The aim of this work is to argue for the idea that processes and process-based entities are to be modelled as relational structures. Relational structures are genuine structures, namely entities not committed to the existence of basic objects. My argument moves from the analysis of Whitehead’s original insight about process-based entities that, despite some residual of substance metaphysics, has the merit of grounding the intrinsic dynamism of reality on the holistic and relational characters of (...) process-based entities. The current model of process ontology requires genuine emergence and this, in turn, requires organizations, i.e., emergence in organizations. Another view about processes rely on a structural specification of processes. I suggest that the two views can be made compatible by the help of a specific sort of structures, namely relational structures. The appeal to the mathematical theory of genuine structures, category theory, reveals the formal plausibility of this convergence. According to this formal approach, genuine structures are essentially dynamic entities for they are relational, namely, as well as organizations, they are not existentially committed to particulars. Hajime Tanabe (1885-1962), the Kyoto- School philosopher of modern Japan, attempts to interpret Aristotle's ontology as being involved in the logic of self-identical being without self-negative conversion in action from his own dialectical perspective. For Tanabe, the eternal essence or Form is to be mediated by the dynamic character of matter, i.e., the temporality pertinent to the changing movement. For Aristotle, however, the essence or pure activity as the principle of being is devoid of such a dynamic mediation, (...) but is rather regarded as the past being, i.e., what it should be originally and eternally. In other words, for Aristotle, evil and matter are the lacks of goodness and the eternal Form that are identical with the essence of the individual substance. Evil is to be self-negatively mediated to goodness in free action through conversion in Tanabe's perspective. Movement pertaining to matter is not simply an incompletion of pure activity, but is rather self-negatively converted into the activity as the transcendent principle of the dialectical unification of time and eternity, matter and Form, evil and Goodness. The individual existence has freedom to unify the self-contradistinctive opposed moments, i.e., subjective action and objective being in a way of mutually negating conversion. The difference between Tanabe and Aristotle lies in that for Tanabe practice is relevant to the future, whereas for Aristotle contemplation is concerned with eternity as invariable and imperishable being since the past. While Aristotle's logic is confined to the self-identity of being in contemplation, Tanabe's logic is structured by the triadic elements of individuality, species as the relative universal, and genus as the absolute universal in terms of the negative conversion in action. Ushenko's speculative vision opened on the problem of time and its relation to logic. Profoundly concerned about the theme of time--the theme that intrinsically defines romantic irrationalism--he yet endeavored to vindicate within the bounds of temporality the sovereignty of logic so essential to the continuance of classical philosophy. The dual preoccupation with time and logic urged him into the fields of symbolic logic and relativity physics. From the flux of unrepeatable events he disengaged the laws of logic and the propositions (...) of scientific discourse, while at the same time he sought to keep both orders of entity united without injury to either. He ventured into nature as disclosed by contemporary physics and selected the category of event to supplant substance. He undertook to expound a metaphysics of events, grappled with the problem of the unity not only of nature but of the singular events that make up nature, and fixed upon the overarching structure of the space-time of relativity physics to resolve the problem. But this did not suffice. The metaphysical vision at work in these early books glimpsed at moments a principle beyond time, beyond propositions, beyond events--the principle of power. Power and Events: An Essay on Dynamics in Philosophy focused on the principle of power, integrating the other themes in terms of it. As the mature work of a significant and original thinker, Power and Events posed the principle of power as the central idea for the future course of philosophical investigation. In pursuit of its implications Ushenko embarked upon the philosophy of art in his last book Dynamics of Art and in a consistent yet startling fashion advanced the thesis that the substance of art is in effect a dynamic equilibrium of powers. By briefly reviewing three well-known scientific revolutions in fundamental physics (the discovery of inertia, of special relativity and of general relativity), I claim that problems that were supposed to be crying for a dynamical explanation in the old paradigm ended up receiving a structural explanation in the new one. This claim is meant to give more substance to Kuhn’s view that revolutions are accompanied by a shift in what needs to be explained, while suggesting at the same time the existence (...) of a pattern that is common to all of the discussed case-studies. It remains to be seen whether also quantum mechanics, in particular entanglement, conforms to this pattern. (shrink)

Introduction The article is focused on theoretical and methodological analysis of a number of social dynamics models that appeared on the basis of non-classical science. They are “challenge — response”, self-organization, a cycle of phase transitions “birth — life — death”, and “zone model”. The author reveals heuristic potential of each model, its strengths and weaknesses in the methodological aspect. The aim of the study is to consider the models of social dynamics that appeared on the basis of non-classical science (...) in social cognition, identify their methodological foundations; compare these theoretical constructs with each other, and to improve these structures in theoretical and methodological aspects. Methods The following general scientific methods were used in the study: modeling, structural-functional, systemic and comparative analysis. The scientific novelty of the study. The author traces evolution of how the models under consideration have been forming in the framework of social cognition, and points out the epistemological foundations of their occurrence. In the “challenge-response” model, the author identifies its basic ideas and classifies the sources that generate historical “challenges” and the entities that form “answers” to them. The author specifies that the model of self-organization appeared long before the 20th century, but only thanks to the systematic approach and synergetics it acquires the necessary theoretical level. The author also points out positive aspects and limitations of the self-organization model in relation to social cognition. The author specifies the full structure of the “zone model” in social cognition, which includes the following elements: the center, the middle part, the intermediate space, and the periphery. Modifications of this model are shown in the framework of the world-system approach and other social theories. Results. The study demonstrates that in relation to each model, empirical material was first accumulated, and only then it was theoretically generalized on the basis of non-classical science. It is shown that the main merit of the world-system analysis is creating a “zone” model of social dynamics. The author recognizes that the zone model to the maximum extent includes other theoretical constructions: “challenge - answer”, self-organization, the cycle of phase transitions “birth - life - death”. It is assumed that in the future, theoretical approaches in the humanities are more likely to include new methodological tools. Conclusions. The author reveals continuity of intellectual instruments among various non-classical models of social dynamics, shows separate stages of the models evolution. It is stated that in the framework of the non-classical methodology of social cognition, there is a place for the approaches generated by classical science (for example, the assumption of linearity as a way of developing society). Arthur Kaufmann is one of the most prominent figures among the contemporary philosophers of law in German speaking countries. For many years he was a director of the Institute of Philosophy of Law and Computer Sciences for Law at the University in Munich. Presently, he is a retired professor of this university. Rare in the contemporary legal thought, Arthur Kaufmann's philosophy of law is one with the highest ambitions — it aspires to pinpoint the ultimate foundations of law by explicitly (...) proposing an ontology, a general theory of knowledge and concept of a person. Kaufmann's work derives, first of all, from the thinking of Gustav Radburch, his teacher, and then from ideas of Karl Engish and Hans-Georg Gadamer. The philosophy undertakes to pursue the ultimate foundation of law, law which is understood by Kaufmann, first of all, as a "concrete judgement" that is, what is right in a concrete situation. Justice belongs to the essence of law and "unjust law" is contradictio in adiectio. Kaufmann opposes all those theories, which as the only foundation for establishing just law (Recht) adopt legal norms (Gesetz). In Kaufmann's opinion , such theories are powerless in the face of all types of distortions of law rendered by political forces. He suggests that the basic phenomenon which needs to be explained and which cannot be disregarded by a philosopher of law is so-called "legal lawlessness" ("Gestzliches Unrecht"). "Legal lawlessness" which forms a part of life experience for the people of twentieth century totalitarian states. It proved "with the accuracy of scientific experiment" that the reality of law consists of something more than bare conformity with legal norms. The existence of lex corrupta indicates that law contains something "non-dispositive" which requires acknowledgment of both law-maker and judge. Kaufmann, accepting the convergent concept of truth and cognition, assumes that "non-dispositive" content, emerging as the conformity of a number of cognitive acts of different subjects (inter-subjective communicativeness and verifiability), indicates the presence of being in this cognition. The questions "What is law?" and "What are the principles of a just solution?" lead straight to the ontology of law, to the question about the ontological foundations of law. Kaufmann discerns the ontological foundations of law in the specifically understood "nature of