Police killings of unarmed Black people have ignited a national and international response unlike any in decades. But differing from their civil rights-oriented predecessors, today’s activists do not think that the institutions and values of liberal democracy can eradicate structural racism. They draw instead on a Black radical tradition that, Terrence L. Johnson argues, derives its force from its unacknowledged ethical and religious dimensions. We Testify with Our Lives traces Black religion’s sustained influence from SNCC to the present, reconstructing (...) a radical lived ethics of freedom and justice. Johnson demonstrates that Black Power fundamentally contests liberalism’s abstract understanding of democracy, calling instead for new embodied frameworks to achieve human flourishing and dignity. Dr. Martin Luther King Jr.’s theology and rights-based activism remain highly relevant in a constitutional democracy. However, King’s use of human dignity in his early sermons as an extension of political rights faces serious challenges from Black leftist political writers and the Black Lives Matter movement. At issue is the extent to which human dignity should be examined as a distinct political, aesthetic, and moral category that must be explored and embraced more explicitly and wholeheartedly in Black politics and political (...) theory. Bracketing human dignity inside the category of political rights, which King often did in his early writings, undermines the comprehensive nature of antiblack racism and limits the scope and range of questions and resources we might employ to address the social ontology of Blackness. A sustained attention to human dignity provides an opportunity for new scholarly direction in the study of Black politics and political thought by expanding the boundaries of the political and creating space for morality and Black religion in the political (leftist) imaginary. Hasian, Condit, and Lucaites argue that there is "a need for investigating and implementing procedures that would democratize the legal system"i and that the boundaries of the law provide a fruitful site for such investigation. I would argue that one particularly relevant site to recover such procedures is American Indian law. American Indian treaties, although more so in terms of their negotiation rather than their final form, are hybrid documents, combining elements from both indigenous and Western law. Because treaties exist (...) at the boundaries between two systems of law, they are positioned not only to illuminate differences in practice but also to shed light on the balance of power between Indian nations and the U.S. government. Evidence of law's boundaries can be found, for example, in the adherence to, or abandonment of, indigenous practices of law over time. The journals of the proceedings in particular, which recorded the negotiation of the treaties, also documented cultural understandings of power, leadership, human relations, and attitudes toward the land. So if ever there were an opportunity to investigate and implement procedures leading to a more democratized legal system, this would be one. ;Traditional American Indian communication practices were not, and still are not, empty rituals or colorful customs of an exotic culture performed for the entertainment of outsiders. Neither are American Indian law practices the quaint customs of a long-gone past but living traditions still practiced today. I document this continuity in practice by investigating two sites: first, the historical journal of the proceedings from the 1825 Treaty of Prairie du Chien, and then in the contemporary rhetoric of their descendents, Anishinaabe environmental activists. When considering the interactions between rhetoric and argumentation, readers of this journal will no doubt be reminded of the seminal work of Henry W. Johnstone Jr. (1959; 1978) who gathered both concerns together in ways that were designed to engage philosophers and persuade them of the intellectual seriousness of both enterprises. He was, of course, a principal force among those who brought Chaïm Perelman’s work to the attention of audiences in North America, and he himself entered into deep and fruitful (...) dialogues with Perelman by way of reviewing the value that rhetoric brought to argumentation and logic, as well as to philosophy generally. This article describes the racial integration of Emory University and the subsequent creation of Pre-Start, an affirmative action program at Emory Law School from 1966 to 1972. It focuses on the initiative of the Dean of Emory Law School at the time, Ben F. Johnson, Jr.. Johnson played a number of leadership roles throughout his life, including successfully arguing a case before the United States Supreme Court while he was an Assistant Attorney General of Georgia, promoting legislation to (...) create Atlanta 's subway system as a state senator, and representing Emory in its lawsuit to strike down the state statute that would have rescinded its tax exemption if it admitted African American students ). This account supplements my related article on Pre-Start, "'A Bulwark against Anarchy': Affirmative Action, Emory Law School, and Southern Self-Help", providing more information about historical context generally, and particularly about Emory v. Nash. Johnson was ambitious for Emory as a whole, and particularly for the Law School, and he saw in segregation the single largest impediment to making Emory a nationally prominent research university. The story of Emory's integration, and Johnson's leadership, requires revision of the prevailing story of integration generally, and especially of universities. Integration at Emory came about because of the pressure that African Americans and their supporters created through the civil rights movement, but Emory administrators responded to such pressure more constructively than most. Their actions provide an interesting case study in effective leadership during a period of significant moral and political conflict. (shrink)

