a radical reform package for CAP, fiercely opposed by France until the end of the year. (shrink)

The term “patent” is an abbreviation of “letters patent”, the open form of document historically issued by the Crown for the purpose of conferring a right or privilege or otherwise communicating the royal will. In contemporary law it denotes the species of intellectual property that is granted as an inducement for the creation and disclosure of novel, inventive and industrially applicable inventions. In the UK that property is conferred under the Patents Act 1977, or with similar effect the European Patent (...) Convention (EPC), and comprises the exclusive right to use and sell a protected invention for up to 20 years. A protected invention may be any subject matter having technical character; a definition derived from the Act’s express exclusion from patentability of (among other things) discoveries, scientific theories, business methods and computer programs “as such”. Also excluded are surgical, therapeutic and diagnostic methods (for lack of industrial applicability), and inventions the commercial exploitation of which would be contrary to public policy or morality. In these and other respects the Patents Act follows the EPC, which it was the explicit purpose of that Act to implement. Patents are territorial, and are thus only valid and infringed in their country of issue. For a UK inventor to obtain protection outside the UK s/he must therefore obtain a patent from that country, either directly by applying under its laws, or if it is a party to the EPC or other intergovernmental agreement, indirectly by applying under that agreement. Cosmopolitan justice calls for extensive institutional transformations at the international level. But in the absence of a global enforcing authority, such transformations are bound to be hampered by a range of obstacles, including non-compliance and coordination problems. What solutions can a cosmopolitan thinker offer to address these challenges? In answering this question, the paper focuses on the role that international cooperation between the world?s democracies can play in promoting cosmopolitan aspirations. It argues that such cooperation has a crucial (...) role to play in executing global justice reforms; and furthermore, that the world?s democracies have a moral duty to lead the way in implementing cosmopolitan justice. The paper then suggests that a ?League of Democracies? ? an intergovernmental organization which is open exclusively to the world?s democracies ? could potentially facilitate the type of democratic cooperation that is necessary for cosmopolitan justice. The focus of this article is to explain why there is still no qualified digital signature in Denmark as defined by the EU eSignatures Directive nor any other nationwide eID even though Denmark had an early start in eGovernment, and a high level of e-readiness compared to other nations. Laying out the technological, organizational and legal dimensions of eID in Denmark, and comparing these with a number of other European countries made it possible to explain this paradox. Thus, the three (...) main reasons for the special route development has taken in Denmark seems to be concerns over privacy, lack of intergovernmental coordination and lack of cooperation between public and private sector. However, with the recent tender on digital signatures won by the PBS and the roll-out of the NemID it seems that Denmark will finally—after twenty years of delay—have an eID which can be widely used in the public as well as the private sector. The Covid-19 pandemic has affected not only health systems worldwide, but also global civil society, it has posed a global threat to humanity with significant implications and indicated weak points of postmodern civil society such as the lack of global solidarity and global cooperation, the lack of global health equity, the increase in poverty, social insecurity and deep inequality, the lack of support for the liberal international order, the lack of coordination mechanism for responding to the pandemic. Three main (...) crises of postmodern society are identified and analysed: relations of cooperation between nations and states, protests in different countries, the inadequacy of scientific and technological achievements of civilization. The analysis of these crises led to the conclusion that, along with the negative impact of the Covid-19 pandemic for humanity, it should be seen as a crucial moment for human civilization that identified gaps and directions for the development of global civil society. The transformation of society today must take place in terms of rethinking the consequences and results of globalization, and taking into account the processes of socio-political and socio-cultural transformation. Today, humanity needs to transform global society by reconsidering the role of WHO as a leading intergovernmental organization in the global health system, strengthening the role of global governance, creating a new paradigm of global health, developing global cooperation, solidarity and coordination towards global health equity. With the end of the cold war, issues of environment and economic development are assuming greater international salience. By the 1970s, environmental degradation was becoming pervasive, with growing global effects. Increasingly, global and emergent globalized problems are forcing environmental interdependence on the world. Transboundary threats cannot be addressed unilaterally by any single country or group of countries. The global environmental agenda is reviving the North-South debate and rejuvenating the Third World coalition in international fora. The encouragement of environmentally sustainable forms (...) of industrialization in the South requires expanded and improved international cooperation. However, the North’s greater resources and greater responsibility in causing global environmental degradation require its continuing involvement in the search for solutions, including ones applicable to newly industrializing countries. In June 1992, the largest intergovernmental conference ever held was convened in Rio de Janeiro to address these issues: the United Nations Conference on Environment and Development (UNCED, or the Earth Summit). It produced a consensus action plan of about 700 pages: Agenda 21. Agenda 21 presents massive challenges for international cooperation as well as for national and private actors and scientific and technical institutions. It reflects a complex configuration of demands for institutional arrangements that support environmentally sustainable technical and socioeconomic change. One of the most consistent of the Agenda 21 themes, and one of the most intractable issues, concerns “access to technology.” This can be as straightforward as diagnosing and improving the efficiency of a production process in a small manufacturing firm, or as complex as engineering a technological revolution in which production and consumption take place with virtually no material or energy loss to the environment. The selection of entry points for action is a critical strategic problem as well as an important operational issue. In this paper I identify and describe new initiatives intended to improve the environmental performance of industry in the South, and find that they largely aim to promote incremental industrial innovation through international technology transfer and diffusion. This strategy raises many questions about how to promote effective technology transfer and diffusion. (shrink)