things" and, ultimately, in a "person". He proposes a procedural theory of justice, founded on a "person". In my work, I undertake to reconstruct the train of thought which led Kaufmann to the recognition of a "person" as the ontological foundation of law. In the first part, the conception of philosophy adopted by Kaufmann, initial characteristics of law — of reality which is the subject of analysis, as well as, the requirements for proper philosophical explanation of law posed by Kaufmann are introduced. In the second, Kaufmann's reconstruction of the process of the realisation of law is presented. Next, the conception of analogy which Kaufmann uses when explaining law is analyzed. In the fourth part, Kaufmann's conception of ontological foundations of law is discussed. A critical analysis is carried out in which I demonstrate that the theory of the ontological foundation of law proposed by Kaufmann and the concept of a person included in it do not allow a satisfac¬tory explanation of the phenomenon of "legal lawlessness" and lead to a number of difficulties in the philosophical explanation of law. Finally, the perspectives of a proper formulation of the issue of the ontological foundations of law are drafted in the context of the analyzed theory. My interest is centered on the conception of philosophy adopted by Kaufmann, according to which the existence of the reality is inferred on the basis of a certain configuration of the content of consciousness, whereas at the point of departure of philosophy of law, the data to be explained is a certain process, which is, basically, a process of cognition, while the reality appears only as a condition for the possibility of the occurrence of the process. I wish to argue that the difficulties which appear in the explanation of law are a consequence of the assumed fundamental philosophical solu¬tions, which seem to be characteristic, though usually not assumed explicitly, in philoso¬phy and theory of law dominant at present in continental Europe. Thereby, I wish to show the significance of ontological and epistemological solutions to the possibility of a proper formulation of the problems posed by philosophy and theory of law. Kaufmann proclaims himself in favour of a philosophy which poses questions about the ultimate foundations of understanding of the reality. In epistemology, he assumes that answers to the questions "What is reality like?" and ultimately "What is real?" are inferred on the basis of uniformity of a cognitive acts of different subjects. Cognition of the reality is accomplished exclusively through the content of conceptual material. The two fundamental questions posed by philosophy of law are "What is just law?" and "How is the just law enacted?" The latter is a question about the process of achieving a solution to a concrete case. Since, in Kaufmann's opinion, law does not exist apart from the process of its realisation, an answer to the question about the manner of realisation of law is of fundamental significance to answering the question: "What is law?" and to the explanation of the question about the ontological grounding of law, which is, as well, the foundation of justice. The proper solution has to take into account the moment of "non-dispositive" content of law; its positiveness understood as the reality and, at the same time, it has to point to the principles of the historical transformation of the content. Law, in the primary meaning of the word, always pertains, in Kaufmann's opinion, to a concrete case. A legal norm is solely the "possibility" of law and the entirely real law is ipsa res iusta, that which is just in a given situation. Determination of what is just takes place in a certain type of process performed by a judge (or by man confronted with a choice). Kaufmann aims to reconstruct this process. A question about the ontological foundation of law is a question about the ontological foundations of this process. In the analyzed theory it is formulated as a question about the transcendental conditions, necessary for the possibility of the occurrence of the process: how the reality should be thought to make possible the reconstructed process of the realisation of law. Kaufmann rejects the model for finding a concrete solution based on simple subsump¬tion and proposes a model in which concrete law ensues, based on inference by analogy, through the process of "bringing to conformity" that which is normative with that which is factual. Kaufmann distinguishes three levels in the process of the realisation of law. On the highest level, there are the fundamental legal principles, on the second legal norms, on the third — concrete solutions. The fundamental principles of law are general inasmuch as they cannot be "applied" directly to concrete conditions of life, however, they play an important part in establishing norms. A judge encounters a concrete situation and a system of legal norms. A life situation and norms are situated on inherently different levels of factuality and normativeness. In order to acquire a definite law both a norm (system of norms) and a life situation (Lebenssachverhalt) should undergo a kind of "treatment" which would allow a mutual conformity to be brought to them. Legal norms and definite conditions of life come together in the process of analogical inference in which the "factual state" ("Tatbestand") — which represents a norm, and in the "state of things" ("Sachverhalt") — which represents a specific situation are constructed. A "factual state" is a sense interpreted from a norm with respect to specific conditions of life. The "state of things" is a sense constructed on the basis of concrete conditions of life with respect to norms (system of norms). Legal norms and concrete conditions of life meet in one common sense established during the process of realisation of law. Mutatis mutandis the same refers to the process of composition of legal norms: as the acquisition of concrete law consists in a mutual "synchronization" of norms and concrete conditions of life, so acquisition of legal norms consists of bringing to conformity fundamental principles and possible conditions of life. According to Kaufmann, both of these processes are based on inference through analogy. As this inference is the heart of these processes it is simultaneously a foundation finding just law and justice. How does Kaufmann understand such an inference? As the basis for all justice he assumes a specifically interpreted distributive justice grounded on proportionality. Equality of relations is required between life conditions and their normative qualification. Concrete conditions of life are ascribed normative qualification not through simple application of a general norm. More likely, when we look for a solution we go from one concrete normative qualified case to another, through already known "applications" of norms to a new "application". The relation between life conditions and their normative qualifica¬tion has to be proportional to other, earlier or possible (thought of) assignments of that which is factual to that which is normative. Law as a whole does not consist of a set of norms, but only of a unity of relations. Since law is a, based on proportion, relative unity of a norm and conditions of life, in order to explain law in philosophical manner, the question about ontological base of this unity has to be asked. What is it that makes the relation between a norm and conditions of life "non-dispositive"? What is the basis for such an interpretation of a norm and case which makes it possible to bring a norm and conditions of life into mutual "conformity"? This is a question about a third thing (next to norms and conditions of life), with respect to which the relative identity between a norm and conditions of life occurs, about the intermediary between that which is normative and that which is factual and which provides for the process of establishing of norms, as well as, finding solutions. It is the "sense" in which the idea of law or legal norm and conditions of life have to be identical to be brought to mutual "conformity". In Kaufmann's opinion such a sense is nothing else but the "nature of things" which determines the normative qualification of the reality. Since establishment of this "sense" appears to be "non-dispositive" and controlled inter-subjectively (namely, other subjects will reach a similar result) so, in conformity with the convergent concept of truth, the "nature of things" must be assigned a certain ontological status. According to Kaufmann this is a real relation which occurs between being and obligation, between the conditions of life and normative quality. However, it should be underlined that from the point of view of the analyzed system the "nature of things" is a correlate of constructed sense, a result of a construction which is based on the principle of consistent understanding of senses ("non-normative" and "normative") and is not a reality which is transcendent against the arrangement of senses. In Kaufmann's theory, inference from analogy appears to be a process of reshaping the concepts (senses) governed by tendency to understand the contents appearing in relations between that which is factual and that which is normative in a consistent way. The analogical structure of language (concepts) and recognition of being as composed of an essence and existence is an indispensable requirement for the possibility of the realisation of law, based on specifically understood inference from analogy. It is necessary to assume a moment of existence without content which ensures unity of cognition. Existence emerges thus as a condition of the possibility of cognition. According to Kaufmann, the "nature of things" is the heart of inference through analogy and the basis for establishment of finding of law. Inference from the "state of things" to a norm or from a norm to the "state of things" always means inference through the "nature of things". The "nature of things" is the proper medium of objective legal sense sought in every cognition of law. In Kaufmann's view, the question whether the "nature of things" is ultima ratio of interpretation of law or is only a means of supplement gaps in law or whether it is one of the sources of law, is posed wrongly. The "nature of things" serves neither to supplement the gaps nor is it a source of law as, for example, a legal norm may be. It is a certain kind of "catalyst" necessary in every act of making law and solving a concrete case. Owing to "nature of things" it is possible to bring to a mutual conformity the idea of law and possible conditions of life or legal norms and concrete conditions of life. In Kaufmann's conception the "nature of things" is not yet the ultimate basis for understanding the "non-dispositiveness" of