Knowledge of mechanisms is critical for causal reasoning. We contrasted two possible organizations of causal knowledge—an interconnected causal network, where events are causally connected without any boundaries delineating discrete mechanisms; or a set of disparate mechanisms—causal islands—such that events in different mechanisms are not thought to be related even when they belong to the same causal chain. To distinguish these possibilities, we tested whether people make transitive judgments about causal chains by inferring, given A causes B and B causes C, (...) that A causes C. Specifically, causal chains schematized as one chunk or mechanism in semantic memory led to transitive causal judgments. On the other hand, chains schematized as multiple chunks led to intransitive judgments despite strong intermediate links. Normative accounts of causal intransitivity could not explain these intransitive judgments. (shrink)

You might think a simple “No” would suffice as an answer. But there are features of Kant’s ethics that appear to be strikingly similar to virtue oriented views, so striking that some Kantians themselves have argued that Kant’s ethics in fact shares these features with virtue ethics. In what follows, I will argue against this view, though along the way I will acknowledge the features of Kant’s view that make it appear more like a kind of virtue ethics than it (...) really is. My plan is to first set out the distinctive features of what is nowadays called “virtue ethics”, those features that make it a genuine alternative to other normative theories. I then consider the features Kant’s view might share in common with virtue ethics and the case for saying that it is, therefore, fundamentally the same sort of theory. I follow these two sections with an argument against this position. I want to warn you at the outset, however, that my argument itself will be quite unsurprising, since it is an argument that has been central to the way in which most philosophers have understood Kant’s ethics. Any novelty I can claim here is in my account of what makes virtue ethics a genuine alternative to other normative theories, and my defense of this argument against those, in particular Barbara Herman, who have apparently found the argument unpersuasive. Two problems are considered here. One relates to who has moral status, and the other relates to who has moral responsibility. The criteria for mattering morally have long been disputed, and many humans and nonhuman animals have been considered “marginal cases,” on the contested edges of moral considerability and concern. The marginalization of humans and other species is frequently the pretext for denying their rights, including the rights to health care, to reproductive freedom, and to bodily autonomy. There is broad (...) agreement across cultural and philosophical traditions about the capacities and responsibilities of moral agents. I propose an inclusive and expansive way of thinking about moral status, situating it not in the characteristics or capacities of individuals, but in the responsibilities and obligations of moral agents. Moral agents, under this view, are not privileged or entitled to special treatment but rather have responsibilities. I approach this by considering some African communitarian conceptions of moral status and moral agency. I propose that moral agency can also be more expansive and include not just individual moral agents but collective entities that have some of the traits of moral agents: power, freedom, and the capacity to recognize and act on the demands of morality and acknowledge and respect the rights of others. Expanding who and what is a moral agent correspondingly extends moral responsibility for respecting rights and fostering the conditions for the health and well-being of humans and animals onto the collective entities who uniquely have the capacity to attend to global-scale health threats such as pandemics and human-caused climate change. La segunda perspectiva filosófica es la materialista, que entiende el movimiento humano como una manifestación de la motricidad, la cual sería inmanente a la esencia del ser humano. Es decir, estaría dotada de intencionalidad. La tercera corriente sería una mirada ecléctica de las dos anteriores, asemejando el concepto de movimiento humano con el de las contemporáneas interpretaciones de motricidad. En otras palabras, el movimiento humano sería parte de la potencia y el acto. Cambridge: The MIT Press, 2002, xxv, 472 pp., $39.95. ISBN 0-262-11258-2 Sybil Kantor's history of the intellectual origins of (...) the Museum of Modern Art (MoMA) is an engaging account of Alfred Barr, Jr.'s, pivotal role in acquainting an American audience with the modernist movement in art that had developed in Europe and the Soviet Union in the first part of the twentieth century. Scrupulously documented, Kantor's narrative relies heavily on interviews with Barr's contemporaries, his publications, and his extensive correspondence. She also limns portraits of major figures who either influenced his ideas or were instrumental in establishing MoMA. Although the book is very informative about modern art, according to its author it is not intended to be strictly a history of that art. Rather, it is devoted to Barr's early development, his personal characteristics, his attitude toward the cultural