The democratic revolutions in Eastern Europe, the speedy unification process of the two Germanies, growing economic disarray in the Soviet Union and the Gulf War put great pressure on the European Community - and raised high expectations throughout 1990. The external challenges initially seemed to slow down the internal integration process. But by the end of 1990 the Twelve committed themselves to further European political union and European economic union culminating into a central bank and a common currency. The two (...) intergovernmental constitutional conferences on EPU and EMU were installed on December 15. The execution of the internal market programme is on schedule with 70% of the directives adopted by late 1990, although the Commission expressed concern about timely transposition of the directives into national law. The EC's record on external relations is mixed : appreciation for its stepped-up cooperation with Eastern Europe, criticism for its tough stand on agriculture at the Gatt-conference, weak diplomatie performance during the Gulf War. Si l’UE ne peut être considérée comme une fédération, elle contient indéniablement des éléments fédéralistes spécifiques selon chacun de ces aspects. L’opposition dialectique entre le fédéralisme de la Cour de Justice de l’Union européenne et de l’antifédéralisme de certaines Cours constitutionnelles nationales a fini par faire prévaloir le principe de la coopération loyale (...) dans le domaine juridique, cependant que l’Union économique et monétaire a instauré le fédéralisme dans la sphère économique avec la suprématie de la Banque centrale européenne et de la monnaie unique. Dans le champ politique, pourtant, l’intergouvernementalisme qui prévaut dans les institutions européennes entrave le processus de prise de décision. On soutiendra ici que la structure politique de l’UE devrait intégrer davantage d’éléments fédéralistes, en particulier un véritable gouvernement et un Parlement européen politiquement plus puissant, mais aussi que le moyen d’y parvenir est en partie économique, à savoir le développement des ressources propres. In the 21st century, as the peoples of the world grow more closely tied together, the question of real transnational government will finally have to be faced. The end of the Cold War has not brought the peace, freedom from atrocities, and decline of tyranny for which we hoped. It is also clearer now that problems like economic risks, tax havens, and environmental degradation arising with global markets are far outstripping the governance capacities of our 20th century system of distinct (...) nation-states, even when they try to work together through intergovernmental agreements and organized bureaucracies of specialists. This work defends a cosmopolitan approach to global justice by arguing for new ways to combine the strengths of democratic nations in order to prevent mass atrocities and to secure other global public goods. While protecting cultural pluralism, Davenport argues that a Democratic League would provide a legal order capable of uniting the strength and inspiring moral vision of democratic nations to improve international security, stop mass atrocities, assist developing nations in overcoming corruption and poverty, and, in time, potentially address other global challenges in finance, environmental sustainability, stable food supplies, immigration, and so on. Classifying Madness (Springer, 2005) concerns philosophical problems with the Diagnostic and Statistical Manual of Mental Disorders, more commonly known as the D.S.M. The D.S.M. is published by the American Psychiatric Association and aims to list and describe all mental disorders. The first half of Classifying Madness asks whether the project of constructing a classification of mental disorders that reflects natural distinctions makes sense. Chapters examine the nature of mental illness, and also consider whether mental disorders fall into natural kinds. The (...) second half of the book addresses epistemic worries. Even supposing a natural classification system to be possible in principle, there may be reasons to be suspicious of the categories included in the D.S.M. I examine the extent to which the D.S.M. depends on psychiatric theory, and look at how it has been shaped by social and financial factors. I aim to be critical of the D.S.M. without being antagonistic towards it. Ultimately, however, I am forced to conclude that although the D.S.M. is of immense practical importance, it is unlikely to come to reflect the natural structure of mental disorders. (shrink)