law. The relation between obligation and being is determined in the process of the realisation of law. Both the process itself and that which is transformed in this process are given. A question about the ontological bases of "material" contents undergoing "treatment" in the process of the realisation of law and about being which is the basis of regularity of the occurrence of the process arises. Only this will allow an explanation that the result of the process is not optional. Thus, a question about reality to which law refers and about the subject realising the law has to be formed. To this, Kaufmann gives the following answer: that which is missing is man but not "empirical man" but man as a "person". A "person" understood as a set of relations between man and other people and things. A "person" is the intermediary between those things which are different — norm and case are brought to conformity. A "person" is that which is given and permanent in the process of the realisation of law. It determines the content of law, is "subject" of law; this aspect is described by Kaufmann as the "what" of the process of realisation of law. A "person" consists of precisely just these relations which undergo "treatment" in the process. On the other hand, a "person" is "a place" in which the processes of realisation of law occur, it is the "how" of normative discourse, a "person" is that which determines the procedure of the process, being "outside" of it. This aspect of a "person" is connected with the formal moment of law. A "person" being, at the same time, the "how" and the "what" of the process of the realisation of law, is also, to put it differently, a structural unity of relation and that which constitutes this relation (unity of relatio and relata). According to this approach a "person" is neither an object nor a subject. It exists only "in between". It is not substance. Law is the relation between being and obligation. That which is obligatory is connected with that which is general. That which is general does not exist on its own, it is not completely real. Accordingly, a "person" as such is also not real. It is relational, dynamic and historical. A "person" is not a state but an event. In Kaufmann's opinion, such a concept of a "person" helps to avoid the difficulties connected with the fungibility of law in classical legal positivism. A "person" is that which is given, which is not at free disposal and secures the moment of "non-dispositiveness" of law. Kaufmann concludes: "The idea (»nature«) of law is either the idea of a personal man or is nothing". Theory points at the structure of realising law and explains the process of adoption of general legal norms for a concrete situation. The analysis has shown however, that in this theory a satisfactory answer to the question about the ultimate foundations of law is not given. It seems that in the analyzed theory the understanding of human being takes place through understanding of law. What is good for man as a "person", what is just, what a "person" deserves may be determined only against the existing system of law. A "per¬son" adopted as a basis of law is the reality postulated in the analysis of the process of the realisation of law. It is a condition of possibility of this process ( explaining, on one hand, its unity and, on the other hand, the non-dispositive moments stated in this process). A "person" in the discussed theory is entirely defined by the structure of law, it can be nothing more than that which is given in law, what law refers to, what law is about. Being, which is a "person", is constituted by relations between people and objects, the relations which are based on fundamental links between norms and conditions of life established in a process of bringing them to conformity. It has to be assumed that man as a "person" is a subject of law only as far as realising law "treats" given senses according to their current configuration. The system of law is a starting point and it describes in content what man is as a "person". Moreover, being a "person" is the condition for entering legal relations. Consistently, Kaufmann writes that "empirical man" is not the subject of law, man is not "out of nature" a "person". People become "persons" due to the fact that they acknowledge each other as "persons" — acknowledging, at the same time, law. This acknowledgement is a con¬dition of existence, of the possibility of the occurrence of process of realisation of law and of constituting legal relations which ultimately constitute a "person". Kaufmann assumes, that law tends towards a moral aim: it may and must create an external freedom, without which the internal freedom to fulfil moral obligations cannot develop. However, this postulate is not based on the necessary structure of human being. From the point of view of his system, it is nothing more than only a condition for the possibility of the occurrence of the process of the realisation of law — lack of freedom would destroy the "how" of this process. Thus, the postulate to protect the freedom of personal acts has to be interpreted, in accordance with the analyzed theory, as a postulate, the fulfilment of which aims ultimately at the accomplishment of the very same process of realisation of law itself and not the realisation of a given man. Kaufmann considers a "person" to be an element which unites the system of law as a whole. Law is a structure of relations, which are interdependent and inter-contingent. Consequently, a "person" which is to form the ontological basis of law has to be entity consisting of all relations. Being also the "how" of the process of realisation of law, if a "person" is to warrant its unity, it has to be a common source for all procedures. Hence, a single "person" would constitute a subject of law. Man appears to be only a moment of a certain entirety, realisation of which should be an aim of his actions. Law, creating a "person" as an object and subject of law becomes a primary entity. In the analyzed theory, the basis for determination of aims which law sets to man is not the allocation of man-subject to something which improves him but rather, such relation is only just constituted by law. A question appears, why should aims set in law also be the aims of "empirical man"? Why is this "empirical man" to be punished in the name of a "person" understood in such a way? If, however, it is assumed that what is man is determined by a system which is superior to him, then man has to be understood only as a part of a whole and there are no grounds to prohibit istrumental treatment of man and so the road to all aspects of totalitarianism might be opened. A problem of the application of created theory to the reality arises, the reality which the theory pretends to explain. Ultimately in his theory Kaufmann does not give any systemic grounds for a radical questioning of the validity of any legal norms. Every new norm becomes an equal part of system of norms. It is only its interpretation and application to given conditions of life that may be disputable, however, this refers to all norms without exception. Cohesive inter-pretation of norms and applications is necessary and sufficient for the acquisition of just law. New norms have to be interpreted in the light of others, correspondingly, the other norms require reinterpretation in the light of the new ones. Contradiction in interpretation of a norm does not form a basis for questioning norms but may serve only to question the manner of their interpretation (understanding). Therefore, no grounds exist to assume any legal norm as criminal or unjust, and in consequence, to question any consistently realised system based on formally, properly established norms, as "legal lawlessness". As law and a "person" do not exist without the process of realisation of law, the role of legal safety becomes crucial as the condition for the possibility of the occurrence of the process of realisation of law. Denying legal safety would be tantamount to negation of law in general (also of moral law) as negation of safety takes away, at the same time, the basis for occurrence of the process of realisation of law. Moreover, any lack of legal safety would also mean lack of a basis for the existence of man as a "person". Kaufmann's thesis, that civil disobedience is legalized only when it has a chance to lead to success, consistent with his concept of the foundations of law, seems to point directly to conclusions which deny the facts taken under consideration and doubtlessly Kaufmann's own intentions, since it would have to be assumed that accordingly there are no grounds to question a legal system in force based on violence which secures its operation. Force finally seems to determine which one of the mutually irreconcilable normative systems constitute law and which does not. A legitimate position is one which leads to success, it is the weaker system which is negated. If so, then basically violent imposition of law is not an act directed against the law in force but, to the contrary, realisation of law. In the context of the new system the former system of law may be talked about as unjust solely in the sense of being incapable of being consistently united with the new. However, at the base, ultimately, lies force which reaffirms differences and excludes from the process of realisation of law certain norms and their interpretations. Kaufmann was aiming at grounding of that which is "non-dispositive" in a certain given framework of interpretation. Nevertheless, he does not provide foundations for the understanding of phenomena, which he undertakes to explain at a point of departure. Instead of explaining them the theory negates the possibility of their existence. The reality postulated in regard to "non-dispositive" moments of the reconstructed process of acquiring law consist of a specifically understood "person", which appears in Kaufmann's conceptions as a condition of the possibility of the realisation of law. According to this approach understanding of a "person" may be only a function of law. To understand "legal lawlessness" and foundations of justice it is necessary to look for such theory of law in which understanding of man as a "person" and being is not a function of understanding of law (in which a "person" is not only a condition for possibility of reconstructed process of realisation of law; for possibility of cognition processes). It seems necessary to start from theory of being and a "person" based on broader experience than the one assumed by Kaufmann and reconstruct the ontological foundations of the process of realisation of law only in such perspective. Kaufmann points out that that to which law refers is ipsa res iusta a concrete relation of man to other people