and political climate of the times, his definitions of modernism and formalism, and finally, his legacy.Kantor traces Barr's career through the decade of the 1920s, which culminated in his being named the first director of MoMA in 1929; the expansive years of the 1930s and 1940s when, as Kantor puts it, Barr and the museum were at full throttle; and the later years when Barr was relieved of his director's responsibilities to allow him to spend more time on writing and the mounting of exhibitions. He retired from the museum in 1967, began to show signs of ill health in the mid-1970s, and died at the age of 79 in 1981. The Early Years Barr began his studies in the history of art at Princeton where he took courses with Frank Jewett Mather, who taught about modern art, and with Charles Rufus Morey, a distinguished medievalist whose teaching ranged beyond the architecture and sculpture of the Middle Ages to the other arts of that era. Morey's example of comprehensiveness would later stimulate Barr to think along similar lines about modern art and the organization of MoMA. At Harvard's graduate school Barr learned the skills of connoisseurship and museum management from Paul Sachs whose students went on to become directors of major museums across America. This book provides a systematic exploration of the relation between knowledge and factual awareness, arguing that knowledge is but one species of factual awareness and that we can understand the possession of objective reasons, the normativity of knowledge, and the nature of knowledge in terms of factual awareness. In this way, the state of factual awareness is, structurally and substantively, a more basic type of state than (...) knowledge. If correct, this undermines a number of ways in which knowledge has been regarded as ‘first’ in recent epistemology. (shrink)

Provided we agree about the thing, it is needless to dispute about the terms. —David Hume, A treatise of human nature, Book 1, section VIIMap-like representations are frequently invoked as an alternative type of representational vehicle to a language of thought. This view presupposes that map-systems and languages form legitimate natural kinds of cognitive representational systems. I argue that they do not, because the collections of features that might be taken as characteristic of maps or languages do not themselves provide (...) scientifically useful information above and beyond what the individual features provide. To bring this out, I sketch several allegedly distinctive features of maps, and show how they can easily be grafted onto a simple logical language, resulting in a hybrid “manguage.” The ease with which these linguistic and map-like properties can be integrated into a single representational system raises the question of what work broader categories like language and map are doing. I maintain that, as an empirical matter of fact, they serve no particular purpose in cognitive science, and thus do not characterize distinct kinds of cognitive architectures. (shrink)

A new translation and edition of Aristotle's Protrepticus (with critical comments on the fragments) -/- Welcome -/- The Protrepticus was an early work of Aristotle, written while he was still a member of Plato's Academy, but it soon became one of the most famous works in the whole history of philosophy. Unfortunately it was not directly copied in the middle ages and so did not survive in its own manuscript tradition. But substantial fragments of it have been preserved in several (...) works by Iamblichus of Chalcis, a third century A.D. neo-Pythagorean philosopher and educator. On the basis of a close study of Iamblichus' extensive use and excerption of Aristotle's Protrepticus, it is possible to reconstruct the backbone of the lost work, and then to flesh it out with the other surviving reports about the work from antiquity (for example in Alexander of Aphrodisias and other ancient commentators on Aristotle). It is also possible to identify several papyrus fragments of the work, and many references and literary allusions in later authors, especially Cicero, whose own lost dialogue Hortensius was a defense of philosophy modeleld on Aristotle's. In lieu of an abstract, here is a brief excerpt of the content: I would like to begin by thanking the Journal of Japanese Philosophy for making space in these pages for a review of my monograph Watsuji on Nature: Japanese Philosophy in the Wake of Heidegger. Although book reviews do not usually receive a reply from the author—much less one as lengthy as the article that follows—one seemed necessary in this instance because my ideas, unfortunately, have been seriously mis-represented (...) here. Moreover, the number and kinds of misreadings, mistakes, misunderstandings, and omissions are so extensive that even a brief attempt to address the main points at issue is no small task. But the primary problem is that the reviewer contends that I say the opposite of what I actually maintain with regard to some of the central claims of the book. These mistaken assertions are primarily the consequence of a failure to understand crucial philosophical concepts (especially metaphysical nondualism, being-in-the-world, intentionality, and disclosure). But they also stem from a series of errors ranging from the exclusion of some of the fundamental ideas and arguments of the book to the misreading of pivotal claims and the mistranslation of the Japanese-language primary sources.I begin with a single but telling example that is characteristic of the way the reviewer repeatedly portrays me as saying the opposite of what I actually say. Droz states that “For Johnson, while human beings taken collectively as a whole have