I will explore possibilities for formulating linguistic semantics in terms of records and record types of the kind used in recent developments of Martin-L¨of type theory (Betarte, 1998, Betarte and Tasistro, 1998, Coquand, Pollock and Takeyama, 2003, Tasistro, 1997). I will suggest that they give us the tools to develop a theory which includes aspects of Montague semantics, using the lambda calculus1, Discourse Representation Theory (DRT)2, situation semantics3 and Head-Driven Phrase Structure Grammar (HPSG)4 in a single theory. Spirituality has been a part of nursing for many centuries and represents an essential value for people, including nurses and patients. Cumulative evidence points to the positive contribution of spiritually on health and wellbeing. However, there is little clarity about what spirituality means. The literature reveals that nurses have ascribed a diversity of interpretations to spirituality. However, no studies have investigated how registered nurses construct their understanding of spirituality using a critical discourse analysis approach. Therefore, the aim of this study (...) was to uncover how registered nurses construct their understanding of spirituality using a critical discourse analysis approach. Twenty registered nurses from a non‐denominational public hospital and a faith‐based private hospital were interviewed about their understanding of spirituality and practice of spiritual care. A critical discourse analysis approach was used in the examination of the interview texts to uncover underlying social and power features. Links were made between the linguistic features the registered nurses used in their interviews and the broader social context of the study. Three discourses emerged from the interview texts. These include constructing spirituality through personal religious beliefs discourse, holistic discourse and empathetic care discourse. The findings of this study have implications for nurse education and policy makers. (shrink)

Robin Cooper argues that a theory of language based (...) on action allows the adoption of a perspective on linguistic content that is centred on interaction in dialogue; this approach is crucially different to the traditional view of natural languages as essentially similar to formal languages such as logics developed by philosophers or mathematicians. At the same time, he claims that the substantial technical advantages made by the formal language view of semantics can be incorporated into the action-based view, and that this can lead to important improvements in both intuitive understanding and empirical coverage. This enterprise uses types rather than possible worlds as commonly employed in studies of the semantics of natural language. Types are more tractable than possible worlds and offer greater potential for understanding the implementation of semantics both on machines and in biological brains. (shrink)

This paper defends the description of Buddhism—by Schopenhauer and many other nineteenth-century figures—as pessimistic. Pessimism, in the relevant sense, is a dark, negative judgment on the psychological, social, and moral condition of humankind and the prospects for its amelioration. After discussing texts in the Pali canon that provide prima facie support for the charge of pessimism, two familiar responses are considered. One emphasizes the positive aspects of the human condition recognized by the Buddha; the other emphasizes the prospect held out (...) by him for the cessation of dukkha. It is argued that neither response is persuasive—not least because of a failure to appreciate the gulf between ordinary “worldling” existence and that of the arahant or enlightened person. A final section discusses the description of the arahant as “transcending the world” and the human condition. If correct, this supports the charge of pessimism. This is because pessimism is a claim about the human condition, about our being-in-the-world, and cannot therefore be refuted by the prospect of a mode of being that transcends this condition.