and things. This relation, in his theory, appears to be basically only just constituted by law (normative senses "applied" to conditions of life). Therefore, understanding the relation between a given man and other people and things which constitute the aim of his actions, that is understanding of good, is enacted against the background of constitution of senses; constitution which is a result of a process aiming towards consistent understanding of particular contents (of nor¬mative and non-normative senses). "Being" is secondary towards constructed senses it is only their correlate. The primary relation consists of relation of a man to law (system of norms), while the secondary relation is one of man to something which is the aim of his action (relation between man and good). Considering such approach it is difficult to envision a satisfying answer to the fundamental question: why does law put concrete man under any obligation to obey it? The source of this problem can be seen in reduction of the base for understanding good to content of obligation formulated in auto-reflection. Such reduction seems to be a consequence of Kaufmann's adoption of "convergent concept of truth" and in con¬sequence his recognition of indirect, essentialistic grasp of reality formulated in concepts as the basic and only foundation of theory of being and of law. In view of such an approach, analogy of law, concepts and being is the condition for the possibility of the process of transformation of senses which aims at consistent interpretation of all law. Existence is postulated with respect to the possibility of unity of experience and cognition. However, also a different approach to understanding of the problem of being and good is possible. In spontaneous cognition being is affirmed, first of all, not as a certain, non-contradictory, determined content, but as something existing. Together with a cer¬tain content (passed indirectly through notions) existence of being is co-given. The basis for unity of being is not formed by the consistence of content, as it is in the case of the theories departing from the analysis of cognition processes, but by an act of existence realising content (essence). Such an approach makes it also possible to go beyond the convergent concept of truth. It is worth mentioning that allocation of an agent to good is realised not only by the content of duty. A statement that something is good is primary with respect to determination of this good in content. The recognised good always bears some content, however, there are no reasons to base the concept of good exclusively on indirect, formulated in concepts cognition. As primary, can be adopted the relation of man to good and not of man to law. Determination in content appears to be only an articulation of aspectual cognition of being, as an object of action. In such a case the basis for relative unity of norm and conditions of life is not the "nature of things" understood as correlate of sense but it is relation to good based on internal constitution of man as potential, not self-sufficient being. It does not mean, that the moments of the process of realisation of law singled out by Kaufmann are not important to determination of what is just. He, quite rightly, points to significant role played by norms in the evaluation of concrete situations, in man's search for closer specification in content of good innate to him. The structure of process of determining law for a concrete situation, to a great degree corresponds to the processes of determining law which take place not only in the legal sciences. Kaufmann's analyses of the process of realisation of law show the complexity of the structure of these processes and point towards important moments allowing a better understanding of law and man. Nevertheless, these analyses cannot be a basis for construction of philosophical theory of law, theory which hopes to point out the ultimate, ontological foundations for understanding law. Kaufmann's results may become fully valid only in a more general perspective including broader experience at the point of departure. (shrink)

It seems obvious that signs in visual art and musical notation are static carriers of visual and acoustic information. Both types of sign, however, represent dynamic processes. In real space-time, there exists no static visible thing or static audible sound. The sources of visible or audible information are dynamic – i.e. complementary substantialenergetic-informational – entities extending in space-time. The same is true of an artificial or organic receiver and processor of visual or audible information. Reality and semiosis (...) – to be, to be perceived, and to be understood or to communicate – are dynamic processes. From a semiotic point of view, thus, pictures, photographic or artistic sign structures can’t be icons – in any case, if icons in a Peirceian manner are understood as signs representing objects for an interpretant by similarity . Similarity between icon and object is not a static precondition but a dynamic result of visual semiosis, i.e. of categorizing. Seeing something or hearing something is, as a consequence, not an “intuitive” or instantaneous Gestalt shift between representamen and object ongoing in an interpretant. And so, according to Fernande SaintMartin 1990: “visual semiotics … has to adopt an epistemology which is more in agreement with the dynamics of observed phenomena. It will recognize that matter is not inertness, but energy.” If the material carrier of semiosis, the representamen, already is to be understood as energy or dynamic process, all the more the whole complementary triadic sign-relation – object-representamen-interpretant – has to be understood as energetic information flow. This is being recognized in the transition from naturalistic, i.e. reproducing or mapping art, to modern, i.e. processing or interpreting/transducing art. Paul Klee 1990 for example says about the semiotic function of visual art: “Art doesn’t reproduce the visible but makes visible” . And he correlates the artistic activity of visualizing with the primordial, cosmogonic process of formation: “Reduced to the primordial process of formation, to creation, the process of cell division emerges” . Visual artistic semiosis is, thus, obviously to be understood as the process of emerging dynamic sign structures. It is the skill of the painter that makes the static results of dynamic semiosis “readable” for the viewer as signs – lines and surfaces - of the dynamic visual meaning of the picture. (shrink)

Biological objects are often constructive dynamic systems whose structures evolve as a consequence of their internal dynamics, which in turn is affected by the overall structure. As very few tools are presently adapted to tackle constructive dynamic systems, they constitute fascinating challenges for modeling/simulation. In cell biology, the secretory process in eukaryotic cells corresponds to this type of system, as it appears to autonomously generate new structures as a result of its molecular dynamics. Here I briefly (...) review the only documented case of a membrane-bounded intracellular compartment whose very existence strictly depends on its continued functioning. Indeed, the Golgi apparatus of the yeast Saccharomyces cerevisiae appears at steady-state as a continuously renewed set of transitory membrane-bounded structures that self-mature, rather than as a permanent entity. On the basis of this case and of recent advances in related molecular studies, a detailed model is proposed, that encompasses the birth of a yeast Golgi element and bridges its molecular and morphogenetic aspects. This model is extended to briefly outline three evolutionary inventions, from S. cerevisiae to another yeast, Pichia pastoris, on to plant, and on to animal cells: stacking, stabilizing and aggregating the primary Golgi elements. How, if at all, consciousness can be part of the physical universe remains a baffling problem. This article outlines a new, developing philosophical theory of how it could do so, and offers a preliminary mathematical formulation of a physical grounding for key aspects of the theory. Because the philosophical side has radical elements, so does the physical-theory side. The philosophical side is radical, first, in proposing that the productivity or dynamism in the universe that many believe to be responsible for (...) its systematic regularities is actually itself a physical constituent of the universe, along with more familiar entities. Indeed, it proposes that instances of dynamism can themselves take part in physical interactions with other entities, this interaction then being “meta-dynamism” (a type of meta-causation). Secondly, the theory is radical, and unique, in arguing that consciousness is necessarily partly constituted of meta-dynamic auto-sensitivity, in other words it must react via meta-dynamism to its own dynamism, and also in conjecturing that some specific form of this sensitivity is sufficient for and indeed constitutive of consciousness. The article proposes a way for physical laws to be modified to accommodate meta-dynamism, via the radical step of including elements that explicitly refer to dynamism itself. Additionally, laws become, explicitly, temporally non-local in referring directly to quantity values holding at times prior to a given instant of application of the law. The approach therefore implicitly brings in considerations about what information determines states. Because of the temporal non-locality, and also because of the deep connections between dynamism and time-flow, the approach also implicitly connects to the topic of entropy insofar as this is related to time. "Ethical Leadership" in modern multicultural corporations is first the consideration of different personal and cultural value systems in decision-making processes. Second, it is the assignment of responsibility either to individual or organisational causalities. The task of this study is to set the stage for a distinction between rational entities and the arbitrary preferences of individuals in economic decision making processes.Defining rational aspects of behaviour in economics will lead to the formal structures of organisational systems, which are independent of (...) concrete but varying values. Luhmann''s Theory of systems of communication describes the internal dynamic forces of economic communication processes in terms of formal structures. On the other hand Habermas'' Theory of discourse integrates the previous relationship between individual subjectivity and rational behaviour. Habermas gives an indication of how to separate subjective values and meaning from rational arguments in rational communication processes. The translation of these theoretical structures into practical applications for decision making processes and decision taking acts links the ethical, or value-oriented, context precisely to both individual and organisational areas of responsibility. The purpose of this article is to introduce, interpret, and develop two incompatible process -ontological theories of personal identity that have received little attention in analytic metaphysics. The first theory derives from the notion of personal identity proposed in Alfred North Whitehead’s philosophy, but I interpret this notion differently from previous commentators. The Whiteheadian theory may appeal to those who believe that personal identity involves an entity or entities that are essentially dynamic, but has nothing to do with (...) diachronic objectual identity : the binary equivalence relation that every entity bears to itself, and only to itself, even after undergoing intrinsic change. The Whiteheadian theory may also find favor with those who, like Whitehead, reject the possibility of pure processes and hold that in every becoming, something—which need not be an object, thing, or individual substance—becomes. The second theory derives from the notion of recurrent dynamics presented in Johanna Seibt’s General Process Theory. The Seibtian theory may appeal to those who believe that personal identity involves not only an entity or entities that are essentially dynamic, but also the relation of diachronic objectual identity. The Seibtian theory may also find favor with those who, like Broad and Sellars, find reason to postulate pure processes. (shrink)