the capacity to transcend the fūdo, individual human beings apparently do not” (Droz, 133). But what I actually say is that Watsuji “has not shown that this same capacity belongs to the individual human being” (Johnson, 191). I then give a series of examples of individual transcendence: “the forms of transcendence that are evident in, for example, the complex identities of immigrants, of those who have lived in multiple countries, of those who live in multiple milieus at the same time [...] of those who develop a very different character from their compatriots even as they live together in the same place” (Johnson, 191). [End Page 167] I go on to point out that “we also need a subtler account, on a much smaller scale, of the ways the self is both constituted by and is also able to transcend its fūdo. In what follows we will give an indication of some of the issues involved” (Johnson, 191). I then proceed to give such an overview, concluding with the point that “the strong identification with one aspect of one’s milieu rather than another shows that the self is much more than the simple expression of its fūdo. This form of transcendence, I suggest, can be studied with profit as an instance of what Watsuji calls the individual dimension of human beings” (Johnson, 192).Misrepresentations of this sort abound. The most serious instance of this kind concerns one of the central theses of this study. At the beginning of her review, the author purports to recount two criteria that I propose “to clarify what the philosophical concept of fūdo entails” (Droz, 129). But in fact, I list four criteria under two distinct categories. First, in order to determine the scope and boundaries of a fūdo, I propose the following two criteria:1. certain regions as articulated wholes found in nature itself, which is what Watsuji attempts to articulate with his taxonomy of basic types of fūdo (Johnson, 34).2. a relational whole of disclosure, self-interpretation, and natural locale (Johnson, 34).But the reviewer takes note of (1) and passes over (2) in silence—this omission is significant and, as we will see shortly, it leads her into later difficulties. Droz instead moves directly to a second topic, namely, what I intend by the term nature, which is a concept found in both of these criteria. Here I follow Mill in thinking that we need some way to distinguish between nature and nonnature if nature is not simply to be equated with everything. I therefore propose two criteria that we might use to distinguish nature from artifice within a fūdo: A. nature as all-encompassing space and place B. the sheerly given self-unfolding of things . It is standard to attribute to Kant the view that actions from motives other than duty deserve no positive moral evaluation. I argue that the standard view is mistaken. Kant's account of merit in the Metaphysics of Morals shows that he believes actions not performed from duty can be meritorious. Moreover, the grounds for attributing merit to an action are different from those for attributing moral worth to it. This is significant because it shows both that his views are reasonably (...) consistent with our ordinary views, and that he recognized a variety of purposes in evaluating actions, many of which are not furthered by determining whether they were motivated by duty. The faith in progress that propelled the West for over four centuries is in decline due to its own success. The emergence of capitalism with its novel market imperatives has created both the poverty that causes political crises and the material growth that has destabilized the Earth’s climate. There is a growing sense that we are dominated by the technologies and social organizations that we hoped would liberate us. Individualism and secularity have left people feeling isolated and without a sense (...) of higher purpose, leading some to reject Enlightenment values in favor of traditionalisms and even neofascism. In universities, faculty struggle to prove their utility and relevance, because they cannot guarantee their graduates a decent living in a world of automation and globalized production. As a result of these trends, the West’s ability to produce responsible citizens is in question. Our students are largely inured to appeals to transcendent values because they are urged to be “practical.” Faculty are no longer encouraged to care about the character-building nature of a liberal education. United States universities are in danger of not having an independent voice, as those departments that can consistently get major external funding seek commercial applications for the products of their research. In the United States, ideologically based harassment and censorship of unpopular ideas takes place regularly and is a major deterrent to pursuing a career in higher education. Given these challenges, can intellectuals still make a difference in universities? Many have taken to social media and other ways of getting their ideas around the increasingly steep paywalls of academic publications and the de facto censorship in their institutions. Some of the most vibrant exchanges of ideas are now happening in other places, largely online. These venues draw in people who are trying their best to learn something they are unlikely to learn at universities. But are such alternatives truly sustainable or good enough? Higher education is at a crossroads in which even this “retreat and regroup” strategy is highly problematic. (shrink)