Many late medieval Aristotelians assumed that a natural substance has several substantial forms in addition to matter as really distinct parts. This assumption gave rise to a unity problem: why is a substance more than a conglomeration of all these parts? This paper discusses Francisco Suárez’s answer. It first shows that he rejected the idea that there is a plurality of forms, emphasizing instead that each substance has a single form and hence a single structuring principle. It then examines his (...) account of the relationship between matter and form. While accepting the thesis that these two parts are really distinct entities, he claimed that there is a special “mode of union” that binds them together. With this account, he defended the essential unity of a natural substance, but he transformed the program of Aristotelian metaphysics: not substances, but entities and modes inside them, are now the basic building blocks of reality. Concepts are highly theoretical entities. One cannot study them empirically without committing oneself to substantial preliminary assumptions. Among the competing theories of concepts and categorization developed by psychologists in the last thirty years, the implicit theoretical assumption that what falls under a concept is determined by description () has never been seriously challenged. I present a nondescriptionist theory of our most basic concepts, which include (1) stuffs (gold, milk), (2) real kinds (cat, chair), and (3) individuals (Mama, Bill Clinton, (...) the Empire State Building). On the basis of something important that all three have in common, our earliest and most basic concepts of substances are identical in structure. The membership of the category like that of is a natural unit in nature, to which the concept does something like pointing, and continues to point despite large changes in the properties the thinker represents the unit as having. For example, large changes can occur in the way a child identifies cats and the things it is willing to call without affecting the extension of its word The difficulty is to cash in the metaphor of in this context. Having substance concepts need not depend on knowing words, but language interacts with substance concepts, completely transforming the conceptual repertoire. I will discuss how public language plays a crucial role in both the acquisition of substance concepts and their completed structure. (shrink)

One of several important issues that inform contemporary philosophy of chemistry is the issue of structural explanation, precisely because modern chemistry is primarily concerned with microstructure. This paper argues that concern over microstructure, albeit understood differently than it is today, also informs the chemical philosophy of Robert Boyle. According to Boyle, the specific microstructure of ‘chymical atoms’, understood in geometric terms, accounts for the unique essential properties of different chemical substances. Because he considers the microstructure of ‘chymical atoms’ as (...) semi-permanent, Boyle considers these stable entities as operationally irreducible, even if they are not ontologically fundamental. While it is generally believed that our contemporary concern over structural explanation is a function of modern chemistry’s emphasis on microstructure, this discussion of structural explanation in Boyle will serve as a case study to illustrate the manner in which many of our contemporary concerns have deeply historical origins and the manner in which the history of chemistry can substantively inform issues in contemporary philosophy of chemistry. In lieu of an abstract, here is a brief excerpt of the content:Crispin Sartwell SUBSTANCE AND SIGNIFICANCE: A THEORY OF POETRY Jean-Paul Sartre once said that what distinguishes the writer of poetry from the writer of prose is that the poet "considers words as things and not as signs."1 I think that this claim embodies a deep insight into the nature of poetry, and I want to develop it into a reasonably precise account of what poetry is. The immediate problem (...) that arises from Sartre's view is that it seems mysterious how anyone could regard words as objects without being fundamentally confused. For it is clear that Sartre thinks that the poet regards words as material objects. But a word, or a sequence of words such as a poem, is not a material object. A word or a poem can appear in many places at the same time; it can be inscribed, read, recited, or mentally traversed. The poem "itself" is not identical with any of these particular manifestations. I can burn my copy of Shakespeare's sonnets, but I cannot burn Shakespeare's sonnets; a poem is, in the phrase of Arthur Danto, "logically incombustible."2 Shakespeare's manuscript is lost; the sonnets live on. My recitation of a poem ends, say, at three o'clock, but the poem itself does not cease to exist at three o'clock. If identical objects cannot have divergent properties, then the poem is not identical with any of its particular manifestations. Nor can we identify a poem as the scattered, diffuse object consisting of all its inscriptions or recitations; to do so would be to identify the poem with a (perhaps massive) repetition of itself. A sonnet has fourteen lines, but the set of all the inscriptions ofShakespeare's "Shall I compare thee to a summer's Philosophy and Literature, © 1991, 15: 246-259 Crispin Sartwell247 day" is an item with an extraordinarily large number oflines. The poem itself does not grow as the set of its inscriptions grows. The poem, to repeat, is not a material object; rather, it is that which all the manifestations of it have in common; it is the structure or sequence which all the inscriptions and recitations share in virtue of which they are inscriptions and recitations of the poem. Now I do not intend to tackle the ontological problems surrounding poetry in any full-fledged way; to do so would strand us in extremely rugged metaphysical terrain. The ontological status of a poem might be in some ways analogous to the ontological status of a number, a property, and other purportedly "abstract" objects. And one cannot distinguish works ofpoetry from works ofprose (and, again, the project here is to make such a distinction) ontologically. Moby Dick is logically incombustible, as are, discouragingly enough, government reports. I propose, then, to adopt a familiar way of talking about the poem itself in distinction from its inscriptions, recitations, and mental traversais; I shall term a poem a type of which there are tokens. The tokens are the inscriptions, recitations, and so forth; the type is what these inscriptions and recitations have in common. The type/token terminology was first adopted by Peirce, and has been taken up by Wollheim, among many others.3 In itself, such terminology does little to disperse various ontological problems, but I am going to proceed in the touching faith that such puzzles can eventually be solved, because the theory of poetry I will develop depends on some such distinction being made out. And though the theory could perhaps be reconstructed even on a fairly thoroughgoing nominalism, I am going to treat poems as abstract entities, because as far as I can see, nominalism of the type endorsed by Nelson Goodman, for example, introduces more difficulties than it solves. Goodman identifies inscriptions ofa poem (for example) as items which display sameness ofspelling, which, relative to a system of notation, correspond exactly with regard to the sequence of letters, spaces, and punctuation marks.4 Among other things, this makes poetry (or any linguistic item) impossible to translate into different languages; it even makes it impossible to update, say, The Canterbury Tales into contemporary spelling. This article examines some aspects of the natural philosophy of Juan Gallego de la Serna, royal physician to the Spanish kings Philip III and Philip IV. In his account of animal generation, Gallego criticizes widely accepted views: (1) the view that animal seeds are animated, and (2) the alternative view that animal seeds, even if not animated, possess active potencies sufficient for the development of animal souls. According to his view, animal seeds are purely material beings. This, of course, raises (...) the question of how living beings can arise from inanimate matter. Gallego is aware that two other thinkers who understood animal seeds as purely material beings, Duns Scotus and the Louvain-based physician Thomas Feyens, did not solve this problem. Gallego’s solution makes use of the notion of incomplete entities developed by the Spanish Jesuit Francisco Suarez. While Suarez applies this notion to soul and body in order to explain why souls have a natural tendency towards organic bodies and organic bodies have a natural tendency towards souls, Gallego applies this notion to the natural tendency of animal seeds towards each other and towards further substances in their respective environment. In his view, this natural tendency of animal seeds to incorporate further substances explains that origin of material structures complex enough to constitute an animal soul. (shrink)