This paper argues that if motivation by rightness de re is praiseworthy, then so is motivation by rightness de dicto. I argue that these two types of moral motivation have been unfairly compared, in light of a widespread failure to appreciate the structural similarities between them. These structural similarities become clear when we think more carefully about the nature of motivation and about moral metaphysics. I then argue that the two types of moral motivation are on a par by discussing (...) a series of minimal pairs. I argue that in good cases, in which the agent succeeds in doing what she is motivated to do, both motivations seem praiseworthy, and that bad cases, in which the agent fails, arise for motivation by rightness de re in precisely the same way as they do for motivation by rightness de dicto. I then offer a way to evaluate the unsuccessful agents, according to which someone's motivations can still be praiseworthy even if her actions and moral beliefs are both blameworthy, and someone can have certain praiseworthy motivations while lacking others. On my view, most of us are deeply flawed agents who nonetheless have some redeeming features—including our moral motivations. (shrink)

The metaphor of a border has also been employed to demonstrate this transformation, which may be liberating, oppressive, or some complex combination thereof (Weir 2006; Martinez 2004). What (...) happens, in psychic and sociopolitical terms, in the journey across this border? Can a woman, as an independent, autonomous being, preserve her identity, her selfhood as a mother? Is the transition to motherhood an expression of culture or nature? The answers to these questions are infinitely complex, yet are at the core of philosophical, political, and personal explorations of the maternal. Central to these explorations are academic critiques and personal responses to the biomedical mediation of the transition to motherhood. For some women, medical intervention in pregnancy and childbirth is inherently oppressive, whereas for other women such intervention is a marker of privilege. In a groundbreaking volume published in 1998, Margaret Lock and Patricia Kaufert argue that women respond to different biomedical interventions in pragmatic ways, which reflect their lived experiences. They claim that “it is more appropriate to understand women’s responses in medical settings as reflecting their daily experiences as part of a domestic group, a community, or a society” (19). [End Page 65]I would like to advance this analysis by suggesting that women respond to biomedical intervention in pregnancy and childbirth in ways that reflect not simply their practical needs and realities, but important details about inequality and identity. Women’s relative degrees of power and agency in society are expressed through their preferences for care during pregnancy and childbirth. In addition, and in connection with the (structural) dynamics of inequality, these preferences reflect the complexities of shifting, negotiated, maternal identities. In order to consider the ways in which women negotiate maternal identity through their preferences concerning care during pregnancy and childbirth, I will examine the contributions of Adrienne Rich, which effectively serve as the foundation for this and countless other areas of women’s and gender studies. In Of Woman Born, Rich dedicates two full chapters to childbirth, and explains in these chapters that the institution of childbirth has come to dominate and eclipse women’s experiences. Moreover, the patriarchal circumscription of childbirth is reinforced by the isolation of childbirth (and motherhood) from other life events. Rich demonstrates these problems through the metaphor of “giving birth to oneself ” (29), which has (at least) two distinct meanings: self actualization and self replacement.My investigation into these meanings will include an examination of Rich’s philosophical treatment of pregnancy and childbirth and an assessment of the sociopolitical implications of both conceptions of “giving birth to oneself.” I will then subject these conceptions to empirical testing, as Rich insists. Such empirical testing is crucial because the social and political dimensions of the institutions of childbirth and motherhood are complex and differ from one context to the next. Rich explains that[t]o hold power over others means that the powerful is permitted a kind of short-cut through the complexity of human personality. He does not have to enter intuitively into the souls of the powerless, or to hear what they are saying in their many languages, including the language of silence. Colonialism exists by virtue of this short-cut—how else could so few live among so many and understand so little?(65)This essay will avoid a similar shortcut often taken by theorists, which builds philosophical arguments without empirical support. The empirical cases to be considered in the context of philosophical debate include Canada, Honduras, and Cuba, and details of each case will be drawn from extensive interview data from a larger empirical study.1 In the Canadian context, resistance to the constraining effects of motherhood as institution is reduced to resistance to medical regulation of pregnancy and childbirth. We marvel at the creative dexterity of gifted speakers and writers for their special talents in both thinking about certain ideas in new ways, and communicating these thoughts in vivid, poetic forms. Yet metaphors may not only be special communicative devices, but a fundamental part of everyday cognition in the form of 'conceptual metaphors'. An enormous body of empirical evidence from cognitive linguistics (...) and related disciplines has emerged detailing how conceptual metaphors underlie significant aspects of language, thought, cultural and expressive action. Despite its influence and popularity, there have been major criticisms of conceptual metaphor.