This paper is devoted to the late Leibnizian doctrine of vinculum substantiale. In the first section I sketch the old problem of possibility of composite substances. This possibility is refuted on the ground of Monadism (presented in section two). However Leibniz’s correspondence with Des Bosses contains new thoughts concerning composite substances. A vinculum enters the stage as a real unifier, transforming aggregates of monads into genuine substances (section three). In the last section I give a systematic interpretation (...) of a vinculum.I start with the thesis that every composed thing, which is not a pure plurality of objects, must have two structures: the whole-parts structure and the subject-properties structure. In the case of substances the latter is ontologically prior over the former. A vinculum is a subject-of-properties (accidents) determining such a way of composition which makes a compound entity a true substance. Since Leibniz still thought a vinculum unifies independent (existentially and with regard to activity) substances he was inclined to separate a vinculum from the integrated monads and finally conceived it as an additional relatively independent monad-like substance. This book explores a fundamental tension in Aristotle's metaphysics: how can an entity such as a living organisma composite generated through the imposition of form on preexisting matterhave the conceptual unity that Aristotle demands of primary substances? Mary Louise Gill bases her treatment of the problem of unity, and of Aristotle's solution, on a fresh interpretation of the relation between matter and form. Challenging the traditional understanding of Aristotelian matter, she argues that material substances are subverted by matter (...) and maintained by form that controls the matter to serve a positive end. The unity of material substances thus involves a dynamic relation between resistant materials and directive ends. Aristotle on Substance offers both a general account of matter, form, and substantial unity and a specific assessment of particular Aristotelian arguments. At every point, Gill engages Aristotle on his own philosophical ground through the detailed analysis of central, and often controversial, texts from the Metaphysics, Physics, On Generation and Corruption, De Anima, De Caelo, and the biological works. The result is a coherent, firmly grounded rethinking of Aristotle's central metaphysical concepts and of his struggle toward a fully consistent theory of material substances. (shrink)

The Continuous Parameter Estimation Model is applied to develop individual genomic-level heritabilities for the latent hierarchical structure and developmental dynamics of Life History (LH) strategy LH strategies relate to the allocations of bioenergetic resources into different domains of fitness. LH has moderate to high population-level heritability in humans, both at the level of the high-order Super-K Factor and the lower-order factors, the K-Factor, Covitality Factor, and General Factor of Personality (GFP). Several important questions remain unexplored. We developed measures of genome-level (...) heritabilities employing an American sample of 316 monozygotic (MZ) and 274 dizygotic (DZ) twin dyads and a Swedish sample of 863 MZ and 475 DZ twin dyads. This novel heritability index measures individual genetic transmissibility, therefore opening new avenues for analyzing complex interactions among heritable traits inaccessible to standard structural equations methods. For these samples: (1) moderate to high heritability of factor loadings of Super-K on its lower-order factors is demonstrated, evidencing biological preparedness, genetic accommodation, and the gene-culture coevolution of biased epigenetic rules of development; (2) moderate to high heritability of the magnitudes of the effect of the higher-order factors upon their loadings on their constituent factors, evidencing genetic constraints upon phenotypic plasticity; and (3) that heritability of the LH factors, of factor loadings, and of the magnitudes of the correlations among factors are weaker among those with slower LH speeds, demonstrating that inter-individual variation in transmissibility is a function of individual socioecological selection pressures. Abstract“Force dynamics” refers to a previously neglected semantic category—how entities interact with respect to force. This category includes such concepts as: the exertion of force, resistance to such exertion and the overcoming of such resistance, blockage of a force and the removal of such blockage, and so forth. Force dynamics is a generalization over the traditional linguistic notion of “causative”: it analyzes “causing” into finer primitives and sets it naturally within a framework that also includes “letting,”“hindering,”“helping,” and still further (...) notions. Force dynamics, moreover, appears to be the semantic category that uniquely characterizes the grammatical category of modals, in both their basic and epistemic usages. In addition, on the basis of force dynamic parameters, numerous lexical items fall into systematic semantic patterns, and there exhibit parallelisms between physical and psychosocial reference. Further, from research on the relation of semantic structure to general cognitive structure, it appears that the concepts of force interaction that are encoded within language closely parallel concepts that appear both in early science and in naive physics and psychology. Overall, force dynamics thus emerges as a fundamental notional system that structures conceptual material pertaining to force interaction in a common way across a linguistic range: the physical, psychological, social, inferential, discourse, and mental-model domains of reference and conception. Every physical theory has two different forms of mathematical equations to represent its target systems: the dynamical and the kinematical. Kinematical constraints are differentiated from equations of motion by the fact that their particular form is fixed once and for all, irrespective of the interactions the system enters into. By contrast, the particular form of a system's equations of motion depends essentially on the particular interaction the system enters into. All contemporary accounts of the structure and semantics of physical theory (...) treat dynamics, i.e., the equations of motion, as the most important feature of a theory for the purposes of its philosophical analysis. I argue to the contrary that it is the kinematical constraints that determine the structure and empirical content of a physical theory in the most important ways: they function as necessary preconditions for the appropriate application of the theory; they differentiate types of physical systems; they are necessary for the equations of motion to be well posed or even just cogent; and they guide the experimentalist in the design of tools for measurement and observation. It is thus satisfaction of the kinematical constraints that renders meaning to those terms representing a system's physical quantities in the first place, even before one can ask whether or not the system satisfies the theory's equations of motion. Millikan's proposal of a common structure of substance concepts does not explain certain conspicuous findings in the psychological literature such as typicality effects, the context sensitivity of these effects, and slips of the tongue. Moreover, it is unclear how antidescriptionism could be relevant to psychological theorizing. Finally, it does not seem to be true that concepts of individuals, stuff, and real kinds have a common structure in older children and in adults.

This is the revised version of an invited keynote lecture delivered at the "1st Australian Computing and Philosophy Conference". The paper is divided into two parts. The first part defends an informational approach to structural realism. It does so in three steps. First, it is shown that, within the debate about structural realism, epistemic and ontic structural realism are reconcilable. It follows that a version of OSR is defensible from a structuralist-friendly position. Second, it is argued that a version of (...) OSR is also plausible, because not all relata are logically prior to relations. Third, it is shown that a version of OSR is also applicable to both sub-observable and observable entities, by developing its ontology of structural objects in terms of informational objects. The outcome is informational structural realism, a version of OSR supporting the ontological commitment to a view of the world as the totality of informational objects dynamically interacting with each other. The paper has been discussed by several colleagues and, in the second half, ten objections that have been moved to the proposal are answered in order to clarify it further. (shrink)

“Force dynamics” refers to a previously neglected semantic category—how entities interact with respect to force. This category includes such concepts as: the exertion of force, resistance to such exertion and the overcoming of such resistance, blockage of a force and the removal of such blockage, and so forth. Force dynamics is a generalization over the traditional linguistic notion of “causative”: it analyzes “causing” into finer primitives and sets it naturally within a framework that also includes “letting,”“hindering,”“helping,” and still further (...) notions. Force dynamics, moreover, appears to be the semantic category that uniquely characterizes the grammatical category of modals, in both their basic and epistemic usages. In addition, on the basis of force dynamic parameters, numerous lexical items fall into systematic semantic patterns, and there exhibit parallelisms between physical and psychosocial reference. Further, from research on the relation of semantic structure to general cognitive structure, it appears that the concepts of force interaction that are encoded within language closely parallel concepts that appear both in early science and in naive physics and psychology. Overall, force dynamics thus emerges as a fundamental notional system that structures conceptual material pertaining to force interaction in a common way across a linguistic range: the physical, psychological, social, inferential, discourse, and mental‐model domains of reference and conception. Locke’s conception of substance in general or substratum has two relatively widespread interpretations. According to one, substance in general is the bearer of properties, a pure subject, something which sustains properties but itself has no properties. I will call this interpretation traditional, because it has already been formulated by Leibniz. According to the other interpretation, substance is general is something like real essence: an underlying structure which is responsible for the fact that certain observable properties form stable, recurrent clusters. I (...) will argue that both interpretation are partly right, and what is good in them can be reconciled. The traditional interpretation captures the purpose and signficanc of the idea of substance in general, i.e. the reason why Locke says we have this idea. The real essence view is right about the real world counterpart of the idea, i.e. what sort of entity the idea corresponds to. The paper starts with a review of the strengths and weaknesses of the rival interpretations (I, II). Then I examine which part of the traditional interpretation can be sustained in light of the problems it faces (III). Thereafter I will show that the part of the traditional interpretation which can be sustained cannot stand on its own and needs to be supplemented at one point, and the real essence view can provide what is needed. This, as it were, mixed interpretation will be supported by sketching an argument which is plausible within the context of Locke’s teachings and which explains how Locke could have arrived from the view which the traditional interpretation correctly attributes to him to the view which the real essence interpretation takes him to espouse (IV). The two problematic points in this argument will be taken up in the following two sections. (V, VI). How is linguistic communication possible? How do we come to share the same meanings of words and utterances? One classical position holds that human beings share a transcendental “platonic” ideality independent of individual cognition and language use (Frege 1948). Another stresses immanent linguistic relations (Saussure 1959), and yet another basic embodied structures as the ground for invariant aspects of meaning (Lakoff and Johnson 1999). Here we propose an alternative account in which the possibility for sharing meaning is motivated by (...) four sources of structural stability: 1) the physical constraints and affordances of our surrounding material environment, 2) biological constraints of our human bodies, 3) social normative constraints of culture and society, and 4) the local history of social interactions. These structures and constraints interact in dynamical ways in actual language usage situations: local dialogical and social dynamics motivate and stabilize the profiling of a conceptual space already highly structured by our shared biology, culture, and environment. We will substantiate this perspective with reference to recent studies in experimental pragmatics and semiotics in which participants interact linguistically to solve cooperative tasks. Three main cases will be considered: The dynamic grounding of linguistic categories, the construction of conceptual models to relate entities in a scene, and the construction of shared conceptual scales for assessing and appraising subjective experiences. Guilherme Messas is a Brazilian psychiatrist, founding member of the Brazilian Society for Phenomeno-Structural Psychopathology and author of many peer-reviewed articles in the field of psychopathology. His book entitled 'The Existential Structure of Substance Misuse' is an important and comprehensive phenomenological analysis of psychoactive substance abuse behaviour, considering a field still partially explored by clinical and psychopathological research. The contents provided by the author in this work are not only of great theoretical relevance, but also of clinical utility in the (...) rehabilitation of these patients. It would be important to deepen the field of phenomenological research in addictions, exploring the contents proposed with the aim of providing tools and knowledge that would be of concrete help in the treatment pathway of substance abuse. Dynamic Structure of Reality makes available in English some of the most mature thought of the modern Spanish philosopher Xavier Zubiri. He first presented this material as a set of 1968 public lectures in Madrid. They were collected, edited, and published in 1989 as Estructura dinámica de la realidad. In 1962 Zubiri had published Sobre la esencia, a work of metaphysics that was praised by critics with one qualification: its treatment of reality was too static. The 1968 course was (...) devised as a response to those critics. Dynamic Structure of Reality retraces the road Hegel traveled concerning the creation of a self and how that self is realized by an interplay between spirit and nature. Like his great predecessor José Ortega y Gasset, and like his great Jewish contemporary Emmanuel Levinas, Zubiri takes religion in all seriousness and locates its questions within the questions of modern philosophy. In harmony with science, he advances a new idea of becoming. Reality, not being, becomes. As reality’s traits are revealed, in different degrees, reality resembles God, the universal self-giver. Zubiri systematically touches on many disciplines to show the varieties of self-giving--throughout the universe--of structural dynamism. (shrink)

Here, I lay the foundations of a high-level ontology of particulars whose structuring principles differ radically from the 'continuant' vs. 'occurrent' distinction traditionally adopted in applied ontology. These principles are derived from a new analysis of the ontology of “occurring” or “happening” entities. Firstly, my analysis integrates recent work on the ontology of processes, which brings them closer to objects in their mode of existence and persistence by assimilating them to continuant particulars. Secondly, my analysis distinguishes clearly between processes (...) and events, in order to make the latter abstract objects of thought (alongside propositions). Lastly, I open my ontological inventory to properties and facts, the existence of which is commonly admitted. By giving specific roles to these primitives, the framework allows one to account for static and dynamic aspects of the physical world and for the way that subjects conceive its history: facts account for the life of substances (physical objects and processes), whereas events enable cognitive subjects to account for the life story of substances. Research on electroencephalogram (EEG) characteristics associated with major depressive disorder (MDD) has accumulated diverse neurophysiologic findings related to the content, topography, neurochemistry, and functions of EEG oscillations. Significant progress has been made since the first landmark EEG study on affective disorders by Davidson 35 years ago. A systematic account of these data is important and necessary for building a consistent neuropsychophysiologic model of MDD and other affective disorders. Given the extensive data on frequency-dependent functional significance of EEG oscillations, a frequency (...) domain approach may reveal the types of brain functions involved and disturbed in MDD. In this review, we systematize and integrate diverse and often unconnected observations on the content, topography, neurochemistry, and functions of EEG oscillations involved in MDD within the general concept of an EEG oscillatory pattern. The asymptotic limit theorems of information and control theories permit exploration of a surprising number of temperature-like measures and symmetry-breaking dynamics associated with cognition. Each of several markedly different perspectives produces a distinct temperature-analog, capturing a rich and highly-punctuated behavioral landscape across the complex, hierarchical cognitive phenomena that characterize life at every scale and level of organization. Theories of cognition may be confronted by canonical conundrums similar to those plaguing the study of consciousness and its regulation. In short, there may (...) be a spectrum of interacting cognitive ‘temperatures’ for organisms, social structures, institutions, information processing machines, and their composite entities, that varies across different systems, and between similar systems having undergone different individual developmental trajectories. The book aims to examine how a Trinitarian Theism can be formulated through the elaboration of a Relational Ontology and a Trinitarian Metaphysics, in the context of a hyperphatic epistemology. This metaphysics has been proposed by some supporters of the so-called Open Theism as a solution to the numerous dilemmas of Classical Theism. The hypothesis they support is that the Trinitarian nature of God, reflected in a world of multiplicity, relationality, substance and relations, demands that we think of God as (...) dynamic, internally multiple and relational. However, if the expression «God is love» – understood as the formula of the Trinity – is the key to a new theism, it leaves a problem open: how can it be translated philosophically? The research develops on two different levels: first, it assesses whether the expression should be translated into the Trinitarian paradigm, and the aporias it generates; secondly, it tries to assess whether this paradigm (eminently relational) has a correspondence in ontology: is there a satisfactory Relational Metaphysics already available? The suspicion is that such Trinitarian-Relational Ontology, invoked by many as a solution to the incongruities of classical theism, has yet to be formulated in a satisfactorily manner, despite the existence of various attempts to formulate Relational Ontologies. In order to provide an evaluation of all these attempts and to outline some possible new perspectives, the thesis consists of five chapters. It is the aim of the present dissertation to evaluate such attempts, and to outline some possible new solutions. In the chapters some points have been established: 1. there must be at least one irreducible real relation (non-reductionist realism); 2. the relation must be equally fundamental to the substance: this means that it is both external and internal; 3. this relation must be able to account for contingent causality; 4. holism is a plausible position; 5. the Trinity is a good theistic model of the divine, apophatic but rational. The last chapter then returns to ontological questions: several Relational Ontologies are examined – including ontic structural realism and process (or eventist) ontology – together with their applications in philosophy of religion (e.g.: the Relational God, Process Trinitarianism, the Entangled God). This assessment shows how all these ontologies postulate real transcendental relations (subsistent relations), inside the substances or inside the powers, inside the tropes or the structures, describing them as monads or processes (or actual occasions). These relations are the same we need to describe the Trinity. Therefore, they are either possible for both domains – ontology and theology – or they are both impossible. It has been opted for the second conclusion. But they are both impossible and inevitable: the fundamental entities of the world and their interactions (causation) must be described as real transcendental relations because each ontology transforms entities or relations into real transcendental relationships at some point. Thus, neither relationalism nor substantialism are convincing: from the fall of these two dogmas (or, rather, from the fall of their naive interpretations) we can realise that the fundamental reality is something that lies between processism (relationalism) and substantialism. It is impossible to completely substitute the notion of substance with the notion of event, process, structure or relation, both in speaking of God and in speaking about the entities of fundamental ontology. Neither monism nor pluralism can be affirmed in their pure forms. The hypothesis proposed, then, is that the notion of gunk-junk is the only one that can translate the relationality hitherto sought in an ontological model. The central part of the chapter describes the merits and defects of an eventist-infinitive ontology (EIO) based on the concept of gunk, and its potentiality to generate new theistic accounts. Through the notion of infinityings it seems to be possible to find some solutions for the questions left open by the causal relation, and therefore to defend at least the existence of one relation (external and internal). Each fundamental entity is described, in this ontology, through four transcendentals: ‘entity’, ‘relation’, ‘unity’ and ‘multiplicity’. The co-primarity between substance and relations (borrowed from the notion of relatio subsistens) differentiates EIO from the process philosophies precisely because it does not pretend to eliminate the substantial principle, or the category of substance, but wants to think of it with the transcendental of relationality. Of course, EIO poses a challenge to the role, the method and the explicative capacity of metaphysics, because what we can state of the fundamental reality is antinomic. EIO tries to assume the antinomy as a result, to make it the basis of a kind of apophatic ontology. If our best ontology is gunky, then it is possible to confirm what has been said in chap. 4: the ‘how’ of individual substances is unknown to us at least as much as the ‘how’ of God. Even in the world we have the mystery of a distinction that is not division. However, the convergence of these antinomies can find an ultimate explanation in a theistic metaphysics (EIM): God creates inside of Himself and his Trinitarian substance is “contracted” into the worldly entities. They are made contingent and ontologically different by this self-limitation, but it is still the infinity of God that makes space in Himself for something new, even though He is totally present in every entity. It is not absurd to think that the substances of the world keep track of the divine nature, even in His “contraction”. Among the characteristics of the divine nature that each created entity maintains we have the subsistent relationality, the pericoretic indwelling (the infinite gunk-junk), the fact of being always one-and-many. If EIO and EIM are accepted as a good compromise between relationalism and substantialism, even in their apophaticity, then, on this basis, a Trinitarian Philosophy is possible. The picture of reality that emerges represents the world as multiple, substantial, contingent and intrinsically relational, forcing us to postulate the transcendental of relationality and multiplicity. Such transcendental leads us to think of the world and God (and their relations) in a Trinitarian way – With the necessary acknowledgement that this is a reasonable but apophatic discourse. (shrink)

Avicenna’s theory of compounds had virtually no effect on scholastic philosophy. It is always mentioned, indeed, but only to be rejected. At most, one finds that certain thinkers take up this or that particular thought of his; or that, regarding the issue of compounds, the fundamental Averroistic or Thomistic position exhibits a certain Avicennistic tinge. This is particularly the case when it comes to Albertus Magnus, who wants to follow the thoroughly Aristotelian-Averroistic conception, while being convinced that the doctrines of (...) Averroes and Avicenna are fundamentally the same. His judgment agrees above all with that of Averroes. Since one and the same matter cannot receive many substantial forms, one cannot say that the elements in the compound are contained such that the substantial forms are wholly preserved. On the other hand, however, since the properties of the elements are found in the compound body, neither can one say that their substantial forms are in no way preserved. “And for that reason Aristotle said that the intensities of those substantial forms are reduced, and thus that in part they are preserved and in part they are changed: and so all arrive at an intermediate.”. The connection between quantum mechanics and classical statistical mechanics has motivated in the past the representation of the Schrödinger quantum-wave equation in terms of “projections” onto the quantum configuration space of suitable phase-space asymptotic kinetic models. This feature has suggested the search of a possible exact super-dimensional classical dynamical system, denoted as Schrödinger CDS, which uniquely determines the time-evolution of the underlying quantum state describing a set of N like and mutually interacting quantum particles. In this paper the realization of (...) the same CDS in terms of a coupled set of Hamiltonian systems is established. These are respectively associated with a quantum-hydrodynamic CDS advancing in time the quantum fluid velocity and a further one the RD-CDS, describing the relative dynamics with respect to the quantum fluid. Particularly persuasive is his claim that observed patterns of comorbidity are, in important respects, consequences of the structure of the classification system. I am not convinced, however, (...) that comorbidity is best conceptualized as an artifact of the taxonic structure of the Diagnostic and Statistical Manual of Mental Disorders (DSM) and the International Classification of Diseases (ICD). Instead, I suggest that the use of dichotomies such as true versus artifactual should be used with caution when psychiatric classification is being discussed.In contrast with the artifact hypothesis, I argue that the phenomena covered by the term "comorbidity" are real, expectable features of the psychiatric domain. They are not the phlogiston and luminiferous ether of psychiatry. I am skeptical of the notion that high comorbidity rates as a whole can be understood as Kuhnian anomalies, or that there is a crisis, or that after a period of revolutionary science a new paradigm would eliminate these 'anomalies.' In short, high rates of comorbidity in psychiatry will not simply disappear once scientists develop a better nosological paradigm. High levels of comorbidity can, however, be both lowered and provided a better, evidence-based conceptual framework.Many Conditions, One OrganIn general medicine, comorbidity conventionally refers to the simultaneous occurrence of two independent disease processes or distinct clinical entities, such as heart disease and liver cancer (Feinstein, 1970; Jablensky 2004). The presence of one disease is supposed to affect the other in such a way that the co-occurrence of the two has implications for prognosis and treatment.Comorbidity in psychiatry is a broader concept, referring to a variety of conditions that overlap in multiple ways. The different kinds of overlap are amenable to detailed empirical analysis (e. g., Klein and Riso 1993; Neale and Kendler 1995). Unfortunately, forcing psychiatric nosology to conform to an etiological paradigm is unlikely to resolve the problem of psychiatric comorbidity. As noted, the problem is one of distinguishing between the different etiological disease processes that are affecting tightly integrated systems in the brain. The brain as a whole is a multilevel, dynamic, and open system, which has an ecology (Zachar 2000). Research on multinational inter-organizational relationships has demonstrated that the capabilities of small and medium sized enterprises can be developed via partnerships, but at present, we lack studies that relate the development of such capabilities to the management of business governance structure. This study provides a new perspective on internationalized SME marketing strategies in the global context. Using a dynamic capability view of firms, the study develops hierarchical regression models linking global dynamic capabilities and governance structure. This study empirically (...) verifies the research framework from 206 internationalized SME Taiwanese firms. The results confirm previous studies that indicate positive correlations between market orientation, learning orientation, and global dynamic capabilities. The results also indicate that the development of global dynamic capabilities impacts the choice of governance structure in firms. Our study suggests that internationalized SMEs strategically manage their autonomy and strategic options by choosing combinations of different relationship types while they decide to develop global marketing capabilities and global design capability, or both. The study also found that market orientation and learning orientation act as enabling mechanisms for building global dynamic capabilities. (shrink)

It is now clear that two prominent nuclear domains, interchromatin granule clusters (IGCs) and Cajal bodies (CBs), contribute to the highly ordered organization of the extrachromosomal space of the cell nucleus. These functional domains represent structurally stable but highly dynamic nuclear organelles enriched in factors that are required for different nuclear activities, especially RNA biogenesis. IGCs are considered to be the main sites for storage, assembly, and/or recycling of the essential spliceosome components. CBs are involved in the biogenesis of (...) several classes of small RNPs as well as the modification of newly assembled small nuclear RNA. We have summarized data on the molecular composition, structure, and functional roles of IGCs and CBs in the nuclei of mammalian somatic cells and oocytes of some animals with a special focus on insects. We have focused on similarities and differences between the IGCs and CBs of oocytes and the well‐studied CBs and IGCs of cultured mammalian somatic cells. We have shown the heterogeneous character of oocyte IGCs and CBs, both in structure and molecular content. We have also demonstrated the unique capacity of oocytes to form close structural interactions between IGC and CB components. We proposed to consider these joint structures as integrated entities, sharing the features of both IGCs and CBs. (shrink)
